Phoenix from the Ashes When volcanic activity in Europe threw a spanner in Koh Samui's economic works last month it should have been a wake up call for everyone interested in the island's future as a both tourism and residential destination. Samui's resilience and enduring appeal may keep a steady flow of people coming to the island, but in order to guarantee the kind of popularity that's been built up over the last few years, business and community minded citizens need to take a long hard look at what practical measures can be applied to ensure long term recovery. Creative Promotion

has proved popular with local people and visitors. These events offer the chance for special concerts or food promotions to be arranged, which will attract more business to the areas involved. Other special events include the Samui Film Festival in August, a two day showcase of international films based on the theme "Nature and Spirit" to be shown on an open-air projector at Tamarind Springs Forest spa. Then there's the Samui Marathon, which attracted a good number of competitors and spectators in February and is set to become a regular island event. This year's Samui Regatta once again drew visitors from all over the region and also combined competitive sailing with other activities and attractions such as golf, jazz music and a fitness camp.

Often it's useful to consider approaches beyond the island's shores and see what others are doing to make a positive contribution to future growth. In Thailand as a whole, the Tourism and Sports Ministry recently earmarked 1.6 billion Baht to be spent in restoring tourism in various locations around the country. In specific Thai destinations, targeted campaigns are already being launched to encourage more domestic tourists, as well as to reclaim visitors from key markets such as China, Australia and Japan. The Chiang Mai chapter of the Thai hotels Association, for example, will run a campaign entitled 'Amazing one price in Chiang Mai', with more than 50 hotels and resorts participating to attract more domestic and international guests. The city is also working to create more events such as food festivals, sports tournaments, spa visits, and international conferences and workshops. On Samui itself, the recent introduction of regular 'Walking Street' festivals in both Nathon and Bophut

than 50 global brands and 20,000 active consumers, recently revealed that 48% of consumers are willing to pay a 10% premium for green products and services. However, it also said that 64% regard green labels as ‘marketing tools’ rather than authentic expressions of environmental and social responsibility. A surprising 80% of consumers said they respected ‘responsible’ companies, which means false claims to green business could now actually damage a company, or even an island's reputation.

Such creative approaches are crucial as Samui works to maintain and build on its success and reputation. Green Marketing Another important element is the environment. Global warming, climate change, carbon credits and a whole host of other ‘green’ phrases are often heard in today’s world. It's now therefore important for businesses to look at things from an environmental point of view. Not being green is actually becoming bad for business because consumers are increasingly turning to organic, non-toxic and eco-friendly goods and services. The ‘Sustainable Futures 09’ report, which covers more

He is now suggesting to the TAT that a project be launched called '50 great green escapes'. This would involve forming an advisory body on sustainable tourism made up of academics, environmental activists, NGO delegates, and business operators. Koh Samui is ahead of the game in this respect. The island's hotels already apply a number of environmentally friendly techniques and The Samui Green Island Foundation oversees several green projects and initiatives, including the annual Samui Mala Festival, which is once again scheduled as a week of activities for the health of the island in September. By promoting these elements and actively building on the reputation and appeal that Samui has already, the island's businesses and organisations can ensure that we emerge from the ashes brighter than ever and develop in way that survives whatever natural, political and economic troubles are thrown at us.

HOW LONG DOES IT TAKE?

the appointment of the arbitrator. This is a lengthy procedure which can take up to 90 days.

W

hen a party commences arbitration proceedings it normally wants to know when the arbitration will be completed. It is difficult to accurately assess how long it would take to conclude an arbitration, however assuming there are only two parties in the arbitration and the arbitration is conducted under the Arbitration Rules of the Thai Arbitration Institute (“The Rules”) the following matters should be taken into consideration: Claimant’s Statement of Claim The Arbitration is commenced when the Claimant submits its statement of claim (“SOC”) to the Director of the Thai Arbitration Institute (“TAI”). If the Director is satisfied the SOC is in accordance with The Rules he will deliver a copy of the SOC to the other party. Respondent’s Defence/Counterclaim Rule 8 of The Rules requires the Respondent to submit its statement of defence/counterclaim (“SDC”) within 15 days from the date the SOC is served on it. It is common for the Respondent to request an extension of time to submit its SDC and the TAI would normally grant a 30 days extension of time for this. Claimant’s Reply to the Respondent’s Counterclaims Assuming the Respondent does make a counterclaim the Claimant should be entitled to reply to this; The Rules do not specify any time period for this but it is suggested a minimum period of 30 days be allowed for this from the date the SDC is served on the Claimant. Appointment of the Tribunal After all the submissions have been made the Tribunal is to be appointed. Assuming only one arbitrator is to be appointed the parties are normally allowed 30 days to agree the arbitrator who will then have to confirm his availability and willingness to act as the arbitrator and that he has no conflict of interest. The problem arises when the parties cannot agree on the arbitrator; if this is the case the procedures under Rule 11 of The Rules will be implemented for 15

