Kudos For Co-naming Of Jackson Heights Corner As Diversity Plaza By a Staff Writer stretch of road in New York’s Jackson Heights, an eclectic neighborhood boasting of a population of about 200,000, was last week officially co-named “Diversity Plaza”, honoring the heterogeneity of its people and culture during a ceremony. On May 21, officials from the city and people from the neighborhood gathered where 37th Road, 73rd Street and Broadway intersect to co-name the stretch that has traditionally served as a meeting point and the mainstay of Jackson Heights, where South Asians, Blacks and Hispanics live and work side by side. “Diversity Plaza has truly become a neighborhood gathering point for Jackson Heights and Elmhurst residents,” said Council Member Daniel Dromm (DJackson Heights, Elmhurst). The plaza serves as a town square, concert stage, festival space and cafe year round. There is always

The New York City Police Department ‘s Community Affairs Bureau for Immigrant Outreach unit celebrated immigrant heritage through community appreciation at the prestigious New- York Historical Society Museum May 17. The program started with a video presentation of the history of New York followed by U.S. National Anthem sung by Sparsh Shah. Opening prayers were performed by Imam Khalid Latif who also happens to be NYPD Chaplain. Later, Joanne Jaffe, chief of community affairs, addressed the guests. Commanding Officer Lieutenant Adeel Rana of Immigrant Outreach Unit presented awards to community members, including Srujal Parikh from the Federation of Indian Associations, for his exemplary services for community. State Senator Toby Ann Stavisky (D-Queens), the Mayor’s Office of Immigrant Affairs (MOIA), the Friends of Diversity Plaza, SUKHI New York, and the Neighborhood Plaza Partnership, among others. “We are very excited about the co-naming ceremony and the designation of our special public space as, officially, Diversity Plaza,” said Shekar Krishnan, Chair of Friends of Diversity Plaza. “As the gateway to Jackson Heights, it is a reflection of the incredible cultural vibrancy and diversity of our neighborhood,” he said. He said following the recent installation of overhead lights and the beautiful street art by a local business owner and resident, “this is a wonderful day for our plaza,” the town square of our community. “We are grateful for the efforts of Daniel Dromm, the Mayor’s OneNYC Plaza Equity Program, and Neighborhood

Plaza Partnership for working with us and our community to bring these significant improvements to this important open space,” he added. In 2011 Dromm, the DOT and community stakeholders implemented Diversity Plaza as part of a larger neighborhood transportation study that sought to increase pedestrian safety and decrease congestion in the area. The plaza also serves to increase open space in a neighborhood where it is scarce. Because of coordinated efforts, the plaza has become an integral part of the Jackson Heights and Elmhurst communities and is home to a variety of festivals and cultural events throughout the year, and even a gathering point for immigrant communities when disasters occur in their homelands. In 2012, Dromm allocated $500,000 for the capital reconstruction of Diversity Plaza. When complete, the plaza will feature a raised street bed, new lighting as well as new planters and trees. Construction on the plaza is set to start later this year with completion in late 2017. Vita Coco, a coconut water company, has signed on as a sponsor of Diversity Plaza and will be funding additional cleaning and horticultural services for a full year as well as free programming for the community. “I’m proud to see my vision of Diversity Plaza as the capital of the living United Nations in New York City became real,” said Agha Saleh, founder of SUKHI, a nonprofit for South Asian community in New York. “SUKHI’s inclusive team of diversity lead by two women, Shazia Kausar and Fatima Baryab, and their dedicated work with Council Member Dromm at 37th Road during the past four years made this plaza famous around the world,” Saleh said. In a statement Mayor Bill de Blasio noted that Diversity Plaza has been a mainstay of Jackson Heights – one of the most diverse neighborhoods in one of the most diverse cities on earth – for years. “We are proud to stand with Council Member Dromm and the people of Queens to formally recognize the importance of this plaza for the folks here -who speak over 150 languages,” the mayor said.

Yale Awards Honorary Degree To Trinidadian-American Biographer By a Staff Writer n American of Indian descent originally from Trinidad, was awarded the Yale Honorary Doctorate for the Humanities May 22, at the 2016 commencement ceremonies at the Ivy League university. Arnold Rampersad is a biographer, literary critic, and the emeritus Sara Hart Kimball Professor in the Humanities at Stanford University. He is widely credited with renewing the genre of the literary biography and is considered among the nation’s leading biographers. His works, which chronicle the lives of AfricanAmerican luminaries, including W.E.B. Du Bois, Langston Hughes, Arthur Ashe, Jackie Robinson, and Ralph Ellison, have made a distinctive contribution to American culture, according to Yale University. He is an elected member of the American Academy of Arts & Sciences and of the American Philosophical Society. Rampersad's awards and honors include a MacArthur Foundation Fellowship and the 2012 BIO Award of the Biographers International Organization, and fellowships from the National Endowment for the Humanities and the Guggenheim Foundation. In 2010 President Barack Obama awarded him the National Humanities Medal.

