“Bobby’s Law” Linda Unruh says “Move Over One” in New Mexico
Last month while in Baltimore, I had the pleasure of meeting Linda Unruh. Linda has been in towing for 30 years, and I learned that it all came about because of a bet: Two friends of Linda’s told her that there was no way a woman could ever run a towing business in New Mexico. Linda accepted the challenge and, in a very short time, became the first woman and first Native American in the state’s history to own a towing company. Linda then hired the two gentleman that made the bet with her to assist in overseeing day-to-day 8
duties with the company. Pinky’s was established and became a thriving business in New Mexico. Linda’s business not only offered towing, but also had a mechanic shop with 6 bays for trucks and heavy equipment and 6 bays for auto repairs. Linda’s entire fleet of wreckers were pink, except for one truck that was black. That truck was her son Bobby’s truck and was his pride and joy. Linda’s son was very proud of the business his mother built and took a lot of pride in the job he did daily helping people

that were in need. Bobby Unruh, 37, of Tucumcari was killed on February 19, at mile marker 317 on I-40 near Montoya, New Mexico while attempting to tow a commercial vehicle. Linda was devastated--she had just talked with Bobby and asked him to be careful minutes before he was struck. Bobby had seen the 18-wheeler that was coming towards him, he made a conscious decision to move out of his safe haven to help a fellow brother pushing him into the toolbox into safety, Bobby was only steps away from being at front of his truck when he was struck. Bobby’s last act was to help someone in need before securing his own safety. Linda Unruh, stated that “New Mexico was the only state left that didn’t have a Slow Down Move Over Law.” This law had been under discussion and tried to pass for 3 years prior to Bobby’s death. Linda took the pain of loss, her passion for the industry, and the need to protect others and used it to fuel her efforts with help from towers across the state to local legislatures. “Bobby’s Law,” Senate Bill 76, was passed on April 6th and signed by Gov. Susana Martinez. Senate Bill 76 states that motor vehicles traveling on state or interstate highways are required to move over or slow down for certain vehicles flashing emergency or hazard lights, including recovery or repair vehicles. Linda Unruh went on to get a three Hundred Thousand dollars awarded for education in schools, bill boards, advertising, etc. This money will be used to educate our future drivers on awareness and on “Bobby’s Law,” and the value of giving a lane, so our men and women that are first responders can make it home to their families after helping yours in a time of need. 2nd Annual “Slow Down, Move Over” Rally
In the state of Alabama on December the 9th, towers across the state gathered at Garywood Assembly of God for the 2nd Annual “Slow Down, Move Over” Rally. Wes Passmore of Classic Towing & Recovery started the rally on the anniversary of the death of his driver and friend, John Hubbard. John Hubbard was struck on the side of the road while assisting a motorist December of 2016. Over 200 trucks were there at the rally to help spread the word. They led a procession from Hueytown, Alabama to Tuscaloosa, Alabama. First responders, police from Vestavia, Cordova, Bessemer, Jefferson County, and local Alabama State Troopers assisted in escorting the rally. John’s family wants to make sure that other towers get back home to their families safely. The “Move Over” law says that drivers should move over a lane for any vehicle 12

that's parked along the side of the road with lights on. If you can't move over, by law, you are expected to slow down. Jared and Jason Hubbard put it simply:” Slow down! Move over! Give a lane! Save a life!” We preach the “Slow Down, Move Over” laws in every issue of Tow Professional magazine; however, we only reach the owners that already know the importance of the law. Several local media affiliates were on hand to help get the message out. We need towers across the country to reach out to the local news and radio stations. We must get this message to the general public and help them to understand that towers are first responders. The towers are someone’s son, father, husband, daughter, wife, and mother that have loved ones at home that desperately need them to make it back. Help us spread the message!