The Award Under Rule 27 of The Rules the award is to be made within 180 days from the date the arbitrator is appointed. Within this period further submissions may be made, witness statements are to be submitted, the hearing and transcription of the hearing are to be completed and the arbitrator is to write his award; it is common for the 180 days period to be extended. Summary Assuming there is a counterclaim, the parties cannot agree on the arbitrator and the award is not published within 180 days it is estimated the minimum period to conclude the arbitration would be 465 days (15.5 months). The above time period assumes the case is relatively straightforward, the TAI effectively administers the case, the arbitrator effectively manages the case and the parties cooperate to ensure the arbitration proceeds in a timely manner. This is not always the case and it is suggested that in practice a minimum period of 18 months be allowed to conclude an arbitration which is relatively straightforward and is conducted by a sole arbitrator under the TAI Arbitration Rules. Enhancing Investors' Protection through the Effective Negotiation of Construction Contracts confidence at the construction stage of real estate development.

All investors who build their own villas, apartments or even hotels and resorts on Koh Samui or Koh Phangan must, at some point, enter into a construction contract with a Developer/Builder in order to procure the construction of the building. This is a pivotal stage in the development process and can be critical to the future success of a project. There is often considerable scope for an investor to negotiate the terms of the construction contract as the developer/builder will often be keen to “win” the work from the investor. A carefully negotiated construction contract can mitigate the risks of things going wrong and provide the investor with considerable re-assurance and

In order to provide a level of contractual certainty to the investor, the construction contract should contain a clear and unambiguous completion date upon which all construction works contemplated under the construction contract shall be completed. The investor should be entitled to a “late completion penalty” in the event that the developer/builder fails to complete construction of the property on or before the contractual completion date which should be deductible from the final payment to the developer/builder. The construction contract should allow the developer/builder to postpone the construction completion date upon the service of advanced written notice to the investor, in the event that a delay is caused by events beyond the developer/ builder’s control, such as adverse weather conditions for an extended period of time or the unavailability of essential building materials. The agreed contract price should be clearly set out in the construction agreement and should be payable on construction milestones rather than on 16


fixed dates so that payments are made as construction advances. If the construction stage which triggers the payment installment has not been reached, the Investor should be permitted to retain the payment installment until such time as the relevant construction stage has been reached. The Investor should be entitled to retain the final payment installment until all snagging defects have been remedied to the satisfaction of the developer /builder. The construction contract should allow the investor to appoint a qualified surveyor who should be permitted to inspect the progress of construction at each construction stage to verify that the relevant construction stage which triggers a payment installment has been reached and to confirm that all construction works have been undertaken correctly and in accordance with good working practices. The developer/builder may agree to provide contractual guarantee against structural defects emerging within a defined period of time after construction of the property has been completed. The developer/builder will not usually agree to guarantee the works of sub-contractors or to repair damage caused by hostile weather conditions or general wear and tear. The construction permit, together with all architectural plans, drawings and specifications, floor plans, unit plans, elevation plans, master plans and plans of the common property and landscaped areas (as applicable) should be attached to and form an integral part of the construction contract. The developer/builder should provide a warranty that all construction works shall be completed in accordance with internationally recognised building standards, techniques and methods. A detailed specification of the materials used in the construction and finishing of the property should also be attached to and form an integral part of the construction contract. The specifications should include the size, type, kind, style, model, brand and 17

