As land-based operations were forced into lockdown, online gaming flourished.. and continues to do so. This issue of Gaming for Africa magazine is dominated by online gaming developments in Africa, but also features some exciting news from TCSJOHNHUXLEY in Botswana and Novomatic Africa on land-based business in Malawi.. a sign of the recovery of the land-based gaming industry. With the easing of restrictions and a Covid vaccine on the horizon, land-based gaming looks set for a recovery in the new year. This, alongside the huge numbers being predicted for online gaming and sportsbetting growth in Africa (as touted by Ed Birkin on page 6 of this issue), will see a new Spring for gaming on the continent. MultiChoice Expands into Gambling with Stake in Nigerian Sportsbetting Operator South African pay TV operator Multichoice has acquired a 20% stake in BetKing, a gambling company with major operations in Nigeria. The value of the deal is said to be worth R1.8 billion. The company revealed the details when presenting its half-year to September results, saying BetKing is a high-growth sports betting group with operations in Nigeria, Kenya and Ethiopia. MULTICHOICE SAID it had bought the shareholding in order to expand the group’s entertainment ecosystem further. “Sports betting is an interesting market that is aligned to our pay-TV business,” said MultiChoice CEO Calvo Mawela in a recent media interview. “We have a lot of sport on our platform, and many people that are betting watch more games.” he said. “BetKing started in Nigeria and has shown rapid growth over the past two-and-a-half years, according to the CEO. “They plan to be pan-African and will be entering South Africa at some stage, too,” Mawela said.

Sportsbetting and Online Gambling will Double in Africa by 2025 Africa’s leading gambling b2b event, ICE Africa, wrapped its 2020 event recently on a high note after moving to an online platform due to the global pandemic. This year’s event mainly focused on the online element of gambling across Africa, and produced a number of key insights around the current explosive growth in online gaming, as well as the predicted future growth in iGaming across the continent. AMONG THE key highlights from the event - is the current status of Africa as a key growth market and the predicted explosion in online, sportsbetting and mobile gaming in Africa, estimated to double from its $1.5bn of sportsbetting gross win in 2020 (30% of which takes place online and 45% of which is on mobile devices). Ed Birkin of H2 Gaming Capital estimates that in as little as 5 years, given the growth in mobile connectivity across Africa, this figure will almost double to betting gross win of $2.9bn (37% of which will take place online, and 60% coming from mobile devices). Set against the key statistic that, overall, Africa’s gambling gross win grew at a compound rate of over 8% per year between 2013 and 2019 - almost 4 times that of global gambling market. The event’s keynote address was provided by South Africa’s Director: Gambling Law & Policy at the Department of Tade and Industry, Nkoatse Mashamaite. South Africa’s is arguably the continent’s most sophisticated gaming jurisdiction, with numerous forms of gaming allowed, including 40 Vegas-Style integrated resort casinos, as well as sportsbetting, bingo, lottery, horseracing and AWPs. But, South Africa is yet to legalise online casino-gaming, and many industry observers believe that - in light of terrestrial casinos only having recently opened after lockdown - South Africa is looking seriously at allowing online gaming, providing a growth opportunity for investors and operators on the continent. ICE Africa Digital 2020 also provided some keen insight into the African gambling market from experienced operators who shared their experiences and advice gleaned from various jursidictions like Botswana, Nigeria, Kenya, Ghana, Rwanda,

Mozambique and Uganda, as well as expert guidance from regulators and African gaming industry experts. An interesting glimpse into the future was also provided by Artificial Intelligence modelling that showcased how AI can be used to model best safety protocols for casinos in tracking Covid-positive players and staff. Casinos and gambling operators are sitting on vast amounts of data that they have only begun to understand to utilise in terms of AI to maximise operational efficiancies and profitability. ICE Africa Digital 2020 attracted more than 1200 registrations, with a phenomenal attendance rate of 72% with 2500+ contacts being made, 2700+ discussions created and 5900+ messages exchanged during the 3-day online event. “The terrific attendance rate for ICE Africa Digital 2020, despite this year’s move

