lthough it may not feel like it here in South Florida, it’s officially fall. We may not have the cooler temperatures, but we certainly experience everything else that comes with this season – the routine of weekday homework, piano lessons, sports practices and weekend games and birthday parties. Another tell-tale sign of the season is the store shelves lined with Halloween costumes and tasty treats. Now is the time to embrace this playful time of year. Decorate the house for Halloween. Gather the kids to carve the pumpkin. Invite the neighbors over to bob for apples. On Halloween night, let’s all have some fun while watching our little ones roam the neighborhood dressed as fairy princesses, superheroes, or whatever else tickles their fancy. he tension escalated as each senior was asked to spell words that would make a college English professor proud. Contestants went ten rounds before a winner was announced in the first annual Senior Spelling Bee at the Southwest Focal Point Community Center in Pembroke Pines. Jay Shechter, Pembroke Pines Director of Community Services and Housing, loves to play Scrabble and came up with the idea for the contest. “This is probably the last generation, of spellers who do not rely on s – p – e – l – l c-h-e-c-k!” said Shechter. When the Spelling Bee was first announced, 24 seniors agreed to participate. After some learned that Bee winners include (l to r): Johanna Rivera, 2nd ; they had to go up on stage, the number dropped to Spelling Selma Goldwasser, 3rd and Alida Morgan, 1st . 15. The contestants ranged in age from sixty-eight to ninety two. CERT members were part of the City of Miramar’s response team after Hurricane Wilma did a significant amount of damage. They helped distribute ice, water and other supplies. They have also participated in non-emergency citywide events. They have assisted with the Mayor’s community garden project, helped at concerts and more. “CERT members act as the eyes and ears of the City,” said Miguel Hidalgo, Emergency Management Coordinator for the City of Miramar. “The City of Miramar will be better prepared to deal with the impact and challenges

atural disasters and other large scale tragic events are often reminders that we are all vulnerable. Miramar’s Community Emergency Response Team (CERT) is trained to respond in an emergency to help themselves, as well as their friends, families and neighbors until the proper help arrives. This month, residents will have another opportunity to take the free course. Approximately 350 Miramar residents have completed the CERT training program since it was implemented in 2003. If Miramar were to experience a true emergency like a hurricane, communication failures and road blockages might prevent people from accessing emergency services they have come to expect at a moment’s notice through 911. It could take hours or even days for emergency personnel to reach everyone in need. The CERT team would be available to help. The CERT program educates people about disaster preparedness for hazards that may impact their area and trains them in basic disaster response skills, such as fire safety, light search and rescue, team organization, and disaster medical operations. CERT members use the training learned in the classroom and during exercises to assist others in their neighborhood or workplace. They are able to provide basic care that will help limit further injury to disaster victims and lessen the possibility of further damage to property. Miramar CERT members must either live or work in the city. The diverse group represents a wide range of ages and backgrounds. Once certified, member phone numbers are entered into the Code Red system, which sends out a mass message during a disaster. The volunteers assist if they are available. They can use items from the CERT backpack they are given at graduation, which includes triage supplies like masks, gauze, splints, gloves, scissors and other items.

As seen on television’s America’s Got Talent, live instruments meet drum loops to produce rock, electronica and indie with a splash of punk and a dash of metal served with a side of pop. The series ends on March 11, with the ever popular Wizard of Oz. Children can follow the yellow brick road over the rainbow with the Tin man, Scarecrow, Lion, and of course, the Wizard himself in this fun-filled musical. Rita Harrison attended several of the shows last year with her three children and is looking forward to another exciting year. “It is a wonderful way to expose children to the arts,” said Harrison. “We always start at the library so the kids can listen to the stories first. The shows are a lot of fun and the activities before and after are awesome. It is a well rounded program and very affordable. I feel fortunate that we have it right here in Miramar.” The Miramar Cultural Center/Arts Park offers a wide range of programs and activities designed to appeal to young and old. Built by the City of Miramar and managed by the Broward Center for the Performing Arts, it was created to celebrate creativity and diversity within the city. It offers concerts, operas, shows and other special events.

