EDITOR'S LETTER Welcome to our Samui Phangan Real Estate Magazine Edition 89 December January 2020, one of the favourite times of the year on Koh Samui for both business and tourists. This is also the exact time of year that I first arrived on Samui, 27 years ago. Been asked a few times recently about “My Story” and how long I’ve actually been living and working in Thailand. Well after leaving the British Army and living in Germany I had a pretty good job and lifestyle. For our annual big holiday Thailand was chosen as the destination and we landed in Phuket. Great place and we liked it but friends had advised us to make sure we visited Koh Samui, telling us tales of an amazing tropical island a little bit off the beaten track. Well a crazy minibus ride took us over and it was love at first site. It seemed to be a dream come true and it wasn’t long before our thoughts were moving rapidly from coming back soon to actually moving here. Which we did 3 months later, moving into a beach bungalow in Chaweng Noi. I completed all my diving courses with Tim and Brian from The Dive Shop and starting working as a Divemaster then Instructor. And yes, it was different then, Samui was still the little-known secret and there were no traffic problems and no developments and the only shopping choices were local owned supermarkets. The nearest big superstore was Big C in Surathani, which meant a ferry ride and a full day’s trip to get there and back. I loved those days and I do miss that Samui. Progress was imminent and slowly but surely Samui became well known and with Bangkok Airways beautiful tropical airport very easily reachable. Now it is one of the most famous tropical islands in the whole world. The quiet secret island is gone but progress does have advantages with beautiful developments, fantastic shopping opportunities and 5 star hospitals and infrastructure that we all need. So yes, I do miss the old island but the new Samui metropolis has so much more to offer, just turn the pages to see how beautiful it would be to live here. Living & Loving Samui CJG Paton-Smith

Wat a Thai Temple Thai temples, known as wats, are very distinctive. The word wat actually means a school, but is used only to refer to temple complexes. The Phutthawat is what we think of when we see the word temple. It is where all of the main religious buildings are contained. The Sanghawat is the living area for the monks. With over 30,000 in the country and 400 in Bangkok alone there’s always a new one to discover. But understanding the meaning of their design and architecture helps to appreciate their beauty even more. Buddhist temples usually feature steep, multi-tiered and richly ornamented roofs, with carved serpents, fierce-looking guardian statues, murals and a lot of course lots of gold. The temples are often compounds of buildings each with a specific function, and some are practically mini-cities, home to hundreds of monks. Here’s what to look out for:
Images of Buddha The heart of any temple, you’ll find Buddha rendered in different artistic styles, poses and materials. The Emerald Buddha, a 66cm statue carved from green jade atop a gold altar in Wat Phra Kaew in Bangkok’s Grand Palace, is the most sacred shrine in Thailand. Carved in the 14th century, the statue is regarded as a key national symbol. It spent over 200 years in Laos, before being returned to Bangkok in triumph by King Rama I in 1784. It’s dressed in costumes for each season of the year. Bangkok’s biggest and oldest temple, Wat Pho, is the home of the Reclining Buddha, a gold leaf-covered statue of Buddha lying on his side over 15 meters high and 46 meters long. Check out his feet, where panels depict 108 symbols of Buddha, from flowers and dancers to tigers. At Bangkok’s Wat Traimit, you’ll find the Golden Buddha, a three-meter high statue in solid gold, weighing over five tons. Hidden in plaster for protection, the 700-year-old statue was only revealed to be made of gold in 1957, when an accident cracked its shell. Vihara This is the part of the temple where important Buddha images are housed. Chedi A chedi, or stupa, is a conical or bell-shaped structure adorned with gold but usually made from stuccotopped brick or laterite underneath. It will usually contain either a relic believed to be from the Buddha, like a bone, or the ashes of deceased royalty or monks. Temples always have at least one chedi as a homage to Buddha, but often they have many. Chedi come in many styles, ranging from domes—a style borrowed from Sri Lanka—to square or octagonal shapes in northern Thailand, to corn-cob shapes called prang, typical of Cambodia’s Khmer temples like Angkor Wat. A 73-meter four-sided prang at Bangkok’s Temple of the Dawn, Wat Arun, is covered with a mosaic of Chinese pottery fragments with decorative motifs. Nagas Nagas are mythical serpents that guarded Buddha during his meditation in the forest in northern India, and often appear on handrails at temple entrances. You’ll also see nagas decorating temple roofs, the tail at the roof peak and the body winding down to the head, rising at the roof edge. Yakshas Giant warrior guardians that ward off evil spirits, these ferocious-looking statues have faces painted in wild colors, with fangs, wide-open eyes, and bodies that are a riot of decoration. The yakshas at Wat Big Buddha are certainly worth seeing with great photo opportunities. Lotus A symbol of religious perfection and transcendence, the lotus flower most often appears as the throne Buddha sits on, meditating in the lotus position. The lotus often adorns temple gates and posts, veranda columns and chedi spires built in the 13th century, when Sukhothai was Thailand’s capital. The heart of every person is like an unopened lotus, which blooms after reaching enlightenment, according to Buddhism. Ubosot The holiest prayer room in the temple, where monks are ordained. It’s not connected to other buildings, and is marked off by eight stones with a similarity to bodhi leaves (Buddha achieved enlightenment under a bodhi tree).

