CONSUMER CHAMPION Bailiffs, debt collectors and your rights. By James Walker, www.resolver.co.uk
It seems that the British public is still struggling under the burden of heavy debt. A survey at the beginning of April by the Debt Advisory Centre has found that more than a quarter of people in the UK have been contacted by debt recovery firms. And of those, many were unsure of their legal rights. Scarier still is the fact that four million of us have received a county court judgement (CCJ) or similar court decree in the past five years. A CCJ is not insignificant, either – it stays on your credit file for six years unless you repay your debt within a month. But there is hope if you’ve been unfairly treated by bailiffs or debt collectors – resolver. co.uk has just added all major bailiff and debt collectors into its system, so you can now get your complaint heard by using us! Here’s what you need to know before you start…
Bailiff or debt collector?
There are two types of firms that could turn up at your door: a bailiff or a debt collector. If they are a debt collector, they have no powers to enforce the debt. If a bailiff turns up they will need to announce themselves as a bailiff. There are three types of bailiffs: • County Court • Certified • Private
If your debt is unsecured (e.g. a credit card, overdraft, or mobile phone bill) your creditors cannot send bailiffs, but they can send a doorstep collector. If they do come to your door, then ask them to leave and request that they contact you by letter only. 6

Your debt can be passed to a debt collection agency, but they do not have any more powers than the firm to whom you owe money. The company can approach the courts and apply for a county court judgement. The court will set repayment terms for the debt. Once set, it is important that you adhere to these terms.
A Warrant
A bailiff must ensure that a legal professional collects the debt, known as a warrant of execution, allowing the bailiff to recover goods to pay the judgement plus any fees or court costs. The warrant can only be issued if a related county court judgement (CCJ) payment has been missed.
Notice
You do not have to open the door to a bailiff, but once the door is open, they may attempt to force their way past to gain ‘walking possession’ of goods in your house, car or place of business. At this point they can take control of your goods, although they may still leave them in your property. The only bailiffs who can force entry are County Court bailiffs.
What is a debt collector?
If you have missed between three and six payments, you could be deemed to be in default on your original agreement. Interest can continue to be added to your account and the money debited from the related accounts.
If a warrant has been issued, then the court will have to give you seven days’ notice in writing that bailiffs will be visiting your home. If you receive such a notice, contact the court immediately and request an N245 form. The form allows you to suspend the visit or to renegotiate any repayments, but you should act immediately.
When can they force entry?
In most circumstances bailiffs cannot force entry to your home – including with eviction orders, persistent unpaid court fines or unpaid taxes. These can be issued by High Courts, County Courts or Magistrates’ Courts. In normal situations, bailiffs have the right of peaceful entry, meaning they cannot break

glass or doors, but they can gain access through an open window, door or climb over a fence. If it is a peaceful entry, then you do not have to let the bailiff into your home. Once the firm has entered your home, they can come back at any time and collect the goods.
Levying of goods
A bailiff is allowed to levy your goods i.e. to seize, secure and then sell to recover the debt. The goods will be sold at a fraction of the cost than they were purchased for. The bailiffs are allowed to take sufficient goods to cover the cost of the debt – although it’s worth remembering. The bailiffs should take an inventory of the goods. After the goods are removed, they should leave a formal notice, called the ‘notice after entry’ or ‘taking control of goods’.
What a bailiff cannot take
The bailiff cannot take items that are not owned by the debtor – ‘tools of the trade’ (but only up to the value of £1350) – which are used for you to earn a living and basic essentials such as a bed. You are required to prove that the goods belong to someone else.
letter so that you have a written copy. If you are complaining because they have taken too many goods, or the goods weren’t yours you must contact the bailiff firm within seven days. The bailiff must then contact the creditor within three days to seek their opinion. The creditor then has seven days in which to decide whether or not the goods were taken unlawfully. If the creditor decides the goods were taken unlawfully, then they will be returned, but if your complaint is rejected, then you will need to go to the court to appeal the decision. If it is your local council, then complain to their legal department, or if it’s national insurance debt, complain to the HMRC National Insurance Contributions Office. You can also make a complaint to the court. For High Court Enforcement complaints, you should complain to High Court Enforcement Officers’ Association (HCEOA). For county courts, complain to bailiff manager at the court and for magistrates courts to the clerk of the court.
Where can they remove the goods?
A bailiff can take goods from your home, where you run your business or a public highway. If they want to take goods from anywhere else, then court permission is required, specifying the premises and must be included in the court order. If you live in a flat share, only goods from a room used exclusively by you can be removed.
Controlled goods agreement
This is an agreement where you authorise that the goods are taken away and sold. At this point the ownership of the goods transfers from you to the bailiff. As the goods are now the property of the bailiff, they can then be removed at anytime. These goods can be left at your property if you honour the agreement to pay off the debt. The agreement does not have to be written and can be verbal.
Complaining about bailiffs

