Jar-gon If you’re like me, you will have that special cupboard at home full of used glass jars, which you just don’t want to throw away. All shapes and sizes and most have some old tattered part of a label left on. Well here we will give you some handy fun tips to use your old jam jars.

Simple, Chemical-Free ways to Remove Labels and Glue Rest from Your Glass Jars

Old glass Jars are used in a lot of DIY projects. They have so many uses, but one thing that can get annoying is when you try to peel off or remove labels or any traces of glue from the jars. First, you must sink the jars in hot soapy water, make a paste of oil and baking soda-the ingredients should be 50/50. Any type of oil will do the trick, but you can try olive oil for the best results. Rub the paste on the sticky surfaces or on the labels and let it sit for a few minutes. Use a clean cloth to wipe the paste away and the labels. The labels and glue will come right off.

Floating Candles in a Jar

It’s astonishing what a homemade burning candle can do. A burning candle can light up a room and change the atmosphere with the scent it burns. You can create a certain scent that will remind you of home. And it won’t take more than 10 minutes to do so. You will need a jar for your summery scented candle and some “special” ingredients such as lemon grass, sliced limes, fresh mint leaves, or some aromatic Thai herbs from the local market and that’s about it. And the thing is that you can use this type of beautiful decorative candle with its fresh smell to keep the pesky bugs away. And the combination of colors can light up and brighten any room. The candles are great decorations, and you can add some drops of citronella, to make the scent even fresher and longer lasting.

Cute Jar Terrariums Step 1. Choose an open jar.

Step 2. Cover the bottom with an inch layer of tiny pebbles or rocks to create a false drainage system for the plant roots. Step 3. Add a thin layer of activated charcoal, this keeps the water fresh, and prevent mold and bacteria from building up. Step 4. Add a layer of potting soil. They also make a special mix if you choose to use cacti and succulents instead of moss and ferns. Step 5. Place plants in the terrarium, starting with the largest plant first.

Protecting your home from flooding Flooding can strike anywhere and as many of us have found out even our beautiful tropical islands are not spared when the weather turns rough. Without sounding like we’re closing the gate after the horse has bolted here are a few tips that households especially in low island areas should know about. The best way to avoid flooding is to stay above water line but as so many of us found out this is an ever-changing margin. Once the water reaches the level of your floor and goes a few centimeters above, you will have substantial damage. We now know most areas that are hit first but even a home on a hill or mountainside needs flood-proofing. Here are some measures that will offer some protection if flooding occurs. Protect in-home electrical and air conditioning systems Raise switches, sockets, circuit breakers and wiring at least 12cm above the expected flood level in your area.

Anchor and raise outdoor equipment Outside air-conditioning units and generators should be secured and raised above your flood level. Consider any equipment that has fuel and make sure this will not contaminate the area. Modify water valves A flooded sewer system can cause sewage to back up into your home. So, you won't find yourself knee-deep in black water, install an interior or exterior backflow valve, where possible. Determine how water flows around your house Called the grading or slope, the angle of the ground can direct water to or away from your house. Obviously, it's best if the home was built so that water drains away from the building. This is easy enough to determine by watching how water flows or accumulates during a bad rainstorm. If your area is prone to standing water even after an ordinary rainstorm, talk to one of the islands professional construction companies. Good


companies would be able to give you advise on water flow, and they can make suggestions. Opt for a major retrofit If your home floods frequently and moving isn't an option, you may need to take drastic and costly measures. • Raise your home on piers or columns so that the lowest floor is above the flood level. If that sounds expensive -- well, it could be but its maybe an investment that would save much money and distress at the next bad flood. • "Wet-proof" your home by installing foundation vents that would allow water to flow through the building, instead of rising inside and causing more damage. Again, consult with a reputable construction company. • Do some "dry proofing" by applying coatings and other sealing materials to your walls dry. Take last-minute measures as waters rise • Clear gutters, drains and downspouts. • Move furniture, rugs, electronics and other belongings to upper floors, or at least raise them off a ground floor. • Shut off electricity at the breaker panel. • Elevate major appliances onto concrete blocks if they're potentially in harm's way from flooding.

Ignore these dangers and you could be splashing around smelly and soaked carpeting, furniture, walls, appliances, lighting, and ruined electronics. Mould can soon follow and you'll find yourself ripping out walls to reach soaked insulation, tearing up flooring and replacing anything electrical.

