t is hard to believe that the summer is already ending. It’s time to review the school supplies list, pick out that lucky lunch box, and finish the summer reading assignments. August 16th is the first day of school for most kids in the area. Preparing for school has certainly gotten more complex over the past 20 years. We have gone from wrapping textbooks in brown paper bags to downloading software onto smartphones, iPads, and Chromebooks. t began with a young man’s itch, a desire to strike out on his own and make a mark in his chosen field. And so Patrick Utter swapped the Giorgio Armani tuxedos he once donned as maître d’ at one of Hollywood’s finest restaurants and the rigid hierarchy of the fine-dining kitchens where he cut his culinary teeth for something that felt more comfortable, more true to himself. A place where he could still provide quality food and service without any pretense, a neighborhood place where the burgers and fries were hot, the beers cold and the kitchen open until the wee hours. A place where a father and son could stop off for dinner after a sunset game of hoops at T-Y Park, where someone could pick up a comforting takeout meal for a recuperating relative at nearby

Memorial Hospital, a place where cops, firefighters, line cooks and servers could come for wings and camaraderie at 2 a.m., after their late shifts ended. And thus, in August 1992, Shenanigans was born. Utter, hardscrabble product of Hollywood and an Irish-Italian family with five boys, liked the word – Irish slang for silly and mischievous behavior – because it reminded him of his mom and dad’s frequent admonishments to “quit your shenanigans.” Thirty years later, he hasn’t stopped yet. In an industry where most establishments go belly up in a few years, Shenanigans has endured. The original Shenanigans Sports Pub, at 3303 Sheridan Street, remains as comforting as ever. A second location, Shenanigans East Side – with a BBQ smoker, pizza oven and drive-thru window – opened in 2008 in Dania Beach, at 1300 S. Federal Highway. There’s no secret to the success: Quality, loyalty, service and value. “Friends don’t let friends eat frozen fish,” a sign on the wall says. Mahi and other fish specials often come straight off local fishing boats. Burgers are made from Angus beef. The award-winning wings (try the black-n-grilled or Shaq-n-grilled) are plump and free of antibiotics and added hormones. Nearly everything is made in house. Both locations feature daily food and drink specials and seasonal promotions. But beyond the products are the people. “It takes a great team to do what we’ve done,” Utter says, crediting his wife Christine, his “CEO and world’s best wing man” Jeremy (who has been with him from the start) and longtime managers and staff. 24th Citizens’ Police Academy is Looking for You!

he City of Hollywood Police Department is hosting its 24th Citizens’ Police Academy beginning September 15th. The tenweek program allows participants to learn and observe the internal operations of the Hollywood Police Department. The program will host classes from 6:00 pm till 9:00 pm on Thursday evenings at the Hollywood Police Headquarters. There is a small registration fee of $50 for participants. Citizens’ Police Academy is targeted at all members of the community who want to learn more about what the Hollywood Police Force does on a day-to-day basis. Each session will host two or three subject matter experts from different units within Police Chief Chris O’Brien the force. Popular

Hollywood PD Youth Programs
The Hollywood Police Department has a number of other community engagement programs in addition to the Citizens’ Police Academy. These include several targeted at engaging Hollywood’s youth, including the Police Explorer Program and the Police Athletic League. The Hollywood Police Explorer is a program designed for motivated and service-oriented young men and women (ages 13 to 21) who have an interest in the law enforcement field. Explorers attend weekly meetings where they receive training in all avenues of law enforcement. The program provides an oppor-

tunity for youth to gain personal satisfaction, enhance their leadership/teamwork skills, and make a difference in their community. The Police Athletic League is a cooperative effort of the Hollywood Police Department, community volunteers, business leaders and citizens. Money raised at P.A.L. goes to funding first-rate programs and purchasing and maintaining equipment used by P.A.L. members. Donations enable community youth to participate in Police supervised activities. Star-Spangled Spectacular Celebration
H
ollywood is home to one of South Florida’s most spectacular Independence Day celebrations every year. Patriotic pride filled the air as thousands of spectators, decked out in red, white and blue, lined the shores of Hollywood beach to watch this year’s Independence Day fireworks show.
Traffic backed up early on Hollywood Boulevard, but years of experience by Hollywood PD made the entire event seem accessible and easy to get home from. Thousands were gathered along Hollywood’s famous Broadwalk in anticipation of the show and enjoyed live music all night long. The entertainment kicked off at the Hollywood Beach Theater on Johnson Street at 5:00 pm and concluded with the massive fireworks display shortly after 9:00 pm. The event was a boon to beach-side businesses and restaurants during the slower summer season. Residents need not wait for a special occasion to enjoy live music on Hollywood Beach. There are free concerts at the Hollywood Bandshell on an almost daily basis.

ife estates can be an excellent tool for Medicaid planning, probate avoidance and tax advantages, but there are potential problems. Being fully aware of potential pitfalls is the function of a good attorney. In a life estate two or more people each have an ownership interest in a home, but for different periods of time. The person holding the life estate, usually the person who previously owned the property prior to executing the Life Estate, possesses the property during his or her life. The other owner, or the remainderman, has a current ownership interest but cannot take possession until the death of the life estate holder. Recall that ownership and possession are two different concepts. Imagine a rental home where the landlord owns the home, but the tenant has possession of the home for a defined period of time. Life estates are excellent planning techniques for many circumstances. They permit parents to pass ownership in their homes to their children while retaining absolute possession of the property during their lives. By executing a life estate deed, the home avoids probate at the parents’ deaths, is protected from a Medicaid lien, and receives a step-up in tax basis. A step up basis means that the remainderman would inherit the home at the then current market value, effectively canceling any potential capital gains tax.
PROVIDING PEACE OF MIND BY PRESERVING GENERATIONAL WEALTH
However, there are potential issues that may arise with life estates and it’s important to fully understand the following risks:

As a life tenant, you may not easily sell or mortgage the home with a life estate interest. The remaindermen must all agree if you decide to sell or borrow against the property. If the home is sold, the remaindermen are entitled to a share of the proceeds equal to what their interest is determined to be at that time. There is a table that attorneys use to determine the value of the interest. It is not as easy to remove or change a name once it is on a deed to real estate as it is to change the beneficiary on a life insurance policy or bank account. Once a remainderman is named on the deed to your house, he or she has an interest in the home and his or her legal problems could become yours. For example, if your child, who is a remainderman, is sued or owes taxes, a lien could be filed against your home. Your child’s interest in the home is not protected if he or she files for bankruptcy. If your child gets a divorce, his or her spouse could claim all or part of your child’s interest in your home. Should your child die before you do, the child’s estate would have to go through probate unless at least one other remainderman was listed as a joint tenant. However, while these claims may be made against the home, no one can kick you out of it during your life.
Giving away an interest in property could disqualify you from receiving assistance from Medicaid should you require long-term care within five years of the transfer. This is because you “gifted” a portion of your home to someone other than your spouse, without obtaining fair market value. In addition, if you and the remaindermen were to sell the property while you were in a nursing home, Florida could have a claim against your share of the proceeds for payments it has made on your behalf, but the share of the proceeds allocated to your children would be protected.
As with most planning tools, a life estate can be very useful with valuable benefits, but it is not for everyone. In some cases, the potential problems outweigh the benefits. As the law in this area is complex, it’s important to talk to a lawyer who knows about this in-depth.