This is an important warning for anyone who pays for childcare. There are major changes due to take place to the system this year – and you need to decide rather soon how they affect you. There are major changes due to take place to the system this year – and you need to decide rather soon how they affect you. If you leave it too late, you could miss out on thousands of pounds. Are you eligible for childcare tax credits? The most important start point is to check if you’re entitled to what’s technically called the ‘Childcare Element of Working Tax Credit’ – this is NOT the same as Child Tax Credit. You can usually claim it for children up to age 15, provided you pay for approved (Ofsted or equivalent) childcare. Sadly the eligibility criteria are very complex. So I’ve tried to distil it in a simple rule of thumb: ‘if you’re a single parent working 16+ hours a week, or a couple BOTH working 16+ hours a week, and your total household income is under £46,000, you should definitely check out if you’re entitled.’ Please read this carefully – I’m not saying you are entitled, just that it is worth checking, as this is big money. The average pay out is around £60/week. That’s over £3,000/year. If you’re not entitled to tax credits, decide now which other scheme works for you This is where everything is changing. If you’re eligible for tax credits, you’re likely to be better off getting that. If not, there are other schemes to look at. This autumn, the new ‘tax-free childcare’ scheme launches and the current childcare vouchers scheme that lets many pay for childcare from their pre-tax income will close for new applicants. So if you’re eligible for vouchers, but won’t be for the new scheme, get in quick. - New tax-free childcare scheme: If you’re a single parent who works, or a couple where BOTH work, and you each earn under £150,000, for every 80p you put in a new childcare account, the government will add 20p on 12 The New Addington Magazine
top which can be used to pay for Ofsted approved (or equivalent) childcare for under-12s. The maximum the Government will contribute is £2,000 per child per year. Most childminders, after-school clubs are Ofsted approved, as are many nannies. Current childcare voucher scheme. Here you usually trade in your pre-tax salary for vouchers. For example, a basic-rate taxpayer can swap £1,000 of salary, which after tax and National Insurance is only £700ish in your pay packet, for £1,000 in childcare vouchers. So you’re up £300 per £1,000. The maximum you can get is £55/week per year per parent, which would be a gain of £930 for a basic-rate taxpayer. Any parent can do this, even if their partner doesn’t work, provided your employer offers it (many do, but many don’t). Yet if you’re not signed up to this by the time the new scheme starts, you can’t do it after. So if it’s right for you – sort it soon. Tax-free childcare vs childcare vouchers. If you’re a couple where only one works, the vouchers win hands down, as you won’t be eligible for the new scheme. Plus, if your childcare costs are low, it’s likely vouchers win due to the tax and National Insurance savings. Yet for the self-employed, those whose firms don’t offer the vouchers, or those with more than one child and high childcare costs, the new scheme wins. This is just the tip of the iceberg – full analysis of which wins at mse.me/childcare. What about free childcare for three and four year-olds? The Government have announced plans to give working parentswiththreeandfour-year-olds30hoursoffreechildcare per week. If made law, pilot schemes will start in Sep 2016, though there’s scepticism about whether it’s deliverable. Yet already for at least 38 weeks a year (each week of the school year), if you’ve a three or four-year-old, you’re entitled to 15 hours a week of free childcare. Families with a low income may also get free early education for two-year-olds.

Contact your local council to check if your child qualifies at (a good place to start is gov.uk/find-free-early-education). If they do, go to finder.familyandchildcaretrust.org for info on which childcare providers you can use under the scheme. You then liaise directly with the provider to get the free childcare. Is there help for paying for summer schools? If you’ve got older children and work, check whether there are any summer schools in your area that they can go to. Some schools, community centres and youth groups have their own schemes. Most are Ofsted (or equivalent) registered, so if you pay for them, you qualify for childcare tax credit or you can use childcare vouchers to pay for them.

