‘Right to road’ is a basic obligation
A
nyone passing through Somasundrapalya Road from HSR Layout will come face to face with official apathy and civic nuisance. The road at the junction of Rockview apartments is a mess. There are courier vans, school buses and Uber drivers adding to the chaos. With no proper civic amenities, water lines and sewage drains, it’s an urban nightmare. To add to the chaos, there is the allegation that Sobha Daffodil has encroached a previously existing village road to build its 9.6-acre property. Even the latest Comprehensive Development Plan of the BDA shows the road cutting through the Sobha property. The Sobha residents say that the CDP is for new roads. What about the Haralakunte village map that shows that the road existed before they came into the picture? When Residents Watch investigated the issue and went through the documents from both sides, it was clear that the BBMP and BDA played foul. Without going through proper procedures, the BDA had given away government property (B Kharab land) to Sobha when the government land actually belonged to the Revenue department. However, based on complaints from the residents, the BDA examined the issue and asked the BBMP to demolish the compound wall in June 2016. It couldn’t have done this if the wall was legal. The High Court order number of March 2014 that is quoted along with the ‘Private Property: No Trespassing’ signboard on both sides of Sobha Daffodil is outdated. Two years ago, the High Court only prevented the BBMP from demolishing the compound wall by saying that Sobha’s version should be heard before BBMP court arrives at a decision. In November 2014, the BBMP Zonal Court clearly said the complainants can approach the concerned authorities (which is the BDA in this case) and get a road sanctioned and built. By saying this, the case was dismissed. Now, both the BDA and BBMP have to act on this judgement. The revenue department has to re-survey the Sobha land, take over the government property, use it for public utilities and punish the encroachers if they are found guilty of it. NEIGHBOURHOOD NEWS BMTC BUS STOPS
According to the Federation of HSR Layout Residents Welfare Associations, HSR Layout has had a long wait of over 15 years to set up bus stops officially. And it happened last month with the setting up of 23 bus stop boards across the neighbourhood. “This will simplify the process of identifying where buses are likely to halt for alighting or boarding the buses,” says Dr L Ravindran, secretary, HSR Federation. “Currently 18 routes are operational and therefore it is felt that we are likely to see betterment in transport connectivity. These boards have been sponsored by NH, HSR Layout.”
HSR 10K FREEDOM RUN
HSR’s Kaagaz Foundation, an NGO, is organising the 4th Edition of HSR 10K Freedom Run on August 15, 2016. There are twin objectives to this charitable drive: awareness and campaign for a greener and healthier Bangalore. HAWKERS CANNOT ENCROACH FOOTPATHS: HC In April this year, the Karnataka High Court has ordered that hawkers cannot erect temporary or permanent structures on the footpath. The decks are now cleared for a major long-pending drive in HSR by the MLA and BBMP Joint Commissioner. The issue of food trucks need to be resolved too as HSR corporator Gurumurthy Reddy is alleged to have had his supporters beat up one such food truck owner recently on 27th Main Road opposite Juice Junction. After garbage segregation and plastic ban, it’s now the turn of footpath evacuation drive.

In the next three months, 10 e-toilets at a cost of Rs 20 lakh are to be set up in HSR over the next three months. “With rapid decline in open areas, it is mandatory that these utilities are put up in places with maximum public movements in areas that are