George Horvat Named as Chief Operations Officer

COMPLAINING AS A LANGUAGE
“Why were you late this morning?” the manager asked. “I had to let my car warm up for like twenty minutes, and then there was frost, and the defrost thing wouldn’t make it go away, and I had to use one of them ice pick things to scrape the window,” the young man explained. “You didn’t know it was going to dip below freezing? It’s the middle of November,” the boss added. The young man gave a blank look. “Well, we needed you here at six. It was almost 6:30 when you clocked in,” the manager stated. “I know, yeah, I’ll try to do better,” the young man offered. I had to shake my head. Everyone has a phone, especially young people. 16
Everyone has an Android or iPhone, and all you have to do to check the weather is hit a quick app, or like on my phone, touch the location and temperature icon and it gives you weather for that day and the next few days. I’d have to have a significant chat with this young man about personal responsibility. That is mainly because after the boss talked to him, he walked directly over to the cashier and started going off about what a jerk the boss was, how he chewed him out for being late, and that it wasn’t his fault that there was frost on his car. I gathered my items and left, and the young guy’s mouth was still running, and I predicted his diatribe would continue for quite a while. Many people won’t take responsibility

for their actions nor do preventive measures like checking the weather or allowing for things like Daylight Savings Time. It’s always someone else’s fault. Because of this, most of them have developed complaining as an actual language or dialect. They can’t communicate unless they’re whining. Guy walks in at work:
“Man, I had to work two extra hours of overtime last night. I didn’t get home until 8. Rhonda was all kinds of pissed.” Second guy can’t leave this alone. “At least you get overtime. You must have your nose up the boss’s backside. I haven’t had any overtime for months. And I’m only making $10.00 an hour.
This job sucks.” First guy: “I’m not kissing the boss’s butt. I just work harder than you. You’re the one always calling out of work. That’s why I get the overtime. I get $12.00 an hour, though. If you weren’t a little sissy, you’d get a raise, too. I just hate working extra. It always happens when somebody calls out. I wish it was more predictable.” Second guy: “How can it be predictable when somebody calls out? You whine too much. Man, $12.00 an hour? And I’ve been here longer than you?” First guy: “I don’t whine near as much as Roger. That guy is always whining.” Two truckers heard recently: First guy: “This job sucks. I hate driving so much and trying to deal with traffic.” Second guy (a competitor): “I know what you mean. My dispatcher always sends me on loads through Atlanta, and
Atlanta’s traffic sucks.” First guy: “Yeah, I go through there about once a week.” Second guy: “Once a week? I’m through there at least three times a week, sometimes four or five. Once a week is nothing!” First guy (turns into a competitor or one-up): “Oh yeah? One time last month I was through Atlanta twice a day for a week. Twelve times through Atlanta!” My point to all of this is that these guys were on the clock getting ready to make deliveries. If this is a daily “whine session”, they could easily hit two or three hours of whining per week. With a driver making $18.00 an hour, times two for two drivers, plus the 1.4 factor that it actually costs you as an employer, that’s $25.20 per hour, per person. After talking to many tow companies and small associations, we all feel that our industry needs help. I am in the process of running a national survey to find out what the rates are for light-, medium-, and heavy-duty tows. I am getting rates from all the major cities in every state. I did a survey 6 years ago, and I am curious to compare the rates then and now. After talking to many tow companies and small associations, we all feel that our industry needs help. have gone up: 1. Truck prices 2. Insurance (that is, if you can even find insurance) 3. Gas 4. Tires 5. Any equipment relating to towing With the economy the way it is, all small businesses are struggling to survive.