Get the oven on first so that it heats up to 180°C and grease up or line a large baking tray. Bake the wrap(s) at a medium temperature for around 10 minutes and flip over halfway through so that the wrap goes slightly crispy. INGREDIENTS per person
1 tortilla (wrap) per person 5 tablespoons of chopped tomatoes Sprinkle of dried herbs 1 small sliced onion 1 handful of grated cheese
Take it out of the oven and cover with the tomato. Sprinkle the rest of the toppings over the top and finish off with the cheese. Pop the wrap(s) back in the oven for a further 5 minutes or so until the cheese has nicely melted.

Benefits of Garlic As the days get shorter and the weather gets cooler the focus on your vegetable plot starts to turn from growing and harvesting, into clearing and tidying. Time spent on clearing and preparing your beds now will pay dividends next year. Make the most of the autumn sunshine to get compost dug into bare beds and you’ll have saved yourself hours of work on those chilly Spring days. Jobs for October:Make sure that plenty of sun can get to your pumpkins in order to get them ripe in time for Halloween. Plant garlic, shallots and Japanese onions. Leaving dead seed heads etc. on your flower borders will provide valuable food and shelter for garden wildlife over winter, as will leaving an undisturbed log or two. Build a rough shelter in a quiet corner and you might get a hedgehog move in! If you get lots of fallen leaves on your plot don’t waste them. Make a bin from chicken wire attached to 4 posts. Fill this with the leaves and they will rot down to give you sweet-smelling black leaf mould in one to two years time.

October is a good month for taking stock of how things have gone this year and starting to make plans for what you will grow in the future. Removing spent crops exposes slugs and other such pests to birds and other garden friendly wildlife. It also gives you the chance to look after your soil and assess how the space will be used next. Crop rotation is important so if the space is to remain bare over winter it may be wise to make notes about what grew where this season. Add matter from your compost heap to newly cleared areas, either digging it in, or leaving a layer on the top where the worms will gradually incorporate it into the deeper soil over winter. If the soil is heavy leaving it bare will enable frosts to help break it up. Our soil is lighter and benefits from being covered over - we use flattened cardboard boxes which protect from the rain and also help keep the weeds at bay. You may think that it’s all too late in the year to be planting, but there are some crops that definitely need to be thought of now, and others that, given an early start now, will benefit next Spring.
and with just a small amount of space you can grow enough to see you through the whole year! Now is definitely the time to order your garlic bulbs and they can be planted anytime between now and Christmas, but preferably not when the soil is too wet. Rather than planting all the garlic together it may pay to spread it around the plot as the strong smell can be an aid in keeping pests such as the carrot root fly away from other crops. Each garlic bulb should be separated into individual cloves and the cloves are planted with the pointed end uppermost, just below the surface, leaving about 4 inches between each one. They like well drained soil and you’ll be pleasantly surprised in the long winter days to see their green tips creeping upwards. Each clove matures into a whole new bulb. The traditional time for harvesting garlic is in June, on the longest day of the year and if properly dried and stored it will keep right through the winter. Would you like some fresh, tender, young, peas early in the Spring next year? Look out for hardy varieties that can be planted now. They can be overwintered and are able to withstand the frosts, though protection with a cloche will be appreciated. We will be starting ours in pots to keep in the polytunnel over winter ready for early planting next season.

Our Experience in Central Parade Savvy traders on Central Parade know that their greatest competition is located, not necessarily the nearest high
street, but on the nearest smartphone, pc, laptop or tablet. When 80% of adults in the UK go online every day and ordering shopping from the comfort of our bed, sofa, train or bus is just a few clicks away, street-based retailers need to develop an online presence and keep up to speed with the ever-changing world of technology and digital media. That’s why the Central Parade Business Partnership (CPBP) recently commissioned a pilot programme of digital skills, social media and online marketing for local businesses. Said Ken Burgess, Chair of the CPBP and New Addington BID: “Most of our local traders, no matter what their product or sector, have experienced an impact on their sales due to the increase in web shopping. Unfortunately many of us don’t think we have the time, skills or confidence to take advantage of online marketing and digital technology to fight back.” Ken continued: “The CPBP highlighted digital technology and online marketing and communications as a skills gap for many of the Central Parade small businesses and so the BID Board agreed to fund a pilot programme from funds raised through the BID levy”.