How to Plan
and Start a Home Decorating Project This is going to be exciting, but where to start? Ask yourself, are you after a simple refresh or an entirely new look for your home? Either way you are going to need a plan...and a budget. The easiest option and the cheapest is to give your home a new lick of paint. If your furniture is modern go for a neutral colour, if it is oldie worldly go for a colour of which there are infinite choices, and of course, you can mix your own colours. You can choose a colour from something decorative like cushion covers or a favourite art piece and use hues of it on the walls, in patterns, on upholstery and in the accessories. Decide on your budget and commit your ideas to paper. Planning is everything. This is an important stage so do not rush it. Making a plan, is a lot of fun

and gives you the opportunity to change your mind or adjust your plan at a later stage. Include a mood board (Mood boards are a visual collage to illustrate the style you wish to pursue). A mood board will help you to identify the style elements first and bring them into your space. Your mood board should include a colour palette, materials, and a concept that defines your style. Bromeliads (Urn Plant) these are ornamental plants with beautiful flowers, slow-growing, easy to care for, and drought-resistant. They do well both where there is a lot and a moderate amount of sunlight. If one gets a lot of sun, the leaves become more and more colourful. Bromeliads give off oxygen during the night and absorb carbon dioxide, making them especially good to have inside especially the bedroom.
Staghorn Fern (Climbing bird’s nest fern) this fern has climbing roots and thick, green leaves covered with fuzzy hair. The leaf ends fork, resembling a stag’s antlers. For their beautiful and unusual shapes, and their moisturizing quality, they’re often used as ornamental plants. Fan palm (Palas Payung): the standout feature of the fan palm is its wide, spreading leaves, resembling folding fans. It can reach four meters in height. But be careful the leaves end in sharp, thorny points.
Hardy Gingers & Heliconia's Heliconias are an integral part of any tropical garden design. The form great back drops and screens with the large upright leaves. Most tolerate full sun which makes the large heliconias great for creating some shade for smaller under-story plants.
Shell Ginger (Alpinia zerumbet) Beautiful Ginger with large white and pink flowers and lush tropical foliage. Full sun to part shade. Fairly drought hardy. Heat hardy with enough water.
lobster-claws (Heliconia-Rostrata) Heliconia Rostrata (also known as hanging lobster claw or false bird of paradise) is a plant that has downwardfacing flowers, the flowers thus providing a source of nectar to birds, especially the hummingbird. Because of its unique heat hardy characteristics, it is often used in tropical gardens.
Heliconia Strawberries & Cream (Heliconia Psittacorum) Another beautiful small Heliconia for tropical gardens. It is suitable for full sun to part shade, heat tolerant and drought tolerant (although it looks best with regular watering). Flowers are stunning and brighten any garden heavy on foliage. Flowers for many months at a time.
Canna Indica (Cannaceae) Any Canna is a fantastic addition to your garden, every single Canna flower is a work of art, absolutely stunning. Canna indica is one of the toughest Canna's around, and is suitable for full sun to part shade positions. Very heat tolerant. Looks best with regular watering, but is very drought tolerant also.

