The Association operates the local Multiple Listing Service® (MLS®) System and provides ongoing professional education courses for its members. In addition, RAHB is an active participant in the Home Ownership Affordability Partnership (HOAP) and holds an annual  auction in support of local charities. from Rahb Ceo George O'Neill Competition Tribunal decision with respect to TREB’s VOW policies

You are most likely aware that on April 27, 2016, the Competition Tribunal released its anxiously awaited decision with respect to the Commissioner of Competition’s claim against TREB. The decision was that certain aspects associated with TREB’s Virtual Office Website (VOW) policy include restrictions that constitute an abuse of dominant position under section 79 of the Competition Act. The full decision remains confidential pending the outcome of further submissions requested by the Tribunal. Those further submissions will assist the Tribunal to determine the appropriate remedy, at which time their ruling is expected to be made public, and at RAHB we will be in a position to fully understand the decision and determine implications for our members. As soon as we have that information, we will share it with you. With just about perfect timing, Paul Feuer, Senior Competition Council from CREA, will be in Hamilton on May 10, 2016 to meet with our members to discuss competition issues and what is known about the TREB ruling. Regional Matrix MLS® System update

After May 10, RAHB is expected to be the only association of the original eight founding regional boards/associations in the regional MLS® System not fully cut over to Matrix. As communicated previously, we would not risk MLS® service interruption to our members during the busy spring market; therefore, we are currently considering a suitable cut-over date later this summer. This assumes the remaining business/ governance issues discussed at the March RAHB AGM are either resolved or are well on their way to being resolved with ORTIS, the company established to manage the regional MLS® System. Because the other STARRS boards (Brantford, Niagara and Simcoe) are scheduled to cut over to Matrix on May 10, listings their members take within RAHB’s trading area will no longer be displayed in Fusion after that date. Therefore, if you are not already doing so, use Matrix for all search activities, and Fusion just to load and edit listings. Note that Fusion listings are automatically uploaded to Matrix every fifteen minutes (but Matrix listings are not downloaded to Fusion), and this parallel period will continue until RAHB fully cuts over to Matrix. To access Matrix, visit http://onregional.ca or click the link from your SSO dashboard. Just remember - even though you can access Matrix through your dashboard, you will still have to sign in with your Matrix user ID and password. Your Matrix user ID is the same as your Fusion user ID with "HB" at the beginning. For additional information about using Matrix, be sure to review past issues of The Shift, which are posted REALTOR Link®, under the MLS® tab. MLS®/technology Your saved searches are moving to Matrix On May 10, 2016, CoreLogic will be performing a large data pull from Fusion which will collectively copy saved searches you have created in Fusion and move them into Matrix. This data pull into Matrix will not automatically activate your saved searches in Matrix – you will have to enable your searches yourself. To enable your searches so they become active and begin sending listings to your clients from Matrix, you need to: Hover your mouse over the “My Matrix” tab and click “Contacts” Click on your contact’s name Click the “Saved Searches” link Click on the “Name” you have given to the search Click on the “Settings” tab Click the link in the top left corner “Turn this Saved Search into an Auto Email”  Enter a subject line for the email  Click “Save”      

You can also watch a video at https://youtu.be/9U5OCoCMQw0 for complete instructions. Once you have enabled a search in Matrix, you will want to disable the search in Fusion. This will ensure your client won’t receive emails from BOTH Fusion and Matrix for the same listings. IMPORTANT – DO NOT DELETE YOUR SEARCHES IN FUSION - ONLY DISABLE THEM. IF YOU DELETE YOUR SEARCH FROM FUSION, IT WILL DELETE THE SAME SEARCH IN MATRIX. To disable your searches in Fusion:  In Fusion, hover your mouse over the “Search” tab and click “Saved Search Manager”  Click on the contact’s name  Under the Search Name that displays on the right hand side of the page, click “Search Settings”  Under the “Settings” tab, uncheck the box beside “Turn on auto-notifications for this search”

This will disable the search in Fusion while still retaining the search criteria.

Important Reminder

Even though RAHB has not fully cut over to Matrix, it is important that you do all your searches – including auto emails - in Matrix, rather than Fusion. Remember, as of May 10, all other associations in the Regional MLS® system will be entering their listings directly into Matrix and data for those listings are not being imported into Fusion. All the listing data from the eight associations participating in the Regional system, including RAHB’s, can be found in Matrix. If you are searching only in Fusion, you do not have access to all the listing data from the other participating associations.

