Members of the association may use the REALTOR® trademark, which identifies them as real estate professionals who subscribe to a strict code of ethics. The Association operates the local Multiple Listing Service® (MLS®) System and provides ongoing professional education courses for its members. In addition, RAHB is an active participant in the Home Ownership Affordability Partnership (HOAP) and holds an annual auction in support of local charities. Musings from RAHB CEO George O'Neill It was one year ago, in my August 2016 Musings column, that I spoke about the decision RAHB’s Board of Directors made to proceed with the upgrade of Fusion to our own Matrix system, instead of cutting over to the regional Matrix system operated by ORTIS. At that time, after a great deal of deliberation, our Board decided it was not reasonable to give up management of our MLS® System to another entity. Even though we did not wish to be part of the regional system business model as it evolved to, our founding goal remained to secure a data sharing agreement with our neighbouring real estate boards and associations, so that all our members could continue to benefit from access to a wider pool of MLS® information. So we embarked on negotiating a data share contract with ORTIS. Here we are, one year later. We now have our own Matrix 7.0 MLS® System in place and in preview mode and ready to launch within a number of weeks. But as I write this, appropriate control of MLS® data is still being resolved as we work to finalize a data sharing agreement with ORTIS. On July 19, RAHB President Lou Piriano and I sent an update to each full RAHB member, explaining our current situation; a copy of the letter is reprinted later in this issue. In a nutshell, we made concessions on eight of the last ten areas we were concerned about with respect to ORTIS’s most recent version of the data sharing contract. Compromise is often required to move things forward, and your Board was willing to make concessions to give you, our members, access to the regional MLS® data you want. However, our Board was unable to compromise on two fundamental issues: the control of the distribution of your listing information and reciprocity of data access. We thought these issues had been worked out with ORTIS earlier in the year, but they were subsequently deleted from the contract proposed by ORTIS. RAHB’s business lawyer has amended the contract to include the two items previously agreed upon, and ORTIS has a copy of the amended agreement. It is our hope the ORTIS board will bring negotiations to an end by signing the agreement and giving members

of all the boards and associations what they want – that is, region-wide listing information. This has been a long and rocky journey to bring you a wide range of MLS® information so you can better serve your clients and customers. Through it all, your Board of Directors has acted with integrity and always with the best interests of you in mind. To each of you I’d like to say, thank you for your patience, thank you for your understanding, and thank you for being a member of RAHB. On August 1, we are launching a weekly E-newsletter, NewsReal, especially for breaking news about our discussions with ORTIS, and our progress towards Matrix. It will be emailed to you every Tuesday throughout the remainder of this summer and fall. Please be sure to check your email, and don’t hesitate to contact me directly if you have questions or comments. We have also tentatively planned a general meeting for August 22 at 9 a.m. We’ll hold it if ORTIS and data sharing issues are still outstanding at that time. For now, please put it in your calendar. We’ll confirm it closer to the date. ***** There are two new events coming up this fall that I’d like to bring to your attention. The first is RAHB’s ProDev+ professional development event on Thursday, October 12 at the Holiday Inn Burlington. This is an upgrade on Professional Development Days and will give you the opportunity to spend a day becoming more informed about current topics in real estate. It’s also a great chance to socialize with your colleagues in the courses, at the trade show and at the wind-up Signature+ cocktail mixer. Check out the information about ProDev+ later in this issue. The other event is the Real Estate Outlook on Wednesday, November 8 at Liuna Station. This is a joint venture by CMHC and RAHB, and will include a presentation by a CMHC market analyst and feature a panel of experts who will help you navigate the current local marketplace. Real Estate Outlook will also offer great networking opportunities. There is more information about the event in this issue of Realinfo. Regards,

In medium bowl, mix frosting and peppermint extract. Spoon about 1 cup frosting into decorating bag fitted with 1/8- to 1/4-inch tip. Insert tip into center of 1 cupcake, about halfway down. REALTORS® rev up for charity On Wednesday, July 5, 2017 REALTORS® from across Ontario gathered at the RAHB office to kick off a 200+km journey to Sarnia to raise funds for shelter-related charities across the province.

“You definitely get a lot of looks when 40+ REALTORS® ride together on their motorcycles!”

