Summer Days, Drifting Away I don’t know about you, but the older I get, the faster the summer seems to go by. I know it’s not just because my kids are growing up so fast or that it’s hard for me to believe they are the same kids, but it’s because I remember how summer felt when I was young. I counted down the days until school was out and then... Bam! Summer began, and you rode bikes everywhere, went swimming and on family vacations, and hung out with friends all day. It seemed like it went on forever, but when it was August, in a weird way, you almost looked forward to going back to school because you had run out of things to do, and you were excited to see your other friends. Now days, summer flies by, and you don’t feel like you got to even enjoy it before it’s over. Summer isn’t the only thing that moves by fast anymore. Changes in this business are coming faster and faster. Whether it’s new technology, new requirements, new laws or new employees, your business is changing and growing faster than ever. That is why we do a Buyer’s Guide each year so you can see products and have a comprehensive listing of all the vendors in this market and what they do. A Look into the Jerr-Dan Corporation as Seen Through the Eyes of Richard del Campo, Vice President and General Manager a history. In 1972, Jerr-Dan was formed. In 1972, I was born, and today, we are both still here! In addition, we have five individuals that started with Jerr-Dan that year and are still here—that is continuity. Forty-five years is a milestone; it means being a pillar in the industry dependable, solid, tested and true!
Richard del Campo TPM: Richard, to get started and for fun, what is something that nobody knows about you? del Campo: I am Cuban; I play tennis; I grew up in Miami, and I speak three languages: English, Spanish, and Portuguese. TPM: What is something funny that people don’t know about the Jerr-Dan crew? del Campo: I have been traveling for twenty years, and we travel light. What is funny is that when we have new people that join us, they don’t always know we don’t check in bags. If you travel with us and have a bag to check in, we require you to buy a carry-on and transfer all your stuff. This way we never lose a bag and never wait on luggage because we have a job to do! TPM: What does 45 years mean to you? Del Campo: It means a company with 6
TPM: What or how does the JerrDan brand set itself apart? For example, how is Jerr-Dan’s brand different so that it would convince that hardcore brand loyalist to become a JerrDan user? del Campo: Competition is good, and we respect our competition, yet we don’t base ourselves off our competition. We are not focusing on what others are doing; we focus on our strengths. Specifically, what sets us apart is our people, our quality across the board, our commitment to safety (which is what drives our quality), and our unwavering commitment to ethics as seen in our company being been named a 2017 World’s Most Ethical Company. Finally, what sets us apart is listening to our customers-what they need is what drives us. TPM: What is the relationship with JLG and how are their resources coming into play for the Jerr-Dan brand and business? I recall when I did the factory tour, I saw more than the Jerr-Dan brand there; I saw JLG lifts, and I thought it was a perfect relationship of blending from Oshkosh. del Campo: We have an enormous advantage in Oshkosh celebrating 100 years from trucking to chassis to technology. They give us a competitive edge. A good example of this edge can be seen in Jerr-Dan’s Tow Performance Calculator which gives an estimate of

