7 GREENS ON SAMUI The Tourism Authority of Thailand (TAT) and the Thai tourism industry are jointly pursuing ‘green initiatives’ in an effort to maintain the delicate balance between tourism promotion and environmental protection to ensure long-term sustainability.

“The growing concern worldwide over global warming and climate change has led to dramatic changes in consumer attitudes, travel patterns and trends,” says Ms Sasi-Apha Sukontarat, Executive Director of TAT’s Product Promotion Department. “It is influencing individual choices regarding travel destinations, the length of trips and other factors such as the availability of environmentally-friendly modes of transport and environmentally-responsible service providers." Koh Samui has been selected for a pilot project as part of TAT's 7 Greens initiative. The aim being to force the island to address important sustainability issues and correct mistakes in order to attract more visitors by protecting and enhancing the environment and enriching the tourism experience. A seminar was held late Janaury to set an agenda for action, with members of the local and foreign community coming together to discuss options and proposals.
THAILAND LOOKS AT TOURISM BOOST
The Thai Tourism and Sports Ministry recently proposed a number of recovery measures to draw visitors back to the Kingdom. The proposals include waiving visa fees, slashing air fares, and cutting airport charges.

Tourism generates 6-8 per cent of the annual GDP, but the global economic crisis and last year's eight-day closure of Bangkok's two commercial airports has had a serious effect on visitor numbers. As part of the revival plan, the Ministry will urge Thai Airways International and other carriers to cut fares by 50 per cent to encourage more advanced bookings. It is also urging the government to waive visa fees for tourists from all countries for six months, with a possible extension of a further six months. The ministry has also asked the government to reduce VAT on hotel rooms for one year, and is asking the Airports Authority of Thailand to cut landing fees at the country's international airports to persuade more airlines to increase flights.Banks, meanwhile, will be encouraged to extend debt-repayment periods for operators in the tourism sector for three years. The Cabinet has already approved a 1 billion Baht fund to help tourism-related business, but more funding will be needed to support the recovery effort. According to Prakit Chinamourphong, President of the Thai Hotels Association, 3 and 4 Star hotels have also planned to discount room rates by 50 per cent for people visiting the country in February and March.
PAC REBOUNDS Koh Phangan Animal Clinic is rebuilding after arsonists destroyed the previous treatment centre on the island back in August. Members of the PAC team are now recovering and gaining the support of the island community through a vigorous campaign that has involved all eleven temples on Koh Phangan, as well as attending district meetings and gaining public support. The group is hoping that the support of the community will give them the protection against whoever set out to bring down their efforts to help the animals.
The clinic, which has been open since 2001, is run by volunteers and vets who have been treating stray animals all over the island with the help of donations. After several years of fund raising, the clinic finally reached completion phase and was fully operational when the building was destroyed by intentional fire. Police on the island and in Suratthani have been involved in the investigation but no arrests have been made. PAC has taken matters into their own hands with the decision to publicly denounce the attack and gain the support of the community. board and predictions estimate a further drop of 20% in 2009 due to the restrictions on credit and consumer sentiment, while the value of Sterling has fallen 25% against the dollar. Meanwhile, in the US, the Dow Jones index dropped 34% in 2007. With increasing real estate foreclosures, US house prices also dropped significantly in 2007 and some states are predicted to drop a further 25% in 2009. Furthermore, in Hong Kong, the Hang Seng Index dropped 44% in 2008, while in the property market, home prices have already fallen 20% and analysts are expecting them to fall a further 20% over the next 12 months. The Upside While all the news from worldwide economies appears gloomy, the resort property market in Koh Samui is in a unique position for 3 reasons. Firstly, the Thai resort property market has already been flat for the past 3 years since the 2006 coup that ousted Thaksin from power. The effects of the global recession have been less pronounced because much of the pain has already been felt and factored into the market; prices have already dropped to reflect the circumstances. The global recession has simply prolonged a market characterised by weakening demand and market sentiment.
