EDITOR'S LETTER Sitting at my desk and looking out over Samui’s stunning scenery it is that time again to start composing my editors notes for the next issue. I would like to thank all those that took the time to write and I hope that I did not miss anyone out and replied to you all. Especially I’d like to mention the email from Nancy & Julian, they emailed me from Kent in the UK after spending month on Samui. With mostly only praise for our beautiful island and magazine Nancy & Julian brought up the topic of accidents on Samui. We all came to the same conclusion, sadly Samui seemed to have more than its fair share of accidents and by that, I mean mostly traffic accidents. The Samui Rescue Service is already doing a fantastic job and with the amount of good hospitals on the island you are luckily able to get to the nearest hospital quickly. Our only thoughts were about the “First Responders”, with a general lack of any first aid training most Thai citizens would rather video the event or make selfies with it instead of getting in and helping. With that in mind I had a meeting with Scott H. van Doren, Scott is the #1 Emergency First Response: EFR Instructor in Asia & Worldwide within the EFR organization. Scott has 30+ years of emergency rescue training having served as member of the United States Military’s Special Operation community. Scott later served as a Law Enforcement Officer and a Team member of the Emergency Response Team (ERT), responding to medical and crisis management incidents. Scott is also a H.E.A.T. Instructor with courses conducted at the U.S. Embassy & Royal Thai Police Law Enforcement Tactical Training Centre. Scott is no stranger to Samui and regularly conducts Emergency First Responder courses here. Scott has very kindly agreed to write some articles

How to Paint Your House's Exterior
Living in the Tropics is a wonderful experience with the beautiful weather almost all year-round. But this amazing weather and some of the storms we have plus the sea air do have a big impact on your property. If your house is looking a little tired for the cost of a few cases of exterior paint, plus some patching and sanding, you can have a whole new home A fresh paint job has the power to totally transform the look of your house in less time and for less cash than any other remodelling project. That thin skin of resin and pigment also protects your investment, shielding it from sun, wind, and rain—until the paint begins to crack and peel, that is. Then it's time to button up with a couple of new coats. Properly applied, new paint should last for a good 15 years, provided you use top-quality materials, apply them with care (and with an eye on the weather), and, most important, clean and sand every surface first. Here's what you need to know to get a first-class finish on your home's exterior.

It's easy to paint concrete. Concrete surfaces are common in households, especially on exterior walls and surfaces surrounding the home. Even though it’s rough texture makes it a piece of cake to get fresh paint to adhere to untouched concrete, every so often your concrete needs to be touched up with a fresh coat of new paint, which is a bit more challenging. Repainting concrete surfaces is a bit more demanding than painting freshly-laid concrete. Aged concrete surfaces are coated with various things, such as staining compounds, sealants, and of course older paint, all of which present difficulties. Here's how to update your worn down concrete the correct way. Step 1 - Cleaning and Scrape Prepare a solution of water mixed with any household cleaning chemical. Scrub the surface with a longhandled brush. Allow the concrete surface to dry. Existing paint needs to be scraped and sanded. Scrape any areas with loose or flaking paint, and lightly sand using fine (80 - 120 grit) sandpaper. Lightly sand intact areas of paint as well to give them the grip needed to receive new paint. The painting of the interior masonry surfaces is a little different from painting of the exterior ones. When deciding to paint the exterior of a foundation or exterior masonry walls, keep in mind the unique qualities of the concrete and follow the tips below. One more point: you might want to trim the grass and line the ground around the concrete surface with a drop cloth or something of the sort to protect the surface from picking up various particles.
Painting concrete walls If the surface is damp after cleaning, let it dry completely. Depending on the weather and the surface location, it might take some time. Painted exterior concrete wall It is not necessary to apply a sealer when painting the exterior concrete. However, it is advisable to apply a concrete primer that fills the pores and evens the surface. It usually dries within a few hours. But it is better not to rush and wait for around 8 hours before painting. Professional exterior painting contractors prefer to use exterior paint formulated specifically for concrete applications. It is thicker than the regular paint and has better expansion/contraction qualities to accommodate specifics of the masonry surfaces. However, the regular exterior latex paint should also do the job. Apply a thin coat. Wait for the paint to dry (around 24 hours) and then apply a second coat if needed. Do not try to get it done with one thick coat as besides creating the pools and drips, it will affect the hardiness and protective qualities of the paint. Because concrete is porous, you will need a thick brush and a longer nap roller (3/4″) to apply the primer and paint. Conclusion Exterior painting jobs on concrete walls freshen up a house exterior. Slightly different approach is required for the inside masonry surfaces, especially floors. Remember to apply some effort towards preparing the surface before painting and follow our advice. Any seat with arms counts as a lounge chair and they are made of a variety of materials from laminated wood to powder coated aluminium or a combination of different materials. Lounge chairs come in many shapes and sizes and styles. There are high backs, low backs, Asian style, rattan, plush velvet or fabric that will blend well with your other furniture. Try coupling a matching pair of statement armchairs for a dramatic effect. Classic Egg chair anyone? Danish-Style (lots of nice wood beautifully crafted) or Hygge (coziness) is popular or if you are feeling extravagant, soft leather and a gentle colour tone will make it an ideal place to rest a weary frame or settle in for a good read or a spot of online indulgence and remember, leather always ages well and lasts for years.

