Latest Towing Industry Overhaul Bill To Receive Changes, Vote Next Week Towing companies and lawmakers are close to an agreement on legislation that would make a number of changes to the industry. Sen. Frank LaRose, chair of the Senate Transportation, Commerce and Labor Committee that's considering the bill (HB 341), said a handful of amendments to address issues raised in each camp will be added before the legislation is reported next week. Lawmaker concerns include reversing penalties set in a previous towing industry overhaul bill (SB274, 130th General Assembly) and giving the Public Utilities Commission of Ohio more authority over towing businesses, Sen. LaRose said. Under the bill, a tiered violation and penalty system would be created to separate major and minor penalties. Industry advocates have been supportive of the change because new PUCO regulations that went into effect last month as a result of SB274 could be a death knell for businesses that commit administrative offenses such as failing to provide towing cost estimates or receipts. "There are several changes where a major violation is turned into a minor violation," Sen. LaRose said. "There are a few members who have concerns about that so we're working through those discussions." In addition to fines that increase along with the number of major and minor violations, the bill keeps in place the ultimate penalty of repeat offenders losing their Certificates of Public Convenience and Necessity that are now governed by the PUCO. Sen. LaRose said committee members are leery about a provision that would give the PUCO more control over the industry by allowing it to set towing rates. Currently, tow away zone laws set the 10

rates at $90 for a tow and $12 per day for storage. Those fees would increase slightly to reflect the consumer price index, and the commission would hold a hearing after five years to potentially set new rates if the bill becomes law. The price for tows that occur after traffic accidents have long been up for debate as insurers claim that some companies send inflated bills for coverage. The bill creates a Towing and Quick Clear Board to review appeals while owners get their cars repaired. Although the Association of Professional Towers-Ohio and the Ohio Insurance Institute are backing the solution, Sen. LaRose said changes may need to be made in that area of the legislation. "I think there is a well-known sense around here that the administration just doesn't like creating new boards under the idea that we have quite a few already, and we just don't want to go creating new boards every General Assembly," he said. Meanwhile, the Towing and Recovery Association of Ohio has submitted some of its own amendments. At least four are being considered, its counsel, Robert Mecklenborg said. Among the request are that the final version of the legislation address problems that can occur when offering consumers

that ability to pay with credit cards with the use of a mobile device and limit the prohibition on compensation for authority to tow vehicles to monetary compensation. "These hard-working men and women perform an important service which promotes the free flow of travel and trade day after day often under severe and dangerous conditions. They perform these regulated and needed services only after considerable training and capital outlay," Mr. Mecklenborg told lawmakers. "This bill gives you the opportunity to go beyond providing the traditional lip service to our small businesses by improving the regulatory climate in which they operate." The legislation as it stands would give operators more leeway in various instances, such as increasing the number of miles a towing lot can be located away from the site of the tow and clarifying that drivers must deliver cars to low within two hours only if it's practical. It also creates a process for a storage lot to receive a salvage title for abandoned or junk vehicles so that space can be freed up in a reasonable amount of time. Witnesses who testified in support of the measure on Thursday applauded the provision that makes changes to a process put in place by SB274. www.trao.org

Arizona Professional Towing & Recovery Association Hires Angela Roper Barnett as New Executive Director The Arizona Professional Towing & Recovery Association announced today that Angela Roper Barnett has joined the team as Executive Director. Angela comes with close to 20 years of experience in the towing and recovery industry. Angela has owned two towing companies in Texas and has been an industry instructor for 10 years. What is Fuel for Thought?

It’s a short question with an easy answer. There are four things that I want you to think about and consider doing this coming month. Hopefully, I’m going to add some fuel to your thought.

First Thought – Element: In Baltimore last month, I attended the INA Towing Forum with Element. It was extremely enlightening and informative. Gay Rochester and her wonderful team will indeed handle the group of Elite Towers that are already serving the network. Element fleet management has over one million leased vehicles out there needing help and is looking for the best to do their superior service particularly for key clients such as Red Cross and Pepsi. The head of the Red Cross spoke at the Forum and thanked the large group of towers for their professionalism and for 18