According to CondĂŠ Nast Travel Magazine, Thailand was voted the 4th most popular worldwide tourist destination recently and within Thailand, the principal resort destinations were named as Koh Samui, Phuket, Pattaya and Hua Hin. While Pattaya and Hua Hin attract a number of Thai buyers for luxury condominiums and villas, due to their proximity to Bangkok, the luxury resort property markets of Koh Samui and Phuket are almost entirely dependent on non-Thai or foreign buyers. For this reason, Koh Samui and Phuket are more influenced and exposed to what is happening in foreign economies. And foreign economies have been severely affected by recession.
Secondly, unlike in the US and Europe, property owners are not struggling to meet mortgage payments because mortgages are virtually unknown for non-Thai property owners. Buyers have used cash to fund their investments so it is not a market meltdown like in the US or Europe. Thirdly, with Koh Samui being among the top resort destinations in the world, it should be among the first to benefit as world economies and tourism recovers.

The Results Looking at the specific effects of the global recession on Koh Samui, there are fewer enquiries and reduced buying activity across the board, from low to high end properties. In addition, agents are reporting low numbers of enquiries and limited transactions. This is because resort properties are a discretionary lifestyle purchase, as opposed to investments that meet the immediate needs of the working population. It is also because potential purchasers that do have cash to invest are not making commitments due to uncertainty about how long this recession will last. Lower tourist numbers and hotel occupancy rates are also a factor as people scale back their holiday expenditure, especially Europeans who are taking cheaper holidays closer to home instead of exotic far-away destinations. There is a close correlation between tourist numbers and resort property sales, so naturally, this has impacted the property market. Property prices are flat. Some developers are putting projects on hold or scaling down due to demand or cash flow concerns. In cases where individual property owners or developers urgently need cash, prices are falling to find a market. Therefore, selective bargains are available for investors looking to pick up assets and lock in prices for when the market recovers. Buyers that are in the market are seeking bargains or excellent value for money, such as new high specification villas previously selling for Baht 19M that are now on the market for 12-15M. Gone are the days of excessive pricing models or fantasy asking prices. In fact, the Thai government is looking at measures to stimulate the tourism and property sectors. Property Leaseholds Lease Renewal Options
Enhancing the Security of Leasehold Investments in Koh Samui and Koh Phangan The legal restrictions in Thailand relating to the ownership of freehold land by foreign investors are well documented. In response, many foreign investors elect to acquire a leasehold interest in the land beneath their properties as an alternative to freehold ownership; indeed, many developers now only offer a leasehold ownership structure to their customers. Christian Glanville, lawyer and Partner at Belmont Limcharoen (Samui) examines leasehold ownership in Thailand and examines ways in which a foreign investor can enhance the security of their leasehold investment through awareness of some of the main issues which can undermine leasehold investment structures.
The Basic Principals of Leases in Thailand It is a popular myth amongst foreign investors new to Thailand that 90 year leases or even perpetual leases are available in Thailand. The correct position as it currently stands in Thai law is that a registered lease to a foreigner is limited in law to a term of 30 years. Section 540 of the Civil and Commercial Code of Thailand states that: “The duration of a hire of immovable property cannot exceed 30 years. If it is made for a longer period, it is to be reduced to 30 years. The aforesaid period may be renewed, but it may not exceed 30 years from the date of renewal”. Accordingly, Land officers at Provincial Land Offices will refuse to register any lease with a term of more than 30 years. From an investment perspective, a limited basic 30 year lease is not a particularly attractive investment opportunity as any capital appreciation is offset by the ever diminishing remaining term of the lease and the capital appreciation in the land value vests in the freehold land owner who shall re-possess the land at the end of the lease term.

One solution available to foreign investors in order to allow them to occupy the leased land for a term of more than 30 years is to secure a contractual promise from the person or entity granting the lease (known in law as the ‘Lessor’) to grant contractual options to the foreign investor allowing them to renew the lease term for multiple (usually two or three) subsequent lease terms of 30 years each. As set out above, the provisions of Section 540 of the Civil and Commercial Code expressly allow the renewal of leases for subsequent terms of not more than 30 years. The lease renewal option usually takes the form of a series of provisions in the lease agreement stating that immediately upon the expiry of the initial registered lease term, the parties to the lease shall immediately register a new lease on precisely the same terms for a further term of 30 years or the longest registerable lease term at the time of each contractual renewal. The rental for each contractual renewal is usually limited to no more than the costs of registering the subsequent leases. Please note that familiarity with the acceptance of certain provisions at the time of registration of the lease by the relevant land officers in Koh Samui is necessary to ensure appropriate and secure registration.
