Slate roofing Slate roofing tile has a long and interesting history and is generally known as one of the highest quality, longest lasting roofing materials on the market. Studies have shown slate roofing can easily outlast a century. That’s quite a difference between the 20 to 30 years life a normal tiled roof is based on. But they are much more expensive, installation requires a slate professional, and the relative fragility of slate roofing tile means it’s not the perfect choice for everybody. Let’s have a look at the advantages and disadvantages of slate roofing. The Pros Slate roofing has many benefits, mostly due to the fact that it’s a natural stone product, giving it a unique, beautiful appearance, and the longevity that slate is famous for. Here’s a list of the most popular reasons homeowners choose to install slate roofing tiles on their home. Slates great look— First and foremost, homeowners are drawn to slate because its looks great. There simply isn’t a roofing material on the market that has a classier, more notable appearance. Furthermore, slate roofing tiles offer more choices than most homeowners actually know about, available in varying sizes and thicknesses, as well as a wide range of colours, including grey, green, purple, black, red, and mottled tiles that sport several colours mixed together.

Durability— Slate roofs can and should be routinely built to last at least a century. In fact, 150 years is a reasonable expectation of a roof’s life if the roof is properly constructed. That’s a big plus in an industry where many roofing systems are lucky to last 20 or 30 years before needing replacement. Fire Proof— Slate roofing is one of the most fire-resistant roofs that exist. Unlike many other roofing materials, slate tiles themselves are completely fire proof. That’s a big advantage when it comes to preventing fires caused by air borne sparks from fireworks, wildfires, or from adjacent house fires. Environmentally Friendly— Roofing waste accounts for more than 5 percent of the total waste sent to landfills across the nation every year. Since the majority of that roofing waste can be attributed to asphalt shingle roofing that needs replacement every 20 to 30 years, it’s easy to see the positive environmental impacts of installing a roof that is going to last 100 years or more. The Cons The most notable disadvantage when it comes to installing a slate tile roof on your home is its high cost, but we’ll get to that in a minute. Other than that, the down side of slate roofing is that homeowners should be aware that slate roofing requires a slate professional as the installation has tough requirements, the brittleness of slate tiles, and complications that arise in replacing damaged slate tiles. You would not want an unexperienced contractor causing more damage than good working on your roof. Poor Installation— The vast majority of roofing contractors, as well as general Thai contractors, know very little about slate roofs. This certainly would not deter Thai construction from giving you a quotation or trying to install slate roofing tiles anyway without real slate knowledge. When you are hiring a contractor, be sure to inquire about experience and ask for references. A well installed slate roof will last a century or more. An inadequately installed one would cause more grief and cost than good. Weight— The weight of slate roofing tiles is anywhere between 350 and 700KG per 10m2. As such, you’ll need to have your residence assessed from a structural standpoint before you install slate roofing tile on your home to make sure it can take the weight.

Durability— The fragility of slate roofing tile can be a big negative for homeowners. You don’t walk on them unless you know what you’re doing. You certainly don’t want the Thai A/C on your rooftop, he’ll break tiles and cause expensive damage. Replacing broken tiles isn’t as easy as it sounds, either. Since slate comes in lots, that makes it nearly impossible to find replacement tiles that are a perfect match. Lighting is a big subject and very important as it sets the whole mood for your home. Basically, there are three main types of indoor lighting to consider when choosing the right lights to illuminate your home and create the desired homely atmosphere and also have the right functionality. These are Ambient Lighting, Accent Lighting and Task Lighting. Every room in your home should include these three types of lighting. Lighting works best when you use a combination of different types of lighting. Avoid at all costs a single overhead light, as it casts horrible shadows and makes people look ill if they are only lit from above. As always there are exceptions, such as a Statement Light. For example, a Chandelier hanging from the centre of a room, which will undoubtedly make a grand statement, but even then you will find that other lights will be needed such as floor lamps, a favourite of mine as they can be moved around. Let us start with Accent Lighting. I choose this sort of lighting first because you will need to create the right atmosphere and ambience. Then you can fill in the shadows with Ambient Lighting. Decide what is important to focus on in your room. In a living room it could be a piece of art, a hanging picture, a vase of flowers. Track lights are types of Accent Lighting. Remember, these lights are often brighter and some you will be able to focus so they draw your eye to whatever they are illuminating. Accent Lighting can be either halogen, which gives a warmer light or LED, a colder light which is gaining in popularity, especially if your furniture design is contemporary. They are great for mood lighting so make sure they can be dimmed to better control the lighting in your room. Distribute them evenly throughout the room and avoid placing them too close together.

Table lamps are great too. Wherever you have a side table think about placing a table lamp on it with a good shade. Don’t forget, shades on lamps are important as they contribute to the overall design ascetic, so choose them carefully.

Kitchens nowadays are often incorporated into the living space and should have their own lighting; mainly functional and built into cabinets and overhead in the ceiling covering all work spaces. You do not want single piece lights in the kitchen area or on work surfaces as they will get in the way and can easily be knocked over.

Lastly, there is Task Lighting. These are lights that fulfil a certain function such as angle poise lamps, pendants and reading lights on side tables. These lights are stand alone so they can be easily moved around to where they are needed.

Once you have your Accent lights in place you can add your Ambient Lighting or general light to fill in the shadows and light the whole room.

Why HYDROPONICS?

