One of the most frequently asked questions from expats when they first arrive is: where to buy furniture in Samui? Many expats choose not to bring their furniture from home. This is in case the furniture does not fit or to avoid unnecessary shipping charges on possibly unusable items. Relocated singles and sometimes young couples, may not even own much furniture back home. Many just want the chance to start from the ground up with new furnishings and decorating. The first port of call then is to find a suitable store. Like most shopping in Thailand, if you need to buy furniture in Samui, there is a huge range to choose from, depending on your needs.

Today we take a closer look at Rudi’s Windows and Doors Rudi being a long-term ex pat on Samui (28 years) has specialized himself on windows, doors, kitchens and walk in closets. Three years ago, Rudi invested in an Austrian professional carpentry factory. Importing all the heavy machinery and equipment from Austria to his 800M2 factory on Samui might seem a touch extreme but Rudi wanted the complete factory to be able to offer his clients on Samui the wide-ranging customization solutions that only such a workshop can offer. The factory also includes a professional lacquering room, giving the final show finish in both High Gloss and the modern Matt finish to the end product. The speciality with Rudi’s factory is the possibility to build complete custom furniture solutions. This includes being able to produce furniture materials of over 3 metres in length. Most products are normally only maximum 2.4m in length.

Hydroponics 2 If you are like me then you care about what goes into your body. Sometimes not easy in our busy world and hectic days but I am a firm believer of the adage “You are what You eat”. So, till recently I’ve tried when possible to buy organic foods and eat a healthy diet. Organic is great but sadly it is not easy to tell at the supermarket shelf how strict the farmers have been on following the organic guidelines and there still have been cases of pesticides and other poisons on our supposedly healthy products. Maybe in a perfect world everyone world have a small vegetable garden and can grow most of their own. But the world is not perfect and most of us hardly have much of a garden and if we do it is a constant battle with the elements. Most of us have come here for the heat and the wonderful sunshine but these are not exactly congruent for a vegetable plot especially when you’re trying European salads etc. What to Do? Most of us have all heard of Hydroponics, I certainly had but it has always been something that I considered too complicated or near impossible to set up in a home environment. But the last few months has seriously changed my attitude and I think many of you will appreciate the info. In our last edition, we looked at the advantages and disadvantages of a hydroponic set up. Looking at the different systems that can be used and the benefits. Now I very quickly received quite a few emails asking various questions. Most were asking about two subjects. First what grow medium or substrate is best and then questions about nutrients and where to buy.

Hydroponic Growing Medium Which Is Best for Your Garden?

The hallmark of hydroponic gardening is a soil-less growing medium... No soil! But plants need to be supported or held up somehow, right? We do this with soil-less media... inert, non-organic materials. They do not add to or change the chemical makeup of the nutrient solution in any way. These substances are porous, light, and coarse, which allows oxygen and nutrients easy access to the plants roots. Different Hydroponic Media There are only 3 basic growing media that I recommend: - Coconut Coir - Hydroton or clay balls) - Perlite

That's it. Forget about gravel, vermiculite or rock wool. There are also two advanced hydroponic techniques that don't use any hydroponic growing medium whatsoever... Aeroponics and NFT (nutrient film technique). We will learn more about this later. For now, all you need to know about are the "Big 3": Coco, clay balls and perlite. Each has advantages and disadvantages, and so are better suited to specific growing systems. Coco Coir and perlite are denser, and hold water better, but LECA has superior drainage and aeration. Experienced hydroponics nuts usually have their own favourite formulas using these 3 media.