Encroachments by commercial establishments aside, the residents are equally to blame. One Sector 1 sector resident points out a case of about 6 ft. road encroached by a house owner on 31st Main, 7th Cross to construct a fully cemented car ramp. In addition, the house owner has taken over the entire road by erecting a structure and planting plants and parking all his vehicles across the 10x30 ft dead-end road. “The neighbours are inconvenienced because all the vehicles coming to his house, park in front of their house as there is no space left in front of the owner’s house,” says aggrieved resident Kavitha Reddy. “It’s a visual mess.” A similar case is on show at house number 308 on 14th Cross, 8th Main, Sector 6. “The owner has encroached about 5-7 ft. at this junction. The 14th Cross Road gets reduced to 31 ft. from 40ft, making it a bottleneck at this junction,” says Maj (retd) Nagthan. “A written complaint was made to BBMP, but no response so far. If such apathetic, complacent and indifferent attitude continues by BBMP towards such serious civic issues, everyone will soon resort to encroachment and there will be total chaos.” Will the
MLA and BBMP act on these law breakers, please? Another request from the residents to the BBMP. “When BBMP is removing encroachments, don’t give away the name or contact number of the person who raised the complaint as they make life hell for them,” says Kavitha Reddy.
VIDEO TUTORING
Recently, Hasiru Mithra conducted a unique waste segregation awareness program at Agara temple with videos. They even interviewed the visitors to the wedding in progress. However, a few days later, on one of the festival days, resident Kamesh Rastogi was pained to see plastic glasses strewn all over the footpath in front of Airtel store on 24th Main. “There is no class among the educated folks,” he says. “When I asked one lady, she said what’s my problem and why does it bother me.” This incident was not just confined to HSR but was seen across Bangalore. Says another resident Lakshmi S: “I found photos of gods thrown around the trees with the garbage. I am an atheist but I respect enough that I won’t throw pictures for dogs and pigs to pee on.” What’s more, a few residents have seen pictures of gods being burnt by people instead of keeping them in their houses.

A coconut vendor on HSR Club Road did not have a straw to give us because of the plastic ban. We had to drink straight from the coconut, and put up with water dripping down the chin. Similarly, when residents went for lunch at Kohinoor Restaurant on 27th Main, no straw was given for lassi because of the ban. The ban is working. We wish it works at the many eateries around the Yeshwantpur railway station area where plastic bags are still being given out when you parcel food.
ANOTHER CIVIC AMENITY SITE GOES AWAY
Residents were up in arms when the land near Cambridge School was being used to construct a wedding hall. But some fact digging showed that the civic amenity land was allotted as per the BDA master plan and yet the Sector 1 resident welfare association didn’t do anything about it. Plans for a political protest also fell through because it should have been opposed earlier. “The resident associations should have gone to BDA and asked them to give the allottee, an alternative site,” says resident Kavitha Reddy. “It’s not land-gobbling but inefficiency of our own people who knew many years ago that it was allotted. Even if it’s taken to court, it will be dismissed in favour of the allottee.”
BBMP CIRCULAR TO TEMPLES
Last April, BBMP Joint Commissioner Muniraju issued a circular to all the temples in Bommanahalli, not to use plastic and instead use banana leaves, steel cups and steel glasses. Health inspector Mahesh was on rounds to all the temples to fine those who didn’t abide by the rules. Going forward, if residents find any violation during upcoming festivals, they can call him up and complain – you can make a difference by reporting on ground.
THEFT NEAR POLICE STATION
Recently, the JP Collections showroom on 27th Main was broken into by thieves who took cash from inside the drawer and vanished in no time. The store is just 100 meters from the police station. The same night, Baby Outlet on 24th Main was also a victim. There was not much action taken by the HSR police. Perhaps, the traders should install CCTV across this
thoroughfare to protect their goods.
COMPLAIN ABOUT BLACK SPOT AND BBMP BURNS GARBAGE
BBMP is finding an easier way to dispose mixed waste dumped at garbage black spots in HSR Layout. It’s burning them every time a resident complains. That can be done by the residents themselves. Why do they need to complain then? “When BBMP sees environmental damage in controlled scientific incinerating, how is burning of garbage out in open, not an environmental disaster?” asks resident Kavitha Reddy, who has stopped complaining about the heaps of garbage on the BBMP Sahaya website because “all that BBMP does is burn it’. “This damage to environment and the trees around is absolutely not acceptable. BBMP has to come up with a real solution for mixed waste. Else, daily damage to the environment and particularly air, will never end.”

The residents of Sector 4 teamed up recently to take back the land meant for a Bal Bhavan but encroached by a temple. Not that the temple is demolished; but it occupies a small part of the land originally meant for children’s amusement.
HSR TO GET 23 CYCLE STANDS
The fencing of the park next to Lawrence School on 9th Main Road is broken at four places. According to resident Ramesh Chandra, it could be the handiwork of the boys playing cricket and football. “These people have spoiled the plants and tree guards that we had installed with great difficulty. We have complained many times to both the BBMP and the elected representatives, but no response so far. There is no watchman either.” We urge the BBMP to repair the broken fencing and provide for a watchman shed and get someone to monitor the park round-the-clock.

