It shall be the Brokerage’s responsibility to ensure that notice of all Membership resignations and/or other Membership terminations for Members registered with such Brokerage are received at the Association office within seven (7) business days of such termination. Notice of any resignation and/or other Membership termination received after such date, shall be subject to a penalty in the amount of $50.00 per incident, which sum shall be payable by the Brokerage to the Association.

RCC Update

Early registration is now open for the annual Canadian Commercial Conference being held in Parksville, B.C. from September 15-17, 2014. The event is a joint presentation by CREA and the Vancouver Island Real Estate Board. The conference will provide an opportunity for commercial practitioners, or those interested in commercial, to network and learn about the latest trends in commercial real estate. The first two days of the conference are open to all CREA members and will feature an introduction to commercial real estate for those REALTORS® who are new or considering a move into commercial real estate; courses on taxation on commercial properties and investing in commercial real estate; keynote speech from BMO Chief Economist Doug Porter plus panel discussions about emerging trends in commercial real estate. is located on Highway 6 in Haldimand County and is approximately 45 km southwest of Hamilton and 15 km southwest of Caledonia. ● Charles

and David Hager built the first bridge across the Grand River at Caledonia, then purchased land further south, where Highway 6 (then known as the Plank Road) was being constructed. A small village – to be known as Hagersville in honour of the Hager brothers – grew where the Hagers settled and began building. ● In 1852, Charles Hager built a frame hotel at the corner of the Plank Road and Indian Line; the hotel Haldimand County housed the first post office. Millenium Clock Tower ● The building of the Canada Southern Railroad in 1870 and the Hamilton and Lake Erie Railway three years later helped to make Hagersville a prosperous village. ● The Junction Hotel was built by the railroad tracks and survives today as The Old Lawson House. ● During World War II, Hagersville was the home of the British commonwealth Air Training Plan Station 16 Service Flying Training School where trainee pilots were taught to fly the Harvard and Anson aircraft. The site was later used by the Canadian Army for various purposes and was known as Camp Hagersville. The camp was closed in 1964. ● Hagersville gained international notoriety in 1990 for an uncontrolled tire fire - 14 million tires burned and released toxic smoke for 17 days. The fire actually occurred in Townsend, a neigh- bouring community, but media labeled it as Hagersville due to Townsend’s relatively unknown status in the area.

Their famous parade will be led by approximately 20 firetrucks coming to celebrate 150 years of firefighting in Caledonia. A story for a busy market

arah Salesperson had buyers with whom she’d been working for months. They were all getting a little desperate – the buyers because they were buying their first home and nothing they saw in their price range appealed to them, and Sarah because she’d shown them every house in their price range and they were just too picky. Still, she liked them and tried very hard to find their first home. She remembered what it was like when she was buying her first home and how hard it was to let go of some of the dreams.

Section 11.05 of the MLS® Rules and Regulations states: The Co-Operating Brokerage may be paid a lower commission than that specified on the Association’s MLS® System if an agreement in writing has been reached between the Listing Brokerage and the Co-Operating Brokerage, or their authorized representatives. No attempt may be made to negotiate such an agreement in the presence of the Seller.

Then the perfect house came on the market. It had everything the buyers were looking for and it was in the perfect neighbourhood for them. Unfortunately it was priced just a little too high for her buyers. She decided to show it to them anyway; maybe they could somehow come up with more money for their down payment or maybe – just maybe – she could negotiate the price downward enough that they could afford it.

Section 11.02 also says that: No Member shall attempt to negotiate the distribution of commission between Members in the presence of the Seller or Buyer.

Not surprisingly, because the house had great features at a great price, there were a number of offers on the property. Sarah worked with the buyers to put together the best offer they could handle, but it was still below the listed price. Sarah knew that even though it was a great offer from her buyer’s point of view, it probably wasn’t going to measure up when compared to the other offers. The only thing she could think that might sway the sellers toward her buyers’ offer was an incentive of some sort.

The time came for the offer presentation and Sarah presented her offer, pointing out how sincere her buyers were, how much they loved the house and how they considered it their dream home for their first home. Then she offered what she hoped would clinch the deal: if the selling salesperson would be willing to reduce his commission, Sarah would be willing to do the same. She really wanted these buyers to get the house.

Sarah was happy with her presentation and the incentive she was able to throw in at the end. She was a little surprised at the listing salesperson’s tight-lipped response to it, however, and left the presentation feeling like she wasn’t going to get much support for her offer. Was Sarah right in thinking the listing salesperson wasn’t very supportive of her suggestion to lower the commission? Answer Sarah was lucky the listing salesperson was courteous enough to show restraint after her suggestion that lowering the commission would be the answer to her buyers’ dreams.

Very clearly, Sarah should have contacted the listing salesperson ahead of time to determine if a reduced commission was possible.

