Looking Forward to 2022 I want to wish everyone a Happy New Year and hope 2022 will bring us all good will, prosperity and an end to the material and labor shortages. As 2022 begins, so does FRSA’s 100th Anniversary. All year we will be celebrating our remarkable success and the path that brought us to where we are today. In July, FRSA’s Convention and Expo will take place at the Ocean Center in Daytona Beach, the location of our first organizational meeting and the home of our first Convention. We hope that you’ll mark your calendar and help us celebrate this wonderful milestone in our industry’s history. The FRSA President’s Breakfast, a private event for Past Presidents, Life and Honorary Members and Campanella Award recipients, will take place at the Plaza Resort & Spa. One hundred years ago, the hotel was called the Clarendon Hotel, and was the meeting place for 30 industry leaders who had the foresight to begin an industry organization. More on this later. The 2022 Expo is sold out and Director of Convention and Expo, Cheryl Sulock, is finalizing plans for the events. For our 100th Anniversary year, we’ll go back to a four-day Convention and three-day Expo. FRSA has reserved the entire Hilton Daytona Beach Oceanfront Resort and the Hard Rock Hotel. Members will receive information on booking these hotels in February. Details for events and registration will be forthcoming, so keep an eye on the website,
www.floridaroof.com and read updates in the magazine and on social media. Last month, as FRSA President, I was invited to attend an FRSA Self Insurers Fund Trustee meeting in Winter Park. It was a very enlightening meeting led by Chair Adam Purdy, CPRC. The SIF Trustees work hard for Fund members and during their meeting, declared a $1 million dividend. If you’re Joe Byrne, FRSA President not a member of the FRSA- Owner, Byrne Roofing Inc. The Governmental Affairs Subcommittee also met last month and were brought up to speed on proposed legislative changes to Chapter 558, Construction Defects. Incorporation by Reference in Contracts Trent Cotney, CEO, Cotney Attorneys & Consultants We understand how a contract is formed but opposing parties love to confuse roofers by incorporating other contract documents into their agreement. If you have ever reviewed a commercial contract, most of them incorporate at least one other document. The classic example is the AIA form documents. AIA A101 or A111 incorporate A201 by reference. A201 is a 40-page document that has numerous terms that may impact a contractor’s ability to get paid including terminations for convenience, waiver of consequential damages and notice provisions on claims. Most contractors gloss over the reference and never bother to obtain, let alone read, A201. Similarly, most roofing subcontracts incorporate the prime contract, the plans, the specifications and a variety of other documents. A roofing contractor should review all of the contract documents before the contract is signed, because if the term “incorporated by reference” is used, the verbiage in those documents is as much a part of the subcontract as the subcontract itself. In most contracts, there is a section of the contract entitled “Contract Documents” that identifies the documents that should be considered part of the contract. Have you obtained and reviewed all of those documents? The review of these documents is critical because it may dictate your ability to assert claims or defenses in the event of a problem on a project. Often, as someone who is reviewing contracts, you may request copies of these documents but never receive them prior to the time you have to sign the contract. In that case, we recommend sending an email to the opposing party stating “I have not received the following documents despite request: _______. If we don’t receive them by end of business tomorrow, we will assume they are not part of the contract documents.” If the additional contract documents are not provided to you in that time frame, then at least you have an argument that they are not part of the contract. What happens if there is a conflict among documents? Normally, there is what is known as an order of precedence clause or a “who’s on first clause.” This clause states: “In the event of a conflict, the following documents control and govern in the order listed: subcontract, prime contract, plans, specifications.” In this instance, if there were a conflict between the subcontract and the incorporated by reference prime contract, the subcontract would control and govern the agreement. 6

