publisher’s page Spring Is in the Air and Summer Is Not Far Away

I

t’s hard to believe, but the tropical South Florida heat is with us again. The sun is burning down and the air conditioners are humming at full blast. While we are trying to decide between pool or beach, our kids are already looking forward to their summer break, and we are hurriedly making last minute arrangements for summer camps and family vacations.

In the midst of all this, Spring is passing us by and Mother’s Day has “sneaked up” on us. Let’s take a little pause and honor our mothers (and our wives) for they are always working hard to care for us, look after us, and pamper us. Let’s pamper them for a change! Have a fantastic Mother’s Day celebration! Sincerely,

SvenSvenBudzisch Budzisch Publisher/Owner

Positive Parenting From Generation to Generation By Jodi Kurry Cohen, MS.Ed, Director of Early Childhood Programs Temple Dor Dorim Early Childhood Center

T

his year I lost both my grandmothers, bringing me to the hard realization that all of my grandparents are gone. I realized there’s something that happens when you lose people who were so much a part of your childhood. Their passing opens up a floodgate of memories that brings you back to the time when you were tiny, growing up, and you see that person as they were, so many years ago. Recently, when writing my grandmother’s eulogy, I seemed to recall silly things like brushing my teeth over my grandma’s toilet (her solution to me not being able to reach the sink) and the little glass bowls of candy she had strategically placed in spots I had memorized around her house. I envisioned her in a green dress baking cookies and I remembered playing dress-up with her handbags and hats, painting my face with her bright lipsticks, and dousing myself in her assorted perfumes. I also recalled emotional moments like watching my grandmother dote on my grandfather, the way she hugged me when I was hurt or squeezed my hand in a difficult moment, and how she beamed with pride at my graduations. Most of all, I recalled her words of wisdom: “If you feel the urge to laugh at an inappropriate time, think sad thoughts” or “It will be what it will be,” and I realized the impact her words had made on me. Fostering the love between a child and their grandparent, can be one of the most rewarding relationships in a child’s life. If children are fortunate enough to have

grandparents, or even great grandparents, in their lives there is so much more to be nurtured in a relationship beyond the occasional meal or holiday. There are lessons to be learned, unique experiences to be had, and a familial tie to be developed that can be carried on from generation to generation. When grandparents live close by, weekly visits and special trips to such places as a museum or the zoo are great ways to bond. Finding a hobby to do together like a craft or magic are also great ways for generations to connect. It’s not as easy when grandparents live far away but that doesn’t mean this challenge can’t be overcome. It may mean vacations planned specifically to spend time with grandparents, books read on “laps” or hobbies that are shared via Skype, Face Time and phone calls that are frequent. Whether grandparents live close or far, it comes down to priority and the effort made to carve a niche of time each week to form those special ties. Being reminded of just how precious those relationships were for me as a child, I’ve vowed to make sure, while the opportunity is there, that my children continue to grow these special bonds. Jodi Cohen has a Masters degree in Elementary and Early Childhood Education as well as a Bachelor degree in Psychology. Jodi has led many workshops on parenting, behavior modification techniques, curriculum development, special needs training and crisis management. She has been the Director of Temple Dor Dorim’s Early Childhood Center in Weston for the past 12 years. community news Davie Honors Veterans By Debby Teich

O

n May 30, Davie families will gather for the Annual Memorial Day Parade, Service and Family Cook-out to pay their respects to the men and women who died while in the military service. The festivities will begin with the Memorial Day Parade at 10 a.m., presented by the Scoutmasters Camporee Committee South Florida Council and Boy Scouts of

America. More than 60 groups will participate, including scouts, Davie Police and Fire Rescue, military organizations, local politicians and more. The parade will proceed down Davie Rd., beginning at SW 39th St and ending at the Bergeron Rodeo Grounds. “Bring your family, friends and a lawn chair and celebrate Memorial Day with the Boy Scouts,” said Special Projects Director Bonnie Stafiej. Following the parade, at 11 a.m., a Memorial Service will take place at the Bergeron Rodeo Grounds. More than 1,500 people are expected to show their support for our soldiers and acknowledge the sacrifice they have made and are making to ensure the country’s freedom. Soldiers who fought in each of the different wars will be recognized during a moving ceremony that includes a 21-Gun Salute. The public will have an opportunity to place a flag on a veteran’s graves. The flags will be available prior to the service for $1. After the service, there will be a family cook-out with live music, food, drink and fun. The event is sponsored by the Veterans of Foreign Wars, Davie Post #9697, whose 615 members have all fought in combat. The Veterans will be cooking hamburgers, hot dogs and Sloppy Joes and the Ladies Auxiliary will be selling baked goods. They will also be collecting donations for red poppies to help disabled veterans. All of the proceeds from the family festival will benefit Veterans of Foreign Wars Post #9697. “We will remember all of our friends that fought in wars and did not come home,” said Stuart McLees, Commander of Post #9697. “We hope you will come out to support your local Vets.” For information, visit www.davie-fl.gov, call 954-797-1163 or send an email to bonnie_stafiej@davie-fl.gov.

