EDITOR'S LETTER Welcome to the April May 91st Edition of the Samui Phangan Real Estate Magazine. A beautiful clear blue sky this morning as I look up from my desk, one of those perfect days to look up through the coconut palms and watch the wisps of white clouds disappearing against the stunning blue background. Its early March as I write this and news whether national or international is all about the Corona Virus and traveling. Personally, I’m finding the news very frustrating, everyday something seems to change and reports of infections around the world are either scare mongering or worse telling the truth. What is fake news and what is really going on, sadly I don’t know and its more than infuriating searching for sincerity. Just read an article where it claims pets in China in certain areas are being disposed of to stop the virus being transmitted from animal to human although the World Health Organisation is saying there is no proof this transmission exists. Even had images of pets wearing masks which I find approaching ridiculous. Koh Samui seems to be doing better than many other tourist areas of Thailand as the Chinese were not flooding the island as extreme as they had been in Pattaya for example. Koh Samui I still find amazing how it manages to soldier on and come out shining even against some of the most difficult of situations. Samui is and will always be a special island for us all. So, in this magazine we have the latest up to date Corona information and advice. Once this is published some time will have passed and I sincerely advise everyone to reconfirm anything important. We take a closer look at our beautiful Real Estate on the islands and our Developer in View this edition is Villa 55 on Bophut Hills. Our Legal Buzz team have kindly given us some important information that should be considered if you’re thinking of leasing a property, and we have part two of our renovation and insulation feature. Insulating is Money Since the last article, we have ordered the new light bulbs for the outside area, gotten a quotation on replacing the windows in the Manager’s room, and made some further calculations on how we can make the biggest improvements in the Deluxe Rooms.

Outdoor lighting

We immediately changed the outdoor lights to the newest 3000 Kelvin, 100 Lumen 1W lights. These would replace old 3W LEDs, 5W CFLs and 15W standard lights. At 2,500 Baht for 100 light bulbs in return for saving a couple of hundred W/h is not going to save our client much money in the short run; but their staff will not have to change a single one of those light bulb for at least the next 5 years, and that is money too! 12

Insulating the Windows

Last time, we immediately located two major issues at the hotel: The windows at the Manager’s Office, and the windows (or rather: plexiglass) above bathrooms in each of the 5 Deluxe Rooms on the ground floor. Therefore, we decided to make some measurements of exactly how much heat loss (or rather: “cold loss”) we were looking at. We installed two thermometer/hygrometers in the Deluxe Rooms. Sensor 1 we placed on the bedside table, and Sensor 2 we placed on the shelf above the sink in the bathroom. The results, which can be seen in the two graphs on the opposite page, confirmed our suspicions: The temperature decrease when turning on the AC is significantly slower, than the temperature increase when turning it off again.

The air-conditioner had been set to 24 °C, but had it been set lower, for instance to 21 °C, the upwards curve would have been even steeper. Sensor 2 was positioned near the offending plexi-glass windows at the back of the bathroom, and the peaks in the graphs show how the temperature immediately jumps off whenever the air-conditioner is “taking a breather”.

We immediately got quotations for insulated glass that could be installed instead of the leaky plexi-glass. Each window is 78x44 cm, and we specified the windows to use a double layer of glass with Argon in between, and the outer glass to be glazed to reflect some of the sunlight. This amounted to 2,780 Baht per window; 11,120 Baht per room, or 55,600 for all five rooms. 25,000 baht for installation. A total of 70,600 + VAT. Considering the additional AC cost per month is roughly 500 Baht per room, the return period on the investment will be less than 3 years. Next time, we will look at the cost and return for upgrading the windows in the Manager’s office.

Walk in style How to make your villa stand out

First impressions matter, so the saying goes. The moment you enter someone’s house your first impression tells you whether or not you are going to like it. What hits you first? Is it the size of the room or the furniture? Perhaps the colour scheme or the how light the room is. There are many things that can influence your decision. Good interior design will go a long way to make your home stand out and give a positive first impression.

