ON PRIORITIES With major infrastructure projects in progress across the island, the current Samui Administration is making serious headway in following through on its promises and plans. Elections are scheduled for later this year, and the Thesabaan says that another 4-year term will allow them to complete the much needed improvements they have started, as well as to implement a number of ground-breaking new ideas and initiatives that will have a profound and lasting impact on the future of Samui.

In the ground
Unfortunately, communicating intentions and publicizing their achievements to the foreign community is not yet one of the local government's strengths. An overview of the current and proposed projects and initiatives reveals a comprehensive and committed approach to developing the island in a sustainable, inclusive way.
Water and drainage management have been a priority for the Samui government over the last 3 years and the lessons learned from periods of flooding mean that in addition to adding effective drainage systems, the authorities are now focusing on the island's natural tributaries, re-directing the underground water flow in areas that were previously blocked in order to alleviate the damage in times of heavy rain. A greater understanding of the causes of flooding has allowed the Thesabaan to adopt strategies that work with, rather than against the island's natural drainage channels.
On the road After considerable research into the best approach to converting the roads from concrete, tarmac is currently being laid in several key areas. What's more, the installation is being carried out using the 8
Around the Lake The recreation facilities, car parking, planted areas, public toilets and refurbishment of public buildings around Chaweng Lake is now almost complete. A stroll through the area already indicates the difference this regenerative work will make as the government plans to make this new community zone a focal point for a range of activities that will help integrate the island's increasingly cosmopolitan population. Once complete, Children's activities will be a major part of a regular event schedule by the lake. In addition, the island's first official tourist information and cultural centre will be opened there, and a regular walking street will feature a floating market specifically designed to promote local products. With a focus on integration, education and traditional island culture, the government says the rejuvenated Chaweng Lake community zone will play an important role in creating a sense of pride and awareness for future generations.
From the land With visitor numbers back on track, Samui's local officials believe now is the time to work on creating more synergy between local island industry and tourism. Surprisingly, although Samui's local
farmers grow large amounts of fresh fruit and other consumables, much of the produce bought by and consumed at the island's hotels is imported to the island. A new initiative has therefore been proposed by the authorities to ensure that hotels and resorts buy some of their fresh produce from local producers. The government is working with farmers to ensure they use organic farming techniques, and will also promote and encourage hotels to use local produce in their kitchens. In the long term, ideas such as tours of local farms can be introduced so that guests can see where the food they enjoy was planted and harvested. Projects and policies such as those highlighted above are a clear sign that the current Samui government is committed to a more intelligent, sustainable and inclusive approach to developing the island's infrastructure and sense of community. As always, they welcome input from island residents. CONDOMINIUMS Vs APARTMENTS K
oh Samui and Koh Phangnan offer a huge choice of tropical residences for would-be buyers: from ocean-side bungalows to hilltop retreats, studio apartments to multi-million dollar luxury villas for the rich and famous, but each property is underpinned with legal structures as varied and diverse as the residences themselves. Over recent years, Koh Samui has seen a rise in the number of apartment and condominium projects offered by developers, many of which are now recently competed or nearing completion. To the end buyer, an apartment unit and a condominium unit may appear to be identical. However, from a legal perspective, there can be significant difference between the respective legal structures, and such differences can have significant consequences to both the would-be buyer and developer.
Condominiums According to Thailand’s Condominium Act BE (2522) (1979) (as amended) foreign investors are permitted to own up to 49% of the private living space of a condominium building with a title akin to “freehold title”. The remaining 51% of the private living space of a condominium building must be owned by Thai individuals or qualifying Thai companies. The take up of condominium units by Thai persons in resort areas such as Koh Samui and Koh Phangan is usually much less than in urban areas such as Bangkok, and consequently, the majority “Thai-owned” units in a condominium project are often leased to foreigners, which is permissible in accordance with the laws of Thailand. The Condominium Act provides a variety of important legal protections to Condominium buyers, which are not available to apartment buyers. The most recent amendment to the Condominium Act in 2008, for example, provides that the sale and purchase agreement in a newly built condominium project must contain standard “benchmark” terms and conditions, and any term contrary to those “benchmark” standards will be legally unenforceable. In addition, the sale and purchase agreement cannot allow for the extension of construction periods beyond one year. Furthermore, developers are now legally bound by representations made in advertising and marketing materials, and are no longer permitted to charge administration fees when a buyer assigns his unit to another party.

