It is another exciting magazine that we are proud to bring to the shelves and this edition we are also extending our distribution to Dubai and Abu Dhabi, as well as Bangkok Suvarnabhumi Airport. Our mission has always been to support the Islands development by providing quality content and practical information for those working, living and investing in an Island with a strong and bright future. Functional Bathroom Design Ideas for Cosy Homes
Designing a small but perfectly functional bathroom might seem like a difficult task, but it might be the design challenge you’ve been looking for and one you can proudly showcase to your friends. Creating a functional and storage-friendly bathroom may be just what your home needs. Every part in a small bathroom should have a functional purpose and in some way or another help to create a space-saving sanctuary.
1. Finding Storage Space Don’t hide them away, but showcase your colourful, textured towels in open shelving. This will add warmth and playful colours to your space and eliminate unwanted large furniture pieces. Or: • Use Stackable floating shelves to add storage in a fashionable way. • Colourful storage ladders showcase personality and are a great place to store almost everything. • Sink skirts add flair and hide cleaning products. • Wooden crates can be stacked, drilled into the wall or placed on the ground for accessible storage and give a funky retro look to your bathroom.

Beginners Guide to Property Investment in Thailand As the popularity of Koh Samui and Koh Phagnan has continued to grow, new visitors looking to invest in their own piece of paradise can easily make mistakes. When these new investors make quick decisions to secure what seems like a dream estate, they may fall victim to some easily preventable legal challenges. Any person considering making an investment in real estate in Thailand is advised to follow a more methodical process before completing the transaction, in order to prevent that new home from becoming a long-lasting headache.
Land Due Diligence Before an investor signs on the dotted line, the new investor should make sure that the reservation agreement or other sales contracts include a language that allows the investor to conduct land due diligence before the transaction becomes fully binding. It is important for the new investor to understand what it is they will be purchasing, whether the seller has the authority to sell the investment to the investor, and whether the land is legally issued and zoned for the proposed real estate investment.
Land Titles
It is strongly recommended that investors engage a law firm to conduct a full title search of the historical evolution of the target land. This will involve a physical investigation at the local land office in an attempt to trace the land back to its original possessory title of Sor Kor 1. In Thailand, there are various titles including the following, non-exhaustive list: Sor Kor 1; Nor Sor 3 Kor; and Chanote. The Chanote, (Land Title Deed) is the superior land title, representing true ownership in land; while Nor Sor 3 Kor (Certificate of Land Utilization) represents a mere right to utilize the land, although it is often treated like true ownership by financial institutions. Next, assuming the property in question is held under adequate title, you should ensure that the title itself has been legally issued. In Thailand, for instance, Chanotes have generally originated from Sor Kor 1 (i.e., the government originally issued a Sor Kor 1 on the land, and that Sor Kor 1 was upgraded to Chanote). Therefore, it is prudent to investigate whether a Sor Kor 1 was issued in the past, which can be done at the local land office.
Access
You should also ensure that the property has access to public roads and utilities, which can be done by checking aerial maps at the land office. It is not atypical for a parcel of land to be connected to a public road vis a vis a smaller, concrete road, and yet still lack legal access rights. In other words, the smaller concrete road crosses private property without any legal entitlement and the legal right of access should be obtained before your full investment in the property.

Zoning and Encumbrances
It is prudent to investigate what activities are permitted and what structures may be built on land before acquisition. The islands are divided into a number of different regulatory zones, restricting the height and footprint of structures, prohibiting certain business and other activities while promoting yet other activities. Ideally, if there is a structure currently situated on the property, it should comply with the zoning regulations and be subject to a valid building permit, which should be located at the land office. In other words, make sure that zoning allows the type of real estate property and that the construction permit covers the intended design. This has become an increasingly important issue in Koh Samui and Koh Phangan and it should be reviewed carefully before a purchase is completed. Similarly, you should investigate whether there are any mortgages or other encumbrances over the relevant land and/or building; and whether the current owner is subject to any litigation that may relate to the land. If you opt to acquire shares in a Thai land holding company, it is recommended that you conduct further due diligence into that company by inquiring into whether the company (amongst other matters) is involved in any litigation; is in good standing with the relevant authorities; has any outstanding liabilities, debts or taxes; and has filed all of its accounts.