he Miramar Cultural Center is bringing well-known children’s stories to life as it kicks off its award-winning Family Fun Series. It is a great opportunity for children to enjoy a variety of activities as they develop a love of reading and theater. All of the shows take place in the Center’s 800 seat theater, which is well equipped with high-tech lights and sound. There is not a bad seat in the house. The fun actually begins before the show even starts. The children can visit the Miramar Branch Library and read the stories with Princess Reads-A-Lot. On the day of the show, they can arrive early for pre-show hands-on arts and crafts provided by the Young At Art Museum and enjoy face-painting by Curly Sue and Friends. The adventure continues with a one hour theatrical performance that ends happily with everyone enjoying post-show snacks provided by Whole Foods. The Series starts on October 22, with Mufaro’s Beautiful Daughters, a modern-day Cinderella story that combines authentic African drumming, powerful and majestic choreography and thrilling music. On November 19, A Brown Bear, A Caterpillar and a Moon: Treasured Stories by Eric Carle will come to life. The triple-bill features evocative music, stunning visual effects and innovative puppetry. On January 28, kids can follow the latest adventures of Ramona Quimby, an exasperating but lovable third-grade student who has delighted young readers for over fifty years. The Family Fun Series continues on January 29, with ArcAttack, which uses high

One of the negative influences that I would like to bring to all of our attention is that according to recent research, every day more than 2,500 teenagers abuse prescription medications for the first time. The prescription drugs most commonly abused by teens are painkillers, depressants, such as sleeping pills or anti-anxiety drugs, and stimulants mainly prescribed to treat attention-deficit hyperactivity disorder (ADHD). hope you had a great summer. The kids are back at school and the roads are a lot busier with commuter traffic, including school buses. I know that people have been hearing about red light cameras in the media, and have various thoughts and ideas about the installation of these cameras at different intersections. The City of Pembroke Pines was among the first cities in the state with a red light camera enforcement program. When the state law was passed last year confirming the ability for cities Pembroke Pines Mayor Frank C. Ortis to use cameras for red light enforcement, the City immediately adjusted its program to the state law. The City’s first camera was installed at Eastbound Pines Boulevard at 129th Avenue. Additional cameras were added late last year, and this past May. There are currently 22 camera locations in operation in the City.

In the initial 13 months of the program, from July 1, 2010 to August 15, 2011, a total of 12,381 violations were issued using the cameras. These are all vehicles that ran red lights. The City of Pembroke Pines does not enforce right turns on red violations with the cameras unless right turns on red are prohibited at all times and additional signage to that effect is at the location. One of the criticisms of the program is that the City is in it for the money. Note that the state gets 52.5% of all payments to the City. It is estimated that for the initial fiscal year of the program, the City will at best break even on the program. The program is set up to provide persons an opportunity to avoid court and other sanctions if a violation is caught on camera. The use of cameras permits the identification of a vehicle but not the driver. This is why the notices of violation are sent to the registered owner. The fine at this stage is $158, and court is avoided. If the fine is not paid, a traffic citation is issued and the fine increases to $263. A registered owner can file an affidavit to identify the driver, then that person will be responsible for paying the $263 fine. If a citation is issued and ignored, a person’s license could be suspended. Although there were challenges early on in the court activities, the Cities are prevailing more often than not in court challenges. Safety on the roads is a top priority. All of us who drive a vehicle or who are passengers—such as our children in school buses—need assurance that we will be safe on the roads without danger of collisions or fatalities. pproximately 1,000 people attended the City of Pembroke Pines September 11th Memorial Unveiling and Remembrance Ceremony at City Center. They remembered the tragic events of ten years earlier and witnessed the unveiling of the September 11th Memorial, the first of its kind in South Florida. Pembroke Pines Mayor Frank C. Ortis welcomed the crowd to the event which included moving words from many dignitaries, as well as the Presentation of Colors, an invocation by Pastor and United States Veteran Peter

Tokar, the National Anthem sung by Deborah Hartner, fire and police sirens 10 second sound off at 8:36 a.m., the lowering of the flags, a bag piper, comments from Pembroke Pines Commissioners, the acknowledgement of fire fighters, police, survivors and American Airline Pilots and much more. Songs of appreciation, patriotism and hope filled the air from the students of the Pembroke Pines Charter School System Elementary and Middle schools, as well as Flanagan High School. The crowd was in awe as the City of Pembroke Pines