n estimated 500 people, especially those of Nepalese and Tibetan origin, gathered at Diversity Plaza in Jackson Heights May 22 to mark the 2,560th birthday of Lord Gautam Buddha. The celebration in Jackson Heights was organized by the Himalayan Buddhist Community of Nepal in the U.S., a nonprofit working to unite all the Buddhism followers from Nepal in the United States. According to a QNS.com report, dozens of Buddhist priests recited a special prayer during the celebration. “This festival is a platform to bring together all the Nepalese

Buddhists living in the USA,” Tenzing Ukyab, president of the organization was quoted as saying by QNS. “The other purpose of the celebration is to spread the information of the birthplace of Buddha, which is Nepal,” Ukyab said. The official name of the Buddha’s birthday celebration is Vesakha, and is known as Buddha Purnima, or Buddha Jayanti. The day is celebrated all over the world, including, India, Bangladesh, Sri Lanka and Nepal that have sizeable Buddhist population. In New York the United Nations observed the day May 20 with Secretary-General Ban Ki-moon noting how the teachings of Buddhism can help the international community tackle pressing challenges,

including violent conflicts, atrocious human rights abuses and hateful rhetoric aimed at dividing communities. “On this Day of Vesak, let us pledge to reach out to bridge differences, foster a sense of belonging, and show compassion on a global scale for the sake of our common future,” Ban said. In Jackson Heights, scores of people, dressed in their ethnic costumes, attended the rally and offered prayers. Ani Kunga Chodron, who is a Harvard graduate, made a special remark at the gathering during which she highlighted Buddha’s teachings. ““I have always believed that following Buddha’s preaching will always bring positivity in one’s life,” she was quoted by QNS.

MOIA, which has called for granting such licenses, said May 17 that New York immigrants, who have been granted DACA, deserve the opportunity to pursue their professional ambitions. It said that the Board of Regents took an important step May 17 by providing a clear pathway for qualified DACA recipients to become teachers, pharmacists, doctors, nurses, and more. Nisha Agarwal, Commissioner, NYC Mayor’s Office of Immigrant Affairs, said last month that immigrants, including DACA recipients are already crucial contributors to New York’s economy. “Researchers have demonstrated that federal programs like DACA stimulate job growth and create new tax revenue for local and state governments through higher earnings,” she said. “Because the proposed amendments are likely to increase wages for DACA recipients and other similarly situated immigrants, New York State and localities within the state will also benefit,” she said. Estimates show that licensing results in up to 15 percent higher wages for licensed workers versus unlicensed workers. For this reason, this rule could result in tens of millions of dollars in increased earnings for DACA recipients in New York City alone.

Gupta, who graduated 15 years ago from the same school, and has won seminal civil rights cases, including overturning past verdicts, and who today is leading the effort to redefine conduct of law enforcement, is the first Indian-American to hold one of the top posts in the Justice Department. She spoke in the presence of her two sons, Rohan, 4, and Chetan, 7. Joking that she remembered just two words from her convocation, Vanita and Gupta, the civil right lawyer said practicing law remained a "noble profession." But even as it turns the values of "We the People" such as equality, fairness, freedom and opportunity, into real protections, it was far from evenly applied. "Despite the tireless efforts of so many to drive this progress – including efforts from my outstanding colleagues at the Justice Department – in too many communities across America today, we see a dramatic gap between what our laws guarantee, on the one hand, and what people experience, on the other," Gupta asserted. She reflected on times when U.S. law did not live up to its highest ideals, such as during centuries of slavery and Jim Crow, when the law codified discrimination and oppression. The law treated women, people of color, the poor as second class citizens, at best, said Gupta. But she expressed optimism about America's ability to bring out the "promise" of the legal framework. Despite tremendous obstacles, she said, the law had achieved "unimaginable" progress, from LGBTI rights to policing and criminal justice reform. But there were important gaps persisting, she said, listing several among them such as difficulty voting, criminalizing of poverty and disability, the difficulty poor defendants have getting meaningful legal representation, continuing racially segregated schools 62 years after Brown v Board of Education outlawed them, use of force, racial justice, and rights of LGBTI individuals. Gupta took the opportunity to slam the North Carolina House Bill 2, denying transgender individuals to use public bathrooms according to their self identification. According to her such bills

charges reversed, and her clients were freed in 2003. Gupta also said her inspiration came from her family's story her parents who came to America 50 years ago, her sister who came out as gay, and a husband who escaped violence in Vietnam to reach America. Gupta became the head of the Civil Rights Division in October 2014. She served previously at American Civil Liberties Union where she is credited with pioneering that organization's National Campaign to End Mass Incarceration. Born in the Philadelphia area, Gupta spent much of her childhood in U.K. and France.

