But despite these hurdles, our industry has always demonstrated resilience. It’s in times like these that I am reminded of a quote by the Greek philosopher Epictetus: “The greater the difficulty, the more glory in surmounting it.”
Although things may seem to have slowed down a bit in comparison to recent years, the pool industry is no stranger to cycles. The surge in demand we saw during Covid was extraordinary, but not sustainable in the long term. As we look ahead to 2025, I remain optimistic. Consumer behavior tends to ebb and flow, but one constant remains—our product isn’t just a luxury; it’s a lifestyle that people love and continue to invest in year after year.
This is the message to pass along to your teams as we gear up for the new season: our work is more than building and servicing pools—it’s about providing a sense of relaxation, joy, and community. When it comes to efficient pool maintenance, selecting the right cartridge filter replacement can have a profound impact on service schedules, inventory management, and operational costs. Cartridge filters, like those offered by Pleatco and discussed by Scott Gleason and Kevin Stewart of Pentair Pool on the Pool Magazine podcast, offer pool service professionals a way to streamline their operations.
One of the biggest challenges pool professionals face is balancing busy schedules, especially during peak seasons. Scott Gleason emphasized how the right filter cartridge can extend the time between cleaning cycles. Pleatco’s
advanced cartridges feature point bonded filtration fabric and PurePleat technology, which distribute dirt evenly and reduce flow resistance over time. This means fewer service calls to clean clogged filters and quicker service when cleaning is required.
“Less frequent and quicker service events translate into fewer unscheduled visits, making it easier for pool pros to manage their time efficiently,” Gleason explained. This enhanced efficiency allows technicians to serve more clients without compromising quality.
Kevin Stewart highlighted how Pleatco’s cartridge design supports multiple pool brands, eliminating the need for pool pros to stock various filter types.
“By standardizing cartridges, service pros save both time and money. You won’t need to maintain a large inventory of different brands, which makes things much simpler,” Stewart said.
Using high-quality cartridges not only saves time but also reduces operational costs. Gleason explained that opting for cheaper, lower-quality filters often leads to more frequent cleanings and service visits. “While some pool owners may focus on the initial cost, higher-quality cartridges offer long-term savings by extending cleaning intervals and ensuring optimal filtration,” Gleason noted.
Pleatco’s cartridges also help conserve water. Cartridge
systems eliminate the need for backwashing, a process required with sand filters that wastes chlorinated water. Stewart pointed out, “Skipping backwashing avoids chemical loss and aligns with water conservation efforts, especially in regions with water restrictions.”

Sand filters require frequent backwashing, which can occur weekly, while cartridge filters may only need cleaning every few months.

