s members of Girl Scouts of Southeast Florida Troop #10144, Hannah Nix, 14, and Christy Boucourt, 13, are dedicated to making the world a better place. The two girls recently completed a project toward earning the Girl Scout Silver Award, the highest award a Girl Scout Cadette can earn. In order to receive the award, the girls must prove that they are leaders who are organized, determined, and dedicated to improving their community. They must also complete a project that makes a difference. When the girls learned that the Saint Ann’s Girl’s Orphanage in Georgetown, Guyana needed school supplies, they knew they had found the perfect project. Hannah’s mother, Bev Nix, grew up in Guyana and moved to the United States when she was 17. Two years ago, she brought her family to see her birth place and they visited the orphanage. “Guyana is a very poor country,” said Nix. “If the girls in the orphanage can get a sound education, it will help them develop the necessary skills to escape poverty. They need the basic supplies to make this happen.” Hannah and Christy created a flyer explaining their project and requesting donations of backpacks and other school supplies. They reached out to family members and friends and distributed flyers at their church. They also stapled the flyers to recycle bags, donated by Publix, and delivered them to homes in the The girls collected enough supplies Hannah and Christy display some of the backpacks they collected. neighborhood. “The girls were amazed by how much they collected,” said Nix. to fill three containers. or millions of Americans, the Thanksgiving holiday is an opportunity to indulge in roasted turkey, buttery mashed potatoes, and pumpkin pie, while enjoying the company of friends and families. For those who are less fortunate, however, the holiday may take on a very different meaning. In November, the staff at the Southwest Focal Point Community Center hosted the 36th Annual Thanksgiving Food Drive to reach out to those in need of assistance. They provided 100 Thanksgiving baskets to families in the community. The staff at the Southwest Focal Point Community Center, area schools, residents and businesses made donations. Chartwells Food Service, which prepares meals for the City of Pembroke Pines Charter Schools, also participated in the effort. Chartwells Executives Farai Sithole and Robert Russell, along with their staff, prepared and donated 35 Thanksgiving baskets, complete with all of the trimmings. The Professional

he Miramar Green Market is quickly becoming the place to be on a Saturday mornings. More than 100 friends and neighbors gather each weekend at the market, which gives them access to the freshest, most nutritious locally grown food the region has to offer. The Green Market is open every Saturday, from 9 a.m. to 1 p.m., in the parking lot of Miramar Square, on the SE Corner of Miramar Parkway and Flamingo Rd. Woolbright Development, which owns the shopping center, started the market in October. “Consumers today want to know where their food is coming from,” said Emily Lilly, market manager. “The market provides a way for local farmers to share their produce with area residents. It is a warm, friendly atmosphere and a great place for people to meet.” There are typically more than 20 venders. While most venders come each week, there are always some new ones for visitors to discover. The majority of the fruits and vegetables are grown locally. Visitors can also find fresh herbs, fresh cut plants and flowers, fresh baked goods, cheese, doggie treats, soaps and lotions. There are prepared foods such as guacamole, jams, jellies and salsas. There is also a vender that sells raised growing beds for people who want to grow their own fruits and vegetables at home.

The market is open every Saturday, from 9 a.m. to 1 p.m., in the parking lot of Miramar Square, on the SE Corner of Miramar Parkway and Flamingo Road. For information, visit www.MiramarGreenMarket.com or call 561-299-8684.

As always, the visit from Santa was the highlight for most of the guests. “Santa brought tears of joy to the faces of the young boys and girls,” said Jay Shechter, Director of Community Services and Housing. hristmas has always been a special holiday for Maria Sanchez of Pembroke Pines. It is a time filled with many traditions, one of which always included the City of Pembroke Pines Annual Holiday Open House. She remembers looking forward to the celebration as a child and she has maintained the same tradition with her own three children, ages 3, 7 and 10. This year, she joined over 1,000 people for the free event at the City of Pembroke Pines Southwest Focal Point Community Center. “It is a wonderful way to share the holidays with family, friends and neighbors,” said Sanchez. “There is always great entertainment, good food and lots of fun.” Gue st s entered through a snow covered log cabin facade into a winter wonderland featuring 26 Christmas trees, each with a different theme. Throughout the evening, guests enjoyed musical entertainment, dancers, a storyteller, hot cocoa, cookies, face painting, holiday displays, a Menorah and a Nativity Scene. The children were enthralled as storyteller Carrie Sue Ayvar told magical tales of holidays long ago. Dancers from the Academy of Arts leapt and twirled in beautiful costumes. s the new year begins, great changes are underway for all of us. We will all have to adapt to different school leadership, different ways of handling our shrinking city budgets, and continuing to work with a fluctuating economy. But the most interesting issue we will face that will have significant impact on all of our futures, our state, and our county, will be redistricting. Every ten years after the Census is taken, the Florida Legislature and Broward County are tasked with redrawing the boundaries of our Congressional, State House, State Senate, and County Commission districts. The intent is to ensure that all districts are equal in population so that each vote counts equally. Florida’s sheer population growth has resulted in two additional Congressional seats. In order to ensure a fair process, Amendments 5 and 6 were passed by 63% of Florida voters on November 10, 2010. The amendments established rules in the Florida Constitution to achieve balanced voting districts. The Florida Constitution now prohibits political favoritism where districts are drawn to favor incumbent politicians or political parties. It requires that districts be compact, contiguous, and follow city or county lines where feasible. To learn more, go to www.floridaredistricting.org. In Broward County Commission’s case, they have initiated the process for preparing a new Broward County Commission district map based also upon the 2010 Census. Pursuant to the Broward County Charter, the County is divided into nine single member districts. Redistricting is required by Section 2.01 A. of the Charter, to balance the populations of the districts and ensure residents have equal representation on the County Commission. To learn more, go to www.broward.org/redistricting/ Pages/Default.aspx. As citizens, it is our civic duty to take an active and vital role in how our government will deal with issues that can have a real impact on all our futures. So, I encourage you to attend hearings and listen to what is being said by your fellow residents and presenters. Also please pay attention to the upcoming 2012 State Budget. In January, the State Legislature convenes to develop the budget for the next State fiscal year which starts July 1. Through all this you can understand firsthand the issues that will be faced by all parties as they seek to draw boundaries that will be fair and reflective of our wonderfully diverse population that is Florida and Broward County.

