Perhaps one of the weird things about death is how shocking it is even when it really shouldn’t be
The fact he was 95, and every major organ was basically failing, still didn’t prepare me for the jolt that was my father’s passing earlier this month
It didn’t help that the old guy still had his wits to the end, telling stories, asking for a scotch, demanding I help him get out of bed to go use the washroom
That was the hard part, telling him “ no, you can’t do that, you ’ re not strong enough ” At one point he said, “I know I’m wrong, but let me be wrong ”
He would have rather fallen on his face trying than be denied his right to make his own choices and mistakes
I couldn’t blame him It really prompts the question of free will versus safety To a child
us all rest
we can say, “No, you ’ re not allowed, it’s not good for you ” But what right do we have to say that to a coherent adult? Maybe none, but we did, although I’m not sure for how long we would have kept that up
The last column I wrote, about a month ago, was also about my dad, his health and the medical system At that time I was complaining about the lack of home care, which seems sadly ironic now It turned out he wouldn’t be at home much longer
Soon after I wrote that, he was in emergency, from there it was up to the internal unit Then up another floor to palliative and finally off to the hospice
Perhaps the toughest part was in palliative where he was stuffed into a room with three or four others It was around Christmas so everyone had visitors At one point, I realized my dad had spent 12 days surrounded by a white curtain, (he was never lucky enough to be put beside a window) hearing disembodied voices from around the room, sometimes hallucinating due to a blood infection.
It felt like a form of torture
When I pointed this out to the doctor (who, by the way, was brilliant in his care for both my dad and the rest of us as we came to terms with what was happening), he asked the nurses to move his bed into the communal lounge area for a couple of hours. It was Boxing Day and they were already short-staffed, but they did it My daughter started playing the piano under the DO NOT PLAY THE PIANO sign I fed him crushed ice, which the nurses forbade for fear he’d choke And didn’t he rally swearing, cracking jokes, teasing his grandkids
Unfortunately, it didn’t last and the next couple of days he mainly slept and finally the decision was made to move him to the Rotary Salvation Army Richmond Hospice
Again noting the circularity of life, one of the first stories I did for the Richmond News as a reporter was an announcement that Milan Ilich was making a significant donation toward the building of what would be Richmond’s first and only hospice.
I’m not sure if I even knew what a hospice was at the time What was obvious, however, was the incredible amount of passion fueling this project And I can assure you now, that passion lives on Touches like the hand-made quilt on every bed may seem small, but in moments of vulnerability can give the sense of coming home
It occurred to me that the hospice was everything home health wasn’t. The hospice is a private organization, yet the coordination between it and the hospital was seamless Is it because there’s only one, or because it’s a not-for-profit? I don’t know, but our experience there couldn’t have been more different than when we left the hospital after earlier visits and began negotiating the fractured and confusing hybrid world of private and public home support
As I looked out the French glass doors of my dad’s hospice room at the glorious sunrise that followed just minutes after his passing, I knew this little sanctuary, that provided such a gentle end, would make it possible for us all to rest in peace

Open letter to mayor and councillors,
We all deplore the exceptionally low voter turnout in Richmond. One reason given by voters is that they don’t know the candidates and their platforms.
The city prepares an excellent Candidate Profile document which should be considered essential for voter education. The problem is that this document arrives in the mail as unaddressed advertising material along with other ads and is frequently discarded.
In the last election, I did not receive this document in the mail and the five other residents I consulted on my street, who checked carefully for it, did not receive it either Another half dozen voters told me they didn’t receive it when I asked them.
The answer is to include the Candidate Profile document with the Voting Location card that is individually addressed to each voter by placing both in an individually addressed envelope. This may also require an earlier deadline for candidates to submit their profile.
It’s worth trying everything we can think of to increase voter participation.

Dear Editor, Re: “Council this week: soil use, political signs, speed zones,” Online, Jan. 23.
Residents of Richmond are all too familiar with the proliferation of election signs that have become a mainstay for aspirants to office.
City council is now proposing to ban election signs on public property and curtail signs on private property
That is a complete over-reach to a questionable problem.
The need for amendments apparently came from sign complaints from the 2022 election.
A total of 20 from 230,000 residents. Hardly a popular groundswell.
And no empirical input from the citizens of Richmond. Regardless, most residents can likely point out minor annoyances.
Instead of considering enforcement of the current bylaws, the proposal is to essentially “gut“ political signage, during elections in Richmond.
Granted, excessive and illegal signs should not be tolerated particularly where they obscure intersections and road signs. Current bylaws need to be enforced.
Candidates who do not take down signs after elections, or other obvious violations, are accountable to the current bylaws, and can be fined.
Most election signs are not an environmental problem. Current signage is recyclable and the frames can be re-used.
Signs, contrary to the bylaw assertion, do not favour those with more campaign dollars.
Incumbents often spend tens of thousands on media ads, while spending less than five per cent of their budget on much cheaper
road signs. But essential for lowbudget candidates.
The proposal to require an official legal document of permission from the City of Richmond to place a sign on private property is bureaucratic over-reach designed to significantly curtail the practice.
It is also an obvious affront to “freedom of political expression.“
The suggestion the enforcement of these new restrictions will cost the taxpayer nothing is absurd. An office will have to process the legal paperwork for signs on private property, and designated “sign police“ will be required to ensure community compliance.
This “sledgehammer“ approach to some minor problems, that could mostly be handled by enforcing current bylaws, is ill-advised.