Pool Allegedly Linked To Legionnaire’s Sues State

In a complicated legal battle unfolding in Iowa, commercial pool operator, Jason Bailey, owner of Custom Fitness and Whole Health Natural Foods LLC, finds himself at the center of two lawsuits over the operation of a swimming pool. What began as an effort to maintain a community facility has spiraled into a dispute involving the state of Iowa and Linn County, as each side accuses the other of failing to uphold their responsibilities.
Jason Bailey’s legal troubles began in October 2020 when Linn County inspectors and the Iowa Department of Public Health (IDPH) examined the pool and spa at Custom Fitness, a facility located on Wilson Avenue in Cedar Rapids. The inspectors found multiple violations at the pool, prompting concerns about public health and safety.
Among the issues were broken water heaters and filters, essential components for safe pool operation. Although Bailey replaced these parts promptly, inspectors determined that the repairs constituted “reconstruction” of the pool. Under state regulations, reconstruction of older pools— like the 1980s-era pool at Custom Fitness—requires the entire facility to meet updated building and safety standards.
IDPH notified Custom Fitness in January 2021 that if the issues were not resolved, the pool would have to close. While Bailey hired a pool architect and submitted new plans to bring the pool into compliance in March 2021, the pool remained shut down.
However, tension between Custom Fitness and local regulators escalated. In 2022,
Linn County filed a lawsuit against the gym, alleging that Bailey had reopened the pool without authorization and removed closure signs posted by the county. According to court documents, the county accused Custom Fitness of defying health orders and continuing to allow public access to the pool.
The situation worsened when a case of legionnaire’s disease—a severe form of pneumonia— was traced to someone who had attended swim classes at the gym. The person had to be hospitalized, adding urgency to the county’s legal action. In December 2023, Linn County sought and was granted an injunction, formally prohibiting the use of the pool. The injunction took effect in February 2024, forcing Bailey to keep the pool closed pending further compliance.
A trial date for the county’s lawsuit is now scheduled for December 17, 2024.
Frustrated by the three-year delay in reviewing his pool repair plans, Jason Bailey and Custom Fitness have now sued the state of Iowa, accusing it of failing to act on their permit application. The lawsuit, filed in Polk County District Court, names the Iowa Department of Inspections, Appeals, and Licensing (DIAL) as the defendant, as well as Linn County.
Bailey’s lawsuit claims that Custom Fitness followed every step required by the state to comply with pool regulations. According to the company, it submitted detailed architectural plans for repairs in March 2021, paying all necessary fees. However, the state has allegedly refused to review or approve the application for more than three years.
“Custom Fitness’s application of March 2021 has been languishing at the state for more than 1,200 days,” the lawsuit alleges. “We can take
no further action to address the deficiencies identified in October 2020 without approval of our plans and issuance of a permit.”
Bailey’s frustrations intensified after the state transferred oversight of pools and spas from IDPH to DIAL in 2023, as part of a government reorganization. The lawsuit claims that DIAL’s refusal to act has placed the company in a “Catch-22” situation. According to Custom Fitness, Linn County won’t accept water samples from the pool until the state issues a permit, while the state refuses to review the permit application without water samples.
The lawsuit accuses both DIAL and Linn County of obstructing the company’s efforts to reopen the pool, stating that “the agencies have actively interfered with the compliance process.”
The gym alleges that the delays and closure have cost it more than four dozen members and caused significant financial losses.
In its lawsuit against the state, Custom Fitness is asking for financial compensation to cover the damages it has incurred from the pool’s prolonged closure. The company is also requesting a declaration from the court that replacing the water heaters and filters should not be classified as “reconstruction,” which would exempt the repairs from requiring a permit under Iowa law.
Bailey’s complaint emphasizes that Iowa Administrative Code requires the state to issue decisions on permit applications within 15 days, far from the three years it claims it has waited. “Despite requests in 2024 for the state to process Custom Fitness’s March 2021 plan and permit application, DIAL refuses to do so,” the lawsuit states.
If successful, Custom Fitness hopes the lawsuit will force DIAL to act on its application and reopen the pool for its 1,800 members.