COVER STORY POC American Fusion Buffet & Sushi Sets the Bar By Stacey Bomser

P To Advertise in Pines Miramar Town Times, Please call 954-306-1007 | www.pinesmiramartowntimes.com

OC American Fusion Buffet & Sushi is in a class by itself. The upscale, contemporary restaurant has redefined buffet-style dining. With locations in both Weston and Coral Gables, this gourmet restaurant serves the freshest sushi around, plus an extensive menu of perfectly prepared dishes from around the world.

“We didn’t just raise the bar, we set it,” boasts Will Lin, owner of POC American Fusion Buffet & Sushi. “Our style of food is called American-fusion. Think American, Asian and Continental cuisine prepared by culinary artists who really care about creating an unforgettable dining experience for you.”

And who could ever forget the endless display of over 120 freshly prepared items, ranging from sushi and gourmet entrees to delectable desserts. “You could eat at POC every day and never have the same meal twice,” jokes Will. The star of the show at POC is definitely the sushi buffet featuring sushi, sashimi and skillfully prepared rolls, all created by master sushi chef Kevin Z, who comes to POC from the famed Nobu and Sushi Samba. While the selection varies daily, depending upon what fresh fish is available, the restaurant features several specialty rolls always on the menu. Will recommends the House Roll with eel, avocado and tuna on the inside and tuna, salmon, whitefish and avocado on the outside. Chef Kevin Z’s culinary creativity is further evident in rolls such as the Las Vegas Roll with unagi, cream cheese, salmon, avocado and masago, and the Caribbean Roll with salmon, lettuce, avocado, cucumber and pickles. Once you’ve had your fill of sushi, grab a fresh plate, or two, and head for the buffet. There are dozens of items on the hot bar including POC’s famed Grand Marnier Prawns. Other Asian-inspired items include POC Fried Rice, Poached Salmon in Dashi Broth, Panko-Crusted Grouper, Steak-Wrapped Asparagus, Classic POC Sesame Chicken, Stir Fry Vegetables, Beef Negemaki, Salmon Teriyaki, and Shrimp Tempura. “Our Raw Bar features a selection of fresh seafood shipped daily from the sea to your plate,” shares Will. Selections include Alaskan Snow Crab Legs, Peel & Eat Shrimp, Fresh Oysters and Clams, and Cooked Mussels in the Half Shell. Diners in Coral Gables can also enjoy Dungeness Crab and Spicy Crawfish. On top of all the wonderful buffet items, the POC in Weston offers cooked-to-order Japanesestyle hibachi. Choices include NY strip steak, chicken breast, shrimp or scallops. The Grill and Carving station at the Coral Gables location also serves BBQ ribs, juicy prime rib, churrasco steak, smoked pork tenderloin, and more. Be sure to save room for dessert. POC offers a delicious array of tasty treats including homemade Crème Brulee, plus cookies, brownies and assorted ice cream. There is also a selection of fresh fruit. At the Coral Gables restaurant, the dessert bar boasts an international influence with the addition of Panna Cotta, Tiramisu,

chocolate mousse and delicious Thai doughnuts. With its diverse menu and delicious food, it’s easy to see why diners consistently rave about POC American Fusion Buffet & Sushi. It was voted best sushi restaurant and best buffet restaurant in the Miami and Broward area according to UrbanSpoon.com. A recent Yelp. com review stated: “The service is superb and dinner is excellent.” Zagat magazine, the authority on restaurant reviews and rankings, has stated: “There is no better Asian buffet in Miami.” POC American Fusion Buffet & Sushi offers two convenient locations, serving lunch and dinner daily. The Weston POC, which is celebrating its sixth anniversary this month, is located at 1651 Bonaventure Boulevard, next to Walgreens near Weston Town Center. To book a private party or to make a reservation for parties of six or more, call (954) 389-5188. The Coral Gables POC is located at 2121 Ponce De Leon Boulevard in the Bank Atlantic Building. tudents at Chapel Trail Middle School have always been taught to tell the truth. In a recent workshop, however, champion liar Pat Nease gave them a lesson on how to stretch it. Nease is an educator with 35 years experience, both as a classroom teacher and a library-media specialist. She is also a writer, a creator, and a teller of tales. In November, she shared her passion for words with fourth grade students at Chapel Trail, in a “Tall Tales” workshop, organized by the Broward County Library and underwritten by the Florida Center for Books. “The students had an opportunity to learn that writing can be fun and exciting,” said Liz Grafe, Chapel Trail media specialist. The students gathered in the cafeteria for a two hour lesson in creating tall tales, or stories with unbelievable elements, related as if they were true and factual. During one activity, she started several stories and then had the students finish them. In another, she showed the students a poem and then covered up all of the verbs. She asked the kids to use their imaginations to find strong, alternate verbs as substitutes. “She was such an inspiration,” said Karol Turco, 4th grade teacher. “She taught the students to use their creativity to develop stories and characters. She also stressed the importance of good word choices to keep the reader’s attention.” After the workshop, the students had an opportunity to write their own tall tales. Teachers selected the six best tales and the authors were invited to participate in a contest at the Storybook Festival, a day of larger-than-life fun and activities for kids and their families, held at the Southwest Regional Library on Nov. 19. The six students - Joy Liu, Katie De Los Rios, Alyssa Cagan, Kaelyn Dickson, Justin Wachs and Jason Co – read their tall tales in front of the audience, as well as three Master Storytellers who judged them. The winners were: Jason Co, 1st; Alyssa Cagan, 2nd; and Katie De Los Rios, 3rd. All three winners received gift cards to Target.