You only need to use Fusion for entering your new listings and listing changes. Should you have any questions, please contact RAHB’s MLS® department at 905.667.4650.

Fill your cart Matrix allows you to put aside listings for review at a later time. When you are viewing a listing you would like to review, click on “Carts” from the “Actions” menu located at the bottom of your screen. You will see a list of carts you can add the listing to. You have one cart for each property type, and one for each client. For the client carts, you can put aside listings that you feel your client may be interested in, but may fall outside of their search criteria. At any time, you can open the client’s cart from your home page (or from the contacts list), and e-mail some (or all) of the listings in the cart. The system will automatically keep track of when you emailed the listing to your client by displaying the date beside the listing or it will read “Never” if you have never emailed the listing to your client.

From the Board Table The Board of Directors met on April 7, and here’s what transpired: was decided that a task force be established to examine strategic options for RAHB over a 2-5+ year time frame. The composition will be determined by the President and CEO.  The recent vacancy created by the resignation of Peter Holgate will be left vacant until the regular election meeting in the fall, given the vacant term is only eight months in length.  The work plans for the Finance Committee and the Governance & Bylaw Committee were approved.  The 2016 Audit Committee was selected.  The Board considered changes to the members-only Facebook group and decided to support the status quo with staff monitoring.  It

Mohawk students earn RAHB scholarships RAHB Outstanding Student scholarships were presented to Mohawk College students Eang Phat (first year) and Justin Sharpe (second year), both pictured with RAHB Past President Bruce Moran. Bruce has represented RAHB on the advisory committee for the Urban Planning Program at Mohawk College for the past 28 years. RAHB awards $1,000 scholarships each year to the first- and second-year Mohawk students with the highest grade point average in the Urban and Regional Planning program.

Scholarship application now available Applications are now being accepted for the 2016 Karan Barker Scholarship. This scholarship is awarded to a student who is or will be attending university or community college and is a child or grandchild of a RAHB member or RAHB employee. The student must demonstrate academic excellence, a high level of involvement in school and/or the community, maturity, initiative and/or strength of character.

Yes, you must cancel that appointment – here’s why The following case study is taken from the Professional Standards files of the REALTORS® Association of Hamilton-Burlington.

Salesperson A contacted ABC Brokerage Realty Inc. to make an appointment to view 123 Anywhere Street. Upon driving by 123 Anywhere Street, the Buyer Clients decided they did not like the location and declined to view the property. Salesperson A did not contact the Listing Brokerage or the Seller to indicate they would not be attending the appointment. The Sellers were extremely upset as they had had to tidy up and get three young children and two dogs out of the house, only to find out that no one showed up for the appointment. They expressed their disappointment and frustration to their Sales Representative that the other Sales Representative acted “unprofessional” and lacked courtesy for not advising they had to cancel the appointment. The Listing Sales Representative filed a complaint with the Professional Standards Committee against Salesperson A. Salesperson A opted for an Abbreviated Hearing for a breach of the REALTORS® Association of Hamilton Burlington Rules and Regulations, Section 8 – Selling Procedures, Sub- Section 8.04 which states: If a Member is unable to keep an appointment, the Member shall: i. where the appointment was made directly with the Listing Brokerage, advise the Listing Brokerage, or if direct contact with the Listing Brokerage is not possible, advise the Seller directly; or ii. where the appointment was made directly with Seller as permitted under these Rules, advise the Seller directly. The Member was assessed $250 Hearing Costs and a $500 fine. Moral of the story: Members are responsible for notifying the Listing Brokerage or Seller if they are not able to keep their appointment. Not cancelling an appointment is not only considered as “unprofessional” by both the consumer and fellow members, but is also a breach of RAHB’s Rules and Regulations, and shows a lack of respect to all parties involved.

OREA News New tutorial on OREA Form 127 OREA’s newest standard forms tutorial is now available online. The tutorial is a step-by-step video guide about how to complete Form 127, Condition(s) In Offer – Acknowledgement. The purpose of Form 127 is to confirm that a buyer understands the risks and ramifications of not inserting certain conditions and/or of waiving certain conditions from an offer. The Form 127 tutorial walks you through the form section-by-section, explaining what and where information is required. OREA’s standard forms tutorials are a new resource created to help you avoid common mistakes and costly errors when you are working with standard forms. Like forms explained documents, the tutorials are a short, practical resource you can use to help them fill out some of the most common forms.