Whilst such legal protections provide additional comfort to the Buyer of a condominium unit, such legal protections (and a host of other legal requirements) provide an additional burden to the intended developer of a condominium project, which the prospective developer must consider during the planning stages of a project.
Apartments In accordance with the laws of Thailand, both foreigners and Thais are permitted to acquire a registered 30 year lease over a plot of land or a habitable structure such an apartment unit. In addition to the 30 year registered lease, a lease agreement may provide the lessee with the contractual right to renew the lease for subsequent 30 year terms, provided always that the contractual lease renewals are carefully prepared in accordance with the laws of Thailand. A number of savvy foreign investors choose to employ a so-called “protected leasehold structure”, whereby, in addition to acquiring a registered 30-year lease (with lease renewal options), the buyer is also provided with a share in an offshore company and that offshore company itself owns shares in the limited Thai company which owns the land in question. This “protected leasehold structure” allows the buyer to better safeguard its investments through certain voting rights, and provides the buyer with an element of control of the bespoken lease renewals. Although apartment projects are not governed by the same consumer protection standards contained in the amended Condominium Act, with a little effort, buyers can take steps to protect themselves. For instance, as with the acquisition of any interest in property within Thailand, it is important for the would-be buyer to undertake comprehensive due diligence into both the land and the building structure (investigating the legality of the land title, legal access, zoning restrictions, amongst other matters) before making any significant payments to the seller. Furthermore, the buyer should consider negotiating a purchase or lease agreement containing comprehensive warranties and representations with regards to the legality of title and access, construction completion dates and adherence to plans (in off-plan projects) with the right to withhold progress payments to the developer in the event that the developer is in breach of the Agreement.
A Note on Zoning Land in Koh Samui and Koh Phangan is subject to zoning regulations. Such zoning regulations limit the height and the footprint of structures that may be built on land, require that structures be set-back from water sources, amongst other restrictions. Indeed, condominium projects and apartment projects are prohibited in certain areas of Koh Samui while encouraged in other areas. Therefore developers must take steps to check the zoning rules affecting the land which they propose to develop into a condominium/apartment project. Furthermore, buyers should also check that the zoning rules that apply to the development site in order to ensure that the developer has considered this issue. This article is intended to provide investors with a brief insight into the key legal characteristics of condominiums and apartments in Thailand. As in any jurisdiction, it is important to seek independent legal advice before entering into a legal transaction. Tax Update
What is the “official value” of my property and why does it matter ? Ownership of land, house and/or a condominium unit is legally transferred by a written registration at the relevant authorized Land Office. In general, the current fee and taxes applicable to and payable upon the registration of such change of ownership of an immovable property are the: 1) transfer fee; 2) income tax (payable as withholding tax); and 3) stamp duty or specific business tax/local development tax. The transfer fee and (individual) seller’s income withholding tax which are required to be deducted and paid to the authorities upon transfer are calculated based on the Land Office’s Official Value of the property. The stamp duty or specific business tax/ local development tax which is also required to be deducted and paid to the authorities upon transfer and both are calculated based on the Official Value of the property or the actual transaction value of the property, whichever is higher. Thus, because the Land Office’s appraised value of the property is one of the key elements used for the calculation of the fee and taxes applicable to and payable upon the registration of ownership of immovable property, you might wish to know more about this Official Value. An immovable property’s Official Value is an assessed or appraised value which is generated periodically by the Valuation Committee in accordance with Sections 105 and 105 quinque of the Land Code (1954) (“LC”). However the process to determine the Official Value of the various type of immovable property i.e., e.g. land, non-condominium building and condominium are all different. Since non-Thais may generally only own buildings and condominiums in Thailand, we will have a look at how the Official Value of noncondominium building is determined in this, part 1 of this article and in part of 2 of this article we will see how the Official Value of condominiums are determined. Pursuant to Chapter 2 of the Valuation Committee’s Regulations for Determining the Criteria and Procedures for Valuating Immovable Properties for the Purposes of Levying Fees for the Registration of Rights and Juristic Acts (1992) (and as amended in 1998) issued under the LC, the criteria to be taken into account by the Valuation Committee in determining the Official Value of a non-condominium building are, for example: 1) the price of the construction materials; 2) the wages of the construction workers; 3) the administration costs for the construction in that particular province; and 4) what the is the type or purpose of the building. Each province in Thailand has its own Official Value for buildings that are not condominiums. For example, the following are some of the Official Values for the provinces of Phuket and Suratthani (in which Koh Samui is located) applicable to the transfer of ownership of non-condominiums buildings during the period from 2008 to 2011:

Once the Official Values in any particular province are announced, they are applicable to all such buildings in the province regardless of where the buildings is located in that province, for example, the appraised value per square meter of a one-storey concrete villa in the vibrant heart of Patong will be the same as that in the most un-developed part of Phuket. In general, the appraised value must be re-evaluated every four years and all provinces generally do so concurrently. The current appraised value for each province is applicable from the beginning of 2008 to the end of 2011. The next cycle of appraised values will be applicable from the beginning of 2012 to the end of 2015. Welcome to Feb/March edition on Samui Phangan Real Estate Magazine the island's leading publication for property news, island tips and information. The year has started with a return to form for Koh Samui and Koh Phangan. Many of the islands' hotels were fully booked for the festive season and the main beaches are buzzing with holiday-makers from around the world. Property developers are now pushing forward with new projects as many of the these visitors fall in love with Samui and look for a place in to invest in and return to on a regular basis. Who can blame them? With the Valentines just around the corner what's not to love on islands that boast every possible comfort and convenience but are still surrounded by stunning natural scenery and offer access to some of the most beautiful beaches and views on the planet. Having suffered from terrible floods last year in many parts of the country, the people of Thailand are hoping 2012 will be a more positive year. In the Thai lunar calendar, this year is actually 2555, and in the Thai language, the number five is pronounced, "Ha", which has led many people in the Kingdom to pronounce this a particularly happy year "Ha, Ha, Ha". It is also the Year of the Dragon in the Chinese calendar, a symbol of power, ambition and success. With so much to offer visitors and investors, the islands in the Thai Gulf certainly offer plenty of reasons to be cheerful, as well as all the key ingredients for success.

Koh Samui’s enduring appeal as one of the world’s top holiday destinations has inspired many people to relocate to the island, either choosing to make it their permanent home or spending extended amounts of time living what those in less blessed locations would understandably consider an idyllic lifestyle. Although the island’s tourist and residential worlds often collide, they can also be very distinctive. But in terms of choice, both groups benefit from the island’s incredibly diverse and eclectic offerings, whether in terms of accommodation, retail, dining, entertainment, health or adventure. As a long term resident on Samui, if you stop to consider the sheer extent of comfort and convenience on offer around the island today it’s sometimes difficult to remember that you are living on a small island in the Gulf of Thailand. As soon as you leave the beach you are spoilt for choice - shopping malls such as Tesco Lotus and Big C stock all the daily necessities and more, specialist outlets like Tops Supermarket and Villa in Lamai offer indulgent imported goods, while 7Elevens, Family Mart outlets and local shops make impulse buying a an easy option, even at 4 in the morning. odney Waller is the author of a new book entitled “The Essential Guide to Buying Property in Thailand”, the definitive guide to investing in resort property in the Kingdom. The book is neatly divided into 8 clear steps to success and covers everything from land purchase and building your own property to buying off-plan or completed homes. Specific sections also offer detailed guidance on legal, tax and financial considerations, as well as essential approaches to successfully renting out a property.
to the nature of risk. It was necessary to go to numerous different sources, many of which had different opinions, before it was possible to form an opinion on which informed decisions could be made. So what I have tried to do is bring together all the information a property buyer needs in one place. In short, I have tried to write the book that I would have liked to have had handed to me at the outset – it would have saved an enormous amount of time and effort! In addition, buying property in Thailand is fraught with hazards and many traps await unsuspecting purchasers. Rodney moved to Hong Kong from the UK after completing a Business & Economics degree and post-graduate law degree at one of London’s leading law schools. He has since spent most of his career in Asia and developed a passion for property investment while in Hong Kong at the time of the handover from Britain. How long did it take to write and how did you research?
What inspired you to write the book?
It has taken a year to write. Much of the research is based on information supplied by established professional firms operating in Thailand, together with information from personal sources. The book developed from notes taken in numerous meetings.
When first learning about Thailand’s resort property market, it was hard to find reliable information or advice, bearing in mind that everything was different, from land titles and ownership structures