community news Davie Residents Participate in 15th Annual Waterway Clean-Up By Debby Teich

T

he message from Davie’s recent waterway clean-up was clear. Davie residents are proud of their community and want to make sure that it is litter-free. On March 26, more than 450 volunteers gathered for the 15th Annual Waterway Clean-up, sponsored by the Central Broward Water Control District and the Town of Davie. The effort, which started with a group of volunteers gathering on a Saturday, has grown into a major event involving school clubs, boy and girl scouts, religious and non-profit organizations, local families and individuals. Each of the volunteers was assigned to a small area along the C-11 Canal. In total, they cleaned more than eight miles along Orange Drive and Griffin Road, between State Road 7 and Flamingo Rd. “The event is a great way for these volunteers to give back to the community,” said Special Projects Director Bonnie Stafiej. “It is also a good way to remind them that it is important to keep our waterways clean.” The campaign seems to be working. Volunteers used to find cars, refrigerators, air conditioners and other large items. Each year, however, they find fewer large items and less trash. In return for their efforts, participants received com-

munity service hours, a free Waterway T-Shirt and a ticket for admittance to the “Trash Splash after the Clean-Up Party” held at Pine Island Park Pool, with free food and a DJ. Carole Davis’ two children participated in the clean-up. Her children are very concerned about the environment and have scolded people for throwing empty fast food

bags and other trash out of their car windows. “I cannot believe how much they collected,” said Davis. “So many people litter without thinking about what it will do to the environment.” For information, visit www.davie-fl.gov.

F

ifteen-year-old Rachel Franchesca Marvilli has always dreamed of becoming a princess. Now she is a queen. She was recently crowned Miss Weston Teen USA 2012. The Cooper City teen entered five pageants prior to winning the Weston title in February. She competed against seven other delegates, who were all judged based on interviews, swim suits and evening gowns. “I am proud to be able set a good example for other teens,” said Rachel. “I have met so many interesting and important people through the process.” She plans to compete for the Miss Florida Teen USA in October. Rachel is used to working hard to achieve the things that are important to her. She has been a professional model since she was five-years-old. She enjoys dancing, as well as singing in English and Spanish. She has also been a competitive skater since she was seven-years-old. She practices five days a week and hopes to skate in the Olympics one day. Most of all, however, Rachel enjoys helping others. Two years ago, she started the RFM Foundation to reach out to those in need in the community. She volunteers on a regular basis at the Joe DiMaggio Children’s Hospital. She visits with the children and brings them toys, clothes and arts and crafts. “I get so much joy out of making them happy,” said Rachel. She plans to become a medical physician assistant so she can continue her efforts to help others throughout her career.

lthough Rebecca Whittaker of Davie was only six years old when she rode her first horse, she immediately knew that she had discovered her passion. She made up her mind that she would ride in the Olympics one day and has been pursuing her goal ever since. Her performance at the Wellington Equestrian Festival last month proved that she may be well on her way. After competing against riders from all over the world during the 12-week festival, Rebecca was named the new Circuit Champion in the Low Children’s Jumper Division. The fifteen-year-old trains at Competition Farms in Southwest Ranches and was the first rider at her barn to win a circuit competition. Her victory was the result of a lot of hard work and sacrifice. tice riding and take care of her horse Cartier after completing her honors and Advanced Placement classes at Western High School. She also spends several hours at the barn on weekends. When she is at home, she watches videos and reads books about riding. She has missed birthday parties and given up time with her friends to ride. “It has been difficult to find the perfect balance between riding, school, and friends, but I know what I have to do to achieve my goals,” said Rebecca. “I also know that there are no short cuts. The most important thing is to stay positive and have a good attitude. I have developed a very close bond with my horse. We have learned to trust each other. When something unexpected happens, I focus on how to fix it so it does not happen again.” Rebecca has set a series of short term goals in her effort to reach the Olympics. She plans to compete in Chicago this summer and hopes to move up to the Junior Division in next couple of years. She wants to attend Brown University as a member of their Division One riding team. She also wants to become a professional rider. “Rebecca is skilled, determined and hard working,” said her trainer Erica Garcia. “She does whatever it takes to win and will go very far.” Rebecca wants others to love riding as much as much as she does. She has learned a tremendous amount from her mentor and idol Georgina Bloomberg and believes it is her responsibility to serve as a role model for the younger kids at the barn. She teaches them to ride during camps and helps them train for competitions. “Riding is such an incredible sport,” said Rebecca. “I would encourage everyone to try it.”