This is the time of year when a little help can go a long way for our community. I also want to clarify some of the erroneous news articles that have surfaced recently regarding Pembroke Pines City Center. The City of Pembroke Pines purchased the “City Center” property on July 17, 2003. This purchase of 115 acres of undeveloped land adjacent to City Hall cost $21.8 million. This site is the last major piece of property along the Pines Boulevard corridor, and will provide a unique opportunity for the City to ensure that the needs and well-being of our residents are properly evaluated and provided for in a controlled environment. The City is overseeing the development of this property as a “City Center” for the benefit of residents. In addition to the initial investment, the City has spent an additional $39.5 million for spine roads, infrastructure and hardscape development. The City Commission and the administration have worked arduously to develop strategies to promote the sale of City Center. In the past several years, there have been various proposals that did not materialize. However, on January 25, 2011, the City Commission gave the final approval for the sale of 27.2 acres to Mills Creek Residential Trust LLC, which intends to develop 700 rental garden apartments and rental townhomes and related amenities for a total purchase price of $18.2 million. The development will take place in two phases, with “Phase 1 Property” being the development of 422 rental garden apartments and rental townhomes for a purchase price of $11 million and “Phase II Property” which will include 278 rental garden apartments and rental townhomes for a purchase price of $7.2 million. The City Manager’s office continues to receive inquiries on a regular basis. Currently, discussions on purchase options, such as an office building and additional residential, are taking place.

pproximately 50 students from the Pembroke Pines Charter Middle School Central Campus participated in “Special Kids Day” to help special needs students experience the Broward County Youth Fair. The PPCMS-Central students represented the Future Educators Club and the Builders Club. All of the special needs students attend Broward County Schools. When they arrived at the fair, they were paired with a “buddy” from PPCMSCentral. Together, they watched a magic show and several demonstrations. They visited a petting area with donkeys, goats, cows, llamas and sheep and had an opportunity to feed some of the animals. They learned how to clean clothes on a washboard and how to use old farming equipment. “It was a great experience for all of the kids,” said Piper Spencer, Builders Club advisor. “Our students demonstrated kindness and compassion and learned how to step in when someone is in need. They had an opportunity to build friendships with people they might not regularly get a chance to meet. By the end of the day, most of the students learned that they had a lot in common with each other.” Community volunteer Dr. Ken Sargeant has worked with Special Kids Day since he helped establish the program 33 years ago. “In those days we were unable to get enough adults on a week day to push the wheelchairs for the kids,” said Sargeant. “Many of these students would probably not have an opportunity to attend the Fair with their families. The Special Kids Day is the type of event that makes you feel good. It’s about helping others.” Special Kids Day ties into the missions of both the Builders Club and the Future Educators Club. Sponsored by Kiwanis of Greater Pembroke Pines, the Builders Club

is dedicated to building leaders and teaching students about the importance of making a difference in the community. Club members have participated in Coins for Unicef, Pennies for Patients, food drives and much more. Students in the Future Educators Club participate in activities that give them some exposure to teaching. “There is an ongoing national shortage of teachers who are certified to work with special needs students,” said Kimberly Scarola, Future Educators Advisor. “Hopefully service activities like this one will ignite an interest in some of our students and help fulfill that need.” The Pembroke Pines Charter Middle School Central Campus is located at 12350 Sheridan St., in Pembroke Pines. American Legion Post 385 Honors Fallen Heroes By Debby Teich

J

oseph Motes served in the Marine Corp for seven years, including 13 months in Vietnam. As a nine-year member of American Legion Post 385, he stays connected to other Veterans in the area. Last month, Motes and post chaplain Robert Nagle laid wreaths on the gravesites of seven post members who have passed away. They joined more than 500 people who visited the South Florida National Cemetery, as part of Wreaths Across America, to honor the nation’s fallen heroes. Wreaths Across America is a nonprofit organization started in 1992 by Morrill Worcester, owner of Worcester Wreath Company. When his company had a surplus of wreaths during the holiday season, he decided to use them to honor our country’s Veterans. The organization’s mission, Remember, Honor, Teach, is carried out in part by coordinating wreath laying ceremonies on the second Saturday of December at Arlington, as well as veterans’ cemeteries and other locations in all 50 states and beyond. Retired US Army Lieutenant Colonel Allen West delivered a moving speech to the hundreds of Veterans, families and organizations in attendance at the South Florida National Cemetery. Motes had the honor of laying a wreath for the Marine Corp at the main flag pole. After closing ceremonies, the crowd laid more

than 1,600 wreaths on the gravesites. This is the sixth year that Motes has attended the event on behalf of his post. “These are all Vets who have served our country,” said Motes, who knew all seven from his post. “We must never forget what they have done.” Motes says he is hoping that someone will lay a wreath for him when his time comes. Founded in 2005, American Legion Post 385 has more than 280 member Veterans from all branches of the U.S. Armed Forces who served during WWII, Korea, Vietnam, Panama, Grenada, Iraq and Afghanistan. Members meet on the first Tuesday of each month, at 7 p.m., at the Pembroke Pines at the YMCA Pembroke Falls Aquatic Center. They are committed to mentoring and sponsorship of youth programs in the community, advocating patriotism and honor, promoting a strong national security, and continued devotion to fellow service members and veterans. Members work closely with four area high schools to support programs and present medals and ribbons. Last year, they awarded a $500 scholarship to a high school student. Members also support the Boy Scouts, send local winners to State Oratorical Contests, and more. For information on American Legion Post 385, visit www.post385fl.com or call 954-559-3202.

