2016 has been a busy year. With the launch of a new name, new website and a new membership portal in June, the Trucking Association of New York began the process of implementing components of a new strategic plan for the organization. The primary areas of focus of the plan are (1) membership, (2) programs & services, (3) communication, (4) safety & education, (5) advocacy and (6) relationships. It should come as no surprise that these are not new initiatives. When the association moved its offices in May of 2015 we came across many old documents and files. One document I found to be most intriguing was a membership brochure that appears to be from the 1960s, which is when the association as we know it today was created from four smaller trucking associations across the state that decided to merge together into the New York State Motor Truck Association. What struck me was the first page of the brochure which reads “The New York State Motor Truck Association is the voice of truck owners everywhere in New York State.” In 2012, the association’s board of directors agreed to change the mission statement of the association from “To serve, represent and promote the interests of the trucking industry by enhancing its image, efficiency, productivity, and ability to compete” to simply “The Voice of Trucking”. At the time, the board was unaware of the document from the 1960s, which goes to show that this association’s commitment to represent and speak for the trucking industry has stood the test of time. As I thumbed through the rest of the document, the benefits highlighted sounded strikingly familiar – programs & services, communication, safety & education, advocacy and relationships. It was surprising, and enlightening, to discover how strong the roots of this association truly are. Regardless of what year it is, or what version of a strategic plan the association is on, one thing continues to remain the same – the priority of the association is the membership and ensuring that the membership receives value from the association. To that end, 2017 will bring a renewed focus on bringing the benefits of the association to the membership. The objective of TANY in 2017 is to provide many more training, education and networking opportunities at the regional level and across the state. The regional planning committees have already met to plan programs in each of the regions for 2017. As the 2016 Town Hall meetings wrapped up we brought valuable information and ideas back to the regional chairs and association staff to implement during these planning meetings. Watch for increased training and networking opportunities, job fairs, toucha-truck programs, share-the-road training and much more in 2017! The current strategic plan continues to build on the success of many strategic plans before it. There are some new ideas and some new initiatives but one thing I’ve come to realize is that our tools in the toolbox may change, but the project remains the same. At the end of the day, and always, the association will be here as THE Voice of Trucking, because, as we have discovered – the more things change, the more they stay the same. Best Regards, Kendra L. THE THAYER HOTEL AT WEST POINT The Trucking Association of New York’s 49th Annual Conference & Membership Meeting was held on Sept. 25-27, 2016 at the historic Thayer Hotel at West Point, on the post of the United States Military Academy. Attendees enjoyed the history-filled and picturesque facility and grounds, during a welcome reception overlooking the Hudson River, and a group tour which included the West Point Museum, the Cadet Chapel, Cemetery and Trophy Point, among other historically significant locations. This year also marked the return of vendors after a long absence. Helping kick-off their return were All Star Incentive Marketing, CDX, Cummins Power Group, CurAgeis Technologies, Inc., Dorforms, Inc., GH Berlin Windward, Keevily/Spero/ Whitelaw, LLC, Kenworth Northeast Group, Inc., Leuner, Inc./ Northeast Great Dane, Omnitracs, SAF Holland, Strategic Communication, TeMeDa, Valvoline, Thermo King of Long Island and Zonar Systems. The conference offered something for everyone with topics that impact the trucking industry now and in the future on the agenda. American Trucking Associations’ Chairman Pat Thomas opened the conference with an update from Washington. He focused on the significant improvements the industry has made in safety, citing a 74% reduction in largetruck involved fatal crashes per 100 miles driven from 1980 to 2014. Still, he said that despite the general population thinking truck drivers are safer than the average driver, they don’t end up on the news unless something bad happens. Thomas also discussed the economy and ATA’s current priorities in Washington, the Highway Bill being among them. An engine panel examined something else to come out of Washington: New greenhouse gas regulations and EPA requirements. John Moore from Volvo Trucks North America, Mark Francis from Detroit Diesel, Aaron Peterson from