Roofing contractors should understand how the documents work with each other in advance of signing the contract. It may be possible to slip in certain favorable terms, such as price acceleration provisions, by incorporating by reference your scope of work which includes the provision. This tactic is especially useful when dealing with owners or general contractors that are unwilling to modify the terms of their contract. Governor DeSantis’s Session Priorities Chris Dawson, Attorney, GrayRobinson Law Firm Happy New Year, FRSA! May this new beginning bring peace and prosperity to you and your families in 2022. I am very excited for many great things ahead for our industry, beginning with another successful legislative session. Over the last several weeks, Governor DeSantis has outlined an expansive agenda for lawmakers to consider, including policy changes and a myriad of funding priorities for the state’s 2022-2023 spending plan. Let’s explore the top issues and appropriations laid out by the Governor and his team.
Policy Priorities
The Governor plans to use his significant political capital to weigh in on some big policy initiatives, including the re-institution of a Florida State Guard (FSG). The FSG is a state-governed civilian volunteer force that assists the National Guard in state-specific emergencies. The guard was most recently active during WWII to supplement deployed National Guardsman. The Governor also recently outlined an aggressive immigration plan for the Legislature’s consideration. His proposal would impose penalties on companies and organizations that transport immigrants from the US Southern Border to Florida. Further, it would prohibit local governments and state agencies from entering into taxpayer-funded contracts with such entities. The Governor is also asking the Legislature to tighten requirements for use of E-Verify by granting enforcement authority to the Department of Economic Opportunity.
Funding Priorities
Economic indicators forecast an abundance of state funding for legislators to allocate during the 2022 session. As required by the Florida Constitution, the Governor has outlined a spending plan for his administration in the next fiscal year, which commences July 1, 2022. The Governor’s “Freedom First Budget” clocks in at a whopping $99.7 billion – with total reserves of $15 billion. It prioritizes familiar initiatives, such as water quality projects and teacher pay raises. Additional funding recommendations include: ■ $105 million, an increase of $100 million over the current year, for the Rural Infrastructure Fund to support local rural infrastructure projects such as roads, storm wastewater systems and internet access for rural communities. ■ $100 million for the Florida Job Growth Grant Fund to support projects that create workforce 8

training opportunities and invest in critical infrastructure. ■ $50 million in recurring funding for VISIT FLORIDA, Florida’s tourism marketing agency. ■ $226.7 million to provide salary increases for those working in public safety – including 25 percent raises for all veteran state sworn law enforcement; 20 percent salary increases for entry-level state sworn law enforcement. ■ A $5,000 signing bonus for every recruit who is new to the law enforcement profession in Florida once they complete their training and they officially become a law enforcement officer. ■ More than $660 million for Everglades restoration. ■ $195 million for targeted water quality improvements. ■ $35 million to improve water quality and combat the negative impacts of harmful algal blooms, including blue-green algae. All eyes now shift to the Legislature as they evaluate the Governor’s priorities alongside their own policy and funding initiatives. Additionally, Legislators are tasked with redrawing all state house, state senate and congressional district boundaries through the decennial legislative redistricting process. Lastly, it is also an election year where all four statewide Cabinet offices are on the ballot. It is going to be a bustling 2022 legislative session indeed. Industry Updates Roofing Contractors “Shrink-Wrap” Damaged Homes After Hurricane Ida
An innovative U.S. Army program is helping residents to recover from Hurricane Ida. Under the current program, the U.S. Army Corps of Engineers (USACE) can’t nail the temporary roofing onto many surfaces because it might damage them and tarps simply don’t work on tiled, slate or metal roofs. Three companies were approached for a solution, including Matthew Lennox, West Palm Beach, Floridabased Stormseal. “I’ve been talking with USACE for the past five years outlining the benefits of Stormseal,” Matthew said. “I’m so thrilled we could assist Operation Blue Roof and those affected by Hurricane Ida.” The shrink wrap pilot program involves installing Stormseal’s product over a damaged roof, secured at the perimeter with furring strips. A contractor then uses heat to shrink the material and create a watertight seal. The people who received assistance were selected through the Center for Disease Control’s Social Vulnerability Index, which determined the areas that needed the most support. U.S. Army Corps of Engineers, Memphis District and Hurricane Ida Recovery Field Office commander, Col. Zachary Miller, said he’s optimistic about the potential uses for the new program. “If this pilot program works as intended, it could really be a game changer for survivors needing a temporary roof following a major storm event,” he said. “Disasters can devastate a region but being able to stay in your home while you recover is a win-win for the survivors and the community.” USACE and FEMA will evaluate the program to decide whether it can be used to help people affected by future natural disasters.
Roofing Alliance Announces Newly Created Bennett Award
The Roofing Alliance, celebrating 25 years as the foundation of the National Roofing Contractors Association (NRCA), announced a new Roofing Alliance award in honor of Bennett Judson, who is also the first recipient. She received the award during a Roofing Alliance ceremony at NRCA’s Fall Meetings. Receiving the first annual Bennett Award, Judson was recognized as an individual who makes things happen for the betterment of the roofing industry. Judson began her career at NRCA more than 40 years ago. As the Executive Director of the Roofing Alliance since 2003, she has embodied the type of leadership that truly brings the highest level of professionalism to the roofing industry.

