Now that September has rolled around, we at RAHB are getting ready for a busy fall season, as I am sure you are as well. First on the agenda are Open Forum meetings scheduled for three communities in our market area – Grimsby (September 28), Dunnville (October 4) and Caledonia (October 11). These are informal meetings where you tell us what you would like to talk about, and we will discuss what’s going on at RAHB. RAHB’s Member Engagement Committee is planning and hosting these meetings, and hopes that you will be there to share information and for the opportunity to network with your fellow RAHB members. Look for further details in this issue of REALINFO. You might want to know that I have heard something about door prizes – one more reason to attend!
Professional Development Days are next up, occurring from October 12-14. This is a great opportunity to take courses on topics that will help you both personally and professionally. There is more information about the PD days in this issue of REALINFO. Be sure to register early so you get in on the free registration; the cut-off date is September 23. RAHB’s Annual REALTORS®4Kids Charity Auction is taking place on Thursday, November 17. This is an event that truly shows the charitable spirit of RAHB members, and it’s also an evening of entertainment, friendly rivalry in bidding for amazing auction items, and networking. I have seen some of the live auction items and I can assure you it will be another great event. RAHB’s Annual Election Meeting is coming up on Wednesday, November 30. The election is your opportunity to have a say in how your association is governed. By now, you should have received the first announcement about the upcoming election including the schedule for all activities around nominations, hearing from and meeting the candidates, and voting. You will receive more information in the coming weeks. I hope you will take the opportunity to nominate a candidate as a Director (maybe you!), watch videos made by the candidates, come out and meet the candidates, and vote. And make sure you plan to attend the Annual Election Meeting to hear the results of the election and watch the new Board being sworn in. We have some other business on the agenda as well, so I hope you will be there. The fall is also the time for you to consider who of the REALTORS® you know would be suitable nominees for RAHB’s three service awards – the Award of Merit, Volunteer of the Year and Outstanding Community Service. These awards are all about members recognizing other members for their achievements and service to RAHB, the real estate profession and the community. There is more information about these prestigious awards in the Services Spotlight column of this issue of REALINFO, and you will be hearing more about them in the weeks ahead. A reminder about notifying RAHB of terminations in your office
Brokerages are responsible for notifying RAHB when members in their office resign or otherwise leave. Notice must be received by RAHB within seven business days of the member leaving. If notice is delayed beyond the seven business days, the Brokerage will be assessed a penalty of $50 per incident. (RAHB Bylaw, Article 4, Section 1.02.)

“Coming Soon” to MLS®? Q. Can you put up your sign with a “Coming Soon” sticker when you’ve had a listing agreement signed, but the listing isn’t really in effect yet? A. The short answer is “no”, you cannot use a “Coming Soon” sticker on an MLS® sign. RAHB’s MLS® Rules and Regulations specifically prohibit placing a sign of any sort on a property until the commencement date of the listing:
Article 10 10.05 No marketing of any property, including placing a sign on any property, is permitted until the commencement date of the Listing Agreement pertaining to such property. If you can’t place a sign, you cannot place a “coming soon” sticker – it’s still an advertisement of a property which hasn’t actually come into effect yet.
Q. Are there any circumstances under which you could use a “Coming Soon” sign or sticker? A. RECO has issued guidelines about what is required if you use a “Coming Soon” sticker or sign, but notes that if your association has rules against using “Coming Soon” you have to abide by those rules. You should note, however, that RAHB’s MLS® rules apply to MLS® listings. They do not apply to exclusive listings. If you have an exclusive listing that is “coming soon” and your sign meets all of RECO’s requirements, then you may use “Coming Soon”. If you have any questions about the rules surrounding “Coming Soon” signs or stickers, please contact Angela at 905.529.8101 x233 or angelam@rahb.ca.
New “Pick” in Fusion CoreLogic has added a new “pick” called “Modular Homes” to the Type of Dwelling field in Fusion. You will see it when you enter your Residential or Farm listing. This addition was made to differentiate modular homes from mobile homes. The field will not appear on our current listing form, but is visible in Fusion when you broker load your listing. For those of you searching for modular homes, you will be able to specify this in the Type field. For those of you who have active listings that are modular homes, please edit the Type to indicate “Modular”. If you have auto email set up for clients who are looking for Modular, be sure to edit the search parameters so that they receive this residential or farm house type in their notifications. September

Pre-Emptive (Bully) Offers: Know the Rules! What are pre-emptive offers?
Pre-emptive (or bully) offers come into play when offers are only being considered at a certain date and time at the request of the Seller. The Seller signs a Direction re: No Offer Presentations form and those instructions are included in the Remarks section of the listing (look for phrases along the lines of No offers until (date/time) or No offers until (date/time) but the Seller will review/accept pre-emptive offers). When a listing has instructions noted to hold offers, and a Buyer insists on presenting an offer anyway, that is called a pre-emptive (or bully) offer.

What happens when there’s a pre-emptive offer?
If you are the listing salesperson or broker, according to REBBA 2002 you must follow your Seller’s instructions. [Code of Ethics s.24 Conveying Offers -24.(1) & 24. (4)] If you have written instructions from your Seller for “no offers”, you cannot present any offers, and pre-emptive offers are no exception. If your seller has said “no offers until (date/time)” and then changes his or her mind and wants to review offers prior to the presentation date, or has already instructed you that they will review an offer before the presentation date, then you have an obligation to present the offer. But - and this is important - you must make sure that within a timely manner you follow Article 2, Section 2.15 of RAHB’s MLS® Rules and Regulations:
If your seller changes their mind and wants to review pre-emptive offers, you must make sure that you follow Article 2, Section 2.15 of RAHB’s MLS® Rules and Regulations.

What if I have a buyer that wants to put in a pre-emptive offer?
If you are a salesperson or broker representing a Buyer and he or she insists on writing a pre-emptive offer, you will have to advise them that their offer cannot be immediately presented if the Seller’s instructions are “no offers until (date/time)”. Let them know that the Seller may also change his or her mind, and if/when this happens the REALTOR® representing the Seller will be obligated to inform you, and all other parties that have facilitated showings or have registered offers, that the Seller will now be reviewing offers.

RAHB has four awards that recognize RAHB members who go above and beyond! These awards are truly a recognition by peers, as recipients are chosen by task forces made up of RAHB members. Awards are made only when candidates meet stringent criteria, so they may not be given out every year. The Honorary Life award goes to a RAHB member who: is a recognized leader in the real estate industry has demonstrated exemplary service to organized real estate is a person of positive character, integrity and an advocate for ethical real estate practice has made a positive contribution to the association over a period of no less than ten years exemplifies professionalism in real estate The Volunteer of the Year award is presented to a RAHB committee member who demonstrates exceptional qualities, enthusiasm and perseverance or has gone above and beyond to serve their fellow RAHB members. The funds were raised through events such as the company’s annual charity golf tournament, and Halloween Chili Bowl, and sales representatives’ commission-based donations.