International Truck and Engine, Brian Kent from Northeast Great Dane and John Taylor from Cummins Power Group offered their perspectives on what the GHG and EPA requirements will mean to the industry, the challenges they will pose and the latest changes which have come about. Dr. Jonathan Peters, Professor of Finance from the College of Staten Island and John Andrews, President and CEO of Bestpass, Inc. took on the topic of tolling, its future, and what it could be funding. Peters pointed out that when money is needed for any type of transportation project, the trucking industry is viewed as an easy source of revenue and he likened the Move NY transportation plan to a vampire which keeps coming back in different forms no matter how many times it is “killed.” Andrews offered his experience on the tolling side, asserting CONTINUED ON PAGE 10 u Milepost Magazine • Fourth Quarter 2016

that for many of the reasons Peters explained, tolls are here and they’re only going to increase. He cited the growing trend of all-electronic-tolls which rely on transponders and license plate readers to collect toll dollars via follow-up billing. Andrews addressed talks of a toll interoperability mandate, stating that there have been rumors of such a mandate for his entire seven years at Bestpass. The final session of day one turned to the topic of the thenupcoming presidential election. Dr. Don Levy, Director of the Siena College Research Institute stated what many are now saying in hindsight. “The race comes down to a few key states. States that weren’t in play before, now are,” he said. One of the factors found among his polling which he said made the race unpredictable is that “Americans overall don’t trust either of them.” He said mistrust was not limited to the national level, however, as only 13% of CEO’s polled are confident in New York State’s ability to improve business conditions. Day two of the event kicked off with a compelling account of 10

the trucking industry’s significant role in the recovery efforts following Hurricane Sandy. Dr. Jerome Hauer served as the Security & Emergency Services Commissioner of Homeland Security during the nation’s second-worst natural disaster. Hauer discussed how lives were forever changed as over 300,000 homes were lost during the hurricane, a point attested to by Barry Panicola of Sprague Operating Resources, LLC. During his introduction of Hauer, Panicola touched on the impact it had on his company, family, and town, where thousands of homes are still uninhabitable. “My son went to three different schools that year,” Panicola said. Hauer recounted how preparing for the storm entailed mobilizing hundreds of tractor trailers to enter the worst-hit areas with supplies as soon as they were able to accommodate them. He witnessed drivers not just delivering relief supplies, but helping to make repairs to homes and lend a hand where they could. “I’ve never worked a disaster when I’ve asked the trucking industry for anything you can think of that there was ever a ‘no’ or a hesitation,” he said.

The focus turned to trucking regulations with Brad Georgal from J.J. Keller, who discussed the entry level driver training proposal, published in March, which would require training on 35 topics, both in the classroom and behind-the-wheel. He also discussed the driver medical certification process and reviewed who is exempt and who is not from the electronic logging device rule. Non-CDL drivers within a 150-air mile radius and CDL drivers within a 100-mile air radius are exempt up until the ninth day, as well as intermittent drivers within a rolling 30day period. Additionally, he discussed an “unassigned mileage event,” which occurs when driving mileage is not accounted for due to such things as maintenance and test drives. The conference also featured Rod Suarez, an Economic Analyst from the American Trucking Associations. Suarez explained that the United States is closing the gap on “full employment” with only 1.4 people available for every current job opening, as opposed to over 6 people available for every job opening in CONTINUED ON PAGE 12 u Milepost Magazine • Fourth Quarter 2016

2009. Suarez discussed the trickle-down effect full employment brings, including income growth, but that lower interest rates are hurting spending because people feel that they need to save more money, since they’re not earning much interest in the bank. Back by popular demand, Frank Kerbein, Director of the Center for Human Resources at the Business Council of New York joined the TANY Annual Conference, concluding this year’s event. Kerbein offered a candid analysis of New York’s take on the new federal minimum salary level requirement, which was set to take effect on Dec. 1, but did not following an injunction. This law requires that employees be paid $47,476 annualized,

in order to not receive overtime pay. “New York likes to do everything on their own and a little bit different,” he explained. The classification of all employers needs to be examined, he said, since “exempt” and “non-exempt” classifications are not determined by an employer, rather by law. Additionally, things such as accessing work emails during non-business hours and answering the phone during lunch breaks will also pose a challenge should the injunction be successfully appealed. The Annual Conference closed with a social lunch and plans for attendees to meet again next year: Sept. 25-27, 2017 at The Harbor Hotel in Watkin’s Glen.

Each year, the Trucking Association of New York awards the Albert T. DeRoose Memorial Scholarship to a student whose immediate family member is a member of the association. The scholarship program was established by the association in 1987 as a way to honor Al DeRoose, an industry champion who always placed an emphasis on truck safety. He was also a vocal advocate of higher education.

The winner of the 2016 Al DeRoose Scholarship was Ashley Adair, daughter of Tim and Donna Adair, of Timco Transportation. Ashley is a junior at Rochester Institute of Technology, where she is majoring in Biotechnology and Molecular Bioscience, with a minor in Science, Technology and Society. She plans on pursuing her Masters in Embryology and currently works part time at a biotechnology company in Rochester, in addition to attending school full time.