World had 7.451m Gaming Machines in 2019 Australian trade association GTA has completed its latest study of the number of gaming machines operated around the world in 2019. THE STUDY is one of very few authoritative investigations into jurisdictions and machine numbers that is available on the market. The Gaming Technologies Association, with nearly all of the active suppliers in the Australian market in membership, told InterGame this week that the number of authorised machines globally in 2019 was 7,431,125. This is up 39 per cent from 2018. In its own market of Australia, the GTA pinpointed that there are 192,800 machines operating, down 3,501 from the previous year. The estimate indicated that in 2019 Australia operated 2.58 per cent of the world’s legally installed machines. All jurisdictions across Australia, except for Western Australia, saw a decline in gaming machine numbers compared with the previous year. Gaming machines can be found in various establishments internationally, from casinos to cruise boats, clubs and local bars, racing venues, amusement parlours, restaurants, petrol stations and even in corner stores and cafes. The World Count of Gaming Machines, as the report is named, illustrates the evolving nature of the industry, both in Australia and internationally. It found that Japan has the most gaming machines in the Asia Pacific region with 4,195,930; the US has the most in North America with 900,704; Argentina leads in South America with 97,555; Italy in Europe with 407,267; and South Africa is the leader in terms of numbers in Africa with 37,815. The GTA first commissioned the World Count of Gaming Machines in 1999 in response to unfounded and exaggerated figures that were circulating at that time. More games are in production that will be added to complement the existing suite of games in 2021. Alexa was previously an area manager for Vukani Gaming in the LPM industry. With further and sustained growth expected, especially in the retail market, more personnel will be onboarded as this growth materialises.

Evolution Services Headed by Industry Expert Dean Finder Dean has been involved in the betting industry for over 30 years. As both an independent bookmaker and Chairman of the bookmaker’s association in the Western Cape from 1998-2013. In 2013 Dean sold his betting operation to concentrate on his horse racing betting odds consultancy and consequently, assumed the role of GM of the bookmaker’s association. In August 2015, Dean joined Phumelela Gaming and Leisure as their fixed odds executive and COO of Betting World. On the back of his successful turnaround of Betting Worlds fortunes in a short space of time, Dean was also handed the Legal and Compliance portfolio as the responsible executive in Sept 2017. In September– December 2018 Phumelela experienced changes at senior management level, which resulted in Dean considering his options and ultimately resigning in April 2019. Dean agreed to Phumelela’s request to remain on as a consultant for a year, however, terminated his consultancy and joined Evolution Services SA as their CEO on the 1st of December 2019.



Western Cape Gambling Amendment Stalls due to Differing Legal Opinions The Western Cape Nineteenth Gambling and Racing Amendment Bill appears to have stalled due to differing legal opinion around the constitutionality of some of the proposed changes that the amendment will bring about. THE BILL aims to address the increasing funding shortfall of the Western Cape Gambling and Racing Board – the Board historically got revenue from exclusivity fees. Casino operator licences were allocated to each of the regions for a period of ten years, for which an exclusivity fee was payable. This period of exclusivity has expired, leaving a revenue shortfall. The Board also received revenue from Limited Gambling Machine Operator Fees. The Act is being amended and provides for these fees to be paid for a ten-year period. As a result of the loss of these two revenue streams the Board has become

increasingly reliant on transfer payments from the Provincial Treasury. Among the proposals tabled to address this shortfall are the reintroduction of a LPM Operator Fee, as well as a Casino Operator Fee. Among the ideas presented in a briefing to the standing committee on finance and economic opportunities by the provincial treasury was an amendment to the law that would permit the moving of existing casinos to other areas. Originally, casinos were established in five of the province’s district municipal regions, and owners were each granted a

licence to operate exclusively for a 10-year period in a designated area. The exclusivity periods have now expired. Deputy director-general for Fiscal and Economic Services Anthony Phillips said: “The 19th amendment to the Western Cape Gambling Act looks at efforts to make the board self-sustainable. It carries the introduction of a casino operator fee as well as a limited payout machine operator fee. “It also provides for the accruing of certain fees to the board to aid selfsustainability,” said Phillips, adding there were two more amendments in the pipeline.