September 11th Memorial was revealed. Local artists Felix Gonzalez and Benoit Menasche spent five years working on the project, which began when Commissioner Angelo Castillo requested a piece of the Twin Towers. The oneof-a-kind piece of art was created from marble and steel and weighs more than twenty tons. It is a majestic and moving tribute to all those lost in the attack on freedom, their loved ones, the first responders and those who hold America dear in their hearts. Miramar Remembers 9/11 By Debby Teich

Howard Champion was working on Wall Street at the time of the attack and had a difficult time fighting back the tears during the memorial service. “It was a beautiful service,” said Champion. “I lost many of my dearest friends on that horrible day. It is a time in our history that we must never forget.” The City of Miramar is in the process of creating a 9/11 memorial which will be located behind City Hall. The memorial will contain pieces of steel that once held up the World Trade Center. It is expected to be completed next year.

he City of Miramar held a memorial service to commemorate the anniversary of the terrorist attacks that shook the nation 10 years ago. Interfaith religious leaders conducted the invocation and closing remarks. Mayor Lori Moseley delivered words of wisdom. The moving service also included a presentation of arms and colors by the Miramar Police Department’s Color Guard; a wreath-laying ceremony; singing of the National Anthem; Miramar Fire Department tones and tolling of the Fire Bell; a moment of silence to honor the victims of 9/11; ceremonial firing; taps, bagpipes and more.

an’t decide what to eat for dinner? Then head to POC American Fusion Buffet & Sushi. With locations in both Weston and Coral Gables, this gourmet, buffet-style restaurant serves the freshest sushi around, plus an extensive menu of perfectly prepared dishes from around the world. This is definitely not your typical buffet restaurant. “We are setting a new standard,” states Will Lin, owner of POC American Fusion Buffet & Sushi. “Our style of food is called American-fusion. Think American, Asian and Continental cuisine prepared by artists who really do care about creating an unforgettable experience for you.” That’s no understatement. The culinary talent at POC is unheard of for a buffet restaurant. Lin has partnered with two of the industry’s most talented chefs, Johnny Hong Kong and Kevin Z. “Johnny Hong Kong built his experience in the New York kitchens of David Bourke’s The Oak Room and Balthazar. In fact, that’s where he got his nickname. Now he blends Eastern and Western techniques in his unique and spectacular recipes here at POC,” shares Will. “And Kevin Z wows sushi lovers with his artistic and delicious creations inspired by his years at the famed Nobu and Sushi Samba.” With this dynamic duo of chefs, it’s no wonder POC is earning rave reviews. “People are raving about us on the internet. We are consistently one of the Top Ten restaurants in South Florida according to UrbanSpoon.com,” boasts Will. “That’s out of over 2,000 restaurants. We are always at the top of the list in both the buffet and sushi categories.” You don’t earn those accolades unless you continually deliver excellent food and service. At POC there is no compromise on quality for quantity. The bodacious buffet boasts over 100 freshly prepared items, from sushi to gourmet entrees to delectable desserts. The star of the show at POC is definitely the sushi buffet featuring sushi, sashimi and skillfully prepared rolls. The selection may vary depending upon what fresh fish is available each day, but the restaurant has several specialty rolls always on the menu. Will recommends the House Roll with eel, avocado and tuna on the inside and tuna, salmon, whitefish and avocado on the outside. Chef Kevin Z’s culinary creativity is further evident in rolls such as the Caribbean Roll with salmon, lettuce, avocado, cucumber and pickles, or the Las Vegas Roll with unagi, cream cheese, salmon, avocado and masago. There are also plenty of picks for non fish eaters, including the Tempura Roll with sweet potato, carrot, green bean and squash. Once you’ve had your fill of sushi, grab a clean plate, or two, and head for the buffet. There are dozens of items on the hot bar including POC’s famed Grand Marnier Shrimp. Other Asian-inspired items include sesame chicken, shrimp tempura, steak wrapped in asparagus, fried rice and much more. On weekend nights, the buffet features gourmet dishes such as Filet Carpaccio and Tempura Crusted Grouper. The cold bar offers fresh seafood selections with Alaskan Snow Crab legs and oysters added at dinner. There is also a small salad bar. On top of all the wonderful buffet items, the POC in Weston offers cooked-to-order Japanese-style hibachi. Choices include NY strip steak, chicken breast, shrimp or scallops. Unique to the POC in Coral Gables is a Grill and Carving Station. Here diners can

