EDITOR'S LETTER It’s all about Quality of Life. Looking out now at the glorious weather and the crystal blue shimmer of the sunlight on the ocean it seems hard to remember the rain and flooding that we all had to bear only a short while ago. I was then thinking of how bad it got in our home towns. UK and Europe hit by snow storms this year and freezing weather. A friend from Canada was saying they had temperatures of minus 30° celsius. So, I thought I would put a positive list together of points towards increasing your quality of life in Thailand, especially in Samui. I won’t say that any place in the world is perfect. There are always certain changes and compromises we must make to create a better situation for ourselves. But here are some of the benefits, sun and fresh air. Do I really need to explain this?! Amazing food! There’s a world of difference between a fruit that grows on a tree and is picked hours before you eat it, and a fruit that is picked too early, shipped over long distances and sold to you for ridiculous money. In Thailand, you can eat delicious, cheap, quality, tree-ripened fruits and vegetables, and avoid genetically-engineered foods, hotwater treated mangoes and tasteless, imported produce. Less stress, you can reduce stress radically by relocating here at least part of the year. Samui, where the pace of living is slower, more relaxed and where people value real friendship and relaxation over the constant desire to work, work and consume. New Culture, you can find interest and growth by living together with a different culture and become enriched by it. Save money, living a life in the tropics is still a much better bargain than freezing in an expensive European home. You could wake up in the morning, listen to tropical birds singing outside from your window, go pick your own fruits or buy inexpensive, super fresh produce at the local market. You could swim in pristine, turquoise waters, feel the breeze and the sun nourish your body, and yet live in close distance to all the modern amenities you’re used to. On Samui you will not miss out on anything except the cold. You can walk at night in the neighbourhood and feel safe, Thailand is still a very safe place to be. In Samui, you can hire a local person for less than Euro 200 per month to work in your house several hours a day, to prepare all your healthy meals and take care of all your household chores and leave you time to enjoy life. So, if you’re here already I’m preaching to the converted but those of you enjoying your time here maybe it’s something to think about. I did 24 years ago and have never looked back. One wonderful thing about living in the tropics is that almost every day you can spend outside. There is nothing better than relaxing early evening in your garden or on the terrace and listening to the waves lapping at the shore or the sounds of the jungle. That is until the sound changes to that quiet but awfully distinct hum of a mosquito. How can it be that one such tiny insect can ruin an evening, and I’ve not even gone into the diseases that they can spread. Look, mosquitoes are awful. They fly around searching for animals or people, to bite and suck your blood. They may be great food for birds and bats, but you don’t want them flying around your garden or terrace. You also don’t want to spray yourself in harsh chemical poisons dubbed as mosquito repellents. So, aside from making your outdoor living areas less friendly to the larvae by getting rid of any standing water, what else can we do to keep these little buggers away.

