Make a Difference

Despite the continued impact of a global economic slowdown, Samui's local government has been pushing ahead with its commitment to improving in the island's infrastructure and empowering the local community. Throughout 2011, the municipality has also been working hard to build stronger relationships between local and central government in order to secure the necessary budgets to carry out work on the island's road, water management and waste management systems. One of the main areas to see positive changes this year has been the public space around Chaweng Lake, where new pavements, lighting, roundabouts and parking spaces are now close to completion, all of which will create a new community and commercial zone to complement the main tourist strip along Chaweng Beach Road. "This part of Chaweng needed urgent attention," said Khun Sinn, Advisor to the Mayor's Office. "With a better infrastructure in place we are now adding sports facilities, public toilets and spaces for local residents to gather, exercise and hold cultural events such as local craft fairs, art and music events, a floating market, and other attractions."

"With elections due in October 2012, we are hoping theSamui people will give us a mandate to continue the work we have started and to make even more significant improvements to the island in the years to come."

Other ongoing local government projects include resurfacing and upgrading the main Island Ring Road from the Samui Civil Court to Nathon Town. This project includes improvements to the drainage system in the area, increasing road width and adding infrastructure under the road to lay cables and piping. Better street lighting has also improved road safety and residents in the area now enjoy better access to and from the road. With regard to waste, the Thesabaan has also now serviced the island's incinerator, which is once again being used to burn combustibles, but with the necessary separation procedures in place. Sealed landfill sites provide additional waste disposal options and these are now managed to ensure that only suitable types of waste are deposited. On the water management side, lowland reservoirs are being built in disused rice fields near Taling Ngam where salt water conversion will be used to create an additional public water source. In addition to these practical, visible improvements, the current Municipality also understands the need for community participation in the island's development. Education programmes have been introduced in local schools, aimed at creating a new generation of environmentally aware Samui citizens and the Mayor and his team also continually visit local villages to listen to suggestions and keep the islanders informed of the government's plans and progress. "Samui's original communities were built on tradition and strong family values," added Khun Sinn. "Widespread development in a relatively short period of time has since had both a positive and a negative affect on the island and its people. Essentially, the future still lies in the morality of the people that call Samui their home. By fulfilling our promises, involving everybody in the process of growth and working with the government in Bangkok to give the island more independence, we are building on the island's strengths and at the same time re-building its citizens' sense of pride and social responsibility." 9

PROPERTY ACQUISITION IN THAILAND:

4 KEY STEPS FOR BUYERS

With repeat visitors to Koh Samui and Koh Phangnan increasing ever year, it is no surprise that a large number of overseas visitors eventually seek to establish a second home in Koh Samui or Koh Phangnan, or retire and make Koh Samui or Koh Phangnan their permanent home. It is important for would-be property buyers in Koh Samui and Koh Phangnan to understand that the procedure to acquire property in Thailand may be considerably different to the procedure adopted in their home country. Furthermore, foreign buyers must be aware of the legal restrictions which exist in connection with the ownership by foreigners of certain types of property located in Thailand. Consequently, would-be property buyers must heed the maxim that “fools rush in” and take time to understand the legal procedure, the legal restrictions and the risks which may be associated with the transaction. Jeffrey Martin, senior associate of the law firm Limcharoen, Hughes & Glanville (Samui) sets out four key steps to follow when acquiring an interest in real estate in Thailand.

1. Choose the Right Real Estate Agent With little investigation, one will discover that there is an abundance of real estate agents in Koh Samui and Koh Phangnan, who are eager to assist would-be property buyers in the selection of their “dream” property. Real estate agents can possess different expertise, including but not limited to, types of property listed and value of property listed; and some real estate agents even cater for specific nationalities, such as Russian buyers and investors. It is important for the would-be property buyer to select a real estate agent that lists properties of a similar specification to those sought by the would-be property buyer, in terms of the type of property (whether villa, apartment or condominium), size, location and price. It is prudent to carry out enquiries to ascertain whether or not the real estate agent has a good reputation and whether or not the real estate agent has an established presence in Thailand.

2. Reserve the Property In order to secure the real estate, it is prudent to enter into a “reservation agreement” with the seller setting out the key terms of the transaction such as the property description, the agreed price and the agreed payment terms. The Reservation Agreement should also state that the seller will not agree to sell the property to anyone else during the time that the buyer will be conducting due diligence into the real estate. The buyer will usually be required to pay a small deposit to the seller to secure the property, which should be retained by the seller’s lawyer pending the outcome of due diligence enquiries conducted by the buyer. The Reservation Agreement 10


should at the very least stipulate that the reservation deposit will be refundable in the event that the due diligence enquiries undertaken by the buyer yields negative results. The reservation agreement should be tailored to the buyer’s circumstances and any “extras” which you may have negotiated with the seller should be set out in the Reservation Agreement.