sample different cuts of meat including New York strip, churrasco steak, smoked pork tenderloin, juicy prime rib, and grilled chicken. There is also a selection of Yakitori (Japanese-style kabobs) and grilled seasonal vegetables. In the evening, diners can indulge in “Surf & Turf” with a visit to the Raw Bar. Because of the region’s large Latin population, the menu also features favorite Latin dishes including Argentinean-style steaks, Colombian fried pork skins, Cuban Pork Osso Buco, fried plantains. There is even a Cuban sushi roll. Will says it has been his life-long dream to open a restaurant featuring a fusion menu. “My father was a sailor and when I was a child I traveled around the world with him. I always loved tasting different foods as we visited different ports of call,” he shares. “That was my inspiration to open POC, which stands for Ports of Call.” Regardless of which ethnicity of food you choose to sample, you know it’s fresh. “We are constantly changing out the food on the buffet. Nothing sits for long. Of course, our food is so good the serving plate is usually empty long before then,” jokes Will. Be sure to save room for dessert. POC offers a delicious array of tasty treats including homemade Crème Brulee, plus cookies, brownies and assorted ice cream. There is also a selection of fresh fruit. At the Coral Gables restaurant, the dessert bar has an

international influence, with the addition of Panna Cotta, Tiramisu and Canoli from Italy, chocolate mouse from France, and delicious Thai doughnuts. Another difference between to the two locations is Coral Gables features a full bar. It offers Happy Hour on weeknights from 5 to 8pm with two-for-one drinks. On weekends, POC in Coral Gable serves its famous bottomless Mimosas and Bloody Mary’s at buffet brunch. In addition to sushi and other entrees, POC’s breakfast fare includes made-to-order omelets, pancakes, breakfast pastries and much more. Tips for Beating the Bank in Foreclosure Proceedings By Omar J. Arcia, Esq. Foreclosure Defense and Bankruptcy Protection Attorney

F

rom December 2007 to the present, South Florida has experienced a 400 percent increase in foreclosure filings and 1 out of every 197 homes in the United States is undergoing a foreclosure proceeding. In view of these staggering statistics, most homeowners simply give up the fight for their home before it even begins. However, a foreclosure lawsuit is just like any other lawsuit – the lender must prove its entire case before it can obtain a judgment. Just because you’ve been served with foreclosure papers does not mean you have to leave your home! Here are some suggestions on how to use foreclosure proceedings to your advantage, and possibly beat the bank.

CONDUCT A FORENSIC AUDIT OF YOUR LOAN

First of all, perform a detailed audit of your loan transaction through a qualified mortgage auditing firm. A forensic audit often reveals serious violations of Federal and State laws committed by the same lenders that initiate foreclosure proceedings. An audit may also reveal flaws in the transfer of your mortgage. If you don’t know a reputable mortgage audit firm in your area, please contact the Arcia Law Firm and we will gladly point you in the right direction.

FILE A COUNTERCLAIM AGAINST YOUR LENDER

Using the results of your forensic audit, and assuming you have identified violations of law in connection with your loan, you should file a counterclaim against your lender. In other words, sue your lender within the same foreclosure proceedings as a means to establish better negotiating leverage.

DEMAND THE ORIGINAL NOTE

Most foreclosure proceedings are not initiated by the original lender, but rather by a party who claims to “own and hold” the Note securing payment of the loan. Surprisingly, some of these third parties don’t actually have possession of the original note, or the right to enforce the obligation. The Note is a negotiable instrument, like a bank check. Do you know any bank that will cash a “copy” of a check? Likewise, no Court will decide a foreclosure proceeding based upon a “copy” of your Note. If you demand the original Note, and the lender is unable to produce it, a foreclosure judgment cannot be entered.