Major Issues which could undermine the Lease Renewal Options Whilst lease renewal options are a legitimate means for foreign investors to acquire an interest in land in Thailand, foreign investors must ensure that the provisions for the renewal of the lease are as robust as possible and that the procedure set out in the lease agreement for the registration of the lease renewals is clearly defined. The identity of the Lessor in leasehold structures is an important consideration for foreign investors and can have a significant impact upon the likelihood of the lease being renewed at the end of the initial 30 year term.
If the Lessor is an individual, it may not be possible for the foreign investor to enforce the lease renewal options against the heirs of the Lessor in the event that the Lessor dies during the initial 30 year registered lease term. A contract is usually only enforceable between the parties who originally signed the contract and consequently the heirs of the Lessor will not usually be bound by the promise made by the Lessor a generation earlier. Foreign investors should consider through planning that a Lessor who signs a lease at the age of 40 years old must reach the age of 70 in order to effect the first renewal and 100 in order to effect the second renewal. A foreign investor can significantly strengthen the security of the lease renewal options if the Lessor is a limited Thai company. Legally speaking, a limited Thai company is a “legal person” in the sense that it can be sued in the same way as a living person if it fails to perform its obligations under a lease contract, however, unlike a living person, a limited company cannot die or disappear.
Notwithstanding the benefits of leasing from a limited Thai Company, the Thai company itself must be correctly and legally formed and properly maintained during the lease term, furthermore, foreign investors should ensure that the terms of the lease do not undermine the benefits of leasing from a limited company. For example, any provision in the lease agreement which allows the Lessor to assign its rights under the lease to a third party should be resisted. Even with a Thai company, the principals controlling the lessor Thai company could change, and this could affect the relationship between the parties with respect to the lease.
More Sophisticated Leasehold Structures – “Protected Leasehold” Increasingly, a number of progressive developers in Koh Samui offer a more sophisticated “Protected Leasehold Structure” to buyers in residential developments. In addition to the registered 30 year lease with lease renewal options, the foreign investor is provided with a

share in an offshore company which indirectly owns shares in a limited Thai company which owns the project land of the development and grants the leases to each of the Buyers. This structure allows each of the buyers in the project, collectively, to exercise control over certain important decisions of the land owning company relating to the land, in certain circumstances, allowing the foreign investors to collectively direct the Lessor to grant the lease renewals at the end of each registered lease term. Special care must be taken by the foreign investor to ensure that the offshore company and the limited Thai land owning company are correctly set up in accordance with the relevant law in order for this Protected Leasehold structure to work. Provided this structure is implemented with care and consultation – legal; tax; accounting and with regard to commercial implementation, this can be very effective indeed.

Notwithstanding the potential benefits of leasehold investments, foreign investors and their legal representatives must ensure that the leasehold structure offered is fully compliant with the laws of Thailand and that the proposed terms of the lease do not restrict the investor’s enjoyment of the property unnecessarily. The corporate structure of the lessor should be examined to ensure it works properly with the structure being ‘sold.’ Particular care must be taken to ensure that the lease renewal options are as robust as possible within the parameters of Thai law.