Additional Benefit Programs Since 2014, National Income Life Insurance Company has been offering an automatic accidental death and dismemberment policy to all TANY member employees, and benefit plans which offer discounts on prescriptions and health services including eye, hearing and dental plans to TANY members whose insurance covers only a limited portion of those services. These are not insurance plans but are designed to supplement existing insurance plans. Any employee of a member company is eligible to participate.
TANY Workers’ Compensation Safety Group The TANY Workers’ Compensation Safety Group was created in 2011, shortly after the New York State Workers’ Compensation Board made the decision to close the association’s Workers’ Compensation Group Trust. Safety groups are workers’ compensation insurance programs that are underwritten by the New York State Insurance Fund (NYSIF). A State Fund safety group is a cost-plus plan for workers’ compensation insurance producing low-cost non-profit coverage for groups of employers with similar operational hazards. As an incentive to group members to operate safely, the State Fund returns generated savings in the form of dividends to the group members. Hence, every dollar saved by a prevented or properly managed claim is a whole dollar returned to group members. Unlike a group trust program, there is no joint and several liability in a safety group. Keevily Spero Whitelaw Insurance manages and runs the safety group and is able to provide quotes on workers’ compensation insurance for TANY members, at a significant discount. Safety Supplies In 2016, nearly 110 companies benefited from the association’s discounted safety supplies including driver medical forms, log books and driver vehicle inspection reports, with members saving an additional 10% over non-members. As a benefit of membership, TANY can provide its members with all of their safety supply needs at lower prices than most of the national retailers. Training Library The Training Library offers the use of hundreds of training DVDs, often valued at $300 or more, to TANY members at no cost. In 2016, dozens of training DVDs were borrowed by member companies, whose only expense was mailing the training material back to TANY! This has proven to be a convenient, cost-saving resource to the membership. A list of available titles is available on the TANY website at www.nytrucks.org.

Membership Committee The Trucking Association of New York’s Membership Committee was established to determine how best the association can meet the changing needs of its members. The committee assesses the needs of the membership and suggests programs and services which may be beneficial to current, as well as potential members. The committee looks at both membership retention and recruitment to determine how best to serve the members, and is responsible for making recommendations to the board regarding new or existing programs. Affinity programs, which are partnerships between TANY and specific service providers, are under the purview of the Membership Committee.
Government Affairs Committee The Government Affairs Committee of TANY was created to develop policies to guide the association’s stand on local, state and national issues. The committee meets via regularly scheduled conference calls and is tasked with: • Advocating for the industry by promoting highway safety; • Providing educational programs and fostering a healthy business environment; • Assisting in developing the association’s legislative agenda; • Reviewing regulatory and legislative issues and assisting in determining the association’s position on those issues; • Reviewing policy and position papers; • Assisting with the development and promotion of the association’s annual visits to legislators in Albany and Washington, D.C.; and • Continuing to develop and enhance the association’s Government Affairs program.
GOVERNMENT AFFAIRS ROUNDUP For the first time in many years, transportation was a high priority issue in Albany during 2016. Right out of the gate, as part of the New York State budget negotiations, there were high level discussions regarding the need to not only restore parity between funding for the transit system and roads and bridges, but to also increase that funding. Much of the credit for prompting those discussions goes to the Rebuild NY Now coalition, a partnership of supporters, including TANY, seeking to raise public awareness

about the issues impacting New York State’s infrastructure. The efforts of the coalition paid off, with the passage of a budget that included $27.1 billion in funding for a 5-year Department of Transportation Capital Plan- the largest in history. The budget also restored parity between transportation and transit funding for the first time in many years. In a long-fought victory for the trucking industry, the state budget included language to transfer management of the New York State Canal System from the New York