head of the June 7 primary in New Jersey, a group of people gathered in Jersey City May 17 for the formal New Jersey launch of South Asians for Hillary in a bid to enlist community’s support for Democratic presidential candidate Hillary Clinton and to galvanize volunteers to reach out and be proactive. The event at the Curry On restaurant in Indian Square, Jersey City, was attended by an estimated 100 people, including former New York City Deputy Public Advocate and Girls Who Code founder Reshma Saujani, former Kansas State Representative Raj Goyle, and Hillary for America Director of Women’s Outreach Mini Timmaraju. The event was also hosted by South Asians for Hillary Jersey City lead Bhavesh Patel. The evening launch was a show of South Asians’ support for the former New York Senator and to demonstrate that the community is an influential voting bloc in the American electoral process. Supporters for Clinton had come from throughout the state, including Hudson, Middlesex, Passaic, Bergen and Union counties. Jersey City Deputy Mayor Marco Vigil and Jersey City Council President Rolando Lavarro were also in attendance, and spoke briefly. “We were truly surprised by the overwhelming turnout at our New Jersey launch event,” said South Asians for Hillary New Jersey co-chairs Amit Jani and Dinesh Suryawanshi, who hosted the event. The organizers said it was gratifying to see that the South Asian community would like to

Clinton was ahead of Bernie Sanders among likely Democratic primary voters, 54 percent to 40 percent, in the Quinnipiac University poll released May 19. While Sanders runs better in the general election, Clinton tops him 54-40 percent among likely voters in New Jersey's Democratic primary. Only 6 percent of Democrats are undecided and 15 percent say they might change their mind before the June 7 primary, the poll said. "Sen. Bernie Sanders hangs in there, but New Jersey looks solid for Secretary Hillary Clinton in the June 7 Democratic primary. Some people are 'feeling the Bern.' But in New Jersey the Bern is lukewarm at best," Quinnipiac University Poll Assistant Director Maurice Carroll said. enough to just say you support Hillary Clinton.“You need to go knock on doors, make phone calls and write checks to make sure that our community’s voice is heard,” she said. Goyle, the first South Asian elected in Kansas, also echoed this sentiment of getting involved and being active with the upcoming elections. He stressed his family’s own immigrant experience and the importance of the South Asian community in the upcoming primary election in June and general election in November. “It’s time that we elect a candidate that will support our community, who has stood with South Asian and who will continue to do so going forward,” said Timmaraju. The organizers said South Asians for Hillary will also be holding other events throughout New Jersey in the upcoming weeks leading up to June 7 primary.

Hate In Hoboken Ravinder Bhalla, an accomplished attorney and the only Sikh councilman in Hoboken, New Jersey, engaged in a Twitter battle against a Trump supporter who labeled him #Terrorist, Ela Dutt reports ow the hell did Hoboken allow this guy to be a councilman? Shouldn’t even be allowed in the U.S. #terrorist.” That was a hateful tweet out of the blue for Hoboken Councilman Ravinder Bhalla, the first of its kind during his multiple terms as the only Sikh Councilman sporting a beard and turban. The tweet came from a Robert Dubenezic, who according to Bhalla, is from Jersey City, and a Trump supporter, he told Desi Talk. Bhalla didn’t take it lying down, wanting to nip in the bud what he sees as a rising tide of hateful speech encouraged by the tone set by Republican Presidential nominee-in-waiting Donald Trump. “Sir, I am born & raised in America. You clearly don’t know what it means to be an American. #ignorant @dubenezic @TotallyHoboken @HobokenInc” Bhalla tweeted back unfazed , adding, “Unfortunately, ignorance and racism are alive and well, even in Hudson County. I am not deterred but more determined to serve my community in Hoboken - as a proud American and a proud Sikh.” In the face of a cascade of responses from loyal Bhalla constituents, Dubenezic continued relentlessly. “No towel on my head,” he tweeted, according to the Hoboken Patch online news. He is no stranger to anti-Sikh speech, however. In the 1970s, during the crisis with Iran, he was called “Ayatollah;” when the war in Iraq took place, he was called “Saddam Hussain.” With 9/11, he was branded “Osama.” This time round, he said, because of the nature of the presidential campaign, “People feel more emboldened to say these things when one of the people running for President condones this kind of behavior.” Bhalla was referring to Trump’s “Wow. This is the impact of a Donald Trump candidacy. People feel more empowered to publicly express their ignorance and hatred. You’re doing a great job. Keep up the great work you do,” one supporter messaged Bhalla. And one Bhalla supporter is quoted in rawstory.com, pointed to Dubenezic’s name saying, “Your last name is as foreign as it gets! BTW, he’s not Muslim. Educate yourself.” During his tenure in council, Bhalla is proud of his accomplishments. And the hospital that was on the brink of collapse, was saved by selling to a private entity, thus saving 1,000 jobs, he noted. More Indian-Americans are moving into Hoboken, young professionals wanting to live in the “miniature Manhattan,” he said. These growing numbers have combined with some of the old timers who did not flee Hoboken when violent hate crimes against Indians spilled over from neighboring Jersey City that spawned the “Dot Busters,” gangs of the 1980s. For his Sikh community he helped bring a major change. “Last year, we were able to get the Hoboken City Police Department to change its policy and allow turbans and facial hair to be work by recruits,” he said. “So we have the ability to have a very diversified police force,” he added, and urged Indian-Americans to apply for law enforcement jobs. Bhalla graduated from the University of California at Berkeley, got his Master of Science degree in Public Administration and Public Policy from the prestigious London School of Economics in the United Kingdom. He has a law degree from Tulane Law School in New Orleans, Louisiana. Councilman Bhalla is married to Navneet K. Patwalia Bhalla, and they have two children, daughter Arza K. Bhalla, 9, and son Shabegh S. Bhalla 4.