fitness forum Five Reasons That Diets Fail Ellen Latham, MS

S

o, many clients who work out at my facility refer to themselves as Professional Dieters. They have tried every weight loss plan, scheme, and promise under the sun and have failed over and over. The following five reasons are usually the reasons why.

Reason #1

They were not ready to make a full time commitment. Weight loss is at least 50% attitude. Do you want the truth? Do not start a weight loss program unless you are ready. ADVICE: Do some serious soul searching and figure out what your personal motivation is to shed the extra weight. The motivation has to come from you. Then you need to recharge that motivation everyday if you are going to make it. I am a firm believer that short term goals are more important than long term goals in this situation.

Reason #2

You expect miracles. You have unreasonable expectations in regard to how much weight you should be losing. You will end up very disappointed and fall off the wagon. ADVICE: I know you are looking for that quick fix. It does not exist, even if that infomercial says you will lose 20 pounds in one hour. Snap out of it. If you stay slow and steady you will be on your way to fantastic end results.

Reason #3

You’re on a ridiculous plan. If you’re following an extreme weight loss plan (i.e. the cabbage soup diet) where it does not remotely resemble normal eating, there is a good chance you will fail. You may lose some weight but I guarantee it is back on within a week. ADVICE: A good food plan is based on healthy foods that keep you satisfied and energized, not cranky. This food adjustment should be a launching pad for long term lifestyle change.

Reason #4

You had a breakdown and ate two pieces of cake and started falling apart. You tell yourself, “I already ruined everything so I might as well give up.” ADVICE: Don’t dwell on your mistakes. Instead, shake it off and get right back on track at your very next meal…..or the next day

Reason #5

You do not include proper fat-burning, metabolism-raising exercises in the mix. ADVICE: A fast metabolism is critical to burning fat and managing body weight. The more muscle you use the more calories you burn. Intervals on the treadmill and multi and single joint weigh training are the best. May begins a new month of the Biggest Loser Contest. Anyone interested in this four week program of exercise and food coaching to lose 10 to 40 pounds in 4 weeks (that is our weight loss statistically) should call 954-472-9440.

ask the expert What is Gynecomastia? By Dr. Charles Messa

T

he term comes from the Greek words gyne meaning “woman” and mastos meaning “breast.” In practical terms, this means abnormally large breasts on men. The condition is relatively common in adolescent boys, and 90% of the time symptoms disappear in a matter of months, or as adolescence wanes, a few years later. But the remaining 10% are burdened with a social handicap that can cause shame, lowered self-esteem and confidence. There are many potential causes including puberty, steroid abuse, obesity, marijuana use, side effects of medicine, and certain genetic diseases. Gynecomastia can be emotionally devastating. A man or boy with gynecomastia struggles with anxiety over such simple acts as taking off his shirt at the beach. In cases of obesity, weight loss can alter the gynecomastic condition, but for many it may not totally eliminate it. For all other causes, surgery is the only known physical remedy, and often the best solution. Once the contour of the chest is restored to normal, the patient can begin to feel more confident and self-assured with his physical body image. Plastic surgery to correct gynecomastia is technically called reduction mammaplasty and reduces breast size, flattening and enhancing the chest contours. In severe cases of gynecomastia, the weight of excess breast tissue may cause the breasts to sag and stretch the areola (the dark skin surrounding the nipple). In these cases the position and size of the areola can be surgically improved and excess skin may be reduced. The procedure can be performed under intravenous sedation or general anesthesia depending on each individual’s medical condition. In cases where gynecomastia is primarily the result of excess fatty tissue, liposuction techniques alone may be used. There are various liposuction techniques that may be used; the technique most appropriate in your case will be defined prior to your procedure. Excision techniques are recommended where glandular breast tissue or excess skin must be removed to correct gynecomastia. Excision also is necessary if the areola will be reduced, or the nipple repositioned to a more natural male contour. Incision patterns vary depending on the specific conditions and surgical preference. Sometimes gynecomastia is treated with both liposuction and excision. Any surgical treatment to correct gynecomastia will require incisions. While most incision lines are concealed within natural contours, some may be visible and are a necessary result of breast reduction surgery. After surgery, dressings or bandages will be applied to your incisions and an elastic bandage or support garment may be used to minimize swelling and support your new chest contour as it heals. The procedure duration is typically one to two hours and most men are able to return to work within 4 to 5 days depending on how much lifting is required. After the procedure you will be given specific instructions that may include how to care for your surgical site(s), medications to apply or take orally to aid healing and reduce the risk of infection, and when to follow up. Men often have a very difficult time talking about their breasts to anyone, but it is the first step toward relief. If you have additional questions regarding gynecomastia, you can schedule an individual consultation with me by contacting my office at the Weston Cosmetic Surgery Center 954- 659-7760. www.davietowntimes.com