IT’S ALL CHILDS PLAY Have an 'incy-wincy' bit of fun this Halloween By Sue Gascoyne
With autumn half term just around the corner and Halloween well on its way, now is the perfect time to fuel children's imagination with some spooky stories, creepy crafts and 'spooktacular' activities. With a bit of inventiveness, Halloween provides rich opportunities for capitalising on children’s interests to get them involved in exploration, reading, art and crafts. Halloween is great for unlocking children's imagination with storytelling and watching them thrive on its magical spookiness. One book that is perfect for Halloween and beyond is Aaaarrgghh, Spider, by Lydia Monks. Not only does it provide inspiration for spooky activities, but it’s also available (see stockists list) complete with an adorable fabric spider, sensory-rich web and wealth of fun activity ideas to really spark children's creativity. Children will love this story about a clever and charming spider whose only mission is to be part of the family she shares a house with. The book follows her quest to be loved and sees her put outside time and again and even flushed down the plughole as the clever spider tries to convince them that she’ll make a perfect pet. Spiders are almost guaranteed to cause a scream or two and children are naturally inquisitive, so why not capitalise on this by trying the following hands-on fun activity ideas this Halloween:
Hide plastic or rubber spiders in trays of sand, shredded paper, dried couscous or pasta for children to have fun finding them with brushes, spoons and tongs.
Make furry spiders by gluing cardboard legs onto woollen pom poms and attaching googly eyes. If you dare, make lots to decorate your house for Halloween.
Create 3D spider webs by sticking uncooked spaghetti to card and decorate using glitter or string for the thread.
Play a game of moving like spiders and other creepy crawlies.
Make magic spiders and spider web pictures by drawing on white paper with white candle wax and painting over with black paint to reveal a creepy surprise.
Make spooky spiders to hide in the garden or hang from trees where they will only become visible at night. Get some small cardboard boxes and add eight legs made from strips of cereal card or plastic cups. Paint them black. Make two holes for the eyes and one for the mouth on one side. Attach a loop of card to the top of the box to hang from a tree branch. Snap a glow bracelet to activate and place one inside each box, then sit back and wait as a crowd of spooky eyed spiders comes to life!
Make a spider themed tea by cutting up peppers and carrots into crudité sticks and arranging around a tub of hummus or other dip with olive eyes. Alternatively provide children with flour tortillas or crackers for them to create their own savoury spiders using ham, olives, cheese and salad.
Make spider pizzas using stringy cheese web, olive or tomato eyes and pepper legs.
Carve out a pumpkin to create pumpkin spider lanterns instead.
Children will love making gingerbread spiders to decorate with icing with sweets for eyes.
Bake chocolate cupcakes and decorate to make edible spiders.
Why not take some tasty treats to neighbours as a lovely alternative to Trick or Treating?
End the day with spooky spider broth - hot chocolate decorated with cream, mini marshmallow eyes and biscuit or sweetie legs.

Fairhands expands its home visiting physiotherapy service and invests in specialist equipment with help from Croydon Enterprise Loan Fund In need of some guidance, it was to Matthews Yard that Frances Lamberth recently ventured when she was seeking to raise additional finance to support the growth of her home visiting physiotherapy business. She had tried her own bank but without success and therefore had to seek an alternative way of raising the much needed funds. There, located in a corner of the café, she found the team of Keith Miller and John Rodd of GLE, who manage the fund on behalf of Croydon Council, to whom she put her request while enjoying a coffee.
Frances explained that she started Fairhands in 2008 after thirty years working as a physiotherapist in both the NHS and private sector. She has seen a gap in the market in that most physiotherapy practices do not have the time, or resources, to make home visits especially for the elderly.
I have been able to invest in physiotherapy equipment, which has definitely increased the numbers of patients being treated. Additionally I have now taken on a second part-time physiotherapist. The loan has also supported our development of digital patients records thereby maximising patient confidentiality and staff time efficiency.’ Frances went on to say, “ I have found Keith and John to be really encouraging and professional with lots of practical advice. As such Fairhands provide help, advice & practical treatment with all the problems around walking, mobility & balance for people in their own domestic home, nursing home residents, their families & carers. This helps restore independence & quality of life with all clients being offered their own personal physiotherapist who provides one-to-one attention. Within a couple of weeks she had completed the application process and held a further meeting at Matthews Yard where she was to learn that she had been successful with her request. Frances explained ‘It has been very exciting to be granted a business loan from the Croydon Enterprise Loan Fund. Founded in 2008, the Croydon Enterprise Loan Fund was set up to support Croydon businesses, which may not have been able to access finance from banks. Over the last six years £2.5m has been lent to over 250 businesses and almost 300 jobs have been created or protected as a result of the fund.