If you are like me then you care about what goes into your body. Sometimes not easy in our busy world and hectic days but I am a firm believer of the old adage “You are what You eat”. So, till recently I’ve tried when possible to buy organic foods and eat a healthy diet. Organic is great but sadly it is not easy to tell at the supermarket shelf how strict the farmers have been on following the organic guidelines and there still have been cases of pesticides and other poisons on our supposedly healthy products. Maybe in a perfect world everyone world have a small vegetable garden and be able to grow most of their own. But the world is not perfect and most of us hardly have much of a garden and if we do it is a constant battle with the elements. Most of us have come here for the heat and the wonderful sunshine but these are not exactly congruent for a vegetable plot especially when you’re trying European salads etc. What to Do? Most of us have all heard of Hydroponics, I certainly had but it has always been something that I considered too complicated or near impossible to set up in a home environment. But the last few months has seriously changed my attitude and I think many of you will appreciate the info. So, what is HYDROPONICS? This is what Wikipedia says Hydroponics is a subset of hydroculture and is a method of growing plants using mineral nutrient solutions, in water, without soil. Terrestrial plants may be

grown with their roots in the mineral solution only, or in an inert medium, such as perlite or gravel. So, in plain English you are growing plants without soil using a nutrient feed solution for the plant feed. There are then various methods of going about this which we will look at later. But before we go too deep, let’s have a look at the benefits Faster Growth! Plants grow faster with hydroponics because it’s a more efficient way to grow them. For example, most experts agree that plants will grow at least 20% faster with hydroponics vs soil. That’s a huge time saver and difference! Bigger Yields! Scientists have lots of theories as to why this is the case, but the fact of the matter is that experts also agree you can expect at least 20-25% more yields with hydro as compared to growing in soil. That truly adds up! No soil! This can be a benefit because you may live in an area where there is no good soil to grow plants outside. Or perhaps you don’t have any outside area because you live in an urban area. With a hydro grow you can still grow plants, even if you don’t have soil! Space Saving! Because your plants don’t need to spread their roots out into lots of soil to get the nutrients they need (because they’re surrounded by oxygenated nutrient-rich water solution)–you can pack more plants closer together. This saves a TON of space and one of the amazing features about indoor grows is how many plants can be put together and grown in a small space. Again, this is perfect for urban dwellers who want to grow a lot of plants with little space. Water Saving! Because you are using reservoirs that are covered (to prevent evaporation) and no water seeps out of the bottom (because they’re sealed)–the plants take up the exact amount of water they need at any one time and the rest remains in the reservoir to be used later. Compare this to soil gardening where you have to water your plants daily and most of the water is wasted. It’s easy to see how the same amount of water used to water a plant in soil for a day can water a plant in a simple hydroponic system for multiple days or even a week at a time! In short, you can save about 90% of your water by switching to hydro growing. No Weeds! One of the most tedious, time-consuming


and frustrating activities for many gardeners is cleaning their gardens and pulling out weeds. With hydroponics growing there are no weeds to pull! Less Diseases & Pests! Because you’re not using soil, you also get rid of a lot of soil-borne diseases and pests that can normally wreak havoc on your plants and make gardening a pain. The Truth is “Hydroponics” is not rocket science and can be easily learnt. In our world today all the hydroponic supplies can be bought effortlessly online, I use Lazada and AliExpress. You don’t need to have much space and whether indoors or out or a small kitchen set up or a larger Hydroponic grow it is simple and fun to grow your own vegetables. The big advantage for me is that although I’m “officially not growing organic” my vegetables are pesticide and poison free. Not only that but fresh on my table when I need and “Home Grown always tastes Better”. It is possible to grow with organic nutrients but for our beginning we will keep it simple and you can look which hydroponic solution would best fit your requirements. The Different Types of Hydroponics and How They Are Different. When it comes to hydroponics systems, there are six main types to choose from. These are:

Wicking System - No air or water pumps, a wick delivers nutrients to roots. Nutrient Film Techniques (NFT) - Nutrient solutions pumped through channels to roots. Solution drops into the reservoir to be constantly reused again. Ebb and Flow (Flood and Drain) - This system doesn't constantly introduces the solution to roots like the others. Instead, it creates "floods" in a tray with a water pump. It needs to deliver nutrients to roots multiple times a day. Aeroponics - Like an ebb and flow, the roots are in the air. Instead of a flood, this system mists the roots with nutrients. Drip - Very common system where plants sit in solution and overflow drips below into reservoir and pumped back toward the roots. DWC - The reason why we are here, so we can’t skip over it. The process utilizes air pumps and containers filled with water. The roots stay fully submerged. We'll expound on this system in just a bit.

Now, there are actually multiple variations of each of these different types of hydro systems, but these are the “high level” overviews and categories of basic designs. Here’s the important thing to remember: ALL these systems are hydroponics because they don’t use soil, and because you’re feeding the plants a nutrient-rich water solution instead of planting them in soil. The only difference between each type is HOW they deliver the water, oxygen and nutrients that you’re feeding the plants. The EASIEST Type of Hydroponics System to Setup Deep-Water Culture (DWC) hydroponics system Without a doubt, most hydroponics experts would agree that a is the easiest type of hydro system to use for indoor growing because it requires the LEAST amount of materials, supplies, and know-how to get started: The Deep-Water Culture (DWC) hydro system is the easiest for beginners to use. In a DWC hydro system, you simply fill up a reservoir with your nutrient solution. You then suspend your plant’s roots in that solution, so they receive the steady, continuous supply of water, oxygen, and nutrients. Then a continuous oxygen supply is added to the water. The most common way that growers oxygenate the nutrient solution reservoir is with an air pump and air stone to pump bubbles into it. This keeps your plant’s roots from “drowning” which — while it sounds weird — is a real concern because your plants will suck the oxygen they need out of the water. Using the DWC system, you’ll find it’s extremely simple to setup (once you understand how it all works) and extremely low-maintenance (again, once you understand how it works) making it perfect for hydroponics beginners. If you go out and source all the bits yourself, you can build a small DWC system for less than 1000 Baht. These systems can also be bought ready to use and there are some slick set ups that would not look out of place in a stylish kitchen. Legal Issues for Baby Boomers Looking to Spend their Golden Years in