community news Will the Real Housewives of Forest Ridge Be Next? By Debby Teich

T

he Real Housewives of Miami is Bravo’s newest show in the series, but the Housewives of Forrest Ridge could be next. Members of the Forest Ridge Woman’s Club love to follow the lives of the characters on the LA series. The women on the show recently had a “White Party” that looked like fun so club members decided to have one of their own. On March 31, the women got together for a “Real Housewives of Forest Ridge - All White Party,” hosted by Janis McKendry and Diane Bossle. Marcelo, of Creative Design, donated his services so the women could have their hair and makeup done for the event while they sipped champagne. They dressed in all white and had a great time. “We can identify with the women on the show because we are a group of real housewives who get together for events,” said club president Beverly Payne. “I am convinced, however, that we have a lot more fun.” Payne started the club nine years ago after she moved to Forest Ridge. She was not working and her son was in college and she found it difficult to meet people. She realized that she was not alone when 35 people showed up for the first meeting. “Women

need girlfriends to share the good times and the bad times,” said Payne. The club’s 62 members live in Forest Ridge and the Ridge on Nob Hill. They meet once a month at a different member’s home. The hostess provides a main dish and the rest of the group brings wine and food to share. Although they are all in different stages of their lives, they have one thing in common. They are all seeking camaraderie and friendship. Most of their time is spent caring for their husbands and children or volunteering in the community. They meet once a month just to focus on themselves. When club members are not feeling well, want to sell something, or need a roofer, they can bring it up at a meeting or post it online and they can always find the help they need. “We talk, laugh and just have fun,” said Payne. “We are a major support system for each other. This is the best group of women I have ever known.” New members must live in Forest Ridge or the Ridge on Nob Hill. Annual dues are $35. For information, send an email to bspayne@bellsouth.net.

A

s an attorney handling automobile accident claims in South Florida, I frequently counsel individuals to select an insurance policy that best fits their needs. Many times, consumers do not understand the importance of carrying Uninsured Motorist coverage in Florida. Do not confuse Personal Injury Protection (PIP) coverage with Uninsured Motorist (UM) coverage. Drivers in this state are required to carry $10,000.00 in PIP insurance. PIP covers someone that is injured in an accident regardless of whether they are at fault for the crash. Florida law provides that PIP shall cover eighty percent (80%) of medical bills and sixty percent (60%) of lost wages when a person is injured in an accident. This coverage is paid out as the person receives treatment or submits proof of lost wages. However, when someone is injured in an accident, often the coverage provided by PIP is insufficient to fully compensate them for their damages. In Florida, drivers are not required to carry Bodily Injury (BI) coverage. Therefore, if the person that caused the accident did not purchase BI coverage, fled the scene of the crash or carried insufficient coverage, there will not be insurance available to compensate the injured person for their full measure of damages unless they purchased UM coverage. Recent reports indicate that 25-30% of drivers in Florida do not maintain BI coverage. This number is increasing because of the economic climate. Unfortunately, we have seen more and more clients that are the victims of a severe crash where the responsible party did not have BI coverage or their policy limits were insufficient to compensate them for their damages. This is when UM coverage becomes essential. Under Florida law, an insurance company must offer drivers the option to purchase as much UM coverage as liability coverage. Many professionals decide to purchase large amounts of liability coverage to protect themselves and their assets in the event they cause an accident. Unfortunately, these professionals do not understand the importance of also obtaining UM coverage to protect them in the event they are hit by someone with minimal or no bodily injury coverage. It also protects them if they are a victim of a hit-and-run accident. UM coverage can be used to pay for an individual’s medical bills, lost wages, pain and suffering as well as future costs and expenses relating to their injuries. We always make it a point to review a client’s insurance policy and emphasize the importance of obtaining adequate UM coverage. It is critical to review your policy to ensure that you carry sufficient insurance to protect you and your family in the event you are injured in an automobile accident.