When I started Southwest Tow Operators (one of the largest towing associations in the U.S.), we identified over 66,000 tow companies in the U.S. I know because we called them all. If I were to identify tow companies today, I think we would be much lower than 66,000 and closer to mid to low 40,000. There are things taking place in our industry that will drive even more tow companies out of business. There is a group trying to implement a program that requires national testing for all tow operators. Although their intentions are good, if not done right, it could really hurt the industry. I was at a tow show recently, and I discovered that there were several companies offering tows to companies for a monthly fee. Once again, the tow company gets hit with another expense just to get revenue. My wife was telling me
Insightful talk By D an Mes s ina about a video she watched recently showing companies how to not pay their storage fees and just dump cars at the tow company’s expense. There was a tow hearing recently where the tow company lost all his storage charges because he did not have the approval of the consumer to tow his car. This was a car
involved in an accident. Look at your business and see how much you would loose on storage just because you don’t have the consumer’s permission to tow the car. Over 40% of the tows are thru service providers like motor clubs and other service providers. These tows are done by the small tow company who
services the motor clubs. I know most big tow companies don’t care about motor clubs because they don’t take these calls; they make their money on city rotations. It’s the little guy that needs help or our industry will lose more tow companies. I previously mentioned other ways to generate revenue, here are a few of them: 1. One company got rid of his heavyduty business. This cut down on expenses, and he opened a convenience store. 2. One tow company and another tower from Alabama also opened a convenience store. 3. A wife of a tower in Shepard, Texas opened a nail salon and tanning salon in the front office of their storage lot. 4. One tower opened a U-Haul rental from his storage lot. 5. Tow junk cars and run them across the scales. 6. Offer RV and boat storage. 7. Store cars for new car dealers. 8. Store cars for other tow companies. 9. Offer storage units at your storage yard. 10. Provide overnight parking for tractor trailers as they pass through town. If you have room on your storage yard, there are ways to make money with it. Work with the small companies in your city and help them out by sharing your tow yard. If the tow associations, especially at a national level, want to help the industry, we should look at the following: 1. Open a school and train drivers. All tow companies need drivers, so pick a central location, lease a vacant building, and open shop. This way all associations can get involved. 2. Develop a certification program for drivers but make it fair to all. I know what I am about to say may sound silly, but don’t make reading mandatory. There are people that worked 50 years in the industry but are not good at taking tests for one reason or the other.

3. Help to unify our industry. The some of the magazines get along, some don’t. Some of the state associations get along, and some don’t. Some of the tow companies get along, and some don’t. This must change; we all must worked together and get along if we are going to survive as an industry. In the past three years, technology has become a big part of the industry: new dispatch software, new GPS ideas, and new digital dispatch software just to name a few. It becomes harder and harder for the little guy to survive because of the lack of technical skills. I am working
on a product that I will roll out in January that could have a major impact on the industry. Here are a few benefits: For the tow company: 1. Gives you a tow you never had. 2. Cuts your expenses. 3. Provides service for free. 4. Provides free GPS. 5. Improves communications. 6. Offers fair tow rates. 7. Provides quick pay by service provider For the service provider: 1. Improved ETA. 2. Large tow network. 3. Improve Communications. 4. Cut expenses. Who really benefits is the stranded motorist, alone in the middle of the night, needing help. I am going to be providing a service that benefits all involved. That’s what we need to do as an industry. State
associations must work together, national associations must include associations west of the Mississippi. And finally, tow companies must work together to get higher tow rates. Our industry needs help, and it’s time we all come together and make it happen. N

INA TOWING Hosts Towing Elite Forum of Industry Leaders By Darian Weaver - President - Tow Professional On November 15, 2018 as towers from around the nation descended on Baltimore for the Tow Show, INA Towing was preparing for another Tow Elite Forum. Gay Rochester hosts this event each year with Element Fleet Management and industry leaders with a discussion scope of promoting a safe future combined with reliable service and growth for the upcoming year. INA brings their tow provider many things--one being the ability to service Element Fleet Management and their clients. This gives INA Towing the ability to send safe and reliable business to their provider network and the ability to pay them fairly and squarely for their work. When INA Towing calls a provider, that provider is assured that they are being called from an experienced party that not only understands the time need for the job but also takes their safety into consideration first and foremost. INA Towing doesn’t look at their relationship with providers as just a vendor relationship but as a true partnership. Gay Rochester stated, “The cornerstone of our relationship is respecting our providers and standing by them 100%. We offer our providers many tools to 22
assist them along the way.” INA Towing’s software system called “Shepherd” is exclusive to their providers, so they have the top tools to manage dayto-day tasks. The system helps assist your staff in performing their jobs as efficiently as possible so that any driver that was in harm’s way could be moved to safety as quickly as possible. We have formed relationships with CenterPoint Insurance to assist our network of providers with competitive rates on what is needed on insurance and to assure there is no shortfall. The Element Fleet Management Team was on hand to take part in the event and to have an open discussion with providers. We all were able to dip into the well of knowledge with the team on hand that consisted of Brad Burgess, Bill Jones, Ryan O’Shea, Marcy Galloway, Joy Schnetzka and Jason Roberts. Element has instituted a three-part plan that focuses on: client experience, automation and accountability. 1) Client Experience – focusing on driving experience and efficiency with providers. 2) Automation – reinvesting in automation to bring a more efficient process to the client.