“The Bennett Award acknowledges the venerable Bennett Judson and her inspiring 40-year career in the roofing industry,” stated Dave Lawlor, the 2021-2022 Roofing Alliance President. “Bennett is an exemplary team player who is also organized, passionate, tireless, professional, humble and positive. Anyone who has had the pleasure to work with or alongside her knows this recognition is well deserved.” Future Bennett Awards will be presented annually and recognize individuals who volunteer and offer notable positive accomplishments on behalf of the Roofing Alliance and industry. RoofersCoffeeShop announces the release of its latest Roofing Industry Trends Report. This Trends Report, which gathered information throughout 2019 and 2020, focuses on the labor shortage, the top business needs in the industry and contractors’ greatest needs and challenges. “RoofersCoffeeShop is committed to the roofing industry and the contractors who make it great,”
stated Heidi J. Ellsworth, RCS President. “We want to know what the industry is seeing and experiencing as it continues to roof and protect buildings across the nation. The strength of the industry lies in the knowledge of the professionals and their ability to network, gain ongoing education and communicate effectively.” Nearly 70 percent of respondents identified labor retention and recruitment as a top business issue. COVID-19, product costs, safety, technology and competition also stood out as challenges contractors are facing.From the information gathered, digital-based marketing is a significant need within the roofing industry with contractors responding that website development, digital advertising, marketing plans and content are among their greatest needs. Since 2016, RCS has surveyed contractors in the industry and developed three Trends Reports to date that focus on the challenges faced by contractors, their likes and the tools they are using to build their businesses. Owens Corning Expanding
Gunner Smith, President of Owens Corning Roofing Division, announced that customers will see significant changes in production over the next two years. “Our top priority is servicing contractors’ growth, so we must continue to increase our capability to deliver products to them when and where they are needed. We invest every year in process improvements and automation to increase the throughput at our manufacturing sites, but thanks to industry support we need to accelerate increased production capabilities to support growing demand for Owens Corning roofing products,” Gunner stated. “Our plans for 2022-2023 include a multi-million-dollar investment that will increase capacity across our shingle plant network, adding the equivalent of a full shingle line to our shingle production capability.” In addition, Owens Corning will make significant investments in increased inventory levels and warehousing to meet demand surges during peak seasons. “Given the industry’s fiberglass mat constraints, we are also excited to share that we have announced an expansion to our fiberglass mat facility in Arkansas that will significantly expand our mat capacity starting in 2023. These investments will increase our production capacity in our roofing accessory products as well, supporting the growth of our Total Protection Roofing System,” Gunner disclosed.

