A

t 4.35am on September 4, 2010, the earth came to life as the seismic current of a 7.1 magnitude earthquake rippled beneath our sleeping city. The impact of the resulting 40 seconds of shaking is now part of our collective consciousness and will be with Canterbury forever. This month we mark five years since our region lost its tectonic innocence. A lot can happen in 40 seconds, but even more can happen in five years. Christchurch’s once barren CBD has begun to stir and life is creeping back into this central space as fences come down and developments spring up. Philip Carter’s $140 million precinct The Crossing and the $150 million project The Terrace by Antony Gough are expected to make the city space bigger, bolder and brighter than ever before. Yet it’s the residential developments which are expected to play the next big role in the city’s regeneration. Post-quake approximately 1,200 residential dwellings have been removed from the inner city, half which were apartments or townhouses. With the council’s goal to have 25,000 people living in the city within the next five years, residential developments are springing up, with around 90 apartments completed so far, 180 under construction and approximately 200 proposed to be built in the next two years. As Harvard economist Ed Glaeser said, cities aren’t buildings, they’re people and it’s Christchurch’s human capital which will form the basis for its recovery. It’s just a matter of getting them back there. This issue we look at the impact residential development could have on the CBD and we profile two of the latest central city apartment developments. We’ve also looked at some more of the city’s most striking new residential assets with the announcement of the House of the Year Awards for 2015. We take a sneak peak at the country’s first 10 Star built home right here in Christchurch and we look at panelised building, the expected “game-changer” of the housing market. It’s been five years, but a lot has transpired. I’m not quite sure how to fittingly mark this occasion in words other than to repeat the beautiful Maori expression which became the unofficial slogan for Christchurch after the event – Kia kaha, stay strong.

was taken by Shaun Stockman for a tour of what really is happening in the area that was to be the South Frame recently. This is the area between Tuam and down to South City, east to Barbadoes Street and west to Antigua Street. The blue print had this earmarked for a business park style area with office buildings located in park-like areas and a wide cycle path running east west down the centre of the blocks between Tuam and St Asaph Streets. The car yards were to all move, this area was to be covered by no more than 50 percent buildings, with the balance being open grassy areas. A great vision, but this has slipped the noose and we are seeing solid infill of one, two and three storey buildings throughout this area. I do not see this as bad at all and I think the reality of this turning into a business park area was a bit ambitious. This area is alive with dozens of new buildings, cafés and restaurants in every second or third building, with a real sense of energy here now. The car yards are here to stay and so they should. These companies have spent millions of dollars setting up impressive showrooms that form an important part of our city. What did surprise me was the reduction of car yards along Moorhouse Avenue. Many have gone and left large, open areas of sealed yard with nothing in sight. Not only are we seeing strong infill of new low rise businesses and offices here, but residential is also showing up. There is the brand new Ramada Inn Hotel of Tuam Street between Madras and Barbadoes Streets and a brand new apartment style hotel south of St Asaph Street between Colombo and Manchester Streets. Fletchers have taken over the huge Electrolux site near Smiths City Market and cleared the site. They are about to build over 100 residential units here. Other residential units are appearing in this mixed use area as part of commercial developments. It is this growth of residential in this area of our central city that has got me really excited. Once you get people living in the CBD, the city changes from being a 9-5 city to one that is alive 24 hours a day. We need people to live in our central city and to my surprise, this is the area this residential CBD is growing from. So I feel south of the Hereford Street has found its new form and it will be a fantastic area to stroll around in. It is well worth a stop off for coffee or lunch at any one of the many new offerings here.

ational’s economic strategy has bet the farm on high international dairy prices rather than building a diversified, research and development focussed export sector. The slump in global dairy prices has highlighted the pitfalls of this and the industrial agriculture model. The Government’s strategy of big subsidies for irrigation, including for schemes such as Central Plains Water, has encouraged dairy farmers to chase the peaks in milk supply, regardless of the costs to water quality, biodiversity, and our climate. Farmers have piled on land, debt, cows, supplementary feed like palm kernel, and irrigation to maximise production. This has sharply increased farm costs. It means the dairy industry is much more vulnerable and less resilient to swings in the world commodity prices, and to droughts like the one in North Canterbury. Rural communities are hurting with the current crash in dairy payouts. Yet instead of focusing on adding value, Fonterra continues to push to raise milk supply from 20 billion litres today to 30 billion litres in 2025. We need a productive and thriving primary sector. It is a major contributor to Canterbury and the national economy. But we need to focus more on building value instead of volume. We will never win just as a bulk commodity producer. But the 100% Pure NZ brand is uniquely ours and a great way to tell our story. Helping our farmers make 100 percent clean, green brand real is the basis for a sustainable and thriving primary sector. An effective strategy of adding value also means recognising that New Zealanders need to own the land, forests, and productive assets in the value chain, not allow overseas companies to take huge profits from our natural resources. New Zealand is losing ownership of the building blocks of our economy. Five percent of our productive land has sold to offshore interests in the last five years. When a majority of shareholders in large rural supply companies such as PGG Wrightson are based overseas, then the profits flow offshore rather than circulating locally. We need stronger controls on the sale of land and businesses to overseas interests.