Enjoying the Sun and understanding the Essentials of Sun Protection The climate in Thailand is not something that most visitors will be used to. In fact it is often the change in climate that attracts people to such an exotic destination in the first place. Those who are arriving from colder countries will not usually be used to intensity of the sun on the island. This lack of knowledge combined with the desire to go home with a tan can lead these individuals into trouble. Thailand is in the planet’s tropical zone. This means that it is sunny and hot for most of the year. Even during the cool season it will still be hot enough to lie down on the beach and get and soak up the sun’s rays. The dangers of over-exposure to the sun are real and people can develop problems easily. Not only can too much sun lead to immediate problems, but it can also put the individual at risk of long term issues. One of the most common dangers that people experience is sun burn. This occurs because the individual has allowed the sun’s ultraviolet rays to come in contact with the skin for too long. When people have been exposed to the sun for too long it can cause them to develop sun stroke. This means that the body has been forced to deal with more heat than it can manage, and it can become a life-threatening situation. Too much sun tends to make people feel irritable and this can spoil their holiday. Over exposure to the sun can caused people to become confused and lightheaded. This can mean that they are in danger of accidents. Are you a sunscreen expert? I’m certainly not and even though I’ve stayed over in Thailand for close to 25 years my good white English skin will still get sun burn if I don’t protect myself. Most people know they need to use sunscreen but their knowledge ends right there. So, let’s get familiar with the terms SPF, UVA, UVB and PA so you know exactly how you can protect your skin from the sun. For even more enhanced protection, look for highquality products that have an additional protective formula that can keep your skin nourished too! To care for our skin properly and keep it away from the sun, we need to be conscientious of the damaging UVA and UVB rays. They are two very different types of radiation that can damage your skin. To make it simple, remember UVA – A for Aging as these are the rays that age your skin. And, think UVB – B for Burning as these are the rays that burn your skin.

UVA rays cause premature aging UVA rays are responsible for skin aging and wrinkling and can contribute to skin cancer. Because UVA rays pass easily through the ozone layer, they make up most of sun exposure. UVA rays can pass through clouds, glass and especially clothing. You might not be able to feel them but they are there. UVB rays cause sunburn UVB rays are responsible for sunburns and cataracts, and they can affect the immune system. Most importantly, UVB rays also contribute to skin cancer. SPF (Sun Protection Factor) Sun Protection Factor (or SPF) found in our sunscreen products, does not indicate the amount of protection you will get but instead gives you an idea of how long you can stay in the sun before your skin starts to redden. And, everybody is different! SPF ONLY applies to the UVB rays. It does not apply to the UVA rays. SPF products come in various levels including SPF 15, SPF 30, SPF 50 and more. Here’s how they work: for the sake of easy math let’s say that your skin will start to redden when exposed to the sun in just ten minutes. You would take that ten minutes and multiply it by the SPF number you are using. For example, if you are using an SPF 30 product: 10 minutes x 30 (SPF) = 300 minutes or 5 hours. The result of 5 hours is standard for sun protection. PA indicates the level of protection from UVA rays PA (or Protection Grade of UVA rays) is often levelled as PA+, PA++, PA+++ with the more plus signs you see, the more protection from UVA rays. PA+ can protect your skin against low to medium UV radiation. PA++ provides moderate protection against UVA rays, and is suitable for normal skin exposed to medium UV radiation. PA+++, the highest grade of UVA protection currently available, is designed for normal skin that is exposed to very strong UV radiation. And to enhance sun protection while keeping the skin younger and smoother, there are other ingredients that you should be looking for. When you are faced with many choices, opt for one that also contains the following ingredients: Aloe Vera. The healing properties of Aloe Vera can additionally help reduce the pain and inflammation associated with sunburn. It helps moisturize the skin without that greasy feel. Vitamin E is one of the best-known moisturizers for the skin that has become rough or dried out because it helps speed up the healing of damaged skin cells. The powerful antioxidant capabilities of Vitamin E also encourages elasticity by protecting collagen fibres from free radical damage.
Vitamin C is full of antioxidants to protect against free radicals. Aside from lightening the skin, it also helps in the production of collagen which reduces fine lines and keeps skin from sagging. The vitamin C added to a sunscreen also acts as extra layer of protection against the UV rays. Vitamin B3 has been shown to improve the ability of the epidermis, or the upper-most layer of the skin, to retain moisture. This translates to softer, smoother skin with less dryness and flakiness. Now that you understand the terms linked to sun protection, and are familiar with the special ingredients added to give extra loving care to your skin, choosing the sunscreen product that is most adapted to you will be easy! Just remember the basic rule: Always apply sunscreen, whatever the weather, even when it is cloudy. Top 5 sunscreen myths Sunscreen myth #1: There’s no need to apply sunscreen if it’s in my makeup Makeup with SPF is usually applied unevenly. It’s simply not enough coverage to offer appropriate protection, so it’s important to double up on our protection and use a sunscreen as well. Sunscreen myth #2: If your sunscreen says it is waterproof you don’t need to reapply! With the term water resistant, companies must now designate whether the product is protective for 40 minutes or 80 minutes, while swimming or sweating. You must reapply at least every two hours, and even more frequently, if you are swimming or sweating. Sunscreen myth #3: Sunscreens are only meant for certain areas of the body, not everywhere If you have skin that’s exposed, it needs sunscreen. This includes your feet, ears, back, arms, legs and neck. If it’s an exposed body part, it needs protection. Sunscreen myth #4: Sunscreens made for adults are not as protective as those made for children Sunscreens contain the same active sunscreen ingredients whether they are for kids or adults. They can be fragrance free, chemical free, paraben free and more. And many products for kids are tear-free to avoid any stinging of the eyes. Sunscreen myth #5: That bottle from last year is ok to use this year. A good rule of thumb is to not treat your sunscreen as a seasonal product. Nothing lasts forever and sunscreens will lose their effectiveness over time. The sun is a wonderful thing that we all enjoy but the facts are the facts. Unprotected sun exposure is the leading culprit in sun stroke, skin aging and skin cancer. Mitigating Investment Risks in “Off Plan” Real Estate Projects in Koh Samui and Koh Phangnan Whereas property buyers in Europe usually acquire a property which is perhaps built in the 1930s or earlier and has had ten or more previous owners, the likelihood in Koh Samui and Koh Phangnan is that a buyer may acquire a property “off plan”, in other words, a property that has not been built yet based upon plans, designs and images of what the developer intends to build. In recent years the supply of “off plan” properties for sale has increased in all segments of the property market. There can be financial incentives to buy “off-plan” as the price of the property can be less than the value of the same property once it has been completed. Additionally, buyers may be provided with the opportunity to tailor aspects of the property to their particular tastes. Despite the advantages, “off-plan” developments can come with financial risks, and some projects never reach completion, usually as a consequence of financial issues. The good news for buyers is that measures can be taken to mitigate the risks of investing in “off-plan” properties. As a general step, prospective buyers should conduct detailed enquiries into the developer and the project before committing any money to it. Such enquiries should determine (amongst other issues) the financial standing of the developer and the likely ability to deliver a completed project. It is important to raise direct enquiries with the developer to establish how the construction of the project will be financed. Enquiries should be raised to establish whether or not construction finance has been secured from a lending institution and on what terms funds will be released to the developer. Buyers should research any other residential projects that the developer has completed in Thailand by conducting investigations through the internet and other sources and actually visiting the project. Independent enquiries may also be made of the developer to establish what projects the developer has undertaken in other countries. An independent lawyer should be appointed to undertake due diligence into the land title in order to establish that the developer is the legal owner of the project land and that the title to the property has been legally issued in accordance with the laws of Thailand and has full legal rights of access. Further checks should be made through the legal representative to establish whether or not a valid building/construction permit has been issued in relation to the project. Furthermore, it is important for the appointed legal representative to establish whether or not a suitable insurance policy is in place to cover risks during the construction of the project. Buyers should be aware that if the project is not insured properly, there is a risk that the investor will lose their investment in the event of serious damage being sustained to the property or project.

