ompleting four years of consistently bringing out Residents Watch every month is no small potatoes. But we have done it and are now on to our fifth year. Thank you, dear readers and advertisers, for making this happen. Much has been accomplished and much more needs to be done by Residents Watch. But we are happy with the progress we have made. It has clearly laid out a road map for all of us to follow. Be proactive, be responsible and be righteous, and much can be achieved. In November 2012, when we began publishing Residents Watch, the market was still nascent. There weren’t as many shops as there are now. Vacant plots were all over the place. Landlords were shying away from building anything. The traffic jams within HSR and Outer Ring Road were unheard of. Today, it’s hard to find a parking spot on 27th Main Road. The jam at the BDA flyover sometimes takes almost half an hour. Commercialisation is turning many homes into offices and apartment complexes. Many illegalities are cropping up every day. It’s the herd mentality in action. If one landlord breaks the law, the others in the vicinity follow suit. If the government takes a stand against such illegal constructions tomorrow, all these buildings will face the axe. So beware, dear reader. Follow the law first before you can accuse the others of not following it. Be the example you want to see in the world. Don’t make a mockery of the law. The law is there for a reason. Imagine what senseless building deviations might do. For one, the building might fall and kill innocent people, like it happened in Bellandur recently. Two, the parking problem will upset the neighbours and the road users. The garbage generated from each building will be higher and soon, you might have to pay more for garbage collection because you will be termed a bulk generator (if there are many apartments in your building). It’s difficult to convince one neighbour and now you will have so many of them. The noise pollution will be much higher from that same 20x30 sq. ft. area that is generally home to three households but is now housing seven. NEIGHBOURHOOD NEWS CyCle day Continues to attraCt residents The monthly fitness ritual started by HSR Layout residents continues to attract fitness enthusiasts. From yoga practice to tree planting, the children and adults are having fun at the same time. The next time, you want to cycle away to glory, just find yourself on the other side of 19th Main, opposite Aishwarya Supermarket. It’s on from 6.30am to 10.30am on the last Sunday of every month. Cycle Day is anchored by the Bangalore Coalition for Open Streets (BCOS), a non-profit collective comprising of the Directorate of Urban Land Transport, Praja RAAG, EMBARQ India, ESAF and individual citizens. Their mission is to ‘transform Bangalore through cycling and open streets, creating active communities, connected citizens and happy neighbourhoods’.

A sewage treatment plant for HSR has been ruled by the courts, thanks to a handful of residents asking for it. This was despite the opposition from a majority of residents that led to the shifting of the plant from Agara Lake. Here is a ready-reckoner on how HSR was thrust with an STP. According to Kavitha Reddy, the vice president of Agara Lake Protection Society, an STP was never a demand from their association. “It was opposed democratically and technically. A few vested interests went to HSR Federation, bypassing the Agara Lake team’s decision,” she says. “Initially, only 1 MLD plant was proposed by the BWSSB. But since a few people went to court, they took advantage of it and made it 35 MLD. The evaporation per day in the lake is less than 1 MLD, so you can guess what the rest of the 34 MLD is meant for? We did not oppose the STP once we were told that the STP will not come up on the wetlands. Otherwise, our plan was to go to court to save the heart of the lake, which is the wetlands. Today, with a 35 MLD plant, it will be a mini KCDC given the current state of STPs across the city. Also, people went to court asking for a 1 MLD tertiary treatment plant, but they have now got a 35 MLD secondary treatment plant. Our objections on STP was restricted to wetlands, but a 35 MLD STP in a residential area is no good either.”

We have to fight commercialisation and save our locality, and Bangalore Mirror did a good job of it recently by dedicating space for it. We urge the paper to continue to do it as a series on different neighbourhoods of Bangalore and make the corrupt authorities and businessmen suffer for it. “There is rampant commercial activity around HSR Layout,” says resident Fazal Khalil. “Not to mention, the attitude of the people who have scant respect for the building bylaws and the ‘might is right attitude’. Less said the better about the officials who grant permissions.”
Hsr: seCond most user of Cauvery water
According to a 2015 report by the BWSSB, HSR Layout is the second highest water consuming locality in Bangalore. That’s 36.2 crore litres per month. HSR is also one of the top ten metered layouts in the city. And we are not even talking about the water consumed by borewells in apartments. “We have to save every drop of water,” says resident Shashidhara K. “We have an equal responsibility.” Right, indeed. To begin with, stop washing your cars and porticos with water. Just wet the cloth and apply it on any surface. It should be just as clean. Don’t just save water in the summer. Save it in the winter, so you don’t suffer in the summer since it becomes a habit. We know of apartments rationing water during the summer; but we think it should be all the year round. Only then, will saving water become a habit.