Trial date set for birth tourist suing Richmond docs, hospital

A trial date has been set in the BC Supreme Court for the claim filed by a socalled “birth tourist,” who’s suing Richmond doctors, Richmond Hospital and a local “birth hotel.”
Late March has been pencilled in for the case of Peng Chen, on behalf of his now four-year-old son Stephen, who was born at Richmond Hospital in 2018 with alleged complications
Chen alleges that two doctors Brenda
Tan and Balbinder Gill as well as Vancouver Coastal Health (VCH) were negligent in the provision of medical care to Stephen and his mother, Rang Heng, at Richmond Hospital
He also claims the Richmond birthing house business which got paid to set up the birth locally for the family from China misrepresented the level of care that his wife and child would receive in Canada
So-called “birth tourism” refers to the perfectly legal, tried and trusted practice of expectant mothers arriving in Canada to purposely give birth here, due to children being born in Canada automatically re-

Prior to the trial date being set, Dr Tan’s lawyer had applied to the court to order Chen to release documents relating to his family’s visitor/residency status in Canada
The reason for the demand, according to court documents, was because where the child and his family will live in the future, and therefore their residency and immigration status, may affect the “assessment of the infant plaintiff’s income loss and cost of future care. ”
Documents also indicated that Dr Tan’s lawyer had twice requested the documents from Chen’s legal team, without success

He further alleges that Jie Zheng and a Ms Liang who operated ABC, a birthing house on Ash Street in Richmond misrepresented the level of antenatal and/ or perinatal care and expertise that his wife and child would receive in Canada
Chen claims that, because he had “little or no knowledge of the health-care system in Canada” he was “particularly vulnerable” to the alleged misrepresentations from Zheng and Liang
All named defendants in the lawsuit have denied any negligence

A Richmond nurse has been disciplined after his regulatory college found him guilty of sleeping during his shift, failing to administer medication on time and not properly assessing a patient who removed their urinary catheter, which could have had dire consequences
Ivan George Dacanay, a former licensed practical nurse from Richmond, was also accused of unethical conduct by the B.C. College of Nurses & Midwives (BCCNM) for not following the college’s guidelines regarding patient assessment and documen-
tation, and disrespecting colleagues
Dacanay has voluntarily agreed to the public reprimand and terms that will limit his nursing practice He received a twomonth suspension of his nursing registration and is prohibited from being the sole regulated nurse on duty, supervising nursing students or orienting new staff
Meanwhile, Dacanay will have to develop a learning plan to improve his professional communication, ethics, documentation and administration of medication The plan will be shared with his employer and BCCNM
The college is one of 18 regulatory bodies empowered under the Health Professions Act and regulates nursing, practical nursing, psychiatric nursing and midwifery
Feds fund youth gun violence prevention
The federal government aims to prevent gun violence with a cash injection of $250 million of which Richmond will receive $2 68 million

A Supreme Court judge has upheld an arbitrator’s order to evict a Richmond tenant for not paying her rent.
The tenant, Fuping Li, petitioned for a judicial review of a Residential Tenancy Branch (RTB) ruling, claiming that it was “patently unreasonable” and that the RTB had made errors in addition to acting with “bias and bad faith.”
Li initially signed a lease in 2018 with her former landlord to rent a house for $2,500 per month, but later signed a second lease in 2019 to reduce the rent to $2,000.
Her new landlord, Sarabjit Singh Virk, asked her to e-transfer $2,500 for rent after only receiving the original lease.
Li disputed the amount and did not pay rent when it was due on April 1, 2022 and was served a notice to terminate her tenancy 10 days later
The parties took the issue to the RTB and Li did not pay rent from April to August 2022.
An RTB arbitrator decided in August 2022 that $2,000 was the correct rent amount, but Virk was entitled to evict Li because she had failed to pay rent since April.
In Madam Justice Jacqueline Hughes’ reason for judgment, she agreed with the RTB arbitrator that Li failed to prove she had tried to pay her rent in cash.
She also decided the RTB was correct in deciding Virk’s eviction notice complied with the law since there was indeed unpaid rent owed by Li.
According to Justice Hughes, Li didn’t have a legal basis to support her decision to withhold rent during the dispute.
She also rejected Li’s claim that RTB acted in bad faith and bias.
“(Li’s) allegations of bad faith and bias are wholly unsupported in the evidence and appear to arise solely from disagreement with the (arbitrator’s) findings,” said Justice Hughes.
Li’s petition for judicial review was ultimately dismissed and she has been given until the end of the month to move elsewhere.
Highway lane closed for repairs
A section of Highway 99 in Richmond will be closed overnight for the next few weeks so repairs can be done to an overpass
Drivers are being advised that Highway 99 southbound will be down to one lane at Cambie Road to allow crews to repair the overpass.
The work will be car-
ried out from 9 p m until 5 a m , Sundays through Thursdays
There will be no closures overnight on Fridays and Saturdays Work began Tuesday and is expected to be completed by Feb 20
Drivers are asked to use caution and obey signage, traffic-control personnel and the construction zone
speed limit
The overpass was the scene of a bad accident last June, when a commercial truck’s load smashed into the bridge and then fell on another truck