The effective negotiation of the terms of the sales contract can assist the investor to reduce the risk in “off-plan” transactions. The contractual payment terms in the sales contract should link purchase price payment installments to construction milestones so that payments are made as construction progresses. Investors should avoid payment terms which require a large “up-front” payment of, say, 70% of the agreed purchase price before construction commences and instead should seek to negotiate payment terms which allow the investor to make smaller purchase price installments during the earlier stages of construction with a large final payment upon completion and handover of the property. It is important to verify that the construction stage which triggers each payment installment has been duly reached by the developer before the next payment installment is made. Buyers should appoint a surveyor to inspect the progress of construction at each construction stage to ensure that the construction has been undertaken correctly and in accordance with recognized building practices. At the very least, buyers should inspect the project themselves or request clear digital photographs evidencing that the completion stage that triggers payment has been reached before handing over the next payment installment. The sales contract should also require the developer to pay penalties or allow the buyer to terminate the sales contract and receive a full refund of monies paid in the event that construction of the property and communal areas are not completed by a stipulated date, unless an event occurs outside of the developer’s control which causes the delay. In certain circumstances, prospective buyers could petition the developer to register a lease over the buyer’s land plot in favour of the investor as soon as installments of the purchase price commensurate to the value of the land plot have been paid to the developer. In this scenario, in the event that the project fails, the investor will at least have a legal interest in the land plot for their money. Buyers should be aware, however, that most developers will be reluctant to agree to the registration of a lease over the land plot in favour of the buyer because the developer’s rights will be undermined in the event that the investor reneges on future payment installments. This option will not be available to buyers in “off plan” condominium projects and apartment projects because transfer of the unit will not be possible until substantial completion of the project. It is clear that there are some fantastic “off-plan” investment opportunities on offer in Koh Samui and Koh Phangnan the various measures set out above will assist investors to reap the rewards of investing in “off-plan” properties whilst minimising the potential risks. Important Changes to the Work Permit Law Employers and Employees Take Note. Both Employers and Employees should take note of the new work permit regulations and notification requirements which came into effect on 28th March 2018 and affect all employers of foreigners and foreign employees in the Kingdom; including those who are working in Koh Samui and Koh Phangnan. We examine the changes to the work permit law and examine the implications to both employers and employees.
Administrative Changes Under the old laws, an application for a work permit was required to be made in person, in Thailand, at the Department of Labor. According to the new laws, it is now possible to submit an application for a work permit electronically either within Thailand or from overseas. In addition, the issuance of a work permit will not exceed 15 working days.
The New Regulations The latest amendment to the Emergency Decree on Managing the Work of Aliens 2017 enacts a number of key amendments to the work permit law: Foreigners who enter Thailand occasionally for the purposes or organizing or attending meetings; give opinions, give lectures or provide talks, participate in training sessions, tour, seminar, art or cultural exhibitions, sports competition, or other purposes prescribed by the cabinet; are no longer required to obtain a work permit. These changes are in-line with other developed countries which do not require any special permissions to attend such events. Secondly, foreigners who enter the Kingdom to engage in business or investment; or who have skills which will help improve the country, subject to certain specifications, will also be exempt for the need to obtain a work permit. Thirdly, representatives of a foreign entity which is granted a foreign business license pursuant to Thailand’s Foreign Business Act shall also be exempt from obtaining a work permit.
Definition of “Work” The legal definition of “work” has been narrowed to “performing any profession, whether or not there is an employer, excluding business operations of a foreign business license’s holder under the Foreign Business Act”. The previous definition of work was “exerting one’s physical energy or employing one’s knowledge to perform a profession or perform work, whether or not for wages or other benefits”. New Reporting Requirements of Employers and Employees An employer is now legally required to notify a work permit official of a foreign person’s name, nationality and the nature of the work undertaken by the employee; within 15 days from the employment date. At the end of the employment period, the employer is legally required to notify a work permit official of the cessation date of employment. A failure to comply with the reporting requirement may subject the employer to a fine of up to 20,000 Baht.
Employers who have already engaged foreigners on 28th March 2018 are subject to the same reporting requirements on or before 26th May 2018. Any existing employers who have not been aware of the changes until reading this article should comply with the reporting requirement as soon as possible. In addition to the new reporting requirement by the employer, a foreign employee is required to notify a work permit official of their employer, work places and nature of their work within 15 days from the employment date; and on every occasion that the foreign employee changes their employment. A failure to comply is subject to a fine of up to 20,000 Baht. Penalties Finally, penalties for working without a work permit have been weighted more against the employer than the employee. Under the former regime, a foreign employee working without a work permit (or outside of the scope of their work permit) was subject to a penalty of up to 5 years in prison and/or a fine of up to 100,000 Baht. Under the current penalties, the maximum penalty is only a fine only of between 5,000 Baht and 50,000 Baht. Conversely, an employer who under the old regime was subject only to a fine of up to 400,000 Baht for employing a foreigner without a work permit, is now liable for a custodial sentence of up to 1 year for repeat offences and may be prohibited from employing foreigners for 3 years. Both employers and employees should be aware of these new regulations and ensure that their business is in full compliance with the new laws and regulations and further ensure that internal procedures and processes are altered to accommodate these changes. 有关工作许可证法律的重要变更 - 雇主和雇员须知 所有雇主和雇员都应该知道在2018年3月28日生效的工作许可证新法则和汇报规定,因其影响到 泰国境内所有外国雇主和外国雇员; 包括在苏梅岛和帕干岛工作的外国人。在此我们审视新工作 许可法的变化,并评估对雇主和雇员的影响。 新规定 对于 “2017年管理外国人工作紧急条例” 的最新修正案,针对工作许可法进行了若干重要修订: 凡偶尔进入泰国组织活动或参加会议的外国人; 提供意见、演讲或会谈,参加培训课程、旅游、 研讨会、艺术或文化展览,体育比赛或其它经内阁许可的活动; 将不再需要申请工作许可证。这 些修订与其它发达国家一致,不再需要任何特殊许可即可参加此类活动。第二,进入泰国从事商 业或投资的外国人; 或具备有助于改善国家的技能,在符合某些规范的情况下,可以免除申请工 作许可证。第三,根据泰国“外国商业法”而获得外国营业执照的外国企业代表亦得以豁免工作 许可证。 行政变更 根据旧法,申请工作许可证必须由本人亲自在泰国劳工部提交申请。而现在依据新法,则可以在 泰国境内或海外以电子方式提交工作许可证的申请。此外,工作许可证的发放将不会超过15个工 作日。 ”工作“的定义 “工作”的法律定义已缩小为“无论是否有雇主而行使任何职业。但不包括根据『外国商业法』 取得合法营业执照的业务活动”。以前”工作“的定义是“发挥个人的体能或利用个人知识来执 行专业或从事工作,无论是否有工资或其它利益”。 雇主和雇员的最新汇报规定 现在,法律要求雇主在雇用外国雇员当日后的15天内,向工作许可处官员通报该员的姓名,国籍 和雇员所从事的工作性质。并在雇用期结束时,亦应依法向工作许可处官员通报该员终止工作的 日期。 如果不遵守汇报规定,雇主可能会被处以最高20,000泰铢的罚款。 若在2018年3月28日以前已聘用外国人的雇主应在2018年5月26日之前依汇报规定提报。而任何在 阅读本文之前未知新变更的现有雇主则应尽快遵守汇报规定。 新汇报规定除了对雇主外,外籍雇员亦须在被雇用日期后的15天内向工作许可处官员通报其雇 主、工作地点和工作性质; 此后每次外籍雇员改变其工作时均应遵循此法。不遵守规定的,最高 可处以20,000泰铢的罚款。 惩处 最后,对于没有工作许可证而工作的惩处,雇主的程度将高于雇员。根据前政权规定,在没有工 作许可证(或在工作许可证规定范围之外)而工作的外国雇员可被处以最高5年的监禁和/或最高 100,000泰铢的罚款。而目前的新规定,最高罚款仅为5,000泰铢至50,000泰铢之间。相反的,根据 旧制度的雇主,如果雇用没有工作许可证的外国人,只会被处以最高400,000泰铢的罚款,现在则 可以对累犯处以长达1年的监禁,并可能被禁止雇用外国人长达3年。 雇主和雇员都应了解这些新规定,以确保其业务完全符合新的法律规范,并应进一步确保内部程 序和流程修正以适应新的变化。 本文由LIMCHAROEN LEGAl(SAMUI)律师TANUN RUNGWIWAttANAKOOl撰写, 请致电0935759675联系我们的苏梅岛办事处或发送电子邮件至SAMUI@LIMCHAROEN.COM 中文翻译:方良玉 JADE FANG 电话:0818938366 邮箱:jADE.YU5566@GMAIl.COM