health & Wellness Look Years Younger – No Surgery! By Dr. Jean-Claude Nerette

S

pring back the hands of time. Look years younger with no surgery, virtually no downtime and after one hour. Is this possible? Yes, absolutely. Our youthful facial appearance is robbed as we start to grow older because of a loss of collagen. The breakdown of collagen creates volume loss which results in wrinkles, facial lines and loose skin. This is visually seen as shadows on the face from the contours created on the face from a loss of collagen. In addition, gravity pulls skin down resulting in sagging skin and jowls. It is important to understand that youthfulness is not achieved by only taut skin but by fullness of facial contours. Dermal fillers are the answer to immediately smooth away wrinkles and improve laxity of skin because they replace areas lacking in volume, lift skin and acts as scaffolding to your facial structure and stimulate your own body’s natural collagen production. The more popular fillers consist of either hyaluronic acid (Perlane, Juvederm, Restylane) or calcium-based microspheres (Radiesse). These fillers are placed under the skin using very small injections. The type of dermal filler chosen determines the longevity of the product. Dermal fillers may last from six months to over a year. More important than choosing the filler, however, is selecting the best artist/practitioner to apply the product. Often times, practitioners want to chase the fold – meaning they will go directly where they visually see a loss of volume. This may not be the best way to treat the wrinkle. Let me explain. One of the first folds in the face to appear as a result of collagen loss is the nasolabial fold. This fold is located near the corner of the nose extending to the outer upper lip. Many times I treat this fold by giving minute volume to the cheeks first. As a result, the fold is then lifted. This lift creates a more youthful natural appearance and diminishes the nasolabial fold. I may or may not need to use any more filler at this point. Downtime – there is essentially no downtime with fillers. The only thing that may be considered downtime is the possibility of bruising. The face is extremely vascular meaning it has many blood vessels. One of these blood vessels may be touched when the filler is placed causing a bruise. Not all clients who receive dermal fillers have bruising and most of these bruises obtained from the dermal fillers can be hidden with makeup. The goal to achieving the most natural youthful appearance is choosing the right practitioner who is an artist with the product, will chose the best product to correct the deficit, utilizes the least amount of product to create the desired effect, and makes the experience comfortable. Depending on the area treated, different anesthetic services may be rendered to make the experience as comfortable as possible. You definitely don’t want this procedure to be uncomfortable or rushed. It is possible to turn back the hands of time and look years younger with no surgery or downtime in approximately one hour! What You Need To Know About Stroke By Efrain Salgado, M.D.

S

troke is the third leading cause of death following heart disease and cancer. Every year, more than 795,000 Americans suffer from a new or recurrent stroke episode – that means that a stroke occurs every 40 seconds. Americans will pay close to $70 billion in stroke-related medical costs in this year alone.

Join us for free web chats to learn the latest information on health topics that matter most to you. Cleveland Clinic specialists will share their expertise.

Q: What is a stroke? A: A stroke or “brain attack” is damage to the brain when blood supply to part of the brain is reduced or completely stopped. Brain cells deprived of blood die and can no longer function because they stop getting oxygen and nutrients they need to function.

