EDITOR'S LETTER Dear Readers, Welcome to our August September 2017 Edition of Samui Phangan Real Estate Magazine. In this bumper packed issue, we are showcasing some of the best developers and property agents around our islands. Samui is continuing to increase in popularity and the standard of build quality, construction materials, and appliances is just incredible. I honestly think that there isn’t much that you cannot buy on Samui anymore. More and more high end businesses and developments are arriving and making Samui their home. In this issue, we start a small series of the advantages of using the new High Tec LED lighting systems. Did you know there are actual health benefits? Handy Plumbing Tips and Tricks

To save you time, money and headaches, we collected our favourite tips and tricks for solving common household plumbing problems in Thailand. Most of these tips make use of things that cost less than a 1,000 Baht and these tips could save trying to call in a plumber.

Don't Overtighten pipes or Supply Lines

This is too often my mistake putting them on too tight, just to be safe. But overtightening supply lines is riskier than under tightening. A loose connection that leaks is easy to tighten, but overtightening can wreck rubber seals and crack the threaded nuts, especially with the Thai PVC piping. So, get into this habit: Make the connections at both ends of the supply line finger-tight, then give them a gentle turn of another one-eighth to one-quarter turn with pliers. If they still leak, snug them up a touch more.

Don't Reuse Supply Lines

When you're replacing a toilet or a tap, you can save a few pennies by reusing the old flexible supply lines. But don't. Plastic degrades over time, and even a small leak can lead to catastrophic water damage. It's a small risk, but not one worth taking. Buy new lines that are encased in braided stainless steel; they're much less likely to burst. But even if you already have braided lines that are several years old, replace them.

Use a plunger before removing sink traps

Before you remove a sink trap, give the drain a few plunges with a toilet plunger. This will push most of the water out of the trap, lessening the mess when you pull the trap. If you have a double sink, be sure to plug the other drain to contain the air pressure

Deaden sounds with expanding foam

Fill the space between two stainless steel sink basins with expanding foam. The foam deadens vibrations and lessens the gong effect. It's possible to do this with the sink in place but much neater and easier before installation. Either way, let the foam harden and then trim away the excess with a knife.

Use a wet vacuum to remove hard objects

When a hard object like a toothbrush, comb or toy plugs a toilet or drain, a plunger may not be the solution—it might only push the obstruction in deeper. Instead, suck out the water and the obstruction with a wet/dry shop vacuum.

Tips for Using PTFE Thread Tape

PTFE Tape is easy and a reliable solution for sealing pipe threads. Often a cheaper and cleaner option than pipe sealant which will smear onto your hands or tools and end up on the carpet. Here are some tips for tape: Cheap tape works fine, but the thicker the better and is easier to handle and tears more neatly. How many times should you wrap it around the thread? There are no rules, but the most common answer we got from professionals was three. It is important to always wrap the tape clockwise around the threads. Otherwise, the tape will unwrap as you screw the joint together.

Keep a bucket of water handy before you turn off the mains

Then you won’t have to run to the neighbour’s house to check your work. Before you turn off the water supply, fill a bucket with water. Test your pipe work first by using the water or flush the toilet with it. Once you’re as happy as you can be with your work then you can turn the mains back on.

Take a picture before closing walls

Your walls may not have much inner beauty, but it's a good idea to take pictures of what's inside during remodelling or repair work. The same goes for floors and ceilings. When your next project rolls around, you'll know exactly where the framing, electrical and plumbing lines are.

Get a look at hidden spaces

Trying to find out what screw is behind the toilet or whether you're just running a new pipe, knowing what's inside the walls is helpful. Use your phone or small camera and take a picture with the flash on and get to see into the dark space before you work.

