Welcome Editor’s note. You might have noticed there’s something missing from the pages of Canterbury Build magazine. The people who, five years later, still living in limbo as they seek what they see as fair reparation for their earthquake claims. The large patches of barren wasteland that remains uninhabited within the confines of our central city. The ballooning costs as the city takes what will be its future form and the timeframes which have taken on a somewhat timeless quality, with no end in sight. So where is this content? Well it’s already in the other publications of course. We are in a very unique segment at Canterbury Build magazine. We see our role as one of highlighting new developments and initiatives, featuring research pertaining to earthquake strengthening, showcasing improvements within the region such as public transport and new businesses, reporting repair and rebuild options and outlining some of the latest building products and techniques. These aspects of the rebuild are equally relevant to public interest and are seldom able to be covered by daily news outlets. The fact that everything hasn’t been sorted out doesn’t negate the good things that have occurred and will continue to occur as our city comes back to life. When we comment on positive aspects of the rebuild, we are by no means suggesting ‘everything’ is positive, which we certainly know is not the case. Like you, our local team have lived through the last five years here, raising and supporting families both young and old through these challenges and we are well aware of the ongoing issues and frustrations being experienced by many. The fact that five years on these challenges and frustrations continue doesn’t negate the positive which is also taking place and this is where we see the role of Canterbury Build magazine. It’s about supporting our city with information that meets the needs of its residents and celebrating Christchurch as we move forward. As Helen Keller once wrote, keep your face to the sunshine and you cannot see the shadows.

I
t is great to see the CBD road and underground services repairs are almost caught up. Much fewer roads are now impacted by these earthquake repairs, road cones around CBD building sites are now the more significant intrusion into roadways and these are generally for much shorter times. I am told that by the end of this year, most underground service repairs in the CBD will have been completed. On the building front we are seeing the completion of most new office buildings along Durham Street north of Worcester Street. Richard Peebles' new offices and Warren and Mahoney's building along Montreal Street now anchor this block between Cashel and Cambridge Terrace. Both are great additions to our new CBD. Next door in Cashel Street the huge new five storey Price Waterhouse building runs from the Warren and Mahoney building on Cashel Street all the way to the Bridge of Remembrance. The five storey steel frame is now up and this is progressing at pace. Opposite, Ngāi Tahu have already started work on building two new office buildings where the old Police Station was. This development will include a 600 bay car park which is very much needed for the west side of the Avon River. The Justice Precinct has reached its full height and its form is very evident now. This precinct will be a combination of several building to house Police, Ambulance, The Courts and Fire. Instead of being one huge block of a building, it will appear as several different buildings. This is due for completion in early 2017 and will bring 1,100 staff to this block. It however has to be the retail precinct where five separate big building projects are being built, all at the same time. Nick Hunt's Hereford Street BNZ Square will be the first finished in November 2015. Others will follow in 2016 with the remaining being completed in early 2017. This is only 18 months away and represents the most significant rebuild of our core CBD. Other buildings close by, such as Grand Central on the former Grand Chancelor Motel site and Environment Canterbury over the road from our new Bus Exchange in Tuam Street, are also major new builds in the CBD. The Innovation Precinct with the Vodafone and Kathmandu buildings are really flying out of the ground. What an exciting time we are in watching the rebirth of our CBD.

here has been an outpouring of public concern in recent weeks for the refugee crisis engulfing the world. In keeping with our reputation for compassion and a strong humanitarian spirit, New Zealanders have called on the Government to do more. The number of refugees New Zealand is prepared to accept each year has been static at 750 for the last 27 years. After dragging its feet, the Government finally agreed to a small additional intake of 100 emergency refugees from Syria. While this is a start, it is not our fair share. It was very disappointing that John Key's Government recently blocked the Green Party's proposed law changes which would have increased our refugee quota permanently to 1000 refugees annually. Christchurch was once a hub of the quota refugee resettlement programme. Since the 2011 earthquakes, we have only had 31 refugees as the Government stopped refugee resettlement in Christchurch. While we have missed out on new refugee residents, we have gained in migrants coming to Christchurch to help with the rebuild. Since July 2011, almost 5,500 work visas for the Canterbury rebuild have been issued – with most workers coming from Britain, Ireland, and the Philippines. The diversity we value as a country, and as a city, thrives as more people make Christchurch home both in the short and long term. Recently the Government announced that it would be made easier for migrants coming to Christchurch to get work visas. While this is good news, we need to ensure migrant workers are treated fairly. We have heard too many stories about workers being exploited, being subject to unfair employment conditions and being forced to live in cramped, overcrowded accommodation. The Green Party's proposals for a warrant of fitness for rental accommodation would help avoid this, as would strengthening workers' rights, rather than eroding them as National has done. Christchurch thrives on diversity. It is our job to welcome everyone. We can all help refugees battling to survive on the other side of the world and, when they come to New Zealand, we must ensure we welcome them with open arms.