3. Due Diligence Once the reservation agreement has been executed, it is important to conduct comprehensive due diligence into the property. Due diligence is one of the most important legal stages when acquiring property in any jurisdiction, including Thailand. Land title due diligence in Thailand requires a professional review of the original land title documents actually physically present at the relevant land office in order to determine whether or not the seller actually owns the land upon which the property is built and whether or not there are any encumbrances registered over the land, such as leases or mortgages. The history of the land title beneath the property should be thoroughly reviewed by a legal representative and a comprehensive report should be issued with a clear opinion on the quality of the land title. It is important to establish whether or not the land has full legal rights of access both on foot and by vehicle and access to the electricity grid, water supply and drainage. Careful consideration must be given to the zoning, environmental and planning restrictions which apply to the land. Litigation checks should be conducted against the land owner (and the authorized director of the land owner if the owner is a limited company) to ascertain if there is any issue with the property or the individuals selling the property. Buyers should be aware that the existence of a number of previous owners does not automatically mean that the land has good title.

4. Contracts and Closing If the due diligence produces agreeable findings, the buyer should execute a binding contract with the seller, obligating both parties to complete the transaction. For both parties, this entails a significant economic decision. Therefore it is crucial that the relevant contracts are carefully worded to protect the buyer’s interests. The following should be considered in any contract negotiation: a) executing two separate contracts for the acquisition of land and a structure on the land, if applicable; b) including representations on behalf of the seller regarding the legality of the title, access to public roads, adherence to zoning and other regulations, and similar matters; c) including adequate default provisions, to provide remedies if a party breaches the contract; an d) including a clause that bestows your rights upon you successors, assigns, and heirs. Finally, on the completion date, the buyer will likely transfer all or a portion of the contract price to the seller, and the seller will register the transfer of the legal interest to the buyer or a separate company, depending on the legal structure of the transaction. This process should carried out by legal counsel using valid Power of Attorneys for each party In following these steps, buyers are likely to avoid some of the headaches occasionally suffered by overseas buyers. This article is intended to provide a very brief overview of the steps involved to acquire an interest in land, or land and structure/s in Thailand, and is not intended as a do-it-yourself guide. Tax Update

THE THAI HOUSE AND LAND TAX I

f you or your company own a condominium unit or villa here in Thailand that was used for even one day (with or without having actually received rental income) during the tax (i.e. generally the "calendar") year then you or your company will most likely be obliged to pay an annual “house and land tax” (“HLT”) in accordance with the House and Land Tax Act (A.D. 1932) and as further amended. The HLT is one of the few taxes that enable the local municipalities, rather than the national revenue authorities, to collect taxes. Pursuant to the HLT, the local authorities in Thailand have the right to collect this tax from certain structure property owners. In general, the HLT is imposed on structures and land if the owner of such structures and land receives, or should receive, rental income from these. The current HLT rate is 12.5% of the annual "rental value." The annual "rental value" is defined as the “sum for which the property might reasonably be expected to let from year to year. When there is a lease, the rent is the basis of the annual value (…)”. The basis of the taxation is the annual rental value of the foregoing year. The most important exemption from the HLT is available where the “houses or other structures (are) inhabited by the owners thereof (…). But note well and again, if your property is subject to assessable rental income for even one day, then the HLT is payable in an amount of 12.5% of the total rental value for the entire year. The owner of property subject to HLT is required within thirty days after having received notice from the relevant authorities, or within the time frame outlined in the same notification, to submit the form “Por. Ror. Dor. 2”. This form constitutes the declaration of the annual rental value of the property for the foregoing year. The relevant municipality will then use this information to confirm or determine the annual rental value of the property and, therefore, the amount of tax to be paid. If the municipal authorities do not agree with the rental value figures submitted or if no figures are submitted, they are empowered to assess and assign the value themselves. By not submitting the above-mentioned form, the right to appeal the decision (i.e. “assessment”) of the relevant municipal authorities is waived. Further, a fine not exceeding Thai Baht 200 will be applicable. Providing false and wrongful information or making a false statement for the purpose of evading the proper calculation of the annual value could also result in punishment with imprisonment not exceeding six months or a fine not exceeding Thai Baht 500 or both.

