Musings from Rahb Ceo George O'Neill Established in 1921, the REALTORS® Association of Hamilton-Burlington (RAHB) represents more than 2,900 real estate brokers and salespersons from Hamilton, Burlington, and surrounding areas. Members of the association may use the REALTOR® trademark, which identifies them as real estate professionals who subscribe to a strict code of ethics. The Association operates the local Multiple Listing Service® (MLS®) System and provides ongoing professional education courses for its members. In addition, RAHB is an active participant in the Home Ownership Affordability Partnership (HOAP) and holds an annual auction in support of local charities. The U.S. election is big news right now, and the focus is on which candidate is the right one for the job. The RAHB election might not be on as grand a scale as the U.S. election, but it’s equally important for RAHB members. The question is the same – which candidates are the right ones for the job as Director of the 2017 Board of Directors? What makes a good director? If you have been reading the information being sent out over the past few weeks, you will have seen references to desirable qualities in a director – an experienced REALTOR®, business acumen, strategic thinker, good listener, and so on. The RAHB Board needs directors with varied and diverse skills and experience. No one director will possess all the desirable qualities we’ve been talking about, but every director should have some of the qualities. Why? Because it takes lots of different viewpoints and life experiences to create a strong, effective Board that can make great decisions for the Association and all members.

What’s the commission to the Selling Brokerage? Have you ever seen a Commission to Listing Brokerage that said “1” and left you wondering if that meant $1 or 1%? Wouldn’t it be better for everyone if it was specified if the commission was a dollar amount or a percentage? So that everyone is clear on what the commission to the selling brokerage will be, be sure you indicate in the Commission to Selling Brokerage field whether the amount is a percentage or a dollar amount. That way, everyone will know what to expect.

MLS® Reminder:

Report those sales and leases the right way! Make sure you and your administrative staff report these sales and leases according to the MLS® Policies: 1. Selling Brokerage is a non-RAHB member The Selling Salesperson field should say “NONMEM” and the Selling Comments should have the notation “Sold by (Name of Selling Salesperson) – (Name of Selling Brokerage).” 2. Leases The lease breakdown must be entered on the comment line, in the same unit as the list price. For example, if the list price is $14 per square foot and the lease price is $12 per square foot, the Selling Comments should show the breakdown and total volume for the lease. Example – Leased for 1 year at $12 per square foot per month x 500 square feet = $72,000 Not sure about what the policies are? You can find the MLS® Rules and Regulations and MLS® Policies on REALTOR Link® (under the MLS® tab), in Fusion under the Resources gadget – click on the RAHB Documents link, and in the RAHB section of Matrix Links.

Important changes to MLS® Rules & Policies The Board of Directors recently approved the following changes to the MLS® Rules and Regulations and MLS® Policies: 1. MLS® Rules and Regulations, Section 2, Sub-section 2.15 regarding “no showings until” was amended so that OREA form 244, “Seller’s Direction re: Property/Offers” should be used to document the Seller’s instructions for “no offers until”. 2. MLS® Rules and Regulations, Section 12 – 12.01 Trading Procedures was amended by the deletion of sub-section 12.01 regarding deposits. 3. MLS® Policies – RAHB Members Open House was amended by the deletion of Policy #5 regarding a change of open house hours on a day of a RAHB membership meeting. These changes are effective immediately. The RAHB MLS® Rules and Regulations and MLS® policies are posted in REALTOR Link®.

Government Relations Update A plan for more affordable housing in Hamilton RAHB Past President Donna Bacher and GR Committee chair Nikola Bucalo re-presented the RAHB/HDAA Safe Sustainable Housing Compliance Program (SSHCP) to the City of Hamilton Rental Housing Subcommittee on September 15, 2016. The SSHCP was originally presented to the City of Hamilton as an alternative to rental housing licensing. The Program presents easily-made amendments to Section 19 of the Hamilton Zoning Bylaw which would make it easier for property owners to safely bring their rental accommodation into compliance with zoning bylaws, which would in turn open up more safe, affordable housing in Hamilton. The Subcommittee has taken the report under advisement.

RAHB representatives will soon be meeting with area Members of Parliament at the upcoming PAC Days in Ottawa! REALTORSÂŽ from all over Canada will meet in Ottawa from October 16-18 to discuss REALTORÂŽ issues with MPs. RAHB representatives will meet with the six MPs from the greater Hamilton-Burlington area. Ethics Corner The following article was printed in the September, 2016 issue of OREA’s The Edge. It is reprinted with permission.

RECO DECISION: Lot size error leads to complaint The following decision from RECO Discipline and Appeal Hearings has been condensed. All individual and corporate names have been changed.

THE FACTS Jackie and Mike wanted to sell their property. They were working with Mark, a salesperson with Tops Realty. Mark listed their property on the MLS® System. The lot size in the listing was stated to be 31.99 feet by 119.91 feet. About a month later, Cindy and Bob signed an Agreement of Purchase and Sale (APS) to buy the property. Since the information about the property was obtained from the MLS® listing, the lot size in the APS was also stated to be 31.99 feet by 119.91 feet. After purchasing the home, the buyers discovered that the lot size was smaller than described. They complained to RECO that the lot size was in fact 31.99 feet by 109.91 feet and that they were misled by the MLS® listing and the APS. The couple said they felt they had overpaid for the property. They also included their sales representative, Sally from Witt Realty, in their complaint because she did not check the dimensions of the lot. The buyers provided RECO with a copy of the MLS® listing from May 2006 prepared by Country Real Estate as well as a report by the Municipal Property Assessment Corporation, both of which included the correct property dimensions. Cindy and Bob also provided two MLS® listings for 2012 and one for 2013 -- all with incorrect dimensions -- prepared by Mark of Tops Realty. Mark stated that the 2006 listing stated that the dimensions were 32 feet by 110 feet. He tried to change the numbers to be more precise, matching them with data from GeoWarehouse, a web-based property information site, which showed the dimensions to be 31.99 feet by 109.91 feet. He said that he had made a mistake when entering the numbers and that mistake continued to appear in the subsequent re-listings of the property.

THE FINDINGS The RECO panel determined that Mark acted unprofessionally by failing to verify the correct lot dimensions of the property that he listed for sale on MLS® and in the APS. Mark’s actions also exposed his sellers to possible civil litigation for misrepresenting the property. The panel ruled that Mark breached the following sections of the REBBA 2002 Code of Ethics: (4) Best interests; (5) Conscientious and competent service, etc.; and (38) Error, misrepresentation, fraud etc. Mark’s actions also exposed his sellers to civil litigation for misrepresenting their property.

THE PENALTY

Mark was fined $6,000, payable to RECO. The full decision can be viewed on the RECO web site at www.reco.on.ca. Look under “Complaints and Enforcement” and then under “Regulatory activities and decisions” and scroll down to “Disciplines and appeals decisions.” Scroll down and click on “Search by year.” Select 2014 then “Search.” It is the second case dated 2014/12/01.

When we talk about volunteers at RAHB, we are talking about members – members who make up the various committees and task forces that provide input and insights to the Board of Directors and CEO. We’re also talking about the individual Directors on the Board, because each Director is serving as a volunteer.