Hydroponic Home kits Starting a home vegetable and herb garden in hydroponics is today very easy. There are ready made kits available where just some assembly is required. Hydroponic grows can be a small set up that fits on your kitchen worktop or larger grows which require more space. Here the limit is only how much you’d like to produce and how much space you can allocate. Maximizing Legal Protection through the Effective Negotiation of Construction Contracts Irrespective of whether an investor is building a skyscraper, a world-class resort, or a small house; all investors must at some point, enter into a construction contract in order to procure the construction of the building. This is a pivotal stage in the development process and can be critical to the future success of the project. New and first time property developers are often unaware that there is usually considerable scope to negotiate the terms of the construction contract as the builder will often be keen to “win” the work. A carefully negotiated construction contract can mitigate the risks of things going wrong and provide the investor with a level of control at the construction stage of real estate development. In order to provide a level of contractual certainty to the investor, the construction contract should contain a clear and unambiguous completion date upon which all construction works contemplated under the construction contract shall be completed. The investor should be entitled to a “late completion penalty” in the event that the builder fails to complete construction of the property on or before the contractual completion date. This penalty should be deductible from the final payment to the builder. Having said this, there does need to be some flexibility to the benefit of the builder. The construction contract should allow the builder to postpone the construction completion date for a defined period of time in the event that a delay is caused by events beyond the builder’s control, such as prolonged adverse weather conditions or the unavailability of essential building materials. The contract price should be clearly set out in the construction agreement and should be payable on construction milestones rather than on fixed dates so that payments are made as construction advances. If the construction stage which triggers the payment installment has not been reached, the investor should be permitted to retain the payment installment until such time as the relevant construction stage has been reached. The investor should be entitled to retain the final payment installment until all snagging defects have been remedied to the satisfaction of the builder. The construction contract should allow the investor to appoint a qualified surveyor who should be permitted to inspect the progress of construction at each construction stage to verify that the relevant construction stage which triggers a payment installment has been reached and to confirm that all construction work has been undertaken correctly and in accordance with good working practices.

The builder may agree to provide a contractual guarantee against structural defects emerging within a defined period of time after construction of the property has been completed. The builder will not usually agree to guarantee the works of sub-contractors or to repair damage caused by hostile weather conditions or general wear and tear. The construction permit together with all architectural plans, drawings and specifications, floor plans, unit plans, elevation plans, master plans and plans of the common property and landscaped areas (as applicable) should be attached to and form an integral part of the construction contract. The builder should provide a warranty that all construction works shall be completed in accordance with internationally recognized building standards, techniques and methods. A detailed specification of the materials used in the construction and finishing of the property should also be attached to and form an integral part of the construction contract. The specifications should include the size, type, kind, style, model, brand and colour of all materials and specifications to be used in the construction and fit out of the property. For example, if the builder promised “teak” doors then this should be clearly stipulated in the specifications. If the specifications stipulate “wooden doors” the builder may not be in breach of the construction agreement in failing to provide “teak doors”. The comprehensive terms and requirements of a fair and balanced construction contract are detailed and beyond the scope of this article and are often contingent upon the type of construction. As a basic guide, all construction contracts should be vetted before any payment installments are released to the builder. Property investors should be aware that there is often considerable scope to negotiate the terms of a construction agreement and enhance the contractual legal protections on the part of the property developer. Important Changes to the Work Permit Law Employers and Employees Take Note. Both Employers and Employees should take note of the new work permit regulations and notification requirements which came into effect on 28th March 2018 and affect all employers of foreigners and foreign employees in the Kingdom; including those who are working in Koh Samui and Koh Phangnan. We examine the changes to the work permit law and examine the implications to both employers and employees.

Administrative Changes Under the old laws, an application for a work permit was required to be made in person, in Thailand, at the Department of Labor. According to the new laws, it is now possible to submit an application for a work permit electronically either within Thailand or from overseas. In addition, the issuance of a work permit will not exceed 15 working days.

The New Regulations The latest amendment to the Emergency Decree on Managing the Work of Aliens 2017 enacts a number of key amendments to the work permit law: Foreigners who enter Thailand occasionally for the purposes or organizing or attending meetings; give opinions, give lectures or provide talks, participate in training sessions, tour, seminar, art or cultural exhibitions, sports competition, or other purposes prescribed by the cabinet; are no longer required to obtain a work permit. These changes are in-line with other developed countries which do not require any special permissions to attend such events. Secondly, foreigners who enter the Kingdom to engage in business or investment; or who have skills which will help improve the country, subject to certain specifications, will also be exempt for the need to obtain a work permit. Thirdly, representatives of a foreign entity which is granted a foreign business license pursuant to Thailand’s Foreign Business Act shall also be exempt from obtaining a work permit.

Definition of “Work” The legal definition of “work” has been narrowed to “performing any profession, whether or not there is an employer, excluding business operations of a foreign business license’s holder under the Foreign Business Act”. The previous definition of work was “exerting one’s physical energy or employing one’s knowledge to perform a profession or perform work, whether or not for wages or other benefits”.

New Reporting Requirements of Employers and Employees An employer is now legally required to notify a work permit official of a foreign person’s name, nationality and the nature of the work undertaken by the employee; within 15 days from the employment date. At the end of the employment period, the employer is legally required to notify a work permit official of the cessation date of employment. A failure to comply with the reporting requirement may subject the employer to a fine of up to 20,000 Baht.


