Realinfo

Established in 1921, the REALTORS® Association of Hamilton-Burlington (RAHB) represents more than 3,100 real estate brokers and salespersons from Hamilton, Burlington, and surrounding areas. Members of the association may use the REALTOR® trademark, which identifies them as real estate professionals who subscribe to a strict code of ethics. The Association operates the local Multiple Listing Service® (MLS®) System and provides ongoing professional education courses for its members. In addition, RAHB is an active participant in the Home Ownership Affordability Partnership (HOAP) and holds an annual auction in support of local charities. The address on their account (which comes from their membership records) does not match the address the credit card company has on file, and so their payment is declined.

You can contact one of our corporate services staff, or log in to your Single Sign On (SSO) dashboard at my.rahb.ca, click on “Education/Account Services”, then click on View/Update Personal Information and update your own information.

Musings from RAHB CEO George O'Neill At RAHB we strive to continuously improve everything we do, focused on the three core competency areas of our association: 1) managing an efficient real estate marketplace, 2) providing effective local advocacy and 3) offering the best professional development opportunities for our members.

OREA is taking the lead in discussions with the government and in recommending measures to strengthen the real estate licensing legislation while taking into account how REALTORS® work in their respective marketplaces. Read more about OREA’s recommendations later in this issue.

You may remember that in May of this year, in this column, I talked about how RAHB contributes to the efficient real estate marketplace in Hamilton, Burlington and our outlying areas. The three pieces that work together to provide an efficient marketplace are the MLS® System itself, the rules and regulations for ensuring the system is fair for all, and the discipline process that is invoked if a member works outside the rules.

Local advocacy and government relations have been an important part of RAHB’s place in the community and our service to you. We will be placing greater emphasis on those two roles and looking to place RAHB more firmly as a voice for the real estate community and home ownership. We intend to forge stronger relationships with municipal elected officials and representatives, and continue working closely with OREA and CREA

We have taken this step for several reasons. First of all, we want to be able to provide you with information about issues of importance to you when the information is still current, but without filling your inbox with additional emails from RAHB. Once-a-week communications will have us in touch with you regularly but not too often. We are also concerned about conservation – conservation of paper and staff resources. Printed copies of Realinfo were historically circulated to all member offices, yet recently only a few members indicated an interest in continuing to receive a paper copy. I’m excited we can be in touch more regularly, and you can be kept more up to date on RAHB news. Last but certainly not least … I would like to encourage you to attend one or more of the four community open forums coming up in September. Modernizing REBBA! Did you know that OREA is leading the charge to modernize REBBA 2002, and they want to hear from you? The first phase of the review of REBBA 2002 addressed the Province’s interest in banning double-ending in real estate transactions. The Ontario Real Estate Association (OREA) sent the message to Queen’s Park that REALTORS® are interested in higher standards in the real estate profession and that a complete ban on doubleending would not be productive. OREA’s submission was prepared after consultation with real estate boards and associations across Ontario (RAHB was part of the consultation). Watch for updates on how this plays out legislatively this fall.

Four advertising shortcuts that lead to consumer complaints RECO often gets complaints from consumers about advertisements for the home they have bought or sold. Here are four advertising issues that often upset buyers and sellers. Each one could be a breach of the Code of Ethics if you don’t take proper steps and obtain the necessary consent. 3. Ads that contain info about the buyer or seller

1. Their listing shows up where they didn’t expect it

When brokerages share data, listings often end up captured and advertised by another brokerage through a shared advertising agreement. This can catch consumers by surprise if this isn’t how they thought the brokerage would market their home. If the listing will appear across multiple sites, make sure the seller is aware and they’re okay with it. Fully explain the implications of advertising or promotional clauses in listing agreements, and keep in mind sections 3, 4, and 5 of the Code of Ethics. 2. Ads that include images of the home they just bought

Before the transaction is completed, you only need the seller’s written consent to advertise the property. However, after the deal has closed, the buyer’s consent in writing is also required, even if you’re only placing a simple ad that shows the property as sold. See section 36 (8) of the Code of Ethics.

Even if the owner of the property has consented to advertising their property, they may not want any information about themselves to be included. If you want to include any information about either party of the transaction, you must get written consent from that party. See section 36 (7) of the Code of Ethics. 4. Ads that contain info about the transaction

If your ad will include pricing information, or any other aspects of the deal, you need to obtain written consent from both parties. Even if you’re only advertising that the property sold for over asking, that’s private information that requires their permission. See section 36 (9) of the Code of Ethics.

REMEMBER TO DEAL WITH THE OTHER PARTY VIA THEIR REPRESENTATIVE When obtaining consent from the other party, it’s important to communicate with them via their representative. For example, if you are representing the seller, you must obtain consent from the buyer via their representative, unless the buyer’s brokerage has given you written permission to talk to the buyer directly. See section 7 (1) of the Code of Ethics.

Yes, you must cancel that appointment – here's why Have you had buyers who, when sitting in front of a listed property, decided they no longer wished to see the home? Or have you been running late with your buyers, so you need to cancel a showing? When that happens, do you contact the listing brokerage to cancel? Your answer to that should be an emphatic “Yes!”. If your answer was “No”, or you aren’t sure, take a look at what happened in a Professional Standards complaint heard at RAHB. This is an actual case. A salesperson, “Bob” (not the actual salesperson’s real name), contacted a Listing Brokerage to make an appointment to view their listed property. When Bob and his buyers arrived at the property, the buyers decided they didn’t like the location and didn’t want to even look inside the house, so they moved on to the next house. Bob did not contact the Listing Brokerage or the seller to say they wouldn’t be keeping the appointment. The sellers were extremely upset, as they had tidied up and taken three young children and two dogs out of the house for the appointed time, and then Bob and his buyers didn’t view the house and didn’t have the courtesy to cancel the appointment. The Sellers told their Listing Salesperson they were disappointed and frustrated, and they thought Bob lacked professionalism because he failed to cancel the appointment.

The Listing Salesperson filed a complaint about Bob with RAHB’s Professional Standards Committee. The complaint was based on RAHB’s MLS® Rules and Regulations, Section 8 – Selling Procedures, Sub-section 8.04 that says: If a Member is unable to keep an appointment, the Member shall: i.

Where the appointment was made directly with the Listing Brokerage, advise the Listing Brokerage, or if direct contact with the Listing Brokerage is not possible, advise the Seller directly, or

ii. Where the appointment was made directly with the Seller as permitted under these Rules, advise the Seller directly. After going through the Professional Standards/ Discipline process, Bob was ultimately required to pay a fine of $500 and hearing fee costs of $250.

SUMMING UP: you are responsible for notifying the Listing Brokerage or seller if you aren’t keeping an appointment. Not cancelling an appointment is considered unprofessional by consumers and other members alike, it shows a lack of respect of the seller’s time and efforts, and it is a breach of RAHB’s MLS® Rules and Regulations.
