than 3,400 communities that currently participate in the program, which is sponsored by the Arbor Day Foundation in cooperation with the USDA Forest Service and the National Association of State Foresters. The Arbor Day celebration is one of four requirements necessary to maintain its designation. The Town must have: a tree board or department; a tree care ordinance; a community forestry program with an annual budget of at least $2 per capita; and an Arbor Day Observance and Proclamation. Last year, Southwest Ranches also earned the Tree City USA Growth Award, which recognizes environmental improvement and encourages higher levels of tree care throughout America. The Town received the award in the area of Planning and Management by developing open space with major tree planting; conducting a baseline inventory and analysis of all street and/or park trees in the Town; and protecting and enhancing Wildlife Habitat. Town officials are hoping to win the award again this year.

he residents of Southwest Ranches have an opportunity to enjoy the Town’s beautiful parks and rural landscape on a daily basis. In fact, Southwest Ranches has almost as many trees as residents. On January 20, from noon to 1:30 p.m., the Town will celebrate Arbor Day, a holiday which encourages tree planting and care. Although National Arbor Day is the last Friday in April, Florida observes the holiday on the third Friday in January. Town officials will plant a sapling in front of Town Hall and light refreshments will be served. The Town will also implement an art/essay contest in the schools and the winning entries will be displayed in the Town Hall. “The value of trees is immeasurable,” said Town Arborist December Lauretano-Haines. “The Arbor Day celebration helps create awareness of their many benefits. Trees reduce heat, provide shade, increase property values, help clean the air, provide a habitat for wildlife and so much more. They also beautify the community.” The Town of Southwest Ranches has celebrated Arbor Day since 2007, when it earned the distinction of becoming a Tree City USA. It joined more

an annual tradition. In 23 years, they have not missed a dance. “We both look forward to it each year,” said Robert. “We have a lot of fun together. It is nice, quality bonding time.” Laura has created a scrapbook to chronicle her special “dates with dad”. It includes the event tickets, themed portraits, place cards, and other items from each dance. When Robert and Laura first started attending, the venue was just a short drive from their Cooper City home. Once Laura left for college, it involved much more effort. ach year, on the third Monday of January, the nation celebrates the birth, life and dreams of Dr. Martin Luther King, Jr. It remembers the injustices that Dr. King fought in his quest for the freedom, equality, and dignity of all races and peoples. On January 15, Davie residents will have an opportunity to honor his dreams and vision during the Dr. Martin Luther King, Jr. Day Poster, Essay Contest and Picnic Celebration at Potters Park, from 1 to 4 p.m. Hundreds are expected to attend the celebration, which will include a climbing wall, bounce house, petting farm, free lunch (while supplies last) and more. The Town of Davie has sponsored the free event for more than 20 years. The winners of the Town of Davie’s MLK poster and essay contest will also be announced at the picnic. The Town Mayor and Town Council members will award Rosettes for the best theme posters and essays in each overall grade level from participating schools. The winning posters will be on display and the student authors will read their winning essays. The annual contest educates and informs students of the lifetime achievements of this great Nobel Peace Prize-winning American. All schools and non-profit groups in Broward County are invited to participate. This year’s prompt is “…out of the mountain of despair, a stone of hope.” It is taken from Dr. King’s 1963 speech and is also inscribed on the main statue at the Martin Luther King, Jr. National Memorial in Washington, D.C. Students in grades K to 8 design small posters, while high school students write an essay that is 250 words or less. Four winners from each grade level are selected. “Martin Luther King was an extraordinary man,” said Beverly White, who attends the picnic every year to see the posters and listen to the essays. “He stood for peace, justice, tolerance and so much more. His message is still very relevant in today’s world.”