Other Important Provisions of the Lease for Foreign Investors in Koh Samui to Consider The lease agreement must be carefully reviewed by the foreign investor and his legal representative prior to any payments being made. An “investor unfriendly” lease may not only restrict the foreign investor’s enjoyment of the property but may also adversely affect the saleability of the property. For example, any provision of the lease which allows the Lessor to terminate the lease in the event that the Foreign Investor breaches any of the lease terms should be strongly resisted. Further, any clause which requires the Foreign Investor to obtain the Lessor’s written consent prior to carrying out certain acts upon the land should also be resisted, unless there is proper justification for such a clause (such justification may include the Community Rules and Regulations in an apartment or condominium project). Correctly structured leasehold investments can be a secure and viable means by which foreign investors can acquire an interest in real estate in Thailand for a term of years beyond the maximum registered lease term of 30 years. Living on Samui There is a fast growing expatriate community on Koh Samui, with people moving from Europe and beyond to escape the stresses of western life. Thailand is known as one of the most welcoming countries in the world and as Koh Samui has developed over the years it has gradually begun to offer all the comforts of home, but in a tropical island location. Living on Samui is easy; the island now offers a range of excellent locations for shopping, including two large, well stocked supermarkets: Tesco Lotus and Tops. In fact, with all the modern conveniences now available it's sometimes easy to forget you are in Thailand at all. New shopping malls and entertainment centres are on the way, and Western treats like good wine and imported food that foreign residents may have once missed, are now readily available. People who live on Samui enjoy a vast choice for wining, dining and entertainment. Thai food of course abounds, and is both tasty and extremely good value. There is also a huge choice of international cuisine with everything from fine French cuisine to fast food chains. For those who like drinking and socializing, many Western style pubs and clubs not only serve local alcoholic drinks but also offer many favourite international brands. A number of bars also show live international sporting events, so it's possible to enjoy a cold beer in the sun whilst watching your favourite football team play in the cold wind and rain back home. Of course Thailand wouldn't be the same without its people. It is mainly because of their friendly nature that foreign visitors keep coming back and end up living on Samui. Most local people speak a certain amount of English, which means that speaking Thai is not necessary, although life becomes much easier if you do make the effort. Don't expect tobe living an authentic Thai life though; around 80 percent of the population on the island is made up of visitors or expats. Samui is fast becoming a comfortable, sophisticated haven in the sun, but it is also important to remember that there are significant cultural differences that may cause frustration. Local people enjoy a relaxed approach to life, and this can take some getting used to. As long as you are prepared to meet the local people half way, living on their tropical island can be a pleasure indeed.

PERSONAL PROFILE
A Family Affair Robert and Charlotte Honey are the young, dynamic brother and sister team behind a smart new boutique real estate and rental agency on Samui known as Halcyon Properties. Their father, Patrick Honey, is CEO of the recently launched Himmapan Beach resort and Spa project, which is set to transform Samui's northern coast in the next five years, providing the island's first fully comprehensive, multi-functional resort and leisure facility. Samui Phangan Real Estate spoke to them about their company and ambitions. Born in the UK, but raised in Zimbabwe, Antigua and southern Spain, Robert and Charlotte have a broad experience of the world, not to mention a sound knowledge of both the hotel and real estate business based on their father's impressive 30-year career as MD for a number of major hotels and resorts around the world. Returning to the UK to complete their education, Robert completed his tertiary studies, graduating from Dundee University with a M.A Honours in Politics and Spanish, while Charlotte worked in the same city on reservations and at the front desk of the Hilton Hotel. Both have previously spent time in Thailand, so when an opportunity arose to live and work on Samui, they jumped at the chance. "I spent 6 months working as a volunteer with the Father Ray Foundation Orphanage in Pattaya, " said Charlotte. " I learnt a lot about the country and its people, so relocating was a natural progression." Robert, meanwhile, had travelled to Phuket on previous visits and immediately understood the country's appeal. "Thailand is one of the most attractive destinations in the world," he said, "It will always be a popular place for people, whatever their nationality and Samui is only just beginning to fulfill it's potential. It's a great time to be doing business here." Halcyon Properties specialises in exclusive villas and resort developments. is gradually developing beyond its backpacker roots to become a

The Rise Of The Rental Koh Samui, like many places around the globe is bracing itself for the tidal effect of the world economic decline. While the past years have seen a huge increase in expectations with regard to the tourism industry, the sad fact is that many of the tourist related establishments are set for a slow down. The number of hotels rooms available on Samui has seen a staggering 30% increase over the past year alone, adding an extra 13,000 rooms to be filled. As a result, the hotel industry has marked Koh Samui as a prime market in the coming years, but is this viable? Aside from the tourist numbers being on the downturn, it seems that many travellers are looking for an alternative to hotel accommodation. That's why holiday villa bookings are on the up.
