Tanzania to construct us$ 1.8 billion fertilizer plant Tanzania Petroleum Development Corporation will be constructing a mega fertiliser manufacturing plant at Kilamko, Lindi Region. Construction of the US$ 1.8 billion fertilizer plant in Tanzania is set to commence in December this year. The fertilizer plant is likely to see the price of the farm input lower as a result of competition. Tanzania Petroleum Development Corporation will partner with three private companies. The companies will use natural gas as both feedstock for production and a source of energy He named the companies involved in the business as the Denmark based Haldor Topsoe Company, Ferrostaal Industrial Project from German and Fauji Fertiliser Company based in Pakistan. The corporation will hold a 20 per cent stake in the business while the foreign partners will own the rest.

First affordable houses in Cape Town CBD

Cape Town – Central Cape Town will get its first affordable housing project in years, a city official announced on Thursday, Ground-up reports. Households that earned between R3 500 and R15 000 a month would qualify and there would be a split between rented and owned housing, Mayoral Committee Member for Transport Brett Herron said. This was part of the Foreshore Freeway Precinct development, a six-hectare portion of land under and between the unfinished free-ways on the northern edge of the central business district. The move followed a public outcry over the lack of affordable housing in central Cape Town. Bids for the project had to include an unspecified percentage of affordable housing, which could be built within the development, or somewhere else within the CBD. Herron said the percentage was undefined, as the city believed if developers were given a target percentage, only that amount of affordable housing would be created. Now, developers had to compete on how much affordable housing they intended to deliver. The prospectus for the project would be issued on July 8 and be on display at the Civic Centre for three weeks for public participation. The bid evaluation committee had to take this input into account. There was no deadline for the completion of the project yet. Bidders would be required to give a time-line. Activist organization, Ndifuna Ukwazi (NU), welcomed the announcement of the creation of affordable housing, since no affordable housing had been built since 1994.

Despite Global Commodity Price Declines, Labor Shortages Driving Up Construction Costs in U.S. According to a new report from CBRE, despite the global collapse of commodity prices - including many key inputs to construction - overall construction costs continue to rise nationwide in large part due to labor supply and demand dynamics that first surfaced during the recession and still have yet to resolve. In January 2016, average total construction costs in the U.S. registered a year-over-year increase of 1.8 percent, according to the RS Means Construction Cost Index (CCI). Since January 2011, the national CCI has increased by an annual average of 2.3 percent, resulting in a cumulative 11.8 percent increase during that period. "The price of materials is just one driver of overall construction costs. The cost of construction labor tends to be much more variable across geographies and over time, so it typically has a larger impact on overall cost trends," said Andrea Cross, Americas head of office research, CBRE. "The collapse of the housing market and subsequent recession affected supply-side dynamics for new construction throughout the country, as a substantial number of construction workers left the industry during the downturn and never returned."

According to analysts at the recent Dubai Property Show London 2016, British citizens have emerged as the second largest investors in Dubai real estate and according to the Dubai Land Department they have invested £1.9 billion in 2015. This is a strong indicator of the UK investor demand for high quality real estate is up. Dubai's property market fundamentals are made up of worldclass infrastructure and a regulatory environment that ranks among the most favorable in the world. Masood Al Awar, Dubai Properties Chief Commercial Officer tells World Property Journal, "The Emirate of Dubai and Dubai Properties present an attractive investment haven of real estate investments. Our participation in this event was key to further boost international inward investments in light of the great response we have witnessed. We believe that the combination of our offerings combined with UAE's stability, continued economic growth and high returns on investment are appealing vital drivers to the growing British investors' base, particularly from the UK." This 18th Property International Magazine –Dream to reality issue is a jubilant one and it confirms Property International prowess as the “Best Exhibitor in Construction and related Materials Category” three times in a row at the 38th , 39th and 40th Dar es Salaam International Trade Fairs (DITFs). The continuous accolades are anchored on the saying, “When life gives you a lemon, you should make a lemonade….” Indeed it is very true that the world is awash with building materials but the combination or the recipe that PIL Team creates is what has mattered so far. This is no rocket science but simply creative and critical thinking in action making the distinctiveness of the PIL brand in the property and real estate sector in Tanzania. In this issue, we spoke to some of our clients to sample some feedback on their sentiments towards our services; also featured is how the landlords and tenant relate in the negotiation of rents; a careers’ section covering the work of a legal and documentation officer as well as the role of a documentation and public relations manager in real estate setting; also featured are sampled five luxurious bathroom ideas in 2016; a list of registered title deeds for some of our clients awaiting collection; our usual menu of sponsored