Employers who have already engaged foreigners on 28th March 2018 are subject to the same reporting requirements on or before 26th May 2018. Any existing employers who have not been aware of the changes until reading this article should comply with the reporting requirement as soon as possible. In addition to the new reporting requirement by the employer, a foreign employee is required to notify a work permit official of their employer, work places and nature of their work within 15 days from the employment date; and on every occasion that the foreign employee changes their employment. A failure to comply is subject to a fine of up to 20,000 Baht. Penalties Finally, penalties for working without a work permit have been weighted more against the employer than the employee. Under the former regime, a foreign employee working without a work permit (or outside of the scope of their work permit) was subject to a penalty of up to 5 years in prison and/or a fine of up to 100,000 Baht. Under the current penalties, the maximum penalty is only a fine only of between 5,000 Baht and 50,000 Baht. Conversely, an employer who under the old regime was subject only to a fine of up to 400,000 Baht for employing a foreigner without a work permit, is now liable for a custodial sentence of up to 1 year for repeat offences and may be prohibited from employing foreigners for 3 years. Both employers and employees should be aware of these new regulations and ensure that their business is in full compliance with the new laws and regulations and further ensure that internal procedures and processes are altered to accommodate these changes. Thai Spouse Property Owned, Finance The coastline of Koh Samui & various Thai islands are known for their luxury beach front hotels and pristine beaches though, in amongst these paradise locations are scattered, homes of paradise for some luxury residences and pool villa’s. It is these pool villa’s which are often of high end value and of attraction to new buyers who wish to live by the beach and with open air space in abundance. Ownership of a Villa for Thai nationals is easy, simply go to the local land office and register in their personal name on the back of the title deed. Ownership for Foreigners tends to be a grey area and comes up with mixed options available. It is common around the kingdom, for Villa’s to be bought by foreigners under either Thai company ownership OR having a 30 year leasehold structure in place. One other option which is often overlooked is having the property owned in a Thai spouse name. Let’s assume for example we have a couple married together for a number of years and not only this, have their own children to further cement their relationship together. If, one of the married couple is Thai, it can often be made easier to raise Mortgage Finance on a property purchase or refinance, when is to be registered in just a Thai name only and having a Foreigner as the guarantor to the loan and with no ownership. Ownership can be looked at more closely when compared to the alternative Thai company structure where the Foreigner intends to “own” the property. Foreigners are in most cases not able to own land here in Thailand therefore, by having a Thai company own the land, the ownership is considered as Thai therefore the land office in theory has no question to transfer the title deed. On the other hand, when looking at the company structure, 3 shareholders are usually required minimum and with at-least 2 being Thai. Local nationals are by law not able to act as a nominee on a Thai company which has been intended for a Foreigner to own the land, particularly when the voting rights within a Thai company may, be leaning toward the Foreigner side. Now the big question, how can one individual decide on whether a Thai person has acted as a nominee on a Thai company… and also, whether the Thai company has been used as a way to circumvent the law… These kind of decisions are often made at the land office when the day comes to transfer ownership and certainly over the years, I have seen several instances where complications have occurred and on rare occasions, seen a transfer halted altogether. The most part usually after a Mortgage application which took time to prepare all paperwork, conduct valuations/inspections, approvals, contracts signed only to finally be told, sorry, no can do. Of course, there are instances where things go through clean sailing and everything goes to plan, though few could say with 100% confidence no possible hiccups could happen, particularly here in Thailand.