most important chapters would be “Comparing Properties” and “What to look for when viewing properties”. For those considering the purchase of land, key chapters include “Land title” and “Access”. Chapters considered essential are in fact highlighted in the book. Which of the three main property types would you say is the best investment: Land, off-plan or completed properties and why? It’s impossible to answer such a question. There are so many factors to consider, including market timing and personal circumstances. Each can be successful if approached in the right way. The book does contain relevant chapters on “Investing for capital appreciation” and “Investing for rental income”.
What are the most common surprises investors face due to lack of research? When buying properties within a development, the usual surprises relate to management fees, utility costs or restrictive terms contained in the contracts entered into with developers or management companies. When building your own property, the most common surprises tend to be related to material specifications and late completion penalty clauses. With the purchase of land, surprises might include buying land that has no access or is subject to an ongoing dispute, or buying title to land that is different to the land the buyer has viewed! It should always be born in mind that in Thailand: success is not a given. To do things properly – whether you are buying, building or renting out a property – there is a lot to know and many traps await unsuspecting buyers. To be successful, buyers need to be aware of them and take steps to avoid them beforehand. Being proactive, being prepared and performing thorough due diligence are thus essential elements of a safe investment.

What for you are the most important chapters for investors to read and why?

Real Land Purchase Issues This article aims to provide useful information and advice on what you, the buyer should be aware of when looking at the property market in Thailand.

n Thailand there are several legal issues to understand before purchasing land. Careful consideration of common law is imperative so you do not leave yourself unclear on what, where and how you own and access land you would otherwise consider yours.

In fact, if you have done your homework correctly, the reasons you had for acquiring the land should have improved and in doing so increase your capital gain nonetheless. We have all seen those properties that make no sense, either by way of design, location, use, amenities and or servility. Places that are almost unsellable due to circumstances some of which may have been out of the owner's control but more often than not, mistakes on their part or previous owners before they passed on to the unsuspecting buyer. It is therefore very important “before acquiring any land”, to get the right advice from industry experts with years of experience in Thailand and the industry as a whole. Prevention is better than the cure…. and a lot cheaper too!
Unlike almost all other articles regarding acquiring land in Thailand, this guide will tell you nothing about legal diligence, company structures or ways in which to best acquire a piece of paradise to build your dream home or investment upon. This guide is going to look at the land purchase itself, the very thing that gets overlooked almost every time.
Below are just some of the general things you should consider if looking to acquire land: • Seek advice from a professional builder/developer (one with proof and a track record who can show you tangible properties and developments). • Seek advice from a professional legal advice (ask the simple questions below). • Ask around, i.e. restaurant owners, hotel managers for general opinions and to develop a personal impression of projects, builders/ developers, lawyers and particular areas they would consider to be the best to serve your purposes. Do you need proximity to school’s, transport and or major tourist areas? • Ask local people about the areas your looking at i.e. is the area prone to flooding, anti-social

For this reason it is important that you work within the rules and understand the laws that govern land and property ownership. When looking at land to acquire the location should be paramount. That’s not to say that it should be amazing, but it should be relevant to what you want in the short and medium term, and if possible long 42