CHALLENGE YOUR LENDER’S RIGHT TO BRING THE FORECLOSURE PROCEEDING

Florida law only permits an action to be presented by the “real party in interest.” If you never signed an agreement with the party that filed the foreclosure, you can challenge their right to file the foreclosure proceedings. At minimum, you can challenge the validity of the assignment of mortgage and the endorsement on the promissory note. Judges will not hesitate to dismiss a foreclosure proceeding initiated by a company that has no legal right to bring the action. In general, most obstetricians would not recommend elective dental care such as restorative fillings or x-rays be done during pregnancy because of unnecessary risk to the unborn baby. The City of Miramar’s Economic Development and Revitalization Department, in association with the City of Pembroke Pines and the Miramar/ Pembroke Pines Chamber of Commerce, will be hosting its first Business Forum. It will be held on October 13, from 7:30 a.m. to noon, at the Miramar Cultural Center ArtsPark, located at 2400 Civic Center Place. The forum will provide information that can be beneficial to Miramar and Pembroke Pines businesses, and enable them to be more competitive. Armed with the information, local businesses can be more effective in attracting and retaining customers, compete in the international market, and ignite commercial growth. “The City of Miramar has collaborated with other cities on similar events in the past,” said Richard Hughes, Business Development Coordinator. “We wanted to host our own event to make it more convenient for local businesses to participate. It is part of our effort to reach out to the business community and make them aware of programs and services that will help them grow their businesses.”

The event begins with a networking breakfast and a panel discussion on international trade. “Businesses in South Florida have easy access to ports and airports,” said Hughes. “They have an opportunity to grow their business through international trade.” After, there will be breakout sessions with a variety of professionals offering business assistance. Some of the organizations include the Small Business Administration; Broward County; Sunbeam Properties, which operates the Miramar Park of Commerce; M.D. Stewart & Associates, Inc., a multi-purpose consulting firm offering an array of business development and strategic planning tools; Greater Ft. I

n my experience, marriages go through different and predictable developmental stages. When couples are unaware of these foreseeable transitional periods, however, they often misunderstand them and overreact instead of learning from their significance. Couples who are patient enough to manage these universal stormy periods can grow with greater love and commitment to one another. The “marriage map” as defined by Michelle Weiner Davis in her book The Divorce Remedy gives couples a guide to navigate through this terrain. The first two years are known as the “Honeymoon Period.” During this phase, the couple is head over heels in love with each other as well as blinded to the other’s faults. Emotionally and sexually the couple is on a natural high. Around years two to six the marriage enters the “What was I thinking?” phase. In this most difficult period, the blinders come off and each partner becomes acutely aware of the other’s faults. Couples who are able to successfully compromise and negotiate change make it through this stage; others faced with all their partner’s faults, often decide to flee the marriage.

What You Can’t See May Hurt You and Your Pet! By Dr. Christie Waldie-Torres

W

e love our pets and consider them family members. They provide us with love, friendship, loyalty and even health benefits. It is therefore our responsibility to keep them as healthy as possible by feeding them a healthy diet, keeping their vaccinations up to date and getting regular check-ups by their veterinarian. Another important and often overlooked job of a pet-owner is to keep them protected from parasites, both those we can see and those we cannot. Pets are exposed every day to internal and external parasites which can be harmful not only to their health but to ours as well. Parasites we can see such as fleas and ticks are widespread in our area and can carry and transmit several diseases that can make our pets and us ill. Ticks can transmit diseases such as rickettsiosis and Lyme disease and fleas act as an intermediate host to tapeworms. Parasites that aren’t visible with the naked eye include heartworm disease and intestinal parasites such as hookworms and roundworms. Heartworm disease is transmitted by mosquitoes, of which we have no shortage, and causes worms to actually grow and multiply in the heart and blood vessels around the heart. They can kill or seriously debilitate dogs and cats and unfortunately the treatment for heartworm disease is becoming unavailable. Hookworms and roundworms are transmitted through the feces and can remain infective in the environment for a very long time. Once infected, cats and dogs can have vomiting and diarrhea and may even develop anemia. Many times, though, pets can be infected and not show any signs. Hookworms and roundworms can infect humans and do pose a significant health risk. Hookworms can penetrate the skin leading to a condition called cutaneous larval migrans. This usually occurs when walking barefoot in areas where pets leave feces. Roundworms can infect people through contact with contaminated soil or feces and cause serious illness, particularly in children and pregnant women. Fortunately, we can minimize these risks considerably by practicing good hygiene and cleaning up after our pets. Routine intestinal parasite checks, veterinary visits and keeping our cats and dogs on monthly heartworm prevention and flea and tick control are also extremely important. Many of the monthly heartworm prevention products control and treat intestinal worms in addition to protecting them from heartworm disease. There are many options for parasite control and your best resource for information on these products is your veterinarian. Keeping your pet healthy and free of parasites will help to keep you and your family healthy as well.