According to some of the leading villa management companies on the island, the number of rentals this year has yet to decline. In fact, in many cases they are busier than ever. It seems that holiday rental and long stay rental villas are becoming a primary market for Koh Samui in the general economic climate of today. Samui Phangan Real Estate looked at some of the key players in the villa rental industry to investigate what this means.

He says that a key to this island’s rental achievements may have to do with the plentiful supply of private beachfront villas. These far surpass the numbers found in other holiday destinations around Thailand and even South East Asia. This accomplishment means that people have plenty to choose from, which also means that when they want to return, they have a prime selection. This may be one good reason for choosing Koh Samui, but why are people looking at villa rentals rather than hotels? We have seen some of the most reputable brand 75
names in the tourism industry gambling on the island recently, yet it seems that people are looking towards private villa rental instead. "With a villa, people are assured privacy, personal service, facilities and at the end of the day, it’s more economical," says Marc. Indeed, renting a private villa may seem like an extravagance on first glance, but there are important economic factors to consider. The cost of villas can range from $80 to $2500 per night, and even at the top end this means savings in comparison to a one-room hotel stay if you are looking for value to the Pound, Euro or Dollar. But why?
The Added Value Can a villa really provide more than a hotel? “People want to experience in-house facilities, " said Marc. "They don’t want to have to leave the privacy of their luxury surroundings. A villa provides a relaxed atmosphere with family and friends and the services on offer now can be brought right to them. If they want a chef or a massage, it can be arranged on-site. We create these services and people now expect them. It is a specialty we call our 'concierge' service.” Meanwhile, the numbers of villas, like hotels, is on the increase and this only means more choice for clients. Because of
the prime real estate on Koh Samui, return customers are villa hopping, trying new areas and villa types for variety. “We have clients return 2 or 3 times a year and while some of them request the same villa, often they are looking to try something new," Marc explained. "This is great because of the selection and because of high standard of service we provide at all of our villas, it works out nicely.” If it is top service you’re looking for while in the privacy of your luxury villa, it appears that it is all here. Private management companies now offer such things as private beauticians, flower arranging courses, private drivers, chefs and massage therapists. These are all becoming common 76
expectations from seasoned villa renters and companies are constantly looking for new ways of adding to these impressive services to gain client interest. If you are on the flip side of the rental game, and it is a management company that you require for your villa, there are plenty to choose from. From private villa caretakers to the comprehensive full package including marketing, they are available and shopping around to find what works for you and your property may pay off. Victor Arman has taken on the role of manager to a private villa and explained how his responsibilities differ from large company control. The owners generally ask for matters of the house to be taken into account, as if this was the company's own home. This can mean a multitude of things, from overseeing repairs, maintenance, paying bills, ensuring security and looking after arriving guests. Not to mention anything else the owner may request. “Villa management on this level can be completely designed by the client," he said. "I knew my clients previously, and so the trust was already in place. It works out very well. I am close by, and can be on call if anything goes wrong. I handle whatever my client requests and can add a personal touch to visiting clients who rent the villa. I know the property very well and this is an advantage.� This bespoke service is something that may or may not work for everyone, but does offer a truly individualized service. Other companies are springing up that offer such services, with a personalised approach that includes them accessing email accounts 77
and checking mail. This gives the impression that in the owners' absence, there is nothing left to chance. On the larger scale of property management, some of the most reputable firms on the island now provide such a high standard of service that they have built a strong following of clients. Most offer a number of packages to choose from that will cover most budgets and services can be marketed through trusted methods. With the market heading undoubtedly towards rental yields, it seems likely that the options will expand even further, giving rise to a rental boom that will benefit both the companies and the owners that got in on time.