Let us start with the entrance to your villa. A spectacular entrance paints a picture of grandeur. The lead in to your villa will dictate how people view the size of your property whether or not it is large or small. The bigger the path or entrance to your villa the more spacious it will seem. Double entrance doors with large decorative door knobs will give the impression you are about to enter a grande villa. Solid wood is ideal or a pair of finally carved antique doors if you can find them. Once you enter your villa you need to feel the space. Avoid cluttering the entrance with furniture so you can enter the room without having pieces of furniture in your path. Give your furniture space. Remember less is more. Make your room as light as possible, you do not want to be entering a cave. Keep your colour scheme neutral and choose to add a splash of colour here and there. If you have a view onto a garden or natural landscape allow it to come into the room and do not shut it out with curtains. If you need to control the sunlight use blinds on your windows. As you pass through your villa it should be seamless. In other words, you should be able to move from one room to another without barriers in your way. Avoid more doors if you can to keep that open feel throughout. Try removing doors to adjoining rooms, it will allow you to glimpse what lays beyond and encourage you to use the whole villa rather than living room by room. An open plan kitchen is a must if you want to interact with your guests while you cook. Kitchen design these days is very high tech and good design will blend seamlessly with your dining/living area. Consider a different style in each room. You could change the furniture style or lighting to fit the mood of the room and the way in which you might use it. For example, it might be somewhere you use as a study or a room to read and relax in. Statement pieces will do a lot to make your villa stand out. A large sculpture or a chandelier will define the space and pieces of art and photographs placed strategically around your villa will have a big impact and say a lot about your taste and individual style. Choose fabrics and cushions to give that luxurious feel in your bedrooms and around your villa. Lastly, go for comfortable outdoor furniture that blends well with your landscape and creates an indoor outdoor environment.

Travel advice Coronavirus (COVID-19)

Guidance for British people travelling and living overseas following the outbreak of coronavirus (COVID-19) in Wuhan, China, and in other countries worldwide. Information republished from https://www.gov.uk/guidance/ travel-advice-novel-coronavirus Cases of novel coronavirus were first reported in Hubei Province, China, in December 2019. Since then, further cases of the virus have been confirmed in several Asian countries and further afield. This is the latest advice for British people travelling and living overseas. As of 03/03/2020 from the British Foreign and Commonwealth Office. This covers the current situation in the UK and abroad, and provides specific advice for travellers returning to the UK from:

The National Travel Health Network and Centre (NaTHNaC) has also produced general advice on preparing for foreign travel and how individuals can help reduce the spread of respiratory viruses during the COVID-19 outbreak. Foreign & Commonwealth Office (FCO) travel advice The FCO is currently advising against all travel to Hubei Province, and against all but essential travel to the rest of mainland China. If you’re in China and able to leave, you should do so. See the latest travel advice for China up to date on https://www.gov.uk/guidance/ travel-advice-novel-coronavirus. The FCO is also advising: against all travel to the city of Daegu and all but essential travel to the city Cheongdo, in South Korea against all but essential travel to 10 small towns in the Lombardy region and 1 in the Veneto region of Italy

The FCO is not advising against travel to any other country/territory because of coronavirus risks. You should also check with your airline or travel company for the latest information. Air travel Some airlines, including British Airways and Virgin Atlantic, have suspended flights to and from China, or revised their schedules. Other flights in the region may also be affected. If you’re due to travel on an affected route, keep up to date with the latest information from your travel company or airline. International cruises Some cruise line passengers have experienced disruption to their travel because of measures taken by individual countries to combat coronavirus. The Cruise Line International Association (CLIA) has adopted an enhanced member health policy which all CLIA ocean member cruise lines are required to follow to address the coronavirus. This includes guidance on who should be permitted to board cruise ships. If you are due to travel on an international cruise, contact your travel company for the latest information. Travel insurance The Association of British Insurers (ABI) has produced information on travel insurance implications following the outbreak. Leasing Land in Koh Samui and Koh Phangnan – a Brief Guide. All potential investors into real estate in Koh Samui and Koh Phangnan learn rather quickly that the ownership of freehold land by foreign persons in Thailand is prohibited with no viable exceptions. As a result, the most common means for foreigners to secure long term rights over land is to acquire a leasehold interest in the land beneath their properties. It is important for potential investors to be aware that the longest registerable lease term in Thailand is 30 years, considerably shorter than the maximum lease term in other countries. The following article examines leasehold ownership in Thailand and discusses ways in which a foreign investor can enhance the security of a leasehold investment through robust legal structures, contracts and understanding the nature of leaseholds in Thailand. The Laws Relating to the Leasing of Land by Foreigners in Thailand: Thai law states that a registered lease is limited in law to a term of 30 years. Section 540 of the Civil and Commercial Code of Thailand states that: “The duration of a hire of immovable property cannot exceed 30 years. If it is made for a longer period, it is to be reduced to 30 years. The aforesaid period may be renewed, but it may not exceed 30 years from the date of renewal”. Accordingly, Land officers at Provincial Land Offices will refuse to register any lease with a term of more than 30 years. Clearly a 30 year lease is not a particularly attractive investment opportunity as any capital appreciation is offset by the ever diminishing remaining term of the lease and the capital appreciation in the land value vests in the freehold land owner who shall re-possess the land at the end of the lease term.