Twenty three cycle stands are said to come up in HSR shortly. They are being fully funded by CSR (Corporate Social Responsibility) wings of various companies. “We won the contest after four rounds of interviews,” says Shashidhara, the founder of HSR Cyclists Club. “Out of 130 projects proposed by various citizens across Bangalore, HSR is the only layout getting these cycle stands.”
SHOPKEEPERS HAPPY WITH PLASTIC BAN
Dr Shanthi Tummala says Safa department store at BDA Complex is saving more than Rs 1 lakh a month by not buying plastic bags. “The shopowner admitted that he was not supportive at first but now that he sees the benefits, he is committed,” she says. “Similarly, the proprietor of Sobha Supermarket is saving Rs 45,000 to 50,000 every month.”

otholes are everywhere but the BBMP says there are hardly about 500 of them across Bangalore. Perhaps, that’s their way of excusing themselves. The truth is that every other road has more than one road cutting to lay sanitary and water lines. The result? A horizontal pothole. If just these road cuttings are taken into account, imagine the number of potholes dotting the city? And what about the mess caused by GAIL while laying the gas pipeline? HSR is suffering from exactly these and more issues. Such is the apathy and total disregard to potholes that complaints made online are closed without addressing the problem. In such a dismal scenario, Hasiru Mithra residents of HSR Layout, came up with an innovative plan to highlight their pothole woes. Started in July, they have already conducted four poojas at different spots in HSR and gained traction both in print, on radio and electronic media. The BBMP has fixed all the potholes highlighted, but the work has been patchy all through. What else can you expect from BBMP? But what’s the pooja for? “We pray to the pothole that ResidentsWATCH - HSR Layout

Patchy work by BBMP after Pooje it does not kill us and thereby mock the administration,” says Kavitha Reddy who came up with the idea. “We will continue to do innovative stuff to bring the pothole issue to the attention of authorities.” We suggest that they should circle the potholes with a bright colour that can stand out at night to prevent vehicle users from falling into it. And instead of one pothole at a time, they can pothole-hop to about one pothole per sector to highlight the problem.

BBMP fails to act despite BDA writing to them; residents suffer

all it official apathy or abject negligence by officials and the elected representatives, the access road issue involving Sobha Daffodil apartment complex in Somasundrapalya reached epic proportions last month when over 3000 residents gathered near Ravindra Bharathi School and alleged Sobha had blatantly encroached a previously-existing village road. Interestingly, both the MLAs of the adjoining areas failed to turn up for the protest: Arvind Limbavali and Satish Reddy.

“The CDP shows the road and so does the village map by the revenue department,� says Ramakrishna Reddy, the president of HaralurSomasunderpalya Residents Federation. But Sobha refused to budge from their stand that they have not done anything illegal. However, papers accessed by Residents Watch show that the BDA has written two letters dated 17/12/2015 and 10/6/2016 that clearly instruct the BBMP to demolish the compound wall. But BBMP is doing nothing about it. Several points were raised by the federation on protest day (July 23, 2016) and we asked Prince Thomas, the secretary of Sobha Daffodil Residents ResidentsWATCH - HSR Layout
Welfare Association to respond. And here is what he had to say‌ As per DC’s land conversion order in Survey no 27 and 29/5 of Haralukunte village, the total land is 9 acres 39 guntas, out of which 21 guntas is government land (B Kharab). In both the survey numbers, the B Kharab is shown as footpath roads (21 guntas) as per the Haralukunte village map. And by law, the B Kharab land cannot be converted and should be used only for public purpose. The kharab land is encroached and an unauthorised building is constructed over it by the builder of Sobha Daffodil. Prince Thomas: As per the conversion records and RTCs that we have in our possession, no piece of land in Sobha Daffodil property is classified as B Kharab. The same can be verified by anyone accessing the RTCs and Mutation Records from bhoomi. karnataka.gov.in website for the above survey numbers. In 2005-06, BDA sanctioned Sobha Daffodils apartment plan with certain conditions. One condition clearly says that whatever road is earmarked and shown on the map shall be given to the BDA without any cost. The building approval that Sobha Ltd has obtained from BDA, has a clause stating that

