World Wide Equipment Sales and Jerr-Dan Donated a New Wrecker to CTTA Foundation

Jerr-Dan Corporation, in conjunction with Worldwide Equipment Sales, donated a new 2018 Dodge Ram (chassis) with a CHP-approved Jerr-Dan MPL-NG aluminum body to the California Tow Truck Association (CTTA). The new wrecker was recently auctioned, and the funds raised will benefit the CTTA Foundation, a 501(c)3 non-profit dedicated to providing training and continuous education to keep tow drivers and the motoring public safe. “Jerr-Dan is a strong supporter of towing associations that are committed to their local communities and those that foster education and training of our industry,” said Richard Del Campo, vice president/general manager at Jerr-Dan.

Talbert Cuts Ribbon on Expanded North Carolina Facility Talbert Manufacturing, a North American leader in specialized heavy-haul solutions, hosted a ribbon cutting May 14, 2019, officially opening the 58,000-square-foot expansion of their Liberty, North Carolina Facility. The 120,000-square-foot Liberty Trailers LLC will manufacture Talbert’s Tag-A-Long Series, Traveling Axle Series, and Hydraulic Tail Series trailers. With the expansion, the manufacturer looks to increase dealer and customer support throughout North America with increased production capabilities and a support staff of 60 associates. Several Talbert representatives were on hand for the occasion, including President Andrew Tanner, Co-Owner Russ Stern, Vice President of Sales and Marketing Troy Geisler, Vice President of Operations Jim Hall and Vice President of Purchasing Jamie Myers.

“In 1938, Austin Talbert set out to change the heavy-haul industry,” said Andrew Tanner, president of Talbert Manufacturing. “With the expansion of Liberty Trailers LLC, Talbert Manufacturing is closer than ever to realizing his vision of customer-driven design that meets the ever-changing needs of the hauling industry. We’re able to double our current output, allowing us meet the needs of our Tag-A-Long customers and dealers across the U.S. and Canada, so we can continue growing together.” The Liberty facility was originally home to Ferree Trailers, which Talbert purchased in 2014. The 60,000-square-foot building was completed in 1999. From there, Ferree served a loyal following of customers in industries including transportation, construction, military, government, and special OEM companies, producing a wide array of trailers. With the acquisition, Talbert continued producing select Ferree products and moved production of their Tag-A-Long, Traveling Axle, and Hydraulic Tail series trailers from their Indiana facility to Liberty. As the OEM grew, so did demand for the trailer series being produced at Liberty. In 2018, Talbert began expansion of the building and staff as part of its overall growth plan. The opening of the expansion marks the completion of the Liberty Trailer LLC upgrade. In addition to the 58,000-squarefoot increase in space, the expansion also houses two state-ofthe-art painting booths, overhead cranes, and a large finishing area. Equipment and staging areas were designed for optimum 14

flow throughout the manufacturing process, allowing Talbert’s production at Liberty to grow even past their current goals while maintaining the high degree of safety, durability, and resale value that are the pillars of the Talbert brand. “When we purchased the facility in 2014, we had 18 employees and a modern facility to allow for the type of growth we needed,” Tanner said. “Today, we have 60 employees at Liberty and are looking to staff well over 100 long-term. DOWNTIME LITIGATION HELPS COMPANY OWNERS I have been involved in the legal field as an expert witness for almost 20 years, and just when you think you have seen it all, something new comes along and surprises you. I recently began working with Kelsea Eckert, chief attorney at her law firm in Fleming Island, Florida. Kelsea and her firm do something I had seriously never heard of – they recover downtime claims for company owners and truck owner/operators who have experienced downtime on their equipment due to mechanic’s mistakes, shop negligence, accidents, or production delays. I was introduced to Kelsea Eckert through my good friend and towing/DOT 18

guru, Brian Riker, after he attended the Mid-America Truck Show (MATS) in Louisville, Kentucky earlier this year. He and I talked about how people with our backgrounds (those with shop experience, accident procedures and normal practices, and good knowledge of the transportation industry) could help Kelsea while she’s helping owner/ops and company owners. Brian has an incredible background in repair and service in addition to DOT/FMCSA knowledge as a driver, trainer, and evaluator. I have a background as a service manager and automotive technical school instructor, as well as expertise on the valuation and diminu-