An Introduction to TM30 and how it affects foreign tourists and long-term foreign residents. Many foreigners who regularly visit or reside in Koh Samui or Koh Phangnan would now have heard about TM30 and the reporting requirements placed upon landlords and foreign visitors; both tourists and long-term residents. Foreign visitors who are not yet aware of TM30 must be aware of it and comply with the obligations which it places upon landlords and foreign residents. This article explains TM30 reporting requirements, how it affects different types of visitors and explains the consequences of failing to comply. What is TM30? TM30 is a section of Thai Immigration law that relates to the reporting of the whereabouts of foreign nationals in Thailand. The law places an obligation upon the owner of a property to register all foreign nationals who reside at their property to the local immigration department. The TM30 law has been enforced in relation to hotels and guesthouses for many years, however, in the wake of the increased risks of terrorism in the world and as a means to better target persons who flaunt the immigration laws, the enforcement of the law has now been expanded to include foreigners who reside at properties other than hotels and guesthouses. Who is covered by the TM30 reporting requirement? All foreign visitors to Thailand are subject to TM30 requirements. In other words, anyone who offers accommodation must register their foreign guests to the immigration department within 24 hours of their guest’s arrival at the accommodation. Every guest must be reported not just the person named on the booking. For example, a family of four with two minor children must all be registered, including the children, regardless of the children’s age.

The vast majority of international visitors who reside exclusively at hotels and guesthouses during their stay in Thailand do not have any active obligation to comply with TM30 reporting requirements because the hotel or guest house is legally obliged to deal with TM30 reporting on their behalf. Foreign visitors residing at hotels and guesthouses, simply provide their original passport to the hotel staff upon check-in and the hotel complies with the relevant reporting requirements. Of course, not all visitors to Thailand reside in hotels or guesthouses and these types of foreign visitors are caught by the wider enforcement of the TM30 law. Accordingly, foreign visitors who reside in their own home, a private house, apartment or condominium; whether the home of a family member or friend are now obliged to make arrangements to ensure that they are in compliance with their TM30 reporting responsibilities. Who Is Responsible for reporting? Ostensibly, it is the responsibility of the owner of the property to register the foreign person(s) residing at their property with the local immigration department within 24 hours of their arrival at the property. If the foreigner is also the owner of the property, the owner is required to report themselves to the local immigration department within 24 hours of arrival at their own property. Even a foreigner who stays in a hotel for one night or travels overseas (even for just one day) must be re-registered with the local immigration department within 24 hours of returning to their principal residence. Fines of up to 1,600 Thai Baht can be imposed against property owners for every instance of non-registration of a foreign guest. Notwithstanding that it is ultimately the property owner’s responsibility to comply with the reporting obligation, it can often be the foreign resident who suffers the consequences of not having been reported. Often the owner of the property will not be aware that their foreign tenant or guest had travelled and may simply refuse to pay any accrued fines. The immigration office may refuse to renew long term visas if any outstanding fines are unpaid and therefore, it is ultimately the foreign resident who may suffer the consequences of the property owner failing to report them. How Can a Private Home/Apartment/ Condominium Owner report? There are essentially three way for a home owner to register their foreign guests: •
On-Line Registration System; The Property Owner applies for a username and password and registers each guest within 24 hours of arrival. Whilst this may appear to be the most convenient means of complying, the On-Line registration system can be temperamental and prone to crashing.
•
Registration in Person; The TM30 form can be downloaded, completed by the home owner and then filed in person at the local immigration office;
•
Registration by Foreign Tenant/ Foreign Guest; The foreigner can complete the TM30 form and then file it in person with the local immigration office. The foreigner will also need the written approval of the property owner to register themselves on behalf of the property owner.
It is advisable for all foreign persons who are currently not complying with their TM30 obligations to immediately take steps to comply to avoid fines and difficulties in renewing long term visa.

Condominium Mortgage Finance As Thailand continues to reach out, aiming for an upgrade into a high income class country, with deep links into expanding Chinese and Asian transportation networks, residential and condominium development continues to grow at an increased pace. Just when things appear to be slowing, all of a sudden a steady flow of new condo development launches take place aiming to set new standards on existing high end projects. Whether the big city of Bangkok or, the nearest seaside towns such as Pattaya/Jomtien or, Hua Hin, projects continue to spring up. When it comes to financing such properties, particularly for foreigners, Thailand holds a restriction which makes it difficult for easy local baht mortgage finance. The major hurdle is a requirement of having to remit money from overseas to buy condominiums (specific to foreigners) or at-least, make sure a currency exchange takes place from international currency to THB, in order for local banks to make a Foreign Exchange Transaction Form (FET). This paperwork is used to show the land office on the day of property transfer and almost always is required, to allow a foreigner to own the title deed of a freehold condominium unit. Now, if a local bank attempts to lend THB under Mort-