he World Health Organization released some disturbing facts about falls. It warned that nearly 500,000 individuals in the United States die each year from falls. As such, falls are the second leading cause of accidental or unintentional death from injury each year. In addition, of the approximately 38 million falls that occur each year, more than half are significant enough to require medical care. The portion of the population most at risk for falls is the elderly and children. Children are highly susceptible to falls because their bodies are still developing. They are also naturally curious about their environment and, as they grow, insist on more independence and take on risk-taking behaviors. The elderly are at the highest risk of death or serious injury due to a fall with such risk increasing with age. In fact, the death rates from falls are highest among adults 60 years and older. Senior citizens are more prone to falls because of bodily changes brought about by aging and also because their environments are not well adapted to their needs. Homes are a frequent site for falls. According to the NIH Senior Health, six out of every ten falls occur at home, where we often move around without thinking about our safety. Here are some tips to help prevent home accidents and injuries:

▸▸ Do not walk around in socks or stockings. ▸▸ Be sure rugs have skid-proof backs or are tacked or taped to the floor. ▸▸ Use non-skid bath mats in the bathroom. ▸▸ Make sure stairs are well lit and have railings on both sides. ▸▸ Keep a flashlight and a lamp near your bed. ▸▸ Replace satin sheets and comforters with ones made from non-slip material like cotton. ▸▸ Place lights in the staircase and along the path from the bedroom to the bathroom. ▸▸ Reduce clutter—boxes, newspapers, cords, toys—especially in bedrooms and walkways. ▸▸ Repair loose tiles or wooden floorboards immediately. ▸▸ Quickly remove liquids, grease or food spills on the kitchen floor. Considering the frequency of falls, you would think people would exercise extreme caution to prevent falling. Yet statistics show that this is not the case. If you have not been giving it much thought, start doing so today. By watching your health and improving home safety, you can reduce the risk of falling and better protect your loved ones. Citron & Bloom has offices in both Weston and Coral Springs and handles cases involving motor vehicle accidents, slip and falls, dog bites/animal attacks, defective products, medical negligence and nursing home abuse. ask the expert Do You Need a Facelift? By Dr. Charles A. Messa, III, FACS

A

s the mean age of the population and average life expectancy increases, more and more people are concerned with maintaining a youthful appearance of their face. The signs of aging that become evident as we age occur as a result of gradual loss of collagen and elastin in the skin as well as progressing atrophy or loss of facial fat. These changes are accelerated in individuals who have had excess sun exposure, poor nutrition and in smokers. The areas which are most noticeable and readily amendable to cosmetic surgery are the naso-labial folds, jowls and neck bands (platysma). Initial improvement can be accomplished with soft-tissue fillers, such as the hyaluronic acid compounds like Juvederm, Restylane and Perlane. Other fillers that increase collagen production include Radiesse and Sculptra. When there is excess skin laxity of the face and neck, and soft-tissue fillers are not enough, surgical correction is indicated.

Enhancement of facial appearance by skin excision can be performed with a minifacelift if neck skin laxity is not an issue. This procedure typically involves making an incision from the top of the ear to the earlobe and is placed in front of the ear along the natural contour of the ear. If neck banding and laxity is present, then the incision can be extended behind the ear to allow for tightening of the neck skin and platysmal muscles. Depending on the length of the incision, the procedure is referred to as a short scar facelift or “S” lift or “lifestyle lift” or “feather lift”. Plastic or cosmetic surgeons will attempt to make “their” procedure sound less invasive or more advanced by attaching a catchy sounding name to it; however, anatomically and functionally—it is a facelift. Each patient’s individual concerns and specific areas of skin and muscle laxity which need to be addressed. Any surgical procedure that promises to require no downtime, no changes to your external skin, and no scar, is not likely to result in much improvement in your appearance and any effects it may bring about are typically not long lasting. A facelift can be done alone, or in conjunction with other facial rejuvenation procedures such as an endoscopic brow lift, eyelid lift, or laser resurfacing around the mouth or eyes. Performed under local or general anesthesia, a facelift, also known as rhytidectomy, removes the excess skin around the jaw and neck is removed and the skin is pulled back to reveal a tighter, more youthful appearance. Although a facelift will improve and enhance the contour of your face and jaw line, it will not correct sun damage or fine wrinkles that have developed on the skin’s surface. To treat these conditions, additional skin care will be needed, which is also available at the Weston Cosmetic Surgery Center. These options can be discussed during your initial consultation. The Weston Cosmetic Surgery Center is located at 2823 Executive Park Dr., in Weston. To schedule a complimentary consultation with Dr. Messa, please call the office at 954-659-7760.