colour of all materials and specifications to be used in the construction and fit out of the property. For example, if the developer/builder promised “teak” doors then this should be clearly stipulated in the specifications. If the specifications stipulate wooden “doors” the developer/builder may not be in breach of the construction agreement in failing to provide ‘teak doors’. The comprehensive terms and requirements of a fair and balanced construction contract are detailed and beyond the scope of this article and are often contingent upon the type of construction. As a basic guide, all construction contracts should be vetted before any payment instalments are released to the developer/builder. Investors should be aware that there is often considerable scope to negotiate the terms of a construction agreement and enhance the contractual legal protections on the part of the Investor. Living on Samui There is a fast growing expatriate community on Koh Samui, with people moving from Europe and beyond to escape the stresses of western life. Thailand is known as one of the most welcoming countries in the world and as Koh Samui has developed over the years it has gradually begun to offer all the comforts of home, but in a tropical island location. Living on Samui is easy; the island now offers a range of excellent locations for shopping, including two large, well stocked supermarkets: Tesco Lotus, Big C and Tops. In fact, with all the modern conveniences now available it's sometimes easy to forget you are in Thailand at all. New shopping malls and entertainment centres are on the way, and Western treats like good wine and imported food that foreign residents may have once missed, are now readily available. People who live on Samui enjoy a vast choice for wining, dining and entertainment. Thai food of course abounds, and is both tasty and extremely good value. There is also a huge choice of international cuisine with everything from fine French cuisine to fast food chains. For those who like drinking and socializing, many Western style pubs and clubs not only serve local alcoholic drinks but also offer many favourite international brands. A number of bars also show live international sporting events, so it's possible to enjoy a cold beer in the sun whilst watching your favourite football team play in the cold wind and rain back home. Of course Thailand wouldn't be the same without its people. It is mainly because of their friendly nature that foreign visitors keep coming back and end up living on Samui. Most local people speak a certain amount of English, which means that speaking Thai is not necessary, although life becomes much easier if you do make the effort. Samui is fast becoming a comfortable, sophisticated haven in the sun, but it is also important to remember that there are significant cultural differences that may cause frustration. Koh Samui's development as a multidimensional holiday, business and residential destination has always been driven by tourism. Although recent political issues troubled the island's hotels and related hospitality services, tourism trends and figures inspire confidence that Samui will soon be back on track. Although it may not be the case for Thailand as a whole, on Koh Samui all things lead back to the tourist. Whether you're a hotel relying on regular bookings, a property developer hoping to sell newly built houses or a taxi driver looking for fares to and from Chaweng, the essential ingredient for success is a continuous flow of visitors to the island. During Samui's meteoric rise to fame as an international destination, the obstacles facing the tourism industry have not always been minor ones. 9/11 saw the beginning of strict anti-terrorist regulations in airports and on planes, which put plenty of people off flying, the Tsunami rocked Thailand's image as a safe place to holiday, SARS and Bird Flu introduced new health worries, then the world economic slowdown and consequent exchange rate fluctuations made Samui less affordable that it had once been. Yet through all these trials and tribulations the island has continued to develop and grow, enticing an ever more diverse range of visitors from a multitude of countries around the world. Whatever it is that makes Samui special seems to help the island ease its way gently along the path to greater success. Peaking and troughing perhaps, but always heading in the right direction. The current political situation did nothing to deter the annual Easter and Songkran boom, particularly at the luxury end of the market, and although bookings are down for the coming high season, last minute enquiries now constitute a major part of the island's