Read Before Signing If the due diligence produces agreeable findings, you should execute a binding contract with the seller, obligating both parties to complete the transaction. For both parties, this entails a significant economic decision and, typically, may involve a long term management relationship between the investor and the seller. Therefore it is crucial that the relevant contract is carefully worded to protect your interests. Without delving into every detail of the types and terms of sales agreements, the following issues should be considered: (1) ensuring that the seller provides significant representations and warranties regarding the legality of the title, access to public roads, adherence to zoning and other regulations, and similar matters; (2) including adequate default provisions, to provide remedies if a party breaches the contract; and (3) including a clause that bestows your rights upon you successors, assigns, and heirs, particularly in the event of a long term leasehold agreement. This article is intended to provide a brief overview of the general steps any investor should take before investing in real estate in Thailand and is not intended to be used as a do-it-yourself guide. As in any jurisdiction, it is important to seek independent legal advice in order to address your specific proprietary interests and testamentary wishes.

Thai Condo Re-Finance in 3 Weeks Koh Samui is most often referred, as a Hotel & Resort or Luxury Villa based real estate market which of course comes with its more favourable luscious greenery and turquoise sea colour with white sand beaches… Over recent years it has begun to develop a few decent condominium ventures which perhaps offer a different dynamic to our Thai, Paradise Island. Aside from a hotel, resort and luxury villa, a foreigner is often tempted to part with their hard earned Cash, for a condo purchase. This is an easier legal structure to understand in comparison to a villa. In essence, a Foreigner name is written on the back of the Chanote (title deed/ownership document) which is registered at the relevant districts land office. Even though the writing is of course in Thai, the foreigner's name is translated and inscribed on a legal document as proof of ownership. There is no extra legal structure involved such as a Thai company, which is commonly used for a villa or hotel ownership since foreigners are not able to own land (in general). The only catch when making a condo purchase is that the land office will in most circumstance require paperwork, such as a FET/ Foreign Exchange Transaction Form/ Tor Tor 3, to show money was remitted or exchanged from another currency in order to make the purchase. i.e. A Foreigner is bringing money into Thailand to buy the condo which in theory would then in turn help the Thai economy with cash inflows. Without this paperwork, the land office may not transfer the title into a foreigner name. For some who live and work in Thailand and earning in THB currency, often is the case where transfers are made out of and then back in, to Thailand, just to acquire this paperwork.
Once the condominium has been transferred and things are going according to plan with life, a foreigner may wish to use this condo as collateral in order to obtain a mortgage. Perhaps to provide a cash injection into their business or, make a further investment in property or, even splash out on a luxury yacht etc.... The choices are endless. This may sound straight forward enough as after all, if you have demonstrated the ability to purchase a condo with cash in the first place, it surely must be easy to obtain a mortgage and service the loan with monthly installments…. A Thai bank would surely jump at the chance… The Bank of Thailand (BOT) restricts lending to Foreigners therefore, it may be found difficult to obtain finance. In addition to this, if you do actually find some finance, it may also be restricted to just 1-3 properties as any more, is usually again restricted by the BOT, even for Thai people too. This is where a reputable finance company and not a Bank can come into play. There is no major restriction and simply a pot of money to lend for the right collateral. There are well versed and managed financial institutions in Thailand, which offer flexible mortgage refinance on condo’s around the Kingdom, a niche market which helps fill the void left by Thai Banks. Whether a condo for that weekend in Bangkok to get away from Samui’s Island life OR, perhaps a condo for the family in another province, finance can and is, made available on a daily basis! The good thing about a condo is that when you have seen one unit in a building and understand construction specifications along with understanding the building strengths and weaknesses in comparison to other condo buildings,