Good Light is Good for Your Wallet For decades, light has been used in Thailand for merely lighting up the place. When building a new condo or house, there would be some sort of ceiling light using either fluorescent tube lights or energy saving lights. Lights would be used sparingly according to the philosophy that 'if you need more light, use a stronger light bulb'. Fortunately, with modern LED lights, we can now use more light sources and save a lot of money at the same time. Ulrik Eeg, founder of Anubis Consult that specialises in high-quality lighting solutions elaborates: 'LED lights have come a long way since the first LED strips, and now you can get LEDs in any shape, size and form, even replicating the old tungsten glow bulbs. The LEDs render light much better than energy saving light bulbs and they use significantly less power and produce less heat. So using LEDs will not only increase the value of your home, but it will also save you a lot of money.' It is Good for Your Wallet You will save a lot of money on using modern LEDs. LEDs are cheaper in the long run because they use significantly less power than all other light sources. As a rule of thumb, you'll get as much light from a 7W LED screw bulb as from an 18W energy saving light bulb or a 75W conventional light bulb. Also, the LED technology has improved at a fast pace, a few years ago you would get 60-70 lumens per Watt, you can now get 90-110 Lumens per Watt. So, remember, to look for the Lumens, not Watts (see fact box at the end of the article) when purchasing light bulbs. Another important factor is that LEDs last significantly longer than other light sources – sometimes as much as 10-20 times as long. They are also less prone to blow when the voltage changes. Especially here in Thailand where the voltage can fluctuate between 180-240 Volts, a huge benefit. An energy saving light bulb, may have to be changed once a year or more. A modern LED will only have to be changed every 3-10 years or even less than that. In an average household of 150 m2 with 60 light bulbs, you will save about 1,000 baht per month on your electricity bill alone, or as much as 75,000 baht over a 5-year period when you factor in the cost of energy saving light bulbs vs. LEDs.

Yearly Savings: 12,031 baht or 1,003 baht per month. As mentioned previously, the LEDs will still be working after 3, 4 or even 5 years, where in contrast you will have to change the conventional energy saving light bulbs and halogens about once a year. At a cost of roughly 100 baht for a conventional light bulb and about 250 baht for an LED, you will have saved an additional 3,000 baht after 3 years, 9,000 baht after 4 years and 15,000 baht after 5 years. Over a 5-year period, you will have saved 75,000 baht by changing your existing lights to modern LEDs! In this 5-year period, you will have saved 13,825 kWh, or the equivalent of more than 10 Tons of CO2!

BAD LIGHT

Improve the Value of Your Home Replacing your old lights with LEDs will not only save you money, it will also improve the perceived value of your home. LEDs emit between 75 to 98 % of the full colour spectrum. With the wider colour spectrum, the colours of your home, the décor and art look brighter and more vivid. Think of the difference between hospital fluorescent lights, and a high-class restaurant, and you understand the difference. For clarification, see the illustration comparing bad lights used in a 75 Million baht home real estate ad, and a recent restaurant retrofitting carried out by Anubis Consult. If you have spent millions on good building materials and expensive furniture, why would you skimp on the lights? Also, the better light from LEDs is better for your health – but that is a story for another day!

Understand the Data E27: This is the socket. E27 is the standard 27 mm diameter screw bulb. Halogen spots are usually called MR16 or GU 5.3. Tube lights are called T8 or T5. Watt: In the old days, Watt was the yardstick for light - more Watt, more light. These days, however, Watt only tells you something about your electricity bill. Lumen: Lumen is a measure of the light intensity. This is what you should look for when purchasing light bulbs. A good modern LED light bulb of about 450 lumens is roughly the equivalent of an old 60W light bulb. Halogen light bulbs of 35 Watt produce almost 600 lumens, but because of the reflector the light is concentrated in a narrow cone. Angle: How wide an area that is illuminated by the light bulb. Colour Temperature: Measured in Kelvin; less than 3,000 is considered Warm White, above 6,000 is considered Daylight. In between those two are Cool White. CRI: Colour Rendering Index reflects how well the light source represents colour. Fluorescents are notoriously bad at reproducing colours, having a CRI of 50-60. Halogen and incandescent light bulbs have a CRI of 100. First generation LEDs had a CRI of 70-80. Modern LEDs have a CRI of 80-90, and the best LEDs like those from Segula have a CRI of above 90. Grass is always Greener on the other side In Search of the Immaculate Lawn in Thailand Having a beautiful lawn in Thailand requires a little more research and care than back home, here in the Tropics grass will grow but you need to know a little about the two main varieties available and in the beginning, you must be watering your lawn often if the sun is strong. A quick note here is that if you’ve just laid fresh turf, water heavily a few times rather than a little bit more often. Research has shown heavy watering does better to propagate healthy long root growth. Grass seeds are available if you search hard enough but we’ve found that most fail trying to plant their own seed and the turf available is reasonable and can be found of good quality. Most garden centres will even give you a complete quote for finishing the complete job of laying your lawn. OK So what is available: Broad Leafed Malay or the Narrow leafed Japanese? Basically, you will find two types of grass turf here, Malaysian Grass and Japanese Grass. The Japanese looks the best if you’re after a British style lawn. The grass is a good healthy green colour and the blades are thin as you expect from a lawn back home. It is hardy under direct strong sun and grows back well after a hot drought limited water season, areas of shade nethertheless are prone to balding patches. If you don't have sun all day, or have a lot of shade, you need Yah Malay (Malaysian Grass). This is the only grass that will survive shady conditions. It puts out runners to propagate. Malaysian Grass is thick leafed (see our images) and is softer and thicker under foot. Many will say the Malay Grass is a harder type and seems to grow with any conditions, plus it will come back quicker from cutting back on water in low season. When you’re visiting the garden centre look for healthy green turf that is moist and kept in the shade. The best quality of turf will have a thicker heavier base and won't fall apart when you shake it. Check that the grass is free from obvious weeds growing in-between, if you can see them now they will ruin your lawn in little to no time. Tips


