National Sherriff’s Association Conference
By Syre Perkins Tracked Machines NARecently I had the privilege to be invited to attend and speak to the National Sheriff’s Association’s Annual Conference in Grand Rapids Michigan (June 2023) to provide a briefing to the NSA Legal Affairs Committee about the capabilities and the required use of Tow Track Towing Robot Machine with Electric Vehicles in Europe. Thirteen European Countries have mandatory legal requirements for the use of the TowTrack when dealing with disabled Electric Vehicles (EV’s). Law Enforcement is looking at U.S. Mandates for this machine use under the Traffic Incident Management System due to the legal issues.
At the conference, heavy discussion related to bad towing incidents with allegations consisting of Usury, Fraud, Theft, Excessive Fees, Improper Equipment, Over-Weight and other illegal conduct by tow companies and their operators while performing services for motorist in emergency situations on public roadways. Some incidents have made national news with events occurring in New York, Chicago, and Atlanta. Placing bad publicity into the towing industry and giving the public impression that law enforcement is not doing anything. These stories are causing public and law enforcement outrage.
At the NSA Conference I met attorneys, law enforcement leaders and representatives from the Commercial Transportation Insurance Industry, Commercial Insurance Actuaries and Underwriters, Attorneys for Federal Motor Carrier Safety Administration (FMCSA), Agents from Homeland Security and many elected Sheriff’s. I was surprised about the issues and problems being discussed by law enforcement and Commercial Transportation Insurance Industry were about the Towing Industry.
In my conversations with elected Sheriffs and attendees, I realized this subject matter is going to make substantial changes within the Towing Industry.
Transportation Insurance Officials told the Sheriffs “The Roadside Towing Industry has been around since the invention of the automobile. During this time, the Towing Industry has not changed the way it operates, and with some companies operating outside the legal requirements! Most towing companies on Law Enforcement Rotation have retained legal counsel and been briefed the legal towing requirements in the state? The
problematic issues speak for themselves. The Towing Industry had major changes with the enactment of the Federal Motor Carrier Safety Administration, the Homeland Security Act, the Electronic Signature Act, and Supreme Court Case Law (Columbus V. Ours Garage & Wrecker Service, Inc.: 536 US 424 (2002)) that provides local law enforcement control over the towing industry for Public Safety purposes. These issues are now being addressed to law enforcement by the Commercial Transportation Insurance Industry who is now educating the Sheriffs and Police Chief’s.
Most towing companies and their operators are not aware that they operate under the Public Safety classification, and this is a big issue for law enforcement. Tow Providers take no oath, have no formal training and qualifications. They operate for profiting by helping disabled motorist. So, the question is how do they share a classification in Public Safety?
The answer is unique. Towing Companies and their operators are provided this public safety designation by the Insurance Industry and the Federal Emergency Management Agency and is also defined under the North American Insurance Industry Classification System (NAISC), National Counsel of Compensation Insurance (NCCI), the Federal Emergency Management Agency (FEMA) and the United States Department of Transportation (USDOT), Traffic Incident Management System (TIMs). These classifications are due to the towing companies and operators are performing transportation rescue services to disabled motorists on Federal, State, County Roadways. Any tow operator who is performing towing services on a public roadway can be criminally charged by local, state, or federal law enforcement. The Tow Operator is responsible for the motorist upon the operator’s arrival per the Traffic Incident management System. With this, do not be surprised in the future when law enforcement mandates background checks on all drivers and requires accountability trip reports on all towing companies in operation in the county.
The Elected Sheriffs in Ohio are taking these legal issues very seriously and are determined to make major changes. For example, The Ohio Sheriffs Association is 100% united and makes their presence known by wearing their iconic blazer/jackets everywhere to show they are Ohio Sheriffs and possess unity. They

