Moving with the

Times

As Samui heads into 2011, the island is a very different place than it was at the beginning of the first decade of this century. Diversity is an understatement when it comes to the island's economic, social and cultural landscape, which means business and public interests not only cross over, but also conflict with each other regularly. Balancing the needs of all the sectors and interests on Samui is therefore a complex task, one that the local government deals with on a daily basis, while at the same time attempting to deal with the practical needs of an ever-expanding island. When the current administration was elected by the local people, they were faced with a mammoth task. Uncontrolled development had created serious infrastructure issues, while a series of municipal governments controlled by Suratthani had been largely left behind by the fast pace of commercial growth, leaving a distinct lack of foundation when it came to providing basic amenities or any semblance of integrated community management. The initial challenge was to simply assess the scale of the problems and identify ways to solve them. This, they did both by talking to local people and also by seeking national and international assistance. At the same time they began to allocate what limited public budget they had to make urgent improvements that matched the needs of the island as a whole. Asphalting the island's Ring Road, improving drainage and cleaning up the roadsides were three major projects chosen by the local government early in their current term and all of these have now been initiated and remain ongoing. These projects have already significantly improved transport and access for residents and businesses alike, while at the same time giving international visitors a more sophisticated and well organised impression of Samui as a whole. Completing and extending such major works required a significant increase in public funds and this could only be achieved by changing the fundamental status of the island at national level. Previously, Samui was simply considered a small part of Suratthani province, but after an extended period of lobbying and a series of presentations to the government in Bangkok, the island now has special status as an

independent administrative region and therefore enjoys greater recognition and in some cases receives direct funding from central government. "This has enabled us to apply a more long term approach," says Khun Sinn, Advisor to the Mayor's Office. "The new projects and initiatives being launched this year will improve the quality of life for local people and also provide a framework for future development'. Projects that will have an impact in the coming year include improving and widening the road behind the airport. The project required the consent of each local land owner along the route and also the involvement of private enterprise, including Bangkok Airways. Good progress has been made and the road will soon provide a wider, cleaner and smoother route to the planes. In addition, the stretch of road passing the lake from the main road in Chaweng will also be asphalted. Another initiative involves dealing with waste disposal. Funds have already been allocated to repair the island's incinerator and lined land-fill sites have also been created to cope with the high levels of garbage collected from households and businesses every day. To reduce the pressure on these services, a recycling programme has also being implemented with the rubbish separated and items re-used when possible. As part of a more long-term strategy, the island's younger generation is being educated as to the value of reducing their impact on the environment, both through public campaigns and special events, as well as in classes at the island's schools. "Making lasting changes has to involve young people," added Khun Sinn. "We can deal with urgent problems on a case by case basis, but to really make a difference we have to teach the island's future leaders to value their legacy." Samui's waterways are also high on the Municipality's agenda for 2011, with plans to clean up and beautify the main canals in Chaweng. On his travels through Europe, Khun Sinn noticed how a city's waterways can be made an integral and attractive part of the urban environment. The government therefore plans to clean the water, remove waste and encourage local people to maintain Chaweng's waterways by installing walkways, benches and lighting, effectively creating a new pedestrian zone that will appeal to tourists and residents alike. Undertaking major structural improvements means targeting different areas based on their specific needs. Few people realise the total scope of public projects currently in progress around the island. In some cases, the changes may seem small, but when considered as a whole they add up to a significant overall improvement. As more funds are allocated from Bangkok, Samui's government will continue to push forward with projects that will provide Samui with a firm foundation for future smart development.

Litigation in most jurisdictions is considered to be an expensive, slow and cumbersome process for a party to enforce its contractual rights and / or recover damages from the defaulting party. In Thailand, these problems are compounded as court proceedings are required to be conducted in Thai and you are obliged to engage a Thai lawyer as foreign lawyers are not allowed to practice law in Thailand. Given these problems why do parties litigate their commercial disputes? One of the main reasons is that litigation is the default procedure where no other form of dispute resolution is prescribed in the contract. The most common reasons for not having a dispute resolution provision in a contract are a) the person drafting / reviewing the contract does not foresee any disputes arising in the future, b) he / she is not aware of the alternative forms of dispute resolution that are available and is not aware of the difficulties of litigation in Thailand or c) the omission of the dispute resolution provision is simply an oversight.