Mosquitoes are attracted to certain odours. They’re especially attracted to certain body odours and even perfumes or deodorant. There are a few plants with strong scents that we find pleasing, which you can use to help mask your own smell and keep nearby mosquitoes at bay. The aroma needs to be in the air around you, at the very least, and ideally on your skin. To get the maximum effect of these natural mosquito repellents, crush herb leaves in your hands to release their perfume and essential oils, and then rub the leaves and their oils over your skin. By including these plants in your garden, you can reduce your dependence on deet sprays and high chemical citronella candles. Lemon Balm Has a lemony aroma and flavour and is a natural insect repellent. Crush the fresh leaves and rub them directly on your skin, especially around the ankles, arms and other areas most exposed and vulnerable to bites. The lemon scent, which repels, is very strong. It rubs off very well onto skin. You can just sort of crush the leaf up a bit, and then use the leaf like a wipe. Lemon balm happily thrives in the sun or partial shade, and should be kept in moist, well-drained soil. This member of the mint family has white flowers, as well as some healing properties, but it’s also an invasive species, so be careful when growing it in your garden. It does well if you plant it in a pot on your patio, or other outdoor areas. Catnip This fragrant mint cousin contains a natural chemical called nepetalactone, catnip may be even more effective at repelling mosquitoes than DEET, the poisonous ingredient used in most repellents. It also repels roaches, a characteristic that many of us living in town or city areas will certainly appreciate. It can be used similarly to lemon balm; crushed and rubbed onto the skin. A word of caution to cat owners: watch where you plant your catnip! Your cat may want to roll around on it and play with it. Plant catnip apart from the rest of your garden so your cat doesn’t accidentally damage any other plants nearby. Basil A study showed that the essential oil from this essential part of indoor herb gardens is toxic to mosquito larvae. Grow this amazing plant around any natural water sources, such as a pond, to help control the rate of eggs being laid. Lavender Lavender scent will repel flying insects like mosquitoes, moths, and flies. The flower’s perfume is well-known, and while it will scent the air, it’s most effective way to control insects is by rubbing the plant on your skin to release the oils. Marigolds In addition to mosquitoes, marigolds repel other garden pests, too! Marigolds growing in the garden will help to keep the bugs away from your vegetables. The flowers are edible as well, and add colour and flavour to salads or can be a gorgeous garnish when you want to dress up a dish. Peppermint In its concentrated form, peppermint is sometimes used as an insect repellent, and its oil has been shown to repel the adults and kill the larvae and eggs. Citrosum (aka Mosquito Plant) This perennial is often sold as the “mosquito plant,” and sometimes referred to as the citronella plant primarily due to its strong citronella scent. Quite the original for bug repelling, with a powerful lemony scent. Unfortunately, though it’s the most heavily marketed, there’s some research that suggests it’s also the least effective garden plant at mosquito control and it’s a grass-like plant that can grow up to 6 feet tall. Still, there are some benefits to be had from rubbing the crushed leaves on your skin, and if there’s nothing else around, it will provide some protection. Sage + Rosemary If you’re planning to gather around a BBQ or open fire, try burning a little sage or rosemary. The incense these plants give off when they burn not only smells good but is unpleasant enough to most species of insects that it’ll repel them—if you’re near the smoke.

Philip Johnson’s Glass House People who live in glass houses shouldn't throw stones The Oxford English dictionary explanation is that you should not criticize other people for bad qualities in their character that you have yourself. Mr. Johnson himself was always a very provocative architect, praised for a handful of brilliant projects and for his influential role as a curator and mentor, and despised for his determination and for work that some considered shallow and copied. He loved attention and cultivated his personality, holding court daily in Manhattan at a reserved table at the Four Seasons restaurant, which he himself had designed in 1958. Beginning in the mid-1940s, with his purchase of a five-acre plot, Mr. Johnson assembled what would become a 47-acre estate with 14 buildings and follies, old and new, including a brick guest house, a library and painting and sculpture galleries. Philip Johnson’s Glass House, built atop a dramatic hill is a piece of architecture famous the world over not for what it includes, but for what it leaves out. The dwelling’s transparency and merciless economy are meant to challenge every conventional definition of social home life. The residence Johnson built for himself in 1949 suggests a life trimmed down to essentials—and gloriously ready for critical examination. There is something intimidating to people about the restraint such an existence would demand, as if the house itself were silently judging our own bad choices. Still, the charm of all that self-control, that meticulousness, is practically narcotic. Why not banish every bit of clutter?

Its design is simple: an open plan interrupted only by a circular brick bathroom, a kitchen concealed under a sleek walnut folding bar, and ventilation provided by floor-to-ceiling doors on all sides that can be opened to the four winds. Although Mr. Johnson and his partner Mr. Whitney, an art curator, were avid collectors, only two artworks are on display: a statue by Elie Nadelman and a painting attributed to the 17th-century artist Nicolas Poussin, on a two-legged stand in the middle of the space.
“I don’t think clutter was allowed,” said the painter Jasper Johns, a friend of both men. “One was always aware of their ruthless elegance.” Johnson died on January 25, 2005, at age 98. In 2007, The National Trust for Historic Preservation (to whom Johnson donated the Glass House in 1986) opened the residence to the public and more information and opening times can be found on