Recession Proof: Luxury Pool Projects

While many segments of the pool industry are experiencing a slowdown in new construction, the sentiment among professionals engaged in high-end luxury projects remains remarkably positive. According to Jason Jovaag, owner of Hammerhead Aquatics, demand for premium pools and outdoor living spaces has held steady. “We deal with a lot of highend builders and high-net-worth individuals,” Jovaag shared. “I wouldn’t say it’s recession-proof, but there’s still strong demand for what we do. We haven’t seen much of a slowdown in these higher-end projects.”
Jovaag, whose expertise lies in acrylic pool design, is frequently tapped to collaborate on innovative, large-scale builds across the country. In a recent conversation with Pool Magazine, he emphasized that the upper-tier market shows
no signs of weakening. “We’re still getting new designs daily, and while some builders may be cautious with election uncertainty, the flow of high-end projects has continued without interruption.”
The frenetic pace of new work for Hammerhead Aquatics has been emblematic of the resilience of luxury projects. The firm’s recent work includes the renovation of the Siesta Key Market pool, a property once featured on MTV’s Siesta Key. “The owner wanted to give the pool a facelift after the show wrapped,” Jovaag explained. “We added a four-sided acrylic window looking down into a bar area beneath the pool. The result is stunning, with ambient lighting enhancing the pool’s appearance throughout the day and night.”
Jovaag’s involvement in marquee projects underscores the strong demand for luxurious, high-
concept pool designs. A standout among these projects is a recent installation at the St. Regis Resort. “We installed 24 acrylic windows in small plunge pools across three residential towers,” Jovaag noted. “Each unit has its own individual pool, and the stainless-steel vessels we used were a perfect fit for the project. This is a one-of-a-kind addition to a world-class property.”
Another eye-catching endeavor involved a rooftop pool renovation in downtown Miami. The stainlesssteel pool, designed in partnership with Bradford Products, had to be delivered in multiple pieces by helicopter. “It was a challenging project,” Jovaag admitted. “Once the pool structure was installed, we added six acrylic windows around the perimeter, offering panoramic views of the Miami skyline. It’s a breathtaking addition, especially with the ambient lighting extending into the bay.”
High-end work such as this highlights a trend that has defined 2024—despite economic uncertainty, the luxury market continues to thrive. “These projects take years of planning, and the investment level remains high,” Jovaag said. “We’re working with clients who want to make bold statements with their properties, and they’re willing to pay for the best materials and craftsmanship.”
Looking ahead, Jovaag’s firm is poised to take on even more ambitious projects, including collaborations on international resorts and high-profile developments. “We’ve got some exciting projects lined up,” Jovaag revealed. “There’s Hilton work coming, resorts in the Bahamas, and a large-scale project in Anguilla that will push the boundaries of what we’ve done before.”
Hammerhead Aquatics is also involved in a unique build in Beverly Hills, working with McClean Architecture. “The project features a pool that is 80% acrylic, suspended over another pool on
a lower level,” Jovaag explained. “The design includes eight acrylic windows built into the pool floor, with a U-shaped acrylic structure cantilevered off the house’s edge. As you drive through the Bird Streets, you’ll see this body of water seemingly floating off the side of the house.”
This level of complexity demonstrates how demand for high-end pool designs remains strong despite broader industry challenges. Jovaag emphasized that the market at this level has proven resilient. “We’re not seeing doom and gloom,” he said. “There’s some cautiousness with the upcoming election, but the high-end builders and designers I work with are staying busy. We’re planning well into 2025, and there’s no indication that the flow of luxury projects will slow down.”
Jovaag attributes some of the ongoing demand to changes in consumer behavior sparked by the pandemic. “COVID made people rethink how they use their homes,” he explained. “Backyards
became personal retreats, and outdoor living spaces exploded in popularity. Even now, clients want to create spaces that rival luxury resorts. They’re investing heavily to make their outdoor areas enjoyable year-round.”

In the early months of the COVID-19 pandemic, supply chain disruptions and plant closures created a surge in chlorine prices that pool owners and service providers are still grappling with today.
Many hoped that the reopening of BioLab’s plant in November 2022—a critical producer of chlorine products—would ease the strain on the market. However, almost two years later, chlorine prices remain high.
Seeking to provide clarity, we delve into the underlying reasons why chlorine prices have not returned to pre-pandemic levels, despite expectations of relief. A combination of market dynamics, increased demand, limited supply, rising production and transportation costs, and inflation continues to exert
upward pressure on chlorine prices.
To understand why chlorine prices remain elevated, it’s essential to look back at the events that triggered the initial spike.
The initial spike in chlorine prices can be traced back to a combination of several key factors:
1. The BioLab Plant Fire in 2020
The most significant event contributing to the chlorine shortage was a devastating fire at BioLab’s production plant in Westlake, Louisiana. The fire occurred in August 2020, shortly after Hurricane Laura swept through the area, damaging the plant. BioLab was a leading producer of chlorine tablets,
and the destruction of this facility removed a major supplier from the market. With fewer producers able to meet demand, prices began to rise sharply.
2. Surge in Pool Construction During the Pandemic
The COVID-19 pandemic led to a boom in backyard pool construction. As a result, demand for chlorine soared. With more pools being built than ever before, both new and existing pool owners stocked up on chlorine, further exacerbating the supply crunch.

With BioLab out of commission, the remaining producers struggled to fill the gap, leading to further price increases.
Although chlorine prices have eased slightly from their peak in 2022, they remain stubbornly high compared to pre-pandemic levels. Market reports indicate that prices have decreased from their all-time high, offering some relief to pool owners and service professionals. However, chlorine still costs approximately 20% more than it did before the pandemic began.
This modest dip in prices reflects a gradual recovery, yet, the market has not returned to normal. Persistent inflation, rising production and transportation costs, and increased demand for chlorine are keeping prices elevated.
While these conditions suggest that further price stabilization may be on the horizon, the 20% gap highlights the lasting impact of the pandemic-era disruptions.
Many pool owners have had to adjust their budgets and explore alternatives, such as mineralbased algaecides or UV systems, to manage costs as they continue navigating higher chlorine prices.
Inflation has played a major role in keeping chlorine prices elevated. In recent years, inflationary pressures have increased across nearly all sectors of the economy, from raw materials to labor and transportation. The pool industry has not been immune to these effects.
The cost of producing and transporting chlorine has also increased significantly, contributing to the persistent price hikes. “The logistics involved in transporting chlorine are complicated and expensive,” one industry insider explained. “These costs inevitably get passed down to the consumer.”