Unfortunately, the occasion for the municipal authorities to assess the HLT also sometimes provides an opportunity to “discuss and negotiate” the payable amount. This and other inefficiencies relating to the HLT (and the local development tax which is applicable where the HLT is not i.e. to land without structures) has inspired the government to consider drafting a more modern and comprehensive property tax that would change the basis of the taxation of property with structures from the assessed rental value of the immovable property to the assessed value of the property itself. In such case, the municipal authorities would no longer be empowered to determine the tax payable themselves. The assessment of the value of the property would be performed by the already existing Valuation Committee under and in accordance with the Land Code. The same valuation method is actually already in use as the basis for calculating the fees and also the personal income tax payable at the land department upon transfer of immovable property in accordance with Section 49bis of the Revenue Code. This method is based on valuating using actual market value pursuant to Section 103 et seq. of the Land Code, as opposed to rental value. However, like the HLT, it is expected that any such new property tax act would also exempt property if it is inhabited by the owner. Such a comprehensive and modernized property tax that would “replace” the current property taxes including the HLT has been discussed and anticipated for quite some time now. However, although as recently as late 2010 the Cabinet approved a draft of the new tax for various reasons the Ministry of Finance tabled the draft. Koh Samui’s enduring appeal as one of the world’s top holiday destinations has inspired many people to relocate to the island, either choosing to make it their permanent home or spending extended amounts of time living what those in less blessed locations would understandably consider an idyllic lifestyle. riginally from New Delhi, Manish Antal has been involved in the sales and marketing divisions of resorts and hospitality industry products since 1996. He recently left the corporate world and relocated to Samui where he is now launching Oceans 13 The Residences. Manish Antal has vast experience in setting up operations and leading teams in Asia. He has lived and worked in many countries, including India, Thailand, Australia, Singapore, Turkey and Sri Lanka. During his 11 years of employment with Karma Royal group Manish visited Thailand many times, working first in Phuket, then in 2004 on Samui. "Karma was one of

Koh Samui welcomed over 800,000 visitors last year, but relatively few of them experienced the island in the same way its long term foreign residents do. Living on Samui is very different from spending your holidays here. Residential enclaves have developed around a number of the island's beaches, allowing Samui's permanent citizens to combine an idyllic beach lifestyle with the daily demands of work, family and community endeavours. Tourist magazines and websites often list Samui's best beaches, but they usually focus on the main tourist centres of Chaweng and Lamai, with additional recommendations in the less busy beach areas such as Bang Rak and Bophut. Of course, there is inevitable crossover between the tourist and residential worlds on Samui, but people who choose to live on Samui also have their own version of the island, their homes, schools and amenities centred around a handful of popular long stay locations, many of them on and around coast that stretches north from Chaweng. Choeng Mon A rocky stretch of coast backed by steep cliffs and hills divides Samui's eastern and northern beaches. Choeng Mon sits in the middle of this section of the coast and the beach behind the main village is considered one of the island's finest. The areas around Choeng Mon have become very popular with residents and developers, the latter having already built a number of extravagant private villas overlooking the rolling waves in the bay. The sloping land from the cliff tops down to the main road that serves the village is also home to a number of residential bungalows and low rise condominiums. Bang Rak As the main arrival and departure point for Koh Phangan and Koh Tao, and also the closest beach to Samui International Airport, Bang Rak sees plenty of tourists, but most of them are usually just passing through. Bang Rak village has its own appeal with hotels, bungalows, restaurants and bars catering to both short and long-stay visitors. A 3km stretch of road sees local village life blending with tourist amenities, which gives the area its own special character. Bang Por As the Samui coast stretches north towards the port town of Nathon, development thins and the range of resorts become less prevalent. Perhaps because of the lack of tourism in this area, residents have zoned in on Bang Por in the last few years. Land Title Deeds in Thailand There are two main types of land ownership in Thailand which we should explain

Rights of Possession Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

Rights of Ownership Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

Tips for starting a new business Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares. Getting started To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section. Shares Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders. Shareholders and Chairperson A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company. However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government.

Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession. Little things that matter A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. VISAS & WORK PERMITS I have recently been asked to clarify the way the Thai system works with visas and work permits if you are opening a company here and would like to have a work permit. Firstly I must point out that each Thai province does follow slightly different guidelines and my information does in no way substitute you actually having a legal consultation with a reputable lawyer’s company if you actually intend to work. There are those that believe the little they would do in reality would make a work permit hardly worth the trouble. This is a big mistake and one that could cost you more problems than you would believe. The Thai Immigration takes cases of foreigners working without a work permit very seriously and the penalties are harsh. If you are here on a tourist visa you cannot in any way participate in a job. So let’s have a look at what’s actually required to apply for a work permit. Firstly you need to have a business class visa which in most cases will have to be applied for at a Thai Consulate outside of Thailand. There have recent changes to the system, whereby smaller Thai embassies such as the one in Penang, Malaysia, have stopped issuing multiple entry visas. Initially there were those who whispered that the only way to arrange these multiple entry visas was for the individual in question to return to their home country and obtain the visa from their local Thai embassy. This however had been proved to be incorrect with the embassy in Kuala Lumpur still issuing multiple entry visas until recently, but currently the situation remains in a state of flux with even legal professionals unsure as to the long term guidelines. We therefore strongly advise obtaining up-to-date legal advice well in advance of pursuing your visa run, to ensure you are fully equipped with the documentation currently required for your business visa. Those working in Samui who earn a salary of 50,000 Baht per month however, shouldn’t have to face these visa run hassles, as they’re entitled to a business visa that only needs to be renewed once per annum at an immigration office. Further details of this scheme can be obtained via a legal professional or at the local immigration office in Na-Thon. Either way, once you have the correct visa, you’ll be able to apply for or renew your current work permit. Once again there are procedures required for this, which your legal professional will prepare for you. This process might seem tedious, but it is nothing unusual, with every country having its own procedures and legal applications. Thailand is no different and don’t be fooled by the laid back and casual attitude of many Thai people on the island, as this is no reflection of the order required in any formal legal requests such as visa or work permit applications. When it comes to legal matters you need to ensure you follow the correct procedure and can produce the appropriate paperwork. FAMILY ROOMS Traditional homes have different rooms for clearly defined functions, but the open wide spaces in modern homes mean multiple living spaces now often flow seamlessly together. So which room is the family room? The family room should be a cozy gathering space for all members of the family to spend time together, and where warm memories are most likely to be created. When decorating a family room in your house, bear in mind that it should be an all-purpose room used for informal gatherings. More likely than not, a television set is the main focal point of the room, but as they detract from quality time with one another, it's often best to arrange furniture and lighting accents around a beautiful piece of artwork or floral arrangement nstead, or in a way that takes in views through the windows.