adverts; the PIL Office Space Design portfolio; and the various PIL plot projects up for picking in conjunction with our banking partners – Tanzania Postal Bank (TPB) in partnership with PSPF, Amana Bank, and now Dar es Salaam Community Bank (DCB) who recently signed a pact with PIL on plot financing scheme for the members of the public and public servants. We have also brought to you the 40th Saba saba (DITF) experience in this issue in the form of pictorial images of our pavilion. Lastly, I’d like to now formerly welcome our new plot financing partner Dar es salaam Community Bank (DCB) on board as we launch the plot financing product to as many members of the public and public servants as possible. Looking at the new government and the past six months in the economy and especially interviewing few business men in Tanzania and real estate stakeholders and people in the tourism sector, there’s a lot we can learn and project the future with ease. Here’s brief of what we found out. NEW TRENDS IN TOURISM

MAGUFULIFICATION President Magufuli’s approach to leadership takes us back to the glory days of the father of the nation. Tanzania has been shaken up by his zero tolerance attitudes to corruption and inefficiency. The scandals are unravelled daily make for a shocking read but the norm that this country has enjoyed has been challenged. Early into his government, sacking of the top officials rocked the Tanzania Revenue Authority. This translated into the highest revenue collection in the history of Tanzania. TRA became a prelude to subsequent measures that have cut through virtually every major industry earning him a reputation worldwide for not only being frugal but diligent in the ideals of good and firm governance. An air of seriousness and attitude change has become characteristic of civil servants who understand that his is a dispensation of a new era. All this is done to strengthen institutions that have until now been a shadow of their potential. Prospects exist more in not new, but already existing measures and programs of government that have until recently not been operating at the optimum potential. The sleeping giant that is Tanzania is awakening to the knowledge that its possible to have a new reality and norm. In the next half-decade, with the consistency of this leadership approach, institutions should get more efficient and increase output and service delivery. It is a public secret that Tanzania’s natural beauty and resources are not proportional to the revenue that it reaps. Even though investors get their fair share in return investments, the number of tourists is nowhere near our neighbours Kenya even though they the country has more to offer in the way of attractions. Of course its not just natural attractions that matter but our facilities have also been found wanting. Trip Advisor in 2013 put together a list of complaints that tourists had after visiting the Zanzibar. At the top of this list was the lack of activities and facilities to make different activities possible. The review suggested that in as much as tourists like the cultural heritage and prestige white sandy beaches, it seemed to be all they could get from our archipelago. Efforts towards improving activities are somewhat visible, but such complaints speak to the have careful and coordinated facility development that is as much driven by private investors as it is by government. In short, there needs to be an ardent development of facilities and activities to attract tourists to Tanzania. The recent exit of Britain from the European Union calls for a change in direction for tour operators in the country. Why is Britain so important, well because after Americans, they are the second biggest contributors to our tourist influx and they bring with them the all mighty Sterling Pound, which worse yet has also taken a hit as a result of Brexit. British tourists are ever more volatile than Americans because of their habits. Strength of the pound makes it easier for them to plan vacations more recently to the date (6months on average) than their American counterparts. Also Poaching, multiple taxes, poor infrastructure and inadequate promotion funds should be tackled for Tanzania to realize its target of attracting two million tourists annually in the next five years. Additionally tourism provides 600,000 direct jobs to Tanzanians; over one million people earn income from tourism not to mention the value chain of tourism which supports parks, conservation areas, farmers, transporters, fuel station, builders, tent manufactures, suppliers of food and drinks etc. We need to address issue of multiple taxes if we need to succeed to bring two million tourists to Tanzania by 2020.