Tips When you mow the lawn don’t remove all the cuttings, leave the cut grass to rot back in. Every couple of weeks or so buy a few bags of soil from your local garden centre, spread it around and then water it in. The sooner you see and remove any indigenous weeds that may appear will only make your life easier. Leaving them for a week or so will give them enough time to flourish and spread wildly. Try removing them at best after rain or watering the area so that when you pull them out all the roots come out complete. A good general lawn fertilizer should provide all three of the major essential elements: nitrogen, phosphorus and potassium (abbreviated NPK). The three numbers on the front of every fertilizer bag represent the percentage by weight of these three elements. The first number represents the percentage of nitrogen. Nitrogen is required in the greatest amount by freshly laid turf grass and should have the highest value by a ratio of at least three to four times the other two. The nitrogen can be present as a mixture of several different materials. Some of these are very water-soluble and are rapidly released in a short period. Others are formulated to be released slowly over a longer period. Artificial Turf Artificial turf might have been a rather off putting option a decade ago but now artificial turf can have many more advantages than real grass. I have seen some and it has only shown to be fake as it looked so perfect. For those looking for a stunning lawn that requires no maintenance this might be a great solution.

Purchasing a Property from a Private Seller in Koh Samui or Koh Phangnan The real estate markets in Koh Samui and particularly in Koh Phangnan are still in their infancy and most properties for sale by realtors are offered by property developers who are building new build properties. However, as the property market matures, more and more properties are being offered for sale by private owners who have perhaps owned a villa or apartment in paradise for several years and are now seeking to re-sell their property and realize their investment. The following article examines the key issues that buyers should consider when purchasing a property offered by a private seller, as opposed to a developer in Koh Samui or Koh Phangnan.

As a starting point, a prospective buyer must be aware that the legal rights of foreign nationals to own property in Thailand are likely to be considerably more restrictive than their right to own property in their home country. For example, foreign nationals are generally prohibited from owning freehold land in Thailand. Consequently, if the Seller is a Thai national, a foreign buyer may not be entitled to own the target property in the same manner as the seller. It is important, therefore, for prospective buyers to undertake comprehensive research and understand their rights and the restrictions or limitations which may apply to them in respect to the acquisition, ownership and future re-sale of real estate. It is imperative that a prospective buyer does not simply rely upon the representations made by the seller with regards to the target property. Buyers should beware that they buy at their own risk and should therefore undertake detailed and independent investigations into all aspects of the property prior to paying any portion of the purchase price to the seller. The scope of such investigations will depend upon the precise nature of the property but all investigations should include: A title investigation to establish that the Seller is the legal owner of the property and that the title to the property has been legally issued in accordance with the laws of Thailand and has full legal rights of access; An investigation to establish whether the property has been built in accordance with local building and environmental regulations; A structural survey to ensure the structural integrity of the property and to ascertain whether any major repairs are required; The physical testing of the facilities at the property such as the swimming pool pump and filter and air conditioning units to ensure that they are in full working order. Any defects, inconsistencies or concerns which are revealed by such investigations should be put to the seller in writing and the seller should provide further written information or documentation to satisfy the concerns of the prospective buyer. Where appropriate, such information and documentation should be independently verified. It may be appropriate in certain circumstances for the seller to provide contractual assurances with regards to certain matters or offer a reduction in the purchase price to reflect the cost of corrective actions to be undertaken at the cost of the buyer after acquiring the property.