gage Finance terms and the proceeds are to be used to “purchase” a condominium, the land office will still require FET paperwork, so where does the paperwork come from IF the foreigner is using local THB to finance the purchase…? One solution to this conundrum is to obtain short term bridge finance from overseas or even finance from friends using foreign currency. These foreign currency funds are than used to purchase the condominium then, after the property transfer has taken place, obtain a cash-back/refinance loan depositing money onto a local Thai bank account then, remit back overseas or, to the friends again to repay any short term bridge finance used to purchase in the first place, all just to satisfy the FET requirement. A little bit of work involved of course however, for those truly determined to own a condominium unit in Thailand, does present an option for what limited other ideas are available. If one chooses to go with the above solution, than it is likely when buying an off-plan condominium, adequate planning goes into the initial stages to make sure mortgage finance will be available upon completion. Most lenders would tend to wait or hold off until a
project is finished before giving a full loan approval with contract since why would a lender approve a mortgage loan, when there is not even a spade in the ground yet to start construction and zero security yet high risk. There has however in the past, been one lender who would consider off-plan projects and even off-plan “Memorandum of Understanding to borrow” contracts, to allow some kind of pre-approval and planning. The most recent off-plan memorandum required a condominium to at-least be 50% finished although preferably closer to 80%/90% and then, a memorandum could be agreed. The idea is that a buyer of an off-plan project who was half way through off-plan installments or, when the project was nearing completion (within around 1 year), could gain some kind of initial approval of how much finance could be arranged upon completion. This way, overseas currency bridge finance talks could begin to take place as early as possible. Typically, a mortgage loan amount could be agreed in principal based on present work circumstances for up to 12 months or even slightly longer and then when it comes near to the actual mortgage date, paperwork updated just to check no major changes and with a final third party valuation carried out to ensure the value is in line with the actual purchase price or more. This way, when the time comes to final payment, adequate time and planning was done beforehand to bring money into Thailand then, within 1 or 2 days after the property transfer takes place, a refinance is carried out to give the money back so the buyer can repay any short term bridge loan. At MBK Guarantee Co., Ltd., part of the MBK Shopping Center in Bangkok, we have been producing off-plan memorandum loan contracts intermittently for almost 10 years and whilst various changes over the years have been implemented, we always strive to make sure some kind of solution is available where possible to finance a condominium unit. Typically off-plan contracts require a slightly higher than usual 3.5% set up fee paid up-front, with 2% refundable upon mortgage draw down providing within 12 months from loan approval. If require longer than 12 months loan approval, a further 2% set up maybe required for each year required. Interest rates are based on present day terms and could change over the off-plan period however at the time of writing, an interest rate of 8.65% (Kasikorn Bank MLR + 2.4% would be applied). Loan terms are for up to 10 years or aged 70, which-ever comes first. Both local and overseas income can be used to approve a loan. Maximum loan size is usually up to 60% of the valuation and would depend on the board’s preference and appetite to lend on any particular project. A low floor car park view with much noise may
be only 30% loan to value or could even be rejected altogether since might offer lower liquidity. Finally, as we are now in the December addition, I would like to take this opportunity to thank the Samui Phangan Real Estate Magazine as always, for another year of opportunity writing a column in our favourite Thailand tropical islands real estate magazine. There are three types of systems that get specified; On Grid, Off Grid, Hybrid. On-Grid Solar PV Systems - on-grid systems are connected to the utility, in Thailand that’s either the PEA (provincial electrical authority) or the MEA (metropolitan electrical authority). With these systems they will only work if there is a utility connection. If there is a power outage then your Solar PV System will shut down to protect workers working on the line (regulation). You will not be able to use your rooftop Solar PV during these times. These systems are low maintenance once installed and are good for customers with a high daytime power demand. Off-Grid Solar PV Systems - off-grid systems are mainly for rural installations, we do not do many of these as its not generally called for here in Thailand. Off-grid systems require a series of batteries to provide power for the installation and will also require some form of generator to keep the batteries charged during low sun days. These systems require a fair bit of maintenance and understanding of the various components. Solar Hybrid Systems - hybrid systems are a combination of the above two systems and are becoming mainstream, especially with the introduction of Lithium type batteries. These systems have a utility connection but do not shut down when the grid is down because they have batteries connected and keeping the system online. With these systems you can use your Solar PV Array during daytime power outages. You can use your batteries at night to reduce your dependency on the grid therefore reducing your monthly power bill and you have the battery capacity for emergency loads. The Sun charges your batteries during the day or if not enough sun (due to bad weather etc.) from the utility so you will always have power in your home.
What System Best Suits Your Needs? The selection of a Solar PV System comes down to your needs, what do you need a Solar PV System for; saving energy, being independent from the grid, having an emergency power supply? Depending on your needs and your budget you can then select the right system for you.
Benefits.. If you stay home most of the day and power outages are rare, you have an AC running, maybe a pool pump, refrigerators, washing machine and some lights and you objective is to reduce your monthly power bills then maybe an on-grid system will suit your needs.. If, taking the above scenario into account, but power outages are frequent and you need constant power for your work then a Solar Hybrid system would be better..
If you live remotely and are a bit of a ‘tech’ then maybe you can set up an off-grid system.. It all depends on your needs. On Grid systems are the most cost effective and there is a Feed in Tariff Scheme available (not so easy to apply for and the benefits are not that attractive), but if you main goal is to reduce your monthly power bill then this would be the best option. Off Grid systems would work out the most expensive due to component parts and the required additional power supply like a generator. Hybrid systems with Lithium Batteries are the most efficient but the costs are still fairly high, but you can always start small and add on more batteries as required..