The Sad Story Behind Canada’s Formal Apology To Indian Immigrants By Ishaan Tharoor n May 18, Canadian Prime Minister Justin Trudeau delivered a formal apology in his country’s House of Commons for an incident that took place more than a century ago. In mid-May 1914, the Komagata Maru, a Japanese steamship, arrived in Vancouver after leaving Hong Kong in early April. On board were 376 passengers, most of whom were Sikh migrants from what was then British India. The ship was not allowed to dock. A 1908 Canadian law at the time forbade arrivals in the country who did not make a “continuous journey” from their nation of birth or citizenship. In an era when hundreds of thousands of white European immigrants were settling in Canada, the law was seen as a measure to stymie Indian arrivals because it was practically impossible to travel directly from the Indian mainland to North America. In a challenge to the rules, the Komagata Maru, chartered by a Sikh businessman with ties to an influential Sikh political party in the Americas, steamed across the Pacific. Its arrival in Canada was anticipated by doom-mongering local headlines, which warned of an impending “Hindu invasion.” Sir Richard McBride, then the Conservative premier of British Columbia, made clear the explicit racism of Canada’s policies on the night the Komagata Maru reached Vancouver. “To admit Orientals in large numbers would mean the end, the extinction of the white people,” he said. “And we always

have in mind the necessity of keeping this a white man’s country.” After an almost two-month standoff, which also involved feisty demonstrations by ethnic Indians on Vancouver’s shores, the ship was eventually turned

away. When it reached Calcutta, now Kolkata, in India, British colonial authorities attempted to seize suspected Sikh radicals on board. The semi-riot that ensued saw security forces kill at least 19 passengers and arrest many others.

The incident is a reminder, particularly for Canada’s considerable Sikh population, of the widespread discrimination and bigotry meted out on Indians and other Asians on the west coast of the Americas a century ago. “The real value in the apology lies in a re-examination,” Ali Kazimi, an Indian-Canadian academic who made a documentary on the Komagata Maru story, told the Toronto Star. He added that should lead to a recognition “that Canada for the first 100 years of its existence had what was effectively a ‘White Canada’ policy.” “We failed them utterly,”

Trudeau said in April when he indicated his intentions to make a formal apology. “As a nation, we should never forget the prejudice suffered by the Sikh community at the hands of the Canadian government of the day.” In 2006, Trudeau’s predecessor, Conservative Prime Minister Stephen Harper, made a formal apology in the House of Commons to the country’s Chinese community for the discriminatory “head tax” imposed on Chinese immigrants who came to Canada between 1885 and 1923. In 2008, Harper apologized in Parliament to the country’s indigenous populations for an official government policy that saw tens of thousands of indigenous children taken from their families and resettled in boarding schools. But an apologetic speech he made in 2008 at a Sikh cultural event in British Columbia didn’t assuage Sikh demands for a proper reckoning with the past, which many argued must also include a formal apology delivered in Parliament. Trudeau, who defeated Harper and the Conservatives in elections last year and appointed the world’s most Sikh Cabinet, promptly obliged. Trudeau, perhaps more than any other politician in the Western hemisphere, has also been particularly outspoken about the need to welcome Syrian refugees. Descendants of those aboard the Komagata Maru are expected to join him in the House of Commons. “It’s staggering,” Sukhi Ghunam, whose great-grandfather was aboard the Komagata Maru and never stepped foot in Canada, told the Globe and Mail. “I don’t think he ever thought this moment would come.” – The Washington Post

But, will the Trinamool Congrees (TMC), which hasstormed back to power in West Bengal with over two-thirds majority vote, play ball? Trinamool Congress supremo and West Bengal Chief Minister Mamata Banerjee, at her press conference after her party's victory indicated she would. “For us, our election manifesto is like raksha kawach. We have ideological differences with BJP but if there are matters which will help people, we can cooperate,”

Banerjee said in Kolkata when asked about Trinamool's role in passing the stalled Goods and Services Tax (GST) Bill, described as one of the government's most important economic measures. The TMC, in its manifesto for the 2011 assembly elections and the 2014 parliamentary polls, had promised support for the GST, which the Lok Sabha passed in 2015 but is pending in the Rajya Sabha as the BJP-led NDA lacks the numbers there.