have already started to take control of the towing storage and vehicle foreclosure process by conducting it themselves. Some County Sheriffs have already made these changes with storing and collecting all impound fees for the impounded & foreclosure of vehicles and removed the tow providers from the entire process. The only service a tow provider provides is the initial transport of the impounded vehicle to the sheriff’s impound lot and then sheriff pays the contracted tow provider $125 directly to the and then all other storage charges & fees generated are collected by
the County Sheriff. This process has gotten the attention with other Sheriffs around the United States is under consideration in seven other States. Sheriffs that have already adopted this process are looking at purchasing the TowTrack Robot, and tow trucks to operate through the County Public Works Program. This is newfound revenue for the County, and they can control the vehicle foreclosure issues.
Law Enforcement is aware that 70% of all tow operations start through law enforcement contact. With this they are now experiencing legal issues with
damage claims and lack of insurance due to the insurance policy restrictions with the towing EV’s. Light Duty Wreckers and Flatbeds exceed the legal federal allowed weight capabilities of the wreckers and rollback trucks. The average weight of an Electric Vehicle is 7200 lbs. Light-duty wheel lift wreckers like the Ford F-550 and Dodge 5500 operate under the maximum federal weight limit of 19,500 lbs. and are limited to carrying around 3300 Lbs. therefore failing to possess to legal capability of transporting EV’s. If a dolly system is used, they are only rated for 3000 lbs. and will fail. Which means the truck is operating over-weight and illegally and there are no valid insurance coverages due exceeding the capabilities of the truck.
In dealing with these problems in the towing industry, we look at the minimum requirements that all towing companies must obtain to legally operate. According to the United States Code of Federal Regulations (CFR), Towing Companies are transportation companies that are required to possess Federal Motor Carrier Operating Authority prior to engaging in commercial transportation duties prior to operating anywhere in the United States. To obtain “Operating Authority” the tow company must file Federal Form MCS-150 to obtain USDOT number for the Motor Carrier Operating Authority.
As a condition for a Tow Company to be granted Motor Carrier Operational Authority, they must agree in advance of obtaining this authority to follow all requirements set by the State Department of Transportation (SDOT), the U.S. Department of Transportation, Homeland Security, and all other government rules,
regulations that are placed with county and/or municipal levels of law enforcement.
In 2002, the Homeland Security Act (HSA) was passed. The HAS changed the transportation industry forever. The Towing Industry and Roadside Assistance Dispatch Industry have failed to acknowledge this requirement. Under the HAS Amendment of 2022, all industries and their employees bear full responsibility and accountability with the operation and duties conducted inside the United States. Every citizen is responsible for the Security of the United States. This includes all Motor Carriers Operating under authority, their w-4 employees, 1099 contractors who have previously agreed to engage in commercial transportation under the operating authority.
The HSA also touched on many issues related to the towing transportation industry. Some are:
1. Commercial vehicles are prohibited from transporting hazardous materials including (gasoline or other flammable chemicals) on their trucks in areas with a population of more than 300,000 people.
2. Unattended motor-vehicle towing, and unattended vehicle and property delivery (after hours all transportation issues) is Prohibited on Public Roadways. Tow Providers do this every day, but a motorist can push an arrest warrant.
3. The (Federal) ESIGN Act, 15 U.S. Code § 7001, allows electronic signatures on documents, but transportation
matters but (Motor-Vehicles) require a physical signature to be made from the person requesting the service and the person who accepted the property at delivery. ESIGN is exempted in commercial motor vehicle transports and prohibited under 15 U.S. Code § 7003.
The issues discussed in this article are some of legal issues that every sheriff in America is talking about and facing. There are major changes coming to Towing Industry. Trying to make a profit and stay afloat gets harder and harder every day. I strongly urge the Towing Company Owners and Operators to get competent legal advice to ensure you are operating within the legal requirements in your area. The towing industry is regulated at all levels of law enforcement (local, state, and federal). The State of Ohio Towing Industry is regulated by the Ohio State Utilities Commission and then the Sheriffs are looking to adding another layer of regulation.
A few unique facts that you may find interesting: There are 3,081 Sheriffs in the United States: Three States have no elected sheriffs. The State of Hawaii has one Sheriff who is Appointed by the Governor, Alaska and Connecticut have no Sheriffs. In the State of Ohio, all Federal Law Enforcement Agencies must notify the Sheriffs of any arrest activities prior to the agents acting.

Like other conventional offerings, PW with LPR Pay to Park uses signs that are posted at the lot with QR codes which customers scan with their mobile phone. Customers are then directed to a site where they enter their LP and purchase a permit for the selected duration.
Then the benefits of integration kick-in. The entered License Plates are automatically entered into the advanced License Plate Recognition (LPR) system. An LPR-equipped spotter vehicle can efficiently and frequently patrol the lot to identify violators. The LP and geolocation on the vehicle in violation is automatically forwarded to tow trucks that are nearby and standing by to impound vehicles with expired or no permits.
The lot owner makes more money. You earn processing fees for the permitting, generate more impounds, and have the capabilities to serve more lots. The payback on the Vigilant camera system is typically measured in months!