State Thruway Authority to the New York State Power Authority. The association has opposed Thruway control of the canal since it was transferred there in 1992. At the time of the transfer the state made a commitment that the canal would not be a drain on the Thruway Authority. However, in the last 24 years, over $100 million of toll-payer dollars has been spent on the canal annually. It has been a long time coming, but TANY applauds Gov. Andrew Cuomo for taking this critical step toward getting the Thruway Authority focus back on its primary mission – maintaining its own roadway.
GOVERNMENT AFFAIRS COMMITTEE Fairness in Contracts (S4173 Nozzolio/A7307 Lupardo) A TANY initiative, this bill prohibits absolute indemnification clauses in motor carrier transportation contracts. The bill passed both the Senate and Assembly unanimously and was signed into law by Gov. Cuomo on November 4, 2016, making New York the 45th state to enact such legislation.
Related to the Thruway Authority, the state budget also included funding to help hold tolls on the Thruway at current rates until at least 2020. TANY appreciates this shortterm relief for the industry but still has serious concerns over the funding for the $4 billion Tappan Zee Bridge replacement, as well as current and future Thruway capital needs and how that may impact tolls in the future. As a result of a lawsuit brought by the Owner Operator Independent Driver Association (OOIDA), the state was forced to reduce the fees for a highway use tax certificate of registration and decal from a combined $19 per truck to $1.50 per truck. TANY appreciates the work OOIDA has done to find relief for their members and will use this recent court case as a step towards full repeal of the Highway Use Tax during the 2017 session. Late in the session, legislation was introduced that would create a “Move NY” plan for New York City. The plan, essentially a congestion pricing scheme, is primarily intended to raise funding for transit, however there is a small carve-out for transportation. TANY has been involved in discussions surrounding the “Move NY” initiative for many years, but has some serious concerns with the legislation that has been introduced. The association will be watching this issue closely in 2017. The 2016 legislative session ended on a high note with the passage of antiindemnification legislation. The legislation, dubbed “Fairness in Contracts,” prevents absolute liability clauses from being included in shipping contracts. TANY recognizes that these indemnification

clauses create a hardship for the trucking industry, particularly small carriers, and has worked diligently for nearly 5 years to pass the legislation. Gov. Cuomo signed the legislation into law on November 4, making New York the 45th state in the nation to have such legislation. Overall, 2016 was not an incredibly friendly year for the business community at large with the passage of a minimum wage increase and paid family leave. However, the association was pleased that many TANY priorities were addressed, providing both administrative and cost savings to our members. Over the course of the 2016 session, TANY tracked nearly 50 different pieces of legislation that were of interest to the trucking industry. The primary bills of interest are:
Municipal Fines (S6422 Avella/A9249 DenDekker) Passing with little fanfare, but important to the trucking industry, this bill prevents municipalities from collecting administrative fees when a traffic ticket is dismissed. The passage of this bill provides relief for carriers that have had instances of multiple traffic tickets getting dismissed by a court but still being left with hundreds of dollars of administrative fees to pay. Gov. Cuomo signed the bill on March 21, 2016. Move NY Plan (S8089 Lanza & A9633 Rodriguez) This legislation would create a congestion pricing zone in New York City south of 60th Street. Tolls on currently tolled East River crossings would be reduced, however tolls would be reinstituted on the currently free East River crossings. Additionally, gantries would be placed along 60th Street and tolls would be collected to enter what is called the “Central Business District” in New York City. While there are some small concessions included in the legislation for the trucking industry, TANY is concerned with the overall impact of the “Move NY” plan. The legislation was introduced late in the session and was not voted on by either house. TANY will watch it closely in 2017.
CALL ON ALBANY AND CALL ON WASHINGTON In April, 16 TANY members participated in ATA’s Call on Washington program. They met with congressional members and staff as well as senate staff to discuss issues impacting trucking. They focused on legislation to preserve the 34-hour restart provision without the 1:00 a.m. to 5:00 a.m. back-to-back breaks and the need to modify the Federal Aviation Authorization Act of 1994 to make clear the original legislation
that preempts state laws from passing meal and rest break requirements on interstate trucking and state bans on “piece rate” pay. In May, TANY and the Government Affairs Committee hosted Trucking Moves NY Day at the Capitol. Sixteen members met with elected officials discussing the issues and concerns of the industry in New York. Fairness in Contracts, Highway Use
Tax, and reopening closed rest areas were the main issues focused on this year. In addition, Truckers Against Trafficking brought their Freedom Drivers Project trailer to downtown Albany and parked it on the street outside the state Capitol, allowing legislators, staffers and members of the general public the chance to understand the trafficking issue.

Safety Maintenance Management Council The Trucking Association of New York Safety Maintenance Management Council (SMMC) develops, promotes and organizes all phases of safety and maintenance activities for the association and serves as a resource to the association by providing training and education to the membership. Additionally, the SMMC is involved in outreach efforts which help educate the public about interacting safely with trucks on the road. Comprising safety and maintenance personnel employed by TANY members, the council works toward developing standards and best practices for the industry.
TRAININGS Smith System Driver Trainer Course/ Smith System Recertification Course Five members received their Smith System Trainer Recertification following the 3-day course in Clifton Park in September. Six attendees became certified Smith System Driver Trainers through the Smith System Driver Trainer Course held for five days in Clifton Park in October.
Heavy Advanced Braking Systems Over the course of 2016, 63 technicians attended five two-day Heavy Advanced Braking Systems trainings. The courses took place in Tonawanda in April and May, in Farmington in July, in Tonawanda in August, in North Syracuse in October and in Tonawanda in November and December. You: The Inspector Nearly 90 people attended three You: The Inspector trainings held in Tonawanda in March, in Saratoga Springs in April and in North Syracuse in May. Electrical Systems Training Nearly two dozen technicians attended two two-day Fundamental Engine and Electronics Trainings in 2016. The courses took place in Marcy in July and North Syracuse in November.