tion (diminished value) side of litigation. After several cases and a little time passed, I reached out to Kelsea for more information, so I could share this unique niche-market law practice with people in my circle. We conducted an interview while I was transporting a Freightliner M2 recycling truck for my drive-away business, rolling through Florida on my way to Texas. Kelsea gave me some great information to pass along, and I’ll also explain how my involvement in the process works. First, I’ll share a couple of sample cases that I have worked on for her firm. An owner/op from Florida had his very nice


spread-axle stainless-sided reefer trailer torn up by a yard jockey with a trailer while he was delivering. He filed a request with the food warehouse, but they low-balled him and sort of blew him off. They had no idea that several polished stainless panels and some of the side rail would have to be replaced to properly repair his $60,000 trailer. I researched the estimates he’d gotten and reported formally to Kelsea Eckert, and we hope to gain him the real money needed to recover his loss due to damage. In another case, an owner/operator with a Volvo 760 and a flatbed needed to replace the u-joints on his driveshaft, and between him and the shop, they determined that a new shaft and yokes needed to be fabricated. The shop welded and built a driveshaft, and it failed 5 days later, costing him a tow and further repairs. The original shop had used yokes that were too short and tried to make

them work. After all was said and done, he was out another $4,000 and 18 days down. His truck generates a gross figure of $1,800 per day based on my calculations of 650 miles per day at $2.79 per mile. The man is out around $30k. During my interview, Kelsea Eckert made some straightforward points. She stated very directly, “Eckert & Associates handles insurance claims for small to midsized towing and trucking companies. Our team collects the claims you don’t have time to handle. Our clients are busy running the day-to-day operations of their businesses and don’t have time to be bogged down with insurance matters, especially small ones. We provide free consultations to all business clients and handle all matters on a contingency-fee basis. No money up front is required. What makes us unique is we handle downtime claims nationwide. We calculate the lost profit for our clients and pur-

What would that cost you?

I’m amazed by this unique approach as this is simply an area where no one else has ventured. Ms. Eckert continued, “(We) operate as an outside claims department for even the smallest of businesses with specialized knowledge of property damage, subrogation, and downtime/loss of income. We establish claims and recover the money rightfully deserved. Small companies feel the biggest hits from accidents. Large fleets can move equipment around to meet deadlines and fulfill commitments. Small businesses don’t have this luxury, rental is often not an option, and losses add up quickly. I asked how long they’d been doing this and told her we needed to get the word out. Her straightforward nature is notable: “We’ve been handling transportation related claims for 30 years. We saw a need – providing quality insurance claims services to small businesses at an affordable price.” Their insurance subrogation and collection services include: filing insurance claims, pursuing and negotiating property damages, pursuing towing and storage

We strongly agreed that towing companies need an attorney who focuses exclusively on the insurance and transportation industry, someone who understands their needs and is not afraid to pursue the insurance companies and mechanic shops for payment. bills, and proving the reasonableness of bills to insurance companies, handling insurance billings, fighting denial of coverage issues, calculating and demanding downtime/lost income claims due to accidents and mechanic negligence, pursuing self-insured companies and uninsured motorists for accounts receivable, collection matters, and negotiating limits issues and prove liability of denied claims. In our discussion, we strongly agreed that towing companies need an attorney who focuses exclusively on the insurance and transportation industry, someone who understands their needs and is not afraid to pursue the insurance companies and mechanic shops for payment. The process is simple and painless— two ideas that you welcome after an acci-

dent or mechanical incident has left you without a functioning piece of equipment. Here is the process: you contact their firm, they refer you to me or another expert they’ve contracted, and we experts collect all the vital information, including repair orders, your statements, accident reports, or anything else pertinent. We then formulate a formal report and help their firm calculate the actual daily/weekly/monthly loss of your downtime. The lawyers then do their thing and argue on your behalf. An Opportunity to Work Together I would like to talk to you about TowTrax not so much the app, but the process I'm going through to get companies to register. I'm working with several service providers servicing their calls. They tell me they have dead areas where they can't find a tow truck. They gave me an example of some like Milwaukee or anything south of Austin too. I looked at Milwaukee and found 72 tow companies in the area. I’m in the process of registering each of these companies. For years, there was always a big prob22