Resident Smita Kulkarni informs all the residents who are into composting their wet waste to get the composting bricks (cocopeat with microbes) from Safa supermarket in BDA complex. “Kindly refer them when you do swachagraha workshop in and around HSR,” she says. SAFEGUARD THE HEALTH OF YOUR HOUSEKEEPING STAFF
Resident Lalithamba requests all residents to guide their maids and house-keeping staff to enrol their family under the government-run medical insurance scheme called ‘ eshaswini Cooperative Farmers Healthcare Scheme’. More details can be found here www.yeshasvini.kar.nic.in about. htm. Towards this end, an awareness session was conducted recently by her apartment association at Aakruthi Silverline. According to the scheme, one person from the family should pay a one-time fee of Rs 50 and become a member. Every family member will have to pay Rs 300 per year. Once they do this, they are covered under medical insurance for Rs 3 lakh. The age limit is 0. Every year, the enrolment commences from July and ends by October. HOARDINGS MENACE CONTINUES
Every time there is a new shop opening, hoardings come up at all the prominent corners of HSR Layout with pictures of the MLA, MP, or corporator. They are all illegal and don’t carry the permission of the BBMP. If you, dear reader, see this anywhere in your neighbourhood, you can dismantle them without fear or favour. Nobody can do anything to you because they are illegal in the first place. We also request the MLA, MP and corporator to warn their supporters from making a mess of the neighbourhood by using their pictures. “The elected representatives should end this senseless ex and banner politics and give firm warning to their followers,” says Kamesh Rastogi who was part of the ‘kill bill’ campaign that caught the imagination of people across the city. So much so, that it became the catchline for a citywide campaign against billboards and hoardings.
NOISE POLLUTION
Auto, cab and two-wheeler drivers honk too much. “They are risking others in addition to themselves,” says resident Kamesh Rastogi. “The Times of India declared ‘No honking day’ on August 22 and a series of noise analysis were published.” Dr Shanthi T says anyone caught honking should be fined prohibitively. “Only then will people use them only when really needed,” she says. We have noticed many two wheelers honking indiscriminately in HSR Layout. And they use modified silencers to mimic the four wheelers. We urge the traffic police to conduct periodic drives to nab errant honkers in residential areas that’s the only way to educate and bring down the noise pollution. “The majority of water tankers have extremely powerful air horns,” says resident RS Hiremath.

ROADS GET TARRED… FINALLY
After intense pressure from the residents, the BBMP finally woke up. Many roads in HSR Layout are now sporting black-topped roads. Even the neighbouring Somasunderpalya now has better roads on some stretches. We thank the residents and BBMP officials, particularly engineer inayak, for making this happen.
SAFETY ALERT
The next time you give away any self-endorsed xerox copies of address and ID proofs while applying for a new SIM, Pan card, updating K C in the bank and so on, don’t just sign those documents and hand over. Just imagine your self-certified copies are freely available in the hands of unknown people and those documents can be used by them for anything. It’s serious and was known to be employed in terrorist activities where the K C documents are sourced from SIM card dealers. Therefore, make a habit of writing the date and purpose for which you are submitting the self-certified K C documents so that those documents cannot be used for any other purpose.