The ownership of shares in so-called offshore corporations, which are usually registered in tax havens, have become the target of scrutiny by tax authorities in many countries in recent years and consequently, prospective buyers should seek advice in their home country as to whether it is prudent to own shares in such offshore corporations. In circumstances which involve the sale of shares in a limited Thai company by a foreign buyer, enquiries must be undertaken to ensure that the company will comply with Thai laws once the foreign buyer has acquired his/ her shares. Foreign buyers must be aware that Thai law prohibits the control of freehold land by foreign individuals and foreign companies and restricts the number of shares in a limited Thai Company which can be legally owned by foreigners. The seller and buyer should negotiate a detailed sale and purchase agreement with regards to the sale of the property, or Share Transfer Agreement if the transaction relates to the sale of shares, setting out the respective obligations of the parties. The sale and purchase agreement should set out clearly the main terms of the agreement between the seller and buyer including the purchase price, payment terms, completion date and the consequences of a breach of the agreement by either party. Any specific terms and conditions agreed verbally between the seller and buyer, should be clearly set out in the sale and purchase agreement with clear consequences for failure to comply with the obligations. This article sets out some of the main issues which should be considered by prospective buyers who are seeking to acquire a re-sale property in Koh Samui of Koh Phangnan. Bitcoin Investment using Thai Property Finance

Thailand is often considered home for an extraordinarily high number of local & international entrepreneurs. Considered as the “lifestyle” preference, to reside and choose to spend life’s short span of time, the kingdom provides relative freedom for daily pleasures of life, including all kinds of experiences & adventures. Whether relaxing on the beaches or spending hard earned baht cash in shopping centers, restaurants, theme parks and resorts or, your local 7/11, centralised money is earned, and than centralised money is spent. Over the past 12 months, there has been an increased number of reports in mainstream media of “Bitcoin” and usually, either reports of millionaires made overnight and in short spaces of time OR, warning on dangers to invest in Bitcoin. In addition, friends and acquaintances all report first hand, on Bitcoin investments, mostly positive. Bitcoin is considered as a “Cryptocurrency” and offers a “Digital Payment System” to almost anyone, with access to the Internet and a little cash to invest. With no reported central governance of the coin, countries and governments in theory have no control or, input over how it is run. A complete peer-to-peer transaction means that once you acquire a digital wallet to hold your coins and own digital coins in the wallet, in many ways there is no need for centralised and governed cash in daily life as it would than be possible to make purchases with digital

In various countries of the world, it’s allegedly possible to purchase almost anything with Bitcoin including a new home to live in, often considered as the biggest purchase one might make in life. In Thailand over the past year, I have seen properties on offer for example with owners accepting Bitcoin as a means to purchase. By now, you may have noticed, I choose to use the term “invest” when associating with Bitcoin. This is due to the fact as with most currencies, the perceived “value” of the currency can be traded which in turn can either make OR lose cash/value. At the time of writing this, and over the past month, 1 Bitcoin could be purchased for anywhere between USD 2,200 right up to almost USD 3,000. Around 36% increase in value if bought at USD 2,200…in just a 1-month turnaround! The difficult/challenge for many to overcome is that there is no hard currency you can see, touch, smell and even hear to pass on to your local shop to buy a daily loaf of bread… in fact it is quite the opposite. You are exchanging that essential sense of cash/ownership/ wealth for nothing, that you can physically touch and only a digital code, which you may not commonly be able to use at the local shop or worse, can lose altogether if one might lose the digital code. Almost like throwing cash/ money away into the wind.


For the generation of days gone by, independent countries and hard currency has, and always will be, the essential ingredient in order to get by in daily life. A younger entrepreneurial generation however, may tend to be more inclined to delve unto the digital spectrum with a more globalist view, international appeal and digital lifestyle. The older days of going into an “office” or “workplace” are slowly disappearing and more “digital” offices are taking place which can be run from anywhere on a Wi-Fi connection. If being digital, it is possible to live life and earn digital “coin” which can than be used to make daily required purchases of food and drink, it could than be deemed a visionaries future of how life should be.