Koh Samui and Koh Phangnan A significant number of baby boomers from around the world, including retirees from Europe, Japan and Australia, are choosing to retire in Koh Samui and Koh Phangnan. The baby boomers are attracted by factors such as the climate, comparatively low cost of living, culture and lifestyle. Generally speaking, baby boomers (defined as persons born between 1946 and 1964) are much more travelled and affluent than the generations before them and are desirous to live the golden years to the fullest after a lifetime of hard work. All indicators would suggest that the trend is for retirees to choose Thailand will continue in the foreseeable future. The following article examines some of the key issues for persons who are considering the prospect of retiring in Koh Samui and Koh Phangnan and examines the real estate ownership options available to retirees in Koh Samui and Koh Phangnan. In terms of immigration compliance, persons seeking to retire in Thailand must obtain a retirement visa. The principle requirements to qualify for a retirement visa are that an applicant must be at least 50 years of age and be able to show that they have the sum of 800,000 THB in a Thai bank account. The money must have been in the Thai bank account for a period of 3 months at the time the application is submitted. A retirement visa can be extended on an annual basis. Prior to 1st January 2019, an applicant for a retirement visa could provide a letter issued by their embassy confirming an income of no less than 65,000 THB per month which was sufficient to meet the financial requirements for a retirement visa for retirees who do not have sufficient savings in a Thai bank account. However, embassies will no longer provide such letters and therefore it is unlikely that applicants can provide evidence of income to obtain a Thai retirement visa.

Many retirees elect to rent accommodation in Koh Samui and Koh Phangnan and there are many reputable and trustworthy real estate agents in Koh Samui and Koh Phangnan who will be able to assist retirees to secure rented accommodation to suit any budget. In order to avoid problems it is prudent to confirm that the person renting out the property is the legal owner of that property (or has the legal authority to act on behalf of the legal owner) and this can be confirmed by checking the land title documents and the passport or identity card of the landlord. Some reputable and trustworthy agents will conduct checks of landlords before listing their properties. Retirees should sign a written lease/ rental agreement with the landlord setting out the key terms such as the monthly rental and the length of the lease term. Retirees who should wish to invest in property in Koh Samui and Koh Phangnan should be aware that, with limited exceptions, the ownership of freehold land by foreigners is strictly prohibited. However, foreigners (retirees and other investors) are permitted to own a freehold unit in a condominium building, lease an apartment unit or house or lease land. In accordance with Thai law, up to forty nine percent of the livable area of a condominium can be owned by non-Thai persons. Recent changes to Thailand’s Condominium Act provide foreign investors with a host of statutory protections including protections against false claims made by developers in advertising materials and standard form contracts for condominium contracts. Foreign investors who are not resident in Thailand must remit the funds required to purchase the condominium unit from overseas in order to obtain freehold title to the condominium unit. Retirees and other foreign investors may acquire the long term use of land or an apartment by leasing land or an apartment from the freehold owner. In accordance with the laws of Thailand, a registered lease is limited to a term of no longer than 30 years, however, lease renewals can be secured through carefully drafted clauses contained in the lease agreement. It is important to note that a lease agreement is terminated upon the death of the lessee and will not transfer to the heirs of the leaseholder unless there is a suitable succession clause contained in the lease agreement. It is important for retirees who invest substantial sums of money into Thailand to make provision for the succession of their assets in the event of their death by instructing a lawyer to draft a last will and testament in both English and Thai. This will provide re-assurance to the retiree that family members (who may live thousands of miles away) will not be unnecessarily burdened with dealing with the estate of the deceased in the event of death. Whilst retirement communities and active adult communities are big business in the USA and Australia and are growing in other South East Asia countries such as the Philippines, there is a seeming lack of supply of retirement/active adult communities in Koh Samui and Koh Phangnan. This provides entrepreneurial developers with an opportunity. Developers and investors should be aware that the Thai government offers special investment privileges to investors in retirement communities in Thailand under the Board of Investment, such as foreign ownership of the project land, the right to bring in foreign workers into Thailand and the right to take or remit foreign currency abroad. Important Changes to the Work Permit Law Employers and Employees Take Note. Both Employers and Employees should take note of the new work permit regulations and notification requirements which came into effect on 28th March 2018 and affect all employers of foreigners and foreign employees in the Kingdom; including those who are working in Koh Samui and Koh Phangnan. We examine the changes to the work permit law and examine the implications to both employers and employees.

Administrative Changes Under the old laws, an application for a work permit was required to be made in person, in Thailand, at the Department of Labor. According to the new laws, it is now possible to submit an application for a work permit electronically either within Thailand or from overseas. In addition, the issuance of a work permit will not exceed 15 working days.

The New Regulations The latest amendment to the Emergency Decree on Managing the Work of Aliens 2017 enacts a number of key amendments to the work permit law: Foreigners who enter Thailand occasionally for the purposes or organizing or attending meetings; give opinions, give lectures or provide talks, participate in training sessions, tour, seminar, art or cultural exhibitions, sports competition, or other purposes prescribed by the cabinet; are no longer required to obtain a work permit. These changes are in-line with other developed countries which do not require any special permissions to attend such events. Secondly, foreigners who enter the Kingdom to engage in business or investment; or who have skills which will help improve the country, subject to certain specifications, will also be exempt for the need to obtain a work permit. Thirdly, representatives of a foreign entity which is granted a foreign business license pursuant to Thailand’s Foreign Business Act shall also be exempt from obtaining a work permit.

Definition of “Work” The legal definition of “work” has been narrowed to “performing any profession, whether or not there is an employer, excluding business operations of a foreign business license’s holder under the Foreign Business Act”. The previous definition of work was “exerting one’s physical energy or employing one’s knowledge to perform a profession or perform work, whether or not for wages or other benefits”.