what a tower’s truck could tow so the tower can match resources with what the customer needs from pricing, size, location, and more specifying the equipment needed. TPM: What is the most common misconception you hear from people about Jerr-Dan? del Campo:The most common misconception I hear is that Jerr-Dan is limited. Jerr-Dan is limitless; we are setting the pace and tone. TPM: What is Jerr-Dan’s goal for the next 45 years? del Campo: We will stick to what has made us successful: (1) Have a sense of urgency, and instill it in your people. (2) Be accountable: do what you say and say what you do. (3) Communicate across the board. TPM: Is there anything else you would like to add or share to show the strength of the 45 years or Jerr-Dan in general? del Campo:I would add that our distributors are on the frontline of our strength. Also, I would say a buzz word for us here is “solutions.” We are focused on what our customers need, so “Customer Solutions” centers our direction moving forward. TPM: Finally, Richard, what are you most proud of? del Campo: We are most proud or our people. Alternative Chassis Set-ups for Centrury 9055 Now Available Miller Industries Towing Equipment Inc. now offers alternative chassis set-ups for the tried and true Century® 9055. By offering Tandem-Tandem chassis configurations on the Century® 9055, Miller Industries has taken the knowledge gained from their European counterparts and applied it to the North American 9055. The Tandem-Tandem configuration lightens the rear axle weight by eliminating the lift axle. Miller has also invested in the benefit of tandem steer technology to add additional front axle weight. This configuration puts four steer tires and brakes on the ground for enhanced steering and control during braking.
The concept came from the European cab-over chassis while working with Boniface and Jigé. Boniface Engineering and Jigé International are Miller Industries partners in Europe. In our test case, the vehicle had only 21,000 lbs. on the tandem steer and 24,000 lbs. on the drive axles. The better balance is achieved by eliminating the tag/lift axle, which actually takes weight off the front steer tires while in use. Texas Towing Industry Concludes Successful Session
Senate Bill 1501, recently signed by the governor, solves many of our major lien processing issues. Southwest Tow Operators has been working hard on these issues for the last two years. We want to thank the Texas Department of Licensing and Regulation, Representative Kuempel (R-Seguin), and Senator Zaffirini(D-Laredo) for their help in getting this done. This bill contains some important initiatives we have been working on for a while: • Reporting abandoned vehicles to law enforcement will now only be required if the law enforcement agency REQUIRES it. • Tax offices CANNOT require proof of DELIVERY (only proof of mailing per statute) for notification letters in order to process a storage lien. • If you accidentally send the first or second notification letter a few days late, you can still sell the vehicle without going to district court for a title. Also, the dual license has been repealed. If you hold a tow operator license, you can now work in a Vehicle Storage Facility (VSF) without a special VSF or dual license. And, the Towing and Storage Advisory Board will now be made up of nine members. 5 industry members and 4 others (2 law enforcement, 1 insurance and 1 parking facility representative). There is an opening for a new towing/VSF member and we will now have more representation from industry than from outside the industry, which is important. These changes are effective immediately. In addition to getting this passed, we also killed many bills that would have devastated our industry: 10
- Two bills requiring property owner to be present at the time of tow: KILLED - Bill requiring VSF’s to store vehicles free for the 1st 24 hours: KILLED - Bill requiring cargo to be released at no charge: KILLED - Bill requiring TDLR to regulate Incident Management tows and put a CAP on IM tow fees: KILLED - Bill requiring rights of vehicle owner be printed on tow signs: KILLED - Bill giving vehicle owners 180 days to file for tow hearing: KILLED We did not accomplish all of our goals this session, but we are very happy with what we did get done. We are already working on our goals for next session, which will occur in less than two years. In the interim, we will be working with stakeholders on the issue of price gouging for large truck tows and getting a daily storage increase for the industry. This has been the most stressful, but the most successful session the towing industry has had in many years. We have had more people involved than ever before. Thank you to all of the industry folks who took time off of work to show up at the Capitol to testify. Also, a big thank you to everyone who made phone calls

to your representatives and others on these bills. The visits and phone calls go a long way and are noticed. Additionally, thank you to our loyal members who pay dues faithfully each year and support the industry by training and testing with us. How you can help: • Get involved and support your local association any way you can. • Contribute to a Political Action Committee so that organizations can support legislators who are friendly to our industry and who support small businesses. • Get to know your state senator and representative. Let them know you are in the towing business and are here to help. Sponsor a fundraiser for them or put up signs. Representatives in Texas have to run every two years, so they need a lot of help. • Help us keep the momentum going so we can get a storage rate increase next year. Getting disabled cars off the roads more quickly helps decrease traffic congestion and reduces secondary accidents. Streamlining the towing dispatch system also allows police to get back on the streets faster and focus on public safety. In addition, AutoReturn takes the hassle out of towing by making it easier for citizens to find their cars after they’ve been towed. AutoReturn’s system allows car owners to find their vehicles through a user-friendly web search or an automat-

