EDITOR'S LETTER Good Morning Koh Samui. Welcome to the June July issue of Samui Phangan Real Estate Magazine. This I must say is my favourite time of the year, yes, I know it’s still hot, actually very hot but the heat and the every so often heavy gush of refreshing rain and the growth and green that it produces is just beautiful. Even after all these years of living in Koh Samui it’s still breathtakingly picturesque. I know this is not just Koh Samui or Koh Phangan but the Tropics but the heat with the growth and the greenery will never be tiresome. This edition is again full of some of the most stunning real estate and real estate related topics our wonderful islands have to offer. We have a very interesting article thanks to the Attorneys at Limcharoen (Samui) about separating the legal myths from the actual truths. Here our author corrects some of the false truths relating to Thai law and what foreign property investors and buyers can and cannot legally achieve in Thailand. Outside Air Con Units
How to hide that ugly outside air conditioner unit I have actually just gone through this dilemma? The new house is almost finished and is looking just perfect, well that was until I realized I need two of the outside air con units to be sitting on the outside wall of the house. While that outside air conditioner is essential to your indoor comfort, air conditioner manufacturers have yet to come out with a unit that’s particularly attractive looking. So that leaves it up to you to come up with a way to camouflage it in your outdoor space. Luckily, lots of creative people out there have dreamed up some ingenious ways to hide an outside air conditioner. Here are some of my favorites.

Two rules for hiding your outdoor air conditioner Rule #1 Don’t Block the Air Flow. If your outside air conditioner doesn’t have access to enough air, it can overheat and break down. Rule #2 Make Sure the Unit Is Accessible for Service. Leave enough space around the outside air conditioner, and/or make your screen easily moveable. If you’re putting plants in the ground, you don’t want them stepped on! And you don’t want to neglect servicing your outside air conditioner; it’s not worth the risk. 1. FENCE IT IN One of the most common approaches is to simply hide the air conditioner from view. For ideas on fences and screens that could work for your garden, take cues from elements you already have in your garden to maintain an integrated look. 2. TALL PLANTS Beautiful pottery with tall grasses, flowers or other greens are a lovely way to hide that outside air conditioner. Be sure to choose hardy plants that won’t be wilted by the hot air blowing from the unit. And keep them far enough away so there’s enough room to service the equipment. 3. OUTDOOR PRIVACY SCREEN If you’re not really a DIYer, you can purchase a privacy screen made out outdoor-friendly resin. They are available in different colors to match your patio decor. 4. CONTEMPORARY SCULPTURE If you love modern art, this could be an idea for you. Sculpted metal panels conceal the outside air conditioner while serving as a piece of art for you and your visitors to enjoy 5. IRON TRELLIS How about an iron trellis surrounded by flowering trees or vines? This look works well if your brownstone has a brick exterior. If you like to spend time outdoors in the morning, we recommend planting some Chinese Honey Suckle, smell wonderful too.
6. VERTICAL GARDEN Creating a natural vertical garden to hide that outside air conditioner is one of my personal favorites. Remember, make sure it’s far enough away from the unit to allow for service and that no plant material gets pulled into the fan. 7. BAMBOO If you love Asian decor, try this simple bamboo screen. You could even try growing your own bamboo plants, but that takes a bit more time. 8. LASER CUT WOOD PANELS Laser cut wood veneer panels from Lightwave Laser come in a wide variety of patterns to match any decor. Make sure you have them sealed for outdoor use.