Low-barrier sport a hit among seniors

No one knows when pickleball first landed in Richmond, but the sport has exploded in popularity in the city
According to co-founder Gordon Farrell, the Richmond BC Pickleball Association’s (RBCPA) membership has grown from around 100 to almost 600 since it was established in 2019
Farrell came to learn about the sport through word of mouth a few years ago when pickleball enthusiasts played at community centre gyms during “sporadic times of the day ”
The lack of dedicated courts or even outdoor courts never stopped the enthusiasts, and the high demand and desire to bring the sport to the city’s attention were what inspired the formation of RBCPA
The city eventually took note of the pickleball hype and managed to convert nine tennis courts into dedicated outdoor pickleball courts by 2020 just in time for the COVID-19 pandemic
A simple way to describe the game, according to Farrell, is that you ’ re playing table tennis while standing on a big table
“So, the ball moves and has the same sort of sounds, and the paddles are similar but much larger,” he added
The result is an addictive and strategic game, much like chess, that isn’t as physically demanding as similar sports such as tennis or racquetball
Richmond is only one of the many cities across B C experiencing the pickleball boom One major factor contributing to the sport’s popularity is the COVID-19 pandemic, according to Farrell Many gravitated to the outdoor sport during lockdown
The sport is also inherently inclusive: it’s a
good cardio workout and requires strategy but puts less stress on one ’ s body, allowing players of all ages, especially seniors, to participate
“Our youngest member is 12, the oldest member is 86 And it’s not unusual to see them all playing together in the same court,” said Farrell, adding those who played other sports such as squash, racquetball and tennis often pivot to pickleball as they get older.
Pickleball games are more social as well, he said, as the learning curve is quick and games can be short, and players can enjoy the game even when they’re playing with people of different skill levels
“I’ve met people and learned more about other communities Pickleball brings down barriers, language barriers, and preconceptions of people and stuff like that,” he said.
Having a small court also means you don’t have to scream across the court “So you ’ re able to talk as you ’ re playing back and forth, and it’s much more fun and laughing ”

How important it is to plan your land ownership
Introduction
In British Columbia, land ownership has always been the wish of most everyone When I started practice, decades ago, the system of land transfers and ownership was more simple There were no computers in existence Everything was on paper and manually completed The law was different as well In particular, the concept of “joint” ownership was for the most part, straightforward For example, if a married couple owned their home and received legal advice most likely they owned the home in a joint tenancy and if one spouse died, title transferred by way of transmission to the surviving spouse Legally, this transmission was via the concept of the Right of Survivorship The law has evolved, to the extent that the right of survivorship is more complex and can be gifted Therefore, it is in my view no longer as straightforward To illustrate, reasons for judgment (released last week by B.C. Supreme Court) in a case called Preskar Estate v Wagner are worth a look. Arguably title planning is more important than ever
Background
The Court called this case “most unfortunate” The deceased was in a marriage-like relationship with the defendant, since 1994. In 1999, they had a child, who is Plaintiff in this case They purchased a house in the Okanagan, in 2002. Title was registered as a joint tenancy In 2006, though, the couple stopped living together and the defendant moved out. In 2007, thedeceasedlaunchedaMatrimonialaction.Thedefendantcounterclaimed and the action became apparently acrimonious. The Court concluded that litigation fatigue (and probably a lot of expense) accumulated and the action was never resolved before the deceased died, in 2020.
The title to the home remained registered as a joint tenancy No steps were taken by any person to change the joint tenancy ownership before the deceased died (what could and perhaps should have been done is a severance of the joint tenancy into a tenancy in common. That would have resulted in the deceased’s interest falling into his Estate, such that thePlaintiffwouldhaveinherited).ThePlaintiffistheExecutorofEstate
The Will, however, did not make a specific reference to the property
The Plaintiff was simply named the sole beneficiary of the residue of the Estate (after some minor, specific gifts mentioned in the Will).
The Plaintiff applied for a Court Order that the joint tenancy in the property was actually severed such that the Estate owned a one-half interest in it.
Courts decision
The Court noted that because the couple separated before 2013 and never married, neither could make a claim under the then existing legislation, to an interest in the property Also there was no Separation Agreement.
Therefore, the claim of the Plaintiff had to proceed under common law (read, old law, here).
The Plaintiff had advanced 3 precedent cases, which the Court reviewed
The Judge concluded that one aspect of our common law is that a joint tenancy can be legally severed through a “ course of conduct” that the owners followed over time The Court had to decide whether the parties, essentially behaved in such a way over years, that their joint tenancy was indeed severed
The Court held, in this case, that the joint tenancy was in fact severed
The couple had a very bitter separation and each of them “ was asserting independent claims in respect of the property In fact, the defendant claimed relief by way of a Partition and Sale That legal remedy is one whereanownerclaimsthatthepropertyshouldbesoldandtheproceeds divided between the owners.
Thus, the property was deemed to be a Tenancy in Common and half of it fell into the deceaseds Estate The Plaintiff was successful, though the defendant was still a half owner She did not lose all interest in the property
Conclusions
The first conclusion is simply that when a couple is purchasing a property, it is more prudent than ever to discuss with a professional (in my view) how they want to register their ownership It is of particular significance where the couple is in a subsequent relationship, and with children from prior relationships. They should also consider some kind of Agreement, to confirm what they would want done with the property on death or break up (whether a Marriage Agreement, Co-Habitation agreement or other). The mere registration on title of a Joint Tenancy or Tenancy in Common may well not be enough to settle any future concerns, as you see in this case