The recent rise in AlkaliSilica Reaction (ASR) cases has raised serious concerns within the pool industry. ASR, commonly referred to as “concrete cancer,” is an insidious issue that compromises concrete integrity, causing cracks and degradation that can render pools unusable. With numerous pools across Texas impacted this year, the urgency for contractors to use top-tier products to waterproof pool vessels has never been more evident. As builders scramble to address these challenges, a new solution is emerging: Basecrete Xtreme. This advanced waterproofing product is set to make its U.S. debut, promising improved durability, flexibility, and ASR remediation.
ASR occurs when the silica in concrete aggregates reacts with alkali in cement under moist conditions, forming a gel that expands and creates internal pressure. Over time, this pressure leads to cracking and structural weaknesses in the concrete. Vito Mariano, President of Basecrete, describes it as a “cancer” because of its unpredictable nature. “It’s cancer, so you don’t know where and when it’s going to pop up, how bad it is, or if it’s going to continue to grow,” Mariano explains. “Right now, we’re focused on slowing it down and stopping it in its tracks with new materials.”
Texas has been particularly hard-hit, with ASR issues stemming from changes in material availability during the
pandemic. The use of alternative materials like fly ash and other cement additives—intended to address supply shortages—may have exacerbated the problem. According to Mariano, “Even during the shortage due to COVID, ASR cases kept cropping up in certain areas. Arizona saw it, but Texas has been hit the hardest.” Builders have been forced to confront lawsuits and repair projects, placing a premium on finding products that can repair ASR-damaged pools and prevent future deterioration.
In response to the growing demand for effective ASR mitigation and waterproofing, Mariano and his team developed Basecrete Xtreme. “I’ve spent the last three years working on this material,” Mariano shares.
“Starting in Europe, from Italy to Portugal, I refined it to ensure it was ready for North America.” With its upcoming launch in the U.S., Basecrete Xtreme offers contractors a versatile tool for pool vessel repairs and ASR remediation.
The new formula features advanced fibers and cold polymers that make the material more flexible and impact-resistant. Mariano explains that this innovation allows the product to adapt to the movement of pool structures without sacrificing strength. “The material is more flexible, with no wicking from the fibers, so it performs exceptionally well in high-stress environments like swimming pools,” he says. Mariano notes that the product is easy to use, allowing contractors to spray or squeeze it into place during application. This versatility makes it wellsuited for repairing spider cracks, veneer issues, and pool joints that are prone
to movement and stress. “Concrete is unpredictable— it’s going to crack,” Mariano acknowledges. “But with Basecrete Xtreme, we can bridge those cracks and prevent leaks.”
In addition to its ASR-related applications, the product is gaining interest in the Insulated Concrete Form (ICF) industry, which is rapidly becoming a preferred construction method.
“ICF is the future of pool construction,” Mariano says. “Basecrete Xtreme integrates seamlessly with ICF systems, giving builders more flexibility and reducing the need for mesh reinforcement.”
One of the standout features of Basecrete Xtreme is its enhanced durability in harsh environments. According to Mariano, the product maintains the same high permeability rating as other Basecrete solutions while offering superior bond strength. “We’re getting PSI ratings of 6,000 to 8,000, which makes it an excellent choice for highstrength repairs,” he says. Yet, as Sabeena Hickman, CEO of the Pool & Hot Tub Alliance (PHTA), discussed in her recent interview with Joe Trusty on the Pool Magazine podcast, the industry’s future remains positive. Hickman shared insights from PHTA’s recent Business Operations Survey Report, highlighting key trends shaping the pool sector today and strategies pool professionals can adopt to thrive.
Hickman noted that while the pandemic initially created a surge in pool construction, the industry is now witnessing a return to pre-pandemic norms. “We are seeing sales begin to
normalize,” Hickman explained. “Many people built pools during the pandemic, and now that life is back to normal, customers are turning to service professionals to maintain them. They just don’t have the time to do it themselves.”
This trend has fueled growth in the service sector, which was a standout finding in the 2024 Business Operations Survey Report. According to the survey, pool service businesses have grown as homeowners increasingly delegate pool maintenance tasks to professionals. As Joe Trusty put it, “Service is going to continue— people still need their pools serviced. That’s never going to change.”
The shift toward professional service has also opened new opportunities for builders. Some
are adding service arms to their construction companies to maintain customer relationships after completing projects. Hickman remarked, “We’re seeing builders diversify, saying, ‘I built the pool, I know the pool, and I want to be there to service it.’ It’s a smart way to create recurring revenue streams.”
A slowdown in new pool construction projects is being driven by several economic factors, including rising interest rates, inflation, and even political uncertainty. As Hickman noted, “High interest rates are discouraging some homeowners from taking on large projects, like building new pools. Financing options aren’t as appealing as they were during the low-rate environment we saw during the pandemic.”
Inflation has also caused pool prices to rise significantly in recent years. According to the PHTA’s report, the average cost of building a pool has increased from $60,000 to upwards of $90,000. “The rising costs of materials and equipment have pushed prices up,” Hickman explained. “Builders need to carefully evaluate their pricing models to maintain profitability without alienating customers.”
Political uncertainty could also be playing a factor. As Trusty pointed out, “Concerns over the upcoming presidential election could be making some consumers hesitant to commit to large discretionary projects like pools. While the economy isn’t in a recession, as evidenced by recent GDP growth, consumer behavior is shaped by perception. We’re seeing that perception influence some purchasing decisions.”
While the outlook remains optimistic, economic challenges persist. The report highlights concerns over inflation and rising material costs, which are squeezing profit margins. “Many service professionals have kept their pricing steady for customers despite rising costs,” Hickman said. “Our advice to businesses in the pool industry is to evaluate their pricing and adjust as needed to maintain profitability.”
Interest rates and inflation are influencing consumer behavior, with more customers allocating disposable income toward travel and other experiences rather than large backyard projects. Trusty echoed this shift, saying, “We saw two years of lockdown, and people were ready to get out, take that trip, and make up for lost time.”
Despite these factors, Hickman emphasized that the demand for pools is still healthy. “The average pool price is climbing, and homeowners are investing more into creating resort-like backyard experiences,” she said. “While construction slowed slightly, remodeling projects are picking up.”