awyer Duncan Webb has labelled the repairs as “late, inadequate and frequently defective”. It's not only repairs that are broken, Webb argues; the EQC system itself is broken too. Since this call, stories of shoddy repairs, nepotism and threats of blacklisting have continued to emerge and it's painting a pretty grim picture of what's going on behind closed doors. It's become glaringly obvious that the current situation at the Earthquake Commission is no longer sustainable. This is no basis for a recovery and this is why Labour is backing calls for an independent inquiry into what exactly has been occurring in the process of the EQC repair programme. We are doing this because we know it is critical that individuals have confidence in both the integrity of the repairs to their homes and confidence in the integrity of the EQC system. It's important for those Cantabrians who are rebuilding their lives to know that their repairs are being done on time and up to a high standard. After years of waiting and missed deadlines, the people of Canterbury deserve better. Minister Brownlee has to take responsibility for finding a solution to what is occurring at EQC. It's his job to find solutions for the thousands for individuals who are trapped trying to work their way through the maze of EQC. The Minister can't wash his hands of the problem. There's only one shot at rebuilding our city. We have to get it right, and get it right the first time, so Cantabrians can move on with their lives. It's also his job to ensure that we learn from the Canterbury experience. A robust and independent inquiry would identify what went well and what did not. Changes could then be made accordingly to improve the process. We have to make sure we do better whenever and wherever the next major event occurs.

ive years on from the first major earthquake that changed all of our lives, we can take real pride in what we have achieved together. The momentum of the recovery, in both the central city and suburbs, is now undeniable. Even some of the staunchest critics of the recovery effort are now acknowledging all of the building work that is taking place. This level of development is what the Government was focused on when it launched the Christchurch Central Recovery Plan (CCRP) and the Blueprint in 2012. The anchor projects in the CCRP were all about giving confidence to investors and developers, who create jobs and opportunities for people living throughout the city. I recently had the privilege to announce the completion of the first Government-led anchor project, the new central city Bus Interchange. The $53 million facility is modern, stylish and aimed at providing comfort for those who are using buses in the city. If we want more people using public transport, it is facilities like this that can make the difference. Another key to encouraging use of public transport is the ease of travel around the city. The Accessible City transport chapter of the CCRP will mean priority bus lanes to give more certainty over travel times and reduced traffic speeds in the core of the central city so that it is much more welcoming to pedestrians and cyclists. While the building going on is one measure of recovery, most important is how people are feeling. It is encouraging therefore to see the results of the latest of the Canterbury Earthquake Recovery Authority's Wellbeing Surveys. It found that 79 percent of people in greater Christchurch have a positive quality of life, which is remarkable given what we have been through. Clearly there are some people still facing difficulties and as a Government we will continue to back programmes focused on supporting them.

ews that national electricity retailer Meridian is next year returning its Christchurch office to the Awly building in Durham Street is great news for the CBD. Meridian has signed a 10-year lease for 4,100m2 to accommodate its 370 Christchurch staff in the Warren and Mahoney designed building. Several major office developments are scheduled for completion from late this year through to early 2017 with sizes of buildings ranging from 1,500m2 to 5,500m2. Approximately 92,000m2 of office space is currently under construction across 13 major office buildings. The majority of the large corporate tenants and banks have secured space effectively, anchoring the financial services precinct of the CBD core. The second wave of demand is now coming from quality local companies who have been monitoring the progress of the CBD redevelopment with interest while they see out the end of their 5-6 year lease terms. Landlords will need to consider the smaller size of these tenants and the style of offices they intend to occupy. A high level of amenity and facilities, coupled with suitable car parking and access to public transport will be high on the list, together with total occupancy costs It's fair to say that the CBD landlords are mindful that suburban tenants wanting to return to the CBD have usually spent their insurance proceeds on interim accommodation fitouts that would normally be depreciated over a longer period than the five years. But we know a CBD presence is not suitable or necessary for all businesses. Some place a higher value on access to main arterial routes, higher ratios of car parking at a lower cost and overall lower occupancy costs.