Art on the floor
You have placed your furniture and got your art on the walls but something is missing. Look down at your feet. Your floor needs a rug. Rugs can transform a room. Rugs look great on any floor and help to make a design statement especially a patterned rug with vibrant colours. Rugs will work in any room and will enhance the overall look adding colour and a feeling of wellbeing. They come in all shapes and sizes so it should be easy to find one that will fit your room.
Rugs can be placed anywhere in a room no matter what the shape. Do not be afraid to put furniture on them. They look great under a coffee table for example. Be creative, place your rug aligned to a piece of furniture, it does not have to be in the centre of the room. Where to start? Ask yourself, how big do you want the pile on the rug? In the tropics it is best to choose a rug with a short pile, long piles give the feeling of warmth which is what you might not want although they work well in bedrooms where you might want a little warmth underfoot. Next, take a photograph of a rug you like and look at it in the room you want to put it. How does the pattern and colours fit with your overall design and will it compliment your furniture? A rug in the entrance hall will set the tone for your house. For the lounge you can choose bold colours, cashmere rugs or a modern design rug. In the dining room cut pile wool carpet is easier to keep clean. Bedroom rugs make for peaceful and comfortable feel. Choose a light coloured rug to give a calm feeling. Hand-knitted rugs in wool or silk give a luxurious feel. Get ideas by looking through design magazines and visit design showrooms as they will have placed rugs in different settings to give you an idea of how and where to place them. Tips Safety - Use a liner to keep your rug from slipping depending on your floor surface. Polished wood floors are especially slippery. Cleaning - most rugs can be cleaned by using a vacuum cleaner except for silk carpets as the fine silk threads will be pulled from the rug by the suction. Instead, take the rug outside and beat it with your hands or use a carpet beater on the underside of the carpet but never the face side as this will damage the fibres Silk carpets should be kept out of direct sunlight as this will fade the vibrant colours of the dyed silk over time. Gardens in the Tropics Plants that Love the Sun
I’m only at the early stage of creating and planting my new garden and I have had to give some serious thought to what I should plant and where. I have a large garden nearly 1,000sqm which gives me all the room I need. My house which fits reasonably central on the plot is two storeys and therefore allows some interesting shaded areas and some that are just going to be hit hard by the heat. Finding plants that will flourish in the shade was easy, but I’ve had to research a bit to find some beautiful flowering plants that would complement the lawn and area. In Thailand’s tropical monsoonal climate, the months of March-May are normally the region’s hottest period. These 3 months prior to the onset of the rainy monsoon in late May are usually characterized by hot, dry weather with periods of intense daytime heat. For many gardeners in Thailand, this is typically considered to be a period of minimal gardening activity whereby the soil is too hot and dry. Nevertheless, with several hardy flowering plants this doesn’t have to be the case. Growing plants in full sun, especially within containers, can be challenging unless you choose varieties that are tolerant of these conditions. Many full sun plants are also tolerant of drought and harsh conditions, making them ideal for potted environments too. For instance, rosemary is an attractive, heat-tolerant, sun-loving herb that can be grown in areas with full sun as well as containers.
When choosing plants for areas with full sun, it’s generally better to stick with native plantings whenever possible. These plants are well suited to your particular area and climate, giving them the best chance for success. However, you can also select plants that share similar growing conditions according to your site such as soil type, light and water requirements. I’ve picked just some of my favorites for you to see if they’d make a good match in your garden.

1. The ‘Leb Mue Nang or Rangoon Creeper, Burma Creeper or even known as the Chinese Honeysuckle Family: Combretaceae. Quisqualis indica, Combretum indicum This is one of my personal favorites for the garden, a stunningly beautiful flowering vine that can grow to up to 15m. These tropical vines thrive in Thailand’s hot and humid tropical climate. They are very hardy in warm tropical climates and make perfect covers for garden walls with their colorful blooms. The fragrant blossoms of ‘the vines range from white to pink to red depending upon the age of those blossoms, all in one single plant and smell wonderful. 2. Egyptian Star Cluster or Pentas lanceolata Also known as Pentas, this tropical plant can handle the heat, because it's native to Africa, Arabia and Madagascar. Sure, they'll tolerate light shade, but they bloom most heavily when exposed to full sun. 3. Lantana. Verbena Family As a native to tropical environments, this flower prefers full sun and moist, but well-drained and slightly acidic, soil. And if simply being a truly easy-to-care-for plant doesn't convince you, this one also attracts butterflies and hummingbirds! 4. Desert Rose, or Impala Lily, Adenium Obesum Family. Originally from the Middle East, Desert Roses seem to have adapted pretty well to Thailand’s tropical monsoonal climate. These beautiful flowering perennials grow to a height of approximately 1 to 1.5 meters and have thick trunks and branches. They bloom profusely throughout the year with bright pink to red blossoms, even during Thailand’s hot and dry season. Just be a touch careful as the sap from its branches can irritate the skin. 5. Bougainvillae Native to South America, these flowering creeping and bush plants are now a common sight throughout tropical Southeast Asia, including all regions of Thailand. Bougainvilleas are very hardy and drought-resistant plants and grow profusely in warm to hot tropical climates. Bougainvilleas can grow to very large sizes, and so needs a large structure to support it. Blossoms are especially plentiful during the November-April dry season. Bougainvillea blossoms come in a variety of colors, including pink, orange, red, yellow, or shades in between. In my garden, one of the bougainvillea bushes produces flowers of multiple color in one plant! 6. Liatris Blazing Star When it comes to hardiness, these amazingly beautiful purple stalks are fierce. If you want these plants to thrive and grow between one- to five-feet-tall, plant them in full sunlight.

