Investment Property Listings and Sales – Avoid Misrepresentation

M

any RAHB members have encountered a situation where they are listing, showing or selling a multi-residential property – a duplex, triplex or property with up to six or eight individual rental units. Some properties conform to local zoning bylaws and some – many, in Hamilton – do not. Members must be very cautious when dealing with these properties because it can be easy to misrepresent the property as something it is not. Just because a property has three units and is generating income from those three units, for example, does not mean it is legally allowed to be used as a three-unit dwelling.

So how do you show caution?

The obvious answer is that the listing salesperson or broker should verify the zoning on the property. Make sure it is zoned for its current use. If it isn’t, then the listing should note what the zoning is and then say how it’s currently being used. For example, you could say “property zoned single family; currently used a three-unit dwelling”, or something along that line. It then becomes the buyer’s responsibility to decide if they want to deal with an illegal use. Where a salesperson is working with a buyer and nothing is said about the zoning on the listing, that salesperson should verify the zoning and pass the information on to the buyer. If it’s improperly used, the buyer can make the choice of whether to go ahead with a purchase.

It’s all about disclosure of pertinent facts and avoiding misrepresentation. Just because a multi-residential property contains a certain number of units, don’t assume they are all legal. The REALTOR® must be diligent in verifying the information and ensuring that all pertinent facts are known and disclosed.

All registrants in the province of Ontario are required, under REBBA 2002 and the Code of Ethics, to ensure they do not misrepresent, deceive or deal fraudulently in any trade in real estate. There are numerous parts of REBBA 2002 and the Code of Ethics that apply when listing properties. Here’s a partial list: Code of Ethics – Section 3 3. A registrant shall treat every person the registrant deals with in the course of a trade in real estate fairly, honestly and with integrity.

REBBA 2002 Section 35 35. No registrant shall furnish, assist in furnishing or induce or counsel another person to furnish or assist in furnishing any false or deceptive information or documents relating to a trade in real estate. Code of Ethics – Material Facts (A material fact is defined as any fact that would affect a reasonable person’s decision to acquire or dispose of an interest in real estate.) 21. (1) A broker or salesperson who has a client in respect of the acquisition or disposition of a particular interest in real estate shall take reasonable steps to determine the material facts relating to the acquisition or disposition and, at the earliest practicable opportunity, shall disclose the material facts to the client (2) A broker or salesperson who has a customer in respect of the acquisition or disposition of a particular interest in real estate shall, at the earliest practicable opportunity, disclose to the customer the material facts relating to the acquisition or disposition that are known by or ought to be known by the broker or salesperson Code of Ethics – Misrepresentation 37 – Inaccurate Representations (1) A registrant shall not knowingly make an inaccurate representation in respect of a trade in real estate 38. A registrant shall use the registrant’s best efforts to prevent error, misrepresentation, fraud or any unethical practice in respect of a trade in real estate. Code of Ethics – Conscientious and Competent Service, Etc. 5. A registrant shall provide conscientious service to the registrant’s clients and customers and shall demonstrate reasonable knowledge, skill, judgment and competence in providing those services. Code of Ethics – Error, Misrepresentation, Fraud, Etc. 38. A registrant shall use the registrant’s best efforts to prevent error, misrepresentation, fraud or any unethical practice in respect of a trade in real estate.

Perched on the banks of the Grand River, Cayuga is well known for its iconic heritage bridge and its drag strip, a hot track for stock car racing, drag racing and motorsports. 1,622 (2011)

● Cayuga is situated on the banks of the Grand River between Caledonia and Port Maitland. It is a 20-minute drive from Lake Erie and 30 minutes south of Hamilton.

Cayuga was incorporated as a village in 1859 and became the county seat for Haldimand County because of its central location. It is named after the Cayuga, one of the Six Nations of the Grand River Natives who were awarded land in the area for siding with the British in the American Revolution. ● As the county seat, Cayuga was the location of the Court House and jail. In the late 1700s and early 1800s, public hangings were held in the courtyard and the prisoners buried on site. ● In 1974, the village was amalgamated into the new town of Haldimand within the Regional Municipality of Haldimand-Norfolk. Cayuga is now an unincorporated community in Ward 2 of Haldimand County. ● Cayuga Bridge, the town’s five-span steel through-truss bridge built in 1924, is currently being replaced. The iconic heritage bridge carried Highway 3 over the Grand River and was last rebuilt in 1976. It was the only five-span steel through-truss highway bridge in the province, and the longest steel through-truss bridge in Ontario, with a total length of almost 190 metres (615 feet). ●