ow do we cope during difficult economic periods when we may be struggling with losses of jobs, savings, retirement, and possibly, hope in the future? Moments like these times can break us, but they can also make us. In fact, research in positive psychology and other related fields shows that as we navigate through these times we can and often do emerge stronger. “There is mounting evidence in the psychological literature showing that focusing on cultivating strengths, optimism, gratitude, and a positive perspective can lead to growth during difficult times,” says Tal Ben-Shahar, Ph.D., author of the best-selling book, Happier: Learn the Secrets to Daily Joy and Lasting Fulfillment. Through difficult circumstances we often are able sort out what’s truly important in life from what has little meaning. Cultivating strengths rather than focusing on weaknesses and failures allows individuals to use and develop what they do best. Many individuals may have found themselves in careers that were not personally satisfying but were reluctant to move because of the security of the income. If you are one of those people, now may be the time to explore what strengths you brought to your previous job as well as the skills you perfected. Who knows, applying these strengths to a more personally gratifying goal may awaken a new passion. Optimism can be innate or learned. Nonetheless, optimism can contribute to a happier and more satisfying lifestyle. Optimistic people are willing and able to make positive life action plans to counteract negative events in their lives, while pessimists are often overwhelmed by difficulty to the point of inaction; sinking into negativism, lethargy, perhaps even depression. People with optimistic explanations of life generally feel happier and more energized to cope with obstacles, seeing them as challenges rather than failure experiences. Optimists are more likely to analyze setbacks as situational, consequently developing plans to remove obstacles from their goals. Lucille Ball, the actress and comedian, once wrote: “One of the things I learned the hard way was that it doesn’t pay to get discouraged. Keeping busy and making optimism a way of life can restore your faith in yourself.” Many of my past articles have focused on how having a feeling of gratitude can improve your mood. People with an attitude of gratitude do not necessarily ignore life’s difficulties but rather they focus on the willingness of other’s abilities to lighten their burden. To say we feel grateful is not to say that everything in our lives is necessarily great; it just means we are aware of our blessings. If you only think about your disappointments and unsatisfied wants, you may be prone to unhappiness. If you’re fully aware of your disappointments but at the same time are thankful for the good that has happened and for your chance to live, you may have a stronger sense of well-being. Finally, a positive perspective does not necessarily mean that you are positive all the time but rather that you are striving to be more positive; that is, you are continuously working to become conscientious of your choices, thoughts and reactions. Like an attitude of gratitude, positive people are not in some dream world with no hold on reality. Positive individuals are very capable of understanding the reality of a cynic; they just change their mindset to see the reality from a different perspective. By looking for meaning, life lessons and alternatives to difficult situations, they are often able to avoid frustration and anger thus releasing happiness and contentment.

legally speaking When Is the Right Time for Homeowners to File for Bankruptcy Protection? By Omar J. Arcia, Esq. Foreclosure Defense and Bankruptcy Protection Attorney

M

To Advertise in Pines Miramar Town Times, Please call 954-306-1007 | www.pinesmiramartowntimes.com

any homeowners are under the false impression that they should file for bankruptcy protection the moment they fall behind on their mortgage payments. However, every consumer must be aware that bankruptcy should only be filed as a last resort, when absolutely necessary, and when all else fails. Based upon our experience in handling hundreds of consumer collection matters, foreclosures and bankruptcy cases, there are really just a few instances when a client must file for bankruptcy protection. One such situation is after a final foreclosure judgment has been entered and the homeowner is only days away from a public auction of the home. Filing for bankruptcy protection at this time will automatically cancel the foreclosure sale, and will provide the homeowner with some valuable time to complete a loan modification application or prívate short sale of the home prior to a public auction. Filing for bankruptcy protection at the outset of a foreclosure proceeding is highly unadvisable, especially in view of the fact that in 2010 the average time to complete a foreclosure in Broward County was 600 days. Several other instances when a bankruptcy filing is appropriate are when a debtor is facing a garnishment of wages, seizure of his/her bank accounts, or when a creditor is attempting to repossess property or a vehicle after a final judgment. Under these limited circumstances, filing for bankruptcy makes absolute sense given that there is no time and possibly no legal grounds to attack the collection process in court. However, if a bankruptcy discharge is obtained too early, a consumer will not be able to file for bankruptcy protection again for another 8 years. The preferred type of bankruptcy is a Chapter 7, assuming that your monthly expenses exceed your income. If you qualify for a Chapter 7, all credit card debt, unpaid medical expenses, and all other unsecured debt is wiped out completely. Unfortunately, any debt owed to the federal government for student loans or IRS debt will not be wiped out in a bankruptcy. You also may not qualify for a Chapter 7 bankruptcy if you have other assets which you could sell to cover your debts. In that case, you may have to file under Chapter 13, to restructure your debt, and slowly pay all past due amounts over a period of 3 to 5 years. The bankruptcy code is not easy to navigate. If the bankruptcy petition is not presented correctly, not only will you not qualify for bankruptcy protection, but you may also be prevented from re-filing for 180 days or more. The Arcia Law Firm has assisted hundreds of local homeowners and consumers in bankruptcy and foreclosure defense matters. The Arcia Law Firm recently released a consumer DVD entitled “Fight for Your Home,” which is available for purchase at www.arcialawfirm.com. Anyone that schedules a consultation with The Arcia Law Firm, will receive a FREE copy of this DVD at the appointment. If uncertain whether you qualify for bankruptcy protection or whether it is the right time to file for bankruptcy, contact the Arcia Law Firm today at 1-800-770-7102 or visit us online at www.arcialawfirm.com. Likewise, if you know anyone that is facing a mortgage related crisis, or is considering filing bankruptcy, please forward this article to them immediately.

Memory Loss By Yeny Andrade, M.D.