Legal Expose Separating the Legal Myths from the Legal Truths The author of this article has worked as a lawyer in the property sector in Koh Samui and Koh Phangnan for many years. The following article is an expose of some of the more persistent myths and false truths that the author has encountered over the years.
“My Thai wife can’t own land since she’s married to a foreigner.” Yes she can. This misconception stems from an old law which has been repealed. Until 23rd March 1999 if a Thai person married a foreigner, that Thai person gave up their right to purchase land. However, this restriction was lifted by Ministry of Interior regulations. Since that time a Thai national married to a foreigner is permitted to purchase land subject to the foreign spouse declaring that they have no ownership interest in the land. This requires that the foreign spouse sign a document stating that the land purchase was made by the Thai spouse, using the Thai spouse’s money, and for the sole benefit of ownership of the Thai spouse.

“Leasehold Villa for Sale with 65 more years to run”
A common misconception is that foreign investors can obtain a 90 year lease. In accordance with Thai law, a lease can be registered for a maximum period of 30 years. Due to this restriction, developers often structure leasehold contracts to include a registered 30-year lease term and a contractual promise to provide second and third lease terms of 30 years each. Investors are often under the misconception that the 30 + 30 + 30 lease structure is tantamount to a 90 year lease, it is not. In reality, the extensions are contractual promises, not obligations, by the current landholder to offer the additional lease terms. The reliability of the lease renewal terms will be contingent upon the robustness of the legal structure of the project.
“My company is American so I can get Amity Treaty rights to buy land” Under Thai law a foreign individual or company is typically restricted from operating with the same rights as a Thai individual or company. However, the Treaty of Amity gives American individuals and companies operating in Thailand near equal rights as Thai individuals and companies with several exceptions. The most important for purposes of real estate investment is that a company registered under the Treaty of Amity is not permitted to own land in Thailand.
“I bought land through an offshore company that owns a Thai company” An offshore company is permitted to own shares in a Thai land-owning company with certain specific limitations. Foreign investors often have misconceptions regarding the structure of a Thai land-owning company with foreign ownership. Under the Land Code foreign investors can own a minority stake (maximum 49%) in a Thai land-owning company if: (1) Thai persons or Thai Juristic persons own a majority of the shares, (2) the Thai shareholders are genuine investors, (3) the Thai shareholders outnumber the foreign shareholders, and (4) the Thai company is not foreign controlled through the auspices of a third party such as the off shore company. To put it plainly, failing to comply with any one of these requirements may result in the Thai company being deemed a foreign entity and therefore forbidden from owning land. It is strongly advised that every investor in Thai real estate consult with qualified legal counsel. Do not be fooled by what other investors have done (could be illegal) or go with a deal that’s too good to be true (probably is) make sure that you protect your investment by having a clear understanding of your rights and the best ways to protect your investment from running afoul of the law.

Property Finance & The Signature Request Overload If one may have been residing in Thailand for several years, one may have become accustomed, to signing countless documents, when attempting to apply for anything here in the land of smiles. As a foreigner, if not traveling overseas, we usually, even, have to fill in a form every 90 days just to give our updated address to the government authorities and confirm we still have a pulse. When it comes to a typical mortgage or Kai Faak Finance applications, life can be no different for both the applicant, and the lenders staff member for signatures and a paper trail. Document requests may differ from staff member to staff member, from branch to branch and from province to province for the same end product. In general, there is little continuity and “there is almost, always something” to each and every application which will be required…extra. On occasions, you may be fortunate enough to have stumbled upon the “right”, staff member to liaise with and be in luck, with the “correct moon alignment” to have things go smoothly, quickly and efficiently, without any surprises. In order to begin any property finance loan application, it is useful to let the lender have a copy of their respective application form by email, so a review can be conducted by their staff to determine, what paperwork shall be required. This may than be broken down into a few categories. Employee (Salaried Individual) This is by far the easiest of all loan applications providing, the borrower is not looking to borrow more than one could afford to repay each month.