"Before the demonstrations in Bangkok Samui was having a very good year," explained Alex Andries GM at Zazen Boutique Resort in Bophut, which is about to launch a unique high-end restaurant and Tea Bar concept. "Despite the economic slowdown, the agents were still seeing strong demand for rooms on Samui and even the larger hotels were receiving plenty of bookings. Of course, everyone has lost out, but last minute enquiries will definitely go a long way to making up the shortfall and with the political crisis behind us we should recover quite quickly. " The factors that maintain Samui's popularity as a holiday destination are not only well established, but also growing all the time. Beachside accommodation is now more comfortable and sophisticated than ever, the choice of quality dining options has increased significantly in the last two years and the range of activities, sport and recreation available to visitors is vast and constantly expanding. On top of this, the island's diversity has created distinctive differentiators that allow Samui to draw a range of different tourists in search of different experiences.The development of a thriving health and spa sector has definitely had an impact on both the type and number of visitors drawn to the island. Health retreats like Kamalaya, on the island's south coast, along with reputable spas like Tamarind Springs are helping build the island's worldwide reputation as a wellness destination. Meanwhile, regattas, golf tournaments, marathons and adventure races have given Samui a certain level of sporting kudos. Despite what seems very positive growth in terms of hotel stock, the shift to regional source markets has undoubtedly created less predictable dynamics on Samui. A lack of international passenger arrivals is certainly restricting crossover into the broader hospitality markets, even though the island's airline has made significant moves to introduce code share agreements that consolidate Samui's position as a direct flight destination from Europe. Fortunately, tour operators often sign long term agreements with airlines that guarantee flight prices remain stable, so even in uncertain economic times, air fair fluctuations will not necessarily affect passenger numbers significantly. In the greater scheme of things, Thailand's resort markets continue to outperform other regional destinations like Cambodia, Vietnam and even Bali. But these are all upcoming destinations that currently offer tourists lower risk choices, which means creative solutions will have to applied that draw on Thailand's long standing reputation as one of the world's top locations and maintain the country's appeal in the face of political crisis. Repeat visitors make up a significant percentage of Samui's market and as has been proved in the past, their loyalty and resilience to obstacles brings them back to the island time and time again.

There are now so many different agents on the island, it is difficult to choose between them. Ideally though, your agent should be able to demonstrate a solid background in the industry and offer examples of successful deals they have handled that are similar to your own plans. It is also vital that your agent has good local connections with Thai partners and the authorities. Paperwork and local procedures can sometimes be daunting, but if you have the services of a quality agent with good local knowledge, almost all of the potential stumbling blocks can be swiftly traversed with little or no headaches for you, the buyer. It is vital, for example that you know you are buying or leasing the right type of land. There are various different land titles, the most sought after is the 'Chanote' title. This indicates that the land has been officially surveyed with the use of GPS and its boundaries are now fixed. Be warned that buying land without professional help could mean purchasing what looks like a bargain piece of land that may turn out to be unusable due to the land title. Once the land is purchased and ready for development, thoughts can turn to the design of your house. Of course, you can be as involved in the design process as much as you wish, from merely requesting certain facilities or features all the way to designing the floor plan in its entirety. Several contracting companies are foreign run or employ foreign representatives, which can save time and confusion due to communication problems. It is always good to try and strike up a rapport with the Thai partners and staff too though, as their local knowledge will often prove invaluable. Once you have chosen your contractor, as always make sure your investment is protected by the correct documentation. It would be advisable to have an independent law firm check any paperwork for potential grey areas. If you have ever had a home built in the West, you would have received certain assurances from the building company, including an agreed schedule for completion, a performance bond and a warranty on the finished product. Providing such guaraantees is not always common practice in Koh Samui so the kind of guarantees you are offered should have a significant bearing in your initial choice of construction company. A performance bond is a guarantee issued by the contractor's bank to secure any advance payments you have made. When building on Koh Samui, you will likely need to pay an initial deposit in order for the builder to obtain materials and retain a workforce. Thereafter, you will pay an agreed amount of instalments, which will likely be tied in with certain pre-agreed stages in your home's route to completion. The initial deposit, which could be around a quarter to a third of the total amount, will remain unsecured if no performance bond is issued. In terms of warranty, you should insist on at least twelve months coverage from the completion date. This should be plenty of time for any major building defects to become apparent and resolved at the cost of the building company. With the plans cleared, the paperwork checked and your deposit paid, building can commence. If possible, it is a good idea to make regular visits to your property during the construction phase. This is perhaps the best way to avoid problems or a misinterpretation of your wishes and also means building good relations with the workforce. Land Title Deeds in Thailand There are two main types of land ownership in Thailand which we should explain

Rights of Possession Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

Rights of Ownership Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

Tips for starting a new business Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

Getting started To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder's meeting to reach an agreement on the purpose of your business and set up the company's operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code's partnership and companies section.

Shares Besides the issues of business registration, you must also make sure that your company's shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company's shareholders. The book is evidence that will identify the company's shareholders.

Shareholders and Chairperson A Limited Company's shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company's rights, such as landownership. If less than 49% of your company's shares are held by foreigners, your company is considered a Thai company. However, if foreign nationals hold more than 49% of the shares, your company is a foreign company.