a guesstimate could be made that all other units in the building offer a similar standard of risk and liquidity to a lender thus, making it easy to approve a collateral to make a loan against it. i.e. A newly finished condo near Choeng Mon Beach on Samui is almost guaranteed that each unit in the building will be similar with its specifications therefore, if a lender will lend on 1 unit, they will most likely lend on all units in the building at a similar level, it’s just a case of pre-approval. The building is given an “approved list” status and all units in a building are given easy finance status. The good news with a finance company (as opposed to a bank) is that work permits, residence, Thai income and Thai wives (all common requests) are usually of irrelevance since a mortgage could be granted using the condo title as collateral, rather than the borrower’s ability to repay the loan or Thai connection. That being said, a lender would of course still wish to see regular income or an ability to repay the loan since a lender is after all, a lender interested to make “interest income” rather than interested to collect a property portfolio of bad debts. The magic question is how quick the finance can be granted?? ..Nothing is ever simple, quick, and easy along with user friendly… Is it?... A most recent example is where a Hong Kong investor, who bought a unit in Bangkok several years back, has decided they would like to free up some cash from “The River” Condo based at the Chao Phraya River in the big city of Angels. On a Monday afternoon, while the Hong Kong investor was overseas, they made contact with a lender in Bangkok to confirm what paperwork is needed. The case was pretty straight forward as ticked all the “easy to approve” boxes (though of course, not all are easy). A single person, salaried employee of a sizeable company, decent income & no bad credit record! Our investor submitted the following while overseas via email and then by courier: • Loan Application Form • Business Card • Passport • 12 Month Bank Statements (where income deposited) • Letter from Employer to confirm Income, Position and Start Date • Credit Report • Condo Title Deed • Condo Purchase Agreement (from several years ago) • Condo Common Fee Receipt (to show bills paid and up to date) • Valuation Fee (for this case THB 7,490 on a 108 Sq.m. unit)
A loan size of, no more than 50% of valuation with terms and conditions of 8.9% interest were all agreed on the phone that Monday afternoon, along with a timescale of 3 weeks start to finish & before a meeting in person took place between the lender and investor. Later that same week by Friday, a valuation report was in the lenders hand along with all supporting documents sent by courier from Hong Kong. After the weekend, Monday, the loan was submitted for approval & by Friday, the loan was approved. After another weekend by Monday afternoon, a loan agreement was signed after the investor flew in from Hong Kong and a mortgage date booked for later that week, Friday. Less than 3 weeks from the initial telephone contact, a cashiers cheque is deposited onto the clients Thai bank account for up to 50% of the condo’s value and the client wasn’t even in Thailand!! The client had proxy the lender to carry out the mortgage at the land office on their behalf. In total, the client was in Thailand for a weekend on holiday and then just one Monday to sign a loan agreement. The whole approval process and mortgage registration was carried out without the client even being in Thailand. By now, the client has already spent the cash deposit and happily servicing a monthly loan installment via direct debit. Whilst this is a simple case and is easy when the client understands finance terms, is able to commit to providing correct / readable paperwork in a timely manner and most importantly, the lender has been, seen and lent on the condo building before, a quick loan process could almost be expected and I would certainly be disappointed to expect anything less. In summary, whether you are a resident on our beautiful island of Koh Samui OR live elsewhere in Thailand OR overseas, when you own a condo in Thailand and would like some cash back out of the property investment, a lender could provide up to 50% (some cases 60%) of its value pretty easily, if along with the property you, tick the right boxes and all, within a short timescale. A minimum loan size of THB 1,000,000 may be required.