The teams must research the project, review the plans and specifications, and assemble a full estimate and proposal to submit a qualified bid package. The teams submitted their proposals in November which will be reviewed by industry judges. A maximum of five finalist teams will be selected to travel to the International Roofing Expo in New Orleans, where they will present their proposals as if they were presenting to the general contractor, on Wednesday, February 2, 2022. FRSA – 100 Years Strong Lisa Pate, FRSA Executive Director This year marks FRSA’s 100th Anniversary as a leader for the roofing and sheet metal industries. As we celebrate this milestone, we will also celebrate the many leaders who seized the opportunity to create an organization that would champion for their interest and for the betterment of the industry. Each month, Florida Roofing will share some of our rich history with pictures, articles and snapshots from various committee minutes. We will also share these on social media, in Roof Flash and on our website, www.floridaroof.com, so be sure to engage with us through these platforms. Over the years I’ve heard so many wonderful stories that members have shared with me, including some too colorful for print. I’ve always said this industry was made up of genuine people who care about their trade, are willing to mentor, share their knowledge and who enjoy the camaraderie of other professionals.
The Early Years
It was 1922, just before the first Florida land boom. Sunbeams glinted greenly off Ludowici Spanish tiles as a half-dozen workmen scrambled over the new roof of the Clearwater Presbyterian Church. Charlie Johnson had come all the way from Jacksonville to install this roof. On the ground, he chatted in a shady spot with Frank Tack, subcontractor for the sheet metal work. Tack was a member of the church. He and Nelson Cheney were partners in Clearwater Sheet Metal Works. Fifty years later, when he was 81, Tack recalled that first conversation beside the Church. “We were bosses,” Tack said, “and we didn’t have much to do. So, we started talking about forming a state trade association.” Several goals emerged: this trade association would help solve industry problems, provide leadership in the field and stress occupational pride. After the church was finished, Tack and Johnson met at Johnson’s Jacksonville shop. A dozen shop

owners from www.floridaroof.com around the state were invited. If /flroof memories serve correctly, seven /company/flroof attended. No records have survived. Among the seven were Tack, Johnson, Elmer Blank of Daytona Beach and Charlie Stephens, Sr. of Jacksonville. The group recruited salesmen from the wholesale houses to spread the word about an organizational meeting to be held at the oceanfront Clarendon Hotel in Daytona Beach. At that meeting, a spark was ignited and a small trade association was born which would survive The Depression and a World War. By the late 1960s, it would be known as the most forwardlooking, ambitious professional association in the state of Florida. Tack, in later years, borrowed a quotation to sum up the association’s youth. He said, “History is made by men and recorded by their accomplishments.” This is a record of those men and women and the accomplishments of the Florida Roofing and Sheet Metal Contractors Association (FRSA). At the Clarendon Hotel in Daytona Beach, a group of 30 shop owners decided the association would be called the Sheet Metal Contractors Association of Florida. Elmer Blank, B & F Supply, Daytona Beach, chaired the first meeting. Charlie Stephens, Sr. agreed to serve as the Secretary-Treasurer. Dues were set at $5 a year – in a day when sheet metal workers were making a shade over 60 cents an hour and fringe benefits didn’t exist. Charlie Johnson served as the first President. FRM

What is the Required R-Value for Insulation When Reroofing? Mike Silvers, CPRC, Owner, Silvers Systems Inc. and FRSA Technical Director
This question comes up often, especially when a contractor is dealing with replacing rigid insulation that makes up part of the roof assembly in low slope roofing. Although that is where most questions originate, it isn’t the only place where the answer to the question applies. The answer, like many code questions, is not a simple reading of a single code section, but instead one needs to follow a path created by the code. In this article, I will cite some of the code language that deals with the subject and, hopefully, create some road marks along this path. Since the question involves reroofing, which only applies to existing buildings, we need to start with the following subcode (or volume). There are other sections of the code that deal with reroofing, but most of those are taken from the Existing Building subcode. I will cite this code as it applies to this applicable reroofing work:
Section 202 – General Definitions ALTERATION. Any construction or renovation to an existing structure other than a repair or addition. Alterations are classified as Level 1, Level 2 and Level 3. [Note: Reroofing is a Level 1 Alteration]. REROOFING. The process of recovering or replacing an existing roof covering. See “Roof recover” and “Roof replacement.” ROOF RECOVER. The process of installing an additional roof covering over a prepared existing roof covering without removing the existing roof covering. ROOF REPLACEMENT. The process of removing the existing roof covering, repairing any damaged substrate and installing a new roof covering.

