Stoney Creek is best known as the site of the Battle of Stoney Creek - a pivotal battle between a small force of British soldiers and a larger number of American troops in the War of 1812. Population:
● 62,292 (2006 Census)
Geographic location:
● On the southern shore of the west end of Lake Ontario, east of Hamilton. The historic area known as the “Old Town” lies below the Niagara Escarpment.
Historical facts:
● The Battle of Stoney Creek took place on June 6, 1813 during the War of 1812. The British army, although much smaller in numbers (700), surprised and overwhelmed the 3000 American troops and captured the two U.S. Generals to win the battle that lasted less than 45 minutes and killed hundreds. The victory was pivotal in ensuring that Upper Canada’s existence would not be threatened further until it expanded to become the Province of Canada in 1841 and, eventually, Canada in 1867. ● In 1974 the town of Stoney Creek merged with Saltfleet Township. The merger encompassed the agricultural communities of Elfrida, Fruitland, Tapleytown, Tweedside, Vinemount and Winona. The areas it annexed on top of the Niagara Escarpment west of Highway 20 (now known as Upper Centennial Parkway) became known as Upper Stoney Creek or Satellite City. ● In 1984 Stoney Creek became a city and in 2001 it was amalgamated into the City of Hamilton.

● The site of the Battle of Stoney Creek near Centennial Parkway and King Street has been preserved as Battlefield House with its associated museum, park and monument which commemorates a century of peace between the British and the Americans. ● The Erland Lee Museum, a National Historic Site of Canada, is located on the ridge of the Niagara Escarpment in Stoney Creek. Erland Lee house is the birthplace of the Women’s Institute. ● Devil’s Punch Bowl is a one hundred metre wide rock face that exposes 40 million years of geological history. www.ontariotrails.on.ca ● Stoney Creek Waterfront Trail is now linked to the Red Hill Creek Trail system by a bridge crossing the wetlands and the QEW, connecting Upper Stoney Creek to the lake. www.ontariotrails.on.ca/trails/view/stoney-creek---waterfront-trail ● Eramosa Karst Conservation Area is located at Upper Mount Albion Rd. www.conservationhamilton.ca ● Fifty Point Conservation Area is an 80-hectare park with marina facilities. www.conservationhamilton.ca ● Billy Green Falls is also known as Battlefield Falls, as it is located on Battlefield Creek. The complex ribbon falls is 17 metres high and its crest width is 6 metres.

Landlords and Tenants need to co-operate when selling a home by Mark Weisleder
R
eal estate lawyer Mark Weisleder has some good advice for landlords and tenants – the information is important for REALTORS®, too.
potential buyers to see the home on a timely basis. As an example, agree to only permit showings from 4-6 pm each day.
There is lots of confusion as to the rights of landlords and tenants in Ontario when a home is put up for sale. Landlords are trying to bully tenants into leaving and tenants are refusing to permit potential buyers to see the home.
Some landlords assist their tenant first in finding another place to live, even before putting the home up for sale. This is also an excellent solution, in my opinion. The tenant gets to find another place, without the stress of an eviction proceeding, and the landlord then gets to later fix up their home and make it more presentable to a wider range of potential buyers.
Here are the rules: • Landlords can sell their home at any time; • If the tenant has a lease, they cannot be evicted before the end of their lease term; • Tenants must permit showings to potential buyers, as long as 24 hours’ advance written notice is given and the showing takes place between 8 a.m. and 8 p.m. Tenants need to make sure that any pets that they own are kept securely during showings. Tenants are permitted to be at the home during showings, although it is not mandatory. • If a tenant’s lease has ended, they automatically become a monthly tenant and must still be given 60 days’ notice to vacate, provided that a buyer has already unconditionally agreed to buy the home. Some tenants believe that if they still have a lease for several months, the landlord cannot show the home to potential buyers. Wrong. If the buyers do purchase the home, they must still respect the terms of the lease when they take over as landlord. At the end of the lease term, the buyers, now the owner, can provide a 60 days’ eviction notice based on the fact that they need the home for themselves or their family.

If a tenant refuses to permit showings after proper notice has been given, the landlord can start eviction proceedings as this is a breach of conduct by the tenant. The landlord could also potentially claim damages from the tenant if the tenant’s actions prevent the landlord from selling the home in a timely manner.