Issues for Homeowners to bear in mind for Peace of Mind in Paradise
For the most part, investors who acquire an interest in real estate in Koh Samui and Koh Phangnan tend to be retirees or soon to be retirees who, having worked hard all their lives, are finally realizing a life-long dream of retiring in paradise. Many retirees and other foreign residents may already have put their affairs in order “back home” by making a will in relation to assets in their home country before relocating to Thailand, however, many foreign residents neglect to declare a will in relation to their assets located in Thailand. The existence of a will can help to ensure that the assets of the deceased are distributed in accordance with the wishes of the deceased and avoid leaving the surviving relatives with the burden of lengthy, expensive and costly court proceedings on the other side of the world. This article examines Thai wills and how they can assist foreign residents in estate planning. The first issue to be determined by a person seeking to make a will is what (national) laws govern the transfer of the individual’s assets in the event of death. The answer depends upon the nature of the assets

which form the estate. The devolution of immoveable property such as freehold condominiums and villas is governed by the laws of the country in which the immoveable property is located. Conversely, the transfer of movable property such as jewellery and furniture is governed by the laws of the country in which the deceased was domiciled at the time of death. It is important to recognise that if an individual owns an interest in real estate through ownership of shares in a limited company, the asset which will form the subject matter of the will are the shares in the limited company and not the real estate assets themselves. Shares in limited companies are deemed to be moveable property and not immoveable property. A Thai will is strongly recommended if land and buildings located in Thailand form part of the estate. A Thai will relating to moveable property is also prudent estate planning, particularly if the moveable property in question is shares in a limited company which owns an interest in real estate.
Investors who have acquired an interest in real estate in Thailand through the acquisition of shares in an offshore company such as a British Virgin Island Business Corporation (BVI) will require a will to be drafted in accordance with the laws of the jurisdiction in which the offshore corporation is legally registered. Therefore, it is advisable to consult a lawyer from the jurisdiction in which offshore company is registered to prepare the will. A Thai will must meet several specific requirements set out in the Civil and Commercial Code of Thailand for the will to be valid. Thai law sets out three general categories of valid wills, as follows: (1) A will made by way of a declaration to a public official in the presence of at least two witnesses; (2) A fully handwritten will signed and dated by the individual declaring the will; or (3) A written will signed and dated by the person declaring the will in the presence of at least two witnesses; It is important for investors with a leasehold interest in property to be aware that a lease agreement is generally terminated upon the death of the leaseholder and any unexpired term of the lease may not transfer to the heirs of the leaseholder unless there is a suitable succession clause contained in the lease agreement allowing the succession of the leasehold right to the heirs. The terms of the will should be comprehensive and should cover all the person’s assets to ensure that the person is not partially intestate at the time of death. It is important that a “second” will covering assets in Thailand does not conflict with or revoke the terms of the “main” will in the person’s home jurisdiction. The will should be updated intermittently as the assets forming the subject matter of the will change over time. If there is no Thai will, the assets of the deceased must be distributed to the “Statutory Heirs” in accordance with Article 1629 of the Civil and Commercial Code. The surviving spouse of the deceased is entitled to half of the estate, thereafter the assets are distributed to six classes of statutory heir in the following order of priority (1) descendents; (2) parents; (3) brothers and sisters of full blood; (4) brothers and sisters of half-blood; (56) grandmothers and grandfathers; (6) uncles and aunts. If there are no living relatives, and no Thai will the estate will succeed to the state. It is important for retirees and other foreign residents to consider estate planning issues and make provision for the succession of their assets in the event of death. A professionally prepared, valid and enforceable will can provide retirees and foreign residents with assurance that their affairs are in order and that their loved ones will not be unnecessarily burdened with stressful and lengthy court proceedings and costs in the event of death.