New Reporting Requirements of Employers and Employees An employer is now legally required to notify a work permit official of a foreign person’s name, nationality and the nature of the work undertaken by the employee; within 15 days from the employment date. At the end of the employment period, the employer is legally required to notify a work permit official of the cessation date of employment. A failure to comply with the reporting requirement may subject the employer to a fine of up to 20,000 Baht.


Employers who have already engaged foreigners on 28th March 2018 are subject to the same reporting requirements on or before 26th May 2018. Any existing employers who have not been aware of the changes until reading this article should comply with the reporting requirement as soon as possible. In addition to the new reporting requirement by the employer, a foreign employee is required to notify a work permit official of their employer, work places and nature of their work within 15 days from the employment date; and on every occasion that the foreign employee changes their employment. A failure to comply is subject to a fine of up to 20,000 Baht. Penalties Finally, penalties for working without a work permit have been weighted more against the employer than the employee. Under the former regime, a foreign employee working without a work permit (or outside of the scope of their work permit) was subject to a penalty of up to 5 years in prison and/or a fine of up to 100,000 Baht. Under the current penalties, the maximum penalty is only a fine only of between 5,000 Baht and 50,000 Baht. Conversely, an employer who under the old regime was subject only to a fine of up to 400,000 Baht for employing a foreigner without a work permit, is now liable for a custodial sentence of up to 1 year for repeat offences and may be prohibited from employing foreigners for 3 years. Both employers and employees should be aware of these new regulations and ensure that their business is in full compliance with the new laws and regulations and further ensure that internal procedures and processes are altered to accommodate these changes. 有关工作许可证法律的重要变更 - 雇主和雇员须知 所有雇主和雇员都应该知道在2018年3月28日生效的工作许可证新法则和汇报规定,因其影响到 泰国境内所有外国雇主和外国雇员; 包括在苏梅岛和帕干岛工作的外国人。在此我们审视新工作 许可法的变化,并评估对雇主和雇员的影响。 新规定 对于 “2017年管理外国人工作紧急条例” 的最新修正案,针对工作许可法进行了若干重要修订: 凡偶尔进入泰国组织活动或参加会议的外国人; 提供意见、演讲或会谈,参加培训课程、旅游、 研讨会、艺术或文化展览,体育比赛或其它经内阁许可的活动; 将不再需要申请工作许可证。这 些修订与其它发达国家一致,不再需要任何特殊许可即可参加此类活动。第二,进入泰国从事商 业或投资的外国人; 或具备有助于改善国家的技能,在符合某些规范的情况下,可以免除申请工 作许可证。第三,根据泰国“外国商业法”而获得外国营业执照的外国企业代表亦得以豁免工作 许可证。 行政变更 根据旧法,申请工作许可证必须由本人亲自在泰国劳工部提交申请。而现在依据新法,则可以在 泰国境内或海外以电子方式提交工作许可证的申请。此外,工作许可证的发放将不会超过15个工 作日。 ”工作“的定义 “工作”的法律定义已缩小为“无论是否有雇主而行使任何职业。但不包括根据『外国商业法』 取得合法营业执照的业务活动”。以前”工作“的定义是“发挥个人的体能或利用个人知识来执 行专业或从事工作,无论是否有工资或其它利益”。 雇主和雇员的最新汇报规定 现在,法律要求雇主在雇用外国雇员当日后的15天内,向工作许可处官员通报该员的姓名,国籍 和雇员所从事的工作性质。并在雇用期结束时,亦应依法向工作许可处官员通报该员终止工作的 日期。 如果不遵守汇报规定,雇主可能会被处以最高20,000泰铢的罚款。 若在2018年3月28日以前已聘用外国人的雇主应在2018年5月26日之前依汇报规定提报。而任何在 阅读本文之前未知新变更的现有雇主则应尽快遵守汇报规定。 新汇报规定除了对雇主外,外籍雇员亦须在被雇用日期后的15天内向工作许可处官员通报其雇 主、工作地点和工作性质; 此后每次外籍雇员改变其工作时均应遵循此法。不遵守规定的,最高 可处以20,000泰铢的罚款。 惩处 最后,对于没有工作许可证而工作的惩处,雇主的程度将高于雇员。根据前政权规定,在没有工 作许可证(或在工作许可证规定范围之外)而工作的外国雇员可被处以最高5年的监禁和/或最高 100,000泰铢的罚款。而目前的新规定,最高罚款仅为5,000泰铢至50,000泰铢之间。相反的,根据 旧制度的雇主,如果雇用没有工作许可证的外国人,只会被处以最高400,000泰铢的罚款,现在则 可以对累犯处以长达1年的监禁,并可能被禁止雇用外国人长达3年。 雇主和雇员都应了解这些新规定,以确保其业务完全符合新的法律规范,并应进一步确保内部程 序和流程修正以适应新的变化。 本文由LIMCHAROEN LEGAl(SAMUI)律师TANUN RUNGWIWAttANAKOOl撰写, 请致电0935759675联系我们的苏梅岛办事处或发送电子邮件至SAMUI@LIMCHAROEN.COM 中文翻译:方良玉 JADE FANG 电话:0818938366 邮箱:jADE.YU5566@GMAIl.COM

on Thailand Condo’s Our land of smiles has come up with a number of diverse product offerings over the years and in particular with Thailand’s property finance market, many have tried to enter the sector, though few, have firmly established themselves to be long term growth engines, especially when we include Foreigner finance into the mix. As far as I remember, we have seen commercial banks and finance companies begin offering finance, than let down clients last minute by withdrawing the product, private offshore funds come up with an investment property finance initiative, only for clients to be sold regular savings scheme plans to repay the loan and then withdrawing the finance and then, International commercial banks set up only for a couple years later to wind down the product or certainly do very little marketing. The challenges all faced are consistently the same and have been for years …..and years. Foreigners are in general, not able to own land therefore, when it comes to landed property such as a Villa, Thailand companies are often set up to own the land, and houses