The PHTA’s survey also revealed a growing trend among builders to offer more comprehensive services. “Some companies are becoming full-service providers, handling everything from construction to service and retail,” Hickman noted.
“This diversification not only helps businesses weather economic changes but also allows them to offer greater value to their customers.”
Trusty added that these shifts align with broader consumer trends. “Many people are looking to refresh their spaces rather than start from scratch,” he explained. “Offering remodeling and service options gives companies a competitive edge in today’s market.”

Randy Angell’s design philosophy for this project drew heavily from the work of Frank Lloyd Wright. “The client spent several years renovating their home to reflect Wright’s aesthetic inside and out,” Angell explained. “When it was time to refresh the outdoor space, the goal was to extend that same design philosophy seamlessly into the backyard.”
The original pool, which had been in place for over three decades, was outdated and no longer aligned with the homeowners’ vision. Angell worked closely with the clients for over four years, refining the design through multiple iterations.

The centerpiece of this outdoor living area is a stunning geometric pool, reflecting the clean lines and balance synonymous with Wright’s designs. “The geometry of the pool was a challenge,” Angell admits. “It’s an unusual shape, and no two sides of the pool are parallel or perpendicular to each other. That created a unique opportunity to play with angles and to lay out the porcelain paver decking in a way that complements the pool’s irregular form.”
Surrounding the pool is an expansive deck, designed with the intention of making the space feel open and inviting. Angell selected porcelain pavers for their sleek, modern look and low maintenance requirements, a choice the clients appreciated. “They wanted as little upkeep as possible, so the porcelain pavers were the perfect solution,” Angell explains. “It gives the area a contemporary feel while
keeping it practical.”
One of the stand out features in the backyard is a custom fireplace and seating area that adds both warmth and sophistication to the space. “The existing fireplace was a key element in the design,” Angell says. “We refaced it with custom concrete tiles I designed, inspired by Frank Lloyd Wright’s patterns. The new fireplace, along with the restructured seating area, created a gathering point that gives the space a sense of intimacy.”