Isuzu Announces Production of 40,000th N-Series small-block V8 engine that produces 297 horsepower at 4,300 rpm and generates 372 lbs.-ft. of torque at 4,000 rpm. The powerplant is mated to a six-speed automatic transmission with double overdrive and lock-up torque converter for enhanced fuel economy and performance. An optional version of the engine is capable of being converted to run on compressed natural gas (CNG) or liquefied petroleum gas (LPG, or propane). Every time I hear about a fire at a tow yard or recycling center, I cringe. With so much inventory stacked closely together, it could be a disastrous and devastating situation if there was a fire. Personally, I’ve heard witnesses describe, “flames that were high as the sky,” “a facility on fire with rising black smoke seen for miles around” or “loud bangs with explosions resulting from ignited oil cans and popping tires.” When such a fire happens, we feel badly for those experiencing it. Hopefully they can make some changes so it doesn’t happen again. However, careful planning could have helped them minimize the damage. After reading a piece written by Mark 16
Gamble, I want to share with you Mark’s ideas on how to cut down the risk and avoid major tragedies. Mark described a fire that happened in the dismantling bay at Bessler Auto Parts facility in Kentucky. It was a normal day at Bessler. Everyone was working until the staff yelled, “FIRE!” Instantaneously, two workers put into play their plan. One opened the garage door while the other retrieved a fire extinguisher. While the fire extinguisher was doing its job, the vehicle was being low-

ered. Someone else called 911, and the phone was handed to another employee to communicate their address. As the vehicle hit the garage floor, another worker had boarded a loader ready to remove the vehicle from the bay. The vehicle was removed to an area away from inventory in the open air. The only sustained damages were to a smoke detector, the wiring leading to the smoke detector, and the insulation on the ceiling above. “How could a plan work so quickly?” you ask. It was a working plan. Earlier this year, this facility had attended fire training and planning classes that could help them in such dangerous situations. This facility had installed a safety training program and performed monthly safety drills so they could be prepared for any situation
Fuel 4 thought cont inued inside the shipping and dismantling area. They had also been performing similar, quarterly drills inside the sales area. What a testament to proactive training and planning! Having a plan and working the plan resulted in quick response with minimal damage and no injuries. When asked why they could sustain minimal damage without any injuries, workers unanimously agreed that it was their continual fire safety training that helped them maintain the fire. They didn’t have to think because they had a plan. As a business owner or manager, are you prepared if one of your employees says, “Fire, Fire in the Yard”? It’s a simple question. If you answer “No,” then you might have compound problems later if you don’t implement such a program at your business. If you do have safety training in place at your facility, when was the last time you actually had a drill? Would your people work together to avoid major

damage like the workers did at Bessler Auto Parts? There are companies that can help you be prepared. I know for a fact that Bessler uses Mike James and E-Comply for their training on safety and environmental compliance. Lots of yards use Mike for storm water permits, now for little money ($50 a month), that can solve your environmental compliance problems. Call me if you want to train your people to be safe. Not sure if training is necessary, ask yourself how much is your facility worth

I recently took k a trip to Disney World in Florida. It was an opportunity to bond with my grandkids and show them a good time. This was new to me, and my original thought was to cut cost and go as cheaply as possible. We wanted a room on Disney property to Florida without stopping. In everything that had a full kitchen so I could cook I planned, I tried to save money. meals for nine people. could not drive to Florida with three kids in the car. We changed all our plans and flew to Florida and purchased a meal plan so there was no cooking. We did a redo, and we never even started yet. We had a great week in Disney, but as I look back, there were still several things I would change if I did it again next week--yes, another redo! If you looked back at the last five years in your business, what would you change? When I ran my business, all I did was private-property tows. Many times, I would ask myself the question, “Should I perform other types of tows like city rotations, body shops, motor clubs, and consumer tows?” I worked in the computer industry before I got into towing. I sat in on a meeting once with Ross Perot, who owned one of the largest computer companies in the world. In that meeting, he made a statement that lives with me to this day: “In business, select one thing and be the best at it that you can be.” We selected private-property towing and never looked back. Every few years you should look at your business and make changes as needed. Redo a few things that will make your business more successful. Here are a few things to consider: 1. Reorganize: I read a business busine book that talked about putting everyone in the right seat on the bus. I hired a salespersale son one time, and I paid him a lot of o money. I questioned myself for a year y on whether I should have hired him o or not. Then I realized what he was doing for me. Not only was he my salesman, but he handled all my small claims hearings and a damage claims. He saved me thousands! tho s on At that point, I realized where he sat the bus. Lookk at everyone that works wo for your company and redefine their responsir bilities using the talents they are good g at. Put them in the right seat on the bus, b and this will lighten your load and mak make you a better company. Don’t be afraid to give them responsibilities. 2. Evaluate Your Location: Determine if you offer visibility and an
Insightful talk cont inued access to your customers. Should I open a new location on the other side of town or work with another company that is already there, but is not in competition with me? There are ways to grow your business without adding additional expenses. 3. Consider New Services: Introducing a new service or changing your current services can be risky, but it also gives you a new revenue stream. Are there things I could offer besides towing that uses the resources I already have? If you have a storage yard, store things for other people or haul things on your trucks besides cars. Get creative! 4. Image Your Business: You might want to improve your company image. Small changes could have positive effects on employees and customers. Putting your drivers in uniforms or new paint on the trucks is very noticeable to your customers. Offer more things for the community. Not only will your business increase, but it will also make you feel good. 5. Trim Down: Sometimes the hardest thing for your business is the best thing. If business is slow, it may be time to let go of that problem employee and bring in new people. Reward the people