When it comes to Condo ownership, Foreigners are legally able to own outright in their own name a condo title since a maximum of 49% of the Sq.m. area in the condo building is available to foreigners, 51% is Thai only. As 51% is Thai only, this means the majority in theory means the land is majority Thai owned also. Out of the 2 property types (Condo & Villa), the Condo is easiest to clearly show sole Foreign ownership, the name of the Foreigner is printed in Thai language on the back of the title deed as the true owner. A Villa of course would have the Thai company as the owner and the Foreigner would have creative shareholder structures in place. It’s easy to see why the Villa and Thai company structure above can cause difficulty when it comes to lending as the Thai company structure itself is a grey area. Laws in Thailand often have many terms open and left to be construed in different ways which in turn means, there is often differing opinions on the matter. Add on the fact Thai’s are not supposed to act as nominees for foreigners and things can get complicated. If you are looking to set up a lending business, it can be difficult to sustain a consistent approach to the matter particularly as time goes on, staff change, government officer’s change and therefore, opinions change. What’s good today may not be good tomorrow, in a grey area. Having said that, I wouldn’t even attempt at counting the number of Expats living in Thailand who own landed property and have Thai companies involved, it’s just accepted as “this is how it’s done”. Now, back to our article subject, “The Great Equity Release, on Thailand’s Condo’s”…There is one Mortgage finance product which has truly stood the test of time (around 10 years) without faltering and that is the easy Cash-back, Equity Release or Reverse Mortgage, of one particular Thai public listed company. In essence, the Equity Release model is simple, a Foreigner must already own the Condominium unit in their own name, once you have bought and own it, send the title deed to their staff along with a couple other useful bits of info like date of birth and original purchase paperwork etc. and an equity release loan can be made available, usually around 4 weeks, providing it fits their preferred choice of Condo and applicant paperwork permits. The reason this particular offer is holding steady is down to the fact a Foreigner can legally own a condo and clearly in their own name (albeit Thai language). If a foreigner has bought already, the land office has acknowledged the legal ownership and when wanting to finance the unit after, there are no complications like showing foreigner exchange paperwork (which is a government requirement and means foreign currency paperwork was used to purchase in the first place, not THB). In fact, it makes it easier for the lender to consider approval since if someone has found the ability to purchase a unit, they in theory should have enough spare funds to afford a monthly instalment.

灰色地带。泰国法律常常有些开放式的条款,等待着日后 被完善,也就意味着针对这些条款常有着不同的见解. 加之 泰国人不可作为外国人名义上的代理人,因而事情变得更 加复杂. 如果你想要成立一个贷款公司,很难保持一致性的 方法运行。特别是随着时间,员工的变动,政府官员变动 更或是意见看法上的改变. 在灰色地带中,今天看似很好的 状况明天却不一定了. 即便如此,我不需要细数居住在泰国 的外国人当中,有多少以泰国公司的形式拥有土地房产。 仅需要接受在泰国,事情就是这样办成的. 现在让我们回到文章的标题,“泰国公寓的资本释放抵押 贷款”, 有一种贷款产品多年以来(大约10年)一直非常 的稳定,那就是现金返还,资本释放或是叫反向贷款,这项 业务目前特属于泰国的一家上市公司。 值得一提的是资本 释放模式更加简单,外国人需要已经持有公寓,在购买后 仅需向工作人员提供地契以及一些其他的基本信息,例如 出生日期和购房相关文件原版等等,即可以开始申请资本 释放贷款,通常流程在4周左右,以证明该项目是他们倾 向的公寓且申请者的材料过关。这种贷款方式相对稳定的 原因是外国人可合法持有公寓并注有他们的名字(泰文形 式)。当一个外国人已经持有该房产,意味着土地厅已经 知晓该公寓所有权,所以在贷款融资时便免去了一些复杂 的程序例如外汇证明表(泰国政府要求出示相关文件以证 明购买该房产是以外币汇入的方式,而不是泰铢)。实际 上,这更容易让贷方批准贷款,因为考虑到若某人已经有 能力支付全款购买该公寓,那理论上他应该有足够的资金 来偿还每月的贷款。 释放资产价值模型被运用的很好,在过去的几年里,很 多时候2个礼拜以内就可以释放资金,是的,外国人只要 2个礼拜就可以拿到款项,是以泰铢支票的形式发放,客 户自行存储,可以存到自己户头,根据需求来灵活运用该 款项。 由于贷方会更加关注抵押品,所以这类型的申请要求相对 较少。如果贷款额度小于最高60%贷款额度,这意味着在 最坏的情况下,如果贷款方不支付款项,贷方就可以变卖 公寓来支付贷款,通常情况下,新的买家至少会以60%的 价值买到,因此理论上这些钱也将足够偿还贷款。当然, 相关文件和KYC(熟悉客户)分析文案也依旧会被需求, 只是重点仍然集中在公寓上本身。 泰国公寓融资地图(链接公布在Google Maps上)使得 时期更加简单,因为贷款已经事先审批通过了进350个公 寓项目,并根据楼层,视野,不同单位及建筑等规定了贷 款额度。以下图为例,图中信息为坐落于河边的文华东方 公寓。点击地图上的红色标记便会有窗口显示出详细的每 平方米可贷款额度,只需将相对应的贷款额度乘以公寓面 积,即可得出大致的贷款额。例如,你已经在该项目购买 且持有一个面积为110平方米,位于33层的公寓,那么大约 的贷款额就是110 x 190,000 = 20,900,000泰铢(贷款额不 应超过评估价的60%)。在提交所需文件后的约4周时间, 贷款将会存入客户指定的泰国银行账户上。从右下稍微缩 小的地图上可以看出已经有很多的公寓项目通过审批。再 缩小一点便可以看到在其他府获批的公寓包括华欣,芭提 亚,普吉,清迈以及沙美岛。