O

ver the last few weeks there has been a bit of chatter about whether the Canterbury rebuild is at its peak. Economists from MBIE, Westpac and the ASB have all concluded that spending has reached its peak, while others on the ground have pointed out that although spending will be flat, current levels of rebuild associated expenditure will stick around for another 4-5 years. On a national level, the rebuild peaking about 9 months earlier than expected has some serious ramifications. Fixing our city and region has been contributing about 0.2-0.4 % per quarter to economic growth over the last 2-3 years. Over the coming year, Westpac’s Dominick Stephens argues that Canterbury will cease to be part of the growth story with the rebuild contributing zero growth. From 2017 will be a negative for growth. What about at the local level? There’s no doubt that the rebuild has provided a boom that will to an extent cushion the blow to the region of plummeting diary prices. But, for me and for Labour that is not enough. I want post-rebuild Canterbury to be a contributor to growth in New Zealand as was the case with pre-quake Canterbury. The current government has not provided the leadership required to truly diversify our local economy. A building boom is not a sustainable economic development plan, but we have seen little evidence of thinking from Ministers beyond what Canterbury is contributing to the nation’s GDP. There was not a whisper about sustainable economic development in the Regenerate Christchurch announcements. Locally CDC has been working hard to come up with a development plan that sees a future beyond the construction boom, but this has not been backed up by the National government. There are opportunities and we need the Government to be in there boots and all making sure that the conditions are right for the flourishing of new businesses and opportunities.

ive years have passed extremely rapidly since the first earthquake on September 4, 2010. We have all been through incredible challenges and the trials of picking ourselves up and rebuilding our city after New Zealand’s biggest natural disaster. Five years down the track we need to take stock of where we have got to right across our whole community and explore the continuing challenges and opportunities we have ahead us. There has been a lot of emphasis on the central city and the state of key projects and precinct development. However, important as that is, there has been a lot of activity going on outside of the central city moving Christchurch to where it needs to go. The work going on out of the Port of Lyttelton, at the University of Canterbury, the massive amount of repair and reconstruction going on at the Arts Centre and all the good work that Housing New Zealand is putting in to repairing and rebuilding its housing stock has gone a little unnoticed while we have been preoccupied on our central city. There are some extremely exciting stories to tell in the context of the wider Christchurch rebuild. For example where we are at in terms of our housing stock repair which is further advanced than most of us would have thought we might have been five years down the track, given the constraints we had on housing repairs in the early days following the earthquakes (constraints specifically relating to ongoing seismic activity, complexities with insurance and associated land stability issues). The Canterbury Employers’ Chamber of Commerce will complete some detailed research on our progress and how far down the track we are over the coming months as we think it is important for our entire community to understand who is doing what, in what timeframe and with what anticipated result. Watch this space. There is a lot going on and a lot still to happen. We are excited about it!

licking through the TV channels recently I came across another product of the reality TV age, Undercover Boss. Even if you haven’t seen the show, there’s a good chance you’re aware of the concept in which the owner of a company disguises themselves and joins their employees on the job for a day to find out what’s really happening inside their business. While my attention span for this sort of programme is relatively short, what I saw left me thinking about the value to businesses of honest feedback – not just from staff, but also current and potential customers. These days, particularly in Christchurch’s ever-evolving market where competition is more fierce than ever, managing reputational risk is, or should be, a key component of any business strategy. In the past, a media statement in the top drawer might have been considered enough. Not anymore. Social media and mainstream media – once upon a time just good friends – are now in a committed relationship with each other and the pillow talk can be very damaging, with one person’s online gripe being news within minutes. But wearing a wig and fake glasses and going undercover is not the only way to find out what people are saying about your business or organisation. Other ways of keeping an ear to the ground include: Asking your friends and trusted advisors what they are hearing out in the community Giving your clients opportunities to provide feedback about their experiences Using Google Alerts to monitor online chat about your business or organisation Undertaking formal market research. Then, once you know what you don’t know, you will have the foundation of a communications strategy that will deliver genuine benefits to your business or organisation.