The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department's staff are now required to thoroughly investigate your Thai shareholders' sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

Little things that matter A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company's financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company's board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company's business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. Visas and Work Permits I have recently been asked to clarify the way the Thai system works with visas and work permits if you are opening a company here and would like to have a work permit. Firstly I must point out that each Thai province does follow slightly different guidelines and my information does in no way substitute you actually having a legal consultation with a reputable lawyer's company if you actually intend to work. There are those that believe the little they would do in reality would make a work permit hardly worth the trouble. This is a big mistake and one that could cost you more problems than you would believe. The Thai Immigration takes cases of foreigners working without a work permit very seriously and the penalties are harsh. If you are here on a tourist visa you cannot in any way participate in a job. So let's have a look at what's actually required to apply for a work permit. Firstly you need to have a business class visa which in most cases will have to be applied for at a Thai Consulate outside of Thailand. There have recent changes to the system, whereby smaller Thai embassies such as the one in Penang, Malaysia, have stopped issuing multiple entry visas. Initially there were those who whispered that the only way to arrange these multiple entry visas was for the individual in question to return to their home country and obtain the visa from their local Thai embassy. This however had been proved to be incorrect with the embassy in Kuala Lumpur still issuing multiple entry visas until recently, but currently the situation remains in a state of flux with even legal profession als unsure as to the long term guidelines. We therefore strongly advise obtaining up-to-date legal advice well in advance of pursuing your visa run, to ensure you are fully equipped with the documentation currently required for your business visa. Those working in Samui who earn a salary of 50000 Baht per month however, shouldn't have to face these visa run hassles, as they're entitled to a business visa that only needs to be renewed once per annum at an immigration office. Further details of this scheme can be obtained via a legal professional or at the local immigration office in Na-Thon. Either way, once you have the correct visa, you'll be able to apply for or renew your current work permit. Once again there are procedures required for this, which your legal professional will prepare for you. This process might seem tedious, but it is nothing unusual, with every country having its own procedures and legal applications. Thailand is no different and don't be fooled by the laid back and casual attitude of many Thai people on the island, as this is no reflection of the order required in any formal legal requests such as visa or work permit applications. When it comes to legal matters you need to ensure you follow the correct procedure and can produce the appropriate paperwork. All in all, it is easy to see why the services of a professional and thorough legal company are invaluable, saving you much confusion, stress and potentially time and money.

Keeping the design Functional Welcome back. With this issue I want you to understand the basic theory behind what makes an interior space functional. minutes of the day and how that has affected the way you feel. The bathroom, kitchen, dining room, outside to the garden, maybe to nearly every room in the house. With good design you can help to make the transition between, and function of, the rooms youy live in, comfortably in tune with our bodies.

If we look at the way we live for a moment, we begin to understand how we interact with our surroundings. Most of the time we don’t even think about how we go about our common, every day activities, because we conduct them out of habit. For instance, when we get up in the morning what is the first thing you do? Ok maybe I don’t want to know that… but after breakfast lets take a look at where you have traveled about in the house in these first few

If you are making drastic changes to the layout of your home, consider ‘grouping’ different rooms to help with the overall function. Kitchen, living room and entrance together and bedrooms with a bathroom adjacent, are some of the most commonly used groupings. There are also a series of measurements that have been calculated to facilitate the average human body in a given space. Bed heights, table and chair heights, bench heights, door heights etc are all readily available and must be considered when designing, even door and corridor widths and ceiling heights will have an impact on how we feel about a space. In addition we need to avoid obstacles in our paths, changes in floor heights, awkward positioning of things or large distances from rooms or items in them we use readily. You will need to screen off

when passing through a door or opening so you are more likely to notice a step there. The other golden rules for steps are that they must be the same height if there is more than one. When you climb a flight of stairs, after the first step, your mind has automatically calculated how high it is and sends a message to your legs and feet to tell them how high to step for the next one. If the steps are out of balance you can almost guarantee you will trip on them. In addition the rise of the step should be only two thirds of the length of the tread where you step and the tread needs to be long enough for the whole foot to rest on, minimum. If there is only one step, try to make a change in the colour of the floor at the same place. This will help you and especially your guests, to notice the change in height here also. Another important aspect of your rooms function is the safety of your interior space, especially when it comes to children. Again there are a series of measurements available for hand rail heights, gaps between railings, the type of glass we use in our doors and windows depending on height from the floor etc. If you can’t find this information in books or on the internet, an interior design expert will

We’re all familiar with the much maligned ‘weed’, or at least the notion of what one is. Weeds are not of any particular species. They merely share the common quality of being particularly adept at surviving attempted annihilation. The fact remains that the weed is defined by its location. It just happens to be in the wrong place at the wrong time.