In this situation, a person ’ s home may be sold without them even knowing At the root of it is the problem of fake ID This has surfaced in BC before, where fake ID caused several fraudulent mortgages to be registered on titles across BC on several properties. One step to take for your own property is regular title searching (which is not expensive), to monitor whether anything is happening to your title Another is to remove the duplicate certificate of title from the Land Registry office

Crow takes residence at YVR
It’s been a while since anyone has heard from Canuck the Crow, but there might be a new celebrity corvid in town
A Twitter account called @crowYVR has been documenting the shenanigans of a crow named Moira who decided to move into YVR much like Tom Hanks in The Terminal
“I live in YVR and I want your food. I’ll poop where I please,” reads its bio
The crow was named after Moira Rose, a character from the popular CBC sitcom Schitt’s Creek who starred in an “ apocalyptic fantasy about mutant crows ” (Yes, it’s a parody of Hitchcock’s The Birds )
In a statement to the Richmond News on behalf of Moira, Twitter user @crowYVR said she is “relieved” to tell her story and “finally get (her) Prince Harry moment of clarity with the public ”
According to the statement, Moira moved into the airport about a week before Christ-
mas in 2022, and she has since been showing off her soaring and swooping skills by touring the terminals and stealing food from unsuspecting travellers While she expects to be kicked out, the airport has yet to do so
The crow can often be seen perched on top of totem poles in the Domestic Departures area, which have now been covered in plastic wrap as protection against Moira ’ s poop A sign has also been set up for travellers
“This piece of art has recently become the chosen roost for a different type of aviator a crow who has made its way into the Domestic Departures area, ” reads the sign, which also includes a warning to refrain from feeding the crow
A spokesperson from YVR confirmed that because the airport is the largest building in the province with “hundreds of doors and windows,” wildlife does make its way into the terminal “from time to time ”
According to @crowYVR, the Twitter account was set up to show off Moira’s new life to “old pals” and “tweeting is in (a bird’s) DNA ”

It is with broken hearts we announce the passing of Danielle Mei Cabana, age 6, on November 26, 2022. She was born on October 3, 2016, in Richmond, British Columbia, to loving parents Denis and Tressa Cabana and her two big sisters, Rylee and Madeleine. Dani attended Diefenbaker Elementary School, where she was adored by her classmates and teachers alike.
Dani loved hockey, hunting, baking, fishing, crafting, animals and her cowboy boots. She was the dragonfly whisperer, often having them land on her finger. Dani’s exuberant personality and passion are an inspiration to everyone who knew her and a model for how we should live. She was a fierce go getter who never gave up no matter what the task. Her beautiful smile was infectious and would bring warmth to any heart.
Dani is survived by her parents, Denis and Tressa; sisters Rylee and Madeleine; great grandparents Siu Kam Tau, Val Owens and Nina Kutny; grandparents Daniel and Moony Cabana, Derrick and Judy Kutny; aunts and uncles, Yolaine Cabana, Kevin and Tressa Kutny, Trevor Kutny, Ashley Tarver; and cousins Michelle, Cole, Tyler and Kyle Kutny.