Typical annual interest rates for Thai condo finance are around 8.3% incurring a lender set up fee of 1.25% and various other charges including a further 1.00% mortgage registration payable to the land office. With an increasing use of Cryptocurrency in Thailand, over the past 12 months there has also been a marked increase of Refinance using Thai property as collateral in order to “Invest” into Bitcoin and Cryptocurrencies. i.e. Owners of a property may wish to free up and take their centralised cash out of Thai property to than place onto their local bank account and spend on digital investments.

Once the loan quotation is issued and upon payment of an appraisal/valuation fee to the lenders preferred company, the timescale of 3 weeks to receive cash will begin. During the first week, documents can be prepared and sent to the lender, the following week, will be for loan approval and loan agreement signing, than the third week to allow the lenders legal team to prepare for Mortgage registration at the land office and subsequent release of cash.

Up until recent years foreigners would only be able to finance property through their own personal savings therefore, a high proportion of condo/villa and properties were all bought and paid for with no borrowings. This will of course mean hard earned centralised cash is tied up in solid real estate and may have lost value in some provinces or may even be unable to sell due to mass supply. One area of particular interest is the Thai condo market since one lender, has made Refinance their key and core part of their business making cash available very easily in as little as 3 weeks. For many condo owners, being able to take back up to 60% of the condo value in THB cash and be able to spend on whatever desire takes their fancy, has been a blessing in disguise, especially if they made a killing on various Cryptocurrencies over recent times. To make things relatively easy, there is also a Google map available detailing each and every condo preapproved by the lender with loan sizes available against each specific unit in the building, which happens to be updated on a monthly basis. All condo units on this list are almost guaranteed forms of finance in around 3 weeks. Whilst the interest and fees are considerable in comparison to some area of the globe, when comparable to the returns made on Bitcoin, could be considered as miniscule.

In order to than move the money from a Thai bank account to Bitcoin, a Thai coin exchange company can be used where a simple bank/atm transfer or even payment via credit card can be made. The Thai, coin exchange company will than purchase Bitcoin, once the coin has been purchased, it than can be moved into a digital wallet rather than held as cash in your back pocket. This digital wallet can than be used to make purchases of various Cryptocurrencies and trade over the Internet. Once digital, it is also than possible to send coin to bank accounts worldwide without, the usual bank transfers. Imagine using coin to move money from Thailand to overseas and not having to spend hours speaking to local staff in the local branch… To go into detail on how to transact Cryptocurrency and Bitcoin investments, will require a further article in the next edition magazine though for now, trading prices of the top 2 coins are around USD 2,331 Bitcoin and USD 199 Ethereum. These prices shall be referred against, within my next article as a benchmark. Let’s assume a pre-approved condo of THB 5,000,000 value is going to be mortgaged at the maximum 60% loan to value therefore, THB 3,000,000 capital is available to play/invest with and I shall make a cost analysis on the gains/loss made. There are two different ways people look at the landscape they build on- as a problem or as a gift. Living in the hot tropics should teach us that nature is a gift. True comfort comes from breezes which we cannot control, and the shade of a multitude of plants. The best locations are often hilltops with shallower or lighter soils. Construction in hot areas needs cooperation with nature to use the available materials, breezes, soils, and plants. In hot areas trying to shut out the unpleasant weather does not work well. Electricity for fans or air conditioning is often sadly unreliable and condensation from humidity causes more problems than the heat. Opening to the breezes is much more effective. Peoples living in hot regions can define buildings as roofs with spaces blending from indoors to out through screens instead of walls, allowing breezes in. A sense of security and enclosure may come more from people or an estate than the building walls themselves. samui phangan real estate

Shaping Buildings for the Humid Tropics Wind directions are very important. Ask neighbours, or people who work there, about the breezes. Find out when they blow, how strong they are, where storms come from. Opinions of the people using the buildings are important. Average information may not be accurate for your site. Ask what times of day and seasons are most uncomfortable, and why. Mention buildings or rooms they are familiar with that have different exposures, and ask which ones are most comfortable. Plan buildings differently for nationals and foreigners. Acclimatized people in hot regions can tolerate hotter and more humid conditions, but cannot tolerate weather that is as cool. People from temperate or subtropical areas living short-term in the tropics will suffer more from heat and humidity than the locals do. Those used to air conditioning may only tolerate very narrow ranges of temperature and humidity. Residents of hot humid areas are more used to having damp skin, and enjoy the cooling that brisk breezes bring indoors.