Bethany Junior School has come up on 14th Cross in Sector . How can the BBMP grant permission for a commercial entity in a thickly populated residential area? Having come up on a 40ft x 5 ft area, the residents are under constant stress. “We are facing a perennial problem of vehicular movement besides pedestrians being put to risk,” says resident Nagthan. “The school has obtained a temporary injunction, making the neighbours and myself as complainants, since we had complained to BBMP AEE, Joint Commissioner, Commissioner, Mayor, including MLA and Corporator, but nothing has happened.”
SAI BABA TEMPLE WOES CONTINUE
Whenever there is a major festival, the roads adjoining temples in HSR Layout are blocked. The bone of contention is particularly the illegal Sai Baba temple in Sector 3. “Sai baba temple blocked 19th main today,” griped resident Somrup Pal. Another resident Murali countered “What’s wrong with it? Every day, other roads are blocked for one or the other reason.” Resident Ajay erghese had this to say “It’s high time people stop blocking main roads. One needs to be a responsible citizen to be the change to see the change.” Somrup Pal had the final word “What can be done when the temple itself doesn’t have legal permission? But in the name of religion, we keep mum. I’m a Sai devotee too but my faith says that Sai Baba will not tolerate such inconvenience to people in the name of festivity.” The Whatsapp group of Residents Watch is such a proactive unit that no sooner was this concern raised that another member called the authorities and nipped the issue in the bud. “I talked to both law and order and traffic police and they have not given any permission to block the main road. It Is the handy work of some private people. Informed the police to clear the main road,” announced BNR Reddy, former chairman of HSR Federation. Within minutes, the problem was resolved and the illegal barricades were removed. Says resident Manisha, post incident “We need to ensure the temple folks don’t make this a habit. It started small but has now become a big problem in a short time. Indiscriminate parking and aring tempers have become the norm.” Similarly, the managers of Subramanya temple on 1 th Cross in Sector 3 need to be told not in ict noise pollution during festival days. Multiple loudspeakers are illegally installed on the footpath. On one occasion, there were loudspeakers right up to Cool Joint junction on one end and McDonald’s on the other. The loud music goes on all day for three days continuously.

COMMERCIALISATION ON CROSS ROADS
Offices in residential areas are the new bane of HSR Layout. This leaves many residents fuming. The other day, residents joined hands to get a grocery-shopping office vacated on 16th Cross. Now, another office has taken shape on the same road. “This is getting too much,” says the resident, on the condition of anonymity, and has asked the Sector 4 Residents Welfare Association to tackle the menace. “Please initiate immediate action. Everyone would like to make extra money. But when it’s against the law and people blatantly violate it by thinking that they are above it, they should be taught a lesson.” Another fellow resident had this to say “This is a peaceful residential area and owners are renting out for commercial purposes to make extra money even though they reside here.” The purported landlady claims she has all the approvals. Can joint commissioner Muniraju please clarify and take action if she’s wrong? The matter does not end there. Another neighbour on the same road has rented her five-bedroom house on the 2nd oor for an office space. It goes to show that if you leave one illegality to get away scotfree, others come up. It’s a bad chain reaction. So all of them need to be shut down with an iron hand. Sector 4 is notorious in having many such offices and schools coming up in residential areas, particularly in the areas closer to BDA complex. Is it because many of these houses are owned by the high and mighty civil servants? It’s about time the BBMP officials cracked the whip before the situation of commercialisation gets worse across the neighbourhood. All the sectors of HSR Layout are suffering the same fate. It’s time the landowners rise to the occasion and say ‘no’ to greed. It’s time the BBMP conducts a mass drive in ending this menace.

HAFTA COLLECTION IN HSR
Street vendors are occupying footpaths to sell their wares. But at a price. They have to pay the cops and or the BBMP official. According to resident Murali, there are about 600 street vendors in HSR Layout, quoting some website data. “Even if we take Rs 50 as an average collection from each vendor, the daily collection will be about Rs 30,000 per day or Rs 9 lakh per month,” he estimates. “But actually, every day, more than Rs 100 is being collected from street vendors illegally.” Retail store owner Suraj Lulla threw more light on this subject “There is a good amount of collection happening every night. A small paan shop guy pays a minimum of Rs 20 twice a day. A pani puri guy, Rs 20 once a day. The food cart and food truck guys have different rates. So a mere 2 th main would generate around Rs 40,000-45000 per month.”
PIGGISTAN TO HASIRUSTAN!
After residents got together under the banner of Hasiru Mithra and greened the area, Piggistan turned into Hasirusthan. We are talking about the junction of 24th Main and 2 th Main, near the KPTCL power station. After a few months, the place is now sporting a high mast ood light. “This was being demanded by residents many times and now, it has been installed,” says a visibly excited resident Kamesh Rastogi. “This will help a lot in avoiding accidents at this junction. The next step would be to have a traffic island on the road below the high mast to direct vehicle users. Thanks to all the residents who followed up on this, especially Sector 2 Residents Welfare Association.”
TRADER ALERT: CORN STARCH PLASTIC BAGS ARE BANNED TOO Star Market is doing it and so are a few other shops in HSR. Handing out groceries in corn starch bags. But the truth is that they are far from certified. “Corn starch plastic bags are not exempted from the plastic ban,” clarifies resident activist Smita Kulkarni. “The Truegreen company folks have reached out to all grocery chain stores showing a permission from the Central Pollution Control Board. But the Karnataka Pollution Control Board has not permitted their use. It is being tested and it will take another seven months to obtain the results of the compostability and constitution tests. Until then, it stays banned. I urge all the traders not to invest in these bags.”