Regulatory Matters - has your business begun its protection of personal information journey? by Guinevere Morton CA(SA) Executive Manager at GRIPP Advisory

As companies across the globe react to the threat of increased cybercrime and data mismanagement, safeguarding of ‘personal information’ data is now central to good governance. To mitigate and manage this, legislators have rushed to introduce organisational requirements to facilitate safeguarding. Confirmation by the South African State President (Cyril Ramaphosa) that the Protection of Personal Information Act no. 4 of 2013 (POPIA) would come into effect from 1 July 2020, has catapulted the issue centre stage and galvanised the industry. After years skirting around the issue, all responsible parties now have a deadline to work towards. THE GAMING operations industry is responsible for retaining significant amounts of personal information. This includes material pertaining to patrons, employees, tenants and suppliers. South African Gaming companies have operations spanning the continent and the threat of information crossing borders is an additional complication. It is now more imperative to ensure correct compliance, the issue should be at the top of all Board agendas. Synopsis of POPIA The Act defines responsible parties as “a public or private body or any other person which, alone or in conjunction with others, determines the purpose of and means for processing personal information.”

The purpose of this Act is to give effect to a person’s constitutional right to privacy, by safeguarding personal information whenever it is being processed by a responsible party. This is subject to justifiable limitations which includes a balance between privacy and the right to access information as well as the free flow of information across borders. The Act specifically prohibits a responsible party in the Republic of South Africa from transferring personal information about a data subject to a third party outside our borders, unless the recipient of the information is subject to a law, binding corporate rules or a binding agreement which provides adequate levels of privacy protection.

Responsible parties are required by the Act to adhere to eight conditions to ensure the lawful processing of personal information. Briefly these conditions cover: • Accountability that all conditions set out in POPIA have been complied with when determining the purpose and process to be utilised when dealing with personal information; • Processing limitations require that personal information is obtained lawfully and can only be processed by the responsible party after receiving the data subjects consent; • Purpose specification stipulates that personal information must only be collected for a specific purpose related to a function or activity of the responsible party and this information must not be

retained for longer than required; • Further processing of personal information is only permissible if it is still compatible with the purpose of the initial collection; • Information quality is imperative, and the responsible party must ensure that they have implemented steps to ensure that the information is complete, accurate and update as required; • Openness by the responsible party to the data subject as to where and why their personal information is being retained; • Security safeguards must be implemented by the responsible party to ensure that the personal information entrusted to them or a third-party operator remains confidential; and • Data subject participation is permissible in that they can confirm what personal information is retained by a responsible party and request corrections to be processed against previous share information.

needs to be registered as such with the Regulator. Step 2: A POPIA project plan should be developed to ensure that a structured approach is adhered to when tackling this piece of legislation. Key milestones should be set and progress against these targets should be reported to an organisation governing body. Step 3: Obtaining an understanding of what personal information is held and retained by performing data mapping activities. Data mapping allows the organisation to understand what data is being collected, the location of data, potential risks, and controls in place to protect personal information.

Practical steps to compliance Given this brief synopsis of the Act what practical steps should responsible parties be taking to begin or further their compliance journey keeping in mind that the deadline of 30 June 2021 is fast approaching.

Step 4: A Compliance Risk Management Plan (CRMP) should be compiled for POPIA, allowing the responsible party to assess their compliance status with applicable sections. This will highlight potential control gaps that need to be addressed to ensure compliance with the Act.

Step 1: The Act requires the appointment of an Information Officer (defined as the Chief Executive Officer or any other duly authorised person). The Information Officer will play a pivotal role in establishing compliance protocols, monitoring compliance, and dealing with any Regulator queries. This individual

This would include updating existing policies that link to the collection or retention of personal information. Organisation awareness through training