Is a 30 Year Lease Renewable? One solution available to foreign buyers in order to allow them to occupy the leased land for a term of more than 30 years is to secure a contractual promise from the person or entity granting the lease (known in law as the ‘Lessor’) to grant contractual options to the foreign buyer allowing them to renewal the lease term for subsequent lease terms of 30 years each. As set out above, the provisions of Section 540 of the Civil and Commercial Code expressly allow the renewal of leases for subsequent terms of not more than 30 years. The lease renewal options usually take the form of a series of clauses in an addendum to the lease agreement to the effect that immediately upon the expiry of the initial registered lease term, the parties shall immediately register a new lease on precisely the same terms for a further term of 30 years or the longest registerable lease term at the time of each contractual renewal. The rental for each contractual renewal is usually limited to no more than the costs of registering the subsequent leases. Things to look out for in Lease Renewals Whilst contractual options to renew leases are a legitimate means for foreign buyers to acquire an interest in land in Thailand, foreign buyers must ensure that the provisions for the renewal of the lease are as robust as possible and that the procedure set out in the addendum to the lease agreement with regards to the lease renewal options are clearly defined. The identity of the Lessor in leasehold structures is an important consideration for foreign buyers and can have a huge impact upon the likelihood of the lease being renewed at the end of the initial 30 year term. If the Lessor is a living person, it may not be possible for the foreign buyer to enforce the lease renewal options against the heirs of the Lessor in the event that the Lessor dies during the initial 30 year registered lease term. A contract is usually only enforceable between the parties who originally signed the contract and consequently the heirs of the Lessor will not usually be bound by the promise made by the Lessor a generation earlier. Foreign investors must be aware that a Lessor who signs a lease at the age of 55 years old must reach the age of 85 in order to effect the renewal at the end of the first registered term. A foreign buyer can significantly strengthen the security of the lease renewal options if the Lessor is a limited Thai company. Legally speaking, a limited Thai company is a “legal person” in the sense that it can be sued in the same way as a living person if it fails to perform its obligations under a lease contract, however, unlike a living person, a limited company cannot die or disappear. Notwithstanding the benefits of leasing from a limited Thai Company, the Thai company itself must be correctly and legally formed and properly maintained during the lease term, furthermore, foreign buyers should ensure that the terms of the lease do not undermine the benefits of leasing from a limited company. For example, any provision in the lease agreement which allows the Lessor to assign its rights under the lease to a third party should be resisted.

Other Important Provisions of the Lease for Foreign Investors The lease agreement and any addendum to the lease agreement must be carefully reviewed by the foreign investor and their legal representative prior to any payments being made. An “investor unfriendly” lease may not only restrict the foreign buyer’s enjoyment of the property but may also adversely affect the saleability of the property. For example, any provision of the lease which allows the Lessor to terminate the lease in the event that the buyer breaches any of the lease terms should be strongly resisted. Further, any clause which requires the buyer to obtain the Lessor’s written consent prior to carrying out certain acts upon the land should also be resisted, unless there is proper justification for such a clause (such justification may include the Community Rules and Regulations in an apartment or condominium project). Leasehold investments are a secure and viable means of acquiring an interest in real estate in Koh Samui and Koh Phangnan for a term of years beyond the maximum registered lease term of 30 years. Indeed several high-end luxury developments in Koh Samui and Koh Phangnan only offer a leasehold option to their customers. Notwithstanding the potential benefits of leasehold investments, foreign buyers and their legal representatives must ensure that the leasehold structure which is being offered is fully compliant with the laws of Thailand and that the proposed terms of the lease do not restrict their enjoyment of the property unnecessarily. Particular care must be taken to ensure that the lease renewal options are as robust as possible within the parameters of Thai law.

Bitcoin Part 4

Since I published a first article on Bitcoin in our Samui Phangan Real Estate Magazine back in August 2017, cryptocurrency and Bitcoin in particular exploded, fell off a cliff from its spike and then, began a slow recovery. Back in 2017 we shared article prices of USD 2,331 for 1 Bitcoin (BTC) and USD 199 for 1 Ethereum (ETH). Today indicative from the popular Coinmarketcap website which tracks most cryptocurrencies presenting in a similar fashion like the FTSE 100, S&P 500 or SET 100, prices are USD 8,849 for 1 BTC & USD 228 for 1 ETH. Tidy, 3 year gains of 379% & 114% respectively! How long will this trend of price increase continue…? On 3rd January 2009, the Bitcoin network first came into existence after the last global financial crisis when Satoshi Nakamoto mined the first genesis block (block number 0) which had a reward of 50 Bitcoins. Since then and again according to Coinmarketcap, the present circulation is 18,248,962 Bitcoins. There will only ever be 21,000,000 available which means there are only 2,751,038 left to mine until the full supply is in circulation. It is expected to reach the total supply in the year 2140 so perhaps within reach, for our future grandchildren. On a daily basis 24 hours, 7 days a week, non-stop since 2009, digital money has been mined and continues to be mined with a belief; the future of money has