Much discussion was held in the RW Whatsapp group about the inefficiency of BBMP. We believe that if the government punishes all the civic officials who were responsible for lake and storm water drain encroachments, they would need to hire fresh recruits. Perhaps over 50 of the staff might need to be punished and their bank accounts frozen. The common man is also at fault. They bribe to get things done. Take the illegal oors being built. Doesn’t the common man know the rules before building the house? We get the officials and politicians we deserve. We should first be true to the law. Then we should blame the others. Can you afford to point a finger at anyone? Think and reform yourself. And then the world will be reformed.

HOW TO OBTAIN SENIOR CITIZEN CARDS
Just call 9945 -3 9 1 and keep three passport photos ready, and a xerox copy of one of the following documents Aadhar Card, oter ID, Driving licence or Passport. The person will come and collect it from you for Rs 250. Another method is to visit any of the political party offices. They will do it without any charge and it generally takes about a fortnight to a month for you to get the card. The cards are only for those who are 60 years and above.

he Karnataka Compost Development Corporation (KCDC) is still in the news. After the massive protest last October 31 by residents and catalysed by Residents Watch, the amount of wet waste came down from 500 to 200 tonnes per day. The acceptance of mixed waste has also down comparatively. However, the wet waste processing centre is yet to come good on its earlier promise of an odour-free plant. The place is still smelling badly, prompting residents to raise cries of yet another public protest. Thankfully, joint commissioner Sarfaraz khan visited KCDC late last month to allay the fears of residents. Upon inspection on Oct 25, the following directions were given to KCDC by Khan: 1. The volume of waste to be restricted to 100 MT from Oct 26. 2. eachate (the e uent) is to be completely removed. . Bio filter to be completed by 1st Oct and fully functional by 15th Nov. . Alternative solutions
“Waste to energy plants are the need of the hour,” says resident activist Kavitha Reddy. “In the name of composting and processing, there is too much environmental damage, increasing the number of landfills due to the large amount of mixed waste, soil pollution and health hazards. Water pollution, air pollution and stink only add up to the issue. It’s high time, the state government steps in to set up waste to energy plants and focus on more scientific methods of dealing with garbage.” ResidentsWATCH - HSR Layout