A Summary of the Legal Ownership Structures for Real Property which are available to Foreign Investors in Koh Samui and Koh Phangan

When a person purchasers real estate in their own country, their focus is almost entirely upon the attributes of the target property and not so much upon how they will legally own the property. Buyers in their own country are very much aware that they can own real property in their name and that the laws of their country will robustly and actively protect their right to own the property. This is not the case when Buyers purchase property outside of their country of origin and is particularly the case in Thailand. For example, most European citizens can own property on a freehold basis in their home country, however, however, in Thailand the freehold ownership of real property by nonThai citizens is prohibited. The following article examines the types of legal interests that can be acquired by foreign investors in Koh Samui and Koh Phangan.

Foreign Freehold Condominiums

Foreign buyers are permitted to own on a freehold basis, up to 49 percent of the private living space of a legally registered condominium. The remainder of the private living space can be owned by Thai persons or leased to foreign buyers (see below). It is worth noting that condominium developments are heavily regulated under the Condominium Acts of Thailand which place a number of legal requirements and obligations upon condominium developers such a prohibiting false advertising, limiting late payment fees and setting standard terms for sale and purchase agreements. Accordingly, the Condominium Acts provide considerable legal protection and assurance to buyers. There are relatively few condominium projects in Koh Samui and Koh Phangnan compared to elsewhere in Thailand, this is partly due to the zoning/environment regulations which prohibit condominium projects in some areas of the island.

Leasehold

The maximum term of a registered residential lease term in Thailand is 30 years which applies to both foreign and Thai investors alike. A 30 year lease is not a particularly attractive investment to an investor who is looking to secure the use of a property in the long term, in response to this, many developers offer contractual renewals for multiple terms of 30 years each, such renewals cannot be registered at the land offices, but can be contractual obligations set out in the lease contract. It is important for investors to examine the terms of the lease carefully to ensure that they are afforded full rights of enjoyment of the leased property during the registered lease term. It is also important to understand that lease renewals can be fraught with danger, for example, in the event that the person granting the lease dies during the initial 30 year term and the property is passed to their heirs who may refuse to renew the lease at the end of the lease term.

Collective Leasehold Options

A number of savvy developers in Koh Samui offer a “Protected” or “Collective” leasehold structure to international buyers in residential developments. In addition to the registered 30 year lease with lease renewal options (as described in the previous paragraph), the investor is also provided with a share in an offshore company which in turn owns shares a limited Thai company which owns the project land. This allows the buyers acting collectively, to exercise control over certain important decisions of the land owning company relating to the land, such as (in certain circumstances), the lease renewals. It is important to ensure that indirect participation in the Thai Company which owns the project land does not contravene the Land Code of Thailand which restricts the direct or indirect control of land by foreigners.

Ownership of Buildings

International investors should note that foreign investors can own buildings in Thailand directly in their own name, but it is important to ensure that the paperwork for registering the transfer of building ownership is in order to avoid problems when attempting to re-sell the building in the future.

Shared Ownership

Fractional Ownership refers to the partial ownership of property by multiple investors who each invest a fraction of the cost of the property and in return are entitled to a certain use right in proportion to the investment. It is important to establish the “legal link” between the underlying real estate asset and the investor to ensure that the interest is a genuine interest in the underlying real estate and not just a contractual right of use. Fractional or shared ownership options are becoming increasingly popular in Koh Samui which already boasts a number of luxury fractional/ shared ownership projects. This article is intended to provide would-be investors in real estate with a basic guide to the real estate ownership option available in Koh Samui and Koh Phangan. As in any jurisdiction, it is important to appoint an independent legal representative to assist you to conduct the necessary due diligence checks into the land, legal structure and legal contracts before monies are handed over to the developer.

hailand, along with its paradise islands including Koh Samui, are often known for a more relaxed way of life, where things tend to go at a slower pace in comparison to places such as, London, Dubai, Hong Kong or Singapore. Singapore for example is known for its no nonsense approach to business, rubber stamps and deals done on major transactions in just a few hours. Decision makers making executive decisions in a matter of minutes! In comparison, Thailand is more commonly known for taking several days, weeks and even months on similar decisions with perhaps various run-arounds during the process, not always, though is commonly the case. One clear exception to that rule could be the Thai property market, where things can move at an incredibly quick pace, particularly when there is money to be made or even to be saved. It is questionably a buyer’s market in Thailand at present with various major deals to be had on property purchases. The Kingdom is going through one of its biggest changes in modern history. With both the Government & Royal transitions now well under way, major changes, come not just with new hopes, but also with an increased uncertainty, as official rubber stamps could come with delay. While this occurs, there are almost always new challenges within business and there will be several that fail to adapt and grow into the new markets. Personal income may be affected with possible property fire sales on the increase. Knowing which property is an actual fire sale is also a battle, particularly when various “marketers” promote any old property as a fire sale, just to make a sale. There are of course the well-seasoned business entrepreneurs who know full well how to take advantage of this type of market and those who are so affluent, a possible slowdown in business income is no real immediate concern since there are adequate cash reserves.