Wednesday, May 25 Peripheral Arterial Disease PAD, or Peripheral Arterial Disease, is when the arteries in the legs, or any other part of the body that carries blood out side of the heart, become narrowed or clogged with fatty deposits, or plaque. PAD is a serious condition that can more than double your risk for heart attack or stroke, but often it can be successfully treated by quitting tobacco, exercising and eating a healthy diet. For more questions regarding PAD, join our live on-line chat with one of Cleveland Clinic’s vascular medicine specialists. Speaker:

Tuesday, May 31 Stroke

Q: What are signs or symptoms of a stroke? A: Sudden weakness or numbness of the face, arm or legs; sudden confusion, trouble speaking or understanding; sudden trouble seeing in one or both eyes; trouble walking, dizziness, loss of balance or coordination and sudden, severe headaches with no known cause. Q: What you can do to prevent a stroke? A: A healthier lifestyle plays a big part in decreasing the chance of disability and death from stroke: stop or don’t smoke; exercise regularly; control high blood pressure; maintain ideal body weight; limit alcohol intake; control cholesterol; improve eating habits; take medication as directed; control diabetes and get regular check-ups. Q: What stroke treatments are available at the Cleveland Clinic Stroke Center? A: Physical and neurological exams are performed immediately to determine brain damage and the cause of stroke. The physician may also get a CT Scan of the head to further investigate the type of stroke. If a blood clot is the cause of stroke, as it most often is, a clot busting medication called Tissue Plasminogen Activator (tPA) can be used for treatment, but must be administered within 4 ½ hours of the onset of symptoms. If you or someone with you has one or more of the above symptoms of stroke, don’t delay, call 9-1-1 immediately. To schedule a consultation with Dr. Salgado at the Cleveland Clinic Stroke Center, please call 1-800-639-DOCTOR, or visit www. clevelandclinicflorida.org for more information.

community news Take-A-Kid Fishin’ Rodeo Offers Quality Family Time By Debby Teich

D

aniel Harvey of Davie is a third generation fisherman. As a kid, he spent much of his time fishing offshore, as well as in the Davie canal. On June 4, he will share his passion with his two sons – Zachary, 5, and Alex, 7 - during the 29th Annual Take-A-Kid Fishin’ Rodeo, at Wolf Lake Park, 5400 SW 76th Ave. in Davie. “I went fishing with my father every weekend when I was a kid and we always had a great time,” said Harvey. “Now I am creating wonderful memories with my own children.”

Hundreds are expected to attend the event, which started nearly 30 years ago on Davie’s C-11 canal with only five kids. It is an opportunity for kids to leave their electronics behind and spend some quality time with their parents, grandparents and friends. Registration begins at 7:30 a.m. and includes a goodie bag, bait, hat and lunch. Once families find a spot on the lake, they are permitted to fish from 9 to 11 a.m. When they catch a fish, they bring it to the judges table, where a member of Everglades Bass Anglers will help identify, measure and unhook the fish before releasing it back into the water. There will be awards for the kids who catch the most fish and biggest fish. Everyone will also receive a tackle box, fishing rod and reel, as well as a trophy. Rick Browning is a member of the Everglades Bass Anglers and will be one of the judges at the event. “Club members always look forward to helping out at this event,” said Browning. “All of the families who participate have fun spending time together. Every kid should have the chance to learn how to fish.” Brian Akin plans to attend with his two kids – Michelle, 7, and Jake, 9. “We go fishing on a regular basis,” said Akin. “We leave our cell phones behind and just enjoy being together in a calm and peaceful environment. It is my favorite part of the week.” Registration is at 7:30 a.m. Poles will be in the water from 9 to 11 a.m. For information, visit www.davie-fl.gov.

The students used books, encyclopedias and computers to gather information about famous explorers like ReneRobert Cavelier de La Salle, Christopher Columbus and Jacques-Yves Cousteau. Legally Speaking Have You Been a Victim of Predatory Lending Practices? By Omar J. Arcia, Esq., Foreclosure Defense and Bankruptcy Protection Attorney

P

redatory lending is when a lender imposes abusive, unfair and sometimes illegal loan terms on borrowers, without regard for the borrowers’ ability to repay the loan. When two or more of the following factors are contained in a mortgage loan transaction, the subsequent forensic audit performed on that transaction usually reveals serious violations of federal and state lending laws.

Property Purchased or Refinanced Between 2003 and 2007.

This four year period marked the peak of the real estate boom in South Florida. Just about anyone, including foreign nationals without any past credit history, could obtain a “sub-prime” loan for all the value of the mortgaged property. The sub-prime mortgage market thrived during this time, allowing borrowers to encumber their properties well beyond their true market values.

Mortgage Loan Contains an Adjustable Rate or “ARM” Feature.

These types of loans are initially set at an artificially low interest rate for a brief period of time. They then switch to an adjustable rate for the remaining term of the loan, and the rate can increase as often as every six months. Even if the U.S. interest rate index remains unchanged, the monthly payments on these loans could increase by up to 50%. These loans have the highest delinquency rate of any other loan product.