30-YEAR LEASE STRUCTURE Many developers of leasehold apartment projects in Koh Samui and Koh Phangnan offer prospective investors an ownership structure which is often described in marketing materials and on project web sites as a 30 + 30 + 30 year renewable lease. Christian Glanville, Partner at Limcharoen Hughes & Glanville (Samui) examines the concept of the 30 + 30 + 30 year lease and identifies some important issues which can affect an investor’s security of tenure in residential leasehold structures.

The rental for each contractual renewal is usually limited to no more than the costs of registering the subsequent leases.

A number of leading property developers in Koh Samui offer a more sophisticated “Protected Leasehold Structure” to buyers in residential developments. In addition to the registered 30 year lease with lease renewal options, the investor is also provided with a share in an offshore company which in turn owns shares a limited Thai company which owns the project land and grants the lease to the each of the buyers. This structure allows the owners in the project, collectively, to exercise control over certain important decisions of the land owning company relating to the land, such as (in certain circumstances), the lease renewals.

It is important for investors to ensure that the legal provisions for the renewal of the lease are as robust as possible and that the procedure set out in the lease agreement for the registration of the lease renewals are clearly defined. The identity of the person or entity granting the lease (usually called the Lessor) is an important consideration for investors and can have an impact upon the likelihood of the lease being renewed at the end of the initial 30 year term.

In conclusion, leasehold investments are a secure and viable means of acquiring an interest in real estate in Thailand for a term of years beyond the maximum registered lease term of 30 years. However, investors and their legal representatives must ensure that the leasehold structure which is being offered is fully compliant with the laws of Thailand and that the lease renewal options are as robust as possible within the parameters of Thai law.

Investors should be aware that if the Lessor is a living person, it may not be possible for the investor to enforce the lease renewal options against the heirs of the Lessor in the event that the Lessor dies during the initial 30 year registered lease term. The security of the lease renewal can be enhanced if the Lessor is a limited Thai company. Legally speaking, a limited Thai company is a “legal person” in the sense that it can be sued in the same way as a living person if it fails to perform its obligations under a lease contract, however, unlike a living person, a limited company cannot die or disappear. Notwithstanding the benefits of leasing from a limited Thai Company, the Thai company itself must be correctly and legally formed and properly maintained during the lease term.

TAXATION of Personal Rental Income

Many purchasers of real estate in Thailand are not using their newly purchased home as a permanent personal residence. Such assets are often meant to be used as a holiday home only and are unoccupied for the remainder of the year. One of the ongoing financial burdens of owning a holiday home is the common area fee. This fee is usually connected to the ownership of a holiday home and payable even if the purchaser does not use his asset. In order to “cover the losses” or to receive a return of investment some purchas-

ers are willing to rent out their holiday home for a limited time and therefore “earn” income from their asset. Such owners must be aware of the taxation issues connected to the lease income from such holiday home. This article will discuss the taxation of individuals who own real estate in Thailand and who receive rental income from renting out the property.

First of all, it is important to note that the duty to pay tax on rental income in Thailand does not depend on being a "tax resident" of Thailand or whether you receive the income in Thailand. This fact is often misunderstood. A tax resident of Thailand is “any person staying in Thailand for a period or periods aggregating 180 days or more (...)” (RC Section 41 ). However, rental income is considered taxable income in accordance with Section 40(5) of the Thai Revenue Code ("RC"). And RC Section 41 further states that “[a] taxpayer [i.e. "anyone"] who in the previous tax year derived assessable income under Section 40 (…) from a property situated in Thailand shall pay tax (…), whether such income is paid within or outside Thailand.” Therefore, an individual, whether resident or non-resident, has to pay tax on lease income independent of whether the rental income is paid on-shore or off-shore.