hin” Travieso is a 100% Pedigree MUTT (with some Labrador characteristics). The two-year-old was adopted from a rescue organization. Phin loves his parents Carlos and Katrina, but he has a very large extended family on his street. Phin really enjoys when his parents are outside doing yard work and he can sneak down the street and welcome his neighbors who are arriving home from a long day of work. Phin’s hobbies are catching and retrieving tennis balls, but Frisbees are his specialty! Phin does not like water. He will run right up to the edge and halt. T

his column is normally reserved for family law issues. Today I want to discuss an issue which affects not only couples going through a divorce but also intact families. We are all aware that there is a housing crisis going on in this country. Foreclosures are still being filed daily and property values are predicted to fall once again. I often ask myself why hasn’t the housing market improved? Interest rates are at an all time low and housing prices are the lowest they have been in years. There have been several government programs to assist buyers, but nothing seems to be working. A couple I know recently attempted to purchase a home on a short sale. A short sale occurs when the sales price is listed for less than what is owed on the house. Generally speaking, the price for the home is discounted and as such it is tempting to prospective buyers. This couple had heard “horror stories” about short sales but they decided to test the market. They made an offer on a home which needed a considerable amount of work to make it habitable. Even with the money they would need to invest for repairs and improvements it was a good deal. Not only must the seller agree to the sales price in a short sale, but the mortgage holder must agree as well. In this case there were two mortgage holders, so the process was expected to take longer. They never thought it would take 4 months and counting. Several days ago they backed out of the deal after two closing dates had passed and there was no relief in sight. The “final straw” came when after waiting for four months the first mortgage holder determined that a new evaluation of the home was necessary because the process had taken so long. The buyers had been prepared to close in June, having obtained the necessary financing. All delays were attributable to the banks and the seller. An evaluation of the property was done by an “independent” broker. This is not an appraisal by a licensed appraiser, but rather a real estate broker determining “market value”. The house, after sitting vacant for well over 6 months and deteriorating from the hot summer weather, was somehow found to have increased in value $60,000! The bank told the buyers that their offer had expired and they were waiting for a counter-offer based upon the new value. The fact that they had contracted to buy the house 4 months prior for a lower number and the fact that they had held on to their “good faith deposit” was not considered. The deal was terminated. As a result the house is headed for foreclosure. The seller will now have a foreclosure on his record. The buyers will have to purchase another home. The workers who were going to be hired to repair the house were no longer needed. And the bank will probably get less money than the original selling price. The real estate agents who worked hard to keep this deal alive will walk away without a cent of commission. It’s a lose-lose. I have spoken to attorneys experienced in real estate and they explained this is a typical story. Once again greed reared its ugly head and the average person suffered the consequences. I am writing this to let people know that in spite of all we hear about trying to stimulate the economy, there are still many roadblocks. If you are considering either selling or purchasing a short sale, I strongly urge you to consult a real estate attorney. Perhaps one day common sense will prevail!

Many septuagenarians, octogenarians and even nonagenarians are burnishing their golden years with help from plastic surgery. According to the American Society for Aesthetic Plastic Surgery, in 2010 there were 84,685 surgical procedures among patients age 65 and older. They included 26,635 facelifts; 24,783 cosmetic eyelid operations; 6,469 liposuctions; 5,874 breast reductions; 3,875 forehead lifts; 3,339 breast lifts and 2,414 breast augmentations. Except for a brief turndown during the recession, those numbers have been rising for years now, and experts say the trend seems likely to accelerate as baby boomers begin to pass age 65. But the increase also has raised concerns about safety and the propriety of performing invasive elective surgery on older patients, who may suffer unintended physical and psychological consequences.