Women OF TOWING

Some of my best days are the days when my phone rings and it is DJ Harrington, The Tow Doctor, on the other end of the call. Yes, that is how it really comes up on my phone. He was calling to tell me that my name came up at a meeting he was at and that I should be expecting a call. So, when my phone rang and it said Darian Weaver from Tow Professional Magazine was calling, my excitement went next-level up! I mean, who wouldn’t? Darian asked if I would consider being a contributing editor of Tow Professional Magazine with an emphasis on “women in the towing industry.” I played it cool, but I jumped out of my seat at the opportunity! I must give major props to these two because they are extraordinarily dedicated supporters of women in the towing industry and have been for many years. They see my passion for it and my goals for both the women in this industry and the industry as
a whole. I am extremely excited and blessed with another avenue to give women the recognition they deserve. He asked me to author an article about myself and what my vision is as a contributing editor.
Let us get the lesser of importance and my least favorite thing to do out of the way…. Yes, that is talking about me! I started going to tow shows back in 1992. That was 31 years ago, but who is counting? HDM Towing & Truck Center started in April of 2000 which means I have been growing this company for 23 years. I have learned a lot of lessons in those years of business. However, I like to focus on the more positive side of things, so I am happy to share the successes too. Raising a family and growing a business in this 24/7/365 life; no one gets out unscathed. The support in this industry from mentors and peers that I have gotten is what has helped me through it all and why I hope to give even more back to you
all. I am actively involved at the state and national levels of the towing industry, serving on various boards and committees. I have authored articles for trade magazines and given presentations at tow shows. This year, I started the Towtally She Said Podcast, where we dive into the lives and interests of women in the towing industry. I love this industry! Honestly, I would love it a whole lot more without the 24/7 hours!
Who am I outside of the towing industry? My favorite thing to do is spend time with my family, especially Nana Nights with my grandchildren. Traveling, hiking, picnics, or just hanging out watching ION are all things I love to do. Here in Wisconsin during the summer months, I love to be outside. It really does not matter what I am doing. Yard work, beach time, riding my motorcycle, or trail riding my bicycle are all things you will find me doing. During the winter months, I will just be over here wishing

Women OF TOWING

Now for the fun part…. My vision for this project and goals. I am excited for this opportunity to give women even more of a voice in the towing industry. One of the biggest benefits of this industry is the support and guidance these women share wholeheartedly. From the strong women out on the roadways to the powerful women working behind the scenes, we want your story! Everyone has a story to tell, and Tow Professional Magazine wants to turn the pages with yours.
I am going to keep it simple and throw some stuff out there. If any of this resonates with you, let me know! Towing is about way more than hooking up a truck and towing it to its destination. That part is particularly important but so is all the rest of
it. Running a 24/7 business can be extremely rewarding but it can also be incredibly challenging and draining. I want to talk about the importance of mental fitness in a 24/7 world and what we can do to avoid burnout. Let’s talk about retaining good employees and how to manage difficult ones. You will hear about the significance of your company brand and what you can do to enhance or rectify it. I will share my leadership wins and the lessons I learned from my fails. The importance of great customer service and how to set a standard that far exceeds your customers’ expectations. Are there topics you want to read about? RetainingBusiness
My company provided private property towing. That is all we did. Our market was extremely competitive. There were three major players and we fought each other over the same customer. Once you got a good customer you had to offer things to retain the business. Our big customers were apartments. Striping the parking lots for the apartments was an important thing. The state of Texas said we were not allowed to offer gifts. My competition did not care they would offer striping.
What I did was set up a small striping company and offered the apartments striping at $2.00 a unit. If the apartment had 250 apartments, they would pay me $500 to strip their entire property. I realized early that I was a service company and wanted customer service to be priority number one. Every December my wife and I would identify our top twenty best properties and
our twenty worst properties. The best properties were properties that let us tow cars if there were violations. I did special things for them, things like:
1. On holidays I made sure the office got cookouts for the entire property
2. I provided them with their own driver, so they had a direct line if they needed a car towed.
3. My driver would buy lunches for the office staff every few months.
4. Managers got special rates on certain cars towed.
5. We would give back 16% of the cars towed because of office mistakes.
We made sure we stayed within the boundaries of state laws. The expense to offer these things made sense when the total number of cars tows was rewarding.
You may do things for two or three apartments, but that management may have thirty properties they let you tow from.
If you were in the city rotation you found ways to satisfy that customer. At the end of the day, you must realize you are a service business and good service is king. I made a list of a few ways that may help you retain your existing customer base:
1. Superior Customer Service – This includes quick ways to resolve issues. Understand their issues and
be respectful when resolving them.
2. Maintain a High-Quality Service – Find out what your customer needs and provide that service. Let them know you meet all industry standards and understand
their expectations. This will make the customer think twice about switching companies.
3. Be Loyal to Your Customer - Offer them services they can count on every month. Let them know
they can count on you when necessary.
4. Be Creative – Find new services you can offer them. Stay on top of what your competition is doing and make sure your service is better than theirs. Look at market trends and ask the custom for feedback. Make sure you know they are happy every day.
5. Communicate Daily – Communications are important. As I mentioned earlier, I would assign specific drivers to properties, So I knew I had good communications. There were no surprises with problems, and in most cases the driver resolved the problem. Keep them informed on your
company’s changes and this will make them feel like they are a part of you.
6. Personalize Your Service – Include your customer’s name when in your communications. Tailor recommendations to individuals working for your customer and anticipate their future needs.
7. Offer Flexibility – My customers would have the wrong car towed. I would bring it back at no charge. If they were doing maintenance on their property. I would go out and move cars around at no charge. I never used towing contracts; I used service agreements that could be changed at any time. It was good to let my
customers know that they were not getting locked into long-term commitments. I would tell my customers it was my job to make them happy every day or they could find another company.
8. Understand Your Customer – It is good to know the history of how your customer functions. When they plan to add additional properties and what type of service they might want for that property. This insight can help you with your decision making and allow you to service your customer better.
9. Train Your Staff – Make sure you have the right people talking to your customers. Make sure they understand the type