The Grand River runs along the western portion of the town and offers fishing and other recreational activities. Ruthven Park, located just north of Cayuga, is a 1500-acre National Historic Site featuring the Thompson Mansion, the summer home of the Thompson family who owned the steamship line on the Grand River when it was a commercial route. The Greek Revival style mansion is open for tours during the summer. (ruthvenpark.ca) ● Cayuga Courthouse, one of the oldest Courthouses in Canada, is located at 55 Munsee St. A functioning jail surrounded by rock walls was attached to the Courthouse until the late 1960s. ● Toronto Motorsports Park has been, under various names, the home of drag racing since 1955. It originally shared runways with planes on the Kohler Airstrip, built for training British Commonwealth pilots during the Second World War. (torontomotorsportspark.com) ● Taquanyah Nature Centre offers natural history and walking and hiking trails. ● Haldmand County Museum and Archives showcases Haldimand’s heritage. The Nicholas Log Cabin, built Cayuga Courthouse in 1835, was home to the Nicholas family, early settlers to the area. In 1961 the cabin and its artifacts were moved to Courthouse Park and made a permanent exhibit of the museum. (haldimandcounty.on.ca) ● ●

CayugaFest is the community’s largest event, held annually during the third weekend of July. This event is staged by local service clubs and offers live entertainment, a parade, crafts and more. (cayugafest.com) ● Haldimand Motors Great Tricycle Race is an annual charity event in which Haldimand service clubs, fire stations and high schools compete for cash prizes; the event is a major food drive for Haldimand food banks. News RAHB/CREA Bruce for CREA Director

RAHB Past President Bruce Moran (Chase Realty Inc.) will be running for the position of CREA Regional Director for Ontario in the upcoming election at the CREA Annual General Meeting on March 29. Bruce has been a member of RAHB for 28 years and has been Broker of Record of Chase Realty Inc. since 1996. He has served on many RAHB committees and task forces, the Board of Directors and as President. Bruce received the Volunteer of the Year award in 2003. Voting delegates from Ontario will cast their ballots at the CREA annual meeting in Ottawa.

A salesperson, when asked by a buyer client about zoning requirements, broadly describes his current under standing of local restrictions, but then ensures that the client is directed to an appropriate authority and/or includes a condition in any offer to avoid any possible error or misrepresentation. In doing so, the salesperson has taken reasonable steps to avoid error and misrepresentation when advising the client.) Members must be very clear in their dealings with clients and customers – whether it is in a listing agreement, drafting an offer or in conversation – to avoid misrepresentation. This is especially important when working with multi-unit properties.

AHB members are allowed to download up to 6000 reports from GeoWarehouse in a calendar year. Previously, GeoWarehouse displayed the number of reports downloaded out of the 6000 allowed. The display has now changed and shows the number of reports downloaded out of 1000. Members are still entitled to 6000 downloads. However, members who download 1000 in a calendar year will be required to contact Teranet, to satisfy them that the download privileges are not being abused. Teranet will ask those members to sign an affidavit, and once Teranet is satisfied then members will be allowed to download reports once again. This process will occur after every 1000 downloads in a calendar year, up to a maximum of 6000. Members with questions should contact Teranet at 1-800-208-5263 or info@teranet.ca.

Microsoft Support for Windows XP Ends Soon

M

icrosoft will end mainstream support for Windows XP Service Pack 3 (SP3) as of April 8, 2014. As per CoreLogic Support Policy, version 5.11 of Fusion (the next version, to be released soon) running on PCs with Windows XP SP3 will not be supported. This does not mean Fusion will suddenly stop working; however, issues reported to be specific to Windows XP SP3 OS will not be resolved by Microsoft and CoreLogic will not provide support services to members running XP on their PCs. CoreLogic will continue to support Microsoft Windows 7 and higher. CREA periodically releases maintenance updates to REALTOR.ca or ICX.ca mobile apps to correct issues and implement minor changes. Anyone using the apps should ensure they are using the latest app version.

Demographics added to REALTOR.ca CREA added demographic information to the REALTOR.ca and ICX.ca sites in December. As of mid-January, approximately nine per cent of visitors to the new beta site interacted with the demographics content on the site – that’s almost one million visitors. Demographics will be made available on the REALTOR.ca mobile apps in 2014.

The new .REALTOR top-level domain (TLD) will make it easier for home buyers, sellers and investors to locate a trusted source of real estate information, resources and services online. The .REALTOR TLD will be used as an alternative to .com, .ca, .org, etc. Registration will open later this year, and .REALTOR will be available to all REALTOR® members in Canada and the United States. Right now, members of CREA and NAR can sign up to be on the priority list for .REALTOR domain registration. Those who are on the priority list will have a 24-hour head start to register a domain before other members of CREA and NAR. Priority list registration ends March 15, 2014. Hamilton receives six awards

H

amilton’s Economic Development Department (EcDev) took home six awards from the Economic Developers Council of Ontario’s 57th Annual Conference and Showcase in February.

Two of the awards were in the category of Technology & New Media: one for their video “Ambitious Hamilton” (view the video at www.youtube.com/ watch?v=1-BgySJ2c50&list=TLN498yebSdUKQpQgDUGRI1UbdFXmFECU) and the second for their new Hamilton Site Selector app (http://siteselector.hamilton.ca/). Site Selector is Hamilton EcDev’s online tool for identifying commercial properties available in the city of Hamilton. RAHB has long collaborated with EcDev by providing commercial listing information specifically for the site; Hamilton took the additional step of developing an app for the site in 2013.