In most cases, income of an individual can easily be verified since, will usually be paid through a standard bank account regularly which can easily be provided as evidence alongside, through personal bank statements. Self Employed Many owners of a company who tick the self-employed option, usually pay themselves little income officially, for tax purposes and often need a little help to understand what documents should be required. Most, depending on the loan size and repayment costs, usually satisfy key lenders requirements with any or all, of the following:

Letter from accountant to confirm last year’s income, position, start date 1-3 Months Payslip Business card Last Year’s company financial statements & auditors opinion, company shareholding certificate/list, 12 month company bank statements
In most cases, gross income from the company can be taken into account along with net profit rather than, the personal income of the owner. Point 4 above helps to provide the “paper trail” of where income is generated.
Retired/Investors Many retirees and investors usually fall into property, investments or pension portfolios therefore; key documents required could be any, or all of the following:

Property ownership certificate/s, rental contract/s & bank statement/s Pension & bank statement/s Investment & bank statement/s
Other areas of interest which are integral to any property finance application might include the following: Single/Married/Divorced/Separated For all property finance transactions, the relevant district land office will need to have a paperwork trail & permission where necessary, from any spouse to give consent & ID document. If for example, a borrower tells the lender they are single, borrows several million baht and then the spouse finds out later without signing previously, they can legally request the transaction to be reversed which would likely cause unnecessary complications and costs. The spouse should need to sign a lenders spouse consent to borrow &/or mortgage, plus, provide copies of marriage certificate & spouse ID/house registration/passport/s. Credit Bureau Report The lender will often be required to hold a paper trail verifying the borrower has no bad debts. On many occasion a Thailand expat will say they lived in Thailand for many years and the credit report just shows a blank page with their name and passport number at the top of a “National Credit Bureau of Thailand (NCB)” report than worry, if this is fine. The answer is yes, perfect, it shows no bad debts. The great thing about this report is that in Bangkok, they print it while you wait, for around THB 100 and a copy of your passport. Thai Company Ownership On occasions there are reasons which require Thai company ownership of property therefore, in addition to all of the above, a lender shall require sound, Thai company paperwork. This may include some or all, of the following:

Thai company registration documents & affidavit List of shareholders ID & house registration of all shareholders Company credit bureau report Last 2 years financial statements & auditors opinion
A lender is generally looking to make sure the Thai company has nothing detrimental that could affect the order of worst case scenario repossession, should the loan go into default. I.e. if the lender needs to foreclose but there is some negative equity and perhaps a shareholder gets priority to liquidate the asset over the lender, this would be no good for the lender. The second main point which a lender would wish to verify is that all shareholders are “real”. The final note on Thai company ownership is that a lender may not expect to see the income affordability of the Thai company but, rather see through the Thai company at the true owner. The affordability would then be expected to be evidenced by the personal borrower & true owner, which now can refer to earlier in the article for requirements. Signatures A lender will often ask for each and every printed page to be signed in person, by the true owner, of the specific document. i.e. Spouse needs to sign their passport, borrower need to sign their passport, bank statements etc. In addition, for company paperwork, the official company stamp/seal would be required on each and every printed company page along with the signature of the authorised company signatory. The most common “delay” in any application is for documents to be emailed, sent in the post, and dropped off without signature and sometimes, with a “photocopy” of the original signed document. It will likely need to be the actual signed original with wet ink on the paper document that needs to be submitted. Without signature, may not be approved. One final thought to consider, is that a lender might do a “Google Search” of your name and check relevant criminal databases. So perhaps after submitting the perfect pack of paperwork, a name is flagged internally, which might hinder any loan application. In summary, providing you are patient and could expect the unexpected, there is no reason why property finance could not be made with relative ease. Establish contact with those who help make a process clear, give an end to end solution for each and every possible step to come. A staff member who can provide a logical & “conveyor belt”, like process, plus point out possible anomalies in advance should be required with a breakdown of all fees, interest and related expenses immediately, within any new loan process. HOME EXTERIOR FINISHES
Most homes on Samui or Phangan are not going to be old unless you have acquired a local Thai style property. Real Estate really only started in the mid 90's, s and it wasn’t until around 2000 that things actually took off. But saying that the one small downside of property in our area is that it has to withstand some pretty harsh elements from exactly those which we crave, sun and sea. Those now “older” properties could be feeling a little tired especially if materials were used back then which although available were not of the standard we would expect. Here we have a look at ways to treat the exterior of our homes if your house is needing a pick me up. The cheapest option is to simply paint the exterior of the house using masonry paint in a neutral shade, such as off white, to help unify the different materials. Please note that here if you take the cheapest paint from the local building supply store you’re getting exactly that in Thailand and it would be wise to check prices and quality. Spending a little more will surely give you a much longer lasting finish. Rendering and repainting may be a better option if the original brickwork has been damaged. Or, if you want to give your home a brand new, contemporary appearance, cladding your home's exterior will make a dramatic difference.