CHAPTER 7 – ALTERATIONS – LEVEL 1 SECTION 701 – GENERAL 701.1 Scope. Level 1 alterations as described in Section 602 shall comply with the requirements of this chapter. Level 1 alterations to historic buildings shall comply with this chapter, except as modified in Chapter 12. 701.2 Conformance. An existing building or portion thereof shall not be altered such that the building becomes less safe or energy efficient than its existing condition. Section 701.2 clearly states that you cannot reduce the energy efficiency of the building during the work, but it does not indicate whether additional energy efficiency must be incorporated in such work. Additional information becomes available as we progress on our path to sections more specific to existing roofing. We will come back to this section later in this article.

Section 708.1 (Energy Code) states: “Alteration subject to this chapter shall comply.” This does not say all alterations must comply. Most importantly, it exempts existing buildings except those considered renovated buildings, changes of occupancy type or previously unconditioned buildings to which comfort conditioning is added. A typical reroof does not meet these criteria. A renovated building has a very specific definition that again does not apply to most reroofing. To apply, the total energy-related renovations would need to exceed 30 percent of the assessed value of the structure. Typically, if the building is undergoing that level of renovation, a registered design professional will be involved and will specify any changes that are needed to comply with the code.

History
Originally, sheet metal workers were called “smiths” and there were different kinds of smiths – most likely, the first were the gold and silversmiths who date back several thousand years. Paul Revere is probably the most famous silversmith. When copper and bronze came along, workers were called coppersmiths. A lot of these became armorers and worked for kings and rulers to make swords and armor for the armies of the time. Blacksmiths came along when iron was discovered. They worked with forges to make tools and other implements such as horseshoes, nails, door hinges and other items made of iron and steel. Sheet metal workers came to be known as whitesmiths since they worked with white metals like tin and zinc. They made pots and pans and different items that are used in homes and buildings, roofing, air ducts and certain types of siding. Metal roofing has been around for a very long time. Sheet metal was developed during the American Revolutionary War (1775-1783). A manufacturer named Robert Morris created it in Trenton, New Jersey, where he created the first sheet metal roof for his own Philadelphia mansion. Sheet metal roofing became popular in the 19th Century and metal roofing