If the television must be a focal point, then opt for a flat screen as they are more discreet in terms of interior spacing. If you have a bulky television set, place it in an entertainment cabinet, ideally with doors so it can be hidden away and not the first thing people notice when they enter the family room.

Furnishings Comfort and durability are the two key attributes when furnishing a family room. Some of the must-haves are: • A comfortable sofa and/or soft large chairs to relax in. • Tables and surfaces to set drinks on. • An uncluttered table that can be used to play games on. • A television set. • Lighting that can be adjusted depending on function. • Shelves and storage space for books, games and toys.

Large Family Rooms If you are decorating a larger space, here are some points to keep in mind: • • • • •

Divide the space up into different areas, sectioning them off with furniture. Do not place furniture along the walls. With the furniture, create mini spaces for different functions, such as a reading corner. If you have children, allocate a section of the room with a play table and storage for toys when not in use. A comfortable seating area should be created around the television set. Make sure there are places to set down glasses or plates. The rule of thumb is there should be a surface to put drinks and snacks within reach of every seat.

Garden Planning & Preparation Despite the availability and appeal of good quality botanical specimens in this part of the world, the selection and introduction of varying species is often best saved for the latter stages of the garden design process. The contours and features of the terrain we are working with will dictate the potential constraints or advantages of the envisaged design and aid selection of plants most suited for the final canvas both aesthetically and fro the purpose of shade and soil retention. In the local environment, we are often faced with challenging contours and many residences and developments boasting ocean views are situated on sites that can be extremely steep, whilst lower lying sites may contain depressions.

In order to maximize the safety and utility of the garden area, a particular site may require some groundwork prior to its cosmetic treatment. Terracing steep land with retaining walls or adding back-filled areas that collect water are common techniques to counter typical problems with local site conditions. To ensure earth works are undertaken competently and safely, it would be advisable to seek professional advice and have any structural work planned and installed by recommended professionals prepared to guarantee their work. Poorly executed ground-works can cause dangerous site conditions or merely move the problem elsewhere, particularly in the case of water management. Pronounced seasonal weather characteristics on Samui create their own individual problems.

The Weather Seasonal variants such as high winds, heavy rainfall and persistent dry spells have been unpredictable in duration over recent years, but we can be sure of the impact they have on our plant life, topsoil, garden furniture and whatever else we may have in our outdoor spaces. During the monsoon season massive volumes of water can fall over very short periods, potentially causing devastation to our gardens. With less than adequate planning for such inevitable situations, newly developed sites regularly fall victim to rapid and destructive erosion. Established gardens may also suffer seasonal assaults by the elements, causing unnecessary expense if the problem could be avoided. Some areas susceptible to erosion may employ specimens with deep binding root systems, whereas in other cases a more structural solution may be necessary. Following a heavy rainfall, observe the movement of water through your garden or site surface, taking note of any water remaining for any length of time or coursing to cause erosion. This will help to pinpoint any obvious areas requiring attention. With moderate cases of water settling, soak-away drains can be dug and are easy and relatively quick to install. These work on the principal of drawing excess water underground and promoting its natural dissipation into the earth. In the case of water coursing on your land, the construction of a gutter, scoop drain or underground system should be considered. Any drainage systems involving channeling water should be conscientiously planned to meet with major effective drainage systems keeping in mind that it’s illegal under Thai law to drain water directly onto a neighbouring property.