Choosing a Reliable Agent Whether you choose to live in a gated development, purchase a stand-alone home, or for the even more adventurous, buy a piece of raw land on which to build your future dream house, you will be in need of the services of a good real estate agent. Choosing the right agent is essential as a reputable firm with good local contacts can help you avoid many of the pitfalls that a less informed buyer might encounter. There are now so many different agents on the island, it is difficult to choose between them. Ideally though, your agent should be able to demonstrate a solid background in the industry and offer examples of successful deals they have handled that are similar to your own plans. It is also vital that your agent has good local connections with Thai partners and the authorities. Paperwork and local procedures can sometimes be daunting, but if you have the services of a quality agent with good local knowledge, almost all of the potential stumbling blocks can be swiftly traversed with little or no headaches for you, the buyer. It is vital, for example that you know you are buying or leasing the right type of land. There are various different land titles, the most sought after is the 'Chanote' title. This indicates that the land has been officially surveyed with the use of GPS and its boundaries are now fixed. Be warned that buying land without professional help could mean purchasing what looks like a bargain piece of land that may turn out to be unusable due to the land title. Other pitfalls include road access and the availability of utilities such as electricity and water, not to mention the processing and checking of legal documentation and ownership rights. Once you have found a property, you will have to consider the various purchase options carefully. Foreign individuals may own a property on a renewable 30-year lease, but in the past, many opted to set up a Thai company in order to purchase the property freehold. The latter is less easy than it was a few years ago, but your agent should have a full understanding of both procedures and will be able to explain the pros and cons. Owning a Thai company involves legal and tax issues that you should be well aware of before pursuing this avenue. With so many things to consider, it is easy to see why the services of a good and reputable agent are not just advisable, but essential. By working closely with them to find the solution that best suits your needs, you should enjoy a smooth and painless experience when setting up your new island home.
Building a Property Having a home built to suit your own tastes and needs can be a cost efficient, not to mention rewarding experience. It does take time, patience and energy however, and you need to be absolutely certain that the people you employ to build the property are capable of delivering the house you have in mind.
Once the land is purchased and ready for development, thoughts can turn to the design of your house. Of course, you can be as involved in the design process as much as you wish, from merely requesting certain facilities or features all the way to designing the floor plan in its entirety. Either way, your ideas will have to go through a certified architect in order to ensure the plans are both practical and legal. Many laws exist in Thailand to ensure that buildings do not move too far away from Thai cultural traditions. Once the architect has completed your official plans, your builder, if you have already secured one, should then be able to work out a detailed quote to construct the property to the specifications. When choosing a builder, don't be afraid to ask for references. Some contractors may even offer to take you around some of their previous projects so that you can see the quality of their work and perhaps gain some inspiration for your own home. Several contracting companies are foreign run or employ foreign representatives, which can save time and confusion due to communication problems. It is always good to try and strike up a rapport with the Thai partners and staff too though, as their local knowledge will often prove invaluable. Once you have chosen your contractor, as always make sure your investment is protected by the correct documentation. It would be advisable to have an independent law firm check any paperwork for potential grey areas. If you have ever had a home built in the West, you would have received certain assurances from the building company, including an agreed schedule for completion, a performance bond and a warranty on the finished product. Providing such guaraantees is not always common practice in Koh Samui so the kind of guarantees you are offered should have a significant bearing in your initial choice of construction company. A performance bond is a guarantee issued by the contractor's bank to secure any advance payments you have made. When building on Koh Samui, you will likely need to pay an initial deposit in order for the builder to obtain materials and retain a workforce. Thereafter, you will pay an agreed amount of instalments, which will likely be tied in with certain pre-agreed stages in your home's route to completion. The initial deposit, which could be around a quarter to a third of the total amount, will remain unsecured if no performance bond is issued. In terms of warranty, you should insist on at least twelve months coverage from the completion date. This should be plenty of time for any major building defects to become apparent and resolved at the cost of the building company. With the plans cleared, the paperwork checked and your deposit paid, building can commence. If possible, it is a good idea to make regular visits to your property during the construction phase. This is perhaps the best way to avoid problems or a misinterpretation of your wishes and also means building good relations with the workforce. It will establish your authority as the paying client and seeing your property gradually come together is almost as rewarding as the first night you'll spend in your new tropical home.