Which Exterior Finish Is Right for Your Home? Start by looking at samples of your cladding choices in situ at different times of the day. Ask your supplier if they can give you new and aged samples to see how your home will look freshly clad and a few months down the line. Make sure the weight of your chosen cladding or render is suitable for your property, as some materials are heavier than others. PVCu cladding is one of the most inexpensive options. Coloured or wood-effect PVCu is comparable in price to timber boarding. Low-maintenance and easy to clean, it should last for up to 20 years. Some PVCu cladding has a cellular core that offers good thermal resistance. Laminate cladding is made by compressing impregnated paper or wood fibres and epoxy, phenolic or polypropylene resin. Durable and scratch-resistant, it can have coloured pigments added to the surface during curing, making a variety of colours and finishes possible. Virtually impervious to weather, it can also be cleaned very easily. Composite cladding is made up of stone powder and high-quality acrylic resins with pigments to add colour. Highly weather-resistant, it can be easily cleaned, moulded and fitted. Timber boarding suits contemporary and especially some Thai styled properties. Shiplap boarding has straight tongue-and-groove edges, while featheredged boarding overlaps and has irregular edges. Softwoods, such as pine or spruce, are the cheapest
option. Hardwoods, like oak, chestnut or larch, can be left to weather naturally or sealed with a fire-retardant coating. Fibre-cement weatherboarding, being a composite, is long-lasting, won’t twist or warp over time, is fire-resistant, frost-proof, comes pre-finished, needs minimal maintenance (an annual hose down will do) and won’t rust or rot. Brick slips look like solid bricks but are actually 2-2.5cm deep ‘tiles’ made from clay – either kiln-fired as preformed slips, or sawn from the face of standard clay bricks. Cladding panels with a brick finish and interlocking prefabricated boards are also available. Stone tiles are of a similar construction to brick slips and are split from genuine stone. They are ideal for a more traditional look, offering a cost-effective and lightweight alternative to building with natural stone. Metal is an expensive option but is low-maintenance and weather-resistant. It can come painted, powder-coated, pre-aged or coated to preserve its finish. Steel is the most affordable and should last at least 30 years; lightweight aluminium is good for 40; untreated zinc weathers to look like lead and should last 50 years; copper develops a verdigris finish and should have a lifespan of 100 years. Masonry paint is a cheap and fast way to cover an ugly exterior. Textured finishes are particularly good for hiding minor cracks. It can hide poor-quality or mismatched brickwork on period properties and create a sleek finish on modern homes.

Pariah Dog Koh Samui
"Saving One Dog Won’t Save The World. But It Will Change the World for That One Dog."
Satayu Publishing’s team recently took part in the Spartan Race Challenge to raise money and awareness for the Pariah Dog Centre on Koh Samui. Pariah Dog was founded on the 1st July 2016 on Koh Samui by Dr. Vet. Elena Kireeva from Moscow, Russia & Stefan König from Basle, Switzerland. Animal Rescue Centre’s are numerous now across Thailand and all doing an amazing job with generally very little resources. Our team spent a day at Pariah Dog as volunteers, helping out with the dogs, playing and socializing with them.

Stefan and his team are doing an incredible job and their target is to sterilize five dogs per day on Koh Samui. They already are by 125 Dogs & 10 Cats, so you can see not only how dedicated these people are but how much they are making a difference. If for example half these dogs were female it would not be exaggerating to say that they could have easily breed to 1000 puppies just in two or three seasons. Thailand has a street dog problem and that includes cats too, and it is only through Rescue Centre’s such as Pariah Dog that with love and care these dogs are being treated for disease and accidents and sterilized.