Other considerations Before work begins on the construction or planting phase, planning may also need to be made for irrigation and electrical layouts for pathways, borders and sala lighting as well as access points for servicing. It’s also important to locate existing underground structures such as septic tanks, PVC or HDPE pipe-work or electrical conduit. In the case of new sites, it should be possible to obtain copies of the architectural plans illustrating the position of these. Natural features on the land such as rock formations and natural waterways will usually be advantageous as garden features and should be utilised wherever possible. Sites with large amounts of rock may benefit from some manipulation to make the best possible use of the available space or to create a particular effect. Access permitting, contracting a backhoe and driver should grant adequate artistic license for how you wish rock to sit on the site. Early consideration of the gardens physical and infrastructural assets and limitations will often prevent costly revisions at a later stage. Likewise, early address of water coursing or dangerous excavations will reduce the risk of site damage through water-coursing, flooding or land slippage. Dealing with earthworks and physical preparation of any site whilst perimeters are open and access is easiest should, in most cases, prove to be the most cost effective approach. Home Maintenance

There are about 20,000 different species of bees in the world. Bees live in colonies and there are three types of bees in each colony. There is the queen bee, the worker bee and the drone. The worker bee and the queen bee are both female, but only the queen bee can reproduce. All drones are male. Worker bees clean the hive, collecting pollen and nectar to feed the colony and they take care of the offspring. The drone’s only job is to mate with the queen. The queen’s only job is to lay eggs. Bees store their venom in a sac attached to their stinger and only female bees sting. That is because the stinger, called an ovipositor, is part of the female bee’s reproductive design. A queen bee uses her ovipositor to lay eggs as well as sting. Sterile females, also called worker bees, don’t lay eggs. They just use their ovipositors to sting. Bees see all colors except the color red. That and their sense of smell help them find the flowers they need to collect pollen. Not only is pollen a food source for bees, but some of the pollen is dropped in flight, resulting in cross pollination. Certain species of bees die after stinging because their stingers, which are attached to their abdomen, have little barbs or hooks on them. When this type of bee tries to fly away after stinging something, part of the abdomen is ripped away.

BUMBLEBEES Bumblebees are considered to be beneficial insects because they pollinate crops and plants. They are very social bees and live in large "families". Unlike honeybees, bumble bees can sting more than once because their stingers are smooth and do not get caught in the skin when they fly away. Diet Worker bees gather both pollen and nectar from flowers to feed to the larvae and other members of the colony. Habitat Bumblebees often nest in the ground, but can be found above ground around patio areas or decks. They will sometimes build their nests in attics or under roof beams. If disturbed, bumblebees will buzz loudly, and they will aggressively defend their nests. Impact As part of the aggressive defense of their nests, bumblebees will chase nest invaders for long distances. The bumblebee sting is one of the most painful stings. Swelling and irritation can last for days after you are actually stung. Prevention Bumblebees can be prevented through inspection of potential nesting areas and removal of potential nesting materials. Because bumblebees will sting when threatened, homeowners are advised not to address the infestation themselves. A pest management professional or beekeeper should be called in to help.

Carpenter bees are solitary bees. They build nests just for themselves and only feed their own young. They get their name from their ability to drill through wood. Carpenter bee stingers are not barbed, so they are able to sting over and over again. Diet Worker bees gather both pollen and nectar from flowers to feed to the larvae and other members of the colony. Habitat Carpenter bees bore through soft woods to lay eggs and protect their larvae as they develop. Female carpenter bees will chew a tunnel into a piece of wood to build a nest gallery. The bits of wood she chews and deposits outside the nest are called "frass". The tunnel openings usually look about one or two inches deep, but they can be up to 10 feet long! These tunnels usually have several rooms where the bees hold their eggs and food. Impact Carpenter bees do not pose a public health threat, but they can do cosmetic damage to the wood

where they build their nests. Carpenter bees are beneficial because they pollinate plants that are ignored by Honeybees. Prevention Carpenter bees can drill into almost any wood, but prefer bare wood, so painting and staining wood can sometimes deter them. However, they will sometimes attack stained or painted wood, and their nests can be hard to reach, so a pest management professional or beekeeper should be called in to help.

The Africanized Honeybee, also known as the "killer bee" lives in South America and the Western and Southern United States. They have been known to chase people for over a quarter of a mile once they get excited and aggressive. Even though they are called "Killer" bees, their venom is no more dangerous than regular honeybees. Their attacks are more harmful because they tend to attack in greater numbers, increasing your chance of having a severe allergic reaction to the venom released when they sting you. Killer bees can only sting once, because their stingers are barbed and tear off when they try to get away. Diet Worker bees gather both pollen and nectar from flowers to feed to the larvae and other members of the colony. Habitat Africanized bees have small colonies, so they can build nests in unique places. They have been known to live in tires, crates, boxes, and empty cars. Impact Their venom is no more dangerous than regular honeybees-they just tend to attack in greater numbers, dramatically increasing the odds of having an allergic reaction to the venom. If you are chased by Africanized honeybees run in a zigzag pattern and seek shelter in a house or car. Do not jump in the water.They will just wait around until you come up for air. Prevention Because of the aggressive nature of these pests, a pest management professional or beekeeper should be called in to help.