M

ost older adults are afraid of memory loss. They usually think that memory loss is the same condition as Alzheimer’s dementia. Fortunately, this is not correct. Memory loss is commonly caused by advancing age, prior or current alcohol and drug use, strokes and head injury. Starting in your twenties, you begin to lose brain cells a few at a time. Your body also starts to make less of the chemicals that your brain cells need to work. The older you are, the more these changes affect your memory. Recent memory loss, like forgetting the names of people you recently met, is considered normal. Long term memory, however, is usually not affected. A memory problem is only serious if it affects your ability to live a normal life. Some examples include: getting lost, forgetting how to follow simple instructions, trouble learning new things, forgetting how to do things you’ve done many times before, trouble making choices and handling money, and repeating the same phrases and stories over and over in the same conversation. With dementia, we also find problems with judgment, misplacing things, difficulty performing daily activities such as cooking and bathing, significant changes in mood and personality, and loss of initiative. Another major difference is that dementia gets much worse very rapidly over time. A diagnosis of Alzheimer’s disease can be made by your primary care physician or by a neurologist, usually through a thorough history and physical examination and by answering a series of questions. Your doctor will usually order certain blood tests and possibly an MRI of the brain to exclude other causes. What IS important, however, is early detection so that we can intervene and create a treatment plan right away. If you feel that you or your loved one may have signs of dementia, you should discuss it with your doctor. Although we do not have a cure for Alzheimer’s, some medicines may help slow down the progression of this disease. Fortunately, there are a lot of support networks for families and caregivers of patients with dementia. I will go over some advice for caregivers and patients in next month’s issue. This month’s trivia question: Which of these over the counter sleeping pills is considered safe in older adults? 1. Tylenol PM 2. Advil PM 3. Benadryl (generic = diphenhydramine) 4. Unisom 5. None of the above Answer: E. None of the above. All of these medicines contain diphenhydramine, the active ingredient in Benadryl, which can make older adults dizzy, cause loss of balance and increase risk of falls. It is considered among the 10 most dangerous medicines among the elderly. If you have questions regarding any of these topics or any other health-related questions, we are here to help. BSO Gun Squad – Preventing Violence in our Community

“Duchess”

hen it comes to gun violence, when do we say, “Enough is enough?” When a person changing their tire is hit by a stray bullet? Or when a teenager is shot and killed walking home from school? How about when a decorated law enforcement officer is viciously gunned down in a drugstore parking lot? The time has come to say, “Enough is enough!” People often see me only as the Sheriff of Broward County; many forget that I am first a father and husband. As such, it is my job to protect my family, and as your sheriff, it is my goal to ensure the very same safety for the citizens of this community. As a member of law enforcement for more than 30 years, I take illegal ownership of guns and gun violence very seriously and it is my goal to curb this problem. In an effort to make this goal a reality, in 2009 I assigned six detectives from the Broward Sheriff’s Office to form a Gun Squad. The squad focused on tackling a very serious problem in Broward County – gun violence. The purpose of the Gun Squad is extremely important: stop illegal ownership of guns, seize dangerous weapons and secure our streets. While the task may have seemed impossible to some, public safety is the number one priority of government and I was determined to combat and raise awareness to this important initiative. This initiative was enacted with the sole purpose of targeting people who have obtained illegal firearms and the traffickers who supply them. These are the people who give responsible gun owners a bad name and the criminals who are making some of our neighborhoods dangerous places to live. With two years under their belts, the BSO Gun Squad is learning more and more everyday. Working with other units within our agency and other law enforcement jurisdictions, these detectives have been successful in connecting weapons to various unsolved crimes. With more than 200 arrests and the seizure of 252 guns thus far, the Gun Squad is proving that we are making a difference and we can transform some of the hardest hit neighborhoods in Broward County. That’s 252 guns that will not be used in a crime and more than 200 people who cannot commit a violent act against our children or our community. Often there are family members or friends who know of someone illegally possessing a firearm, but they don’t know what to do about it. We want you to know that you can report it to us – anytime – day or night. Our Gun Stoppers program is administered by Broward County Crime Stoppers and the tip line number is 954.493.TIPS (8477). The more illegally-owned guns we get off the streets, the safer we will all be. Again, if you know of someone who is in possession of firearms illegally, call the tip line. Similar to what our law enforcement counterparts in Miami-Dade have done, I want to expand the Gun Squad. I firmly believe that by increasing the number of law enforcement personnel who are specifically looking for illegally-owned firearms, we can transform the most violent communities in South Florida. With changing technology, a more aggressive approach and a national database to track weapons used in the commission of a crime, gun violence and illegal gun ownership is a problem that can be controlled. Remember, Broward County is your home as well as mine, and we all need to do our part in protecting it. I encourage each resident to be alert and observant. Always report a crime or information about illegally-owned guns by calling Broward County Crime Stoppers at 954.493.TIPS (8477). As another new year begins, let’s work together as a community to make Broward County a shining example of a peaceful community to the rest of the nation. Stay safe!