Condo Finance using a Foreign Exchange Transaction Form
2017 now marks an 8-year anniversary for living here in Thailand and over the years of lending to foreigners & locals using Thai property / land as collateral, there has been various challenges and obstacles which needed to be overcome. No matter how many applications have been processed, there is “always something” on each case. One of the most common items for discussion on each foreigner condo finance application is the Foreign Exchange Transaction Form (FET, FETF) or what may otherwise be known as the Tor Tor 3 (“Tor Tor Sam” is how spoken in Thai). Purchasing of condominiums in Thailand is a relatively straightforward process as Thai laws do allow foreign buyers to own condominiums freehold, this is however the one limitation. Buyers of a condominium unit, in addition to the unit itself will receive a percentage share of the common property area, which will include the land on which the condominium sits. Since foreigners in general are not permitted to own land, the ratio of foreign ownership in a building will be limited to maximum 49% thus leaving the other 51% for Thai ownership. It is worth to note that the 49% is calculated on the total private sellable area and not the number of units, which is occasionally thought. A condominiums juristic person office should be able to confirm Foreign vs. Thai ratio levels if you are looking to buy an older already completed building under foreign ownership.
Now that a foreigner ownership unit has been found within a condo and that the unit is within the 49% quota, foreign buyers must fulfill the following 2 requirements: • Ability to enter Thailand legally. • Show proof that funds used to purchase the condominium were remitted from overseas in foreign currency. As the first requirement is usually ticked off quite easily, the focus shifts to the second requirement and this has proved the missing piece of jigsaw on occasions which can crop up last minute which may ultimately stop the finance of a condominium at the land office. This is the big 1 limitation. When transferring money in from overseas to satisfy the number 2 requirement, you should generally abide by the following: • Must be of an amount at-least equal to what will be, the registered purchase price at the land office. • Remitted from overseas or, brought into Thailand and Exchanged in Thailand. • Either be “From”, a bank in the name of the foreign buyer or, be transferred “To”, an account in the name of the foreign buyer. It is worth to note that if a foreigner is going to have a co-ownership with a Thai person, the full registered purchase price may not be required for exchange, as half may be registered under the Thai share of ownership. The document, which is than used at the land office to evidence a currency exchange, is the Foreign Exchange Transaction Form (FET). This official document/ letter or, form, is obtained from Thai banks and will evidence to the land office an exchange of currency has taken place in order to satisfy the number 2 requirement above. On occasions, particularly when clients have made transfers into their own Thai bank accounts, the assumption is that it is easy to pick up and print off…. From experience, I would suggest going into a bank as early on in the purchase process as possible, to check what can be done. Firstly there is almost always a language barrier and when finally you may have an understanding, it can sometimes take several days or even worse weeks, to have the bank produce the required paperwork. For small transactions, a letter by the bank rather than FET form can be produced, to verify all foreign deposits, which may also take time, depending on how many deposits have been made and over how long. If you are looking to finance a condominium, this is possible, though all relevant FET paperwork for the registered purchase price at the land office should be available to show the land officer, the lender would not always provide this paperwork. Sometimes this is thought that it can easily be obtained though on occasions, has proved the downfall of a finance case since cannot be produced and thus the land
office would not allow a transfer of title into foreign ownership before it is than possible to register a mortgage and complete the deal. i.e. A lender is not going to hand over a cheque to anyone unless, they can register a mortgage with the borrower on the back of the title deed. The land office will however not transfer the title deed into the borrower name (so the lender can register a mortgage) unless there is the FET paperwork available. This is what often makes refinance of Thai property a more viable option since there will be no late in the day surprises. If the title deed is already registered in the foreigner name than the land office has already been satisfied of FET requirements and is as easy as 1,2,3 to provide cash back. A lender may also often prefer to refinance, since also shows that the ability to purchase a condo was there in the first place, so there should be a reasonable level of risk to loan no more than 60% of the condo’s registered value and would also be likely there should be a reasonable level of income to service a mortgage by the borrower. Mortgage options available, usually come with around 8.5/6% interest per annum, up to 10 year term and with a 50% balloon payment option that could be renewed for a further 10 years thus making in a way, a 20 year loan term. Up to age 70 years or even longer is available, when there is a co-borrower to support the loan application and bring the average age down. Monthly installments are as low as THB10,500 for every THB1,000,000 borrowed. Loft
Furniture Designs Most of us while buying a home rarely take into consideration the loft space. Your loft space can represent up to one third of your total house floor area, so putting it to good use a makes good sense. When deciding what to do with your loft space, there are two possible routes to go down: either a full conversion of the space, or – instead – opting for a loft storage room. While both may sound similar, they are in fact extremely different in function and build effort required. The idea of loft living has become appealing and desirable to increasing number of people, worldwide. To begin with, what really is a loft? The standard English dictionary defines it as “a large, usually un-partitioned floor over a factory, warehouse, or other industrial space.” It is indeed like a large studio, with no separation between rooms. Sometimes, there is an extra floor or sleeping area on top of the room, to maximize space, rather than an extra room on the side. The lack of walls and other types of dividers makes it trickier to create separate spaces, such as the kitchen area, dining area, living area, etc. within a large room. A good way to separate areas in your loft space is to use furniture as dividers. For instance, you can separate an open kitchen and living area by using a high kitchen table or “bar” and stools.