This feature aims to providing useful information and advice on what you, the buyer, should be aware of when purchasing property in Thailand. Buying a property in Thailand, whether as a dream, holiday or retirement home or purely as an investment should be an enjoyable and rewarding experience with as little stress as possible. Almost every buyer looking to purchase a property in Thailand is a present or previous owner of property in his or her own country which provides them with a good understanding of the legal and sometimes lengthy procedures including governmental safeguards protecting them. However! Thailand, like most Asian countries is basically operated on a “buyers beware basis� with no property inspections undertaken until completion. This leaves only legal action available to the buyer should they find themselves in a dispute. But it is a lengthy and costly way to go about sorting out problems that could have been avoided. Studies have show time after time that the number one complaint from homeowners around the world in the medium to long term with their property purchases is the quality of the construction and finish. After legal diligence, the quality of the construction and thus the longevity of your property are the most important aspects, yet it is overlooked a vast majority of the time. The construction quality will affect you personally and financially no matter if it’s your home or an investment and the loss could be staggering. Yet little money if any in most cases is spent on checking the quality of the construction itself.

No matter if the property is already constructed or is to be built, the building itself is on average over 73% of the total value of the purchase price and the major factor why you purchased it in the first place. With this considerable financial outlay on the actual property itself any construction defects whether minor or significant will have a detrimental impact on the value of the property and its appeal for rent or resale. Added to this is the actual burden of undertaking these works, especially if you reside overseas to get the property to an acceptable standard for rent or resale in order to maximize profitability and gains. It is therefore very important when buying a property, getting it right first time is so very important. Prevention is better than the cure! Below are just some of the things you should consider when considering the purchase of property or land in Thailand. Get independent legal advice (this is a must). Contractually agree all matters (this is a must). Check service and management charges including water and electric unit rates? Ask around, i.e. restaurant owners, hotel managers for general opinion and to build a bigger personal impression for yourself of the property, project and builder/developer. Ask local people about the areas your looking at i.e. is the area prone to flooding, anti social elements, noise pollution etc. Specific questions you should be asking if buying a new completed property: (1-year old or less) Ask for a warranty period of 6-12 months. Talk to other owners and gain an insight into their personal experiences of the process. Ask for any images taken during construction, as a way of checking after completion. Ask what guarantees are provided, for how long and by whom? (A structural and general guarantee is a must). Specific questions you should be asking if buying an off plan property: (Not yet built) Ask what guarantees are provided, for how long and by whom? Ask for photos on a regular bases to keep track of the work in progress. Make stage payments or small but more regular payments based upon completion targets to help small contractors if required and your exposure to loss. Ask what guarantees are provided, for how long and by whom? (A structural and general guarantee is a must) Look closely at the construction specifications from each builder as the price means nothing with out this comparison. Insist on a 5% retainer after completion for 12-months to “snag” the property of minor defects. Specific questions you should be asking if buying an old property: (2-years or more) Ask for a guarantee period with money held by the lawyer. Seek independent advice on what specific area's of the property should be looked at based upon its particular construction i.e are there common problems with the style of roof and tile for example. Check with neighbors on possible issues and works carried out historically. Have the property inspected by an independent 3rd party and ask for a ‘full warranty’ on their services should a problem accrue in the short term. Never do items: Never pay large amounts of money in cash. Never agree to a labor only price, it has no consideration for material waste and losses. Never pick the lowest price, in most cases it’s the lowest price for a good reason. Never purchase the first property/land you see first, but look and get a feel for specific areas at various times of the day and night to form a great impression of the area’s you like. No matter what the property type, value, location and design, the short-term value and long-term capital gains will be dramatically impacted should the property fail to stand the test of time. Stunning beaches, an affordable lifestyle and an appealing island environment have drawn a growing number of visitors and residents to Koh Phangan’s tropical shores. Many of the island’s visitors choose to stay longer than they originally planned and this has led to the establishment of a sizeable foreign community of long stay tourists, working residents, business owners and retirees. The number of foreign investors choosing Koh Phangan as their second home is increasing every year, with easy transport access, a fast developing infrastructure and a range of lifestyle and hospitality services all adding to the island’s growing appeal. Koh Phangan is a rare island escape just a short boat ride from Koh Samui’s more developed and commercial environment. This means residents and visitors can enjoy the unspoiled beauty of some of Thailand’s finest beaches while still having access to the comforts and benefits of a modern lifestyle. The recent growth in the number of luxury hotels and private villas on the island has prompted the emergence of more upmarket retail, dining and entertainment choices, with cool nightspots and restaurants opening in the more popular beaches like Haad Rin and Thong Nai Pan. As Koh Phangan evolves from a backpacker haven into a full service destination, the island is attracting those with the spending power to combine natural escape with a sophisticated island lifestyle. On a practical level, the opening of a modest Tesco Lotus Supermarket, combined with a significant increase in the number of foreign run businesses has had a real impact in terms on the ease of living on Koh Phangan. Designer boutiques, international cuisine, real estate agents and developers are all gradually changing the island landscape, yet the laid back lifestyle has thus far survived and the local people are known for their commitment to 139