the quality of work they do. If you have the proper equipment and the customer service attitude needed, give me a call. You see, INA has their design company already per each like Tampa 1st Rate, and Stepps Towing; they are looking for the best of the best. In some areas of the country, they could use a “back-up” professional. So, if they are already working a large truck roll-over, then you may be able to fill-in. Some areas of the country are still open. Call me if you’re interested. Second Thought – Tow 123: Boy, what a difference a few passing years makes! I was working the booth at the Baltimore Tow Show. We had to have people come back to give them a demo. Every one of the people from Auto Data Direct was showing others how to run an entire towing operation from a computer, tablet or smart phone. This will be the third largest tow show of 2017--the 1st being Baltimore, the 2nd the Florida Tow Show, and the 3rd Southern Tow Expo and Beach Bash! That one includes a deep-sea fishing tournament. I will be speaking just like old times. I used to have one of the biggest classes in Baltimore right up there with Wreck Master and movies with Tom Luciano. Wreck Master will be there in Orange Beach, Alabama also. Now I have to work on Luciano to come since he’s a professional fishing tournament guy. I know the Exhibitor Hall is filling up fast. Lots of towers this past month told me Merry Christmas, DJ! See in you Orange Beach! Still available are rooms on the beach at $109 a night with a bonfire and keg party right there. This is what family memories are made of. Be proud you are

Insightful talk

As the owner of your company, you have to communicate in many different ways to many different people. The way you communicate or talk to a dispatcher will be different than the way you talk to a driver. You then have to communicate with your customers, which will be different than the way you talk to law enforcement. Then there is the salesperson you talk to along with an insurance company, and so on and so on. You wear many different hats for many different people. This is why communicating effectively is so important. There are many potential problems that can be caused by poor communication skills. Poor communications could lead to employee turnover, more missed calls, and poor customer service, which will affect your company’s productivity. 20

So why does poor communication in the workplace create issues? I found that employees want to feel like they are part of the company, and the lack of information makes them feel left out of the loop. When I had my company, I told my employees everything relating to business along with some fun stuff that wasn’t personal. My wife would ask me all the time why I told the employees certain things. Simple-I wanted to keep them informed. After all, they run my company and make me money. I felt it was good for employee morale to keep them in the loop and let them help me make decisions relating to the business. The one thing I want to be aware of is how I felt when I was communicating with others. Giving the wrong impression will send the wrong message. Keep this

in mind when you are talking to people within your business. Let’s look at a few things that lead to poor communication: 1. Not listening is probably the most common reason for poor communication. When you are holding an employee meeting, some may not be listening because they don’t agree with your opinion, they have no desire to take part in the conversation or you may be talking about something that does not affect them. Learn to speak in a manner that holds everyone’s attention. 2. Making decisions based on assumptions often creates communication problems. By the way you are delivering your message, the people you are

talking to assume that you are trying to say one thing and react one way, when, in reality, the message you are delivering means something totally different. 3. Assumptions are often made as you are delivering your message. You know what they say about making assumptions. When communicating your message, make sure it’s clear and precise. 4. As you talk, your body language will be interpreted in many ways changing the meaning of what you are trying to communicate. If your body language sends the wrong message, employees may not be willing to participate in what you are trying to accomplish. 5. Employees will ask questions without any detail. This leads to incomplete

answers. Make sure you use openended questions to get the proper answers you seek. This type of question includes details like who, what, where, when, and how. 6. Many times effective communication in the workplace is blocked by the overwhelming amount of information. How many times have you seen the same message covering the same information just from a different sender? What ends up happening is that many employees start to ignore those messages. 7. Emotions play a big role in how we approach and accomplish things. If you have a death or illness in the family, the listener may receive the message as being sent angrily resulting in them reacting in a negative way when the same

message can be given in a positive manner encouraging your employees to listen more closely. 8. Sending a conflicting message can confuse the party you are talking to. Your

Insightful talk body language says one thing and your words may mean something else. If the person you are talking to is confused by the delivery of the message, they may ignore it altogether. 9. Any type of distraction can result in a message being delivered or inter-

preted in the wrong way. Something going on around you or a phone ringing can be enough of a distraction to create a problem. 10. Because we all look at the world differently, we all have a perception of how life should be. The same applies

when communicating with people. We can’t change how they look at things, but we want to make sure the message we are sending is perceived correctly. Remember when communicating that, there are other viewpoints and opinions. Always keep an open mind, and don’t be afraid to try new things based on their viewpoints. You never know when their idea may be better than the original message you are trying to send. 11. Dealing with different cultures can create problems when trying to communicate with someone. All cultures have different beliefs and customs. They can often clash and build resistance with what you are trying to communicate. 12. Differences in languages that are spoken in the workplace can affect your ability to communicate. Words can be misunderstood and misconstrued causing negative communication barriers. I was traveling through west Texas one time, and I stopped to ask a policeman for directions. If he had not pointed, I would have never figured out what he was telling me since this was my first exposure to a west Texas accent! 13. In the towing industry, the workplace stress can have an effect on communication within the workplace. Attitudes can create a lack of focus decreasing productivity and weakening communications with employees. Good communication can reduce workplace stress. Because I had to deal with so many different kinds of people at different levels of business, it was often difficult to communicate effectively. I learned quickly how to adjust my stress and body language so I did not send the wrong message. I recommend you get more involved with all your employees and make them feel like they are a part of your company. Remember, it all starts with you, and if you don’t communicate effectively, it could create a problem for your business and cost you in revenue. u