the approval is subjected to Sobha Ltd ceding a portion of their land for building road access. This has been incorrectly interpreted by the various parties as referring to a road cutting across the property. This is a complete misrepresentation of facts. This clause in fact refers to the area in front of the estate, near the main gate. This land has in fact been already relinquished by Sobha Ltd to BBMP to provide connectivity to adjacent apartments. The copy of the relinquishment deed can be found at Sobhadaffodil.in website. The Occupancy Certificate issued by BDA certifies that all conditions were met. As part of the approved plan by BDA, the Sobha developer itself has clearly shown and marked as road on both sides of their compound wall under the High Tension line. In the approved plan, HT line is clearly marked as HT line and access road has been clearly marked as access road. The lines showing the HT line is being incorrectly misunderstood and misrepresented as an access road. The access road August 2016 |19

on either side is meant for access to neighbouring plots and school. It may also be noted that Sobha Ltd owns few (around 30x40 sq. ft.) plots on the access road leading to Daffodil. In the CDP 2015 map, the authorities have clearly shown 24.00 Metres wide road under the HT line. CDP is meant for new roads, not for encroached roads. Dated 4/3/2014, joint commissioner Bommanahalli issued a notice to Sobha which clearly mentions that there is a CDP road connecting HSR 27th main with Harlur road. As per the joint commissioner’s inspection dated 01-03-2014, it was found that an illegal compound has been constructed. The said compound should be immediately demolished, according to the KMC Act.

There was a complaint made by Royal Placid Residency Welfare Association to BBMP and an order was issued to demolish the alleged encroachment without giving an opportunity to Sobha Ltd or the residents of Sobha Daffodil to represent their case. Copy of the original order in Kannada and the translation in English is available at the Sobhadaffodil.in website. Residents of Sobha Daffodil approached the Honourable Karnataka High Court to seek relief in this matter. The Honourable High Court heard the matter and instructed the Joint Commissioner BBMP to desist from any demolition without hearing the aggrieved party (the residents of Sobha Daffodil). the matter in the BBMP Zonal Court has upheld and confirmed that all pieces and parcels of the land was legally transferred by BDA to Sobha Ltd. and has not found any evidence of encroachment in this regard. A copy of the English translation of the BBMP Zonal Court order and the original order in Kannada is available at the Sobhadaffodil. in website. The residents of Sobha Daffodil are confusing the general public about the Karnataka High court order W.P No.12503/2014 dated 14/3/2014, which has actually given a direction to the BBMP authorities to give an opportunity and hear the grievances of the general public. The joint commissioner of the then Bommanahalli BBMP conducted the proceedings for almost 8 months and gave his final verdict on 15.11.2014 where he clearly states there is a proposed road to be formed as per CDP 2015 map, but he has no jurisdiction to act and hence asked public to approach the BDA for further action. A copy of the English translation of the BBMP Zonal Court order and the original order in Kannada is available at the Sobhadaffodil.in website. There is no stay order or any court verdict as claimed by Sobha Residents Association. The court had initially deferred the case to BBMP court and after the BBMP hearing, the court closed the case as BBMP lawyers did not appear for the Court hearings. A copy of the English translation of the BBMP Zonal Court order and the original order in Kannada is available at the Sobhadaffodil.in website. Dated: 7/3/2015 and 30/05/2015, MLA Arvind Limbavali visited the area and scrutinised the road blocked by the Sobha compound, and directed the BBMP/BDA officials to act and break down the compound wall that has blocked the main connecting road. We were not a party to this; hence, we can’t comment on this. We are sure, Mr Limbavali is a renowned public figure, and he would always ensure law abiding citizens of Daffodil are not put into distress. On 17.12.2015, A.E.E No.2 East Sub Division BDA commercial complex, HSR Layout, Bangalore wrote a letter to AEE, BBMP, Bommanahalli requesting them to take the necessary action since HSR layout was transferred to BBMP ResidentsWATCH - HSR Layout
jurisdiction. Not in a position to comment on internal communication between departments without knowing the intent or rationale. Haralur, Somasunderpalya Federation members, met the chief engineer BDA and requested him to take up the demolition of the compound wall since the surrounding citizens were facing lots of hardships in commuting to HSR and other surrounding places. Later, technical assistant HC Ramiandra wrote a D.O letter to BDA executive engineer Veersingh Naiak to take up the demolition of the unauthorised compound wall with the help of the BBMP officials and the action taken shall be intimated to his office. Not in a position to comment on internal communication between departments without knowing the intent or rationale.
Residents Blame The BDA For The Mess
Ramakrishna Reddy of the Federation had this to say: “Any layout of 5 acres and above needs approval from the Bangalore town planning authority and Sobha’s is 9+ acre layout and yet it did not happen in this case. Sobha got approval only from BDA engineering division that is authorised to approve below 5 acres. Any layout that is 5 acres and above should leave space for public utilities, but no such thing was done at Sobha Daffodil.” Residents allege that the BDA failed to check the government land before approving the Sobha project. “They did not ask for the revenue department for clarification,” says Reddy. “BDA has no authority to assign the government land. BDA has failed in relinquishing all the roads passing through Sobha as per the approval document and issued Occupancy Certificate overlooking this. The revenue department is the custodian of the government land. Sobha residents can invite for a re-survey of the land to prove that they are clean. It is time the BDA, BBMP, revenue department and BMTF together conduct a survey of the land and act as per norms. If found wrong, they should impose a stiff fine on the builder and Sobha residents, cancel their Occupancy Certificate and take back all the basic facilities provided to them.”