The Equity release model works so well in fact, for some over the past many years, funds have been available in as little as 2 weeks…..yes, that’s just 2 weeks for a Foreigner, to get a THB cheque payable to themselves, which can then be banked on their Thai bank account and spent of their own free will and choice. The requirements of such an offering are usually very little as the lenders main focus is on the collateral. If the loan size is less than their maximum 60% loan to value limit, this means at worst case scenario, should one not pay the loan, the condo can be sold to repay the loan, and typically, a buyer should be found for at-least 60% valuation which in theory can repay the loan. Of course, documents and KYC (know your customer) paperwork shall be required, though the focus remains on the condo. A Thailand Condo Finance Map (Public link through Google Maps) makes things easier also, as the lender pre-approved almost 350 Condo’s and specified the loan size available for each floor, view, unit and building etc. Take for instance the image below highlighting the newly finished Residences @ Mandarin Oriental on the riverside in Bangkok. Click on the red marker and up pops a window detailing an amount per Sq.m. available in baht finance. Simply multiply the corresponding amount by the size of your unit and this is likely to be your loan availability. For instance, your unit which you bought and have a title deed in your name already than would like to make equity release is of size 110 Sq.m. on the 33rd floor. The loan available to you is 110 x 190,000 = THB 20,900,000 which should be no more than 60% of the official valuation. Submit the supporting documents and typically within around 4 weeks, the baht is available on your designated Thai bank account for using as you please. As you can see from the 2nd image which has zoom out a little, there is a massive number of condo’s pre-approved. Zoom out further and you may see many other provinces also including Hua Hin, Pattaya, Phuket, Chiang Mai and of course Koh Samui. In essence and to summarise, a classic Mortgage structure is used, officially registered at the local land office and is backed by a public listed company which has been around for over 30 years with it’s main headquarters at a Bangkok landmark shopping center. Typically at MBK Guarantee Co., Ltd. Our Condo Equity Release interest rates tend to be from 8.65% p.a. if the Mortgage is registered within 1 month after purchase or, from 9.65% p.a. onward. Working and Retiring in Thailand Social Security Tips & Pension Rights A few of you reading this article will have lived and worked with a work permit in Thailand like myself for many years. Of course, if we work a work permit is required and every month we would receive our salary minus tax and social security payments. As so often all over the world it is sometimes very difficult to find out what our benefits could be relevant to us once retiring. This information is always kept quiet.

This information you are going to find very interesting: If you have worked and paid social security in Thailand for at least 180 months (15 years) once you stop working or retire at 55 then you are entitled to receive most of your social security payments back. This could be a lump sum or monthly pension payments. A German friend of mine having worked many years over here and just retired received 80,000Thai Baht. Thailand’s social security system is funded by workers contributions as well as additional contributions from the employer. There are various sections to the Thai social security system. The social insurance system is for old age and disabled. All those who are working between the ages of 15 and 60 must make contributions to this system if working. A worker will normally contribute 3% of their gross monthly earnings towards pensions and family benefits. If you want to make voluntary contributions, you can contribute 9% of earnings up to 4,800 THB each month. Those who earn less than 1,650 are not required to make contributions. The self-employed make an annual contribution of 3,360 THB. In addition to this, those who are employed will have their contributions topped up by the employer by 3% and the government will add a further 1%.

You can claim the old age pension once you are 55 years of age and have made at least 180 months contribution. The pension or lump sum can only be claimed if the claimant is no longer working and if he/she begins work after claiming the pension it will be suspended until they stop work again. Depending on amount of time actually working the pension could be changed to a lump sum payment. The pension that is paid out is the equivalent of 20% of the average wage earned in the previous 60 months before retirement. Payments are increased by 1.5% of this amount for each 12-month period of contributions over and above the minimum 180 months. As there is no minimum pension, low earners could find that their pension amount is not very much. In addition, a family can claim child allowance each month of 350 THB for each child providing they are registered in the social security system. There is no contribution required for this and the family must have made a minimum of 12 months’ worth of contributions in the 36 months preceding the claim. This benefit is paid out for children under the age of 6 but a family can only claim for a maximum of 2 children. All those working are eligible for medical cover if they have a work permit and are making contributions to the social security system. All those who are not in the system should have private medical insurance to cover them. If you have a work permit and are working then contributions are compulsory, no matter what your nationality. In order to register with the social security fund, it is necessary that the employer completes their paperwork first and provides the worker with the SSO 1-03 form to be completed. This should be presented along with a photocopy of an ID card and a passport, and any other ID documents that are requested. The employer needs to send these to the social security office. When registration is completed the worker will receive a social security card 5 days after registration and this card remains the same no matter how many jobs the person has. There is also a medical card which is sent out after 3 months contributions have been made so that the holder can receive free medical treatment. To make a pension claim, just visit your local Social Security office taking your social security card as the number is important, a copy of your bank book and your passport. Needing a Thai ID card is not requirement you only need proof of your security number and bring any old passports with you. In the Social security office, they must check that all the work you have done is registered in the system from your various passports over the years. I found the Thai staff at the social security centre more than helpful and the whole process for myself took less than an hour and I was then given a letter explaining I would receive over a 100,000 in a week’s time. A few days later the money was transferred to my account, couldn’t have been easier. So, if your over 55 and have been working over here I would advise a visit to the office and check on your payments and what you could receive. It really couldn’t be simpler.

