Members of the association may use the REALTOR® trademark, which identifies them as real estate professionals who  subscribe to a strict code of ethics. The Association operates the local Multiple Listing Service® (MLS®) System and provides ongoing professional education courses for its members. In addition, RAHB is an active  participant in the Home Ownership Affordability Partnership (HOAP) and holds an annual auction in support of local charities. any Conservation Areas are open year-round for visitors and winter can be the perfect time to enjoy the great outdoors in these parks. The Dundas Valley offers hiking, snowshoeing and cross country skiing on 40 kilometers of trails. Valens offers winter camping, ice fishing, ice skating, hiking and cross country skiing on their 10kms of trails. Christie Lake offers many kilometres of trails for cross-country skiing and snowshoeing. Check you your local conservation area for other programs: www.conservationhamilton.ca;

Directors waive monthly fee for December

A

s a result of a review of projected income and expenses until the end of the year, the Board of Directors has waived the December monthly service fee for members. This measure will be evident on members’ December invoices which will be received in January. RAHB Finance Chair Donna Bacher announced the news at the RAHB Annual Election Meeting on November 27. She also noted that the Finance Committee will annually review expected surpluses or deficits to determine what, if any, measures are required to deal with the excess or loss. The review is required by a new policy for surpluses and deficits, which took effect for the end of the current fiscal year.

It provides a comprehensive overview for both REALTORS® and consumers about radon and the health risks and testing measures homeowners should undertake. A link will also be posted on the CREA.ca website. See how consumers view REALTORS® and REALTOR® value! The Great Expectations Tracking Study surveyed over 2,000 homeowners and potential homebuyers in order to better understand the current perception of REALTORS® and the home buying process. Nanos Research conducted the survey on behalf of CREA. This edition builds on the 2009 version of the study.

RE ALTORS ® come out to suppor t RAHB auction

R

AHB’s 26th annual Charity Auction offered an evening of food, entertainment and friendly bidding wars to raise money for the CHML/Y108/ 953 FRESH Children’s Fund. RAHB members and supporters came out to have a good time, and took home a wide range of goods and services purchased in the live and silent auctions. The event also featured chocolate tasting by Forrat’s Chocolates, wine tasting by Diamond Estates – The Winery and lots of opportunities to win prizes and draws. RAHB’s annual auction has raised over $789,600 for the charity, making RAHB its single largest contributor. The Children’s Fund offers assistance to over 30 different charities each year.

When is permission to advertise not permission to advertise?

T

he following decision from RECO Discipline and Appeals Hearings was recently published in the OREA “Edge”. The full case has been condensed and all names have been changed. THE FACTS Bob and Laura listed their home with David, a sales representative with Exclusive Estates Inc. When the buyers, Annie and Ian, made an offer to purchase this property, the documents included an advertising provision. That provision authorized David’s brokerage to advertise information about the listing and sale of the property. After some negotiation, Bob and Laura agreed to sell their property to Annie and Ian. In the final stages of the transaction, both buyers and sellers agreed to remove from the offer the advertising provision. They struck it out and initialed the change. Despite this agreed-upon revision, David published a newspaper advertisement several months later that referenced this sale. He identified himself as the listing representative and included in the ad the general location of the property and the selling price. THE FINDINGS The RECO panel determined that David acted unprofessionally by including information in the ad that could potentially identify the property when the owners had not consented in writing. David also included aspects of the agreement even though the sellers and buyers had not given written consent. The panel ruled that David breached the following sections of the REBBA 2002 Code of Ethics: 2(1) – Brokers and Salespersons; 3 – Fairness and honesty, etc. and 36(8) and 36(9) – Advertising. PENALTY David was fined $10,000 payable to the Real Estate Council of Ontario (RECO). The full decision is among those dated 2012/10/02 and can be viewed at www.reco.on.ca. Look under “Complaints and Enforcement” on the bottom left of the page, then go to “Discipline and appeals /Hearings and decisions.” Choose the year 2012 and search by date and topics: Advertising and Duty to Client.