preserving their traditional culture. Whether selling the daily catch from their boats, chatting with friends in the shade of the village ‘sala’ or celebrating weddings with dances and local music, local people remain distinctively Thai in many ways. As for the foreign residents, the ease of life, natural beauty and diversity of lifestyle choices make Koh Phangan a unique destination as either a permanent or second home. Koh Phangan real estate Koh Phangan’s real estate sector has grown as the island has developed and become more popular with visitors from around the world. Investment opportunities abound, whether it is raw beach and mountain land, off plan residential purchases or completed luxury villas for sale. Restrictive ownership laws in Thailand, however, mean buyers are advised to go through reputable law firms when considering any purchases on Koh Phangan. As is the case on Koh Samui or Phuket, it is important for anyone considering an investment to thoroughly research the laws and regulations, as well as to ensure that any land titles are thoroughly checked and that the most secure method of purchase is found to guarantee a trouble free, long-term investment. Investors should also look into the track record of any construction firms they employ to guarantee that their reputation is solid and that any previous projects have been successfully completed. Island development Recent road improvements have made Koh Phangan significantly more accessible to visitors and potential residents. Work is ongoing in several areas, particularly on the road that links Ban Tai with Thong Nai Pan, as well as the mountain pass that connects the west and east coast beaches. This means it is much easier to travel around the island and therefore also more convenient for long stay visitors to base themselves on a particular beach and head out for shopping, dining or entertainment. Reaching Koh Samui is also very swift and easy with ferry companies offering regular services from Thong Sala to Big Buddha Beach and Nathon, including a car ferry service that also continues on to the mainland at Suratthani. It is also possible to hire a speedboat, which can take as little as 15 minutes to cross the channel that separates the two islands. A planned airport has yet to be confirmed on Koh Phangan with local people both for and against such a move. Various plans have been discussed, but the island’s geography 140


means construction of an airport would be expensive and complex and may even involve land reclamation or the creation of a floating runway. Phangan Hot Spots Haad Rin was made famous by the monthly Full Moon Party and consists of two sweeping beaches known as sunrise and sunset and connected by a small but thriving tourist town on the east tip of the island. Haad Rin has become a bustling centre for shopping, with a large selection of retail outlets offering beach wear, jewellery, crafts and souvenirs. Haad Rin also boasts a handful of modest medical centres, but for serious conditions patients are transported to the larger and better equipped hospitals on Koh Samui. Baan Tai beach is a small oceanside community situated around half way between Haad Rin and the port of Thongsala. Most of the beach resorts in the area have their own Thai and western restaurant, and the village that lines the road has developed into something of a modern hippy enclave, with a bakery and a handful of international cafes. Haad Yao has long been a popular holiday location and is easily reached by road from Thongsala. The beach is known for its fabulous sunsets and the laid back feeling that Koh Phangan is well know for. A good selection of beach and village restaurants serve both tourists and long stay residents, with tasty Thai food and western favourites all available. There’s also a good bakery serving fresh bread. Chaloklum is one of the island’s largest fishing villages and still offers fishing boats a safe harbour during the storm season. The long, secluded beach is a picturesque idyll and the village that has grown along the coast now boasts a diverse bar and restaurant scene, known to many residents and regular visitors for its fine seafood restaurants and water sports centres. Haad Salad is on Koh Phangan’s west coast is known as a quite, family oriented beach, lined with resorts but with some new residential offerings in the surrounding hills. Located down a steep hill from a hillside road, the beach has retained a remote feel but still offers plenty of good food and recreation choices. Thong Nai Pan on the North East coast of Koh Phangan is home to what many people feel are two of the best beaches in Thailand. Tong Nai Pan Noi (small) is the location for some of the island’s most luxurious accommodation, while Thong Nai Pan Yai (big) features a range of mid-range resorts-restaurants and a luxury private development at Thong Nai Pan Estate. Both beaches are also the chosen location for new residential projects in the nearby hills. Other popular beach areas on Koh Phangan include Bottle Beach, a peaceful desert island destination, Sadet beach, home to Koh Phangan’s most famous national park, as well as Had Thien and Had Yuan beaches, only accessible by boat and famous for their wellness centres and peaceful tropical surroundings. 141

Reviving Thai Design Thai Revival Design is an architectural firm on Koh Samui that specialises in bringing back the features of fine traditional Thai design - but in a new way. Ralf Amsden is an architect with an established architectural firm in the United States. He has long been interested in the countless ways that different cultures adapt to their environments in terms of design and the building of structures. Ralf's interest and background in anthropology has taken him all over the world. Thailand is an excellent example of traditional design concepts, so Ralf decided to visit the Kingdom recently and view its architecture first hand. The significant cultural and architectural differences between the United States and Thailand captivated him immediately, and he has since returned four times. "Thailand is very special and unique for many reasons," he says. "Because it has never been occupied be a western foreign power, the indigenous architecture is some of the finest and most beautiful in Southeast Asia."

Regional variations There are four primary geographic regions in Thailand, each of which boasts its own characteristic architectural style dictated by a combination of climate and culture. The Central region, which includes the capital of Bangkok, is also the political and spiritual heart of the country. It is also the centre of politics and history which radiate throughout the rest of Thailand. It is here that the great kings reigned and you will find the spectacular Grand Palace with its sacred Temple of the Emerald Buddha. Architecturally, it was in the central region that the traditional Thai home was established over a thousand years ago.