Carpeting or different floor finishes can also help distinguish different areas. The entertainment area can have a different floor finish or carpet than the kitchen area. Rugs can be strategically placed to designate certain areas. For example, a rectangular rug can be placed to mark the hallway entrance. Or a rug can be placed diagonally to lead from one room into another, or it can simply be placed in the middle of an area, with furniture surrounding it to designate it as the living room. Painting one side of the walls of a room one colour, and the other side a different, can also help differentiate between the two. For example, in one space, the left wall can be painted a pale yellow to mark it as the kitchen, whereas the entertainment area can be painted cream or whatever colour one wishes. The type of furniture you use is just as important as how you arrange it all inside a loft. For instance, ottomans and longer, winding couches with extended chaise loungers not only maximize space, but can help corner off an area. Potted plants can also be strategically placed to fill in little gaps or areas that need a bit of separating. Bookshelves and even beds can be pulled out of the walls and can be tucked away during the day, so that the area can be used for something else.

It is also wise to think about what the focal point of such a large space should be. Preferably, it should be the most social area of a home–the living room. Shrewdly, this also makes more sense, since the bedroom area cannot be in the middle or very beginning of the space, unless it can be pulled back into the wall. Lastly, installing a large, unusual, and dramatic piece in the centre of the living area or large loft space, can really serve as the focal point of the entire space, and can ultimately help to balance out the space. It does seem that Paradise Pool Interiors are making quite an impact on our beautiful island and have certainly raised the bar in pool finishing’s with their PebbleTec® product. Samui Phangan Real Estate Magazine wanted to find out a little more and met up with Lewis Jones from Paradise Pool Interiors. We know you are always super busy Lewis so thank you for taking the time to talk to us. Let’s start at the beginning, when did you first start visiting Thailand and why have you picked Koh Samui as your base? Hi, and thank you for having me. I first started visiting Koh Samui around 2005, when my friends and I used to head out once a year for a holiday. Being very fond of the island and my favourite location in Thailand I decided to invest in property here four years ago when I had my villa built in Lipanoi firstly for the rental market but eventually, hopefully my future home. Having Samui as my base seemed sensible as I already had some contacts within the construction industry here and because the amount of development taking place on the island.