在泰融资-最简化 For many things in life, individuals often prefer the easy route, the simple way, the absolute minimum to get something done. This can sometimes be construed as a cheaper, less efficient and lessor quality way of doing... but, on occasions, this is all that is needed to just, get that something done, the absolute minimum effort, to achieve a desired result. Thailand property finance applications are often considered as one of those things that never seem to end with no application requiring a minimum set of paperwork, only “extra” paperwork. One might only know the exact terms, conditions and repayment schedule forecast after, submitting several books of documents over several trips to the bank over several weeks/ months. It’s almost like a lucky dip entry when you don’t really know what you are applying for OR what you are going to end up with. Document submissions can be entered into the “raffle” and then a request for more documents is requested, then again, until eventually a conclusion is reached which may not even be anything like what is even remotely affordable or, finally and worse still, a rejection. The average buyer/ investor of property in Thailand, usually wants to know from start to finish exactly, what is the minimum amount of effort needed to get the job done plus, what is the likelihood of success if spending valuable time to go through a process. On the flip side, a lender also may wish to do the absolute minimum in order to “get the job done” since, is going to be more cost effective from the company perspective. It’s funny when occasionally asked the question over the years from a possible client, “Please make the process as easy as possible, I not want to waste any time” … I am sure the lender (whether Thai or Westerner staff) prefers to give the alternative difficult option… and enjoys spending their time requesting documents just to eventually say sorry, no can do…