Whether they are acclimatized or not, people who can control their environment feel comfortable in a wider range of conditions. Provide access to a window or vent for each person, and make shutters or blinds adjustable. Everyone is happier if we can see why it is hot or damp, and modify the amount of sun or breeze entering. Plants Cities are hotter than the countryside because all the pavement and walls heat up in the sun. Any shade or green surfaces you can add help to cool the area will only benefit. Locations near parks or planted areas are often much cooler, or on the edges of streams or lakes. Some people use green roofs to keep buildings cool- thin layers of lightweight rock added on top of a waterproof membrane, planted with special drought tolerant plants. In areas of heavy rainfall these might need drainage added under the growing media. Preserve as many trees as possible to shade your building and garden. They can be pruned to allow breezes underneath, but will need protection. The soil beneath their branches must not have heavy stacks of materials or trucks parked on it. The earth beneath existing trees cannot be changed without damaging them, unless retaining walls leave most of their roots undisturbed. It is simpler to leave the ground near trees untouched. New plants can be added to increase shade but will need time to grow before they help much. Be careful what new plants you choose. Many attractive plants that nurseries sell are used all over the world because they are easy to grow. Some of these are invasive exotics- plants from other areas that reproduce too vigorously, squeeze out native species, and are very hard to get rid of. Many indigenous plants suit the climate and soils of an area perfectly, and are useful as well. Some can also benefit by providing edible fruits or medicine. Sometimes their seeds or cuttings can be taken for free. Keeping a wide variety of plants growing in an area makes it a richer place for people as well as animals.

Preserving existing plants is also the best way to keep the soil that you will need for growing new plants in the future. The preferred hill sites often have shallower soils than lower slope areas. And the soils of some parts of the humid tropics are among the most perishable of any on earth. In the Tropics, the processes of decomposition is so quick that natural fertility washes out and water-holding material rots and disappears. Flatten or prepare only enough land to build on and work on right now and leave plants on the rest. If heavy machines will be used, put stakes or mesh fences around the work area. Big machines are easiest to use with lots of room to turn and back up- this will mean large areas bare and hard-packed. Sometimes large machines cost too much in terms of preventing damage to trees, repairing the soils, and replanting and waiting years for shade afterwards. If people remove all the plants and scrape the soil into a stack to use later, soil degrades. New organic materials must then be added. It may never support as rich plant life as it did before, because many native plants depend on soil organisms that die in stockpiles. It is not always possible to 'restore nature' after development. If people want flat outdoor spaces to use on hillsides, they will need to build retaining walls to terrace their land. Walls are expensive, can soak up sunlight and warm the area, and they don't let breezes through. This process will also destroy all the trees or shrubs on the area. Keep walls and slopes smaller by stretching long, narrow buildings along the side of a hill instead of diagonally across, or running up and down the slope. Or better, raise the building up on stone or earth piers or arches and let the rain run undisturbed under it. Air flowing into a building from near the ground on the shady side can cool the building off significantly. Use nature and your environment to your advantage it is a gift that will give back much harmony and happiness when embraced.

This edition of the Samui Phangan Real Estate Magazine (SPRE) welcomes Frank Jerusalem to the personal profile. Frank has recently taken on the position of Resident Manager with Luxury Villas & Homes. We’ve always had a great business relationship with SVH and LVH they have supported our magazine since day one so it was just as important for us to meet the new Resident Manager and find out more about Frank.

Frank, welcome to SPRE, you are originally from Germany, where about did you grow up and where did you study? I was born in Aachen, a nice and well known historic German town bordering the Netherlands and Belgium. I grew up and did my studies in the same famous university town where I lived until I was about 25 years old. So, a lot of good memories from these days… Since when did you take the position of Resident Manager at LVH? I visited Samui the first time in October last year of (2016) before I made the decision to move here and join LVH. I decided not long after my first visit to make Samui my new home in late November. Koh Samui is such a beautiful island with friendly people but the fact that LVH has an established a successful business, made it a very easy decision. However, I recall those months were during monsoon which is an experience I won’t forget with all the rain. Thankfully I have since experienced the real beauty of the island with clear blue skies and calm tropical waters. So, I am very happy that I took the decision to settle on this beautiful island.