What advantages would you say Samui has over other Islands in Thailand? I originally looked at starting in Phuket, but after further research, I felt it seemed a little tired compared to Samui. Koh Samui had very few pool construction and finishing specialists here too and when I made the decision to start a business here, it was evident to me that not only did Samui have a thriving, new development market but also a large refurbishment market, so my thinking was the same as my approach in the UK, if the market does drop or slowdown, which can happen from time to time, the work is still potentially there within the renovation market, hopefully keeping us busy all year round.
When did you start with Paradise Pool Interiors? I started the company around 3 years ago, this was not long after I bought the licence to install and re-sell the PebbleTec® product exclusively here in Thailand. I was still living in the UK working full time as a builder there and travelling around Europe working on pools for the parent company Euro PebbleTec® at this point. Then decided to move over full time early 2015 with my wife to really push things forward. Now from the magazine we obviously have heard about the PebbleTec® product that you are now using in pool finishing’s, could you explain to our readers what this is and why it seems to be taking off so well? Paradise Pool Interiors specialise in the finishing of the pool interior with our product, PebbleTec® which we have the license for here in Thailand. But we also cover all aspects of the pool construction, system and pump room hydraulics from the ground up, and at design stage anything is possible and can achieve whatever the client desires, we offer the latest in construction methods and pool chlorination systems to provide for and work closely with the customer with all the options they would need to make an informed choice. The only two things we restrict ourselves from doing is tiled and liner pools as they can be problematic, so we leave this to the other guys! We see PebbleTec® and its range of products as not only a stunning and superior alternative for our clients, but as a solution to the constant battle with re-grouting and replacing of tiles that pools here in Thailand suffer from, let alone how much the longer the pool will last. If I was a client with an older pool what advantages would I have using PebbleTec®? There is a huge refurbishment and renovation market here on Samui as I am sure your aware many and of the pools here are suffering in some way or another. This can be for several reasons but mainly due to the issues with water chemistry causing damage to the finish as unlike other climates, I think we can agree that Thailand in general has a more intense weather climate than that of say Europe or the USA. Swimming pools are usually the jewel in the crown for a lot of people’s property and something that usually looks tired and in need of attention a lot quicker than the house or villa itself. Due to the nature of the PebbleTec® products application and speedy installation, Paradise Pool Interiors can complete private residential refurbishments on swimming pools in under a week, with no real issue with size of the pool, this always includes the breaking out or stripping of old existing finish, preparation and repair to the pool shell and of course the application and finishing process. PebbleTec® and its products ARE by far the most durable, reliable and longest lasting pool finishes on the market and will put up with any chemicals the pool will throw at it, whilst not compromising at all on its aesthetic appeal.
Does it come with a guarantee? Yes, all work completed by ourselves is guaranteed for 5 years as we are required to do this under our license agreement with the parent company Euro PebbleTec®, the product also carries a genuine 5-year international warranty, supplied by the manufacturer in Australia. So, clients can feel extremely secure and comfortable with us when choosing to use pebble as their finish for the pool. Do you have a showcase pool that has been finished with PebbleTec®? Yes, we have a total of 13 pools completed here on Koh Samui and one that we did on Koh Tao too, the more popular ones we have completed to date is the pool at the very well-known Jungle Club resort in the mountain near Chaweng Noi and our more recent projects on the new Horizon Residence Condominium complex in Cheong Mon. We are always happy to take any potential customers to any of our completed pools by appointment and explain to them the processes and provide them with samples and brochures. Can any pool company offer PebbleTec®? We are the sole licensed applicator exclusive to the whole of Thailand for the PebbleTec® company. Anybody else offering the same would be incorrect, imitating or using low quality stones and pebbles, nothing to do with our brand. The thing that makes us unique is the aggregate used which is tiny quartz pebbles which are only distributed to the network of official licensed applicators around the world, this along with the way that we apply it onto the pool make it impossible for another company to imitate or offer the same. You always seem to have the most innovative products at Paradise Pool Interiors, do you have something new for our readers? We do indeed, we are currently working on samples incorporating the use of different coloured glass beads into our pebble compound to add a ‘bling’ element and an extra dimension to what we can offer as part of our service, we think that this should be available to order by the second quarter of this year as we will have the supply in by then, this will be marketed as Beadcrete and will carry all the same guarantees and warranties as our other products. Large racks of pork and lamb will be found hanging and sizzling around the BBQ which is fueled by local coconut husks giving that food the extra special aroma. Everything is prepared in house and that includes the BBQ and delicatessen, and desserts of course homemade. The menu evolves with the seasons and the dishes are always prepared with fresh products and carefully selected, for authentic flavors and the recipes of yesteryear gastronomy. Our recommendations on trying are the starter: bruchette and rillettes (pork that is cooked for a very long time, almost like a terrine), ham pate, pickles and a fresh tomatoe mix. Then not to be missed is the BBQ Pig Oven main course, barbecued Leg of Pork and Roast Lamb barbecued, both served French style- rare and served with heavenly homemade sauces: Béarnaise or ketchup. Sides are corn on the cob, a baked potato with sour cream, shallot, mint, pepper and paprika sauce and daily side dishes depending on the seasons and the fresh market, corn, tomatoes and provencales ratatouille. This « duo » is only 590 Baht. They do a full set course (starter, main dishes, French cheeses, homemade dessert and French wine) for 10 persons’ min (at 990 Baht per person). With an (not surprising) excellent selection of French wines, Le Cochon Qui Fume will cater also for villas and private functions at the restaurant for a minimum of 25 people and for those in a rush take away is also available.

20th Anniversary 2017 Sisters on Samui 1997 – Was the year that a group of expat ladies decided to get together for a monthly lunch in different venues around the tropical Island of Koh Samui. It didn’t take long for them to start thinking outside of the box and talking about what they could “give back” to this beautiful paradise so many of us have come to love and cherish. We started with supporting local schools and local charities that are based here on the island and over the years have undertaken many projects. Women’s Samui Prison We built them a mother and baby area for the ladies that give birth in prison, we also had help from another charity overseas SFAM (Sisters From Another Mother) based in Australia that helped to set up their bakery section. Buying sewing machines, materials and offering tuition in many areas. These projects offer the ladies work experience giving them the potential to improve their opportunities in life once released. The prison is run by a fabulous man that has done so much for the prison that he has been commended for his work in Bangkok by the Queen.