• Ask if a deposit for a period of time may be acceptable (Good test of credibility) • Why are they selling? (don’t always believe what they say) • How long have they owned it? • Is this the only land they have or that they are selling and specifically why this land parcel? • Have they sold other land in the area/island? (Go and see/ask that buyer for a reference from those they have sold too.) • What is there opinion on the legalities and fundamentals of land sales? (What’s their knowledge of land sales as this will aid and possibly minimize delays in any potential transaction).
Specific questions you should be asking yourself: • The No1 question that must be answered truthfully, Can you afford it? (Nearly half of all buyers get this wrong) • Look around, is the location improving, not changed or unclear (if unclear, always walk away). • What is it about this land that excites you? (if you're not excited, why would anyone else be? Think with your head not just your heart). • Why is this land better than others and will these facts remain in the future? (i.e. a good view). • Is the land value proportionate to the investment/ building? (i.e. huge house, small land, no view etc.) • Is the access normal? (not everyone can or wants to drive a 4x4 or can even afford one). • Is the land normal? (Yes, sounds a silly question, but it’s surprising what some people will buy, a piece of land you can’t even walk up for example). • What is the real value to you and its affordability? (Not the market value, not the area average and never what it’s selling for, as everybody can name a price, there’s nothing illegal or wrong about that.). • Ask the seller for any photos they have? (To check if the land has changed over time and take your impressions and thoughts with you).
Never do items: • Never pay cash. • Never agree a price on the spot, always walk away and make your offer in righting. • Never ask for a discount/low price on the spot, make your offer and wait. • Without years of experience on the ground, never pick the “reduce to sell” items, in most cases it’s been reduced for a good reason, however there are sometimes genuine reasons for this. • Never purchase the first piece of land you see or the any on the first day. Get a feel for specific areas at various times of the day and night to form a bigger and more accurate impression of the area’s you like, that you can give qualified advantages and disadvantages too.
Specific questions you should be asking a professional: • Where do they live and why? (Test them first) • Do they know of this land/area? (One simple question can save a lot of time wasting). • Do they know the seller? (One simple question can save a lot of heartache if you are potentially dealing with the unscrupulous). • What knowledge do they have of this area? (Again time and effort could be minimized). • For this area, what is a good price in their opinion? (if they are not the seller) • Do they know any other buyers in the area you can talk to about similar land and property?
No matter what the land type, value or location, the short-term value and long-term capital gains will be dramatically impacted should basic checks fail short at the first time of asking. You may have put all your life savings into the property or it may be an asset you need to move quickly due to the economic climate. Whatever your reason, the overall presentation of your property both inside and outside is key to any sale and below are some top tips and ideas to help you increase the chance of a swift sale.
Swimming pool A green swimming pool is never attractive and it will put a buyer off. If the pool isn’t being maintained then what else isn’t being looked after in and around the house? Keep your pool area tidy too. Put out sun loungers and towels, hide the old lilos and rubber rings and make the surroundings look inviting.

“Home is where your heart is” and of course you make your home as you want it. What you like, may not be what the buyer likes, but buyers still want to see a home lived in. If your house is cluttered with personal items, however, that could put the buyer off, as they

If some of your rooms have bold colours or each wall is painted a different colour, paint these rooms white or a neutral too. It really could make all the difference to the sale.
Animals If you have pets and keep them in the house, be wary that a buyer may not want or like pets. Hairs or smells can put buyers off so keep this in mind. Air your house and wipe your furniture down with a lint brush.
Rentals Some properties for sale are also being rented either on a long or short-term basis to generate extra income. Make sure you have a get-out clause in your contract to rent out the property, in case you have a buyer. Also make sure your house is available for viewings during the rental period. These points should be negotiated, with the help of an agent, between the property owner and tenant, before any agreement is made.
Budget

Price The value of your house may or may not be what you are looking for. A property generally sells at its value, not what the owner wants and needs to get. Advertising your property at the wrong price level (i.e. too high) won’t sell. It will just stay on the real estate agents' websites. It doesn’t look good if buyers come back to the island a year later and still see the same properties for sale. Land Title Deeds in Thailand There are two main types of land ownership in Thailand which we should explain
Rights of Possession Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.
Rights of Ownership Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares. Getting started To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section. Shares Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders. Shareholders and Chairperson A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company. However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government.

Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession. Little things that matter A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. VISAS & WORK PERMITS I have recently been asked to clarify the way the Thai system works with visas and work permits if you are opening a company here and would like to have a work permit. Firstly I must point out that each Thai province does follow slightly different guidelines and my information does in no way substitute you actually having a legal consultation with a reputable lawyer’s company if you actually intend to work. There are those that believe the little they would do in reality would make a work permit hardly worth the trouble. This is a big mistake and one that could cost you more problems than you would believe. The Thai Immigration takes cases of foreigners working without a work permit very seriously and the penalties are harsh. If you are here on a tourist visa you cannot in any way participate in a job. So let’s have a look at what’s actually required to apply for a work permit. Firstly you need to have a business class visa which in most cases will have to be applied for at a Thai Consulate outside of Thailand. There have recent changes to the system, whereby smaller Thai embassies such as the one in Penang, Malaysia, have stopped issuing multiple entry visas. Initially there were those who whispered that the only way to arrange these multiple entry visas was for the individual in question to return to their home country and obtain the visa from their local Thai embassy. This however had been proved to be incorrect with the embassy in Kuala Lumpur still issuing multiple entry visas until recently, but currently the situation remains in a state of flux with even legal professionals unsure as to the long term guidelines. We therefore strongly advise obtaining up-to-date legal advice well in advance of pursuing your visa run, to ensure you are fully equipped with the documentation currently required for your business visa. Those working in Samui who earn a salary of 50,000 Baht per month however, shouldn’t have to face these visa run hassles, as they’re entitled to a business visa that only needs to be renewed once per annum at an immigration office. Further details of this scheme can be obtained via a legal professional or at the local immigration office in Na-Thon. Either way, once you have the correct visa, you’ll be able to apply for or renew your current work permit. Once again there are procedures required for this, which your legal professional will prepare for you. This process might seem tedious, but it is nothing unusual, with every country having its own procedures and legal applications. Thailand is no different and don’t be fooled by the laid back and casual attitude of many Thai people on the island, as this is no reflection of the order required in any formal legal requests such as visa or work permit applications. When it comes to legal matters you need to ensure you follow the correct procedure and can produce the appropriate paperwork. All in all, it is easy to see why the services of a professional and thorough legal company are invaluable, saving you much confusion, stress and potentially time and money. 102

Miniature species of pineapple are now available in many nurseries and a red variety is free from spikes. The fruit of these small species is inedible but quirky looking. The traditional Thai garden is typified by the presence of fruit trees. With more emphasis usually placed on practicality than ornamentation, the informal Thai garden is commonly made use of for its edible assets. Although it’s difficult to find very much written on the subject of traditional Thai garden style, historical art often depicts the use of fruit trees, especially mango in domestic settings, suggesting that this has long been the case.
Star fruit With several varieties, star fruit flavour ranges from acidic to sweet. Trees grown for commercial and landscape usage in Thailand are often of the sweet variety and there are several differing types. It’s possible to obtain these trees at a very mature size as they develop very well with their roots balled. Self-sacrifice is not uncommon in highly social animals, such as termites and honeybees that will fight to the death to protect the queen. Similarly, soldiers from one termite species will emit a glue-like material to trap anything attacking its colony, sometimes dying from the stress of the excretion. But Asia’s exploding ants will even self-detonate far from their colony, or when lightly touched with forceps in the lab. Some studies have shown that the ants will leave certain smaller-bodied “enemies” alone, saving their suicidal spurts of putridity for larger ants. The strategy trading a life for a life seems designed to win a war of attrition against larger-bodied ants that may have lower populations.
When it comes to “yellow goo”—the researcher’s actual technical term for the post-squish spritz—these ants are literally full of it. The reservoirs that house the liquid make up as much as half the volume of the ant’s body and stretch from the base of the head to the tip of the insect’s abdomen. The goo is made up of various irritating chemicals and strong adhesives that permanently bind the body of the dead Camponotus to the attacker. This enemy ant becomes subdued by the noxious chemicals, as well as the fact that it’s, well, forever glued to a corpse. After locking an enemy in a death grip, these ants bend and compress their abdomens so forcefully that the liquid violently ruptures out of several points on their rear-end. They aim for enemy’s faces,