At least one industry lobby thought the BJP could draw comfort from the showing of the TMC, as also of the AIADMK, which convincingly returned to power in Tamil Nadu. “The NDA Government will certainly find it easier to deal with Trinamool Congress and AIADMK in the Rajya Sabha for passage of crucial bills, mainly the longpending and the most important GST bill,” Assocham President Sunil Kanoria said.

While AIADMK chief and Tamil Nadu Chief Minister Jayalalithaa is yet to react on her party's cooperation in parliament, her stance against the GST is well known but she also enjoys good personal rapport with Prime Minister Narendra Modi. No sooner had the trends become clear May 19, Environment Minister Prakash Javadekar asserted that the government was keen to do business with the powerful regional leaders. “First purpose in any election is to win, secondly it is to ensure defeat of your main rivals and thirdly to feel satisfied that while your enemies like Congress and Left are defeated, the friendly regional parties have won,” Javadekar told journalists. In the Rajya Sabha biennial elections due on June 11, the BJP hopes to gain from states like Rajasthan and Maharashtra where seats have fallen vacant. “The assembly polls saw BJP win in Assam and decimation of Congress in crucial states. This growing anti-Congress mood will be reflected in monsoon session of parliament and regional parties like Samajwadi Party and Trinamool Congress will have to make a clear choice about pushing for legislative measures like the GST bill,” a key BJP leader said. Of the 57 seats for which elections will be held, the BJP and the

Congress each held 14. But the Congress' decimation in assembly polls in last two years in Andhra Pradesh, Maharashtra, Rajasthan and Telangana could result in the party losing at least 4-5 seats. The Congress strength in Rajya Sabha is now 64 and this could scale down to 60, but it will continue to be the single largest party in the house. Twenty-five Rajya Sabha seats are up for grabs in states where the BJP or the National Democratic Alliance is in power. Of them, Andhra Pradesh and Rajasthan account for four each, Chhattisgarh, Punjab, Haryana and Jharkhand for two each, Madhya Pradesh for three and Maharashtra for six. Of these, BJP or its NDA allies can hope to pick up 22 seats, it is estimated. The present strength of BJP is 49 in the 245-member Rajya Sabha. With NDA allies, its number goes up to 67. “The Congress’s strength in Rajya Sabha will come down. The BJP's will increase marginally while regional parties like Samajwadi Party will also benefit. It is these permutations and combinations that had led (Finance Minister) Arun Jaitley to favor voting (against building consensus) in the house on important legislation like the GST bill,” the party source said. –IANS

With Gandhis At Rock Bottom, Opposition Comeback A Daunting Task By Douglas Busvine and Rupam Jain rashant Kishor, the election campaign manager brought in by Congress party to reverse its declining fortunes, knew his real work would begin when the party hit rock bottom. It looks like that moment has come. The party run by the fabled Gandhi dynasty, which has led the world’s largest democracy for most of its existence, suffered humiliation last week when it lost Assam to the ruling Bharatiya Janata Party (BJP) in a state election. Congress had controlled Assam since 2001, and for the nationalist BJP it was a first. The race was not even close, underlining the crisis facing the mother-and-son team of Sonia and Rahul Gandhi. Two years ago they were eclipsed by Prime Minister Narendra Modi in a landslide national ballot won on promises of economic growth and a strong, modern India. While the euphoria of that time has faded and Modi’s agenda has been slowed by stalled reforms, other state election setbacks and devastating droughts hitting rural India, he remains comfortably the most popular politician. The challenge for Rahul Gandhi, the public face of Congress’ comeback, is to make up lost ground in time for the biggest test before a 2019 general election - the state vote next year in Uttar Pradesh, home to around 200 million people. That, and the state of Punjab, will go a long way to defining who is the next prime minister; in 2014, the BJP won 71 of 80 parliamentary seats in Uttar Pradesh and only Sonia and Rahul Gandhi held theirs for Congress. Rahul Gandhi declined to be interviewed for this article, but, in a series of public appearances that have become more frequent in recent months, he sought to target Modi directly. “Modi talked about good days to come but today the country is reeling under drought and farmers are committing suicide,” he told a recent “Save Democracy March” of a few thousand people in New Delhi. “Modi has nothing to say.” In an intriguing twist in the race for Uttar Pradesh, Gandhi has invited Kishor to help coordinate Congress’ strategy, the same man who aided Modi’s march to New Delhi with a campaign that embraced modern electioneering techniques and wowed voters. Kishor now plans to bring those, and an intimate knowledge of the way Modi and the BJP operate, to a party that is widely seen as old-fashioned and overly