One way to help a land officer alleviate the concern for a Thai company is to have ALL Thai shareholders sign not only on behalf of the Thai company, but also as a co-borrower / guarantor to the loan so ALL are equally responsible to repay any Mortgage finance raised, against the property. Very few would sign a personal guarantor which means they have a debt obligation and no real ownership IF they are intending to only be a nominee. When it comes to obtaining Mortgage Finance on a Thai spouse owned property with a Foreigner as the guarantor, this however is by far the easiest method. Quite simply, the local Thai will have full ownership of the property at the land office without any questions and the Foreigner is simply helping or being the main repayment vehicle for the debt rose on the said property. What the lender might be looking for in order to approve a loan is that the applicants have no poor criminal records, no outstanding bad debts and have an ability to repay, each monthly instalment for the foreseeable future. A poor credit history doesn’t necessarily mean a rejection IF evidence can be found within paperwork, that debts were repaid in full. Evidence of income for the next 10 – 20 years is difficult to approve however, historical evidence of good career progressions or good long term income, helps to make things easier for a lender to approve. It is not uncommon for loan sizes of THB 50M + to have a resume submitted with the application so the lender can see and check career history. A good strong online digital presence might also help since when it comes to default, will make easier to locate for repayment. The main rejection point for Villa loans are often, the Villa itself rather than the client or their ability to repay. If the Villa is not so luxury and perhaps on the minimal loan size, so perhaps under THB 5,000,000, the lenders perceived effort to go through a process in order finance, might be too minimal for their business requirements. Properties of THB 10,000,000 upward tend to be more of interest and easier to approve than those of say THB 2,000,000 which might get a rejection regardless of how much evidence the client can show to repay the loan. If the villa is within a village, has a clear right of access to public road (on paper), has great location, which could be by the beach, connected to a main road or in a desirable area and is well maintained, there is likely, a strong chance of some form of loan approval. Lenders may often lend maximum 60% Finance against their preferred valuation and with that in mind are more collateral focused than client focused. air-conditioning As we all know, in the hot Thai climate the biggest drain on our electricity bill is not our lights or appliances, but our air-conditioners. We have changed our refrigerator and tv's to energy-saving units, and we have changed our lightbulbs to LEDs, but unless our home was lit up like a Christmas tree year round, the savings are probably only about 20% or less than a 1,000 baht for a normal household. When we go to Home Pro or our local air-conditioning supplier, they will tell us about the major savings a new inverter will give us, but in reality we're looking at 5 – 10 % savings tops. And unless our airconditioners are from the past decade, that kind of savings won't really make any fiscal sense. There are two other kinds of air-conditioners, however, that can provide more significant savings, and they will give you a much greener conscience to boot. To the best of this writers knowledge, these particular types of air-conditioners haven't been offered in Thailand. Lately, Anubis Consult have begun importing these types of air-conditioners, installing them at retreats, hotels and businesses who are looking to lower their electricity cost and providing their clients with a greener footprint. And now, these air-conditioners are being offered to the home market too. Two types – two kinds of home The new kind of air-conditioners use two fundamentally different, but wellknown, principles: Water-based solar heating, and solar powering for regular air-conditioners. Depending on whether you are building a new home or refitting an existing home will be a deciding factor in which kind of system you should go for: The complete system The solar powered air-conditioning system requires an array of solar panels to run the air-conditioners. Depending on your home and how green you want to live, you can opt for a solar-assisted system, where you have a few panels (say, six 125W panels) which will help power one or two air-conditioners during the daytime. As much of the cost for the system derives from the control unit, the inverters (from 12, 24 or 48V) to 240V, wiring etc., the aforementioned setup with only 750W of power is hardly cost-efficient. Therefore, this option is much more cost-effective in a new construction where you can install panels all over the east-, south-, and west-facing roof, where you can generate several kWatts of power (a simple rule=of-thumb is roughly 100w per square meter of roof), store the power in large battery banks, and draw power from these batteries during the night to power your bedroom air-conditioners.

As such an installation can quickly cost you up to a hefty 1 million baht excluding installation cost, this is clearly a long-term investment, but with a sufficient installation you can easily power several air=conditioners and all of your lights and appliances too. The step-by-step system A more gradual approach may be more to your liking, especially if you are changing those old air-conditioners. Instead of spending, say, 25,000 baht on a new air-conditioner from Home-Pro, which can only save you about 5 - 10 % of the electricity, you can get a solar-heated air-conditioner for 75 – 100,000 baht. Given that an air-conditioner for the bedroom can easily cost you up to 2,000 baht per month, the investment of 75,000 baht on a solar-heated air-conditioner can easily pay back the cost of 75,000 baht, considering that it will save you about 30 – 40 % of the electricity. After less than ten years, the price-premium has been covered, and you can sleep easily knowing that you are polluting much less than you would have otherwise done. The air-conditioner has a water tank attached to it, and as the dun heats up the water, the air-conditioner becomes more efficient. By the end of the day, the water will almost be boiling, and through compression and heat-exchange, the air-conditioner increase its efficiency. The air-conditioner still uses electricity, albeit 30 – 40 % less. Future-proof As the air-conditioner is "plug-and-play", it requires only a normal air-conditioning installer to get it up and running, and you can immediately reap the benefit of the savings. And if you should so desire, you can still at a later date install solar panels, batteries etc. and have the waterheated air-conditioner run entirely off-grid, making it 100 % energy efficient. LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain

RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.

SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.

SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)

STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area.

STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey

building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.

STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.

STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.

In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