Every element tells a story, shaped by the vision of the client, the artistry of tile artisan Ray Corral, and the legacy of Frank Lloyd Wright’s design principles. Corral, the founder of Miami-based Mosaicist, brought
his decades of experience to the project, creating a pool interior that is as visually compelling as it is technically challenging. “This wasn’t just another tile job,” Corral emphasized. “It was a deeply personal project with layers of meaning woven into every part of the design.”
Complicating matters further, the client requested a unique and deeply personal design element—a strip of crimson red tile, subtly integrated into the floor pattern. “At first, I didn’t understand the importance of the red tile,” Corral admitted. “I asked the client several times why she wanted it, but she only revealed the significance during one of our final meetings in Texas. She told me that the red tile was a tribute to her son, who passed away at the age of four. After hearing that, I knew it had to be perfect.”

Transforming an aging pool into a modern masterpiece came with a series of challenges that tested the expertise and patience of the entire team. As pool builder Guy Wood explained, the remodel involved working around both structural limitations and unexpected soil conditions that required them to rethink their approach multiple times. “From the moment we drained the pool, we knew we were dealing with some serious issues,” Wood shared. “There were cracks all over, and we had to figure out how to address those before Ray [Corral] could even start on the tile installation.”
The pool’s accessibility was another key challenge, given that the homeowner required gentle, custom steps to accommodate her mobility needs. “The client has MS, so making the pool easy to enter and exit was essential,” Wood said. “She didn’t just want to look at the pool—she wanted to use it. We had to build eight steps with precise risers that aren’t standard for pools. Getting them just right was probably one of the most intricate parts of the project.”
Adding to the complexity was the discovery of shifting soil beneath the
pool deck. “When we pulled up the old pavers and poured a new concrete sub-deck, everything seemed fine at first,” Wood recounted. “But over the next few months, we started to notice the deck lifting. It was like watching a cake rise with too much yeast.”
The only solution was to completely remove the newly installed deck and start from scratch. “That was one of the toughest moments,” Wood said. “We had to tear out everything we’d just built and engineer a suspended deck system to make sure it wouldn’t happen again. It added at least two or three months to the timeline, but the client was understanding throughout the process.”
Despite the setbacks, Wood emphasized the importance of getting things right. “Our philosophy has always been: If it’s not done right, it’s not done. We worked closely with the engineers and our crew to ensure the new deck would hold up for the long term. It was painful, but looking back, I wouldn’t change a thing—this project deserved the extra effort.”
The custom handrail installation also presented a unique challenge. “The handrail had to be functional for the client, but we wanted it to be a design
feature as well,” Wood explained. “We worked with a fabricator I trust with all my toughest jobs. He crafted the handrail from stainless steel, and we anchored it using a modified pool ladder system, which allows it to be easily removed if needed for maintenance.”
The success of this project was due in no small part to the close collaboration between Angell, Corral, and Wood. “We’ve worked together on other projects, but this one was special,” Angell reflected. “I knew I needed Guy’s expertise to handle the construction challenges, and Ray’s artistic vision to bring the tile design to life.”
Wood echoed those sentiments. “This collaboration has been one of the most rewarding of my career. Even with the challenges, the teamwork and shared vision made it all worthwhile.”
The three professionals praised the homeowner’s involvement as well. “They were wonderful clients,” Angell said. “Their creativity and input added another layer of meaning to the project.”

Yet, for those who seek a little more luxury, adding a spa or hot tub to a pool transforms a simple swimming experience into a full-fledged oasis of relaxation and wellness.
The mid-20th century marked a significant shift in the way people viewed and used their outdoor spaces. Following World War II, there was a substantial increase in homeownership in the United States, spurred by economic prosperity and the development of suburban neighborhoods. With larger yards and a focus on family-oriented leisure activities, swimming pools became a soughtafter feature for many homeowners.
The concept of adding a spa to a swimming pool began to take shape in the 1960s and 1970s. During this period, there was a growing interest in wellness and relaxation, fueled by the counterculture movements of the 1960s and the burgeoning health trends of the 1970s. People were increasingly aware of the benefits of hydrotherapy, and the idea of having a personal spa at home became appealing.