These plants are usually the indigenous species of the area, which we’ve decided to cultivate. They are, by their very presence, the most suitable, naturally occurring plants of that locale.

Hand weeding is, for those with strong backs, the best way to remove weeds from the lawn. Be sure to wear tough gloves for this as some local weeds have sharp thorns.

The secret of their survival often lies below the soils surface where frequently produced seeds can rest dormant for years before germinating. Some weeds also disperse huge amounts of seeds when disturbed. Many perennial Thai weeds reappear from fleshy root networks left behind after hand weeding.

One of these is a type of Mimosa, prevalent in the region, which often appears in lawns, clinging low to the ground and particularly unpleasant when discovered with bare feet. This weed can be identified by its ‘seismonastic’ movements, an ability to open and close it’s leaves in response to being touched as well as other stimulus.

Borders When removing weeds form borders and lawns, it is important to uproot the whole plant. This is not always an easy task due to the slender stems of the freshly spotted invaders.

Taking hold of the base of its woody stem and gently pulling removes the plant with its roots in most cases. It may help to soak the ground should the roots resist. Herbicides

Hand forks or grubbers (3 or 4 pronged claws) are best used for borders where loosening the soil around the roots of the weed makes removal with a pull at the base of the plant pretty easy in most cases.

These chemicals should be avoided if possible and viewed as a last resort. Post emergence herbicides kill weeds, either by contact, or by being absorbed by the plant and destroying it systemically.

Regular hoeing of the soil is another method of destroying weeds in regularly cultivated areas. The Dutch hoe, which many Europeans are familiar with, is not generally available in Thailand but the local tool of choice; the ‘chob’ is most effective and available in a few different sizes. The principal is to chop apart the weeds with a horizontal slicing motion. This will need to be a regular activity, as dormant seeds below the surface will continue to germinate. The ardent gardener will, however, find less weeds appearing over time, as the stockpile of seeds is gradually exhausted.

They are also classified as being either selective or non-selective. The most commonly available herbicide is Glyphosate familiar to many Westerners by the trade name ‘Roundup’. This is a non-selective herbicide and will systemically destroy any leafy plant. Henceforth, great care should be taken in identifying the chemicals you may purchase and appropriate research of their classification and recommended usage must be undertaken.

Lawns

For small areas, weeds may be attacked with boiling water, although one dousing may not be sufficient.

To avoid lawns becoming overrun with weeds, promoting dense growth of the lawn itself is one way to ‘crowd out’ the unwanted plants. Not that this is so easily achieved since producing lush, verdant lawns is a full time occupation in this part of the world. Nevertheless, without going in to too much detail, timely fertilizing with a good high nitrogen, time release fertilizer is a good start, as is watering at the best part of the day to promote maximum absorption (about an hour before sunrise).

Alternatives

A thick layer of mulch or clippings on weedy patches can also be effective in starving weeds of light and moisture. The determined and regular gardener, with some effort, can stand back at the end of a hard days work and enjoy a garden free from weeds. Unfortunately, however, no matter how persistent we are, the weeds, by their nature are here for the long haul.