Your last position was Front Office Manager, then acting Resident Manager at the stunning Coco Bodu Hithi Resort on Bodu Hithi Island, in North Malé Atoll in the Maldives. This small island looks very tranquil and amazing but did you find that it was rather limited in what you could do on your free time or were you just working solidly most days? Many say the Maldives is so beautiful but being mostly small islands means short stays are more appropriate, and you manged two years? The Maldives is indeed idyllic, beautiful and tranquil, especially from the guest’s perspective, it lives up to its famous reputation as of one the most sought after luxury destinations. From a work point of view however it is different and to be honest when I went to work in Maldives for the first time back in 2011, it was more of a challenge than I first expected, unlike the image you have in your mind from the picture perfect postcards. I found that after a while you are limited by the remoteness and size of the islands in terms of individual freedom, so it was quite intensive to balance work life and downtime as you are committed to look after your guests and your team 7/24h in one place. After some time, I adapted to the pace and rhythm and started enjoying my work life balance more and more. samui phangan real estate

Living in this untouched natural environment was a blessing and gave me the opportunity to do simple things like fishing and to learn to dive, a must in the Maldives. I managed to stay almost five years, all in all, and made many friends for life. I think comparing Samui to the Maldives would be wrong but what do you find most interesting about Samui? It is true that they are very different and it would be unfair to really compare the two. Life in Samui offers a lot more options whether it is from a culinary perspective for example, I am absolutely crazy about Thai food, or experiencing cultural divertissement from this part of the world. Koh Samui is big enough to allow you to meet with different people and communities, which I feel is a real enrichment to life. What does your job entail as Resident Manager in LVH? One of my main focuses is to have a full understanding of all the properties that LVH manages and have successfully done so for 15 years already. It is a challenging role, but an exciting and fascinating experience in particular dealing with the individual property owners, international guests and of course working with the entire in-villa teams and our office teams. It gives me great satisfaction to balance the interests of all these various “actors” and to be part of the success story of LVH along with the support of the entire team. I am learning new things every day even after six months or so and hopefully will have an impact by helping to improve on our existing services. You are obviously bringing much hospitality knowledge to LVH with your 20 years’ work experience what do you feel is your strongest point? There are people who think I am a good mentor and motivator. I am definitely a team player and manage to handle any kind of difficult situation. Bringing people together to archive a common target is what I like, but people need to know me first. LVH already has one of the best reputations on Koh Samui, what are your ambitions with the company? For sure I want to participate in the story that started 15 years ago and I want to set and maintain the high level of quality and service granted by LVH to our customers since day one. More globally I wish to strengthen and develop Koh Samui on a long run to be better known as a luxury destination in a tough competition. I believe we have all we need…. LVH already looks after many of Samui’s most incredible beach villas, how many do you have under contract and is there one certain one for you which you find exceptional? We look after more than fifty stylish, unique individual standalone properties along with a couple of larger estates around the island. Properties are spread between the busy northern areas to the peaceful southern districts. The design differences for the properties we manage vary from Traditional Thai mixed with Asian influences to more modern contemporary and minimalistic designs. We are proud to offer such diversity in our rental portfolio which allows us to cater to all tastes and preferences even in terms of size and various facilities available. We have two main portfolios, for example the larger properties are placed within 'The Signature Collection' and the smaller properties likewise are in 'The Boutique Villas' which simplifies the choice for property owners and guests by help classify the differences. The tranquil island of Koh Phangan is in the middle of the gulf of Thailand. It is about 70 km. from the mainland and about 15 km. from Koh Samui. Phangan is the largest of Samui’s neighbouring islands with an area of 168 sq km. Over 70% of Koh Phangan is still tropical forests, lowlands, coconut fields and secluded beaches. From Thong Sala pier, trails run to Panviman Resort all the way from Bantai Village through the mountains and to Thong Nai Pan Beach, which is beautiful and unspoilt. We had specifically chosen Panviman for our peaceful getaway weekend being an easy trip over from Samui and we were certainly not disappointed. Arriving by a private speedboat we were thrilled to be welcomed at the private pier by the staff drumming as the speedboat docked. We had chosen one of their private Cottages which was completely secluded giving us a wonderful feeling of privacy but so built that you had an amazing direct view out onto the shimmering ocean even from the bed itself. The whole teak wood cottage was luxuriously designed with beautiful massive rooms surrounded by huge glass windows showcasing our amazing environment, even allowing us to appreciate the view whilst enjoying a relaxing bath. Surrounding the cottage was a huge spacious balcony including sun loungers where we could chill in the sun or the warm evening air.