Let’s take an absolute minimum condo loan for example and the documents required in order, to get the job done. A lender might prefer to have a condo that meets minimum criteria. For example, no less than a 50,000 Sq.m. valuation price and preferably condo’s less than 10 years old. The lenders wish is to make their lives easy by having newer, less maintenance projects on the books being more easy to promote for sale & liquidate, if need be. A lender might also have an absolute minimum loan size in order to make sure it is worth their while or being more direct, profitable. Promoting a minimum loan size of THB 1,000,000, the absolute minimum might be THB 750,000 but not worth advertising this part since is more effort, than it is worth. The odd small loan here and there is ok. Let’s now take the absolute minimum loan size of THB 750,000 as an example and what absolute minimum documents are required, in order to approve a loan and complete a process. For this example, we shall also assume the loan size represents no more than 60% of the valuation price (THB 1,250,000) and this is Refinance of a condo a client already bought and paid for and is living a single life without ever being married since, is only the minimum age of 18 also.

For this example, THB 750,000 over a 10 year term with a 50% balloon payment schedule gives the client an absolute minimum monthly instalment of just THB 7,900 therefore; income evidence should be THB 23,700 per month (3 times the instalment). The absolute minimum documents required above is only 7 since, proof of address maybe “ticked off” with a bank statement and the valuation report is done by the lender anyway. In summary, a minimum loan of THB 750,000 will cost a minimum amount of THB 7,900 per month and will take an absolute minimum of around 12 – 15 working days from start to finish before cash can be given to the borrower, by the lender, to spend as they please. A very straight forward and easy process to follow and is almost certainly going to be approved. Remember, a quick and easy “minimum size” loan is preferred to be quick by the lender, having an absolute minimum size loan hardly worth any effort dragging on over months might probably end up at the back of any pile of applications, ready to process.

As we get older, life gets more complicated therefore, the absolute minimums change. If we get married, we need spouse consent to borrow and mortgage in Thailand, if we get divorced and the lender know about it, we need the divorce certificate to show land office, if we own property through company structures, company paperwork is required including a breakdown of each shareholder, if we are self-employed and set up various offshore companies to receive income, different paperwork is required again. The big complication is when we borrow using Thai companies since all paperwork is in Thai and if unable to read or write Thai, are reliant upon Thai parties to help the process. The logical western way of doing business than, gets mixed with the Thai way of doing business. There is however still an absolute minimum level of effort required in order achieve the result, no matter how big the loan size OR how old and life complicated, the situation is. Let’s now look at a THB 100,000,000 penthouse and look at the minimum documents required for a THB 50,000,000 condo loan. Assuming a similar scenario although, perhaps a little older client (age 50 male) and married, the only thing that really changes are the numbers and spouse paperwork. The instalment goes up to THB 532,800 per month therefore is easier if at-least THB 1,598,400 income each month can be evidenced. The difference this time is that we can include the spouse income as evidence also. The time taken to receive the cash may take a little longer due to the loan size and is subject to when the board’s monthly meeting is although usually, should still be completed within 20 working days.