Permit Loophole: An Open Invitation FOR UNLICENSED BUILDERS

Building a swimming pool in Nevada might seem like a dream for homeowners, but some are discovering the hard way that hiring unlicensed contractors could turn that dream into a costly nightmare.
A loophole in the state’s permitting process has become a magnet for unlicensed pool builders to exploit, putting homeowners at risk of fraud and leaving them with substandard or incomplete projects. Without stronger enforcement, this issue is set to grow, potentially leaving many Nevada residents in a financial bind.
One Nevada homeowner learned the dangers of hiring an unlicensed pool contractor after paying $12,000 for a project that was never completed. “He collected payment in full but never finished the work,” she explained, requesting anonymity for her safety.
“Further research indicated he had not been licensed with the Contractors Board or the state.” With no legal recourse through the Contractors Board, the homeowner filed a fraud complaint with the Reno Police. Unfortunately, this scenario is becoming all too common.
According to Terry Wike, lead investigator for the Nevada Contractors Board, unlicensed contractors are increasingly hired for pool projects, thanks to a little-known loophole in the permitting process. The issue lies with the owner-builder affidavit, a document found on the Contractors Board’s website. By signing this form, homeowners can waive the requirement for a licensed contractor—provided they agree to complete all the work themselves.
In theory, the owner-builder affidavit gives homeowners the flexibility to manage their
projects. It allows them to obtain permits for construction work, including pool installation, without needing to hire a licensed contractor. However, the system relies on homeowners taking on the work themselves. “You’re allowed to do work on your own house and get a permit through the building department,” said Wike. “But you must do the work yourself.”
The problem arises when homeowners, after obtaining permits under the owner-builder affidavit, hand off the work to unlicensed contractors. This misuse of the affidavit has become a widespread practice, according to Wike. “We believe it happens more than it should,” he admitted.
The lack of oversight during the permitting process enables unlicensed contractors to fly under the radar.
While cities like Reno and Washoe County inspect construction projects for code compliance, they rarely verify who is performing the work. “We inspect for minimum code and compliance,” said Chris Pingree, head of Development Services in Reno. “Our folks aren’t going to inspect I.D. cards to see what company they are with.”
Homeowners are not required to disclose whom they hire for projects covered under the owner-builder affidavit. This lack of follow-up makes it easy for unlicensed contractors to operate unchecked, leaving homeowners vulnerable to poor workmanship and incomplete jobs.
The Nevada Contractors Board’s public information officer, Randy Escamilla, warns that pools built by unlicensed contractors pose significant risks. “You’ve got plumbing, you’ve got electricity, plastering, so there are major components related to health, safety, and welfare,” Escamilla explained.
Despite the rising problem, there is little clarity on who should be responsible for enforcement. The Contractors Board believes it’s the cities and counties’ job to monitor compliance since they issue the permits. In contrast, the city of Reno points to the Contractors Board, arguing that it provides the ownerbuilder option, thus making it their responsibility.
This back-and-forth has created a situation where unlicensed contractors can slip through the cracks. With no agency consistently monitoring who completes owner-build projects, the permitting loophole remains wide open. Until either the cities or the Contractors Board takes ownership of enforcement, the problem will likely continue, exposing more homeowners to fraud and unfinished projects.
For homeowners, the risks don’t end once the project is finished. If you buy a house with a pool built by an unlicensed contractor, you inherit any issues that arise. Worse, the Nevada Contractors Board offers no protection or recourse for homeowners dealing with pools constructed by unlicensed builders. “The pool industry is becoming a big industry for people getting scammed, unfortunately,” said the woman whose client lost $12,000.