lmost two decades ago I met with a young man that had just opened a very intriguing restaurant & art gallery (then it gradually turned itself into a full interior design company later on) in the South of Chaweng on Koh Samui. The shop was called Oriental Gallery opened by entrepreneur Mr. Michael Dietvorst and I remember spending a while talking to this enthusiastic young man about his business and lifestyle. Kitchen Hydroponics If you are looking for an easy homemade kitchen hydroponics system rest assured that a hydroponics system does not have to be complex, difficult to build or require an array of pipes and pumps. It can also be small enough to fit easily into a kitchen. Here is a free plan for a simple but effective and easy-to-build ebb and flow, or flood and drain, kitchen hydroponics system. It requires no electricity except for lights if you don’t have enough natural light in your kitchen. Requirements for this easy homemade kitchen hydroponics flood and drain system are minimal. You need: • • • • • •
Two large buckets, about five gallons each A few feet of flexible half inch tubing Some clean gravel Some fine mesh plastic screen, like window screen Grow medium of your choice A platform for the apparatus to stand on
One bucket will hold your kitchen hydroponics garden, the other your nutrient solution. Make sure both buckets are clean and then cut a hole in each one about half an inch from the bottom. A drill and bit works well for this.
Connect the two buckets with the tubing. Be sure you have enough tubing so that you can lower your nutrient bucket to the floor while leaving your plant bucket on the top of the platform. Check for leaks around the tubing. If the connection is not tight enough apply some silicone caulking. If you want to get a bit more sophisticated you can use a plastic hose coupling here. Next put about two or three inches of gravel in your grow bucket – the bucket that will hold your kitchen hydroponics garden. Lay your screen on top of the gravel. The purpose of the screen is to keep any debris from your grow media from clogging the tubing so it should fit tightly against the sides of the bucket. Now add your grow medium to the grow bucket. Perlite will work well here but there are many other types of grow media such as coconut fiber available – the choice is yours. Now you are ready get growing with your kitchen hydroponics system – plant your seeds or seedlings. At this point your grow bucket should be on the top of the platform and your hydroponics nutrient bucket should be on the floor beneath the platform. Fill your nutrient bucket and then lift it onto the platform. The nutrient solution will flow through the tube and flood your plants. After the grow medium is well-soaked place the nutrient bucket back on the floor and the solution will flow out of the grow bucket, draining your plants. You will need to flood your kitchen hydroponics garden several times a day, depending on the type of grow medium you have chosen and environmental conditions. You should keep the nutrient bucket covered to keep foreign matter out and be sure to give it a good stir occasionally to keep it aerated. Alternatively you could aerate the nutrient solution with an air stone and aquarium pump. This easy homemade kitchen hydroponics system can be located in a roomy kitchen so you can harvest your herbs or vegetables as needed.

Indoor Sports Gymnasium Opens at the International School of Samui Campus The International School of Samui (ISS) has in 2016 seen the opening of a state-of-the-art indoor airconditioned gymnasium. The new sports hall is an exciting development for the island as the spacious hall offers year-round use for ISS students of ISS and is a welcome resource for community sports programs. The hall caters for numerous activities including badminton, netball, basketball, 5-a-side football and volleyball. Furthermore, gymnastics classes, martial arts and dance programs are offered on a daily basis by professional coaches. There is currently a Saturday Futsal (Brazilian skills-based football) Academy run by an experienced coach. The new sports hall has also become an important resource for ISS pupils focusing on team sports and sports competitions in a safe, clean and climate controlled environment. The gymnasium offers a bright and airy facility which readily fits into the International School of Samui’s enriching environment. The sports hall is built to European standard and the flooring is made from a polyurethane structural layer that is strong, durable and free of mercury, lead and heavy metals. ROCKS or The Rotary Club of Koh Samui have been busy at the start of the year with two two Fellowship dinners. The January event saw a return to the Top Ten Restaurant in Chaweng, and February saw a first visit to a new venue the Royal Muang Resort in Choeng Mon. Both were very successful events with attendance over 70 for both. ROCKS are happy to update you on the progress of their main project, the Special Needs School. Friends of Rotary may recall that last year ROCKS contributed just over 500,000 Baht to pay for the Roof, drainage systems, and windows for the school. With the activities in late 2015 and the first part of 2016 ROCKS have now saved enough to fund the doors at a cost of 192,000 Baht. This is one of the final large packages of work, and progress on the school is progressing well. It is hoped that the school will open in the next few months. In addition to this, ROCKS received a donation from a sister Rotary Club in Canada of 50,000 and we have committed this to buying furniture for the classrooms as soon as the school is ready. Owning or even renting a house or apartment means at various times through the year you will need to complete maintenance tasks. Many of these basic tasks can be minimized or reduced by going through a basic maintenance schedule over the year. In plain English you are checking and inspecting the property and avoiding breakdowns and malfunctioning equipment by keeping it serviced and up to date.
