~ William Shakespeare, Romeo and Juliet This year, as part of the New York State Motor Truck Association’s strategic plan, the association will be rebranded as the “Trucking Association of New York.” Some of the reasons behind the name change are outlined in an article appearing in this issue of Milepost, but what’s most important to remember is that it is the same association, just a new name. Many members may not know that the New York State Motor Truck Association, as it is known today, was formed from a confederation of four organizations that were located in cities throughout the state: •

The Committee for Truck Progress - Albany, NY;

The Trucking Federation Niagara Frontier - Buffalo, NY;

•

The Allied Transportation Industry Association - Syracuse, NY;

•

The Empire State Highway Transportation Association - New York City. This association was actually an outgrowth of several groups, which included the New York State Motor Truck Association, formed in 1932.

During the early 1960s, the four groups were united into a single statewide organization and an agreement was made to name the organization “The New York State Motor Truck Association.” The reason for this brief glimpse into the history of the association is to highlight that regardless of the name, the mission of the association remains the same as it has been since at least 1932. The Trucking Association of New York will continue to advocate on behalf of the trucking industry, will continue to promote safety as a priority of the industry, will continue to provide valuable resources and information to its membership, will continue to provide cost-savings benefit programs and will continue to grow and evolve to meet the needs of the industry now and into the future. I’ve written several times in the past about the need for change. The demographic of the industry is changing and the needs of the membership are changing. The association must also change. But, as we know, the more things change, the more they stay the same. So while the association is rebranding, mainly to better identify who the association represents, what won’t change is the association’s commitment to the membership and to the trucking industry. 2016 NYS Truck Safety and Education Symposium & Safety Exhibition The 2016 New York State Truck Safety and Education Symposium and Safety Exhibition kicked off in its new location at the Saratoga City Center and Saratoga Hilton in Saratoga Springs, NY on April 5. The two-day “Trucking in the Technology Age”- themed event began with welcoming remarks from New York State Department of Transportation (NYSDOT) Commissioner Matthew Driscoll and New York State Department of Motor Vehicles (NYSMDV) Executive Deputy Commissioner Terri Egan, who discussed the numerous ways in which technology has impacted the trucking industry in their respective agencies. Driscoll and Egan also applauded the strong partnerships their agencies have with the industry, particularly through the symposium and their relationship with NYSMTA.

In addition to NYSDOT and NYSDMV, attendees heard from other state agencies involved in the trucking industry and highway safety including the New York State Police and Governor’s Traffic Safety Committee.

On the federal level, Anne Collins, Associate Administrator for Field Operations with the Federal Motor Carrier Safety Administration and Steve Collins with the Transportation Safety Administration provided updates from their agencies, while Collin Mooney, Executive Director of the Commercial Vehicle Safety Alliance and Megan Bush, Manager of Safety Policy for the American Trucking Associations discussed the electronic logging device rule. True to its mission of bringing together the public and private sectors, the symposium also included numerous sessions by trucking industry professionals outside of government. Consultant to the trucking industry, Dan Baker, made his third appearance at the Truck Safety and Education Symposium, discussing how to preserve institutional knowledge. Baker volunteered audience

members to illustrate the different generations which are currently in the workforce and discussed the generational communication differences which make preservation of knowledge between those groups a challenge. Bo Mitchell of 911 Consulting educated attendees on the stark reality of workplace violence. He challenged common myths about workplace violence, discussed red flags to look for, and stressed that having a policy in place against workplace violence does not prepare employees for an instance of an active workplace shooter. The mantra “run, hide, fight” must be ingrained in employees, he said, who are essentially “first responders” to these situations which are typically over in under 5 minutes- well before law enforcement is on site. On the compliance side, Matt Schyndler, Safety Manager of Mirabito Energy Products outlined exactly what documents must be retained in driver qualification files, vehicle maintenance files, roadside inspection files and annual inspection files while Swede Oun, owner of O&K Truck Repairs, discussed the need for effective communication between safety and maintenance professionals on the same team. On the financial side, Scott Wichmann, Vice President of Haylor, Freyer & Coon looked inside insurance costs. He discussed what goes into determining premiums and what steps can be taken to minimize both costs and risks. Mary Ellen Vassallo, Claims and Risk Manager