Duchess is one-year-old Cavalier King Charles Spaniel. Duchess’ family - Erin, Ramses, Gabriel and Emma - are her favorites. She enjoys any toy that she can pull all the stuffing out of, including kids’ toys and Barbie feet. Duchess loves when all of the attention is focused on her. She also likes dancing and eating treats. She does not like swimming in the pool, because it messes up her Mohawk. Her favorite thing to do is to play with the kids and lounge on the couch with Mama Erin. She was last seen in the dining room waiting for food to drop off the table.

legally speaking Will I Need an Expert Witness? By Evan Baron

O

ften times, if the dissolution of marriage is a bit complex, it may be in a client’s best interest to retain an expert witness. Expert witnesses can testify about a great many aspects of a dissolution. As an attorney representing one of the parties, I cannot testify about a particular matter, since I am not a witness. In addition, some matters are beyond the knowledge or expertise of the average person and therefore someone with greater qualifications may be necessary. For instance, a homeowner may believe he/she knows the value of his/her home, but in actuality only a licensed appraiser can actually testify about the value of a home if in fact that issue is in controversy. The rules of evidence in court also prevent certain matters from being presented to a judge through a third party. This is commonly referred to as “hearsay”, which prevents a person from testifying about what another person may have said outside of the courtroom. Often times a client will tell me what one of their children may have said, because they want me to present it in court. Such testimony is not admissible because it is the hearsay statement of a third party. However, if a Guardian Ad Litem is appointed to the case, these statements, or at least a summary of the child’s concerns or fears, may be admitted through this expert. Here are some examples of experts which are commonly used in my cases: ▸▸ Accountant: Used to testify about earnings, business income, tax issues and possible hidden assets. Can also be used to assist in the equitable distribution of assets and debts as well as the need for alimony, based upon a lifestyle assessment. ▸▸ Guardian Ad Litem: Used to assist the court with issues concerning minor children. Appointed to represent the best interests of the children. The Guardian can interview the children, parents, family members, school teachers and any other individuals with possible relevant information. The Guardian will testify in court if necessary, because as a general rule, with very limited exceptions, minor children will not testify. ▸▸ Property appraiser: Will testify about the value of real property, such as a home or office building. ▸▸ Psychologist: Can testify about psychological evaluations of children or parents. If not court appointed can be prevented from testifying due to privilege between patient and therapist. ▸▸ Vocational Expert: Used when a spouse’s earning ability is in question. This expert can testify as to the ability of a spouse to obtain employment as well as his/her earning potential. Not every case requires the assistance of an expert. Often times, the need for an expert is balanced against the financial ability of the client. Unfortunately, often times an expert is an unaffordable luxury. rying to shed those holiday pounds? Men and women of all ages and fitness levels are turning to CrossFit Storm in Miramar to help them get into shape. The strength and conditioning program works with a variety of tools, drills and modalities. It is geared to police academies, military special operations and elite athletes, as well as the person who just wants to maintain a healthy lifestyle. Trainers use the same program for everyone and adapt the workout by varying the load and intensity. Roger Taitt, Manager, provided answers to some commonly asked questions about CrossFit Storm. How does CrossFit Storm differ from other gyms? Big box gyms are structured to make money by getting you to sign up, locking you in for years and then hoping you never come back. CrossFit is structured to make you better. Your attendance is our goal. Your hard work is our passion. Your success is our business plan. We are committed to supreme and life-long functionality through workouts that are constantly varied so that you are consistently challenged. Is CrossFit Storm a new concept? CrossFit Storm opened in Miramar in November 2010, but the company has been around for many years. Former gymnast Greg Glassman opened the first gym in 1999 and the concept caught on quickly. Today, there are more than 2,000 affiliations worldwide. Who owns CrossFit Storm in Miramar? Manny Gonzalez, Brandon Corie, Gerald Balboa and I are the owners. We work for the Miami-Dade Fire Rescue

Department and understand the importance of staying fit. We tried CrossFit at another location and six months later we opened our own. Describe the facility. The 4,250 sq. ft. warehouse has a variety of equipment, including a pull up station, barbells, kettle bells, Plyo boxes and dumbbells, medicine balls, bumper plates, sand bags, jump ropes and much more. It also has a powerful stereo system to make the workout a little more fun. Describe a typical class. A typical class starts with a small jog, followed by 10 to15 minutes of stretching. Then, we go over the entire work out of the day, also

known as the W.O.D. The athletes set up their stations and start when they are ready. What are some examples of CrossFit exercises? Some examples of Crossfit exercises are: power clean, dead lifts, thrusters, box jumps, bench presses, wall balls, double unders, pull ups, rowing and running. Describe the staff. The Crossfit Storm staff is enthusiastic, motivating, family-oriented, friendly and easy going. Does CrossFit offer personal training? No, all of our workouts are done as a class. There are trainers for each class to make sure everyone is doing the exercises correctly. Does the training continue after athletes leave the gym? Yes. After the athletes leave the gym, they work on their eating habits, because nutrition play a big part in staying fit. What role does nutrition play? Proper nutrition can either magnify or weaken the results you get from your training program. It is critical to understand that a good diet will increase energy levels, reduce cravings, and burn fat while packing on muscle. When properly composed, the right diet can nudge every important medical marker for health in the right direction. In particular, we have found that the Paleo and Zone diets accelerate and amplify the effects of the CrossFit regimen. Is there a way to try a class for free? Yes. Class is always free for new clients on Saturdays, at 9 a.m. CrossFit Storm is located at 11936-11938 Miramar Parkway, in the Flamingo Park of Commerce, close to I-75 and the Florida Turnpike. For information, call 954-367-3807 or visit www.CrossFitStorm.com.

estate planning Estate Planning Matters By Lawrence Levy, Esquire

F

irst, let me wish you a Happy and Healthy New Year. Now, let me ask you why you haven’t come to see me to put your estate plan in place? Let me tell you a cautionary tale. Two years ago, I had an occasion to meet a young woman with a three year old daughter. She came to see me because her husband of seven years had recently passed away after a brief stay at a local hospital for treatment of pneumonia. Her husband had not planned for his demise, leaving his wife with more questions than answers. Due to the fact that her husband had assets titled in his sole name, a probate estate administration had to be initiated in order to transfer her husband’s assets to his beneficiaries. Since her husband had not executed a Will at the time of his death, Florida law dictated who was to receive his estate. This presented an unintended consequence. Under Florida law, both this young woman and her daughter were the beneficiaries of the estate (contrary to popular belief, the surviving spouse does automatically receive 100% of a deceased spouse’s estate). Further complicating the situation, as the daughter was under the age of 18, a guardianship had to be established for the benefit of their daughter. The guardianship meant that the Court would be involved in all decisions regarding the child’s property until the child turned 18.