Landlords cannot trick tenants into leaving either, pretending to move in so that the tenant vacates and then immediately fixing the place up and selling it. The tenant can sue the landlord for damages if this occurs. This can include all the tenant’s moving costs and higher rent that may have been paid elsewhere. The Board may also add additional fines for breaking the law. If you are planning to sell your home, my advice is to approach your tenant first to work out a plan for showings that accommodates everyone, so that the tenant can properly plan to protect their valuables and secure any pets and the landlord can permit
When landlords and tenants understand the rules and co-operate when a home is being sold, everyone wins.

embers had the opportunity to meet with RAHB President Tim Mattioli, Membership Area Representation Committee (MARC) chair Rochelle Edwards and RAHB CEO Ross Godsoe at town hall meetings in April and early May. The meetings were held in Grimsby (April 30), Burlington (May 2) and Ancaster (May 7).
The RAHB President and CEO updated members on various RAHB initiatives, including the progress toward a regional, shared MLS® database with four additional boards/associations; the MLS® Home Price Index; electronic lock boxes and proposed changes to the RAHB Bylaw and MLS® Rules and Regulations. The town halls were held in advance of the General Membership Meeting scheduled for May 29, 2014, to give members the chance to discuss the issues and provide feedback.

ongratulations, Burlington, on being ranked the Number 1 mid-sized city in Canada according to MoneySense Magazine’s “Canada’s Best Places to Live 2014”. Burlington was also ranked as the fifth-best city overall in Canada.
In addition to this research, a survey conducted by Ipsos Reid highlighted Ontarians’ concerns over the potential implementation of an MLTT in their area which could add as much as $3,680 to the cost of a new home. Seven in ten Ontarians believe that the addition of an MLTT would: • Limit their ability to afford a home purchase – 69% • Make them incur more debt in order to pay the tax – 69% • Delay their decision to purchase a home – 71% • Make them more likely to consider buying a home in a municipality that does not charge an MLTT – 74% • Make them spend less on renovations, furniture or appliances for the home they would purchase – 73% So far, only Torontonians have been saddled with this unfair second tax. But that could change. Many municipalities would welcome the extra revenue a Municipal Land Transfer Tax would put into their coffers.

According to new research by the Ontario Real Estate Association (OREA), Toronto’s MLTT has caused significant job losses and negative economic impacts since being imposed in 2008. The study, conducted by Altus Group, looked into the economic impact of Toronto’s Municipal Land Transfer Tax. They concluded that the tax has cost the city $2.3 billion in economic activity and almost 15,000 full-time jobs over the last six years.

AHB’s 13th Annual Commercial Summit took place on Thursday, April 24 at Burlington’s Royal Botanical Gardens.
RCC Chair Paul Martindale welcomed the 100+ delegates, exhibitors, sponsors and speakers, and turned the day’s proceedings over to moderator Professor Marvin Ryder from the DeGroot School of Business at McMaster University. The full morning of education and updates began with a presentation from Brian Lennie of Horizon Utilities Corporation, who provided information on Horizon’s “Smart Growth Development” program in the Hamilton and Niagara areas. Next, a panel of the region’s economic development representatives presented updates on local current and future growth and development, including opportunities and incentives. Hamilton, Halton and Niagara Regions were represented by Chris Phillips, John Davidson and Bob Seguin, respectively. Keynote speaker Sheila Botting of Deloitte LLP discussed the Canada-U.S. productivity gap and its effects on federal and local growth in manufacturing, retail, office, investment and development. Chairman Paul Martindale noted to the delegates in his concluding remarks: “Your attendance and support encourages the RCC to deliver even more timely and relevant education and services”. REA has updated REALTOR.ca and ICX.ca apps. The apps for REALTOR.ca for iPad and Android and ICX.ca for iPhone are upgrades of the previous design; the upgrade to REALTOR.ca for iPhone is a completely new design.
The following new features, among others, have been included in all the apps: • Ability to switch between metric and imperial at a touch; • User Education overlay, to more easily introduce new features; • Support for multimedia links from REALTORS® such as additional pictures, videos and house tours; • The REALTOR.ca apps have a new mortgage calculator.