There are as many reasons for getting plastic surgery as there are older patients. People are living longer and remaining healthier, and they want their physiques to align with their psyches. Some are preening for potential mates and want their feathers to look their freshest. Others are still working or looking for jobs and want to be seen as more youthful contenders. Any surgery poses risks, but surprisingly few studies have focused on older patients and cosmetic enhancements. One report, published in the journal Plastic and Reconstructive Surgery in June, found that the hazards in people over age 65 are no greater than in the younger population. Researchers from the Cleveland Clinic in Cleveland, Ohio reviewed the medical records of 216 facelift patients over the course of three years. The researchers found no significant difference in the instances of minor or major complications between one group of patients whose average age was 70 and another group whose average age was 57.6. This study documents that physiologic age (the patient’s overall medical condition) not chronologic age that’s so important for any individual considering plastic surgery. tax talk Dealing with the IRS with Payment Options By Jacqueline F. Rodriguez, CPA

I

f you have past due taxes, consider the payment options available for taxpayers. Some of them are deferred payment agreements and installment payment agreements. A taxpayer may request a short-term extension of time to pay a tax debt. Such requests are generally granted by the IRS. IRM 5.14.5.5 discusses the situations and backgrounds of dealing with a request for an extension of time to pay not to exceed 120 days. There can be significant advantages to making the request when the taxpayer is in the process of raising the necessary funds to make full payment. Other types of deferrals will require additional disclosure to the IRS, including the completion of a collection information statement, one of the Form 433s. In the event that the IRS grants a payment extension, it should be included on the account that the extension has been granted and not to issue notice of intent of Levy, notices of hearing, and Levy. These stays are to be followed unless it is determined that the collection is in jeopardy or at risk. If a longer period of time is needed to pay past due taxes, then request an installment payment agreement. While the submission of an installment agreement request can help the taxpayer in stopping enforcement activities, the process can be open-ended. The IRS is required to enter into an installment agreement in certain cases where (IRC Sec. 6159(c)): 1. The aggregate amount of the taxpayer’s liability (determined without regard to interest, penalties, additions to tax and additional amounts) does not exceed $10,000; 2. The taxpayer has not, during any of the of the preceding five taxable years, failed to file any return of tax, failed to pay any tax required to be shown on any return, or entered into an installment agreement for payment of any tax; 3. The taxpayer is not financially able to pay such liability; 4. The agreement requires full payment of the liability within three years; and 5. The taxpayer complies with all provisions of the Code for the period covered by the agreement. The IRS has recently expedited the installment agreement process with what they refer to as their “streamlined process” by generally not requiring financial disclosure for the taxpayer who requests a payment plan and who owes less than $25,000 including tax, penalties and interest. This is done in one of three ways: 1. Calling the IRS on the number included on any billing notice issued by the service and making the request for a payment plan. 2. Filing IRS Form 9465 (Installment Agreement Request). This can be submitted with the tax return that the request is for or post filing. 3. Using the IRS’s new Online Payment Agreement (OPA) system to request an installment payment agreement using the electronic application process available. However, all payment plans other than the short-term extension of time to pay have a $105 processing fee and $52 fee for direct debit agreements as part of the agreement. Willie Stewart, director and member of the internationally known band Third World, was “celebrity banker” for a day at BankAtlantic’s West Miramar Branch. The renowned Caribbean musician and songwriter greeted customers and took pictures with them. The Florida League of Cities has re-appointed Pembroke Pines Vice Mayor Iris A. Siple to its Board of Directors. Vice Mayor Siple will serve on the Board of Directors until August 2012, when elections will be held during the League’s Annual Conference.

Beach Blast

The fun never ends at the Southwest Focal Point Community Center, which hosted 150 guests at the annual endless summer Beach Blast. The event included dancing and a one hour performance by the Acting Class and Community Service Staff. Guests enjoyed free ice cream donated by the Transportation Department. The Social Services Department Sea Shell Game had two winners who guessed how many shells were in a glass bowl. Following the performance, was DiViera the D.J. and more refreshments sponsored by WellCare.

Eagle Scout

Bradford Capuozzo of Miramar led and completed a project at Trailside Park in Southwest Ranches in an effort to become an Eagle Scout. With a red, white and blue theme, he planted dwarf ixora, bridal bouquet, and plumbago. He also planted a yellow tabebuia and installed a bench. He worked closely with Town Arborist, December Lauretano-Haines, to plan and implement the project, which was completed on Labor Day.
