Are Slip and Fall Settlements Taxable?

If you follow our blog page, you are aware that we recently explained how slip and fall settlements are calculated and the types of compensation you can expect from a slip and fall accident. The next big question we want to answer is whether compensation for a slip and fall injury is taxable or not. Do You Have to Pay Tax on Slip and Fall Compensation?

The general rule is that slip and fall compensation is not taxable. Damages for personal injury claims are not considered income by the Canada Revenue Agency (CRA); therefore they are exempt from income tax. This tax exemption applies to compensation for physical and/or mental personal injuries, and includes:

life, loss of earning capacity, shortened expectation of life, and the loss of financial support caused by the death of a supporting individual.

The tax exemption for personal injury damages applies regardless of whether the amount you receive is paid pursuant to an out-of-court settlement or in accordance with a court order made by a judge or jury after trial. It also doesn’t matter if the compensation is paid as a one-time lump sum or over time in periodic payments through a structured settlement. As long as the amount paid arose from a claim for damages for personal injury or death, it is not taxable as income when received, even if the damages were calculated with reference to your loss of earnings.

What does it take to bring three National Awardwinning actors together on screen? Director Suresh Triveni has the answer — a compelling script. The filmmaker recently announced Jalsa, which sees Vidya Balan, Shefali Shah and Rohini Hattangadi share screen space. While the director kicked off the project on Thursday with the secondary cast, Balan will commence shooting on Monday. “After the feel-good Tumhari Sulu [2017], Suresh has taken on an intense subject with Jalsa. It’s a hardhitting drama that studies the different classes of society, and how one influences the other,” says a source. In his second outing with Balan after the delightful Tumhari Sulu, Triveni has rounded up an eclectic cast by roping in Hattangadi. “The senior actor has been active in Marathi showbiz, featuring in serials and movies. She was, however, missing from the Hindi film circuit and was last seen in Bejoy Nambiar’s David [2013]. Actor Huma Qureshi says the market is ready for women-led stories but there are not enough movies that put female-centric characters and stories in the front. Qureshi, who has headlined web series such as 'Leila' and 'Maharani' and plays the role of an undercover agent in her upcoming film 'BellBottom', has also come up with a story about a brown girl superhero. "The amount of films that should have been made with female-centric characters or women leading the cast is less. They are being made but I feel there should be more such films. There is a need for it and the market is also ready for these kinds of stories," the "Gangs of Wasseypur" star said. Talking about her story, Qureshi, 35, said she decided to write it during the pandemic as she had free time. "As actors, we are dependent on other people to write stories for us, so why can't I write for myself? I am enjoying it," Qureshi said, adding that "The News Room" screenwriter Aaron Sorkin is one