was specifically used on buildings whose roofs had a gentle incline. At the time, with domed or gently inclined roofs, tile and clay would not maintain the roof shape. As technology advanced, fabrication and installation has become easier and far more productive. Over the past 40 years that I have been working in the roofing industry, I have seen the good, the bad and the ugly. These days, it seems like everyone is in such a great hurry to get it done that quality and attention to detail is a distant second. Soldering that certain detail to make it watertight, has now been replaced with caulking. “Back in the day” we used to make and take, meaning we installed everything we fabricated. Handmade double lock standing seam metal panels that were once installed with hand tools, are now created with machines and equipment that do both. Ornate cornice moldings and radius copings, which were once created by a coppersmith, now have been replaced with Styrofoam covered with stucco and paint. Residential bay windows that were once made of copper are now replaced with shingles. While I have great respect for the advancements in technology and recognize the need to adapt, I truly miss the artistry involved in laying out and fabricating a custom-made leader head that shows the craftsmanship of the work. I have worked on many different projects over the years, crafting items from cupulas to barrel vaulted dormers to church steeples and spires. I did not learn how to make these during my four years of trade school while becoming a certified sheet metal journeyman; I learned that skill on the job. I have yet to see an apprenticeship program that offered a curriculum in architectural sheet metal design. Most programs focus on HVAC duct work, most of which is designed by CAD drawings and produced with laser assisted equipment that the sheet metal worker then assembles.
The term “Tin Knocker” was mainly used to describe a sheet metal worker or metal duct installer. It was also used as a slang term in construction if one were a non-union worker on a union job. We were also called scab and rats. Sheet metal craftsmen were also responsible for the complete set up of our jobs. Sometimes, before the roofers can do their work, we are installing gutters and edge metals and, after they are finished, we install simple coping systems or ornate copper hip and ridge cap. We are kind of seen as the necessary evil on the job because we gave the roof the finishing touches that it needed. We are sometimes considered to be the “prima donna of roofing” because we don’t want our work to get tarred up in the installation process. Sheet metal workers are the last trade that can take a flat sheet of metal and lay it out, form it and put it together from scratch. The items that sheet metal workers install are some of the most visible and distinctive enhancements to a home. I have worked on many high-profile jobs in my time and let my work speak for itself. Safety is of great importance and the number one priority. Whether it is working off the edge of a five-story building or on a 9:12 pitched roof tied-off and installing gutter and edge metal, to setting up scaffolding or in a man lift 125-feet in the air, you had better know what you are doing. I’ve seen many men, including myself, get severely cut while handling metal or struggling to handle a 30-foot long metal panel and not letting it become airborne. I have fallen off a metal roof, where I was the first one on the roof to tie-off the safety lines for my crew, only to catch a slick of dew on a panel in the early morning. Down I went in an instant sliding 20 feet on the panel and dropping another 20 feet into a parking lot and blowing out my knee. Safety is critical especially when working with metal. The sheet metal trade has changed so much through the years with new machines and computers, but we still need to keep up our skills because
sometimes we need to modify things in the field. Ironically, with all the changes and improvements, you can look at some sheet metal tools used a hundred years ago, and they have changed very little. The pride and the skill that a true sheet metal worker takes in his or her work is what makes them true craftsmen in their trade. The future of sheet metal is wide open for the ones that want to be true craftsmen in a trade that offers great opportunities. L ong live the tin knocker! FRSA-PAC – The Voice of Florida’s Roofing Industry in Tallahassee Mike Reed, CPA, FRSA Controller The FRSA Political Action Committee (PAC) has played an important role in the roofing industry’s political activities since it was recreated by a group of loyal volunteers at a late 1979 FRSA committee meeting. The Board formalized the creation of the PAC at the January 1980 Governmental “Activities” meeting. (The committee is now known as the Governmental Affairs Committee). Bernie Parrish was hired as the Association lobbyist in 1980. During the PAC’s early years, fundraising was the primary focus, along with controlling rising workers’ compensation insurance rates. During its first two decades, the PAC was dependent on fundraising events and individual contributions to raise money. We found it difficult to establish a war chest to make campaign contributions from. FRSA affiliates were viewed as an integral component of the PAC planning and funding at this stage and a contribution of $2,000 was received from the Southwest Florida Roofing Contractors Association in 1983 to jump start a campaign to raise $20,000 in support of business-friendly candidates. SWFRCA challenged other affiliates to match its donation. From 1981 to 1983, an annual meeting was held in Tallahassee with the goal of making as much personal contact with legislators as possible. These were known as “Legislative Board of Directors” meetings and were successful in bringing FRSA members and