Thailand’s Property Backed, Overdraft Facility… When an owner of a property makes that decision to sell or even to leave Thailand, it may not have come lightly and the decision to sell may have taken several months, the time than comes when all they want to do …..is sell. Sell, Sell, Sell. The market value of a luxury pool villa maybe say THB 10,000,000 so an owner offers a price to sell at a slight discount of THB 9,000,000 however really, if they were to receive cash within 1 week and be done, may accept considerably less. For those who have “cash”, available in just a matter of days, reasonable savings on property could be made. At that early stage of liquidation, a quick sale for the owner maybe worth the effort, for less stress and a lengthier uncertainty period in the longer run.


Now when it comes to property finance approval, there is little chance that a bank anywhere in the world and more particularly in Thailand, maybe able to go from start to finish in a matter of days, even more so for foreigners and all on a new property which the bank has never even seen before. An unofficial decision with a 99% certainty of finance in say 3-4 weeks could be granted yes, though actually releasing full funds as cash on the property to purchase would be challenging in just 1 week, particularly using only commercial banks and public listed lenders. There is however an alternative solution for property investors, so they can preferably strike while the iron is still hot, for that property purchase at a discount. Much like how an overdraft facility would work, there is a way to provide an instant amount of cash available using Thai property (preferably condo) as collateral. While this may come with a small set up fee and a little more paperwork, a well versed Thai financial institution is able to pre-approve existing collateral and client backgrounds with a guarantee of finance available in a matter of days for any period up to the next 12 months…..Yes, that was 12 months! You only pay the interest as and when you borrow and your only initial outlay would typically be the appraisal, commitment & lender fee with a possible inspection cost. A preagreed sum is than approved for up to 12 months and providing you draw the full amount in the specified period, you may even get the commitment fee back again. The only slight difference to this rather than an overdraft facility is that you will be required to have a monthly instalment once the initial loan is drawn & on a repayment of some kind basis however, the concept of almost instant cash readily available with interest payable only when you borrow is there. Let’s take for example an investor who owns 2 condominium units where the combined value is THB 20,000,000. A lender happens to have this condo on a pre-approved Thailand Condo Finance Map, which means they can already guarantee finance in around 3-4 weeks, up to 60% value & subject to individual credit profile background checks. The investor however is keen to have pre-approval of up to just THB 7,000,000 and would like this readily available in just a matter of days since they believe our earlier luxury pool villa example, could be purchased for just THB 6,500,000 and would like to move quick to secure the deal in just a matter of days and have a little extra cash surplus just in case. To approve this loan, sign a contract and have guaranteed for up to 12 months (just in case this purchase doesn’t go through as there will always be others available for using funds) the condo owner will do the following on this example:

• Pay for an Appraisal – Cost is subject to size though is usually between THB 5-15,000 • Pay for Lender Fee – 1.25% (THB 87,500) • Pay for a Commitment Fee – 2.00% (THB 140,000) • No fee for inspection this example as “already” on the list It than comes in writing that the Lender Fee & Commitment Fee is refundable in full if, the loan is declined or approved below the loan request (this example THB 7,000,000) and, that once the final contract is signed and loan is fully drawn, you get the commitment fee back again. Once the lender receives all supporting documents and go through an approval process (3 weeks) the owner is than ready with “cash on the hip” so to speak. Let’s now assume this condo owner had already preapproved a loan of THB 7,000,000 several months ago and now was ready with cash on the hip to put in an offer of THB 6,500,000 on that luxury pool villa. On this occasion, the seller accepted THB 6,800,000 and the deal was closed at the land office in 2 days since the seller was ready to leave Thailand and would accept a lower price just to be relieved from stress and an immediate cash injection. In summary, it pays sometimes to have cash available “on the hip” rather than wait for a period as is easier to discount/negotiate when the deal is done rather than wait for finance. Pre-approval may take a little time and a little cost, though with up to a 12-month window to close, if there is confidence a property will come available to purchase, it is worth the effort… At MBKG, our foreigner friendly terms are available at up to 60% loan to value, up to 10-year tenure and with annual interest from as low 8.575% condo, or 12.0% land/villa/house. In testament to the spirit of the Thai people and the mellow mood on the island, IVL noticed guests often left with a newly energized fondness for Koh Samui. IVL was founded in 2012 by South African born Andy Walmsley and originally started as a luxury villa rental company, though pivoted last year to focus on value for money and offering bespoke holidays supported by the international IVL Concierge team. The spirit of IVL is immediately noticed when entering the IVL office which generates a constant buzz with English, Thai, Japanese, Mandarin, French, Tagalog and Russian spoken by the high energy, international staff. Tips to go greener at home Being purposely green or eco-wise is not just about recycling but caring and being thoughtful for a Healthier Planet. One of the great things about applying good green habits? 90% of the time they’re the more economical options. Being environmentallyfriendly is just good plain economics. Here are some small, easy, green tips we can make in our own homes. •