Mortgage Loan Contains Negative Amortization.

Negative amortization occurs when the monthly mortgage payment is not sufficient to even cover the interest due, and therefore, the balance of the loan increases over time even though payments have been made. If you owe more today on your home loan, than when you originally purchased or refinanced, your loan is negatively amortized.

Mortgage Loan is Interest-Only or Pick-a-Payment.

Under these types of loans, the borrower is only required to pay the interest due on the loan or some other minimal payment that does not even cover the interest on the loan. After a few years, the required monthly payment is usually increased to cover the outstanding balance. Once the loan payment is increased, so does the likelihood the borrower will default, and eventually be subjected to foreclosure.

Mortgage Loan Approval Based Only on Stated Income.

Roughly half of all sub-prime borrowers from 2003-2007 were given “stated income” loans, in which they were qualified based on statements in the loan application as to their income. These statements of income were largely unverified, and often the “stated income” required for the loan to be approved was the exact amount included in the application by the mortgage broker. If any of these factors apply to your current loan, you should at least have a professional forensic audit performed to find out whether you have any viable claims against your lender. If your claims are timely and properly raised, you may be entitled to reduce the amount you owe, or cancel your loan obligation altogether. A more detailed explanation of these factors, different options available to homeowners in foreclosure, and key foreclosure defense strategies are discussed in a new instructional DVD developed by the Arcia Law Firm entitled “Fight for Your Home,” which is available in both Spanish and English. Contact the Arcia Law Firm to receive a FREE copy of this DVD (which retails for $39.95 plus S/H). CRIMINAL LAW

f I had to choose the question I am asked the most, it is, “How much is a divorce?” My friend who also practices family law responds by asking the individual, “How much is a car?” It may not seem to be a logical response, but in actuality he is making a valid point. You cannot explain how much a car costs anymore than you can explain how much a divorce costs. The price of a car is based upon the type of vehicle you are looking for. There are cars which may cost $18,000 and there are cars which can cost over $100,000. It obviously depends upon a number of factors which affect the price of a car. The explanation of the cost of a divorce is similar. There are a number of factors which affect the cost. Unlike a car, however, some of these factors may be beyond an individual’s control. The similarity is that just like each car can be a different price, so can each divorce.

The hiring of a lawyer is an important decision that should not be based solely upon advertisements. Before you decide, ask us to send you free written information about our qualifications and experience.

The cost of a divorce is divided into fees and costs. Costs represent funds that are paid to third parties other than the attorney handling the case. They are typically filing fees, costs of a process server, mediation fees, court reporter fees and expert fees such as accountants, psychologists and Guardian ad Litems. Of course, just like a car, not every case requires the above listed costs. Other than the $409 filing fee, the above mentioned costs are not required and are often not necessary. Once again, each case is different. Attorneys’ fees are based upon billable hours. Each time an attorney performs a task on a case the client is billed for the time necessary to complete the task. The amount that an attorney charges for his/her time is determined by the attorney. You can expect that the more experience an attorney has, the higher his/her hourly rate will be. Obviously, the more time that is spent on a case the greater the cost. As I previously stated, sometimes the costs are not necessarily within the control of either the client or the attorney. If the other spouse is perhaps being aggressive, then it will result in more time being spent to address this issue. As I previously stated, more time, more fees. Sometimes a judge’s busy schedule will result in the parties having to wait for a hearing or perhaps have to return another day to complete a hearing. My philosophy is to get a case resolved as quickly as possible. Of course it is also my responsibility to make sure that the client is protected and as such it may not be concluded as quickly as a client would like. Just like a car, every case is different. Real Estate New Homeowners Can File 2011 Homestead Exemptions until 9/11 By Zona Horton, CRS, GRI, Realtor

I

have always strongly recommended to my buyers that it would be a good idea to apply for homestead exemption on their primary residence. Some have elected not to act on that recommendation, when this task (which can now be accomplished online at BCPA.net), would have saved them thousands of dollars each and every year.

What is homestead exemption?