ver since MLA Satish Reddy and MP Kupendra Reddy took the onus of reviving the lake, nothing much has moved except the cleaning of the lake periphery. The detailed project plan by BBMP is hanging fire. The BBMP joint commissioner is mum on the issue and so is the MLA. Upset with the political and official apathy, the KHHSP Residents Welfare Association has written to KB Koliwad, the chairman of the Legislative Assembly Committee on lakes. Currently under the jurisdiction of the Bangalore Development Authority (BDA), the Somasundrapalya Lake (also known as Haralur Lake) is located at the end of 24th Main in Sector 2 in Bommanahalli assembly constituency. Key issues highlighted by the memorandum • The lake originally spread over 16 acres 29 guntas, lost 3 acres to encroachment in the last few years. While some encroachments have been removed, the one by the Karnataka Compost Development Corporation (KCDC) remains to be cleared. • The broken fencing and complete neglect by BDA has resulted in debris dumping, excess growth of weeds, entry of raw sewage and effluents into the lake. It is neither good for a walk or recreation. • The leachate flowing into the lake from KCDC is adding to the already-polluted lake. • This lake is connected to nine lakes around the Varthur vicinity, and receives a good amount of rain water. It can retain and recharge the ground water tables, but neglect and blockage of inlets has resulted in much less water entering the lake. In September 2013, when chief minister Siddaramaiah visited Agara Lake, he had instructed the BDA to re-survey Somasundrapalya Lake, and directed BBMP Commissioner to take the necessary steps to remove encroachments and revive it. Pavement and open space encroachments are rampant in HSR By our feature writer

e asked residents and went around ourselves to catch commercial encroachers in HSR Layout. Here are some flagged by the residents. We urge the BBMP Joint Commissioner (Bommanahalli) and the MLA to take action on them immediately. Enough waiting. It’s time for swift action now. Auto Spa, HSR BDA Complex signal, Sector 4: They have covered the footpath with a ramp and stairs. They have also illegally installed their DG set on the footpath. They have created a separation on the footpath by creating a small block near the DG to make it appear like it’s their area. Maghai Pan shop on the footpath of 17th Cross, Sector 3: Need we say more? The Mughals, 17th Cross, Sector 3: We have been highlighting this illegal encroachment on footpath for more than two years now but no response from BBMP. BBMP grounds, 17th Cross, Sector 3: The BDA is yet to hand over a portion of the land to BBMP that is home to iron and steel shops.
