MLS ®/TECHNOLOGY Unified search now available in CONNECT You are searching in the Southern Georgian Bay section of CONNECT for a listing on a property in Meaford but you can’t find it. So maybe the property was listed by a member of the REALTORS® Association of Grey Bruce Owen Sound, or the Barrie and District association, or TREB. Until now, you would have had to search through various associations’ databases on CONNECT to find that one listing in Meaford. But no more! A unified search is now available in CONNECT – just insert the MLS® number or the property address and you will find the listing, no matter which association’s MLS® System processed the listing*. Unified search allows you to search Active and Sold listings across all of

the CONNECT member boards and associations* from one simple search interface. The unified search interface will provide five basic search criteria fields – MLS®#, Price Range, Property Type, Status and Address. New Email & Print functionality for Client & REALTOR® Reports

Check that listing! You broker load your listing, give it a quick glance and hit “Submit”. The listing is now active and is being sent out to hundreds – maybe thousands – of other members’ clients who have been set up with a saved prospector search. And then you notice the listing price is incorrect. Of course you change the price right away, but that first incorrect price is now shown as the “Previous Price”. RAHB MLS® staff have been receiving many calls asking for the previous price to be removed from the listing because the listing price was entered incorrectly. This is happening often enough that it is obvious that members are not carefully checking their listings before hitting that “Submit” button.

Here’s a tip – print out a report of your listing instead of just glancing at what’s on the screen. Seeing the information on paper may let you see typos you might not see on the screen. And when you check your listing, make sure you look specifically at the following five fields, as experience shows they are the most likely to contain errors:

Changing the Selling Salesperson Recently RAHB has been receiving requests to make sales changes to amend the selling salesperson’s name. When the listing brokerage reports the sale, they likely report the selling salesperson to be the salesperson who presented the offer and completed the deal. However, many members work as part of a team, on behalf of a specific member, and prefer sales to be credited to the team leader. When you are the selling salesperson on an offer but wish your team leader to be credited with the sale, you must

ask the listing brokerage to amend the sale information. You must do this as soon as possible, as the listing brokerage must report the amendment within five business days of the original report of the sale, as per RAHB’s MLS® Policy: Sales 8.

Any corrections to a firm Agreement of Purchase and Sale report, with the exception of revisions to the closing date, must be submitted within five (5) business days of the original report of sale.

Personal Real Estate Corporations – tax fairness for real estate professionals Representatives from RAHB's Government Relations Committee will be meeting with local MPPs in early April to ask for support for an amendment to REBBA 2002 which would allow real estate salespeople to incorporate. A study by the Centre for Spatial Economics found that Personal Real Estate Corporations (PRECs) will have a small but positive impact on Ontario’s economy. The study found incorporation would increase provincial revenue by $0.8 million to $2 million annually, and would increase Ontario’s GDP by an average $9 to $25 million annually. In addition, PRECs will create 33 to 89 new jobs per year.

In Ontario, other regulated professionals such as chartered accountants, lawyers, health professionals, social workers, mortgage brokers, insurance agents and others can form personal corporations. Since 2008, B.C., Quebec, Manitoba, Saskatchewan and Nova Scotia have all moved to allow real estate salespeople to incorporate. Our Government Relations representatives will be asking MPPS to amend the legislation and treat Ontario REALTORS® more fairly.

Print your RAHB invoices for your tax return Tax time is here! Here’s how to print off your RAHB invoice:  Log into the Fusion Homepage  In the Resource section, select “Smartlinks”  From the drop down menu, select “Education/Account Services”. This will open a new window  Select “Print Members Statement”

 Enter the date parameters of your choice. For example, if you want to create a copy of your 2014 invoices, you would enter a start date of 01/01/2014 and an end date of 12/31/2014  Select “Run statement, Print” ** If you get a printer error, go to “select a format” (found above the RAHB logo), select “Acrobat Adobe PDF”, “export”, “print”. **

Scholarship application now available Applications are now being accepted for the 2015 Karan Barker Scholarship. This scholarship is awarded to a student who is or will be attending university or community college and is a child or grandchild of a RAHB member or RAHB employee. The student must demonstrate academic excellence, a high level of involvement in school and/or the community, maturity, initiative and/or strength of character.

Processing fee change An addition to Article 4, Section 4.01 of the RAHB Bylaw – approved by the members at the March 24 Annual General Meeting – now allows that members who transfer from one branch office to another branch office of the same Brokerage will no longer have to pay a processing fee.

Article 4, Section 4.01 (addition):

“Any Member who changes their office location(s) within the same Brokerage shall not be assessed a processing fee”. This change is effective immediately.

CREA/OREA/RECO NEWS Updated fact sheet on changes in offer handling - make sure you are prepared Earlier this month, RECO issued an e-blast to brokers of record and branch managers regarding new rules for handling written offers, stemming from Bill 55, the Stronger Protection for Ontario Consumers Act, 2013. In response to feedback from brokers of record and branch managers, RECO has updated the fact sheet. New rules for handling written offers come into effect on July 1, 2015. Your brokerage must create processes and policies that comply with these legislative changes. RECO has prepared a detailed fact sheet about the changes. All registrants should review it so that they can ensure compliance as of July 1, 2015. Here is an outline of the changes:  Offers must be made in writing. Please keep in mind that a written offer must be signed to be valid.

 A registrant cannot indicate that they have an offer, unless they have a written offer.  The seller’s brokerage must keep a record of all written offers that it receives.  RECO is developing a process to confirm the number of offers that were received for a property.  RECO will provide updates between now and July 1 in response to questions that registrants submit. To review the relevant changes, see section 35.1 of REBBA 2002 and section 19.1 of Ontario Regulation 579/05 made under REBBA 2002. (Note: OREA will design a new form for brokerages to use to comply with the requirements of Bill 55. See following article and stay tuned for more information.)

The OREA Standard Forms Committee will discuss Bill 55 compliance for brokerages and REALTORS® at its spring meeting and design a new standard form to help REALTORS® comply with Bill 55 and Ontario Regulation 307/14. It is anticipated this form will be released prior to Bill 55 coming into effect on July 1, 2015.

On July 1st, 2015, Ontario Regulation (307/14) http:// www.e-laws.gov.on.ca/html/source/regs/english/2014/ elaws_src_regs_r14307_e.htm, which implements amendments made to the Real Estate and Business Brokers Act, 2002 (“REBBA”) under Bill 55, will come into force. These changes are intended to address the issue of “phantom offers” in the real estate marketplace.

What REALTORS® Need to Know Bill 55 introduced a number of changes to REBBA which created new requirements for real estate registrants. Most notably:  Bill 55 prohibits a registrant working on behalf of a purchaser from presenting or representing an offer unless the offer is in writing.  Bill 55 requires that the selling brokerage must retain copies of all written offers that it receives to purchase real estate or copies of all other prescribed documents related to those offers. Ontario Regulation (307/14) outlines the required information that must be contained in a ‘prescribed document’ and states that the selling brokerage must retain a copy of the document or a copy of the written