of service you are offering and be well trained and knowledgeable about your company policies. If your staff is professional and friendly it can enhance your customer experience.
10. Get Feed Back – Your best salesperson should be your best customers. Ask for feedback on your performance and ask them for references. Let your customers know that their opinions matter.
Not all these suggestions may apply to you, but they can be helpful. I provided private property towing and these tips helped me tremendously. Take each idea and see how you can incorporate them into your company. Getting all your employees will improve morale
and make your customers happy. I would set up some type of training for all employees. I would let my drivers pick their own trucks and decorate them. I was often amazed how some owners treated their employees. Remember they are the ones making money for the company. There are many programs for training in all positions within your company. The employee feels like you care by providing training. Offer small rewards like dinners, movie tickets, small bonuses, or even a paid day off.
Once you implement some of these ideas you want to make sure your customers made changes that benefited them. By doing so it will help you retain business.

Some of you might not know that my grandfather was born in Cork, Ireland and that my grandmother was born in Dublin, Ireland. I’m considered FULL IRISH because both parents are from IRISH descent. With my Irish heritage comes the ability to get angry. Such was the case last week. I can certainly say, “I was IRISH mad.” You’re probably wondering what happened.
I was speaking with a fellow businessperson from the towing and recovery industry located in the US. My conversations with this person are usually good ones,
but this time it was different. Being a high-profile person within our industry, he revealed that going to a state association tow show isn’t something that he would ever do because that association is a “state-run” association. At this moment, I am wondering how he gets his training or does he attend anything. Or perhaps he attends a larger show? While I’m thinking, the tower reveals that he attends corporate shows, like the Baltimore Tow Show.
Amazed at his revelation, he continued that you would never see him or his team attending the Florida Tow Show. Not even the Midwest Regional Tow Show held in Ohio. At
this point, I can feel my face turning several shades of red. I wanted to ask him WHY he felt that way because that show is facilitated by the Towing & Recovery Association of Ohio (TRAO), along with the Towing & Recovery Association of Kentucky in conjunction with help from the West Virginia Towing & Recovery Association. Yes, this show is referred to as “The Family Towing Affair.” And, rightfully so.
This is the Tow Show that has a Thursday Night Auction where all the proceeds go to an injured driver’s fund. The money helps the state association help their members with lobbyist and things that aid the local towing industry. Every company that takes a booth or sponsors an event helps their industry at the state level. So, at the state level, the money isn’t going for