Pariah Dog is on a large piece of land that is dedicated to sheltering these animals. There is a clinic section plus a consultation room and a surgery room for the ill and dogs waiting to receive operations or those in recovery. Pariah Dog has the full cooperation from SDF Phuket, PACS Koh Phangan and the Snake Rescue Koh Samui. Each of the dogs here has their own story and each has a name, they are Stefan’s children, and he has rescued them from the streets and has taken them in as they cannot survive alone. Here we have two wonderful examples, you have Uncle Louie, who has a wheelchair but is the dog that takes care of all of the puppies, he is a strong character and the happiest dog I have seen in all my years. Then you have Brownie, who had his leg crushed in an accident, and had an operation in Phuket to amputate his leg and to ensure no disease and infection spread. That is just two examples of the 125 Dogs & 10 Cats at Pariah Dog Koh Samui. Stefan asks for people to kindly donate money for food, for sterilization, for operations (injured dogs) and also adoption to forever homes and has had quite a few of his dogs taken overseas to forever homes. As mentioned they all have a story and he has given them all the opportunity to live.

Greenheights 138 Opening Party On Friday 18.05 there was the grand opening party for Greenheights138 luxury condominium, at the Beach Resort in Bangrak, with Cooperation of the Greenheights138 condominium owner and RE/MAX Island Real Estate (Koh Samui). Greenhieghts138 luxury condominium is set to be one of the most luxurious Condominiums on Koh Samui, built with to the highest standards and with an amazing sea view, looking north, with a full view of Koh Phangan. This was one of a kind luxury party, that was never seen in Samui before. With guests from the Island and guests from Bangkok, real estate agents, lawyers, bankers, investors and developers, including a special guest Samui Mayor, dressed up with mostly suits for men and evening dresses for the women, with a red carpet and pots with green trees all the way from the entrance to the stage on the beach. Decoration included, except from the red carpet that covered all the floor, special flowers designed, lighting effects and a big wall with pictures of the new Condominium. Champagne, wine and every cocktail imageable were served at the bar, with specially crafted food at the table nearby. The large stage had a band that played jazz and later singers, and a great time and lots of fun was had by all.

Bangkok Airways Samui Half Marathon 2018 Bangkok Airways Samui Half-Marathon is third event out of seven planned programs of the Bangkok Airways Boutique Series 2018. Damn Those Dimmers
Many houses and condos built in Thailand in the past two decades have dimmable lights. It is a nifty feature to be able to dim the chandelier over your dining table or dim the lights in the living room when watching a movie. And upscale Thai housing seems to have dimmers virtually everywhere including the bathroom... Although it can be nice to dim the lights based on the time of day and for setting the mood, it does have some serious drawbacks when you are upgrading your lights to LEDs.
Save money on LEDs
It is hopefully well-known that there are considerable savings to be reaped by changing to LEDs. Even the old “Energy Saving Lights”, also known as CFLs, as well as fluorescent lights use way more energy than LEDs. As neither of these lights can be dimmed, we will ignore those for now. halogens and the old-fashioned light bulbs from our childhood can be dimmed, though, and exchanging this type of lights with LEDs will lead to considerable savings, both in outright energy saving as well as in purchase cost of the bulbs over the years, as LEDs will outlast halogen and ordinary light bulbs by at least a factor of 10. If it is an ordinary old-style light bulb, you can just change it to an LED. If it is a halogen, you have to check whether it is a 12V halogen, or a 220V halogen – it will be printed on the bulb whatever type it is, but DO check, or you are in for a nasty surprise (a bang, a smell of burnt plastic and a tripped circuit breaker) if you replace it with an LED with the wrong voltage. However, if the existing light bulb is connected to a rotary-knob dimmer-switch like the 500W Panasonic dimmer pictured in this article, an ordinary LED will not work. First of all, the standard LEDs that you get at the home depot are not dimmable at all – only special LEDs by for instance SEGULA are dimmable, and they are a fair bit more expensive than the ordinary household LEDs. Although some brands have begun marketing dimmable LEDs, most are of inferior quality either in power consumption, colour, colour rendition or lifespan, so consult a specialist if you need dimmable LEDs. Also, your standard dimmer-switch won't work, and you will have to replace it with a modern dimmer. There are two reasons why that is: Firstly, the old-type dimmer-switches that were used for halogen and old style lightbulbs were so-called resistance dimmers; that is, they simply work as a “sliding” resistance that has been inserted between the wires and the bulb, restricting how much power the lights would get .