It was obvious that the whole resort had been designed to enjoy the peace and tranquillity of the surroundings and the stunning panorama with even the delectable breakfast set in a circular lounge with 360-degree sea views. Next to the restaurant and bar was the main large swimming pool and Jacuzzi, also enjoying incredible views over the bay. There was an excellent choice in varied accommodation from family pool villas with great private infinity pools, spa villas, pool villas and more up to the President Suite. Luxurious choices for every traveller or holiday maker seeking that vacation of a lifetime. Panvimans’ services excelled from their new custom built speedboat offering more power, luxury and comfort with greater safety to their romantic candlelight dinners on the beach. The beach itself is in a private cove with its own restaurant & bar. How to Keep Dogs from

Spoiling Your Lawn Sadly, in Thailand if your lawn area is not fenced off you are likely to have a stray dog or two coming along. That or you maybe have your own pets who are damaging your beautiful lawn and you need to find out what can help?

Facts: Dog’s urine is high in nitrogen. This concentrated nitrogen “burns” your grass in the same way that using too much fertilizer does. That’s why urine spots are often brown in the middle, where the urine was most concentrated, and greener around the edges, where the diluted urine acted itself as a fertilizer. It’s the nitrogen content that damages grass, not the acidity, so products designed to neutralize acid are totally useless. While there’s no real difference in male and female dog urine as far as plants are concerned, female dogs often do the more damage to grass since they release their urine all at once on the lawn. Male dogs tend to “mark” trees, shrubs, and fences with small amounts of urine.

Solutions: Water your lawn: The best way to reduce the damage to your lawn is to dilute the urine by saturating the spot with water straight away. This approach also helps should you accidentally spill fertilizer on your lawn too. Make sure your dog is well hydrated: To dilute the strength of the urine. Adding some canned dog food, or moistening dry food with a little water, is another way to add water to their diet. Examine diet: Consult your vet to see if you are feeding your dog the right amount of protein. The nitrogen in urine comes from protein metabolism, and some dogs might benefit from a lower-protein diet. This is not something that should be done without a vet’s analysis of your dog’s diet and lifestyle. Buy high-quality dog food: In general, higher-quality dog foods have higher-quality protein sources, which are more easily digestible and less likely to leave by-products in the urine. Train your dog: Train your dog to go in a designated space away from the main lawn. While this may sound like a daunting task, dogs really can be trained to go in specific places on command. Make sure the area has mulch or light gravel that is easy to replace and keep clean. Keep your lawn healthy: A healthy, well cared for lawn can withstand the occasional overdose of nitrogen better than a stressed lawn. Choose supplements carefully: Your local pet store likely has a variety of products claiming to bind and neutralize urine. Results are not proven on these products, and you should consult your vet to make sure they are safe before using. Generally, I feel it’s better to use solutions that work with biology and nature, rather than trying to alter it.

Within an area of approximately 167km2 with over 70% being unspoilt mountainous and tropical forest many more temples are nestled coherently within the islands natural flora and fauna offering a feast for the eyes of all visitors. Koh Phangan being relatively undiscovered and undeveloped still has the postcard perfect secluded deserted beach coves awaiting discovery via the traditional mode of transport, the long tail boat or for the more intrepid explorer by hike. You truly feel that you are the first to leave a footprint! In that vein Koh Phangan's beauty is emerging as an attractive destination for weddings and events. Due to Koh Phangan's granite structure, there are several small mountains where it's possible to trek/hike. The highest being Khao Raa at over 600m above sea level taking 2-3 hours to realise the summit. LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain

RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.

SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.

SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)

STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area. STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.

STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.

STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.

In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