Marietta Wrecker Gives Back to the Community Marietta Wrecker Service is a family owned and operated commercial Towing, Recovery and Transport Company that has been in business since 1974. The idea and inception of MWS was through the partnership of Mike and Terri Welchel. In 1994, Terri purchased Mike’s shares of the company and has since been the President and CEO. MWS is currently transitioning into the second generation that is operated and managed by siblings Chris, Steve, and Heather. During a planning session in the fall of 2015, Marietta Wrecker Service decided that one of the goals for 2016 was to give back to the community in a unique way. MWS wanted to reach a group of people and support a cause that is often overlooked. Ovarian Cancer is close to our hearts because someone we love passed away from Ovarian Cancer in December of 2001. Steve Welchel, co-owner of MWS watched his wife’s mother Ana Virginia Castro Jenkins go through her fight against Ovarian Cancer. The Company decided to dedicate a truck in honor of Ana and to help spread awareness throughout the community. On March 24, 2016, MWS held a Truck Dedication event that revealed the new Ovarian Cancer Awareness truck. Steve surprised his wife, Emilia Welchel by letting her think that the company was shooting a commercial. During the opening of the ceremony Steve said a few words: “Thank you for all being with us today as we have this celebration. Today marks a special day for Marietta Wrecker Service. Something that affects all of our lives in one way or another is Cancer. The American Cancer Society estimates that in 2016 more than 22,000 new cases of Ovarian Cancer will be diagnosed and over 14,000 women will die in the US. Mortality rates for Ovarian Cancer have declined only slightly in the 40 years since the “war on Cancer” was declared.

Other cancers have shown a much greater reduction in mortality due to the availability of early detection test and improved treatments. MWS is taking a stance in the fight against Ovarian Cancer. Our hope is that we can raise awareness and make a difference. Ovarian Cancer took the life of someone we love and because of that we wanted to honor her memory in a very special way. On December 29, 2001, my wife lost her mother to Ovarian Cancer. Today we dedicate truck 149 in honor of Ana Virginia Castro Jenkins.” The driver of our Ovarian Cancer Awareness truck wears a TEAL uniform every day and gives out information as well as awareness bracelets in an effort to spread awareness and educate people on this silent killer. Every Tuesday is celebrated company wide as TEAL TUESDAY.

Everyone on our team has a TEAL TUESDAY t shirt that says “I wear TEAL for the warriors, survivors and the departed.” Our Facebook page dedicates every Tuesday to Ovarian Cancer Awareness to help educate and spread awareness. MWS feels so passionately about the cause that we felt we needed to do more and make a bigger impact. The natural thing was to partner with GOCA, Georgia Ovarian Cancer Alliance. Together we can make a bigger difference. The MWS Management team is excited to have recently met with Doug Barron, Executive Director for GOCA, to decide how our partnership can educate more people and spread even more awareness. TIE-DOWN STRAPS BY SIMON BIRCH, AW DIRECT TECHNICAL PRODUCT MANAGER

This month, we are going to take a look at the different options available when it comes to choosing a tie-down kit. While using chains and binders is still practiced by many, our industry has been gradually shifting to four- and eight-point, tie-down kits. This direction is likely to continue as modern vehicles become lighter and offer fewer attachment points for chains. There is no hard and fast rule with tiedown kits that makes one style better than another; it really is a case of personal opinion and what the operator prefers. As has been discussed in this magazine in the past, the FMCSA and DOT require that any vehicle being carried on a flatbed or trailer must be secured at all four corners by an appropriate, adjustable securement device. So, where do we start? Let’s take a look at over-the-wheel sets 24