Samui Rescue The volunteers that dedicate their time and efforts for this are amazing and the work that they do for this island is something all of us should be truly grateful for. Last year we donated 60,000 THB which helped them to buy body braces, radio systems, Hi-Vis jackets and other much needed equipment to keep volunteers safe and provide valuable assistance for immediate care for people on the roads of Samui, which we all know can be a crazy place. Nathon Government Hospital In the Maternity Unit, we have bought much needed equipment over the years; an incubator for premature babies, oximeters and surgical lighting. This year we are dedicating our efforts and love into “cheering up” the Children’s Ward. Studies prove that correlation between colour and psychological functioning is healing. So, the order of the day for our next project is bright murals, funky curtains and a little bit of sunshine providing a more balanced and soothing environment for the kids.
Special Needs School We have provided funds and support for the building of the first designated Special Needs School on the island, ideally suited to the education of the wonderful children that attend the school. Dog & Cat rescue centres on the island, run by Brigitte and Elfe, two wonderful establishments are doing a commendable job, but the selfless love of these 2 ladies and their staff is magnificent. We have made regular donations over the years whether it be for vaccines, food or medicine; the dogs and cats appreciate it immensely. Temple schools throughout Samui. Many Temple and National Schools have become close to our hearts, purchasing classroom equipment and educational tools. The original head of S.O.S Sue Holehouse, retired from the S.O.S 4 ½ years ago and asked the ladies to carry on the good work, as she wanted this fantastic institution that she had lovingly run and their monthly meet ups to continue. Enter Yvonne Roberts; who has travelled and lived in many places around the world, property manager, teacher and a wonderful artist with Juliette Burrows; wedding planner, mum, and amazingly creative cake maker. Both from the UK, neither ladies were aware of Sue’s plan that they were to take over the role (both had agreed such a task was too much for one person), hence the lovely Sue decided to create a dual presidency. Unbeknown both ladies met Sue and gladly agreed to unite to continue together and that S.O.S will forever be a part of the island.
Without the support and love from the community of Koh Samui the ladies would not have had such a wonderful venue each much month to gather and raise funds for charity. Hotels and restaurants offer a charitable price of 500 Baht per person! I mean, who gets to eat a stunning 3-course meal in some of the best places on the island for that price? Well we do as ladies of S.O.S, that’s who, and we are forever grateful. This year we started the year off with a fantastic lunch at The Beach Club Shiva Samui in Laem Set followed by The Coast Beach Club and Bistro in Chaweng and then Squires Loft in Bophut. With over 300 ladies on the mailing list from all walks of life and all areas of the globe, we are truly an international group, just trying to make a little bit of a difference in a crazy world. Rotary President Elect Alex Starkey a resident of Koh Samui for over 17 years has just been elected as President elect for the Koh Samui Rotary club. Alex got involved with the club in early 2016 while planning and hosting the Charity Sailing Regatta. The event, which was a great success, raised funds to re-launch the children’s sailing club and also complete needed works at the Special needs school. Alex has become a keen participant in the clubs community projects, Kids weekend and fund raising efforts. He has just returned from a weekend in Ayutthaya where he attended the President Elect conference along with all of the other future presidents of Thailand. Alex learnt many things that he hopes to introduce to his term as President to help make Samui’s Rotary club even stronger for the future. The clubs current projects include a “water for life” project at Wat Lamai School and house building project to help families who lost their homes during this high seasons terrible floods. The scheme was originally the brainchild of a local on Phuket called Krix Luther but is steadily making its way across the shores to other islands and parts of the globe, with Koh Samui being the latest edition. Gary Klungreseth & Steven Buchet have now taken the program under their wing with the first event taking place on the 12th of March on Plai Laem beach from the pier all the way along the expansive beach.

The premise is very simple; as Gary said in a recent interview, “first you train, than you clean. The 45-minute session mixes up functional training, games and drills, catering to all fitness levels. Once you’ve caught your breath, pull on a pair of gloves and get busy picking up discarded bottles, glass bits and butts. It is a sobering experience, but you will leave feeling a sense of satisfaction that you’ve made a positive change to our environment”. Then with the help of local sponsors a free BBQ is paid on for everyone that took part.
After the recent pretty epic monsoonal rains we experienced on the island throughout most of November, December and January the beaches on our little piece of paradise were looking pretty worse for wear with large amounts of plastic and other debris washed up on the shores. Some of the locals decided that it was time for some action and set up the Clean the Beach Samui program.