Stunning beaches, an affordable lifestyle and an appealing island environment have drawn a growing number of visitors and residents to Koh Phangan’s tropical shores. Many of the island’s visitors choose to stay longer than they originally planned and this has led to the establishment of a sizeable foreign community of long stay tourists, working residents, business owners and retirees. The number of foreign investors choosing Koh Phangan as their second home is increasing every year, with easy transport access, a fast developing infrastructure and a range of lifestyle and hospitality services all adding to the island’s growing appeal. Koh Phangan is a rare island escape just a short boat ride from Koh Samui’s more developed and commercial environment. This means residents and visitors can enjoy the unspoiled beauty of some of Thailand’s finest beaches while still having access to the comforts and benefits of a modern lifestyle. The recent growth in the number of luxury hotels and private villas on the island has prompted the emergence of more upmarket retail, dining and entertainment choices, with cool nightspots and restaurants opening in the more popular beaches like Haad Rin and Thong Nai Pan. Designer boutiques, international cuisine, real estate agents and developers are all gradually changing the island landscape, yet the laid back lifestyle has thus far survived and the local people are known for their commitment to 127
preserving their traditional culture. Whether selling the daily catch from their boats, chatting with friends in the shade of the village ‘sala’ or celebrating weddings with dances and local music, local people remain distinctively Thai in many ways. As for the foreign residents, the ease of life, natural beauty and diversity of lifestyle choices make Koh Phangan a unique destination as either a permanent or second home. Koh Phangan real estate Koh Phangan’s real estate sector has grown as the island has developed and become more popular with visitors from around the world. Investment opportunities abound, whether it is raw beach and mountain land, off plan residential purchases or completed luxury villas for sale. Restrictive ownership laws in Thailand, however, mean buyers are advised to go through reputable law firms when considering any purchases on Koh Phangan. As is the case on Koh Samui or Phuket, it is important for anyone considering an investment to thoroughly research the laws and regulations, as well as to ensure that any land titles are thoroughly checked and that the most secure method of purchase is found to guarantee a trouble free, long-term investment. Investors should also look into the track record of any construction firms they employ to guarantee that their reputation is solid and that any previous projects have been successfully completed. Island development Recent road improvements have made Koh Phangan significantly more accessible to visitors and potential residents. Work is ongoing in several areas, particularly on the road that links Ban Tai with Thong Nai Pan, as well as the mountain pass that connects the west and east coast beaches. means construction of an airport would be expensive and complex and may even involve land reclamation or the creation of a floating runway. Phangan Hot Spots Haad Rin was made famous by the monthly Full Moon Party and consists of two sweeping beaches known as sunrise and sunset and connected by a small but thriving tourist town on the east tip of the island. Haad Rin has become a bustling centre for shopping, with a large selection of retail outlets offering beach wear, jewellery, crafts and souvenirs. Haad Rin also boasts a handful of modest medical centres, but for serious conditions patients are transported to the larger and better equipped hospitals on Koh Samui. Baan Tai beach is a small oceanside community situated around half way between Haad Rin and the port of Thongsala. Most of the beach resorts in the area have their own Thai and western restaurant, and the village that lines the road has developed into something of a modern hippy enclave, with a bakery and a handful of international cafes. Haad Yao has long been a popular holiday location and is easily reached by road from Thongsala. The beach is known for its fabulous sunsets and the laid back feeling that Koh Phangan is well know for. A good selection of beach and village restaurants serve both tourists and long stay residents, with tasty Thai food and western favourites all available. There’s also a good bakery serving fresh bread. Chaloklum is one of the island’s largest fishing villages and still offers fishing boats a safe harbour during the storm season. The long, secluded beach is a picturesque idyll and the village that has grown along the coast now boasts a diverse bar and restaurant scene, known to many residents and regular visitors for its fine seafood restaurants and water sports centres. Haad Salad is on Koh Phangan’s west coast is known as a quite, family oriented beach, lined with resorts but with some new residential offerings in the surrounding hills. Located down a steep hill from a hillside road, the beach has retained a remote feel but still offers plenty of good food and recreation choices. Thong Nai Pan on the North East coast of Koh Phangan is home to what many people feel are two of the best beaches in Thailand. Tong Nai Pan Noi (small) is the location for some of the island’s most luxurious accommodation, while Thong Nai Pan Yai (big) features a range of mid-range resorts-restaurants and a luxury private development at Thong Nai Pan Estate. Both beaches are also the chosen location for new residential projects in the nearby hills. Other popular beach areas on Koh Phangan include Bottle Beach, a peaceful desert island destination, Sadet beach, home to Koh Phangan’s most famous national park, as well as Had Thien and Had Yuan beaches, only accessible by boat and famous for their wellness centres and peaceful tropical surroundings. 129