The amount of tax payable is calculated on a progressive tax scale for personal income tax purposes as follows:

The individual tax payer is required to report and remit his income tax using the personal income tax return form PND 91 by the end of March after the year in which the income was paid. In such a case, only the rent (pre-)paid to the developer can be deducted as an expense. Another option for the tax payer to define the taxable income is to procure sufficient evidence of the tax payer's actual expenses. If these are higher than the standard deduction allowed necessary, then reasonable expenses shall be deductible. Note that restrictions on deductibility apply in accordance with the relevant regulations for corporate entities in Thailand. Living on Samui There is a fast growing expatriate community on Koh Samui, with people moving from Europe and beyond to escape the stresses of western life. Thailand is known as one of the most welcoming countries in the world and as Koh Samui has developed over the years it has gradually begun to offer all the comforts of home, but in a tropical island location. Living on Samui is easy; the island now offers a range of excellent locations for shopping, including two large, well stocked supermarkets: Tesco Lotus, Big C and Tops. In fact, with all the modern conveniences now available it's sometimes easy to forget you are in Thailand at all. New shopping malls and entertainment centres are on the way, and Western treats like good wine and imported food that foreign residents may have once missed, are now readily available. People who live on Samui enjoy a vast choice for wining, dining and entertainment. Thai food of course abounds, and is both tasty and extremely good value. There is also a huge choice of international cuisine with everything from fine French cuisine to fast food chains. For those who like drinking and socializing, many Western style pubs and clubs not only serve local alcoholic drinks but also offer many favourite international brands. A number of bars also show live international sporting events, so it's possible to enjoy a cold beer in the sun whilst watching your favourite football team play in the cold wind and rain back home. Of course Thailand wouldn't be the same without its people. It is mainly because of their friendly nature that foreign visitors keep coming back and end up living on Samui. Most local people speak a certain amount of English, which means that speaking Thai is not necessary, although life becomes much easier if you do make the effort. Don't expect tobe living an authentic Thai life though; around 80 percent of the population on the island is made up of visitors or expats. Samui is fast becoming a comfortable, sophisticated haven in the sun, but it is also important to remember that there are significant cultural differences that may cause frustration. Local people enjoy a relaxed approach to life, and this can take some getting used to. As long as you are prepared to meet the local people half way, living on their tropical island can be a pleasure indeed.

Advantage Koh Samui is reaching an economic crossroads. After two years of uncertainty caused by the world economic slowdown and political troubles in Bangkok, tourist arrivals to Thailand have increased significantly, with the larger resort destinations like Phuket and Pattaya enjoying high occupancy,causing property developers to predict strong sales through 2011. On Koh Samui, this year's high season initially brought large numbers of visitors to the island, but the busy period started late and quickly cooled after New Year. Choosing a Reliable Agent Whether you choose to live in a gated development, purchase a stand-alone home, or for the even more adventurous, buy a piece of raw land on which to build your future dream house, you will be in need of the services of a good real estate agent. Choosing the right agent is essential as a reputable firm with good local contacts can help you avoid many of the pitfalls that a less informed buyer might encounter. There are now so many different agents on the island, it is difficult to choose between them. Ideally though, your agent should be able to demonstrate a solid background in the industry and offer examples of successful deals they have handled that are similar to your own plans. It is also vital that your agent has good local connections with Thai partners and the authorities. Paperwork and local procedures can sometimes be daunting, but if you have the services of a quality agent with good local knowledge, almost all of the potential stumbling blocks can be swiftly traversed with little or no headaches for you, the buyer. It is vital, for example that you know you are buying or leasing the right type of land. There are various different land titles, the most sought after is the 'Chanote' title. This indicates that the land has been officially surveyed with the use of GPS and its boundaries are now fixed. Be warned that buying land without professional help could mean purchasing what looks like a bargain piece of land that may turn out to be unusable due to the land title. Other pitfalls include road access and the availability of utilities such as electricity and water, not to mention the processing and checking of legal documentation and ownership rights. Once you have found a property, you will have to consider the various purchase options carefully. Foreign individuals may own a property on a renewable 30-year lease, but in the past, many opted to set up a Thai company in order to purchase the property freehold. The latter is less easy than it was a few years ago, but your agent should have a full understanding of both procedures and will be able to explain the pros and cons. Owning a Thai company involves legal and tax issues that you should be well aware of before pursuing this avenue. With so many things to consider, it is easy to see why the services of a good and reputable agent are not just advisable, but essential. By working closely with them to find the solution that best suits your needs, you should enjoy a smooth and painless experience when setting up your new island home.