arrived. Much like the gold rush of days gone by, would be users aim to mine Bitcoin using their computers hardware to generate “new money”. The world's largest gold rush ever, had begun in South Africa 1852 and the country would never be the same again. Many in the cryptocurrency industry believe similarly that the financial world would now, never be the same again & Bitcoin is, the new global “digital” reserve currency. The financial crisis of 2007/8, was such a severe worldwide economic crisis it is considered by many economists to have been the most serious financial crisis since the Great Depression of the 1930s & was the catalyst for a brave new world. Bitcoin in many ways is seen as an alternative to traditional centralised economics since is allegedly an immutable computable code on a public ledger for which all of mankind may view and forecast the supply and circulation. One particular Twitter handle which goes by the name of Plan B (@100trillionUSD) also previously mentioned in my series of Bitcoin articles, goes one step further & most recently came out with an updated “Stock to Flow” chart which as a result of his mathematical calculations & are independently verifiable, was able to imply that price fits almost perfectly within a range. Future & past prices are based around the regular “Bitcoin Halving” events which seem to have correlated a reasonable


range for which Bitcoin prices appreciate. Of course, many doubt such price forecasts can be so straight forward with Ethereum’s Vitalik Buterin, slating such “useless” prediction however, one can’t help but ponder how the mathematical model strikes a decent resemblance to the actual price in the past. The model for example indicates that within the coming few years, prices should be within the range of 10x from where we are today.

near the bottom... does it now have a more significant upside if Bitcoin recovers… or was it all a scam all along and is about to go to zero… Nobody knows. This is just 1 example of such high price differences in the market & certainly highlights the importance of careful consideration into any such crypto investment. Bitcoin is often considered the most secure and safe since is number 1 on Coinmarketcap however, what if this also decided to plummet and prove the stock to flow model wrong…

The future of course is unknown to most and at present, particularly over the past month, Corona Virus seems to be a major event, the world’s financial markets seem to be going through turmoil once again…could this be Bitcoins first “real” test of the “Stock to Flow” model… or have their been other events within the last 10 years which have already been factored in…

At present, the base currency which many revert, may be their own countries fiat such as baht, usd, gbp, cny etc. however in the future, on this Bitcoin model there would be no need since users could spend Satoshi’s… which are a unit of Bitcoin, the “global currency” where users have become their own bank. It is already evident around the globe users can purchase items with cryptocurrency. Crypto Emporium for example through their website offers various items with worldwide shipping including cars, motorbikes, watches, electronics…even property. Within their payment methods, they have 7 different cryptocurrencies available as payment including of course Bitcoin.

Recently, it has been reported that more than a dozen central banks are now considering how and whether to create digital forms of cash. Whether any other digital coin can challenge Bitcoin to the present number 1 spot by total market capitalisation is another chapter in itself. On the back of the last global financial crisis, Bitcoin was created and the crypto community may desire decentralisation. For the Bitcoin maximalists, the new true, global reserve currency is Bitcoin and any other coin will be simply an Altcoin. i.e. let’s say a country sets up its own digital currency. At present, every other coin can be divisible in Bitcoin as a Satoshi unit. We may have 1 Zimbabwe coin for example which is worth 0.00000001 BTC or, 1 Satoshi. The Zimbabwe coin may become popular and have strength in its own ecosystem which can see growth to say 0.00000100 BTC which is now 100 Satoshi’s. Based on the earlier price of BTC being USD 8,849 the 100 Satoshi’s are worth USD 0.008849…so not much for 1 coin. If you had 10,000 Zimbabwe coins it would be worth USD 88.49 for example. During the Crypto winter and bear market of 2018 many coins focused to build their own “ecosystem” within the community hoping at some time, once Bitcoin recovers, their own digital coins will also begin to rise. KICK coin based on the Ethereum blockchain is one such coin which describes itself as building a large ecosystem for all. It literally can also define both the high and low points of Cryptocurrency pricing. Early investors in the initial coin offering (ICO) may have seen prices plummet since interception. According to Coinmarketcap, at one point back in October 5th 2017, almost near the last BTC peak of Dec 2017, a user could purchase 1 KICK token for 5,886 Satoshi’s. Today at the time of writing, that same coin can be purchased for just less than 1 Satoshi (0.62 Satoshi to be precise). Imagine mortgaging a property to purchase into an alleged “ecosystem” and then going into an investment which goes down to almost zero in the space of 3 years… On the other hand of course, what if this is now

LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain

RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.

SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.

SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)

STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area.

STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.

STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.

STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.

In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