They have asked the transport department to connect neighbouring areas like Somasundrapalya for greater ridership. everal victims of builders have come to the a ention of Residents Watch. eople have been scammed left, right and centre. Those with disposable incomes should be wary of too good to be true schemes. And even where the deals are realistic, it’s important to employ a good lawyer to check the credentials of the builder before investing in any under construction property or vacant plot. Trying to save on the lawyer’s fees (Rs 10000 1 lakh) could cost you much more dearly later. Resident activist avitha Reddy had one case to mention. Many innocent and lower middle class people have been cheated by a couple called Sachin Naik and Mandeep aur. There are serious allegations on them, she alleges. They have cheated people by falsely promising them apartments. Dream , ruha alyan and T S are three of the many fraudulent companies. avitha alleges that the couple has given refund che ues that have bounced repeatedly. They have bodyguards, and if people try to meet them, they beat them up, and for some reason, the police has not taken note of it, and this couple is walking around freely looting people, she says. This couple has offices across HSR. One of the owners who has rented space happens to be a close family friend and after hearing the story, he has decided to ask them to vacate his premises. Adds another resident Rajesh rabhu These property marketing companies, who don’t have a single rupee investment on the projects, are conducting big con jobs. arlier, there was Orange roperties. They gather unsold low key properties, with ero credentials and release big advertisements with some fancy price tags and o ers. They o oad them on gullible buyers who have no clue about the laws of the land and the property market. Finally, they are left cheated. The moral of the story It’s essential to have proper legal verification of the documents, and background verification of the promoters before investing your hard earned money, says rabhu. fter much research, you finally ero in on an under construction apartment for purchase. our decisions are based on cost, location, development, accessibility, uality, reputation of builder and so on. The builder promises the moon to you and you are impressed with glossy brochures and sugary words of the sales managers. So you start dreaming about living in your own dwelling. The builder then sets the terms for payments 20 advance, 70 for slabs (for a typical apartment) and 10 after sale deed registration. After paying the advance (20 ), you will apply for a bank loan. If your Credit Information Bureau (India) imited ResidentsWATCH - HSR Layout
(CIBI ) score is good, your loan is immediately approved because in almost all cases, the land records (sale deed, mother deeds, khata, tax paid receipts for land) are clean. The builder will not let you modify any contents of terms and conditions of either Sale Agreement or Construction Agreement (or Agreement to build). The builder will also not entertain any uestions, clarifications and doubts to be answered or raised. ou will be left with no option but to buy it or look for a di erent flat. Since you would have already tried and got tired of finalising searching a flat, you will not fight with the builder, you will agree to everything. In most cases, the builder would have constructed all the slabs (or will complete all slabs within 2 months) and will raise the Demand Note for the November 2016 |19
Buying blues 70 of the flat’s cost. By this time, you would have paid 0 of the flat’s cost. Builder will use all his tactics coercion force to get the 70 payment as per the Agreement to Build. Builder will also put pressure on the bank to release the payment as per the agreement. Finally, the builder will get 0 of the flat cost into his ki y within three months of the Sale Agreement. This is where the actual problem begins. our flat work will not be completed brick work, painting, fi ings, wood work and so on. Since the builder has mentioned 10 12 1 months, he will take his own sweet time to finish it. Also, the total cost includes our flat lift generator electricity meter common areas All promised Amenities Registration Occupancy Certificate hata. The builder will only complete brick work for your flat and raise a Demand Note for the balance 10 . After the release of 10 (you’ve paid up 100 by this time), the builder will ask you to go for Sale Deed registration without completion of all the other things except your flat. As usual, the builder will promise that he will complete all the common things once and for all, after the flat’s brick work is completed. This usually takes anywhere from 12 months to 1 months. After the Sale Deed registration, the builder will ask you to move into the flat without Occupancy Certificate. Once you complete the interiors and move into the flat, you will start noticing all kinds of problems. The electricity connection will be temporary. To get a permanent connection, it might take one to two years. Without a permanent connection, you will not be able to run the grinder, mixie, fridge, washing machine and so on. ou will notice the peeling of the painting, leaking taps, bad finishing of tiles and patches in the painting. The lift will not be working continuously (will operate on need basis). The list is endless incomplete parking lot, no amenities, not enough generator capacity, incomplete staircase, drainage problems, poor uality construction, sound of continuous construction work, workers using common areas with red spots all over, drainage problems (since there will not be an ST ), no clubhouse swimming pool and all the other promised amenities. BBM will issue Occupancy Certificate (OC), if and only if the building has been constructed according to the Sanctioned lan and meets all the bye laws. BBM has the rights to allow up to a

maximum of deviations (but that too is subject to certain conditions). If deviations are more than , BBM will not issue the OC. Without OC, you will not get hata (so called A’ hata). Still you can pay property tax, but you will not get your A’ hata (I mean hata Certificate and hata xtract). Without A’ hata, neither can you sell your property, nor can you get mortgage loan from the bank. ou can argue that when the bank has sanctioned the loan and the legal opinion is clear, why can’t I get hata The reason is, the bank will sanction loan based on land records only. Since it is an under construction property, the bank will not see any building violations in the case of an under construction property. ven if they know, they will not raise any objections, because everything is legal as per the agreement and payment schedule. The bank will release 0 money just for slabs only. Banks also know that OC and hata will create legal problems for them, so they are also keen to release all the money just after the slab work is complete. ven though the sanctioned le er explicitly states that there should not be any violations and the builder should obtain NOC from all agencies, and A’ hata is re uired for creating e uitable mortgage (from legal opinion submi ed to bank), the bank coolly ignores the same because they need the business, which is the biggest for them. The same bank will not accept your documents or sanction mortgage loan, if you would like to sell or mortgage (after you occupy the flat), since you don’t have OC and A’ hata. The builder will demand 100 money before the building is complete, because all violations happen only after the slab works. The builder will construct an extra one or two floors (penthouse and so on) which are illegal and hence no OC will be given to you. When you check the BBM site for now our Tax aid Details,’ you will still see the land owner’s name against the property and hata number. This is because the original hata has not been bifurcated into individual flat owners. Reason Again, no OC. (B hata has no value, though BBM collects property tax.) In Bangalore, 0 70 of the bank business is from real estate. Who on earth will worry about OC and hata Because finally, the bank will catch the buyer for repayment of loan and not the builder for building violations.