Last year I started building my house and one of the major decisions was about the roof. The decision here had to be made not only for aesthetics but also cost and durability & function.

be quite a bit of price differences between the building supplier, plus make sure delivery is included.
After looking around there was only two real choices, standard heavy tiles or synthetic roof sheets. The first choice was the regular heavy roof tile. Available in many styles and colours the normal roof tile is durable and looks good. Using a quality heavy roof tile will add value to your house and make reselling if that was a later option easier. I would consider this the first choice of many home builders especially if they are foreigners. But they do have a downside for tile is extremely heavy, and so requires a stronger m etal roofing structure which is expensive. These roofing tiles will also crack if walked on or placed incorrectly in a stressed position. The prices are normally reasonable and the choices huge, but you will find that the roofing companies sting you over buying the specialty tiles, such as corner and edging tiles. These tend to be much more expensive than the standard tiles. So, cost would depend much on the actual style of roof being used with the tile. If your scouting for prices then make sure your architect has given you exactly which tiles you require and amounts for costing as you will find there can
Synthetic roof sheets: There is still much negative stigma about synthetic roofing sheets. I would have agreed some of this maybe a decade ago but now the quality of synthetic roofing sheets has improved tremendously. Choices and styles have been upgraded and some are made with a thin layer of insulating material on the underside, giving the house a better insulation factor. Materials are safe, strong and light and the biggest advantage is price and ease of application. Do they look as good as normal roofing tiles, probably not really, but then again the other positive factors are convincing. So, for my house what should I choose? I was not interested in resell value and on calculating the differences in cost and durability I picked the synthetic roofing sheets, in white with insulation. This is one of those rare instances where paying more money would not have led to an increase of quality. If I were put on the spot and had to answer the question, 'Which roofing material I consider better quality?', it would be 'Synthetic roof sheeting'. Aesthetics? Maybe the heavy roof tiles win here but I was cost motivated and I used the synthetic sheets and I’m very impressed with the result. While we are looking at roofing options I wanted to pick up on two more points; insulation and guttering. Both important and should be chosen with the roof itself. We will look more closely at both in later issues.

It’s a powerful sight and any last drops of tension you may have had from travelling will be washed away in that moment. You will feel like stopping right there but as you follow the path the next set of steps will take you into the very-well equipped gym with several exercise machines, Kinesis workout stations and free-weights to keep the fittest person more than happy. Entering the upper level of the villa through the gym allows you the first glimpse of the extraordinary views over the cove and beach at Tongson Bay which is a just a few minutes away. This is the east wing of the villa where you’ll find the sunrise swimming pool and Sala. And you will want to drop whatever you’re doing and jump straight into the pool but take a moment to look around the villa behind you, beside the gym is the sauna and changing room and around the pool there are ample sunbeds, out-door sofas and daytime living space. The huge living room has large comfortable sofas, a wide-screen TV with all the movie, sport and news channels you would expect and a dining table seats eight which can easily be moved to the poolside for evening dining if you wished. All around you’ll be captivated by the lush greenery and manicured gardens. On the upper east wing is the masterbedroom and the second bedroom. Both of these have their own balconies and face the sunrise. On the outdoor terrace in-between these two bedrooms is a glorious Jacuzzi that of course overlooks the ocean. The master bedroom has an entrance hall and a magnificent bathroom with an in-laid terrazzo bathtub and modern shower. The spacious bedroom has a four-poster bed overlooking the sea. All four of the bedrooms are air-conditioned and have fans, flat screen TV’s, built-in wardrobes, a safe and soft seating. They are all equally spacious and designed with comfort, quality and wonderful views in mind. As you’ll see throughout the villa, the floors, beds, bannisters and much of the furnishings are made from beautiful teak wood. Moving along the walkway to the west wing you’ll see the shining golden Big Buddha statue and the long curving bay of Big Buddha beach which leads through Bangrak village and down to Fisherman’s Village which hosts dozens upon dozens of restaurants, bars, shops, market stalls and the famous Friday night Fisherman’s Village “walking-street”.

of Prego at Amari Koh Samui It is with great pleasure that this issue welcomes Marco Boscaini, Executive Chef of Prego Restaurant and Amaya Food Gallery. I’m quite sure it’s around 15 years we have been enjoying not only Chef Marco’s excellent cuisine but also his warm friendship and hospitality. Not a surprise that Marco is one of Samui’s longeststanding chefs and expats. So, on the search for some of his secret recipe tips, Samui Phangan Real Estate had to find out more.
Marco, welcome to our Island Scoop section of Samui Phangan Real Estate. Could you first tell us a little about where you were born, grew up and what you did before arriving in Thailand? I was born in Varallo Sesia, a small tourist village in Piedmont in northern Italy. After my studies and military service, I started my journey as a cook’s assistant in a small restaurant where I refined my skills as a cook and later ran a restaurant of my own for three years. At the age of 30, Thailand called, and I decided to try a new experience. Was Prego your first restaurant in Thailand? It was in 1996 when I was called to conduct training on Italian cooking in Thailand. I worked in some restaurants in the kingdom before reaching Amari where I was given the opportunity to work as the head chef a new restaurant in Samui called Prego.
Have you been Prego’s chef since the beginning of the Amari restaurant? It was 2003 when Amari decided to open Prego and I was part of the project from the beginning – from looking at the construction site, to planning the kitchen, hiring the staff and training them. It was an exciting time that continues through today. The last 15 years has seen many changes on Samui. What was it like for you back then? Fifteen years ago, Samui was an island not yet very well known, with not many facilities or large hotel chains, so even finding authentic products was really a challenge. Many products were sent to me by air and I personally picked them up at the airport. What changes has Prego gone through in these years? Prego was immediately a point of reference for Italian cuisine in Samui, and was a great success for all of us. Over these years, we have experienced many changes, including the development of the island, which has brought more suppliers so many products can now be purchased on site. Additionally, we had the great renovation of the restaurant two years ago, which provided additional comfort to our customers with a new bar and lounge, two air-conditioned dining rooms, the new al fresco dining room, as well as totally new kitchens with the most advanced equipment imported from Italy! samui phangan real estate