Good Samaritan Law Protection We have had a few emails asking about the traffic accidents on Samui and if there is anything a care giver or good Samaritan should know before actually helping at the scene of an accident. Good Samaritan Laws (or related local laws) are enacted to encourage people to come to the aid of others. In general, they protect individuals who voluntarily offer assistance to those in need and are created to provide immunity against liability. Often, a Good Samaritan law imposes no legal duty to help a stranger in need. However, local laws may vary on this point and in some countries like Germany for example people are required to provide aid. To be protected by a Good Samaritan law, typically you should; Only provide care that is within the scope of your training as an Emergency Responder • • • • •

Ask for permission to help - child, parent or guardian Act in good faith Do not be reckless or negligent Act as a prudent would do so Do not abandon the patient once you have begun care.

FAQ’s

Q. Since arriving here, I have heard that there is no Samaritan law shielding those trying to help someone who is injured. Is this true? Are you legally responsible for trying to help someone who may die if you do nothing? My first instinct would be to try to help someone if possible. However, if this opens you up to lawsuits, I would be very hesitant to help except in the direst circumstances. Therefore, I thought it might be helpful to get a professional opinion. Thai Lawyer's Response

According to the Criminal Code, Section 5, 5th paragraph, if you have training in first aid that enables you to save lives, you are by law required to help, but if you are a normal Samaritan with no training you are not legally required to help. You are normally not responsible for the outcome if you tried to help.

Q. I have been CPR/First Aid/AED certified in Thailand 3 times. I will always keep my AED cert. Each time I redo

my certificate for CPR, we are told, even as a 'layperson' holding an AED cert, legally here, we are not allowed to use them. When I had a business 2 years ago, I wanted one in, I was told the same thing by the lawyer. I have just been told that this is a lie, that a layperson (untrained professionally) who is Certified to use an AED, it is not illegal here. Has this law changed since Nov 2013?

Koh Samui Survives Tropical Storm Intact Hotels, ferries & airports return to business as usual KOH SAMUI, Thailand (Jan. 8, 2019) — No casualties were reported on the popular tourist island of Koh Samui as Tropical Storm Pabuk passed through the Gulf of Thailand on Friday and dissipated as it hit the mainland. Ferry boat services from Suratthani to Samui recommenced on Saturday after a two-day suspension due to safety concerns. Normal operations also resumed on 5 January to and from Samui Airport. Sunny periods and scattered showers were forecast for the week ahead, allowing thousands of tourists who have booked holidays on the paradise island to continue their plans. However, “red flag” warnings banning swimming off beaches were still in place. The neighboring islands of Koh Phangan and Koh Tao were similarly unscathed, though electricity supplies were affected. Hotels and businesses on the islands began cleaning up after the storm with most reporting minimal damage from the lashing winds and rain. “Aside from it being a major inconvenience for our guests, I am pleased to report that we are all fine and have suffered no damage,” said Remko Kroesen, the general manager at Banyan Tree Samui resort, which occupies a bay on the island’s southeast coast. “Storms [like Pabuk] are not anything unusual on Koh Samui, but we did experience some very large waves which brought in a lot of debris. “The airport is open again and additional flights are being put on to cater for the high-season traffic. There are patches of blue sky and the wind and rain have dropped. Flood Damage Safe Clean up and Repair

Samui has had this year and the end of 2018 more than its fair share of bad weather. Seems the flooding issues are still severe when the weather turns sour. Without sounding like I’m closing the gate on the horse that has already bolted, here is some good advice on what to do on flood damage clean ups and renovation. I hope that you don’t need it but if you have sadly been affected by the heavy rain and flooding here are a few tips that might help you out. Properties do not need be near rivers, lakes or the coast to be at risk. The majority of flooding events are due to heavy rainfall and surface water not draining fast enough. We are now seeing this more frequently as rain is becoming more intense and urbanisation is increasing impervious surfaces. Urban environments where drainage has not been upgraded are particularly vulnerable.

Initial Precautions Before Clean-up Begins

Make sure that everyone is out of danger of new flood crests, fire, and falling buildings. Assume flood water and flooded materials are contaminated, to a certain extent they will be. Also take these certain precautions: - Electrical safety is extremely important in floods. Check for fire hazards and gas leaks. Use batterypowered light sources. - Before entering your home, look outside for damaged power lines, gas lines and other exterior damage and determine if it is safe to enter. Also, be watchful for fire ants, snakes, or other dangerous animals and insects that might have tried to seek shelter in your home. - Check all ceilings and floors for signs of sagging or other potentially dangerous structural damage. - Open doors and windows so your house can air out before spending any length of time inside. - Always wear protective clothing including longsleeved shirts, long pants, rubber or plastic gloves and waterproof boots or shoes. - Mould: If mould is present, wear a respirator that can filter spores. - Never mix chlorine bleach with ammonia or vinegar as this produces a toxic vapour.

Electrical Systems

Be sure all electric and gas services are turned off before entering the premises for the first time. - Disconnect the main switch and all circuits. - Remove covers from all outlets and the fuse or breaker boxes; flush with clean water. - Let dry, and spray with contact cleaner/lubricant. - Have an electrician check for grounds and other unsafe conditions before reconnecting the system.

Furnishings and Carpets

Remove all furniture, bedding, and carpeting to outdoors to be cleaned and dried (or discarded). - Flooded carpets and rugs are best replaced since flood water may contain contaminants. Flooded carpet pads should always be discarded and replaced. - Remove water-logged rugs, carpets, and pads within 48 hours after flooding subsides. - If salvage is attempted, spread out rugs and carpets outdoors. Hose off. If soiled, professionally clean or work in carpet shampoo with a broom. Rinse well with a solution of 1-gallon water and 2 tablespoons liquid household chlorine bleach to sanitize (if colourfast). If carpet is wool, do not add bleach. - Dry the carpet and subfloor thoroughly as quickly as possible. If carpet is installed damp, it can mildew. - Carpet might shrink, but a professional may be able to stretch it. - All upholstered furniture and mattresses contaminated by flood water should be discarded. If an upholstered furniture piece is valuable, the stuffing and upholstering will need to be replaced. Solid wood, metal and plastic furniture may be cleaned and restored. Hose off any mud, clean, sanitize and let dry completely out of direct sunlight.