What are the most common cooking techniques used in the restaurant? In what way has your past experience influenced your menu? Working with Michelin star chefs taught me rigor, attention to detail, creativity and most importantly, professionalism. Working in these high profile environments is challenging, but it makes you grow and when planning your own menus, your positive attitude with your team, applying new techniques and making people excited about your food comes naturally. Any restaurant recommendations in Koh Samui? I am a big fan of street food so every time (well most of the time!) I see a food stall, I stop and give it a try. I find that it is the only way to taste authentic food, no matter where I am. The Thai sausages on the way to Lamai are pretty good; you should give the BBQ chicken stall in Nathon a try – make sure you get there between 6:00 and 8:00 am! What are your hobbies? Cycling, biking, diving – takes up most of my free time and fuels my creativity. What experiences in your life have led to where you are today? My family faced many challenges when we were growing up and those experiences taught me that if you don’t fight for something you truly believe in, no one else will. When it comes to lighting the cigar, some people still prefer to light the cigar with a long matchstick or a piece of burning cedar although that only works in a place with absolutely no draft. An ordinary lighter works just as well; just be aware that normal BIC lighters aren’t built for burning the 20-30 seconds needed to get a cigar going, so try to get your hands on a jet lighter instead; these also work in drafty conditions. When you travel, remember that you are not allowed to bring any kind of lighter onto an airplane, and some airlines also consider a cigar cutter a knife, and it should therefore be relegated to your luggage and not your carry-on.
n our previous articles, we have covered cigar countries, wrappers and vitolas (sizes); factors which accounts for perhaps 50 % of the taste experience. Like wine and whisky, however, the specific terroir (soil) of the farm, as well as the blender’s taste accounts for at least another 50 % of the taste. Therefore, you will occasionally encounter a strong Dominican Churchill or a mild and smooth Nicaraguan Robusto; both going counter to the perceived taste profiles of the countries and sizes in question. Therefore, I shall in the following give you my taste profiles of ten very different cigars; some readily available here in Thailand, some in Duty Free, and some may require a bit of detective work – but all are worthwhile smokes! – and some aren’t ridiculously expensive either. irst, however, let’s identify the main tastes of cigars: These are in no particular order: Wood, Cedar, Hay, Leather, Earth, Grass, Barbecue, Salt, Pepper, Chilli, Spices, Nuts (hazel, almond, walnut), Berries, Flowers, Perfume, Mint and Citrus. Occasionally, you will also encounter the taste of “baking” or toast - that is the particular taste of toast with varying degrees of “burn” - from lightly toasted to burnt black. None of these tastes are mutually exclusive, although a peppery and flowery stick would be somewhat unconventional. One taste you would want to avoid, however, is oil or tar, because that usually indicates that the oils of the tobacco leaves in the cigar have been overheated and are running. Look at the foot of the cigar - is there a dark, moist spot that rubs off as an oily residue on your finger if you rub it? If so, cut off a quarter inch or so, and continue smoking. If the sour taste and oily smudge persists, put down the cigar! The oily residue is pure nicotine and tar, and in addition to tasting horribly, it may make you quite ill!
inally, a word about how to prepare and smoke the cigar: Cut about 1/8 of an inch (1/2 if it is a torpedo) of the cigar, and try to draw some air through it - if there is only a mild resistance, you have cut enough; if the draw is highly restricted, cut off some more, and perhaps “massage” the cigar to loosen the leaves a bit. Some people prefer a puncher - a small sharpened circular thingy that cuts a hole through the cap. Finally, if you have neither a cutter nor a puncher, you can cut the top of the cigar with your nail - and there is absolutely nothing wrong with that method.