reliant on the Gandhis. The 38-year-old, who largely avoids the public eye but engages the press and senior party figures with increasing confidence, has a backroom team of researchers analysing census data to more effectively translate votes into seats. That may mean targeting a particular caste or religion, for example. Sources close to Kishor, who worked in health activism before being taken on as policy adviser to Modi when he was chief minister of Gujarat state, said Kishor had “24/7” access to Gandhi, although he did not decide his day-to-day movements. Kishor is determined to move away from a system of patronage, inject a sense of urgency and bring in fresh faces from the grassroots level upwards, even if it means upsetting the Congress establishment. And, reflecting a growing interest in politics rather than focusing on number crunching, Kishor wants to portray Congress as the only inclusive national party in India, the sources said.

The BJP has been accused of stifling free speech and promoting a Hindu-first agenda to appeal to the country’s majority at the expense of significant minorities, including around 170 million Muslims. “We are a party of all, for all and by all,” said Jyotiraditya Scindia, a Congress parliamentarian, and, in his mid-40s, is of Gandhi’s generation and one of the party’s “new guard”. “The only other national party, which is the BJP, is not represen-

tative of pan-India, because it is not of all, it is not by all and it is not for all.” Kishor is understood to want to launch a “new face” to lead the Uttar Pradesh campaign, which could be Gandhi, his popular sister Priyanka or someone else. Congress officials and Kishor declined to comment. Separately, a party source said this week that Gandhi’s longawaited promotion to take over Congress from his mother might happen “sooner than you think”. Kishor, for one, is realistic about Congress’ chances of catching up with the BJP. “We are way behind the curve,” said a source familiar with his thinking. “The total collapse of the party isn’t something we can ignore.” In a party steeped in tradition, secrecy and deference, enthusiasm for Kishor is not universal. “Indian politics is not susceptible to modern, professional analysis,” said one former Congress cabinet member. “You get it right, you’re lucky; you get it wrong, you’re unlucky.” Media have also reported on

the campaign manager’s frustration at Gandhi’s reluctance to take quick decisions, and on speculation that Kishor would resign. Kishor’s organization, Indian Political Action Committee, published two tweets to address the rumors: As Kishor works behind the scenes, Rahul is re-emerging on the national stage to take the fight to Modi. Congress loyalists say Gandhi returned a changed man from a sabbatical in a secret location in early 2015. “He ... discovered his inner politician,” said Shashi Tharoor, a prominent Congress lawmaker. “He’s active in parliament. He’s more confident. His repartee shows he can think on his feet.” Since Kishor joined Gandhi’s team a few months ago, the leader has set a frenetic pace, joining student protesters on the barricades, showing solidarity with drought-hit farmers and hitting the campaign trail up and down the country. He has landed rhetorical blows on Modi, taking the floor of parliament in March to liken a tax amnesty announced in the budget to a skin-lightening cream that turns black money white. The latest state polls, which also included Kerala, Tamil Nadu and West Bengal where regional parties expectedly dominated, suggest that Gandhi’s impact has been limited so far. State polls are especially important for the BJP because state legislators elect members of the upper house of parliament where Modi’s goods and services tax bill is stuck because it does not have a majority. Some of Modi’s closest advisers say they are more worried about Kishor’s involvement with Congress than about Gandhi, given his impact on Modi’s victory and inside knowledge of the way he thinks. But political analysts say Modi should not lose too much sleep for now. The BJP vote is expected to hold up relatively well in Uttar Pradesh as things stand, and the two main regional parties are well placed to fend off Congress, said Sanjay Kumar at the Centre for the Study of Developing Societies in New Delhi. “They can’t in their wildest imagination form a government in Uttar Pradesh. The race for Congress is not to be a distant fourth.” As for Gandhi, BJP leaders are dismissive. “What do you relaunch?” asked M.J. Akbar, a former Congress spokesman who joined Modi’s BJP before the 2014 election. “He’s already been launched. He’s been in an active leadership position since before the 2014 election.” – Reuters