Building a Property Having a home built to suit your own tastes and needs can be a cost efficient, not to mention rewarding experience. It does take time, patience and energy however, and you need to be absolutely certain that the people you employ to build the property are capable of delivering the house you have in mind.

Once the land is purchased and ready for development, thoughts can turn to the design of your house. Of course, you can be as involved in the design process as much as you wish, from merely requesting certain facilities or features all the way to designing the floor plan in its entirety. Either way, your ideas will have to go through a certified architect in order to ensure the plans are both practical and legal. Many laws exist in Thailand to ensure that buildings do not move too far away from Thai cultural traditions. Once the architect has completed your official plans, your builder, if you have already secured one, should then be able to work out a detailed quote to construct the property to the specifications. When choosing a builder, don't be afraid to ask for references. Some contractors may even offer to take you around some of their previous projects so that you can see the quality of their work and perhaps gain some inspiration for your own home. Several contracting companies are foreign run or employ foreign representatives, which can save time and confusion due to communication problems. It is always good to try and strike up a rapport with the Thai partners and staff too though, as their local knowledge will often prove invaluable. Once you have chosen your contractor, as always make sure your investment is protected by the correct documentation. It would be advisable to have an independent law firm check any paperwork for potential grey areas. If you have ever had a home built in the West, you would have received certain assurances from the building company, including an agreed schedule for completion, a performance bond and a warranty on the finished product. Providing such guaraantees is not always common practice in Koh Samui so the kind of guarantees you are offered should have a significant bearing in your initial choice of construction company. A performance bond is a guarantee issued by the contractor's bank to secure any advance payments you have made. When building on Koh Samui, you will likely need to pay an initial deposit in order for the builder to obtain materials and retain a workforce. Thereafter, you will pay an agreed amount of instalments, which will likely be tied in with certain pre-agreed stages in your home's route to completion. The initial deposit, which could be around a quarter to a third of the total amount, will remain unsecured if no performance bond is issued. In terms of warranty, you should insist on at least twelve months coverage from the completion date. This should be plenty of time for any major building defects to become apparent and resolved at the cost of the building company. With the plans cleared, the paperwork checked and your deposit paid, building can commence. If possible, it is a good idea to make regular visits to your property during the construction phase. This is perhaps the best way to avoid problems or a misinterpretation of your wishes and also means building good relations with the workforce. It will establish your authority as the paying client and seeing your property gradually come together is almost as rewarding as the first night you'll spend in your new tropical home.

Land Title Deeds in Thailand There are two main types of land ownership in Thailand which we should explain

Rights of Possession Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

Rights of Ownership Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

Tips for starting a new business Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

Getting started To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder's meeting to reach an agreement on the purpose of your business and set up the company's operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code's partnership and companies section.

Shares Besides the issues of business registration, you must also make sure that your company's shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company's shareholders. The book is evidence that will identify the company's shareholders.

Shareholders and Chairperson A Limited Company's shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company's rights, such as landownership. If less than 49% of your company's shares are held by foreigners, your company is considered a Thai company. However, if foreign nationals hold more than 49% of the shares, your company is a foreign company.