RAHB presented a $36,000 donation cheque to the REALTORS Care® Foundation and an additional $ 500 donation in support of the nine RAHB members who participated in the ride.

The riders were joined by two special guests: Tim Hudak (OREA CEO) and Ted McMeekin (MPP, Ancaster-Dundas-Flamborough-Westdale) who gave opening remarks and pumped up the riders before they set off on their journey. This year’s ride broke a record as having the highest number of participants in event history: 47! “You definitely get a lot of looks when 40+ REALTORS® ride together on their motorcycles,” joked RAHB Member, Jamie Edwards. “But it’s so fulfilling to have such a wonderful group of likeminded professionals unite with the common goal of giving back to the community.” Other stops along the way included the Brantford Regional Real Estate Association, the KitchenerWaterloo Association of REALTORS®, the REALTORS® Association of Grey Bruce Owen Sound, and the Huron Perth Association of REALTORS®.

RAHB Charity Golf Tournament update – the final tally is in! Two local women’s shelters – Halton Women’s Place of Burlington and Interval House of Hamilton – shared the proceeds from RAHB’s annual charity golf tournament held May 18, 2017. The final tally came in at $7,022, with $3,511 going to each organization.

Update on data share contract with ORTIS The following letter was sent to all members of July 19, 2017. Dear Member: Yesterday [July 18, 2017] afternoon, RAHB’s Board of Directors met to review in detail the latest draft of the data share contract provided by ORTIS. Although there are ten areas we still have concerns with, in the spirit of cooperation to get the contract in place, we are ready to accept eight as-is, leaving only two outstanding items we cannot accept. These last two items were already previously agreed to by both RAHB and ORTIS but were deleted by ORTIS in their latest draft. The two items deal with control of the distribution of data and reciprocity of data access. Data is a critical asset for brokerages and members, and proper distribution and control are vital to ensuring the continued success of our REALTORS®. It is unfortunate these last two items were removed, as RAHB was prepared to sign the contract yesterday. Therefore, this week RAHB’s lawyer will write the two deleted items back into the contract, and will seek agreement from ORTIS, which would result in a signed contract. RAHB will also ask ORTIS to not shut off the current data feed, as we understand they plan to do on August 15, 2017, so that CoreLogic would have the 6-8 weeks they need to complete the new data transfer program between RAHB’s Matrix system and the regional system. In this event, RAHB will re-schedule our Matrix go-live date so you will continue to have uninterrupted access to all RAHB and regional listings. Should ORTIS not agree to reinstate the two outstanding items, and in order to provide you as much notice as possible, RAHB will schedule a Members Meeting to be held in August. At that time you can address any questions directly to us and to your Board of Directors since we fully appreciate there has been much uncertainty about the data share. However, until the completion of negotiations, or preferably until the contract is signed, your Board of Directors is not in a position to speak in as much detail as you perhaps would prefer. We do not think it is appropriate to negotiate business contracts in public or to share drafts on social media sites. An update will be provided again next week as to the status of the data share contract at that time. Multiple representation consultation paper Recently the Ministry of Government & Consumer Services (MGCS) issued a consultation paper proposing three major changes to the Real Estate & Business Brokers Act: 1. 2. 3.

Establishing a new mandatory designated representation requirement with limited exceptions; Requiring that mandatory standardized disclosure clauses be used; and Increasing the maximum fine for Code of Ethics violations from $25,000 to $50,000 for individual salespersons and brokers and $100,000 for brokerages.

OUTLOOK 2018 The potential measures being considered in this first phase of the review of REBBA 2002 are intended to:  Increase consumer confidence by minimizing the conflict of interest involved in multiple representation situations;  Make it easier for consumers to better understand the nature of the agreements they are entering; and 8, 2017 November  Strengthen consumer protection by modernizing the penalties for unethical behavior for contraventions of the Code of Ethics.

REAL ESTATE

The consultation is the first phase of the government commitment to review REBBA 2002. The second phase will review all other aspects of the Act and extend into 2018. The focus on multiple representation is in response to negative media coverage (CBC Marketplace) which occurred late in 2016.

OUTLOOK 2018

RAHB has submitted comments to OREA which is in the process of formulating a response on behalf of Ontario REALTORS®. This response will be made available to members.