(305) 206-6274 AldoZepeda@hotmail.com

What made the situation more complicated still is that all of the husband’s assets were real estate holdings, so that whenever a property was to be sold, the judge had to approve the sale on behalf of the guardianship and on behalf of the estate. Needless to say, the fees were significant not to mention the delays in putting the husband’s affairs in order. And all of this was occurring while this young woman was trying to cope with her husband’s death and raise her daughter. Had this young couple had their estate plan in order, the fees and delays could have been avoided. However, there is very little, if anything, to be done after a person has passed away. And this bothers me because I know I could have helped this couple avoid this situation if they had come to see me when they began their family. Most likely, they didn’t come because they were a young family and thought that estate planning was far off in their future. Or perhaps they thought estate planning was very expensive. However, you would be surprised as to how affordable it can be to put a basic estate plan in place. So, please call me to discuss the “Just in Case” plan, an affordable solution to your estate planning needs. The initial consultation is complimentary. it’s their business Royal Treatz Dessert Shop Offers Something Sweet for All Tastes By Julie Levin

H To Advertise in Pines Miramar Town Times, Please call 954-306-1007 | www.pinesmiramartowntimes.com

ave you got a taste for something sweet and delicious, but you don’t know exactly what will satisfy that craving? Make sure you check out Royal Treatz, a new dessert shop in Pembroke Pines that offers a complete menu of cupcakes, chocolates, candies, gourmet cookies, pops and more to satisfy any sweet tooth. Staffed by dessert and pastry experts, customers will always find something new and tasty at Royal Treatz. Doug and Lisa Cann, the owners of Royal Treatz, provided some answers to questions about their dessert shop.

What is Royal Treatz? Royal Treatz is a complete dessert shop. We offer gourmet cupcakes - sweet and savory, cake balls, frozen yogurt bar, gourmet coffees and teas with a complimentary coffee topping bar, Cookies, brownies, chocolates and custom designed cakes. We also offer “Cupcake Shakes” that the customer can create with their own flavors When did you open and why did you choose the Pembroke Pines area? We opened July 24, 2011. We chose this location because it is centrally located. What differentiates Royal Treatz from other dessert shops? First of all, I don’t even know of another “Dessert Shop”. There are ice cream and yogurt shops and bakeries. We are all that rolled into one and then some. Is there a “must try” specialty item? Everything is a “must try”. Our cupcake shakes are awesome! The customer chooses 2 “cuppie” cupcakes in any flavor and then chooses their base flavor frozen yogurt (which tastes like ice cream) chocolate, vanilla or a twist. We blend them together and a magical custom flavor is created just for them. As far as a unique cupcake, people are always asking us to bring back the BBQ Pork and Jerk Chicken Cupcakes!

What sort of products do you use? We use the finest ingredients; Ghiradelli Chocolate, Madagascar Vanilla, organic fruits and vegetables. Your logo is “Royal Treatz Where Stressed is spelled backwards” How does that fit the overall theme of your shop? From the time you walk in the front door you are wowed with the decor and details. The sweet smells and friendly atmosphere automatically put you into a relaxed mood. You may come in stressed but you will leave happy. We have been told by many guests that every time they step foot into our shop, they feel as if they are stepping into Disney World. We always know the “newbies” because it never fails, when they first walk in the front door, the “ooooh’s and ahh’s” are heard from across the room. What is your background and how did you get into this business? I was previously a party planner, who offered custom cakes as an “add on” to party packages and people loved them. I had people calling me all the times for cakes and the “cake” part of the business really took off. On a whim and by all things pointing to “cupcakes”, I discussed with Doug about opening a “cupcake/specialty cake” shop and without hesitation he said “Let’s do it”. We decided to make it a “complete” dessert shop to accommodate all tastes. On a personal note, we first met when we were 14, but married others and raised our families. We reconnected in 2007 and finally said “I do” to each other in 2009!

54

Do you offer c a t e r i n g /c u s t o m orders? Specialty / Custom orders are our pleasure! Aside from having 20-25 different daily flavors to choose from, we are more than happy to accommodate special custom orders. From cake carving, to fondant work, to specialty chocolates, to cupcakes adorned with unique decorations, we take pride in our work. Why should customers make Royal Treatz the dessert option of their choice? There is no other COMPLETE Dessert shop around. There is something for everyone! A family can walk in, all with different tastes and desires, and they will all leave satisfied. Every time you walk into the shop, you will find something new in the decor or menu that you missed the time before. All employees are experienced and very knowledgeable in the pastry and dessert field. New inventions are discovered weekly. At least once every day, customers tell us “You need to be on Cupcake Wars”! We also just opened a party room available for birthdays, meetings, and other special events. We also plan on having a teen night starting in January with a Kinect game night. Royal Treatz is located at 7855 PInes Boulevard in Pembroke Pines. For more information, call them at 954986-2424 or visit them online at www.royaltreatz.com.