Dimmable LEDs usually don't work well with resistance-dimmers – the LEDs will either not work at all, will only work when the dimmer is set to no dimming at all, or it may cause the LEDs to flicker, and because of the construction of the dimmer it will cause the LED to overheat and burn it out in no time. This will waste your money, and potentially be hazardous. Secondly, the old-fashioned resistance-dimmers will be constructed to work up to, for instance, 500 Watts. This means that you can have lights using a total of 500 Watts connected to the particular dimmer. However, if you connect LESS than about 1/4 of the rated Watts on that particular dimmer, it won't work either – even ordinary light bulbs would start flicker, and burn out too quickly as the light bulbs would be “fed” too many Watts to handle. If you used to have, say, 8 halogen spots of 50 Watts, that would have been perfectly alright as 8 x 50 Watts = 400 Watts is well within the range of the 500 Watt dimmer. But if you exchange those with 8 x 4W LEDs, then you have a problem. 32 Watts is way below the threshold, and the dimmer won't even be able to register the lights. At best, the LED bulbs will flicker with a very weak light; at worst the LEDs and the dimmer switch will be fried, and hopefully your circuit breaker trips before the smell of burning plastic becomes overwhelming. Beware – your local electrician or handyman will probably say “no problem”, but do not listen: He is wrong!
LED Dimmers
So what do you do? You want to save money and exchange those wasteful halogen spots, but your old dimmer won't work? First question should be: Do I NEED a dimmer for that particular place in your house? Unless the answer is an unequivocal YES, then install an ordinary switch instead of a dimmer. If you always set your dimmer at, say 2/3 resistance, then you just have to find an LED that has the right Lumens (brightness) for your need. A proper lighting expert can easily find a light bulb that gives you the exact brightness and colour that you are looking for. An ordinary switch is less than 50 baht vs. minimum 500 baht for an LED dimmer, so it is well worth saving that money unless you really need the dimmability. However, if you DO need to dim those lights, you will need a modern phase-shifting dimmer. These are electronic dimmers, so they may either have buttons such as the rather fancy one depicted here (which ordinary dimmers would never have) or they may have a rotary knob like an old-fashioned dimmer. Also, it will say so specifically on the dimmer if it is usable for LEDs, as you can see on the Panasonic Dimmer on this page. The two Panasonic dimmers are virtually identical, except for the writing that says “LED Max 50 W” on one, and “500W” on the other. If it doesn't say “LED Dimmer”, it is because it is NOT an LED dimmer. Again, be careful when your handyman comes back with a surprisingly cheap dimmer and claims to have saved you money – he will have brought you the wrong kind! So check carefully. Despite the higher initial cost for changing the dimmer, it is still well worthwhile to change those halogen spots or dimmable Edison light bulbs to LEDs – the 500 baht or so for a new dimmer is paid back within the first year just in energy savings. I would recommend, however, that you order your LED-dimmer from a lighting specialists, such as Anubis Consult (www.anubisconsult.com), and let your handyman or local electrician do the installation. It will save you a lot of grief in the long run.

Within an area of approximately 167km2 with over 70% being unspoilt mountainous and tropical forest many more temples are nestled coherently within the islands natural flora and fauna offering a feast for the eyes of all visitors. Koh Phangan being relatively undiscovered and undeveloped still has the postcard perfect secluded deserted beach coves awaiting discovery via the traditional mode of transport, the long tail boat or for the more intrepid explorer by hike. You truly feel that you are the first to leave a footprint! In that vein Koh Phangan's beauty is emerging as an attractive destination for weddings and events. Due to Koh Phangan's granite structure, there are several small mountains where it's possible to trek/hike. The highest being Khao Raa at over 600m above sea level taking 2-3 hours to realise the summit. There is a bounty of wildlife from monkeys, wild boar, exotic reptiles to stunning birds of paradise not forgetting the spectacular coral reefs that envelop the plentiful bays where the amazing underwater world is accessible for snorkelers and divers equally.

LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain
RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.
RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.
LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.
GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.
SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.
SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.
LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)
STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area.
STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey
building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.
STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.
STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.
In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