Walls

Open flooded walls, even if they appear undamaged, to prevent mould, odour, and structural decay later. - Remove water from the structure as rapidly as possible. Ventilate. - Remove baseboards and cut holes in wallboard to drain uninsulated walls.


- Remove the interior surface of insulated walls to a point above water height. Discard flooded drywall. - Undamaged panelling may be propped open or reinstalled after cleaning. - Remove and discard all wet fibrous insulation. - Clean out mud. Wall studs and plates may be sprayed with disinfectant (1 cup bleach/gallon water) to kill any existing mould and fungi. - Speed dry with dehumidifiers and fans. - Leave walls open until they have thoroughly dried, which may take up to a month. - Select replacement materials that will withstand future floods (such as rigid foam insulation, removable wainscoting, ceramic tile, etc.).

Next Steps

Long-term flooding or wetness is likely to ruin most interior finishes and contents, but the next steps may be possible when flooding is short term and clean-up begins promptly. Delay permanent repairs until the building is thoroughly dry, which may take weeks. Subfloors - Layers of submerged plywood or OSB subfloors will likely separate or swell. Affected sections must be replaced to keep the new floor covering from buckling. - When floor coverings are removed, allow the subflooring to dry thoroughly, which may take months without a dehumidifier. - Check for warping before installing new flooring. Wood Floors - Carefully remove a board every few feet to reduce buckling caused by swelling. If boards are tongue-andgrooved, consult a carpenter or flooring professional. - Clean and dry the floor thoroughly, which may take weeks, before replacing boards and attempting repairs. Tile and Sheet Flooring - If a submerged wood subfloor swells or separates, flooring will need to be removed. - If the subflooring is concrete, removal of the floor covering will hasten drying of the slab, but it might not be necessary if it would ruin an otherwise unharmed material. - If water has seeped under loose sections of sheet flooring, remove the entire sheet. Ease of flooring removal depends on the type of material and adhesive. Cleaning Wall Finishes, Woodwork, & Floors To reduce mould and damage, clean and dry as soon as flood waters recede. - Use a phosphate-free, all-purpose, or disinfecting cleaner. Wash from top to bottom. Rinse with clean water. - One-half cup of household chlorine bleach to a gallon of water can be used on non-metallic, colourfast surfaces as a disinfectant (to kill surface mould and bacteria) after cleaning, but it will not prevent new mould growth on materials that stay damp. - Dry thoroughly and quickly. If the utilities are on, use the air conditioning or heater, fans, and a dehumidifier or desiccants to speed drying.

Appliances and Equipment Clean and dry the submerged household appliance before starting. - With the electricity or fuel turned off, unplug and open as much as possible to rinse or wipe clean and let dry. - Tilt to drain and aid quick drying. Three days to a week is necessary for drying. - Appliance repair professionals should inspect before reconnecting. Many appliances can be saved. Furniture Take furniture outdoors to clean. - Brush off mud. All parts (drawers, doors, etc.) should be removed. Remove or cut a hole in the back to push out stuck drawers and doors. Discard flooded padding. - Use commercial furniture-cleaning products designed for the type of material. Do not refinish or wax until thoroughly dry. - Dry slowly out of direct sunlight because sun will warp furniture. It may take several weeks to several months to dry.

Preventing Mould

Aggressively control mould in the weeks and months after the flood. - When power is available, continuously use air plus a dehumidifier, if possible, to remove humidity. - In an un air-conditioned home, open windows and use fans to circulate air. - Turn on electric lights in closets, and leave doors open to facilitate drying. - Try to reduce activities that add moisture to the indoor air and use exhaust fans when cooking and bathing. Removing Mildew from Household Articles and Upholstery Avoid disturbing and spreading mould spores indoors. Clean mildewed items outdoors. Learn and take precautions to minimize exposure to mould. Visit http:// www.epa.gov/iaq. - Use a HEPA vacuum, if available, to remove visible mould growth. Discard the vacuum bag. Otherwise, wipe with damp paper towels, discard, and seal in plastic bags. - Dry items in the sun, if possible. - Sponge any remaining mildew with thick suds or a commercial cleaner designed for the type of material. - Wipe with a clean, barely damp cloth. - Wipe mildew-stained areas with a cloth dampened with diluted alcohol (1 cup rubbing or denatured alcohol to 1 cup water). Dry thoroughly.

Food and Medicine Items

- Throw out all foods, beverages and medicines exposed to flood waters or mud including canned goods and containers with food or liquid.

Camembert & Ribeye Steak Preparation: Slice the baguette bread. toast the slices in the oven. Cut the Camembert into thin slices. Clean the mushrooms, cut into slices. Halve the slices, chop them a little roughly. Heat a pan with oil. Remove the Ribeye Steak from the fridge – one hour before! Stir fry the dry aged steak medium or rare. Cut the steak into very thin slices immediately. Fry steak strips with the mushrooms for 3 minutes. Place oven on top heat or grill. Cover the baguette bread with the steak strips / mushrooms. Buddhist Monks realised Koh Phangan's tranquillity and spiritual importance and subsequently settled in Wat Phu Khao Noi just outside of the main town of Thong Sala as one of the first temples on the island. Within an area of approximately 167km2 with over 70% being unspoilt mountainous and tropical forest many more temples are nestled coherently within the islands natural flora and fauna offering a feast for the eyes of all visitors. LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain

RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.

SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.

SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)

STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area.

STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.

STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.

STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.

In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