PRIVATE PROPERTY INVESTMENTS Ask any professional today about the general outlook of the construction industry and you will hear sad sobbing stories about how projects have been few and far between or none existent. The stubborn ones have rendered some employees redundant, adapted to the economics of the day and taken the few shillings that they can get. This from an industry that can only boast of its former glory. Those with an imagination and some financial leverage have transformed into property developers to keep revenues streams flowing. Private property investments are quite visible. A drive around any one of Tanzania’s major cities exposes an image that when juxtaposed to the general health of the construction industry couldn’t be more contrast. At Property International, we have observed a influx private property investment. One of the projections for the year 2016 that we discussed was the response of investors to the ever growing need for housing and the regulation of property prices to a point where a balance in pricing can be found. Even though we have a considerable way to until we find the balance, this trend in investment introduces a new voice to the conversation. Investors will be interested in the proper regulation of property and pricing and will lobby the government to do more in the way of changes.

YOUTH ENTREPRENUERSHIP Unemployment has become commonplace in Tanzania. Until the economy develops, we will continue to have more graduates than jobs. The youth are biting at the short hand of the stick. More than ten thousand ghost employees were discovered in 2016 alone which compounds to the problem and frustration plagues graduates who are forever getting called to interviews and just never getting the job. The reality is that the job market is oversubscribed. Youth are not only realizing this but also accepting and adapting the new reality. Technology has become a huge driver of this self-actualization as it has streamlined market access and opened new streams of income. More and more first

time graduates are becoming self-employed immediately after completing their first degree because of the opportunity to make more money that being a business owner offers. For a country whose economy is run by small businesses, saying this is a step in the right direction would be stating the obvious. What is encouraging to witness is the hunger the youth have to employ and empower others while advancing themselves. This phenomenon is only likely to increase and new converts are buying into it daily. 5. Revive Ignored Opportunities Our colonial masters in their cruelty can be credited with having a measure of foresight. There are several factory shells and abandoned colonial farms that offer an endless array of opportunities that the country has failed to explore. Given, funding is an issue but there of all our considerations, inviting purposive agrarian investors into the country has not been one of them. Even though the infrastructure is old, its a foundation to set up much cheaper that if it were non existent. Cultural tourism is another avenue that has not been explored.

Can landlord and tenant freely negotiate rents in Tanzania?

Rents can be freely negotiated. The Rent Restriction Act 1984 which until recently regulated rents in theory (but not in practice) has been repealed. The government owns all land in Tanzania, and leases are only available to nationals. The private rental market (in the sense that interests our readers) is virtually non-existent. The rental market is mostly very informal and is actually subsistence (people forced to rent out rooms in their houses). Where agents are employed, the commission payable on leasing a residential property is one month’s rent.

Q What does your job entail? Ans My job deals with documentation processing. Once a client buys a plot from PIL, we make them sign sales agreement and other legal documents, we also facilitate their payment procedures both to TRA and the ministry of lands and lodge in application until we get the title deed and we hand them back to either the bank, if a client has paid us through bank loan or to the client, if the client has paid us cash.

Q What challenges do you face in relation to land and property issues with your clients? Ans Some incidents I meet people who assumes they know law and land policies more than us professionals, but they are just mare laymen. It is very difficult to advice such clients. When dealing with them, it takes time just to argue and defend the procedures. They always like to cut corners and this is not what we do. When I come across such client, I tend to keep quiet and pay attention to what they say, but once they leave, I stick to my profession and do what is needed to be done. However, sometimes some of the laws do change, hence it is difficult to keep addressing clients on changed laws. There times when clients buy a plot through a bank loan, but for some reason, a bank delays to pay and that plot that a client chose get to be sold to someone else. Q What should people know before purchasing any land? Ans Before buying the land, people should consider to do official search of the plot at the ministry of lands. There are cases where

the same land can be sold to more than five people and without knowing you end up paying the land that has fraud. So always start from the ministry of land.