The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department's staff are now required to thoroughly investigate your Thai shareholders' sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Little things that matter A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company's financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company's board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company's business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. VISAS & WORK PERMITS I have recently been asked to clarify the way the Thai system w works with visas and work permits if you are opening a company here and would like to have a work permit. Firstly I must point out that each Thai province does follow slightly different guidelines and my information does in no way substitute you actually having a legal consultation with a reputable lawyer's company if you actually intend to work. There are those that believe the little they would do in reality w would make a work permit hardly worth the trouble. This is a big mistake and one that could cost you more problems than yyou would believe. The Thai Immigration takes cases of foreigners working without a work permit very seriously and the penalties are harsh. If you are here on a tourist visa you cannot in any way participate in a job. So let's have a look at what's actually required to apply for a work permit. Firstly you need to have a business class visa which in most cases will have to be applied for at a Thai Consulate outside of Thailand. There have recent changes to the system, whereby smaller Thai embassies such as the one in Penang, Malaysia, have stopped issuing multiple entry visas. Initially there were those who whispered that the only way to arrange these multiple entry visas was for the individual in question to return to their home country and obtain the visa from their local Thai embassy. This however had been proved to be incorrect with the embassy in Kuala Lumpur still issuing multiple entry visas until recently, but currently the situation remains in a state of flux with even legal professionals unsure as to the long term guidelines. We therefore strongly advise obtaining up-todate legal advice well in advance of pursuing your visa run, to ensure you are fully equipped with the documentation currently required for your business visa. Those working in Samui who earn a salary of 50,000 Baht per month however, shouldn't have to face these visa run hassles, as they're entitled to a business visa that only needs to be renewed once per annum at an immigration office. Further details of this scheme can be obtained via a legal professional or at the local immigration office in Na-Thon. Either way, once you have the correct visa, you'll be able to apply for or renew your current work permit. Once again there are procedures required for this, which your legal professional will prepare for you. This process might seem tedious, but it is nothing unusual, with every country having its own procedures and legal applications. Thailand is no different and don't be fooled by the laid back and casual attitude of many Thai people on the island, as this is no reflection of the order required in any formal legal requests such as visa or work permit applications. When it comes to legal matters you need to ensure you follow the correct procedure and can produce the appropriate paperwork. All in all, it is easy to see why the services of a professional and thorough legal company are invaluable, saving you much confusion, stress and potentially time and money. 100

The main tools of autism therapy are: 1. Attract the children’s attention away from inside their own imagination to the external surroundings such as the home environment. By stimulating all five senses, this method helps to promote effective brain development. Autistic children do not respond to external stimulation in a normal manner, and often show too much or too little responsiveness. - Stimulate a physical sense of touch. Through holding, hugging, kissing, and massaging, autistic children can feel love and warmth, and learn about interpersonal interaction and relationships. - Stimulate the sense of sight. By making eye contact, autistic children can improve their social interaction skills. - Stimulate the sense of hearing. By talking gently and playing music to them, autistic children can develop their language and communication skills.

- Stimulate the sense of smell. By teaching g autistic children to identify different scents, they can learn to associate external stimulus with objects in their memory. - Stimulate sense of taste. By teaching autistic children to differentiate between the tastes of sour, sweet, salty or bitter, they can learn to categorize ategorize sensations and link external stimulus with memories of past experience. 2. Teach autistic children to understand and the structure and dynamics of their immediate te family. By learning names and being able to associate ate them with the different family members, these children dre en can start understanding their role and how they fit into a larger social group. 3. Teach the children to know their name. By learning their own name and responding ng to hearing their name called, autistic children can n start developing social interactive skills. 4. Assist the children to complete activities s they wish to accomplish. The majority of autistic children are not capable able of articulating what they want done, so they resort sort to signaling by holding a nearby adult's hand nd to communicate their wishes. By holding an autistic child's hand but persuading and helping them em to achieve their own tasks, these children n will experience a decrease in frustration and subsequently an increase in their self confidence.. 5. Train the children in routine activities. Autistic children are taught to identify which tools are e used in basic routine activities. Once they are able e to o point out the correct objects, they are then taught th the e hild processes of the "how to". For example, once a child w to o learns to identify forks and spoons, they learn how use a fork and spoon to eat. 6. Encourage the children to enjoy playtime stic By engaging in playtime interaction with autistic s in children, they can learn to keep their emotions balance and practice their interpersonal skills.