that work hard for you, and this will improve morale. 6. Educate: Times are changing, and you better keep up with the changes or you will be out of business. Start by educating yourself. Go to a tow show and meet other owners. Train and educate your staff. It’s also good for morale, and it will make your company better. 7. Rest: Burnout is the last thing you need! Your body needs rest and so does your mind. So, if you can, give yourself a little vacation. I know what you are thinking, “If I leave, who will run the company?” If you don’t go, you may not have a company to run. Do whatever you can to clear your head. It will help your business, and your employees will like it too. A successful business owner will constantly be evaluating the business. Take a look at what you did last year and don’t make the same mistakes. See what worked and continue to do it and look at what did not work and don’t do it again. The biggest mistakes tow company owners make is they try to do everything themselves. Not only is it impossible to do it all, but it’s the wrong thing to do. Don’t be afraid to ask for help from an employee, another owner or to call me.

We are all in this together! When I got into towing, I had to go to tow shows or ask employees to help make decisions because I did not know much about towing. What I did know is how to get the most out of my employees. From drivers to dispatchers to mechanics, they made the decisions, and I would approve them. Try it; I promise, you’ll like it. In life you don’t get a chance to do many redo’s, but in business you better be redoing every year if you want to survive. Give me a call if you need help. N

IS THE INSURANCE MARKET REALLY THAT BAD? By Hal Kresser - Principal, Hal Kresser Agency
“Tow Truck Market Gets Hit Hard as Carriers Exit Market” This article appeared in The Insurance News Journal on February 6, 2017 and featured on the front cover. Simultaneously, it was posted in the “Forums” section of Tow 411, so it was written before February 6, 2017. Naturally, a front-page article will get the attention, and it did! That magazine is distributed to every insurance company in the country and to most agencies. Within just a few weeks, I heard from underwriters that they will have to tighten up their requirements and continue to raise rates due to claims. They were also apprehensive because many of their competitors were exiting the market. In their minds, the only reason a competitor would exit the market is if they couldn’t make any 26
money. All of them cited this article as their source of information and the catalyst for their changing attitude toward the towing industry. Many companies that have been taking heat for their huge rate increases pointed to the article as validation. Most insurance companies have always considered “Towing” to be a class of business that is too risky with low premiums and high claims. Those companies had their positions reinforced. Nationwide there are fewer insurance companies each year who want to insure towing companies, and news like this is not good! I would like to point out that the author referenced Progressive’s market pull-out last September as the harbinger of bad things to come. The problem with that is Progressive only pulled out of the