Seems that we do much home planning and designing for our homes but one important thing that is so often forgotten or should we say no properly thought through and that is the wireless Wi-Fi router. How many times in your own homes or others has a bad Wi-Fi signal been so annoying, and to know or be told yes just move out of this room or go over there the signal should be Ok is not satisfactory. I know it’s happened to myself I’ve ordered the new set up and thought that the installation guys would come in and pick the best placement themselves but wrong, you need to have a look at your house and decide yourself. Everyone knows that Wi-Fi signal strength weakens the farther away from the router you go. If your router is in the front of your house and your bedroom is in the back, you may be accustomed to waiting for your you tube to buffer. The difficulty depends on many things: your house construction, your placement of the router, the service provider and the router itself. First consideration is really where you put your router. It is critical thing to remember that the signal from a router broadcasts in all directions from the antenna, so it’s useful to think of signal strength in terms of a radius of broadcast. If your router is next to a wall next to your neighbour’s apartment, they’re getting a main piece of your signal, not you, which unless your sharing is pointless. Here are some other tips for optimal placement of your wireless router to get a stronger signal.
Keep it central
Location is key. Try to find the most central home for your router that you can. It’s often worth buying some Ethernet Cat 5 cable and run the wire to the most central location you can. Could make a huge difference. Consider even mounting the router on a wall or in a corner by the ceiling if you have two floors because radio waves generally spread out and towards the ground, not up. Think about putting your router on the second floor if you have one.
Avoid dense obstructions
Radio waves certainly travel through walls, but the thicker the wall, the weaker the signal will be on the other side. And if your home is fortified with brick or concrete walls, the signal is going to be absorbed by the wall and lose significant strength when traveling through it. Metal and mirrors are also your enemy because those materials reflect radio waves, so putting the router behind a TV or in a bathroom is a bad idea.
Kitchen, bad idea
When it comes to contending any potential buffering of your Wi-Fi signal, the microwave is not your friend. Microwaves and Wi-Fi routers operate using the same 2.4 gHz slice of the electromagnetic spectrum. When you use the microwave, it’s literally interfering with your Wi-Fi signal. Additionally, metal objects will absorb a signal, and with a metal fridge, stove, and other kitchen appliances, so just forget the kitchen.
Work with the antenna
All the magic happens with the antenna. It’s the part of the router that’s broadcasting and receiving your Wi-Fi connection. Antennas usually can move side to side or sometimes pivot full-circle in their socket. If you’re trying to get your signal to spread horizontally, positioning your antenna vertically will give you the best spread. If you’re trying to get the Wi-Fi to broadcast between floors in your home or office, position the antenna horizontally. It’s also not uncommon for the antenna to be removable on a Wi-Fi router, and if that’s the case you can take your router to a local electronic store and find a compatible antenna that will broadcast further.

Then you need to look no further than incredible Koh Phangan where you will find meditation, yoga, saunas, detox and wellness centres to Muay Thai boxing, kayaking, wakeboarding, kite surfing, beach volleyball, paddle boarding, zip lining, elephant trekking, archery, diving, snorkelling, wave riding, free diving, horse riding, trekking trails, hiking trails, mountain biking, rock climbing and fine dining all at your fingertips. Buddhist Monks realised Koh Phangan's tranquillity and spiritual importance and subsequently settled in Wat Phu Khao Noi just outside of the main town of Thong Sala as one of the first temples on the island. Within an area of approximately 167km2 with over 70% being unspoilt mountainous and tropical forest many more temples are nestled coherently within the islands natural flora and fauna offering a feast for the eyes of all visitors. Koh Phangan being relatively undiscovered and undeveloped still has the postcard perfect secluded deserted beach coves awaiting discovery via the traditional mode of transport, the long tail boat or for the more intrepid explorer by hike. You truly feel that you are the first to leave a footprint! In that vein Koh Phangan's beauty is emerging as an attractive destination for weddings and events. Due to Koh Phangan's granite structure, there are several small mountains where it's possible to trek/hike. The highest being Khao Raa at over 600m above sea level taking 2-3 hours to realise the summit. There is a bounty of wildlife from monkeys, wild boar, exotic reptiles to stunning birds of paradise not forgetting the spectacular coral reefs that envelop the plentiful bays where the amazing underwater world is accessible for snorkelers and divers equally.

LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain
RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.
RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.
LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.
GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.
SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.
SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.
LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)
STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area. STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.
STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.
STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.
In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