GMM Highlights

Members approve new MLS ® rule; say "No" to electronic lock boxes

M

embers who attended the RAHB General Membership Meeting (GMM) on May 29 approved a change to the MLS® Rules and Regulations which will allow brokers, managers and members with broker load privileges to broker load listing cancellations and suspensions. When discussing the proposed change in the Open Forum prior to the meeting, RAHB President Tim Mattioli noted that suspensions and cancellations would still require the Broker of Record’s or Manager’s written consent on the properly completed paperwork from the seller before they could be broker loaded. RAHB will have a system in place to audit broker loaded cancellations and suspensions. Penalties for abusing the privilege of broker loading cancellations and suspensions are still to be decided by the Board of Directors. The new rule will take effect by the end of June - watch Message of the Day (MOD) for more information. Members also approved an amendment to the RAHB Bylaw which extends the hours for electronic voting in the annual election of directors, from 8:30 a.m. - 4:30 p.m. on three days prior to the annual election meeting to all day on those three days. The updated Bylaw and Rules and Regulations are now available in the Membership Information section on REALTOR Link® and Fusion Resourses - RAHB Documents. After a year of research by the MLS® Committee and consultation with members, the Board of Directors presented a recommendation for association-wide adoption of electronic lock boxes.

Members’ motions from Carl Stars and Don Johnson were also considered by members at the GMM: Carl Stars’ motion asking for member approval for expenditures over $50,000 was defeated and Don Johnson’s motions regarding electronic lock boxes, the MLS® Home Price Index and RAHB membership fees were approved. The Board of Directors will consider the motions and report back to the members with their final decision. (For details on the motions, please refer to the Notice of Meeting email sent to all members on May 16, and see “Voting Items”.) RAHB CEO Ross Godsoe wrapped up the meeting with an update on a shared, regional MLS® system, the upcoming Member Satisfaction Survey and a new app – Look4Homes – to be released before the end of June. (see more info about Look4Homes on the next page)

Members at the meeting defeated the motion, and when asked if the Board will be further considering the subject, Mr. Mattioli replied that the Board would not be revisiting electronic lock boxes.

Look4Homes, a new app designed for iPhones and Androids, will soon be available to the members of the four STARRS associations – RAHB, Niagara, Brantford and Simcoe - and their clients. This new product has great features for REALTORS® and their homebuyers: • Interactive map searching using GPS location-based technology in the iPhone and Android platforms • View property on maps, including satellite view • Search using all the criteria you are used to, including price range, number of beds and baths • Easily see all property details including multiple photos, price and descriptions • Find your way to the front door using the turn-by-turn directions provided • Save properties for easy review later, or share them via text, email, Facebook or Twitter

Watch for the release of Look4Homes before the end of June.

SmartLinks and pop-up blockers It is recommended that you add Fusion (URL: http:// fusion.starrs.ca) to your browser’s list of allowed sites (‘exceptions’) for pop-ups - failing to do so may prevent Smartlinks (GeoWarehouse®, SIM, Connect, etc.) from opening. Shown below are the steps to create an exception for Fusion in each of the major browsers. There may be slight differences due to browser versions and settings, but the instructions should provide a basic overview of how to create a pop-up exception.

CREA PAC Days

AHB volunteers and staff travelled to Ottawa in May to meet with local MPs to discuss issues that matter to REALTORS®. This year’s conference focussed on making housing more affordable by indexing the Home Buyers’ Plan and extending it to people going through major life changes. RAHB representatives met with Chris Charlton, Wayne Marston and Mike Wallace, and received positive feedback about the proposals. Ontario Votes On June 12, Ontario goes to the polls to elect the next provincial government. To find information about your candidates and where to vote visit www.wemakevotingeasy.ca/en/.

Don is well-known for his involvement in the Dundas community. He was instrumental in bringing the Allan Cup to Dundas last year; it was icing on the cake that his team, the Real McCoys, won the tournament. He was the driving force behind Dundas being named Hockeyville in 2010. Don and his Real McCoys are well-known for their charity work during the hockey season. Don has also been a strong supporter of the United Way.

REALTORS ® RIDE from RAHB!

ome to the RAHB office on Wednesday, July 9 to give a big send-off to the Ontario REALTORS® who will be participating in this year’s REALTORS® RIDE for Charity.

The Ride will wind through southwest Ontario and include stops at real estate associations – the Brantford Regional Real Estate Association, Simcoe & District Real Estate Board, London and St. Thomas Association of REALTORS® along the way. The ride will end in Leamington, the “sun parlour” of Canada. The Riders will leave the RAHB office at approximately 9:15 a.m., so plan to come between 8:30 a.m. – 9:15 a.m. to chat with the Riders, check out their bikes and wave them off.