Now you are also looking after Amaya Food Gallery. Can you tell us something about this? I can say that this has been a process of growth for me. After many years at Prego, with the total renewal of Amari Koh Samui two years ago and the creation of Amaya Food Gallery, I have had the opportunity to experience different cuisines, not only Thai but from other regions of Southeast Asia too. With our open kitchens, our customers can not only enjoy local and regional dishes, but also see their preparation. One of my personal reasons for always visiting Prego, apart from the amazing dishes, is the service of your staff. I think I’ve even complimented you on it before. What is Amari’s secret to such excellent quality of staff? This is another part of our success. Amari is famous for forming excellent elements; and at Prego, this is amplified by our team attitude and being proud to be a part of a great experience. Constant training makes the difference and helps the team to grow. What does the future hold for Prego? Prego always has an eye on the future. Our Prego free flow of Peroni beer and Italian Tapas on Fridays starts in September, and the Resident Dining Card (an instrument that many residents use constantly) are all elements that help us to look towards the future with a smile. It seems that when I come to Prego, you are always there! Do you actually have any time off and what do you do for recreation on Samui? Really? I do my job enthusiastically and it is a pleasure for me to be a part of Prego. As for my free time on Samui, I just relax with good music or a good movie, and certainly visit restaurants and wine bars. What would be your favourite dishes? One meat and one pasta? If I had to choose a meat dish, definitely Saltimbocca – thin slices of veal covered by a slice of Parma ham and a leaf of sage with a jump in a cooking pan. The pasta? Do not ask me this. I was born in the middle of fresh pasta, so when we talk about pasta – if it's home-made, anything in every sauce.
Do you have a secret Italian cooking tip for our readers? Something where you know most non-Italians would go wrong? Surely, talking about cooking pasta, remember the famous 10,100, 1,000 – that is, in a litre of boiling water, 100 grams of pasta and 10 grams of salt. This is a simple rule to remember. Keep in mind that the salt is thrown in the pot when the water boils, immediately followed by the pasta. Tonight, you are going out with friends to enjoy a good meal in a non-work environment. Where do you go and what do you choose? Spending a lot of time with the Italian flavours of Prego, I would opt for something simple but of quality. It could be a nice dinner in a cosy small restaurant looking at the sunset or certainly an aperitif at Drink Gallery fol- lowed by an evening at Stacked, where there are not only hamburgers but many other culinary surprises.

help We are starting a series on “Responding to Medical Emergencies outside of the home or office”. You’re sitting in the cinema watching the latest Hollywood “Action” movie and the hero runs into a burning building, or pulls a lifeless body out of the car that’s on fire. All without getting a scratch or cut. Incredible! Yet, if we STOP and THINK about it, how likely is that going to happen in real life? Not very likely, right. Medical emergencies happen. Often, the first person to arrive is a family member, a co-worker, or a friend - someone like you! Would you know what to do? Would you know what the first step is when responding to a medical emergency outside the home of office? Unlike Hollywood movies, we don’t start by running into burning buildings or pulling people out of cars that are on fire. We actually start, by STOPPING. When a medical emergency happens the very first thing we should do is STOP, professionals included. Yes, STOP! . I’ll explain why in just a moment. One of the most important skills you’ll learn in any First Person on Scene (FPOS), Emergency Responder, EMT, or CPR First Aid training course is that you conduct a “Scene Assessment”. It is critical that you “Assess the Scene” for hazards before you procede with a “Patient Assessment” or Triage. Your safety comes first. This is why we start with, STOP, THINK, ACT! This means as the first person on scene or even arriv-