These homes had characteristic features yielding to the expansive rice fields which thrived in the Great Plains fed by the Chao Phraya River flooded every year during the rainy season. As a protection against the floods, the traditional Thai house was a wooden structure erected on a platform raised on wooden posts. Its gable roof high and gracefully sloping is known for its panlom, or gabled roof panels. These panels are curved, windbreak rake boards and the style has been in existence since before the 8th century. The central houses known as Ruen Thai Derm are the classic, traditional Thai houses. This home style is well-suited to the extremes of intense, baking heat and abundant rain. It is among the most beautiful houses built in Southeast Asia and is the style most closely associated with Thailand. The Northern region house designs are very different. Lanna architecture is distinct from the central region in several ways. There is no middle terrace and there is a veranda located on the gable end. Due to the cooler climate, the windows are smaller. The entrance is covered with a small roof, and kitchens, rather than being located at the side or the rear of the home, are usually placed in the front. There are no carved panels under the windows. The gabled roof typically has a pair of crossed, hand-carved boards called “Kalae” at each end of the roof at the peak. These Kalae give this house its name. The Northeastern region boasts traditional “Isaan” houses, which are more utilitarian than the other regions. This area is more arid with a low annual rainfall. Here you will find simple wooden homes with less elaborate carvings or other decorative details than in other areas of the country. Roofs are frequently covered with grass thatch or corrugated iron. Although the area is more arid than most in Thailand, there is still seasonal flooding, so houses here are also raised. 144


The Southern region of Thailand differs again, both architecturally and culturally, with a diverse population of which 70% is Muslim. Abundant rain creates a humid environment, and as a result of the rain, houses also raised as protection against potential flooding, usually on stone or concrete piers. The roofs of the southern area are more likely to be hipped than gabled, as is typically found in the rest of the country. Intricate fretwork carving is often found on interior and exterior walls, allowing for ventilation of the interior space. The decorative trim on houses in the south is usually brightly painted, creating a vivid and energizing atmosphere.

Back to the future Times change and designs evolve but it is certainly possible to reclaim the traditional look of Thai housing by reviving elements of the past that created the Kingdom's unique architecture. It is also important that a home is functional for modern life. FLOOD SAFETY TIPS

Thailand recently experienced some of the worst flooding in its history and with the monsoon season still to come in Southern Thailand, Samui may soon be experiencing more heavy rains. Drowning is the number one cause of flood deaths and most cases occur during flash floods. Even six inches of moving water can knock you off your feet so its important to take precautions in times of flood.

Below are some tips to help you avoid the worst. Use a stick

If you are ever caught in a flood, use a pole or stick to make sure that the ground is still there before you go through an area where the water not flowing.

Do not drive through a flooded area

Most people drown in their cars rather than anywhere else. Don't drive around flood road barriers - the road or bridge may be washed out.

Stay away from power lines and electrical wires

Electrocution is also a major killer in floods. Electrical current can travel through water. Report downed power lines to your utility company or local emergency manager.

Turn off your electricity when you return home

Some appliances, such as television sets, can shock you even after they have been unplugged. Don't use appliances or motors that may be wet, unless they have been taken apart, cleaned, and dried.

Watch for animals, especially snakes

Small animals that have been flooded out of their homes may seek shelter in yours. Use a pole or stick to poke and turn items over and scare away small animals.

Look before you step

After a flood, the ground and floors are covered with debris including broken bottles and nails. Floors and stairs that have been covered with mud can be very slippery.

Be alert for gas leaks

Use a flashlight to inspect for damage. Don't smoke or use candles, lanterns, or open flames unless you are sure that the gas has been turned off and the area has been aired out.

Carbon monoxide exhaust kills

Use a generator or other gasoline-powered machine outdoors. The same goes for camping stoves. Fumes from charcoal are especially deadly -- cook with charcoal only outdoors.

Clean everything that gets wet

Floodwaters have picked up sewage and chemicals from roads, farms, factories, and storage buildings. Spoiled food and flooded cosmetics and medicines are health hazards. When in doubt, throw them out.

Rotary Flood Relief In recognition of the need for help for the victims of the flood disaster in Bangkok, the Rotary Club of Koh Samui has donated hundreds of articles of clothing left over from their September Samui Mala Second Hand Sale to the Appeal made by supermarket chain Big C. Members of the club contacted the local Koh Samui store's General Manager Khun Ekahop Chumpurat who rallied his staff to help take the clothing into the supermarket for later delivery to Big C’s main warehouse in Bangkok. From there, Big C will be using their own transport and with the help of local charities and local government departments will distribute the clothes along with other donations from their country wide supermarkets to those most in need. Rotary Clubs throughout in Thailand have also set themselves a target of purchasing and distributing one million bottles of water to flood victims. The Rotary Club of Koh Samui has already sent a donation of 30,000 baht from their Disaster Fund to help achieve this target.