Also, never, EVER use a Zippo or other kind of gas- And without further ado, it is time for my own list of online lighter – they char too much of the foot of my favourite cigars in my humidor right now: the cigar, and the gasoline fumes seep into the cigar making it unsmokeable. Finally: In our hot country, remember never to leave you lighter in direct sunlight or in your car, or you may be in for a nasty surprise ...
W
hen lighting the cigar, don’t let the visible flame touch the foot of the cigar, but rather keep the cigar half inch above the flame while slowly rotating the cigar in your hand. If you use a jet lighter, you don’t have to puff the cigar; just keep the flame near the foot of the cigar while turning it in your hand for 20-30 seconds until the foot is a nice orange. Should you need to puff the cigar to get it going, puff lightly in and then out with more force. This will create a kind of flame-thrower effect, so be careful of eyebrows, nearby pets, people, hair and so on ...

Body: Medium-Full Origin: Nicaragua Wrapper: Maduro Leaf: Nicaraguan Look & Feel: A beautiful dark brown Maduro wrapper with few discernible veins. Relatively tightly packed with little give. 1/3: Toasting the end gives off a smell a bit like roasted chestnuts. Perfect draw despite the relatively hard-packed tobacco. The first puffs give a bit of the same taste + some dark chocolate and coffee flavours in addition to some burnt wood (hickory?). I must admit already now that the normal Lot 23 is one of my go-to cigars, and the Maduro version doesn’t disappoint either. It simply makes my mouth water like an intense, full coffee, or a top-notch 85% chocolate would do! 2/3: Dark chocolate, leather and wood galore. 3/3: A great cigar - wonderful all the way to the nub.
When you have the cigar going, puff a couple of times, roll the smoke around in your mouth to savour the taste, and breathe it out again. If you retro-hale or let the smoke out of your nose, you will notice a number of additional tastes that you might not otherwise experience. Look & Feel: An almost velvety dark-brown wrapper with clear veins and quite little give to the touch. It feels a bit heavy for its size. 1/3: Perfect draw. An immediate flavour-bomb full of dark, dark chocolate and a spicy BBQ rub with a tinge of sweetness. THIS is how a Maduro should taste! 2/3: I can confidently ash roughly an inch of the dark-grey ash at a time. The 2nd has a dry BBQ rub to it. 3/3: It gets a bit of a hard nicotine-hit in the 3rd, although tastewise it is still in full chocolate/BBQ territory. This IS one of the best Maduros available! It doesn’t surprise you, but it delivers every single time!
Look & Feel: An almost hard, medium-dark wrapper with few discernible veines. 1/3: Perfect draw, light grey and firm ash. Has a nice ‘middleof-the-road’ kind of cigar taste. A bit of chocolate and nutmeg and a sweet, floral BBQ’esque finish. 2/3: It is a nice middle-of-the road smoke with some herby and floral tones. The ash is a dark-grey and relatively firm. If the stick has been allowed to rest at a nice humidity for some months, it gets a syrupy sweetness, adding and extra point. 3/3: It remains linear and consistant with some floral notes. If the stick is a bit on the dry side, a slight hint of harshness creeps in, but not uncomfortably so. However, if it is well moisturised, the syrupy sweetness lingers till the very end.