According to BCPA.net, “all legal Florida residents are eligible for a Homestead Exemption on their homes, condominiums, co-op apartments, and certain mobile home lots if they qualify. The Florida Constitution provides this tax-saving exemption on the first and third $25,000 of the assessed value of an owner/occupied residence. While a complicated formula is used to explain this -- as the additional $25,000 only applies to the non-schools portion of your tax bill -- the bottom line is that the basic homestead exemption saved a Broward homeowner in 2010 anywhere from $688 to $1,029 (depending upon your city’s millage rate) in annual tax savings for all homes with a value of $75,000 or higher. You are entitled to a Homestead Exemption if, as of January 1st, you have made the property your permanent home or the permanent home of a person who is legally or naturally dependent on you. By law, January 1 of each year is the date on which permanent residence is determined.” Homestead exemption caps your property taxes – which can mean big savings in the coming years to homeowners. According to BCPA.net, you may pre-file for your 2012 exemptions or late file for 2011 exemptions (including other exemptions): This includes homestead, disability, widow/widower, granny flat, portability, low-income seniors, and non-profit exemptions. You may also late file now for 2011 exemptions. To be eligible for a 2011 exemption, you must be on the title (deed), make the property your permanent residence as of January 1, 2011, and must submit a complete application by the statutory September 19, 2011 late filing deadline. You can visit BCPA.net to apply for a 2011 homestead, by simply clicking on the link to their online Homestead Application system.

Other ways Homestead Exemption can save you money when you purchase another house in Florida

If you’ve outgrown your current home, or your current home has outgrown you, perhaps it is time to purchase another home and “port” your homestead exemption to your new home, According to BCPA.net, “Florida’s Portability law allows property owners to transfer their Save Our Homes benefit earned on a previous Florida homesteaded property to a new Florida homesteaded property. If you are applying for a new homestead exemption AND you held a homestead exemption on a previous property within the last two (2) tax-years anywhere in Florida, you should also submit a Portability application with your Homestead application. Note: a Portability application transfers any tax savings you have earned, but it does NOT transfer your Homestead exemption from one property to another. You MUST first apply for a Homestead exemption in order to be eligible for Portability.” There is a calculator on BCPA.net which will give you an estimate as to what your “portability power” will be. If you are ready to upsize or downsize your residence, please contact me. I would love to help you make the move! If you would like the current Facts & Trends™ graphs sent to you on a quarterly basis, call 954-306-7298 or send an email to zonster@aol.com.

Home Décor Custom Rugs – Your Way By Faryal Ali

Y

ou are stylish and sophisticated with a unique decorating style. Your paint was custom-mixed to suit your décor. Your drapery and window coverings are custom-made to complement your overall décor. So what about your rugs? Your flooring is a very important layer in decorating so go custom. Beautiful Windows now offers you a 130 Designs in 480 colors all custom created by you on our computers.

*

It is so easy and so much fun. Select one of 130 patterns. Choose your shape and size – rectangle, square, oval, octagon, round, runner or carpet for the room. ▸▸ Choose the colors that enhance your décor – 480 colors in different textures and piles. ▸▸ See it come alive on our computers. Play with it and change it around till you absolutely love it. ▸▸ Order and it’s ready in 4 to 5 weeks. Prices start at just $387 for a 5 ft. x 8 ft. custom rug. Tips on choosing a rug: Use a rug to define or separate areas, such as seating or dining areas, and foyers. ▸▸ Shape: Let the way you group your furniture dictate the shape of your rug. ▸▸ Size: For a room size rug subtract 3 feet from the length and width of the room. Leaving the floor bare at the edges makes it look a little larger. ▸▸ Dining Room: Leave at least 24” of rug from the edge of the table out on all sides. This enables the back legs of the chairs to stay on the rug, when pulled out. Select man-made material or wool (not silk or cotton) for easy clean up and durability. ▸▸ Runners: They should be 4 inches narrower than your hallway and 18 to 24 inches shorter. ▸▸ Layering: Throw a rug over your carpet to accentuate or create more visual interest. ▸▸ Pattern or solid: If you have lots of pattern in your furniture or drapes, I recommend a rug with little or no visible pattern. If the opposite is true, a patterned rug will bring life to the room. ▸▸ Color: Remember your color theory basics when picking a rug. If you want your space to appear larger, choose a lighter color. A darker color will make the room seem more intimate. Bring us a picture of your furniture and we’ll help you select your custom rug. We’ll design your rug right on our computers. It’s the best visual tool ever. See for yourself why so many of our clients are choosing to do Custom Rugs - Your Way. As I always say, “Seeing is believing!” ▸▸ ▸▸