ll players in the construction industry who own property that is on someone else’s premises need to protect themselves from insolvency situations which are becoming commonplace. Personal property can include: ! Construction materials, equipment and goods (e.g. steel, appliances) supplied to a site prior to payment being received from the owner/developer ! Tools, electrical or plumbing equipment stored by subcontractors in a site shed ! Vehicles, scaffolding or fencing supplied on hire arrangement to a building site. Having a retention of title clause in your written contract is not by itself effective against third party claims. So how can you protect your personal property? The Personal Property Securities Act 1999 (PPSA) applies to those who: ! Supply goods on credit ! Have goods sold on their behalf by a retailer ! Lease goods or equipment to someone ! Have goods stored in another party’s possession. The Personal Property Securities Register (PPSR) is an online database where security interests over personal property can be registered and searched. For a small fee anyone can search the PPSR, to see if another party claims an interest in a particular asset. Registration of a financing statement on the PPSR is a public record of your security interest. A financing statement contains a description of the items over which security is held and may include details such as serial or registration numbers. As a general rule, a registered security interest backed up by a signed agreement takes priority over unregistered security interests. If there is more than one registered security interest, the party who was first to register normally takes priority. If you do not register your security interest and your debtor (who has your property) becomes insolvent, then other secured creditors (such as banks) will have priority over you in relation to your personal property – even if you own it! A striking example of the consequence of not registering was a case involving a company which leased port-a-loos to a construction company, but failed to register on the PPSR. The construction company’s bank held the only registered security interest. Even though the company only hired (not purchased) the port-a-loos, the owner was not entitled to recover its port-a-loos, which were sold by receivers. A more recent example is the Mainzeal collapse where many unsecured creditors had expensive equipment locked down on construction sites, unable to prove ownership and in some cases losing out to the receivers. Registering on the PPSR doesn’t always guarantee you’ll get what you are owed or your property back, but it does increase your chances. For the best outcome, make sure you have current terms of trade that include the right clauses (and are signed by the debtors) and register a financing statement on the PPSR.
o your building project is failing: your builder may not be performing or the homeowner has stopped paying. It’s time to go your separate ways. Cancelling a contract can be tricky business. If the proper processes are not followed or the circumstances entitling a party to cancel do not exist then the cancelling party exposes itself to a claim for wrongful cancellation. Ironically the party not in default may end up paying the defaulter. Right to cancel The cancelling party generally has two avenues for termination: 1. Termination following the contract provisions (if any); and/or 2. Termination ‘at law’ under the Contractual Remedies Act 1979 (CRA). Many standard form contracts contain a stepped procedure for the termination of a contract. For example, the Registered Master Builders Residential Building Contract (RBC1 – 2015) gives the owner the right to cancel the contract in circumstances where the builder has failed to proceed with the works with ‘reasonable diligence’ and the builder has not remedied that failure within 10 working days of receiving written notice. A party may also cancel the contract under the CRA in the following circumstances: 1. Repudiation: i.e. the other party makes it clear that s/he does not intend to perform their obligations under the contract. 2. Misrepresentation: if a party has been induced to enter into contract by a misrepresentation, they may cancel the contract. 3. Breach: If a term in the contract is broken by the other party, or it is clear that a term in the contract will be broken in the future. A party is not entitled to cancel the contract in the above circumstances if they have subsequently afrmed the contract. M Van Der Wal Builders & Contractors Limited v Hanham The case of M Van Der Wal Builders & Contractors Limited v Hanham illustrates the importance of ensuring there is in fact a right to cancel. Van Der Wal was engaged to carry out renovations at the Hanham’s home. The Council instructed additional works for code compliance. The Hanhams could not afford the works and attempted to cancel the contract. The High Court held that the Hanhams’ cancellation amounted to repudiation of contract, entitling Van Der Wal to damages for loss of prots. However, Van Der Wal was also under an obligation to mitigate his loss by nding alternative work. Conclusion The decision to cancel a contract should not be made lightly. We recommend taking legal advice before attempting to cancel a contract.