he RAHB office will maintain the following hours for the upcoming holiday season: Monday/Tuesday, December 22 and 23 – Open 8:30 a.m. – 4:30 p.m. Wednesday to Friday, December 24, 25 and 26 – Closed Monday/Tuesday, December 29 and 30 – Open 8:30 a.m.– 4:30 p.m. Wednesday to Friday, December 31, January 1 and 2 – Closed If you require help with Fusion when the association office is closed, the on-line Help is always available. Click on “Help” and “On-line help”, and you can read and download “how-to” instructions and watch tutorials. The association photographer will be unavailable to take photos for broker loaded listings entered from December 23 to December 27, and December 30 to January 4. Please upload your own photos in between these dates. Here’s how: 1. Click on the Add/Edit tab and then click Edit Listings 2. Click the Edit button beside the listing to which you want to upload photos 3. Click the blue Images button on the left hand side of the screen 4. Click the Upload Images button 5. Navigate to where your image is located and select the image you want to upload. If uploading more than one image, click on the first image so it is highlighted in blue, then hold down your shift key and select the last image in your file, which will highlight all the photos in between 6. Click Open 7. Photo images will display on the screen. If you wish to change the order the images appear, click on the Change Display Order button. You can drop and drag your images in any order you wish 8. Click Ok, then click the Save button when you are finished TechHelpline will maintain normal hours (9 a.m. – 8 p.m. Monday to Saturday) with the following exception: CLOSED Christmas – Thursday, December 25

ive new directors were elected to the 2015 Board of Directors at the Annual Election Meeting (AEM) held November 27 at the Royal Botanical Gardens. Congratulations to Kim Alvarez, Ann Forbes Arndt, Gary Herron, Peter Holgate and Jack Loft on their election to the Board. The election of officers has already taken place. RCC Election Results RCC members and guests attended the RCC Election Meeting and Networking Breakfast at Hamilton’s Waterfront Banquet and Conference Centre on November 5, 2014. 2014 RCC Chair Paul Martindale welcomed the attendees, provided a year in review and recognized the RCC’s newest members. RCC Nominating Committee Chair Chris Allen announced the results of the RCC Election. The 2015 Regional Commercial Council will consist of: Heidi Van Der Marel (Chair) Paul Martindale (Past Chair) Hank Balfoort (Chair Elect) Wesley DeGroot Craig Knapman Ruth Lewis Special guest speaker Frank McKeown, Executive Director of the Burlington Economic Development Corporation, shared his impressions and goals in his role as the new Executive Director.


SCHOLARSHIP Awards

2014 Karan Barker Scholarship Awards

Karan Barker was a 25-year employee and former Executive Officer of the REALTORS® Association of Hamilton-Burlington. During her time with the association, Karan was involved in setting up the scholarship program that now bears her name. Karan passed away in 2001. Rebecca Harber is also a daughter of John Harber. She graduated from Blessed Trinity Catholic Secondary School, and is now attending Centennial College to earn her Early Childhood Education diploma.

Dalton Coles is the son of Deborah Coles of Royal LePage State Realty. He is a graduate of Sherwood Secondary School and is now a first-year student at Seneca College for Pre-Service Firefighting before he enters the Fire Fighting Technologies program.

Curtis Kelly is the son of Robert Kelly of Keller Williams Edge Realty. He is a graduate of Robert Bateman High School and is now attending the University of Guelph in the Honours Major Bio-Medical Science program. His goal is to apply to medical school to study emergency medicine.

Devon Coles is Dalton’s identical twin brother and also the son of Deborah Coles. Devon graduated with Honours from Sherwood Secondary School and is now in his second year of the Electrical Engineering Control program at Mohawk College.

Greg Taylor is the son of Heather Lindsay of Right at Home Realty Inc. Greg graduated from Highland Secondary School and is now attending the University of Waterloo in the Math/CPA program.

Jacqueline Harber is the daughter of John Harber of RE/MAX Garden City and one of triplets receiving a Karan Barker Scholarship. She graduated from Blessed Trinity Catholic Secondary School and is now studying in the Bachelor of Arts – Political Science Co-Op program at Brock University. Leslie Harber is also a daughter of John Harber. She graduated from Blessed Trinity Catholic Secondary School and is now attending the University of Waterloo in the Honours Recreation and Leisure Coop program.

OREA Standard Forms – New and Revised Forms/ Clauses for 2015 REA has recently released the 2015 Standard Forms and Clauses - Summary of Revisions. This report is now posted on the OREA website www.orea.com in the Members Only Section, and on REALTOR Link® in the MLS® & IT section. All members and support staff are encouraged to review this document. This report includes the list of the 38 revised and new forms for 2015, and the changes include such frequently used forms such as OREA Form 100 “Agreement of Purchase and Sale”; OREA Form 200 “Listing Agreement Authority to Offer for Sale”; OREA Form 122 “Mutual Release”; and OREA Form 320 “Confirmation of Co-Operation and Representation”. The new forms are now on the OREA site and software companies (including WEBForms®) have been asked to be ready by mid-December. Based on these release dates, RAHB expects to stock the printed forms in the Realty Shoppe by mid to late January. RAHB members are encouraged to use the 2015 forms as soon as possible in the New Year. Members must begin using the 2015 OREA forms by Tuesday, February 10, 2015. continued on back page
