Top 5 things to know about the ICBC minor injury definition

BC’s minor injury legislation will capture many car accident claims and has the potential to significantly impact entitlement to personal injury compensation. Here are the top five things to know about the ICBC minor injury definition.

1.The ICBC minor injury definition is broad. The definition of a minor injury in BC’s Insurance (Vehicle) Act includes abrasions, contusions, lacerations, sprains and strains. But the regulations also include types of injuries that are—or have the potential to be—much more serious, such as chronic pain syndrome, TMJ disorder, certain whiplash associated disorders, concussions, and psychological or psychiatric conditions. 2.If the ICBC minor injury definition applies, your general damages are “capped.” If your injury is minor, compensation for the pain and suffering portion of your claim is limited to a certain amount. If the motor vehicle accident that caused your injuries happened between April 1, 2019 and March 31, 2020, the cap is $5,500. From April 1, 2020 to March 31, 2021, the limit for pain and suffering is $5,627. The minor injury cap does not apply to other types of damages you may be entitled to, such as past and future income loss and future care costs. 3.You can challenge a determination that the ICBC minor injury definition applies to your claim.. You may want to obtain legal advice first. It may be possible to argue that the cap on general damages should not apply because your injuries resulted in “permanent serious disfigurement” or “serious impairment” (meaning an impairment that has not resolved within 12 months of the accident and which causes substantial inability to perform essential tasks at work, school, or home).

ACAT Raises Awareness About Sexual Exploitation of Youth The Abbotsford Community Action Team (ACAT) is raising awareness in Abbotsford middle and high schools about sexual exploitation through posters, stickers and online information. The posters feature four of the possible warning signs of sexual exploitation which include an age difference between the youth and the exploiter, lifestyle changes, gifts and becoming isolated. A QR code allows students to anonymously report if they are feeling unsafe through the ERASE – Expect Respect and a Safe Education initiative of the BC Ministry of Education. Bobby has projects such as Love Hostel and Aashram season 2, besides Bollywood deals such as Apne 2 and Animal coming up. Talking about the love that he has been receiving from fans, especially for Ashram, he says: "I don't know what to feel. It is the love of my fans plus the new fans that I have made who helped me receive this award. They appreciated my work and the web series was watched by so many people. I will continue to support federal funding applications from our community for infrastructure dollars, housing projects, community initiatives and environmental work including those working to implement strong safeguards to protect wild salmon and promote Fraser River conservation. Four years after the decision was made to allow for individuals to grow cannabis for personal, medical use, responsibility for the enforcement and administration of these regulations remains muddled and resources lacking. Municipalities have been placed in a difficult position by the Federal Government’s Access to Cannabis for Medical Purposes Regulations (AC-

MPR) which limit municipal authority and ability to inspect properties. I have sponsored a petition created by residents to address this issue and am working with local mayors to further identify gaps in the ACMPR. Canadians should never be forced to choose between their mental health and their job after a family member dies. Currently Compassion Care Leave ends when a loved one passes away, leaving their caretaker no time to grieve their loss before they have to return to work. This is unacceptable. I jointly seconded Bill C-220, An Act to amend the Canada Labour Code (compassionate care leave) to ensure Compassion Care Leave Benefits are extended. As Shadow Minister for Housing, I will highlight workable housing policy solutions to the federal government and lobby for their implementation to improve the National Housing Strategy and Indigenous housing programs. More must be done to ensure there are affordable housing options both for renters and homeowners, especially in areas of inflated prices like Vancouver and Toronto, where young people can no longer afford to live in the communities they grew-up in. The federal government must be held to account for failing to address money laundering in the Canadian real estate sector and I will continue to push for real action. How would you describe PM Justin Trudeau’s efforts to curb the economic impacts of COVID-19? Where did the government go wrong, and what could have the government done better? What role did your party have in putting together the relief benefits? Amidst all the uncertainty one thing is clear, the Trudeau Liberals do not have a plan to help the millions of Canadians who are looking for work or the tens of thousands of businesses who have been hard hit by the pandemic. Despite two World Wars and the Great Depression, never has the Canadian Government failed to present a Budget until last year. There are now 1.1 million Canadians directly affected by the COVID-19 economic effects – including 636,000 unemployed workers and 433,000 people who are working less than half their usual hours. Canadians want their lives back – not an increase in taxes as the Liberals announced last week.

However, the Liberal government has been successful in creating ethical scandals, shutting down committee work and proroguing Parliament; effectively putting themselves first and delaying help to Canadians. How satisfied were you with the government’s actions to curb the pandemic (border shutdowns, lockdowns, social restrictions, etc.)? Failed communications played a significant role in the government’s decisions to address the pandemic. History will show just how deep failed communications impacted our ability to prevent the arrival and spread of COVID-19 in Canada. Mission-Matsqui-Fraser Canyon is home to four federal institutions and experienced the largest single outbreak in Canada at Mission Institution. 120 inmates and a dozen staff tested positive for COVID-19 and one inmate died of the virus. Pandemic protocols were not sufficiently communicated throughout the Institution or community, lack of staffing and PPE were blamed as major factors for this outbreak. Additionally, the government failed to coordinate with the provinces to align public health orders where jurisdictions intersect. This left employers at a loss on how to comply with ever changing workplace and housing regulations. And served to shake Canadians’ confidence when told by Canadian health officials that masks are inconsequential to preventing the spread of COVID-19, while Provinces encouraged them.