for Superior Plus Energy Services discussed the steps that any company can take to reign-in skyrocketing workers’ compensation claim costs. Taking the time to manage the claim internally rather than solely relying on a third party administrator, and pushing for a fraud finding rather than settling (therefore enabling a company to recoup money already spent) are among the tactics she identified which dropped her own company’s claims by $1 million in her first year on the job. On Tuesday afternoon NYSMTA held an awards luncheon recognizing the 2015 Driver of the Year, Golden Wrench and Fleet Safety Award recipients. NYSDOT’s John Connolly, an annual speaker at the symposium who has retired after 37 years of service, was awarded the NYSMTA’s Outstanding Service Award by association president Kendra Hems for his continued commitment and dedication to commercial motor vehicle safety. NYSMTA to become TANY The New York Motor Truck Association to be renamed Trucking Association of New York on June 1. After careful deliberation, the board of directors of the New York State Motor Truck Association has voted to change the association’s name to the Trucking Association of New York, effective June 1. This decision was not entered into lightly, as it has been an intermittent topic of conversation at the board level for over a decade.

“The New York what? What is a motor truck?” Nearly 85 years ago, when the association was established, the term “motor truck” was more commonly used to describe what we now today consider a commercial truck, semi-truck or tractor-trailer. As a result, the term “motor truck” has been increasingly questioned by those unfamiliar with the organization. “You’re who?” and “What is a motor truck?” are questions those representing the association are routinely asked. The association’s current name frequently requires an explanation as to who the association actually is and what it does. The board of directors felt that the Trucking Association of New York is a much clearer descriptor which leaves few questions as to what the association does.

“You’re not a state agency? But New York State is in your name!” On an increasingly frequent basis, the association receives calls from individuals who are under the assumption that the New York State Motor Truck Association is a New York State agency. This causes significant confusion to those calling the association and time and energy on behalf of the staff who field such calls daily and have to explain what the association is, and that it is not a state agency. Anecdotally, a member of the board relayed an issue he faced with another association he belongs to whose name begins with “New York State.” In that case, a private citizen blocked that association’s use of his land, because he erroneously believed they were an arm of state government- a government with which that landowner is currently very dissatisfied. All parties involved in this decision understand that there is never a convenient time to change an organization’s name. The decision to change the association’s name to the Trucking Association of New York, effective June 1, was made as it will coincide with the launch of the association’s new website. This website will be interactive with the association’s new database management system. What does this mean to you? You’ll be able to do more than ever online including logging in to your account to view invoices, register for events, order supplies and more! The official change to the Trucking Association of New York will take place on June 1. In the meantime, expect to see numerous reminders about the upcoming change in your email inbox, mailbox, and in the Friday Final.

Every year, the New York State Motor Truck Association gives the Fleet Safety Award to carriers who have an accident rate at or below 0.5 (no more than one accident per two million miles) based on their miles traveled in New York. For 2015, there were over 14 million accident-free miles among the applicants.

The awards are divided into two operation types: long-haul/ truckload, and pickup and delivery. They are further broken out into three divisions based on total New York miles: small, medium and large. The top three carriers in each division were recognized at an awards luncheon during the New York State Truck Safety and Education Symposium and Safety Exhibition in April. One overall Grand Champion was selected from the first place winner in each category and those fleets who have received a Fleet Safety Award for at least five consecutive years. The Golub Corporation of Schenectady, NY was named Fleet Safety Award Grand Champion for 2015. They were selected based on out-of-service rates, safety and maintenance programs, performance trends over the last three years and more. Golub logged nearly 7.3 million miles in New York in 2015 with no preventable accidents. Additionally, the Golub Corporation was recognized for having received a Fleet Safety Award for three consecutive years.

Leonard’s Express Driver Named Goodyear Highway Hero Utica resident Julian Kaczor was named the 33rd Goodyear Highway Hero at the Mid-America Truck Show in Louisville, KY in March for pulling a man out of a burning car in July of 2015. He was one of three finalists for the award.

the vehicle door open with his bare hands and pulled the driver to safety.

Kaczor, a driver for Farmington, NY-based Leonard’s Express, Inc., was traveling on Interstate 95 in Florida when a car sped past him, nearly clipping his truck. The car then spun out of control at a sharp curve, flew into the air, crashed into a construction barrier and caught on firewith the driver still inside.