Why not go for an underconstruction property?
In addition to the reasons above, most builders don’t make a provision for STP (Sewage Treatment Plant), which is mandatory as per the state pollution control board (KSPCB). STPs were made mandatory in 2010 for all the new apartments with more than 20,000 sq. ft built up area, having more than 0 flats. The uality of the construction may not be as good as promised before the purchase, but you can’t do anything as you would already have paid for it. You may have to shell-out an additional Rs 6 lakh to Rs 8 lakh to the bank as pre-EMI interest. Agreements are generally one-sided and favour the builders. The penalty for delay from the builder is peanuts, around Rs 5/Sq.ft/month. Say you are buying a 1000 sqft flat and the penalty works out to be Rs 000 per month. Whereas you will be paying close to Rs 50,000 per month as pre-EMI interest alone. e ing any penalty paid to you from builders is cumbersome. Since you would have paid 90% of the cost within a few months of the sale agreement and need to wait for 12-18 months before you get the possession of your flat, you will be at the mercy of the builder to get your flat completed and will not be able to raise any issues or objections with the builder. In all clauses for the cancellation due to any reason, refund will be around 80% of the paid money and will be after 3/6 months’ time frame. There is no clear info on carpet area. All flats are sold based on super-built up area which includes all common areas. Sometimes you might get less carpet area than what is commi ed. Some of the builders may not have NOC from KSPCB, BESCOM, BWSSB, BDA, BBMP and so on. Most of the time, the undivided share of land (which belongs to you) of the flat owners won’t tally with the total land on which the apartment is being built. First-time builders who want to make more money, mess up the whole project and flat purchases will be a ected.

like OC and ‘A’ Khata. Make the bank release payment only after the completion of every stage. Instruct bank to release payment only after receiving wri en approval from you (builder generally sends demand note to banker for payment release and puts pressure on bank for the release of payment). Form an association along with other residents so that enough pressure can be put on the builder to deliver as per the schedule and commitments. Don’t fall prey to the builder saying that your flat will appreciate within one year or so and forces you to pay more. It is not true. Roughly if you take the construction period as 12 months and loan as Rs 50 lakhs, you will pay close to Rs 6 lacs as pre-EMI interest to the bank (taking 1% per month as interest on Rs 50 lacs). The total flat cost at the end of 12 months is Rs 0 lacs + Rs 6 lacs = Rs 56 lacs. You would have paid much more than the appreciation already, and will have remaining instalments to pay too. In practice, since apartment construction is growing and in full swing in and around Bangalore, availability is also increasing day-by-day. So any new buyer of apartment will look for new flats with the latest technology and safety standards. Finding a buyer for an old flat might be an issue. Check that the builder has all the necessary clearances like sanctioned plan, commencement certificate and so on. After the completion of the project, ensure that the builder hands over the whole set of documents to the residents association. Ensure that the builder doesn’t violate the sanctioned plan/bye-laws. Now, an under construction property a racts the same VAT as a completed apartment, so you won’t save on anything.

Footpath encroachments galore on 27th Main 27th Main is the MG Road of HSR Layout. However, there are violations galore on its footpaths. The illegal use of signboards and hoardings is rampant as these pictures suggest. What’s more, there are some shops partially functioning from footpaths. It’s about time BBMP did its job and removed them before other shopkeepers take the cue and do the same. Prevent a chain reaction and let pedestrians walk freely and without any hurdle.