What Do You Need for a Maintenance Schedule? Materials • A yearly calendar (paper or digital) • A copy of your rental agreement or lease if required • Your smart phone or computer
1. Which Maintenance tasks are needed in your home
OK everyone’s home is different so start by checking your rental or lease agreement if you have one or any local house owner information for tasks that are required through the year. Go through all your rooms and outside areas and check off all the equipment you have and estimate how often you consider it’s a good idea to check. You can also search online or use some of our suggestions below.
2. Arrange the tasks on your list by how often they need to be done

List the materials you'll need to complete these tasks in the reminders (like making sure you buy batteries for smoke detectors) so you don't end up skipping anything! And that's it! Creating a home maintenance calendar in one sitting in the beginning of the year is a simple thing you can do that can have a huge and positive impact on your home for the rest of the year.
A sample list of home maintenance tasks to add to your calendar: (But please remember, these are just suggestions. Your home might need more, less or different tasks to keep it in shape all year!)
Once a year • Perform professional air conditioning inspection. This is a job specifically for someone that has been trained to inspect, clean, and repair air conditioning units. The best time to schedule annual maintenance is in the spring before the weather warms up so that you will not have any problems in the summer when you need it the most. • Hire professional to conduct a termite inspection. While you can check around your property once a month for any indication of termite or pest damage. Even if there are no obvious signs, it is still best to schedule an annual inspection by a termite professional that has a better eye for any unwanted inhabitants.
• Power-wash the external walls of your home. This will help to remove excess dirt, dust, and debris that can dull the appearance of your home and eventually begin to adversely affect the paint and exterior materials that protect your home. • Get your roof inspected by a professional. The person you hire should look for leaks, loose shingles, or broken tiles. You can also – unless you are afraid of heights – go onto your roof and do this yourself or just clear it of any broken tree limbs or other debris. Other tasks that you may want to consider handling on an annual basis include the following projects: • Seal cracks in the stucco or replace any siding that shows signs of wear and tear. • Reseal any flooring, such as marble or tile, and any countertops, such as granite. • Get your septic tank cleaned. • Check your fire extinguishers and replace, as necessary. • Clean your clothes dryer vent and hose of any lint that represents a potential fire hazard.
Every six months • Late Spring and Late Fall: Reverse ceiling fan direction, if possible. • Check/change batteries in smoke and co2 detectors • Clean exterior dryer vent • Vacuum fridge coils • Wash windows • Do a home safety check where you test smoke detector batteries, check all locks, and look for things like loose knobs, shelves, tripping hazards and more.
• Seal any decks or woodwork around the home. All outdoor wood structures should be inspected, treated, and sealed once a year to give them a longer life. This would include any decks, stairs, and railings. It is important to clean off any mildew or moss and treat the wood for water stains, mildew, and fungus before it is resealed for the coming rainy season.

• Clean rain gutters. Leaves and debris should be cleaned out during the fall season after the leaves have fallen. In particularly bad weather, you may have to check it again during inclement weather as well as in spring time.

LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain
RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.
RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.
LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.
GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.
SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.
SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.
LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)
STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area. STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.
STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.
STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.
In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