market temporarily due to some technical issues that created problems with the trucking classes. They have now rectified those issues and have re-entered the market. Progressive wouldn’t re-enter a market they couldn’t make money in so that does represent push-back to the article. The bottom line is fewer companies are offering tow-truck insurance. As a result, the prices are on the rise nationwide. Additionally, there is some truth about claims increasing due to accidents as more people are driving distracted by the ubiquitous “smart phone.” What to Do? 1. Consider - recent news about insurance as a threat to your business. 2. Consider - that the insurance company has up to ONE MILLION DOLLARS
on the line for every accident your company has. 3. Consider - the state of affairs with the settlement of claims. Example: recently an insurance company paid $65,000 to a person struck from behind in a parking lot. The damage to the car was an $800 scratch on the bumper, and she claimed back injury. She freely admitted she had a preexisting back injury from another recent collision. 4. Consider - shortly after an accident lawyer’s contact, those involved were offered legal representation on a contingency basis. This means it doesn’t cost the person a dime to make a claim against your insurance. They just give up a piece of any proceeds to the attorney. 5. Consider - claims that are not your fault still count against you--it’s called accident frequency. One claim is usually not much of a problem but multiple claims is trouble. 6. Consider - accidents are a problem with all classes of business including personal car insurance. In 2015 alone, 3,477 people were killed, and 391,000 were injured in motor vehicle accidents involving distracted drivers. U.S. Department of Transportation FMCSA
September 2009 7. Consider - who you buy your insurance from. An agency with experience in towing can be extremely helpful with claims situations, correct filings, and proper insurance coverage. Things you Might Consider Doing to Keep the Drivers on a Claims Avoidance Plan: 1. Get the cell phone out of drivers’ hands! Drivers should be using Bluetooth for hands-free as required by FMCSA regulations. 2. Maintain a reasonable distance from vehicles ahead. 3. Instruct your drivers on what some call “high-aim steering,” where the driver is scanning the roadway from side-to-side at a two to four block distance. The purpose is to observe potential hazards and take evasive action while still in control. 4. Make sure the truck dash is free from papers, maps, and other stuff that can obstruct drivers’ view. 5. Make sure the cab is free of drink cans, coffee cups, rain coats, fire extinguisher, and other stuff that could interfere with the pedals or other controls of the truck.

INSURANCE 6. Make sure the windshield is clean and the wipers are good and don’t streak. 7. Never move vehicles at an accident scene until police arrive. 8. Never take the word of anyone at the scene of an accident. Get out the cell phone and take photos! 9. Get names, phone numbers, and addresses of witnesses and the other driver’s information. Do not rely on the police to include this information in the report. 10. Cameras are almost a necessity. When involved in a crash, have the driver take a bunch of pictures from the direction he was traveling. 11. Tracking devices are a good idea for monitoring vehicle location and speed. You must think defensively. I can’t tell you how many times the story changes the day after an accident. Police reports are not always accurate. Witnesses can be wrong, and then there is the liar who will say anything that will lead him to a payday. The best defense today is a camera or cameras. I realize the expense; I also realize the impact a claim has on your insurance, and cameras are cheaper. 12. Establish consequences for accidents, like paying the deductible, suspension, truck assignment, and termination. You need a proper employee handbook. Make sure it has been approved by your attorney. Proper use of these will protect you from wrongful termination actions and wage and labor sanctions. 13. Testing your drivers’ ability; have a driver take you for a spin or ride along on a recovery. On a slow day, drag an old junker out, push it in a ditch or on its top, and then let a driver show you how it’s done. N Insurance-related articles are planned for each issue of Tow Professional. Dan-Am Air Advanced Aluminum Air Pipe System Are you in need of upgrading your current compressed-air system to run large impact wrenches or tire machines? Then Dan-Am Air is for you! Dan-Am Air pipe uses lightweight, aircraft grade, and powder-coated aluminum, which provides clean, dry air up to 232 psi. The reinforced, composite nylon fittings have dual seals, which rest on un-scraped pipe, providing a leak-free guarantee. Our Press-to-Connect fittings feature a “full bore” design for turbulence-free air delivery. This quick, instant connection eliminates the need to thread, solder or glue accounting for far less installation times than traditional copper or black pipe. Designed with simplicity in mind, DAA allows you to do-it-yourself. Measure, cut, de-burr, then simply Press-to-Connect equaling lower installation times and cost. All fittings arrive pre-torqued for immediate assembly and pressurization, as well as being interchangeable allowing for ease of future addition or expansion. “This “Press-to-Connect” subject tends to be the most misunderstood instructions in the DAA system. We have all been taught since we were young to loosen a given item, put it together, and then tighten it back up, right? That is wrong with Dan-Am Air. DO NOT loosen fitting caps before installation. It really is as simple as pushing the fitting onto the pipe until it bottoms out. Done. Stop. Move on. The only reason to loosen a fitting cap is to remove the fitting from the pipe. Loosening the cap relieves the pressure on the grip ring allowing you to gently back out the pipe. To reuse any given fitting, simply re-torque the fitting cap to factory specs (line the arrows up, see figure 1), and “Press-to-Connect.” As each cap is individual to its fitting, the arrows are either solid or hollow respectively.