On Nov. 5, the Town of Davie and Greenway Golf announced the opening of the new Davie Golf & Country Club, formerly known as the Arrowhead Golf Course. Chiropractic? Why Not? “A Doctor’s Confession toWest Broward”
Dear Friend, want to give credit where credit is due. So, perhaps a confession can help clear the air so there’s no misunderstanding. Before I talk about my confession, though, let me say a few other things first. Let me start by explaining the photo in this letter. You know, when I meet people in town they usually say, “Oh, yeah, I know you, you’re Dr. Rick. I’ve seen your ad with that picture of you and your family.” Well, I’m the guy on the right. he World Health Organization released some disturbing facts about falls. It warned that nearly 500,000 individuals in the United States die each year from falls. As such, falls are the second leading cause of accidental or unintentional death from injury each year. In addition, of the approximately 38 million falls that occur each year, more than half are significant enough to require medical care. The portion of the population most at risk for falls is the elderly and children. Children are highly susceptible to falls because their bodies are still developing. They are also naturally curious about their environment and, as they grow, insist on more independence and take on risk-taking behaviors. The elderly are at the highest risk of death or serious injury due to a fall with such risk increasing with age. In fact, the death rates from falls are highest among adults 60 years and older. Senior citizens are more prone to falls because of bodily changes brought about by aging and also because their environments are not well adapted to their needs. Homes are a frequent site for falls. According to the NIH Senior Health, six out of every ten falls occur at home, where we often move around without thinking about our safety. Here are some tips to help prevent home accidents and injuries:
▸▸ Do not walk around in socks or stockings. ▸▸ Be sure rugs have skid-proof backs or are tacked or taped to the floor. ▸▸ Use non-skid bath mats in the bathroom. ▸▸ Make sure stairs are well lit and have railings on both sides. ▸▸ Keep a flashlight and a lamp near your bed. ▸▸ Replace satin sheets and comforters with ones made from non-slip material like cotton. ▸▸ Place lights in the staircase and along the path from the bedroom to the bathroom. ▸▸ Reduce clutter—boxes, newspapers, cords, toys—especially in bedrooms and walkways. ▸▸ Repair loose tiles or wooden floorboards immediately. ▸▸ Quickly remove liquids, grease or food spills on the kitchen floor. Considering the frequency of falls, you would think people would exercise extreme caution to prevent falling. Yet statistics show that this is not the case. If you have not been giving it much thought, start doing so today. By watching your health and improving home safety, you can reduce the risk of falling and better protect your loved ones. Enhancement of facial appearance by skin excision can be performed with a minifacelift if neck skin laxity is not an issue. This procedure typically involves making an incision from the top of the ear to the earlobe and is placed in front of the ear along the natural contour of the ear. If neck banding and laxity is present, then the incision can be extended behind the ear to allow for tightening of the neck skin and platysmal muscles. Depending on the length of the incision, the procedure is referred to as a short scar facelift or “S” lift or “lifestyle lift” or “feather lift”. A facelift can be done alone, or in conjunction with other facial rejuvenation procedures such as an endoscopic brow lift, eyelid lift, or laser resurfacing around the mouth or eyes. Performed under local or general anesthesia, a facelift, also known as rhytidectomy, removes the excess skin around the jaw and neck is removed and the skin is pulled back to reveal a tighter, more youthful appearance. Although a facelift will improve and enhance the contour of your face and jaw line, it will not correct sun damage or fine wrinkles that have developed on the skin’s surface. To treat these conditions, additional skin care will be needed, which is also available at the Weston Cosmetic Surgery Center. These options can be discussed during your initial consultation.

s members of Girl Scouts of Southeast Florida Troop #11102, Melissa Ellett, Kaci Weekley and Kaitlyn Groselle are dedicated to making the world a better place. The three girls recently earned Girl Scout Gold Awards, the highest achievement in Girl Scouts. They joined the ranks of generations of young women who have made a difference, both locally and globally. In order to earn the Girl Scout Gold Award, each of the Cooper City girls had to complete a project that would make a mark on their community and create a lasting impact on the lives of others. They had to develop a plan, raise funds, find helpers and take action. They also had to share their experience with others. Melissa Ellett, 16, has been a Girl Scout since she was a Daisy. She has earned Bronze, Silver and Gold Awards. Her Gold Award project was inspired by Michelle Obama, who teaches youth about the importance of eating healthy foods and staying fit. Melissa built a National Wildlife Habitat and Vegetable Garden at the Rick and Rita Case Boys and Girls Club in Davie. “I wanted these children to understand that everything they eat affects their overall health,” said Melissa. “I also wanted them to know that eating right can be affordable.” For her project, Melissa needed plants, soil, mulch, stepping stones, bird feeders and other materials. Some of the items were donated by Lowes and Costa Farms and she raised money to pay for the rest. It took approximately a week for Melissa’s crew to dig up the grass, rake the soil, spread the mulch and dig holes to prepare for planting. A few months later, Melissa and the kids from the Club harvested the crops, which included tomatoes, peppers, carrots, lettuce, sunflowers and other vegetables. The Boys and Girls Club is now managing the Garden. Kaitlyn Groselle, 17, has been in Girl Scouts since she was a Brownie. She has earned Bronze, Silver and Gold Awards. Kaitlyn likes to bake and loves arts and crafts, so her Gold Award Project centered around two “cake” projects.

She also held several cake decorating classes, where she taught kids how to make flowers,

any homeowners are under the false impression that they should file for bankruptcy protection the moment they fall behind on their mortgage payments. However, every consumer must be aware that bankruptcy should only be filed as a last resort, when absolutely necessary, and when all else fails. Based upon our experience in handling hundreds of consumer collection matters, foreclosures and bankruptcy cases, there are really just a few instances when a client must file for bankruptcy protection. One such situation is after a final foreclosure judgment has been entered and the homeowner is only days away from a public auction of the home. Filing for bankruptcy protection at this time will automatically cancel the foreclosure sale, and will provide the homeowner with some valuable time to complete a loan modification application or prívate short sale of the home prior to a public auction. Filing for bankruptcy protection at the outset of a foreclosure proceeding is highly unadvisable, especially in view of the fact that in 2010 the average time to complete a foreclosure in Broward County was 600 days. Several other instances when a bankruptcy filing is appropriate are when a debtor is facing a garnishment of wages, seizure of his/her bank accounts, or when a creditor is attempting to repossess property or a vehicle after a final judgment. Under these limited circumstances, filing for bankruptcy makes absolute sense given that there is no time and possibly no legal grounds to attack the collection process in court. However, if a bankruptcy discharge is obtained too early, a consumer will not be able to file for bankruptcy protection again for another 8 years. The preferred type of bankruptcy is a Chapter 7, assuming that your monthly expenses exceed your income. If you qualify for a Chapter 7, all credit card debt, unpaid medical expenses, and all other unsecured debt is wiped out completely. Unfortunately, any debt owed to the federal government for student loans or IRS debt will not be wiped out in a bankruptcy. You also may not qualify for a Chapter 7 bankruptcy if you have other assets which you could sell to cover your debts. In that case, you may have to file under Chapter 13, to restructure your debt, and slowly pay all past due amounts over a period of 3 to 5 years. The bankruptcy code is not easy to navigate. If the bankruptcy petition is not presented correctly, not only will you not qualify for bankruptcy protection, but you may also be prevented from re-filing for 180 days or more. Legally Speaking Will I Need an Expert Witness? By Evan Baron