lem with the tow company and the service provider. Here a just a few of the issues: 1. Slow pay, partial pay, no pay by the motor club. 2. Poor ETA's by tow companies 3. Poor communication between tow company, consumer, and the service provider. These are just a few of the challenges. As I talked to tow companies, they told me their side of the problem. What I have

learned is it's the same problem in every state. As I register companies, I get to talk to a lot of tow companies across the USA, and it's been fun. I joined several state associations and have started working more with them. Montana invited me to be a guest speaker at their show in September. I find myself building relationships in every state. As I build my network of tow companies, I call each state association and issue them how many tow companies are in their state, and probably 80% had no


idea. When I asked them how many members they had, too many of them did not know. It's funny some of the service providers don't want their names on the tows I am sending, because they feel that if the tow company would see their name, then they wouldn’t take the call. Our industry has problems, and I intend to address some of them. I hired a company to run a program that identifies companies in their state; the results were amazing. Several years ago, Southwest Tow Operators payed a company to call close to 66,000 companies. That was the number we used for a long time. Then we ran our program against each state’s numbers. I talked to an association in Ohio, and I asked him how many tow companies are in Ohio. He thought maybe 1500--our report showed 10,000! After we cleaned it up, we came up with 3500--still a far cry from 1500.

By the time I run a report for every state, I would be willing to bet there are close to 90,000 tow companies. It is my goal to register over 30,000 tow companies to towTrax. I want to find tows for all the little guys in remote areas. I talk to some of these state associations, and they only want a certain type of tow company. I talked to one state, and they did not want any more members. That towing association president was the trucking association and did not want to see the towing side grow. Trucking associations usually don't like tow companies, so I would think you don't want a trucker as head of your association. If we look at things on a national level, there is always room for growth which can happen as the states start working more together and become stronger themselves. We do not have enough members in all of associations across the nation, so stronger states can result in a

stronger national effort as we all give support. To grow, we need all our associations to have services and support that not only targets the smaller towing companies, but the larger companies also both on a state level and national level-

Insightful talk cont inued something for everyone. From my experience in the towing industry for over 25 years, I have consistently identified 2 major problems:

hopefully it will be corrected soon. What I want to avoid is the driver needing multiple phones to handle multiple apps. My solution is one phone, one app.

1. Roadside Assistance - The poor consumer is getting killed because service providers and tow companies can't figure it out. I'm working on that, and

2. Tow Truck Drivers - For the past 20 years, I heard nothing but tow companies needing drivers. I don't see our next set of drivers coming from this next gen-

eration, and yet no one has the driver solution. This is an area that associations should work together and fix. I talked to someone at the national level, and they are coming up with federal testing. When you develop federal testing, you want the test to be new-tow company and new-driver friendly. If we don’t make it friendly, we risk isolating those who could benefit from the testing. I have great confidence that our leadership has enough talent to address this issue.

We are an industry in need of change. Everyone is trying to change their own little piece, so they can be competitive, but I don't think that approach will work. We need to work together to figure out what we want our industry to look like then make it work within your environment. A great place to work together and share ideas is Southern Tow Expo’s Association RSVP Dinner in Orange Beach which invites leadership of state associations including first responders to join in on the largest dialogue in the Midwest and Southeast to address these issues that affect us all. This year with 16 towing associations represented and with over 85 in attendance; it’s a place to startgreat opportunity to work together. N 24

TIPS 4 towers By James E. Lewis

ARE YOU KIDDING ME?

This morning I saw one of the most monumentally dangerous things that I've ever seen, and it was preventable in at least 14 different ways. This issue transcends the towing industry and applies to anyone working with equipment or tools. I was on I-30 eastbound in Benton, Arkansas, and a flatbed tow truck was in front of a car to be towed, which was at the front of a state police cruiser. The smooth steel bed of the flat bed was in the down position, sitting at a typical 3045ęš?angle, and the tow operator was up on the bed and had about 3-4' of cable pulled out and was yanking on the cable ferociously to unstick the rat's nest that was the cable spool. 26

So, he was on the side of the freeway during a police response tow, doing this this particular task; it was raining lightly, so the normal oil residue resulting is on the flat bed of the tow truck; the truck bed is angled, and he is ferociously yanking on this cable. owner check their trucks frequently to make sure things like this are handled, addressed, trained into people's heads, and executed properly? Why has this person not received safety and procedure training that was strong enough to make him do the right thing in the first place? Please bear in mind that this is the exact type of operator who might loudly

declare himself all knowledgeable in the industry, swear he's been doing it for several years, has never had a problem, and might even offer to train a new guy. As my fellow training and supervision people can attest, this guy is one hundred times more dangerous than a brand-new person with no experience. I deal with liability cases in this industry where people have little or no training and go out and

Tow Professional interviewed Andrew Loizou who founded and owns Nino Prints/ G.N. Novelties, LLC to share with our readers how and why this diversified business got started and what is has to offer the towing industry.