7. Teach children to communicate through gesture Through this method, trainers teach children to communicate by using hand gestures to communicate. After this is achieved, autistic children are then trained to use their mouth muscles, such as blowing cotton wool, drinking from a straw, and speaking. 8. Recognition of expression By teaching autistic children to read expressions, they can learn to identify emotions and needs of others, which will help them as they interact with society. 9. Medical therapy There are no medical treatments that can cure autism, however, some medication can be used to treat certain unpleasant behavioural traits associated with autism, such as hyperactivity, lack of concentration, aggressiveness and impulsive behaviour.

2. Basic knowledge increases. Children in the centre learn to recognize colours, geometric shapes, Thai and English alphabets, and learn to develop their written communication skills. About the C Centre Samui Lea Learning Centre for Special Needs was established by Mrs. Dalin Reuang Isoon, providing a learning centre learnin cen on Koh Samui for children who suffer from neurol urol neurological or developmental difficulties, such as brain disorders dis or autism. With financial financ assistance from the Koh Samui municipality municipality, the Centre has been able to provide therapy and support to children with special needs free of cha charge since opening its doors in March of 2009. With plans to t be registered as a foundation to assist children with wit special needs, the children need your support. We welcome donations of any kind, whether they be clot clothes, books, or financial.

ROCKS SUCCESSFUL 2010 Thanks to the hard work of our members and the amazing generosity of all our friends, ROCKS has completed its primary project in 2010. Namely the purchase of a much needed set of the “Jaws of Life” for the Samui Rescue Foundation. Rotary members hope, of course, that the Rescue System will rarely need to be used, but in the event of serious accidents, this equipment will help them access and rescue accident victims from vehicle crashes more speedily than ever before, which means saving lives. Our well supported second-hand sale at the Samui Mala Children's Day in September, the hugely successful Motorbike Raffle which raised around 50,000 Baht, together with profits from the monthly Dinner, all contributed to the final amount of funds raised. In conjunction with Alan Brewis from the Samui Rescue Foundation, who identified and sourced the equipment, and with invaluable help from the Rotary Centre in Bangkok, ROCKS were able to purchase and have the equipment delivered to the Samui base on Koh Samui on December 29th 2010.

Another success in 2010 was the annual sponsored holiday for between thirty and forty children from the HDF Mercy Centre deep in the slums of Klong Toey, Bangkok. The Mercy Centre is an orphanage funded entirely by voluntary donations, housing around 240 children with ages ranging from babies to eighteen years old, also those with learning difficulties. The children who come to Samui are chosen by the Centre as those most deserving a holiday and in December they were hosted at the Imperial Resort & Spa in Chaweng Noi where, by courtesy of G.M. Magne Hansen the children were given complimentary rooms and enjoyed a variety of activities including swimming, singing, dancing, games and even a visit from Santa Claus. The highlight of the day was a concert hosted by the well-known Thai TV children’s presenter Todd (Tongdee) Lavelle who entertained both kids and adults alike.

A

new restaurant has recently opened in the Big Buddha area of Samui called the Dancing Crab. Its location is right on the beachfront overlooking the actual golden Big Buddha. The name itself comes from the small community of little fiddler crabs on the beach just next to the restaurant. They have one large oversized white claw and the local Thai people call them dancing crabs because they consider it similar to the way traditional Thai dancers hold their hands. Depending on who you talk to they are called Bpuu ManoraManora is a variety of Southern Thai Dancing or Bpuu Raam Thai which is generic for all Thai Dancing. This great restaurant is a new venture from Mark Cullmore of the well known BBC CafĂŠ and you will find the food and staff as good as you would have expected at BBC.

The restaurant has a wide variety of seafood available in a fantastic setting and some special Dancing Crab dishes. Only the freshest ingredients are used, so while they want to satisfy all tastes it could be that sometimes a certain variety is not freshly available. Specialties of the restaurant are some of the secret sauces that go so well with the various crab dishes. These sauces are specially prepared for the Dancing Crab restaurant on Samui and cannot be found anywhere else on the island. You will find the location about 100m after the Big Buddha entrance, look out for the Dancing Crab and BBC signs.