Q Tell us what is your typical day like? Ans I draft Sale Agreement and the seller provides the necessary documents that confirm s/he has a right of occupancy on the property in case and it is clear of any encumbrance. The notarized Agreement is taken to the Land Office, where the buyer pays for the necessary taxes and fees to have his/her name recorded at the Land Registry. I then prepare a Transfer Deed, which is submitted to the Municipal Land Office with the Sale Agreement. A Certificate of Occupancy is then sent to the buyer.

The approved process on how to get a title deed.

Property International Magazine speaks to Mr. Shaidi Y.M, a Documentation and Public Relations Manager at PIL on procedures and steps to take during the sale or buying of land and getting a title deed, making it easier to implement a sound land information. The government owns all land in Tanzania. Citizens only apply for a lease from the office of land registry and they get a certificate to show the boundaries that they own. If you have land and you want to register it or acquire a registered title over land there is a process you have to undergo. Such unregistered land will in most cases be under the village authority. A title deed is a signed agreement that proves ownership of land and legal rights to it. The first step is to obtain necessary

approvals from the village authority authorizing you to make applications to relevant authorities to have the land registered. Once you have the necessary approvals from the village authorities you will need to consult a surveyor who will do the land survey, take the necessary measurements of the land and draw a survey map. The surveyor will process the map and have it approved by the relevant professionals before the same can be forwarded to the Ministry of Lands in Dar es Salaam.

Issue no.18, July-August 2016 In Dar es Salaam the map will be examined as to how it fits into already established map plans and see if it is properly drawn and if the required authorities approved it. After a thorough examination the map will be approved and returned to the surveyor who will hand it over to the landowner or applicant ready for due processes in the land office of the concerned district. The applicant will make a formal application to the District Land Officer to register the land. The application letter will be filed along with the map, the photocopy of the identity card, passport size photos, the original approval from the village and the necessary fees will be paid. A deed plan shall be drawn and the application will be processed in the District Land Office and the District Land Office will approve the application after a thorough scrutiny and it will be ready to be taken to the Zonal Office of the Commissioner for lands for registration. At the Zonal Office, which is the office of the Commissioner for Lands, the submitted documents will be examined and if the Land Commissioner is satisfied, the documents will be filed and be properly recorded before they are taken to the Registrar of documents for the registration of the title. In the office of the Registrar of documents they will verify if at all there is any other person who is registered as owner of the land to be registered. If it is found that nobody is registered as owner of that land, the title will be formally registered after payment of appropriate fees and a title document or the right of occupancy document will be issued to the applicant. If it is land other than village land, you will need to locate the land and then make an application. The application will be submitted on a prescribed form accompanied by passport size photos with a necessary fee. In case where the owner of surveyed plot (transferor) wants to sell the plot to someone else (transferee), it is advised for the buyer of that plot or the transferee to do official search from the ministry of land. The law in Tanzania provide for a possibility of a power of attorney whereby investors/buyer/transferee can appoint a trusted person to perform the legal transactions on behalf. According to section 103 of the Land Registration Act the appointed agent with a registered power of attorney can sign legal documents as he is exercising lawful powers. The power of attorney can be revoked at any time or cease with the expiry of the assignment.

Payment: It is advised that the payment should be done through the bank. The transferor (land owner) should give the bank account and the transferee (buyer), she pay the lump sum of money to the account given and obtain the bank paying slip

and keep it with the other documentation, which include the sale agreement and transfer documents.

Then, the following documents will be prepared for the buyer.

I) Notification form number 29, ii) Application for approval of disposition form number 30 and iii) transfer deed- form number 35. These must be filled together with photographs of the two parties. After signing these forms you pay capital gain tax at TRA and get capital gain tax clearance. This document and the sale agreement and the evaluation report, you take them back to the ministry of land, where the register of titles will consent about the transfer. Normally the seller is the one who is entitled to pay the capital gain, however in most cases these days, you’ll see the buyer ends up paying the capital gain, due to the negotiations between the buyer and the seller. If all the documents are submitted and you have paid all land rent, then the title deed can be obtained within a short period, less than a month. All this however, applies to Tanzanian citizens. I suggest you contact the land registry/local Tanzanian embassy to get information that is more relevant to you.