Navigating Manufacturer Relationships: HOW TO GET THE SUPPORT YOU DESERVE

Have you ever felt helpless with equipment manufacturers? Did you ever get the feeling like you were getting the go around and didn’t feel supported? Or had the feeling that since you’re not a big enough number, you’re not entitled to get support on products?! I will be completely honest; I have felt at times my issue with manufacturers were downplayed because I do not buy as much equipment as some of my competitor who have 900+ pools. I have even felt like larger companies who do not purchase much from one equipment manufacturer were getting better tech support benefits. I think everyone one of us have felt that way toward one manufacturer or another. However, what are some ways to get the support we deserve?
In the pool industry, like many
others, we believe customer service is key. It is one of the main reasons we use a particular manufacturer’s equipment.
“It’s on the manufacturer to be tight with their customers and anticipate issues before they happen and ensure strong upfront communication. However, when things do happen, the sales rep should do all they can to proactively engage, understand the issue and resolve it. The sales rep should have a caring heart. If you care, customers notice it and makes the process much easier,” Jason Anderson Senior Regional Sale Manager with Fluidra commented.
Documentation is important when you feel you are not getting support. Make sure to document every call, text and email between you and your rep. When you have documentation
on the communication and lack of support you are not getting, it will help you have a professional conversation with the manufacturer’s reps or superiors.
Most equipment installation issues can be resolved by attending manufacturer trainings. You can attend these classes either at regional trainings, conventions, or local tabletops. Not only are manufacturer trainings important to give you the information you need to install and troubleshoot equipment, but it is a way to build relationships with reps throughout your local area. Training sessions can also give you opportunities to meet other pool professionals with knowledge of the equipment and who the warranty stations are. When you are troubleshooting or in a bind and need advice, calling the warranty station can be a great resource.
The best advice I was ever given while learning the pool industry was to network. Building professional relationships with other pool pros allows you to have a circle of people who know the trade and folks you can bounce ideas off with. This provides an outside resource from the pool manufacturers. Believe me, there have been many times I would call a colleague in a unique situation, and they were able to give me tips and tricks that helped me solve my dilemma. It’s also been beneficial having a second set of eyes and ears to help me spot something I had overlooked.
Hey, it is human nature to not mesh with everyone. That is A-OKAY! That is why finding a manufacturer rep that you jibe with is important. One thing we are lucky to have is multiple manufacturer reps in each region. They are divided up between technical and sales. Both can work with you for your needs. If you feel like you are getting nowhere with BOB, you can seek out JOHN. If you do not know who the other reps are in your area you can contact distribution, warranty stations and other collogues to give you their contact information.
So what do we do when we feel we have tried every avenue to resolve our problem, if its faulty product, customer service, rebates, etc?
Start with contacting your manufacturer rep with an email documenting all the steps you have taken to resolve the issue and the results of those steps. In this email hold back emotional responses. Sometimes our emotions can get the best of us and cloud the factual component
of our communications. People are more willing to work with you when they do not feel attacked. I would, also, recommend setting a timeline for a response. Be reasonable with thetimeline. You want to give enough time for the rep to read, research solutions, and respond.
What is the next step if you feel you have not received a better resolution?
In these cases, it is best to direct your communication to management. Forward the email chain you have been using with your local rep. I would suggest keeping the local rep CC’d in the email. This allows everyone to be part of the issue and resolution. I have found in more cases than not; my issues have been resolved by taking this step. With continued professionalism throughout the process, I have been able to still maintain professional relationship with the local rep even with escalating my concerns.
When do you say enough is enough and change manufacturers?
This is going to be a different moment for everyone. When you feel a manufacturer isn’t resolving your issues and you do not want to sell their product, that is up to you. However, keep in mind not every pool has the same brand equipment. You do not want to lose business simply because you only want to use one brand. I would recommend keeping the knowledge and skill set of every manufacturer. When a customer calls for repair work, if they have a different brand equipment, you can still fix the issue with the brand you may not prefer. If the customer asks
for your recommendation, then you can suggest the manufacturer you feel gives the best customer service, with the best quality product. I have gone into many yards, where the customer has called other companies to help resolve issues. Yet, since they had certain brand of equipment and the companies do not install that brand, I won the customer and all their future work because I will work on all manufacturer’s equipment.
Navigating relationships with equipment manufacturers can be challenging, but it’s essential to advocate for the support you deserve. By documenting your communications, attending training sessions, and actively networking with other professionals, you can create a strong foundation for collaboration. Remember that finding the right manufacturer representative is crucial—don’t hesitate to explore other options if you feel unsupported.
If you’ve exhausted all avenues and still feel let down, escalating your concerns to management can often lead to resolutions. Ultimately, knowing when to pivot to another manufacturer is a personal decision, but maintaining a broad knowledge of various brands can enhance your versatility and opportunities. By staying open to all equipment types and prioritizing customer service, you can ensure your clients receive the best solutions, no matter their preferred brand. Embrace the journey, build those connections, and continue to grow in your expertise—support is out there, waiting for you to reach out and grab it!