ften times, if the dissolution of marriage is a bit complex, it may be in a client’s best interest to retain an expert witness. Expert witnesses can testify about a great many aspects of a dissolution. As an attorney representing one of the parties, I cannot testify about a particular matter, since I am not a witness. In addition, some matters are beyond the knowledge or expertise of the average person and therefore someone with greater qualifications may be necessary. For instance, a homeowner may believe he/she knows the value of his/her home, but in actuality only a licensed appraiser can actually testify about the value of a home if in fact that issue is in controversy. The rules of evidence in court also prevent certain matters from being presented to a judge through a third party. This is commonly referred to as “hearsay”, which prevents a person from testifying about what another person may have said outside of the courtroom. Often times a client will tell me what one of their children may have said, because they want me to present it in court. Such testimony is not admissible because it is the hearsay statement of a third party. However, if a Guardian Ad Litem is appointed to the case, these statements, or at least a summary of the child’s concerns or fears, may be admitted through this expert. Here are some examples of experts which are commonly used in my cases: ▸▸ Accountant: Used to testify about earnings, business income, tax issues and possible hidden assets. Can also be used to assist in the equitable distribution of assets and debts as well as the need for alimony, based upon a lifestyle assessment. ▸▸ Guardian Ad Litem: Used to assist the court with issues concerning minor children. Appointed to represent the best interests of the children. The Guardian can interview the children, parents, family members, school teachers and any other individuals with possible relevant information. The Guardian will testify in court if necessary, because as a general rule, with very limited exceptions, minor children will not testify. ▸▸ Property appraiser: Will testify about the value of real property, such as a home or office building. ▸▸ Psychologist: Can testify about psychological evaluations of children or parents. If not court appointed can be prevented from testifying due to privilege between patient and therapist. ▸▸ Vocational Expert: Used when a spouse’s earning ability is in question. This expert can testify as to the ability of a spouse to obtain employment as well as his/her earning potential. Not every case requires the assistance of an expert. Often times, the need for an expert is balanced against the financial ability of the client. Unfortunately, often times an expert is an unaffordable luxury.

s the housing ship starting to make its turn? When asking such a question as this, one must turn to the experts who do extensive research in our field. According to Florida International University’s Real Estate research website, “these are interesting times. Because real estate is the largest asset class for investment, it is essential that all market and policy makers and anyone in business understand how real estate markets work and how they are integrated with our overall economy. Real estate is an essential part of our economic and social systems. Hence, we are required to understand its place and discern fact from fiction.” As each of us watch the news and attempt to decipher for ourselves what is really going on in our marketplace, it would behoove us to look at the market trends for our area. Real Estate is, and will always be, a local affair. The question still exists, however, as to whether it is better to rent or to buy? Are we becoming a society of renters? Ken Johnson, editor of Journal of Housing Research at FIU, asked this same question in his recent presentation: “Is the US going to become a nation of renters rather than buyers?” His research proved that: “Markets are presently presenting excellent buying opportunities based on historical property appreciation rates . . . and markets are presently at unprecedented levels of affordability especially when considered in terms of monthly mortgage payments.” Even though there was still some cause for renting, Mr. Johnson further reported that: “Homeownership enhances civic pride and improves voter turnout and contributes to better societal outcomes – less crime, a better familial environment, etc.” His report summarized that: “There are just too many benefits (financial and non-financial) to ownership versus renting for the nation to move away from ownership and into renting as the largely preferred housing status.” His report concluded that: “Taking all of this together, the evidence suggests that equilibrium forces . . . are presently in place that will preserve the “American Dream” of home ownership. (Send me an email if you would like to see Mr. Johnson’s complete report.) Then why do people still insist on renting? Is it the “I don’t want to be tied down” mentality? Are renters typically spenders or savers? Here’s where renters get stuck: According to the Wall Street Journal: “Renters need to invest all the money they save.” Homes are a forced savings account through the building of home equity and especially as monthly mortgage payments become more competitive with rental payments.

▸▸ Examine the housing market: Study the Facts & Trends market analyses for your area as well as properties available for sale, short sales and foreclosures with a trusted professional Real Estate agent. ▸▸ Consider your costs: Consider the down payment, closing costs, Homeowners Association dues and repair costs.