first. These are available in four- or eightpoint configurations, with several different attachments, including chain ends or hooks. Choosing which over-the-wheel set that works best for you, will often be determined by the attachment points you have on your flatbed. If you have banjo eyes or key slots in your bed, you will likely pick a kit with chain ends that you can drop into those slots. If you have D-rings, you will want to pick a kit that has some kind of snap hook. If you decide an eight-point system is the one you prefer, and you have no attachment points in the center of your bed, you will have to both cut a hole and weld in some steel banjo eyes. Alternatively, you could mount D-rings securely by bolting and/or welding them to the bed. The webbing material used in these straps can vary from manufacturer to manufacturer and is typically graded by

strength, flexibility and weather- or abrasion-resistance. So what other options do we have to work with? Recently, many operators have begun using axle straps around live rear axles and other solid lower suspension systems. This method allows you to secure the casualty to the bed, but still allows the suspension of the casualty to work, which results in a smoother, less jarring ride for the flatbed operator when driving loaded. One of the drawbacks to using axle straps however, is it often seems like you need three hands during the attachment process: two to hold the ends of the strap together, and one to hook in the snap hook. To overcome this problem, AW Direct has developed the industry’s first ever, magnetic axle strap. By placing two high-powered magnets on each eye, hooking up has just become easier, quick-

er and consequently much safer. Simply pass the strap over the axle or suspension component, snap the magnets together, then you have both hands free to secure your strap. This process is going to get you off the side of the road much quicker, thus minimizing your exposure to potential hazards caused by distracted drivers. Another method of vehicle securement is what was once referred to as “sports car tie-down” or more commonly,

way to tie it down, enabling the operator to get off the roadside faster and safer. So, if the lasso strap is not ideal, you may want to contemplate using an axle strap. In a 36"L length, an axle strap is easily long enough to pass through even the widest of rims, and if you are using the magnetic version, snapping the rings together to enable a one-handed hook up will speed up your job even more. So that covers using tie-downs for

“lasso strap.” This method uses a lasso style, 12'L strap with a single ring on one end, which is passed through the rim of a vehicle, and then back through itself and tightened using a ratchet assembly. While this is a simple and quick method, keeping the strap tight can sometimes be a challenge due to the angle of the strap and ensuring it adequately chokes the wheel assembly. On some vehicles, going through the rim is absolutely the best and quickest

securing vehicles on flatbeds and trailers, but what about wheel lifts? As there are so many different styles of wheel lifts available, and literally dozens of different wheel lift straps, it would be impossible to cover them all in this article. Providing you are using one wheel lift strap on each wheel, and they are secured in accordance with manufacturer guidelines, you are going to be in compliance and therefore safe. But what if the unthinkable happens,

and the casualty comes detached from the tow truck? What is stopping it from running away, into oncoming traffic…or worse? We all know that the law requires secondary restraints or safety chains, but we also know that on some vehicles, they can be difficult to install and as a result, are sometimes overlooked. To make matters worse, slip hooks or grab hooks can be difficult to thread through certain areas, then, when the suspension is going up and down while being towed, the hooks can get pinched due to their bulkiness. This wear and tear can cause broken latches, rendering the hooks unusable. An alternative solution to hooking safety chains directly to a vehicle is to use axle straps with protective sleeves. Axle straps are thinner, lighter and easier to install than heavy chains. The magnetic versions in particular, keep your hooks away from pinch points, speed up the hooking process and get the operator back on the road in a safe and compliant way. The service technician is able to test the disabled vehicle’s battery and electrical system in an effort to get the vehicle running under its own power. It’s JUST Insurance, Right? BY SCOTT FOWLER

Have YOU ever said that? Many of you feel that way, particularly if you haven’t had any claims. If you talk to some of your friends that have had claims, you will find out that not all insurance is equal after all. I’ve talked to many clients that routinely shop their insurance at every renewal looking to save every penny they can. Next to diesel fuel, DEF, and payroll, insurance is probably the next biggest expense; so, on the surface, that would seem to make sense. However, with distracted driving-related collisions on the rise and a glut of personal injury lawyers, it’s not a matter of if, but when you have a claim. In days gone by, you could handle the damage out of pocket and move on. However, in a world where the accident attorneys are telemarketing accident participants within hours of a collision and convincing them they have a winning lottery ticket at your expense, it pays to have good insurance. The problem is that you are a towing professional, NOT an insurance professional. So, rather than shop for insurance, you would be better served shopping for an insurance professional. 50