their representatives together. In 1983, a “Shrimp Boil” was held at Ausley Farm in Tallahassee with 34 of 40 senators attending, an incredible number when viewed in retrospect. In 1985, a cookout was held for House Committee chairs as a part of a scheduled FRSA meeting. The first candidate contributions had been made by the PAC in 1982 and efforts were rewarded early on. In 1982, Governor Bob Graham spoke at the FRSA Convention while running for re-election. Speakers at Governmental Affairs Committee meetings during the early 1980s included House Insurance Committee Chair Tom Gustafson in 1984 and Insurance Commissioner Bill Gunter in 1985. The PAC always used these events to raise funds, hosting an evening function following the day’s meetings. The FRSA Convention was also an avenue for fundraising during the early years. In 1984, there was a “FRSA-PAC Entertainment Hour.” In 1985 an act known as “The Mayor and Buford” entertained and, in 1986, a “Jivin’ Drive-in” party was held to benefit the PAC. By the early 1990s, the PAC was well established but still struggling to raise funds on a consistent basis. However, limited funding didn’t stop PAC activity. In 1992 and 1993, efforts by the PAC and other construction partners defeated a large Joint Underwriting Insurance Bill. At this time, the PAC was also actively involved with reform to Chapter 489 and, in 1993, became an early member of the Construction Coalition. In 1994, asbestos removal and disposal was a hot issue and FRSA was fortunate to hire Cam Fentriss as lobbyist the same year. Cam would end up serving the Association and PAC for the next 24 years, to the great benefit of the roofing industry in Florida. The asbestos issue and subsequent disposal requirements led the PAC and the FRSA Educational & Research Foundation to create a class to comply with the new law. In 1996, another Legislative Board of Directors meeting was held in Tallahassee and a
legislative reception was held on Friday evening in the old state capitol Senate chambers. The formation of the Construction Industry Licensing Board (CILB) was a major topic of conversation at these meetings, with FRSA pushing for a roofing seat at the table from its inception. PAC fundraising events were again held at the 1997 and 1998 FRSA Conventions. In 1997, a PAC “Gong Show” was held displaying the talents (or lack thereof) of several Association members. In 1998, an “Artisan Competition” was held with members creating artistic sculptures using only items found in roofing. As an aside, “Roofer Man” stands in my office and a copper suit of amour is displayed in our trophy case, are both items from this competition. In the late 1990s, a lot of work was going on behind the scenes developing the initial edition of the Florida Building Codes (FBC), with the first draft of the code published in April 1999. Lobbying efforts led to five FRSA members serving on the Roofing Technical Advisory Committee (TAC) of the Florida Building Commission during the first FBC code cycle. 1999 saw a milestone in PAC fundraising when the first PAC Golf Tournament was held. The tournament was a success and became a tradition that was held every year in conjunction with the Fall FRSA Board and Committee meetings from 1999 through 2019, with the exception of the aftermath of September 11 in 2001. No event was held in 2020 due to the pandemic and in 2021, a cornhole tournament was held in lieu of
golf. The tournament increased amounts available for legislative contributions but fell short of what many felt was needed to support as many candidates as desired. In 2000, the most significant fundraising item in PAC history occurred, the conversion of the PAC into a new format recently created by the Florida Division of Elections. The creation of a Committee of Continuous Existence (CCE) allowed FRSA to designate a portion, ($40) of each Association dues payment to the PAC for the first time. This immediately increased the amount available for campaign contributions to between $22,000–$26,000 annually, or around $50,000 each election cycle. The increased amount allowed the PAC to participate in a more meaningful way and was also a great way to encourage all members to take part in political activities that affect their businesses. The PAC became increasingly active beginning in 2000 and has been ever since. A larger treasury also benefited lobbying efforts, providing significantly more for campaign contributions, not only to candidates but to political parties and other political committees, both of which are not limited by election cycle limits on amounts they can receive. Along with more contributions to candidates, came a couple of policies that served the PAC well. First, whenever possible, it is viewed as desirable to hand-deliver checks to candidates. Members of the Governmental Affairs Committee have delivered innumerable contributions to candidates in their

Senator Perry has been very supportive and an ally to the roofing industry and was extremely helpful last year as we fought to eliminate the reimbursement scheduled for roof replacement in SB 76’s original language. This was a win for both consumers and roofing professionals. FRM
districts, putting a face with the message supporting the industry. Second, the amounts contributed to individual candidates is set by PAC policy, making it easier to determine the amount to give. The maximum contribution is only given to candidates who have a background in construction or are in a leadership position in the legislature. A third policy that was utilized for many years was to make contributions in the same political party proportion as reflected in the balance of power. In the Twenty-First Century, the Governmental Affairs Committee and the PAC have battled numerous issues, each with the FRSA membership fully informed of both the industry’s position and the stakes for roofing contractors. Information is communicated electronically through periodic Legislative Update reports, along with the occasional “Member Alert” when an issue requires immediate attention. These typically call on members to contact their representative regarding a particular issue. Workers’ compensation reform, Lien Law and Notice of Commencement, retainage and prompt pay, the Florida Building Code, the Florida Product Approval System, out-of-state contractor issues, roofing scope of work items, unlicensed activity (including the creation of an Unlicensed Activity Task Force), tort reform, construction defects, construction
training and property insurance battles have all been addressed at the legislative level by the FRSA-PAC. If an issue affecting roofing contractors’ businesses arises, our Legislative Counsel, Chris Dawson and the Governmental Affairs Committee are on it. Subcommittees are often formed to address specific issues important to contractors like the current Chapter 558 Construction Defects group looking at proposed 2022 legislation affecting any contractor who performs defect repair work. An increase this year in the amount designated for the PAC from Association dues payments has the PAC in sound financial shape going into the 2022 election cycle and beyond. In mid-December, Chris Dawson presented a list of recommended candidates to the Governmental Affairs Committee to support prior to the January 11, 2022 Legislative Session. Members discussed and approved the slate and volunteered to personally deliver checks to candidates. In this way the PAC will continue to be, as it has in the past, an effective voice of Florida’s roofing industry in Tallahassee. FRM