programmes must be rolled out to ensure that all employees are made aware of the need to protect personal information. Step 6: Continual monitoring of compliance to POPIA should form part of any organisations Compliance Functions plans. In addition, independent assurance should be obtained as to whether key controls are functioning effectively. Implication of non-compliance The POPIA holds responsible parties accountable, should any personal information entrusted to them be lost, abused or compromised in any way. ‘Reputational’ damage combined with the threat of significant financial and legal penalties (a fine or imprisonment, or in the most extreme cases, both) for responsible parties is a frightening proposition. The deadline and implementation phase is fast approaching and is being viewed with much trepidation. Levels of prosecution and the magnitude of likely penalties for non-compliance remains unknown. However, affording an organisation increased security and all responsible parties a heightened level of comfort (through improved processes and good governance) with strict compliance is both possible and obtainable. Kenya Parliament Amends Gaming Bill to Permit Gambling Mobile Money Payments The Kenya National Assembly’s Sports, Culture and Tourism Committee has revised a section of the country’s Gaming Bill 2019 which bars gamblers and betting companies from undertaking mobile money or cash transactions. As part of the amendment, mobile money services will now be accepted by gaming operators as an authorised means of payment. The Kenya Parliament introduced the Gaming Bill in 2019 to monitor the system of gambling operators by imposing hefty payable taxes, a mandatory 30% local ownership and disallowing gaming ads. A SECTION of the bill had explicitly stated that licensed gaming operators could only receive payments from players via credit/debit cards, electronic bank transfers or any other method approved by the board. Mobile money platforms were not listed as one of the accepted modes of payments in a rather surprising development considering that mobile money platforms are predominantly used to process payments across Kenya. The country has about 58 million mobile money subscribers – 4 million more than the entire Kenya population of 54 million. This is reflective of how widely adopted mobile money services are in the country, with many people running multiple mobile money accounts. While the amendment has now effectively recognised that statistic, the Kenyan Legislature is, however, proposing the prohibition of credit/debit card payments by gamers. The amendment of the 2019 Gaming Bill is perhaps part of the Kenyan government’s plan to generate more M-Pesa revenue from its legalised billion-dollar gambling industry. A 2019 PwC audit revealed that Kenya is Africa’s third-largest gambling market behind only Nigeria and South Africa. Leaked data from the country’s betting regulator shows that over KSh360 billion ($3.6 billion) was spent on betting in 2019. Kenya’s gambling market is heavily dominated by sports betting on mobile phones. According to GeoPoll, 88% of gamblers in Kenya have placed bets using their mobile phones. Betting in Kenya is mostly done via mobile phones and leading mobile money operator, M-Pesa owns up to 99% of the mobile money market share in Kenya. The platform offers financial services to about 42 million subscribers in the country. Earlier this year, M-Pesa’s intellectual property rights were acquired by Safaricom and Vodacom from Vodafone in a joint venture deal. The Kenya Government owns a 35% stake in Safaricom – which recorded about 20% rise in full year profits to $747 million following the acquisition.

M-Pesa’s performance has been pivotal to the growth of Safaricom and the government cannot turn live in denial of that fact. With the acceptance of mobile money to process gaming transactions, M-Pesa will predictably be the preferred platform for gamers. This will lead to increased usage and increased revenue for the mobile money giant. It also means that the government’s 35% stake will be worth much more than it is at this time. It appears that the proposed ban on credit/ debit card payments by gamers is part of the government’s strategy to clamp down on M-Pesa competition. Gamers will be left with only the alternative of bank electronic transfers which are generally slower. Therefore, it is clearly in the government’s best interests to accelerate M-Pesa’s growth in the country. The Kenya parliament has raised the minimum bet for online gambling by 100% from KSh50 to

KSh100. According to the legislators, the move is an attempt to “discourage” gambling and crack down on illegal gambling in the country. The growth of Kenya’s gambling market has attracted a lot of interest which has led to the creation of a variety of unlicensed gambling centres. Last year, several gambling machines were imported into the country by unlicensed operators. The government had sought to control this by banning importation of slot machines and increasing the minimum gambling/betting amount to KSh59 from KSh20. However, unlicensed operators have found a way to bypass these laws by sourcing locally made machines. Although the Kenya government has said it doubled the minimum betting amount to suppress illegal gambling, it also seems part of its strategy to free up the market share held by unlicensed gambling operators.