ing after others, you need to STOP and conduct a “Scene Assessment“assess” for HAZARDS. Just because others arrived before you, doesn’t mean they have conducted a “Scene Assessment”. Remember, you and only you are responsible for your safety. In order to safely provide pre-hospital life-saving care you must be able to remain safe, so in otherwords your personal safety comes before anything else. STOP and THINK about it. What if something happened to you while you were providing care to an injuried person, because the scene wasn’t safe? We now have two victims and help isn’t going to arrive anytime soon because EMS hadn’t been called. It may be several minutes before someone even discovers the scene and maybe, just maybe gets involved. This is what professional Responders are taught from basic to advanced training. STOP, THINK, ACT! 1.STOP – Assessing the scene starts with asking yourself, “are there any HAZARDS, or any CLUES as to what happened?”. The most common Hazards are: Fire, Wire, Gas, Glass, and Animals. - Fire – Is there something burning, something smoldering (starting to smoke)? - Wire – Are there any downed electrical lines? Is it a car accident with fuel leaking? Did you know that automobiles have a “wiring harness” consisting of thousands of meters of wires? If damaged these wires could possibly ignite a fuel leak.
- Gas Is there leaking gas, either fluid or vapors. Leaking fuel from a car or motorbike in an accident? What about a gas “vapor” leak from the propane cylinder connected to the stove. Maybe a faulty regulator? Not only is this a potential hazard for a fire or explosion, but it could become an oxygen depletion hazard causing you to “pass-out”. - Glass Do you see any broken glass? - Animals Did you know Thailand has more than 30 species of venomous snakes and they are not just in the countryside. There are on the islands and in the city. 2017 was the start of a rabbies outbreak here in Thailand, and the number are increasing. Have you had your pet(s) vaccinated? 2.THINK Formulate safe action plan with “Can I remain safe” in mind. Your safety is the first priority and so is knowing your limitations. Unlike the movie heroes, we don’t have an “S” on our chest and a red “cape”. Do you know the number for EMS? (We’ll talk more about EMS in Thailand later. What you think it is and what it really is). Can you secure an AED? 3.ACT Begin providing care. Follow the emergency care protocols you learned with your last Responder training
course. Always continue to monitor the scene for your safety and the safety of others as you are providing care. It only takes seconds for a scene to turn life-threaten for the Responders. If it’s been several years since you last attended an internationally recognized CPR First Aid Training course, or maybe you’ve talked about going but haven’t made the time yet. There is NO better time than now. WHY? The latest statistics tell us 80% of those certified in CPR more than 3 years ago, cannot perform CPR effectively! How many of those responders can even conduct an effective assessment of an injured or ill person to determine if CPR was even necessary? You would be surprised. How to Use PTFE, Plumber's Thread Seal Tape PTFE tape or plumber's tape is a polytetrafluoroethylene (PTFE) film tape commonly used in plumbing for sealing pipe threads. The tape is sold cut to specific widths and wound on a spool, making it easy to wind around pipe threads. It is also known by the genericized trademark Teflon tape. Applying pipe sealant properly helps prevent fixing leaks later. PTFE tape provides the necessary sealant and lubrication for pipe threads and is an alternative to sometimes messy pipe dope. PTFE tape is a thin, flexible, white tape used when screwing a fixture or hose onto a water pipe. Wrapped clockwise around the pipe's threads, it seals any tiny breaks in the threading, helping to prevent leaks. While this tape seals the connections, it is not a permanent installation. When changing a shower head or hose, the lingering remnants of the old tape should be completely removed before applying new tape to the pipe's threads. PTFE tape comes in a variety of colours, but it is the standard white tape that you will find normally in Thailand. The white tape is suitable for basic water piping jobs while other common colours, such as yellow tape offers double thickness and is used for gas piping and green tape offers triple density for oxygen piping.

1. Clean the threads to remove any dirt, grease or pipe dope. 2. Dry the threads with a paper towel. Get in between the threads to remove all water from the threaded end. Alternatively, allow the pipe to air-dry thoroughly. 3. Wrap the tape around the threads, applying it in the same direction as the threads. This is important because you don't want to be loosening or bulging the tape when screwing in the connecting piece. Start at the second thread and work towards the pipe. Use a finger to hold it against the second thread as you wrap it around the pipe. Overlap by approximately half of the width of tape, but be sure not to put on too much. Use enough pull that you are still able to clearly see the shape of the threads and there are no loose sections. Continue a little beyond the last thread. 4. Cut the tape and press the tape end against the threads. 5. Screw the new shower head, hose or tap in the same direction as the tape -- clockwise. Hand-tighten, then test the connection by turning on the water. If there are any leaks, gently tighten with a wrench and test the connection again. Avoid overtightening; you could damage the pipe's threads. Plumber's tape is used only on water pipes; never use it on a gas connection. Plumber's thread seal tape can be convenient in some situations, but care needs to be taken to wrap correctly with the right amount of tape. The alternative to the tape is pipe dope, which remains soft, spreadable and easy to see if you applied enough to the right spots. This can sometimes be a much quicker and more convenient option than tape. Which Direction Does Plumbers Tape Go? As you unwrap the plumber's tape, you may have a sudden brain lapse about which way the tape goes on the pipe. The plumber's tape goes onto the pipe in the same direction as the new shower head or fitting -clockwise.

Buddhist Monks realised Koh Phangan's tranquillity and spiritual importance and subsequently settled in Wat Phu Khao Noi just outside of the main town of Thong Sala as one of the first temples on the island. Within an area of approximately 167km2 with over 70% being unspoilt mountainous and tropical forest many more temples are nestled coherently within the islands natural flora and fauna offering a feast for the eyes of all visitors. Koh Phangan being relatively undiscovered and undeveloped still has the postcard perfect secluded deserted beach coves awaiting discovery via the traditional mode of transport, the long tail boat or for the more intrepid explorer by hike. You truly feel that you are the first to leave a footprint! In that vein Koh Phangan's beauty is emerging as an attractive destination for weddings and events. Due to Koh Phangan's granite structure, there are several small mountains where it's possible to trek/hike. The highest being Khao Raa at over 600m above sea level taking 2-3 hours to realise the summit. There is a bounty of wildlife from monkeys, wild boar, exotic reptiles to stunning birds of paradise not forgetting the spectacular coral reefs that envelop the plentiful bays where the amazing underwater world is accessible for snorkelers and divers equally.

LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain
RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.
RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.
LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.
GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.
SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.
SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.
LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)
STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area.
STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.
STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.
STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.
In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