As I stated earlier, not all insurance companies are the same. The same is very true of insurance agents. There are fewer insurance companies offering coverage to your industry today than there were five years ago. This is due, in large part, to the increasing number of crashes involving commercial vehicles and the large suits brought by injury attorneys. Now, there is no shortage of insurance agents; however, the list of agents that have knowledge and expertise in your industry is extremely short. In fact in our state of Ohio, for example, there are hundreds of agents that will write your insurance, but only about five that have expertise in your industry. Our agency is one that is on that short list. Towing is a niche market for us because Hal Kresser, the agency principal, is very interested in the industry. He worked for a towing service when he was younger, and even today he is “Wreckmaster Level II” certified and can operate your equipment. Can your current agent do that? Hal is also involved in the industry as he is an active and participating member of the Towing and

Recovery Association of Ohio. In fact he is so well respected that he was nominated and elected to be president of the local region and is currently serving his second term. Before he was an insurance agent, he spent twenty years as a cop. He is certified in accident reconstruction and knows the laws and how to deal with police officers very well. Therefore, he is good to have as an advocate in some of the collision claims that happen when there are disputes as to who to blame. Also, he can help you decide when to fight traffic tickets and violations and when not. When you choose the right agent, he will be able to place you with an insurance carrier that best suits your needs. As an independent agent, we have the ability to add new companies that enter the market. We can eliminate carriers that either leave the market or provide poor service to our clients. Also, the insurance companies themselves are always changing. We have seen companies come in to the towing market for a few years and then get back out. When that happens, you can lose your insurance through no

Industry Insurance fault of your own. A good agent is on top of that and can make transitioning to another carrier seamless. You need to build a relationship with your agent. He is your advocate between you and your company as well as between you and others. He can help you decide when to file a claim or when to pay out of pocket. There have been instances where a claimant didn’t trust that, and we acted as the middle man for the payments. He can advise you on ways to keep your rates down as well as help you implement plans to avoid liability claims. We recommend things like putting cameras in the trucks to document crashes. They can be invaluable in situations where fault is in dispute. You should be communicating with your agent on a regular basis. If the only time you talk to your agent is at renewal time, then you need to make a change. Choose the right agent and build the relationship on trust and integrity. The agent should be viewed as a stakeholder in your business. You need a good, well

managed insurance portfolio to help your business be successful and the agent needs your business to be successful to make his business successful. If you are contemplating any big expansion plans such as adding a new building or moving to a larger facility in another part of town, you should involve your agent during the planning stage to find out in advance what the impact on the insurance will be. Many times I get the call to add something like a building or a second location to the policy after the fact. Then the insured is upset when he sees how much it costs. Now it’s too late. We looked at an insurance policy last year for a prospective client. They had been with their agent for thirty years. The agency had changed hands as people retired. No one had met with them for years. We reviewed the policy and saw that it was for an auto repair business, not a towing service that also sells vehicles. We asked the prospect, and he said that they had stopped doing body work fifteen or twen-

ty years ago. They had NO coverage for car sales or insurance to cover the inventory for sale. We wrote their insurance properly which basically doubled their current rate. However, they were now properly insured and happy to pay the higher rate. In closing, let me reiterate that it’s not always about price. The cheapest policy out there isn’t worth a nickel if it doesn’t cover what happens to you. Also, choose the right agent and then include him in your business as a trusted advocate and stakeholder. You are entitled to recover the net income of the disabled vehicle from the at-fault party. You cannot make such a claim with your own insurance company unless “lost income” is covered in your policy. Not all insurance companies offer lost income coverage on commercial vehicles. As in all insurance claims, you must prove the loss or damage. The records you keep are the key to a fast, fair settlement. You have to provide records listing the annual mileage, cost of fuel, average number of tows and average price per tow for that vehicle. You will then need to list the average expenses, such as fuel, labor and maintenance, etc. Unless you want to spend hours digging through receipts and invoices, keeping this information on a per-truck basis is advisable. Daily logs can work well for tracking. If you want to simplify things even more, using an inexpensive dispatch/accounting software package like Towbook© can be a huge timesaver. Those programs are tailor-made for the towing industry and give an owner this detailed info and more at the click of a mouse. Net Income is the amount of profit (money) a business has after determining gross income and deducting all expenses like fuel, labor, maintenance, etc. In this simple example, all amounts are based on a six-month average. Start with $900 in receipts. Then subtract $128 fuel, $150 labor and $20 maintenance, and you are left with an average daily income of $602. Multiply that by the number of days the truck is out of service, and you have the amount you can claim. Now you simply need to prepare a cover letter to the claims adjustor detailing the claim for lost income. Include the total amount of lost income and make sure you attach the supporting documentation as outlined above. Neatness counts!