Lights. These are some basic tips that many people just seem to forget. First turn off lights when you leave a room, in the day open your curtains and enjoy natural sunlight. Switch as many of your normal light bulbs to energy efficient CFL’s or LED’s. If you have outside lights, use a motion detector on a timer. Plastic Bottles. Our world is being inundated with plastic and buying plastic water bottles is not only a huge expense but costs our planet a large amount of resources and produces very hard to degrade waste. Buy some inexpensive reusable water bottles and fill from a returnable water container. You can easily buy some good-looking water containers for the kitchen from the local DIY centres like Home Pro and these are already fitted with a tap for ease of use. You can fill these from the large containers and your saving money and helping the environment. Stop using the plastic bags all the supermarkets give out for free. You can easily buy or make your own reusable bags. Not only are these stronger but you’re doing your bit on conservation. Did you know plastic is the largest source of ocean litter? Ocean debris worldwide kills at least 1 million sea birds and 100,000 mammals each year. Washing laundry in cold water. Most laundry detergents in Thailand are designed for cold water. Reduce your consumption bills and save energy, your washing will be just as clean.

Collect rain water to use for your house plants and in the garden.

Turn your air conditioner up 1 or 2 degrees. You’ll hardly notice the difference until your electric bill comes in.

When you’re buying household appliances look for energy efficient models.

Unplug unused chargers and appliances at night. They will not only last longer but your saving too.

Minimize: Use less, conserve more. What can you use fewer of? Water, detergent, printer paper, etc. just to name a few. Maximize: Use it up, wear it out, make it do, or do without. Basically, get the most out of your clothing, food, energy resources, etc. Shop smarter and buy only what you need. Prioritize: Make time for what matters. Eliminate things that don't. Don't waste time, money, energy, or resources on the wrong things. You all know what’s really important? All do your part and love life and life will love you back.

Samui Midnight Run The date is set for the 5th Charity Midnight Run organized by the Thai Hotel Association (THA) and the Thai Association of Koh Samui (TAKS) on the island of Koh Samui. The run will take place on Saturday 25th March 2017 at Chaweng Beach. Participants will run 5km or 10km around the buzzy and lively streets of Chaweng Beach. The organizers are expecting between 1000 and 2000 participants for this 5th race, proceeds from the event will be donated to some very worthy causes: firstly, to Koh Samui’s new School for Autistic Children and secondly to the Green Project supported by the Hotel Associations. The Mayor of Koh Samui together with the presidents of the THA and the TAKS, along with the PR team of Bangkok Airways and all the participating sponsors will be there to hand out trophies and awards to the winners. Many spectators are expected to turn up to cheer and join in the celebrations as the competitor’s race along the Chaweng beach road and the crowded streets of the Green Mango then cross the finishing line at the Reggae Pub. This Charity Run is set to become one of the main features in Thailand’s calendar of social, sporting and charity events. This is an event not to be missed! The venue for the Charity Run is the shrine to Bob Marley, the famous Reggae Pub located on the banks of Chaweng Lake. For the Midnight Run, the Reggae Pub will turn into a veritable fortress of fun sporting an open-air dance floor with music spun by foreign Djs and a towering two-storey affair with long bars, pool tables and a live-music stage. This will be the place where all runners and supporters will gather to start the race.