3) Accountability – working hard on accountability to ensure execution on expectations of customers. This plan has already meet expectations for the 3rd & 4th quarter, driving up stocks in favorable value 50% from February 2018 to current day confirming with joy. One of Element’s clients serviced by INA Towing’s providers is Sperry Rail. Sperry rail is one of the largest rail-testing companies in the world. They have a fleet of over 150 trucks and specialized equipment that maintains a plan for the mainline health of the tracks. Sperry Rail has tested over 12 million miles of track and knows that their success or failure relies on the service from their provider. Pete Erickson, Manager of Fleet Support for Sperry Rail stated that “INA Towing was very personable and showed great willingness to meet our expectations. Interaction between INA Towing, Element and Sperry Rail was integral in the design of our trucks. This forward thinking helped us to design our equipment, so that service could be done in the most efficient manner.” The Red Cross is another client that INA Towing works with to assure that their drivers’ and volunteers’ safety is protected on the road. Marvin McClain of the Red Cross says when choosing a provider, cost is a concern, but the safety of his drivers and volunteers is most important. Marvin stated, “I would rather pay for a professional service that is done right than a cheaper service that compromises my driver’s safety.” The Red Cross has a fleet of over 8,000 vehicles that is serviced by INA Towing providers. This year, Marvin McCain of the Red Cross was presented a check from Gay Rochester of INA Towing for 16k in donations from the INA team and provider partners that attended. Linda Unruh was on hand to share her story with everyone that attended. Linda owned Pinky’s Towing and All Rite Towing in New Mexico and was the first Native American and first woman owner in New Mexico. She owned these companies for 30 years and was very successful with her business. Feb 19, 2017 was a tragic day in Linda’s life--she received a
call no tower wants to get. Bobby, Linda’s son, had been struck by an eighteenwheeler and killed while assisting a motorist. New Mexico was the only state out of 50 that did not have a “Move Over Law.” This started Linda’s quest to get the law passed to help protect others in her industry. What many said would take 3 years or couldn’t be done, Linda was able to get the law passed in 19 days. She has taken the pain and loss of a child and used it to push forward and educate others on the risks and the need of protection for our towers. She charged all in attendance to take hold of options available to educate everyone on the need to observe “Move Over Laws.” Her powerful message captured the minds and hearts of the Forum attendees. The collective forum was a great success! It brought together many industry leaders with the Element Fleet Management & INA Towing team and emphasized to all that we are one big family. ECM Performance provides Engine Control Module (ECM) programming and Diesel Particulate Filter (DPF) Deletion Tuning. In real world work applications, repeated short drive times at less than highway speeds are very common. Also, trucks are increasingly used as machines requiring long idle and extended use in PTO (Power Take Off) Mode. Both scenarios prevent a truck from properly going into its regen cycle which is supposed to clean the DPF filter. This is where the trouble begins. A clogged DPF filter can result in diesel soot backing up into the engine, causing damage to the VGT actuator, turbo, fuel injectors and EGR solenoid. Also, the unburned fuel injected into the exhaust system, as part of the regen cycle, can go into the crankcase contaminating the engine oil.Customers unbolt the ECM from the engine block, unplug the harness connections and ship it to ECM Performance. The Current Status of Towing Insurance By Jeff Spadafora - President / CEO Zellner Insurance Agency, LLC We have seen the current market for towing insurance just go crazy. Even if you don’t have any claims, the increase in premiums is at least 44%. What can be done? The answer is simple: “take the bull by the horns” and get away from standard carriers by looking into a captive insurance program. A captive insurer is generally defined as an insurance company that is wholly owned and controlled by its insureds. Its primary purpose is to insure the risks of its owners, and its insureds benefit from the captive’s underwriting profits. Underwriting profits can be generated by reduced claims and investments. Zellner Insurance Agency has teamed up with a Managing General Agency that has experience in setting programs up for specific industries that were experiencing premium increases. The results have
been tremendous! Claims have been reduced because they are either settled for less money or not initiated at all, members received dividends, and safety increased. We anticipate that initial insurance premiums will be better than what we are seeing now, but the real benefit is in years two and three. To participate, the members will make an initial investment and pay their premium.