Ladder Safety Jorge Castanon, Safety Consultant, FRSA Self Insurers Fund Having the right ladder for the job is the safest way to complete any task. So, how do you ensure you are choosing the right ladder? It’s important to understand the differences between ladders, including their function, ratings and types of material used to make the ladder. This article discusses best practices for ladder use and gives tips to keep you safe on every job. First, you should select the style that best fits your job. There are five basic categories of ladders: step, extension, multi-use, podium and job-made. Let’s review the best use for each. A step ladder is a portable self-supporting A-frame ladder. When using a step ladder, open the ladder so that the spreader bar is completely horizontal and locked. Then check that all four feet are balanced and have secure footing. Never use a step ladder in a closed and leaning position. Remember that the highest standing level on a step ladder is two rungs down from the top. The maximum safe reaching height on a step ladder is approximately 4 feet higher than the height of the ladder. For example, if you needed to reach a 10-foot ceiling, you could usually safely use a 6-foot step ladder. An extension ladder is also referred to as a portable ladder and it usually has two sections that operate
with brackets that allow for adjustable heights. To properly set up an extension ladder, you should place the ladder at a four-to-one angle against its point of contact. That means for every four feet up, the base should come out one foot. Then you will need to secure it to prevent any sideways movement. Ensure that both feet are balanced and have secure footing. You should use a ladder leveler when working on uneven surfaces. If you’re on a hard surface, you should use non-skid or rubber feet and, on a soft surface like dirt or gravel, you need to use the metal feet and dig them into the ground to secure the ladder. When using the extension ladder for gaining access, make sure the rails extend at least three feet above the landing surface. On an extension ladder, the highest standing level is four rungs down from the top. Multi-use ladders have the capability to be set up in a variety of configurations. You should read all labels on the ladder for optimum set up and use. A podium ladder is a self-supporting ladder that provides a large standing surface, allowing workers to face any direction without repositioning the ladder. You should make sure that the podium step is correctly positioned to avoid overreaching and that the safety gate is shut and locked once you are on the platform.

The last category is a job-made ladder, constructed onsite, usually out of wood, to fit very specific needs. To decide which type best fits your task, you need to determine the following: ■ For what jobs do you need the ladder? ■ Will the ladder be used inside or outside? ■ What heights will you need to reach? ■ How much weight will be on the ladder including tools and materials? ■ Is there a possibility of working near electricity or powerlines? ■ A ladder duty rating determines the load capacity or maximum weight a ladder can safely support. Calculate the workload to include the approximate weight of the worker, the tools needed and the materials that will be used to complete the job.

FRSA Members Giving Back to the Community
In November, in honor of Veterans’ Day, Beacon revealed the six grand prize winners of its annual Beacon of Hope, a nationwide contest awarding deserving veterans with new roofs. For the third year in a row, as part of Beacon’s commitment to its communities, Beacon delivered and facilitated roof replacement for the six veteran contest winners at no cost to the recipient. Additionally, six second prize winners received $2,500 each to put toward necessary repairs. “Once again we received thousands of votes from people across the country, showing support for deserving veterans,” said Jonathan Bennett, Beacon Chief Commercial Officer. “We created Beacon of Hope as part of our commitment to giving back to the men and women who have served to protect our
country and our freedoms. We’re honored to do a small part in improving the lives of these veterans by awarding them with new roofs or the support needed to complete much needed repairs.” Inspiring stories from the top 12 finalists were shared on the Beacon of Hope website, www.becn.com/beacon-of-hope.