Home Fitness Considerations

Home fitness has come along way since the days of the old tummy belt or conveyer belt walking treadmill. Today home fitness is a sophisticated industry with many layers of designs, manufacturers, and categories of equipment. In general, the industry’s offerings are divided into price sectors and consumer sophistication sectors. Lower priced and lower quality equipment is generally sold to what the industry calls “entry level” consumers. This segment is made up of first time home fitness buyers who can be tempted to impulse buy through TV marketing programs or department store sales programs. The “entry level” segment of the market is very large which explains why people are constantly exposed to promotions for this level of product. Higher priced but much more effective, safe, and higher quality home fitness equipment is generally found in specialty shops or health boutiques. When considering the purchase of home fitness equipment the three things to plan for are: 1) your budget, 2) your space, and 3) your intended use and benefits you are looking for. Budget As the introduction hinted at-always buy quality. If you can’t afford the cash outlay use an extended payment plan. Quality means buying from the leading brands found in the best health clubs. Quality means better bio mechanics and ergo metric design. Quality means good warranties, after sales service, and a good secondary market should you want to sell or trade-up later. Quality also means better features, and programs that are equal or even better than those found in the best clubs. Quality means there is a better chance that the machine will not become a permanent clothes rack. Space Depending on what your ultimate goal is space doesn’t have to be a limiting factor. Nearly any condominium or apartment can support a single piece of cardio vascular equipment. The question to ask your self is how do I balance my intended use with the space I have to allocate for home fitness? If you have an unused bedroom you can probably create a complete home gym or share your home gym with a home office. If you are like most people however, you will need to have your treadmill, cross trainer or home gym near a form of distraction like a window with a view or within site of a television to provide exercise entertainment and get you motivated to get off of the sofa.

Intended Use Are you interested in exercising on your own time? Do you just want to burn some fat between trips to the gym? Is the home going to be the primary place you exercise? Are you looking to strengthen and tone? Do you want to have a full body work out. Who else in your family will use the equipment or the facility you make? What ever the answers to these questions there are quality machines to match your space and intended use. Remember if you can’t afford to build it all at once, buy quality and phase your home gym. If you are serious about investing in your health you will regret going the entry level route just so you can get everything at once. Equipment Selection When selecting home fitness equipment you will be looking at three considerations: Cardiovascular Training Equipment If you haven’t determined what is your favorite piece of cardiovascular equipment take your workout shoes with you when you look at equipment and try them all out. Generally in order of popularity cardiovascular home fitness equipment includes: treadmills, elliptical crosstrainers, upright or recumbent bikes, rowing machines, and stair-steppers. Many people who have developed leg problems have found a new lease on life through the development of the cross trainers which have no impact and also provide upper and lower body exercise. Rowing machines are also excellent all body conditioners. Personal Gyms and Multi Gyms Personal gyms are single weight stack strength trainers allowing one person to exercise. Multi gyms have two to four weight stacks and thus allow more than one person to use the machine at the same time. Both types come in different quality and price levels. Some multi gyms are also warranted by the manufacture for sale into the common area fitness centres of apartments, condominiums and resorts. This is generally a sign of a good robust commercial design ensuring safe use and good bio mechanics and user satisfaction. Some personal gyms offer advanced functional training or converging arc design technology. The better quality personal gyms and multi gyms will provide 20-22 different exercises on all areas of the body with easy to use adjustments to change from one exercise to another. Dumbels, Benches and Free Weights. A twin tier dumbbell rack and five to ten pair of rubber coated dumbbells along with a flat to inclined adjustable bench is a nice addition or alternative to a personal gym if budget or space is a problem. However most exercises done with this equipment is upper body specialization of the arms and back. Free weights using olympic bars and plate weights are not recommended for the home environment unless one always has a workout partner and a strong sound-proof floor. Buddhist Monks realised Koh Phangan's tranquillity and spiritual importance and subsequently settled in Wat Phu Khao Noi just outside of the main town of Thong Sala as one of the first temples on the island. Within an area of approximately 167km2 with over 70% being unspoilt mountainous and tropical forest many more temples are nestled coherently within the islands natural flora and fauna offering a feast for the eyes of all visitors. Koh Phangan being relatively undiscovered and undeveloped still has the postcard perfect secluded deserted beach coves awaiting discovery via the traditional mode of transport, the long tail boat or for the more intrepid explorer by hike. LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain

RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.

SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.

SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)

STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area. STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.

STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.

STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.

In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