HOW IT ALL STARTED Darian: Andrew, I see that you have grown your business into offering over 980,000 different products for not only tow company owners, but also for those who offer top products and services to the tow companies themselves. How did you get started in this business? Andrew: I started this business over 30 years ago out of poverty and a challenged life. Things were not easy for me 54

from day one, as I didn’t have anyone there to hand success over to me. I grew up poor. As a four and five-year old, I remember my mom sending me out to find potatoes from other people’s gardens, just so we could have food to eat. Having been born with just one hand made it hard also. As I got older, others suggested I get on disability to which I refused because I wanted to make my own way. At 17, I started working for a company called Ritten House Paper who provides paper receipts with coupons printed on them for companies like WalMart, Office Max and others. I worked for this company for 12 years going from sweeping floors to becoming the general manager. Here is where I

learned the basics of excellence in customer service, printing, and how to run a business. In 1994, the company moved to Tennessee and asked me to move with them. I had a lot on my plate at that moment: I was going through a divorce, my dad died, and I was facing the responsibility of my raising my 13-month old daughter. I had been at a shop visiting with a friend of mine who said, “Hey man, you are Greek, so why don’t you start your own company and call it ‘Greek Novelties.” It made sense to me. After my dad’s funeral, I was standing at his grave in the cemetery, a man gave me a business card from his father-in-law who made printed T-shirts and did embroidery with a business called Gull Associates. I


contacted him, and he wanted to fund me and allow me to use his resources to get started. G.N. Novelties and Nino Prints was born in 1995.

THE “WHY”: CREATIVITY AND EXCELLENCE IN CUSTOMER SERVICE Darian: So, why do you do your business? What has been the draw for you to do printing and embroidery? Andrew:It is the creativity in the artwork design and the opportunity to provide excellent customer service. Let’s say that you call me up and say, “I need 2000 mouse pads with my company’s logo on them.” You give me the idea of what you want, I design the logo, get them printed, and then have them shipped out to you in 24 to 48 hours. I love the creativity of it, and then getting it to you fast! Let’s say you want to give out candy bars. I will take the chocolate and mold it into the shape of a tow truck, and then have a picture of your tow truck on the candy bar wrapper. Maybe you want to up the quality of the gifts and give out lobster and steak. I will have your logo printed on the lobster and steak and have it shipped to all your employees during the holidays. I like thinking out of the box!

PRODUCTS AND SERVICES Darian: I know you have close to 1 million different products for your customers from which to choose. Tell me about what you have to offer. Andrew: We can see from the major companies who have maintained strong success for years that branding plays a necessary role in getting our products out there in front of the public keeping them “top of mind.” This is exactly what my products do keeping your company’s name in front of the public. Our popular items are the simple T-Shirt, pens, sweatshirts, jackets, and koozies for drinks. Towers love shirts and hats and more, though it’s not just towers who love swag: I did 500,000 purple cushions for Alegra branding their company in base-

ball stadiums. I delivered them in eight 40-foot containers. I have made 1000’s bags for AW Direct/ZIPS branding their logo on their unlocking kits. I also sell the little tow trucks they give away. I put a company’s logo on the wall clock. We also deal in apparel and have printed shirts many of the major sportswear companies such as Fila, Columbia, Nike, and Adidas. So, whether you need a golf shirt for a golf tournament or want to send a name with your company’s logo on it to all your employees, Nino Prints can get the job done. We have partnered with seven other companies, so when you call in on Wednesday you can have what you need on Saturday. Our goal is a 24 to 48 hours turnaround locally and close to that regionally or nationally.

Since had a rough early life, I now own two group homes for men trying to get their lives back on track from drugs and alcohol. The homes total 20 beds which help these men get off the street into AC, heat, cable, TV, free laun-