Operation Safe Driver: Train the Trainer The Operation Safe Driver: Train the Trainer program was attended by nearly 30 members during the half day training in Lancaster in August. Heavy Duty Braking Systems Twenty one people were trained during the day-long Heavy Duty Braking Systems Course held in Champlain in March.

PUBLIC OUTREACH EVENTS Share the Road Over 700 students in 23 Driver Education Classes in New York were trained in the Share the Road Program by TANY member Walmart Transportation in 2016.
Job Fairs The SMMC held two Trucking Industry Job Fairs in 2016. The first was held in Rochester in March, and the second was held in the Albany area in December, to high praise. Hundreds of job seekers met with dozens of potential employers who were looking to fill trucking industry vacancies.
No-Zone Demonstrations TANY members were involved with no-zone demonstrations across the state in Buffalo, DeWitt, Mount Sinai, Owego and Syracuse. Member companies Clinton’s Ditch Co-Op, Inc., NOCO Energy Corporation, Sprague Operating Resources, LLC and Walmart Transportation provided equipment and volunteers for the events. In total, over 4,000 people were educated on the blind spots surrounding large trucks.
TRUCK DRIVING CHAMPIONSHIPS A total of 99 drivers competed in the 58th Annual New York State Truck Driving Championships in Syracuse on June 10 and 11. Golden Wrench Award
The Golden Wrench Award is given by the TANY Maintenance Council to recognize excellence among heavy vehicle technicians in New York State. For 2015, four technicians were presented with regional awards, while one was named the statewide winner. Chris Beckhans of Hub Truck Rental Corporation is recognized as the winner of the 2015 Statewide Golden Wrench Award by TANY President Kendra Hems during the 2016 Annual Conference & Membership Meeting in September. Beckhans was unable to attend the April ceremony due to illness and the award was accepted on his behalf.

Meetings and Regional Events Throughout 2016, the Trucking Association of New York held numerous meetings and conferences, including Town Hall Meetings, the Truck Safety and Education Symposium & Safety Exhibition, oversize and Overweight Training, and the Annual Conference & Membership Meeting. Members of the individual regional chapters were also active, holding both social and educational events to meet the needs of the association members within their regions. The five regions of TANY are: Central Region - Broome, Cayuga, Chenango, Cortland, Delaware, Herkimer, Jefferson, Lewis, Madison, Oneida, Onondaga, Oswego, Otsego, St. Lawrence, Tioga and Tompkins counties. Eastern Region - Albany, Clinton, Columbia, Dutchess, Essex, Franklin, Fulton, Greene, Hamilton, Montgomery, Orange, Rensselaer, Saratoga, Schenectady, Schoharie, Sullivan, Ulster, Warren, and Washington counties. Genesee Region - Allegany, Chemung, Livingston, Monroe, Ontario, Schuyler, Seneca, Steuben, Wayne, and Yates counties. Metro Region - Bronx, Kings, Nassau, New York, Putnam, Queens, Richmond, Rockland, Suffolk and Westchester counties. The Eastern, Central, Western, Genesee, and Metro Regions held a total of seven Oversize/Overweight training courses in January and February. Over 250 attendees were provided with an overview of special hauling and divisible load programs, including a new online permitting system.

Seventeen people attended an Eastern Region DOT 101 training in Selkirk, where they heard from NYSDOT the rules and regulations dispatchers should know when dispatching their drivers, as well as the impact of CSA scores.
The New York State Truck Safety and Education Symposium and Safety Exhibition was held April 5-6, at the Saratoga Springs City Center. More than 200 attendees and 19 vendors learned about safety and compliance issues pertaining to “Trucking in the Technology Age” over the course of the event.

The Eastern Region held a Touch-a-Truck event in conjunction with Bestpass, Inc. and Zappone Chrysler Jeep Dodge Ram at Zappone’s Clifton Park dealership on May 21. Dozens of TANY members participated through sponsorships, equipment donations and volunteering. The event drew hundreds of people, many of whom sat in a big rig and learned about the No-Zone. The event benefitted Veteran’s Count, a program benefitting military veterans and their families.