CAO Mx2 Body: Medium Origin: Nicaragua Wrapper: Broadleaf Connecticut Maduro Leaf: Brazilian Maduro Look & Feel: A Teak-brown wrapper with a ‘solidity’ to it, and some delicate, perceivable veins. The cigar is tightly packed with almost no give. Weighty. 1/3: Draw is slightly restricted, but not unpleasantly so. The first puffs give off notes of firewood, ground coffee, dark chocolate and some hickory sweetness. Also some blackberries. Lovely! 2/3: A firm, dark-grey ash in 1-inch flicks belate an impeccable roll. Draw remains a little restricted. It gains some additional hazelnut or honey-like sweetness, whilst the coffee grows a bit more dominant. 3/3: The sweetness and hickory stays throughout. The Toro is even better than the Robusto! Asylum 13 Ogre Barber Pole Body: Medium Origin: Nicaragua Wrapper: Maduro and Candela Leaf: Honduran Look & Feel: Barber pole wrapper with a slightly oily feel and some discernible veins. Very beautifully made. Wrapper smells of chocolate and berries. Feels a bit heavy for its size. 1/3: Pre-light gives a sweet taste, a bit like prunes. Very smooth and creamy with a sweetness like a good non-acidic coffee. Some nice firewood too. 2/3: This is a slow-burning cigar. Some berries and a sweetspice nuttiness creeps in. Is still amazingly creamy. Reminds me of a perfect cappuccino made with a proper coffee bean. 3/3: It gets a bit spicier towards the end, and is an altogether great smoke through and through - and it doesn’t require 3+ hours of puffing like it’s bigger 7x70 sibling. Score: 91 Typical Price: 1,000 Baht

Body: Medium-Full Origin: Nicaragua Wrapper: Dominican Habano Oscuro Leaf: Nicaraguan Look & Feel: A beautiful teak-brown wrapper with almost invisible veins. Almost no give to the touch. 1/3: Cool, creamy smoke, with ample notes of cedar, dark wood and a hint of very dark chocolate. Nutty and a slightly floral note as well. 2/3: In the 2nd, some toast and Umami is added to the mix and the dark chocolate fades into the background. Some herbal BBQ on the exhale. Still very creamy. 3/3: Despite the primary notes of chocolate, it gets a certain peppery tinge towards the end. I think I’ll let it rest in the humidor so the humidity can get down a notch.

Gran Habano Persian King Tiger Body: Medium Origin: Honduras Wrapper: Nicaraguan Maduro Leaf: Nicaragua and Honduras Look & Feel: The wrapper is medium-brown and quite smooth to the touch, but with a somewhat rustique look. The foot is capped with 1/2 inch of a Connecticut wrapper. The cigar is surprisingly heavy for its size. 1/3: The first 5 puffs are surprisingly easy considering the enclosed cap and the dense packing of the tobacco, and they are full of a sweet nuttiness with an almost maple-like tinge. As the Connecticut foot is turned to ash, a more pronounced pure tobacco taste rears its head, although still a tad on the sweet side. Hazelnut, morning dew, and a roll in the hay. 2/3: The 2nd gives off ample of smoke, which is nutty and floral with a hint of moist cedar or sandalwood. 3/3: It becomes decidedly floral towards the end and with a touch of crisp toast - an utter delight! Score: 92 Typical Price: 900 Baht
Look & Feel: A beautiful, smooth mahogany-brown wrapper with almost invisible veins and a velvety feel. 1/3: Lots of smoke and taste from the first puff with notes of dark oak, roasted coffee and cocoa. 2/3: The cigar mellows out a bit in the 2nd and it gets notes of sweet hickory too. The dark-grey ash is a tad flaky. 3/3: In the 3rd, it still has some of the dark oak, but chocolate and hickory is gone. Due to its vitola, it gets a bit peppery towards the end. It is a good cigar, but it becomes epic in a larger vitola like a Toro or Churchill. I can’t get myself to put it down before it burns my fingers, though. Score: 94 - it is best in the bigger violas. Typical Price: 1,500 Baht
Davidoff Nicaragua Medium-Full Body Origin: Dominican Rep. Wrapper: Nicaraguan Habano Rosado Leaf: Jalappa from Esteli Look and Feel: A nice light-brown wrapper with a few prominent veins. It is tightly rolled and heavy, with very little give to the touch. 1/3: This cigar is waaaay more complex than any other Davidoffs I’ve tried. It manages to be creamy, smooth AND with tons of flavour at the same time. There’s hazelnuts, dark chocolate cake, freshly roasted coffee, some firewood and a pinch of cinamon ... Smoking this cigar without paying attention would be a sin! 2/3: A perfect 1.5 inch light grey ash drops into the ash tray. The taste is very constant into the 2nd, but gains a little bit of sweet spice. I also detect something like fresh-baked bread. 3/3: Perfect, tasty and consistent all the way to the nub :) Score: 94 Typical Price: 1,900 Baht

LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain
RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.
RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.
LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.
GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.
SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.
SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.
LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)
STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area.
STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.
STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.
STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.
In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