ast month, the Metro Sports Facility took another step forward when we announced details of what the people of Canterbury can expect to see included in the facility. This announcement was met with great excitement across the sporting codes. The new facility will be hub for all of Canterbury’s sports fans, with facilities for elite, competitive, and leisure athletes. It will feature a 79m indoor 10-lane competition pool, a 10m diving tower, a learn-to-swim pool and leisure water area, hydroslides, as well as nine indoor courts for a multitude of sports, a gym and a café. The new facility will give children of all ages, and in all stages of their sporting development, the opportunity to rub shoulders with some of New Zealand’s finest athletes. The Government has already purchased most of the land required to develop the facility on a central Christchurch site between Moorhouse Ave, Stewart Street, St Asaph Street and Antigua Street, spanning more than 70,000sqm. The next step is to go to market and find the right people to design and construct this fantastic facility. I look forward to checking it out once the first areas open for use in 2019, or even sooner if possible. This month we mark the fifth anniversary since the first earthquake struck on September 4, 2010. Given everything the region has been through over the past five years, it’s encouraging to see more people are feeling positive about their lives in the latest wellbeing survey. The recovery is progressing well, but there is still much more work to do and many people are still dealing with significant stress. The National-led Government is committed to keep driving the momentum of the rebuild and ensuring the city is an even better place to live, work, and raise a family in.

Liability for Defective Materials

I

Every issue Canterbury Build magazine will bring you up to date legal advice, with some of the city's leading specialist law firms providing information on a wide variety of issues of importance to both business owners and consumers.

t is well known that construction contracts contain implied warranties that the builder will carry out building work in a good and workman-like manner. It is less well known that construction contracts also include implied warranties that the builder will supply good and proper materials which are reasonably fit for the purpose for which they are required. Building elements, which include building materials, must also satisfy the performance requirements of the Building Code. A minimum performance standard of 50 years is required if building elements provide structural support to the building, are difficult to access or replace, or a failure of any of those elements to comply with the Building Code would go undetected during normal use and maintenance. A minimum performance standard of 15 years is required if the building elements are moderately difficult to access or replace or a failure of those elements would go undetected during normal use but would be easily detected during normal maintenance. Defects in building materials generally fall within the category of either patent defects, which can be easily seen, or latent defects which cannot be easily seen and may not become apparent for many years after the building work is completed. A builder will be in breach of a construction contract if the materials supplied are defective. This is so even though the builder may not be aware of the defect. For construction contracts of a commercial nature, implied warranties in relation to defects in building materials may be excluded by agreement however, compliance with the Building Code cannot be excluded. For building work in relation to household units, implied warranties that all materials will be reasonably fit for purpose and of good quality, cannot be contracted out of. Where a builder is not able to exclude liability for defects in building materials incorporated into building work, the builder will have to rely on its contract with the supplier of the building materials following any claim by an owner concerning defective building materials. It is important that builders attempt to limit their liability, particularly for latent defects in commercial construction contracts and ensure that contracts with their suppliers do not limit the liability of the supplier to a standard which is less than that of the builder. It is also important that builders satisfy themselves as to the quality and performance of all materials which they use in their building work.

Getting Paid

C

ash is the lifeblood of the construction industry. We are often asked to help contractors and sub-trades get paid for work they have carried out. What if letters of demand have been ignored or a statutory demand is not appropriate? Many contractors and sub-trades don’t realise that the Construction Contracts Act 2002 (Act) affords statutory protection to unpaid payees, provided the technical requirements in relation to payment claims set out in s20 of the Act are met. If a payer fails to serve a payment schedule in accordance with s21 of the Act then the sum claimed in the payment claim becomes a debt due at law. This means an unpaid contractor can enforce payment in full either by way of adjudication or court proceedings. It will then be up to the paying party to later argue that the sum paid was not due and owing, and claim the money it has paid back from the contractor. In the recent case of Can Build Limited v Kirkpatrick, Can Build Limited (CBL), applied to the High Court for summary judgment to enforce payment of sums claimed in relation to a residential build. CBL alleged that Kirkpatrick had not provided a payment schedule or made payment within the required timeframe. The Court had to decide whether the payment claims met the requirements set out in s20 of the Act. CBL provided two monthly payment claims to Kirkpatrick. The first only made reference to the quantity and rate of labour and total cost of materials. Kirkpatrick requested further information from CBL for clarity, which CBL provided by way of supplementary information. CBL issued a second claim which contained the same references as the first but with a breakdown of named individuals, labour hours and a list of material suppliers. Both payment claims were defective because they failed to provide sufficient identification of the construction works and therefore did not meet the requirements of the Act. Kirkpatrick could not provide a meaningful response to the claims. The Court held that a defective payment claim cannot be cured by serving a subsequent amended or substituted payment claim. Equally, providing extra information after the claim has been served in order to remedy a defective claim only causes unnecessary confusion and does not cure a defective claim. This case highlights the importance of serving a correct payment claim the first time. Canterbury

One of the biggest social housing investment in the South Island’s history is changing lives for the better. Housing New Zealand’s Canterbury Earthquake Recovery Programme (CERP) is spending approximately $350 million repairing up to 5000 earthquake damaged houses and building 700 new homes across greater Christchurch.