USCIS TO HIKE FILING FEES AND IMPOSE A NEW FEE FOR THE EB-5 INVESTOR PROGRAM BENEFIT

J

ust when employers in the United States were unhappy and raising concerns about the steep increase in the statutory fee for certain H­1B and L­1 petitions, and about the lengthy delays in adjudicating petitions, the Department of Homeland Security (DHS) threw another curved ball. Putting into prac­ tice the “Full Cost Recovery” theory, DHS is proposing to raise USCIS filing fees by a weighted average of 21 percent and impose a new fee on the Regional Centers with regard to EB­5 processing in order to fully recover costs for its services and to maintain adequate service. The proposed rule has been pub­ lished in the Federal Register and is open for public comments until July 5, 2016. As many are aware, U.S. Citizenship and Im­ migration Services (USCIS) is primarily funded by immigration and naturalization benefit request fees charged to applicants and petitioners. Fees collected from individuals and entities filing immigration benefit re­ quests are deposited into the Immigration Ex­ aminations Fee Account (IEFA) and used to fund the cost of processing immigration ben­ efit requests. USCIS calculates its fees to recover the full cost of USCIS operations, which do not in­ clude the limited appropriated funds pro­ vided by Congress. USCIS anticipates if it continues to operate at current fee levels, it will experience an average annual shortfall of $560 million between revenues and costs. This projected shortfall poses a risk of de­ grading USCIS operations. The proposed rule would eliminate this risk by ensuring full cost recovery. As such, DHS is proposing to ad­ just fees by a weighted average increase of 21 percent (%). Some the major highlights of the proposed rule include, but are not limited to: • EB­5 (IMMIGRANT INVESTOR) VISAS: NEW FEE FOR THE ANNUAL CERTIFI­ CATION OF REGIONAL CENTER, FORM I­924A. In order to recover the full cost of processing, DHS is proposing to establish a new fee of $3,035.00 for the Annual Certification of Re­ gional Center, Form I­924A, pertaining to the EB­5 Regional Center investor visa program benefit. As many are aware, Form I­924A is used by Regional Centers to demonstrate continued eligibility for their designation. Al­ though approved regional centers are re­ quired to file the Form I­ 924A annually, there is currently no filing fee and the processing cost is borne by other individuals paying fees for immigration benefits. Until now USCIS was using its adjudicative resources to handle Form I­924A without charging any fee for ap­ proximately 800 currently approved Regional Centers. This USCIS’ annual subsidy pro­ vided to the EB­5 Regional Center is soon going to end. Note that the rule also proposes to change the title of Form I­924A from “Sup­ plement to Form I­924” to “Annual Certifica­ tion of Regional Centers.” Further, the proposed fee for processing the Form I­526, Immigrant Petition by Alien En­ trepreneur, will increase by 145 % to $3,675 (from the current fee of $1,500.00). The good news is that the fee for processing Form I­829, Petition by Entrepreneur to Remove Condi­ tions, is going to remain the same at level of $3,750.00.