“Julian acted instantly to help another person who was in need, without regard for his own well-being,” said Gary Medalis, marketing director for Goodyear. “His decision to get involved exemplifies the courage and decisiveness of professional truck drivers.”

Kaczor didn’t hesitate to act. He grabbed his fire extinguisher from his cab and attempted to put out the fire but it was spreading too fast. With the vehicle in flames, Kaczor pried

During an acceptance speech for the Goodyear Highway Hero award, Kaczor stressed the importance of driving safely in construction zones, as the vehicle which crashed had far exceeded the 45 mph speed limit in that zone.

“Goodyear is proud to be the company that honors truck drivers for their heroism,” Medalis said. “Each of our Highway Hero Award finalists is a hero in his own right and is truly worthy of recognition.” The Truckload Carriers Association named Kaczor a Highway Angel on Feb. 8, and Leonard’s Express CEO Ken Johnson awarded him their internal award- the Lenny- over the summer. Johnson said, “He’s a humble guy who took it all in stride and figures he did what anybody else would do in the same situation. He didn’t think it was any big deal, but we certainly did.” ~with contributions from Transport Topics

Golden Wrench Award Every year, the NYSMTA presents the Golden Wrench Award to recognize excellence among heavy vehicle technicians. It is a prestigious award given by the NYSMTA Safety Maintenance Management Council to recognize the best technicians in New York State. For 2015, four technicians were presented with regional awards, while one technician received the statewide Golden Wrench Award. The awards were given at a ceremony during the 2016 New York State Truck Safety and Education Symposium and Safety Exhibition in Saratoga Springs on April 5. For the second consecutive year, Chris Beckhans of Hub Truck Rental Corporation in Farmingdale, NY was named the 2015 Statewide Golden Wrench Award Winner by the NYSMTA. Beckhans has been a technician for over 28 years. He has received his ASE certification in 32 different disciplines and has also received 13 certifications through the New York Automotive Technician Training Program. He has participated in the NYS Motor Truck Association SuperTech Competition for the past four years, finishing 2nd in the engine competition in 2012, 1st in the engine competition in 2013, 3rd place in the annual inspection competition and 1st place again in the engine competition in 2014, and third in the fifth wheel category last year. In addition to holding an inspector’s license, he holds a CDL.

In his free time, Beckhans participates in motorcycle rallies for the Wounded Warrior Project, volunteers for Toys for Tots, Make a Wish Foundation and a variety of fundraisers and is an active member of A.B.A.T.E. (American Bikers Aimed Toward Education), which serves his community. He is often found mentoring younger technicians at work on his own time, always willing to lend a helping hand. The award was accepted by Hub Truck Rental Corporation’s Ken Tirone on behalf of Beckhans, who was unable to attend the ceremony due to illness. Additionally, two of the four regional winners were unable to attend the awards ceremony, as they were both attending a previously scheduled professional training course.

Driver of the Year Award The NYSMTA presents the Driver of the Year Award to drivers with long, safe driving records, who have demonstrated acts of courtesy or safety on the highway and a proven commitment to professional development through civic involvement. For 2015, eight drivers were awarded with the Driver of the Year Award at a ceremony during the 2016 New York State Truck Safety and Education Symposium and Safety Exhibition in Saratoga Springs in April. Seven drivers were honored with a regional Driver of the Year Award, while one driver received the statewide Driver of the Year Award. Samuel Cornwell of Walmart Transportation in Marcy, NY was named the 2015 Statewide Driver of the Year by NYSMTA. He has driven over 3 million

miles in his 28 years of driving, 16 of which have been with Walmart. In 2013, he was awarded the Sam Walton “Good Sam” of the year award and also won the Flatbed class as well as Rookie of the Year at the New York State Truck Driving Championships. In 2014, he again won the Flatbed class at the New York State Truck Driving Championships. Cornwell is active with many charities including Big Brothers/ Big Sisters, Trucker Buddy International, Walmart Heart, Share the Road, Candor Emergency Squad, American Legion, Patriot Guard Riders, Marine Corps League, Rotary exchange, student host and Tioga Meals on Wheels among others. According to his supervisor, “He does it all. I am surprised he has time to drive!”