Mozzie Mania When you're out in your garden enjoying the sun and sparking up the barbecue, the moment can be ruined when you look down at your arm and see a painful, swelling mosquito bite. What is it with these pesky insects? Why do they have to bite me? Do they carry diseases? What can I do to protect myself? Here are some insights and a few ideas to reduce the irritation. Mosquitoes have been around for more than 30 million years. During that time have been honing their skills so that they are now experts at finding people to bite. Mosquitoes have a battery of sensors designed to track their prey, including: Chemical sensors - mosquitoes can sense carbon dioxide and lactic acid up to 100 feet (36 meters) away. Mammals and birds gives off these gases as part of their normal breathing. Certain chemicals in sweat also seem to attract mosquitoes (people who don't sweat much don't get nearly as many mosquito bites). Visual sensors - if you are wearing clothing that contrasts with the background, and especially if you move while wearing that clothing, mosquitoes can see you and zero-in on you. It's a good bet that anything moving is "alive", and therefore full of blood, so this is a good strategy. Heat sensors - Mosquitoes can detect heat, so they can find warm-blooded mammals and birds very easily once they get close enough. Something with this many sensors sounds more like a military aircraft than an insect. That's why mosquitoes are so good at finding and biting you. There are about 2,700 species of mosquito and they can fly about 1 to 1.5 miles per hour. The females drink blood and the nectar of plants, but the males only sip plant nectar. When a female bites, she also injects an anticoagulant (anti-clotting chemical) into her prey to keep the victim's blood flowing. Unfortunately mosquitos often carry diseases such as malaria, encephalitis, yellow fever, dengue fever, dog

heart worm, West Nile virus, and many others. The females can pass these diseases from one person /animal to another as they feed. Fortunately, it's relatively easy to make your own natural, effective mosquito repellent. Just mix some of the oils listed below with a carrier oil such as sesame, sunflower or almond oil to make your own repellent. When using these oils, however, you should be aware that some factors lower repellent effectiveness such as sunscreens, water on the skin, perspiration, absorption into the skin and evaporation in wind or high temperatures. So you should re-apply repellants regularly, especially during the evening when mosquitos are at their most prolific. Another strategy is to eat more garlic, you will sweat this out through your skin and it repels mosquitos. Around the house, mosquito coils deter mosquitos and it's also important that you make sure there is no standing water around in the kitchen, bathroom or garden for them to breed in. Small fish can be placed in vases, urns or ponds and will eat mosquito larvae. You can also research organic pesticides and order them online. Basic precaution can reduce the likelihood of disease and also remove that irritating fear of another itchy bite. Making a Case for a

Samui Public Park Many people believe that Samui needs a ‘life-saving’ park. This may sound strange on an island known for its natural beauty, but in many places around the world, green lungs are islands of peace, regenerating the atmosphere and the spirit of the people. In ten years, in twenty, where will our children play? Will they be able to see native species of trees, fruits, herbs, vegetables growing? Will they be eating imported snacks from other regions or fresh nourishing locally grown foods? A park can be a place for play, for education, for preserving species, for celebrating community events. It can even be a tourist attraction. It can certainly promote the positive image of Samui as a community of people who love and care about their natural environment. There are many uses for a park on Samui: Educational - for both children and adults Life-saving – to grow and sell food and nurturing plants for the island Community oriented - with spaces and gathering areas for public pleasure Attractive - as a clean, beautiful but functional place, aesthetically pleasing but progressive enough to attract tourists - that it has 'wow factor' so that people will make it a point to visit. A park can also be a knowledge bank. A resource for DNA and information where we can share plants and methods of cultivation. A way to demonstrate self reliance, sustainability and regeneration of resources. The systems are not buried and "behind the scenes", but out in front so people can learn how they work. Things like water collection by harvesting water and storing in tanks for drinking and washing, in ponds and klongs for watering and in the living green biomass which will hold the majority of rainfall. 153

Ecological Considerations A park could showcase proper waste management systems with grey water flow forms and black water treatment. It could self generate energy production through solar, wind, hydrogen cell and biomass production. Above all, it could be a place to develop and maintain biodiversity of plant life. Features of a Samui Park Ideally, a Samui Park would be regenerative and therefore located on degraded, spoilt ground that can be re-generated by the project. I would start small and grow ‘organically’, based on community involvement, feedback and demand. A Park Centre could be built from natural, low-cost materials and used as a demonstration building with a "Sun kitchen" with solar oven, solar hotplate, grill and hot water making food using sunlight. There could also be a library, community space, coffee shop, shop, seed saving area and information centre. Outside the main public areas, there should be every plant type available. Thousands of species, including food forest and a 'wild' or unattended area in its natural regeneration cycle for education and observation of nature. Exotic plants, tropical spices and herbs, exotic trees, food trees, traditional Thai and other medicinal plants could be signed along walking paths, with a nursery full of a rich diversity of plants and trees also available for sale to the public. With an appropriate location and staffing by the community, a Samui Park could become a shared asset that not only generates interest and income for the island, but also saves its essence for future generations to use and enjoy.