• THREE­LEVEL FEE STRUCTURE FOR THE APPLICATION FOR NATURALIZA­ TION, N­400. DHS is proposing to establish a three­level fee for the Application for Naturalization, Form N­400. First, DHS would increase the stan­ dard fee for Form N­400 from $595 to $640. Second, DHS would continue to charge no fee to an applicant who meets the require­ ments of sections 328 or 329 of the Immigra­ tion and Nationality Act of 1952 (INA) with respect to military service and applicants with approved fee waivers. Third, DHS would charge a reduced fee of $320 for naturaliza­ tion applicants with family income greater than 150 percent and not more than 200 per­ cent of the Federal Poverty Guidelines. DHS is proposing this change to increase access to United States citizenship. • USCIS WILL NOT BEGIN PROCESS­ ING THE REQUESTED IMMIGRATION BENEFIT UNTIL THE FILING FEE AND/OR BIOMETRICS FEE PAYMENT GETS CLEARED. Current regulations provide that when a check or other financial instrument used to pay a filing fee is subsequently returned as not payable, the remitter is notified and re­ quested to pay the filing fee and associated service charge within 14 calendar days, with­ out extension. Further, if a benefit request is received by DHS without the correct biomet­ ric service fee, DHS notifies the applicant of the deficiency and takes no further action until payment is received. In accordance with these provisions, when a payment is returned as non­payable, USCIS places the immigra­ tion benefit request on hold and suspends ad­ judication. If a check is dishonored or payment otherwise fails, USCIS assesses a $30.00 charge and pursues the unpaid fee and penalty using administrative debt collection procedures. If the biometrics services fee was required and is missing, USCIS generally pro­ vides the filer 30 days to correct the payment. If payment is made within the allotted time, USCIS resumes processing the benefit re­ quest. If the filer does not correct the pay­ ment, USCIS rejects the filing. If the biometric fee is not paid, USCIS considers the benefit re­ quest as abandoned. DHS is proposing to eliminate the above­mentioned rules requir­ ing that cases be held while deficient pay­ ments are corrected. USCIS clears payment checks through the Automated Clearing House (ACH) by con­ verting checks to electronic payments. Be­ cause USCIS converts checks into ACH payments, there is currently no or very little delay before USCIS knows whether the check is valueless. DHS is proposing that USCIS will not begin processing the benefit request until the payment has cleared. DHS antici­ pates that the proposed change would reduce the USCIS administrative costs for holding and tracking immigration benefit requests with rejected payments. This change would streamline USCIS’ process for handling immi­ gration benefit requests when payments are returned as not payable or do not include the required biometric services fee. • HOLDING THE BIOMETRIC SERVICES FEE AT ITS CURRENT LEVEL. A Suitable Coach For The Indian Cricket Team By Anupam Pratihary he Indian cricket board’s experiment with former Indian players as coaches needs to reach its logical conclusion – an Indian head coach. At least, this time the Board of Control for Cricket in India (BCCI) has the luxury of considering someone with credentials such as Rahul Dravid. Few can rival his invaluable experience as a player, having scored over 24,000 runs and 48 centuries in international cricket. Dravid is a modern-day cricket legend and his understanding of the intricacies of the game, including the T20 format, will be of immense value to this young Indian team. Besides, he has done the hard yard as coach, having mentored IPL teams Rajasthan Royals and Delhi Daredevils, apart from coaching junior Indian teams (Under-19 and India A). He understands the rigors of the job. Dravid may not have thrown his hat in the ring, but he is known to take decisions after weighing all the factors. For the current coach of the junior Indian teams and a mentor for the Delhi Daredevils, taking up Team India’s coaching assignment should be a natural progression. Cautious as ever, Dravid told the media in April, “Anything that comes back to you needs to be weighed with a lot of consideration, not only in terms of whether you feel you want to do it but also time that is involved in doing a lot of these things — what does it entail and what does it require, can you devote time and energy, anything that you would want to do, you want to ensure you are completely 100 percent focussed on it.” He may not have aired his intent but it appears India’s most prolific number three batsman of all time is considering all that the job entails. Now that June 10 is the BCCI’s deadline to accept job applications, the ball is in Dravid’s court. Dravid had been a part of the core group of the Indian team, regarded to have the best batting lineup in its test history and arguably the finest in the world during its time. It was perhaps the first Indian team that had the self-belief and aggression needed to win test matches in Australia, England, South Africa and Pakistan – traditionally the toughest to beat in their backyard. And it did. The team led by Sourav Ganguly was truly a champion side and Sachin, Dravid, Laxman, Sehwag, Kumble, Harbhajan and Zaheer were his

legendary sharpshooters who could bring down any team in their own territory. Films Like ‘Sairat’ Gives Us Courage To Compete With Hollywood: Irrfan –MUMBAI ctor Irrfan Khan says that films such as the Marathi blockbuster “Sairat” will give the Indian film industry the courage to compete with Hollywood. “There is a need for our films to address universal audiences and this film is a new language. This film is an identity of the new cinema that will evolve and what the young generation will bring forth. These kind of films will give us the courage to compete with Hollywood films,” he said on the sidelines of a screening of “Sairat” he organized. Irrfan is one of the few Indian actors to do well in Hollywood, having worked in popular films such as “Slumdog Millionaire”, and “Jurassic World” among others. “Sairat” has become the highest grossing Marathi film of all time, having collected Rs.65 crores at the box office and is still going strong with 525 screens showcasing it in its fourth week. About his reason for hosting the screening, Irrfan said: “I felt that our young generation watches a lot of Hollywood cinema and often doesn’t watch our films. So I thought of organising this screening for all the kids’ friends and close ones to give the young generation a taste of it to let them know what is happening in our cinema.” Asked if films like “Sairat” can even beat Hindi films, he said: “The more cinema gets diverse, it is better for the audience and for the growth of the industry. Our audiences are demanding a lot and our industry is unable to cope up with it. Kapil Sharma’s Show Is The Best: Mika –MUMBAI eeping competition aside, Bollywood singer Mika Singh, who is part of “Comedy Nights Live”, lauded comedian-actor Kapil Sharma, calling his recently launched TV show “The Kapil Sharma Show” the ‘best’. Mika shot for the episode of the Sony Entertainment Television show on Friday night along with West Indies star cricketer Chris Gayle and singer Kanika Kapoor. “You all know that I am Kapil’s brother. I am a big fan of his show and his timing as well. I have met him after a long time because three-four songs of mine have been launched. And the best way to promote the songs is through the best show -- ‘The Kapil Sharma Show’,” Mika said. Kapil came into the limelight through Colors show “Comedy Nights With Kapil” but the show was replaced by “Comedy Nights Live” after the ace comedian had a falling out with Colors channel officials due to various reasons. And Mika became a part of “Comedy Nights Live”.