SARGF Hosts Webinar for Responsible Gambling Month THE RELATIONSHIP BETWEEN PROBLEM GAMBLING AND GENDER-BASED VIOLENCE

THE MONTH of November mared the 5th year of the National Responsible Gambling Month (NRGM). During November, and up to 16 December the South African Responsible Gambling Foundation (SARGF) educates the public about the potential harmful effects of problem gambling whilst offering free treatment and counselling to those negatively affected by gambling disorder. The COVID-19 pandemic has had a devasting impact, not only from a social point of view but also from and economic point of view, with a contraction in economic activity as a result of the lockdown many South Africans, have had to either take salary cuts or retrenchments and this has put an immense strain on household income and relations within the home. The South African economy shed 2,2 million jobs in the second quarter of 2020, according to the latest Quarterly

Labour Force Survey Quarter 2: 2020 results, released by Statistics South Africa on 29 September 2020. With tough economic conditions and slow economic growth in South Africa consumers have less disposable income for necessities like school fees, groceries and other household amenities and many consumers may be looking for alternative ways to grow their income over a short period of time. “Taking a risk and gambling to increase your income quickly when you can’t afford it often leads to devastating consequences” says Sibongile Simelane-Quntana, Executive Director, SARGF. As such this year SARGF chose the theme for National Responsible Gambling Month as “Minimising the Potential Harmful Effects of Problem Gambling: The relationship between problem gambling and gender-based violence.” Data gathered by SARGF from international studies indicate that social consequences of problem gambling are affecting both males and females. The majority (67%) of females participating in gambling are divorced, compared to 33% of males. Other social consequences affecting both genders are child abuse, pain and suffering, and loss in quality of life. In addition, the majority of males are involved in domestic violence (62%), as compared to females (36%). Those involved in gambling may end up in large amounts of debt, which can lead to violence or crime to repay the monies owed, therefore creating a spill over effect

upon families, society, the police, and work. Divorce, domestic violence, abuse, suffering, and loss in quality of life, as shown in the table below above, are the major social consequences of gambling across all races. Only those of mixed race and Whites indicated no divorce. It is clear from the data that we have gathered there seems to be a relationship between problem gambling and gender-based violence, and during this month we will be discussing and unpacking different aspects such as the extent to which South African legislation protects families from problem gambling, the relationship between problem gambling and family violence, reporting gender based violence and how the legal system handles gender based violence complaints as well as the reporting and sensitivity of gender based violence in the digital and social media age. “This November and going forward we encourage South Africans that do gamble to continue to do so responsibly and to be aware of the warning signs and the potential harmful effects of problem gambling. This can be done through practicing small habits such as setting a time limit when you gamble and stick to it, keep track of amount of money you are spending and set a limit on the amount you are prepared to spend on gambling, When you are gambling take regular breaks and think about when is a smart time to stop.” Concluded Simelane-Quntana.

Eastern Cape Gambling Board CEO Elected as IAGR President The Chief Executive Officer of the Eastern Cape Gambling Board (ECGB), Mabutho Zwane has been elected as President of the International Association of Gaming Regulators (IAGR).

THE ASSOCIATION which has its headquarters in Las Vegas, Nevada, USA, held its annual general meeting virtually, where Zwane was confirmed president. IAGR works to advance the effectiveness and efficiency of gaming regulation throughout the world and provides a forum in which gaming regulators from various countries meet, exchange views and information and also discuss policy issues. In addition, IAGR creates a means of fostering cooperation between gaming regulators in the performance of their official duties and is a central point of contact for inquiries from governments, gaming regulatory agencies, personnel, and representatives of the international gaming industry. This comes at a time when the (ECGB) has just received its 6th consecutive clean audit outcome from the Auditor General South Africa (AGSA). Zwane, said, ‘I am honoured and excited by the opportunity to assume the role of IAGR president, especially at this particularly important time where there is a significant opportunity to leverage technology to bring global regulators together and to drive regulatory practice. His election puts him in a position to be in constant engagement with international regulators and will expose the ECGB and the province to benchmarking opportunities and provide the ability to share knowledge and gain insight on industry trends, especially post the Covid-19 pandemic which is expected to drive significant changes in the gaming sector. Adv. Ncumisa Mayosi, the Chairperson of the Gambling Board congratulated Zwane on his election and emphasised the need to continue improving gaming regulation and noted that having a representative in an international platform will surely go a long way in ensuring that as the board we do just that. This is the third time that a South African Gambling Executive is elected to this critical position of President of IAGR.