I

t is a massive investment and involves a lot of co-ordination as its staff work closely with an estimated 20,000 people who live in Housing New Zealand homes. Approximately 1000 tradespeople are working on the repairs and new builds programme throughout the city and that work is pumping about $1 million into the local economy every working day. Acting CERP General Manager Andrew Booker says the programme involved big numbers, co-ordination and planning but the best part for him was seeing tenants happy in their repaired or new homes. Housing New Zealand has made great progress in both the repair and new builds programme. As at the end of July, it had completed repairs to 4,463 homes. This work not only involved repairing the earthquake damage but taking the opportunity to make other improvements to reduce the ongoing maintenance needs of the house. A full scope of works is done on each property and many improvements are made while contractors are working on the house. These include new curtains, insulation, carpet, vinyl, painting and ventilation. Andrew says this means the full story in the repair programme is not just about making the necessary earthquake repairs, but enhancing its existing housing stock. “Behind those great figures that show we are making great progress towards our repair of 5000 homes is that thousands of tenants and their families are now living in warmer, drier and healthier new homes,” he says. All of this is genuinely a team effort with many partners involved in making these numbers a reality. Housing New Zealand has strong working relationships with local consenting authorities, build partners, contractors and other important stakeholders. At last count, the organisation was building new homes in 26 Christchurch suburbs and repairing properties in those same communities. Andrew says this has enabled Housing New Zealand to press ahead with its work in Canterbury and it is pleased to play its part in the overall recovery of Canterbury.

I love the feel of them so I love this house,’’ she says. The house was very close to her son’s daycare centre and only one bus ride to her workplace. The warmth and comfort of the home was also very good, she says. “It’s a warm house and really keeps the heat in.’’


investment making real difference Repaired home a real blessing for tenant Her repaired home is warmer, drier and better than ever before according to Bryndwr tenant Jean. The 74 year old tenant has lived in her house for 10 years. Like thousands of other Christchurch tenants, her property needed repairs after the earthquakes. While contractors were completing the necessary earthquake repairs, they also took the opportunity to make other improvements. The organisation’s Tenancy Liaison staff worked closely with Jean to ensure her needs were met during this time. She needed to move out of her house for about three weeks but was keen to stay nearby. The staff arranged for Jean to stay in a house just around the road. They also helped her pack up her belongings and take care of other matters like transferring her telephone to her temporary house. Staff regularly visited her during her time out of her house and worked closely with her to help her move back into her repaired home in late July. The improvements included new carpet, curtains, painting throughout and a new heat pump. Jean was thrilled with her new-look home. “It is just marvellous. It really has made a big difference.’

The Board of Housing New Zealand, along with senior members of Housing New Zealand’s executive team, recently visited Christchurch and were impressed with the quality and pace of the new builds programme. They visited several new developments across the city, including in Riccarton, Phillipstown and Aranui, as well as several sites near completion or poised to have new homes built there. The group also visited a repaired Community Group Housing complex and spent time with members of the Canterbury Earthquake Recovery Programme (CERP) and Tenancy Services teams. Chief Executive Glen Sowry says the visit was a great opportunity for senior staff and Board members to get a first-hand look at the massive programme of work being done by Housing New Zealand across the city. The Board were very impressed with the quality of the new homes being built and excited as the Christchurch portfolio will be the most modern in its stock nationwide.

New video tells the Housing New Zealand story A new and innovative way of telling the story of Housing New Zealand, its people and their housing needs has been developed. A nine-minute video, “Our People, Our Journey’’ tells the story about the country’s largest social housing provider that owns about 67,000 properties that more than 193,000 people call home. The video was filmed in Christchurch and Auckland and showcases many of the new houses being built in those parts of the country, but it also includes scenes from other parts of the country that explains the work the organisation’s staff do for its tenants every day. “Our People, Our Journey’’ is a story about people and their housing needs. It outlines how Housing New Zealand does much more than just collect the rent. Its Tenancy Services staff work alongside tenants to help them manage debt, connect them to support services and ensure their homes are safe, healthy and appropriate for them.

Other interesting facts about Housing New Zealand include:  Over 1,000 staff manage tenants and properties  Maintaining the properties involves more than 3500 tradespeople  40 percent of the people living in our homes are children while another 20 percent are over 65 years of age  Up to $200 million is spent on maintenance each year  Last year, property improvements took place at 5,652 properties and included refurbishing kitchens and bathrooms, new carpets, heating and redecoration  HNZ’s Next Generation Performance Based Maintenance Contract will establish 158 new apprenticeships over the five-year life of the contract  The Canterbury Earthquake Recovery Programme is managing the single biggest investment into social housing stock in the South Island’s recent history  In Auckland, 24 re-development projects have been launched, at a cost of about $45 million  Today, the social housing portfolio is valued at nearly $21 billion.