Building Regulations on Koh Samui In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page) Stage 1. Land up to 10 Metres from the beach. The law states that no construction is permitted within this area. Stage 2. Land up to 50 Metres from the beach. Within this area you are permitted to construct a single storey building only It's height cannot exceed 6 Metres (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Metres. Stage 3, Land up to 200 Metres from the beach. Within this area you are permitted to build up to a maximum height of 12 Metres (including the roof). The maximum allowed size is 2000 Square Metres. Stage 4. Land located more than 200 Metres from the beach. Within this area, buildings of up to 12 Metres in height (including the roof) can be constructed. Residential Developments There are pros and cons to purchasing a property within a purpose built residential community, as opposed to investing in a stand-alone property or building yourself. One definite advantage is that the complete infrastructure will already be in place when you move in, with electricity, water and access roads provided by the developer. Many communities also have an impressive list of communal facilities, which can include swimming pools, shops and other social amenities. Generally there will also be some kind of onsite management, as well as security for the safety concious. On the other hand, whilst there is often a choice of different designs available on residentail projects, these can be limited and some buyers prefer the thrill of finding a unique style, or building a home to their particular tastes, rather than opting for a more uniform theme. Privacy may also be an issue with some developments placing homes quite close together in order to optimize space. It is up to the individual buyer to weigh up the pros and cons for their particular needs. If developed and managed by a reliable compay, residential communities take a great deal of the stress out of not just purchasing a property on Koh Samui, but also living in and maintaining a new island home thereafter.
Upkeep and maintenance Once you have bought or built your dream home, you will obviously want to protect your investment by ensuring the property is well looked after and cared for. For residents living on Koh Samui full time, this should present no problem, but not every home owner will be living on the island all year round. For these people, a residential community may well be the best option, as they often include maintenance contracts to ensure that the property is well looked after in your absence. Be sure to find out what exactly is covered in the maintenance agreement however, and measure the cost of the service as part of the buying process, so that you don't face any surprises or extra bills later on. Remember that communal facilities in these residential communities must also be well maintained. A clean and well-kept community can only help protect your investment and enhance the development's reputation. If you own a property outside a residential development there are a number of management companies on the island who can offer you a similar kind of maintenance contract whilst you are away. As above, ensure you are fully aware of your coverage and costs before making a long-term commitment.
Risks and Concerns Purchasing a home can often be stressful, not to mention when you are looking to set up a new life in a foreign country. The best way to avoid any problems is to thoroughly research your options before jumping into a major purchase without thinking everything through. Buying a home is exciting, especially when you're talking about a tropical island retreat, but it's important to keep your feet firmly on the ground and youe head on high alert. Explore all of your options thoroughly, whether you are looking for an agent, developer or contractor. If possible, do some research on the companies you're interested in. Can they provide you with references? How long have they been operating? Do they have a sound track record? One of the best ways to research is by talking to people. There are plenty of people already living on the island who have taken the same leap you're now considering. Their advice and opinions could just save you a great deal of time and stress. Whilst common sense will help you avoid many potential pitfalls, it is also advisable to obtain the services of an independent and reputable law firm, before you go ahead with any endeavour. Documents such as title deeds or other legal agreements will need to be translated and checked for you. A reputable law firm can ensure that both the purchase process runs smoothly and that the paperwork involved is efficiently produced and legally sound.

Land Title Deeds in Thailand There are two main types of land ownership in Thailand which we should explain
Rights of Possession Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.
Rights of Ownership Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

Tips for starting a new business Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.
Getting started To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder's meeting to reach an agreement on the purpose of your business and set up the company's operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code's partnership and companies section.
Shares Besides the issues of business registration, you must also make sure that your company's shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company's shareholders. The book is evidence that will identify the company's shareholders.
Shareholders and Chairperson A Limited Company's shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company's rights, such as landownership. If less than 49% of your company's shares are held by foreigners, your company is considered a Thai company. However, if foreign nationals hold more than 49% of the shares, your company is a foreign company.
The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department's staff are now required to thoroughly investigate your Thai shareholders' sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.
Little things that matter A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company's financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company's board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company's business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. Visas and Work Permits I have recently been asked to clarify the way the Thai system works with visas and work permits if you are opening a company here and would like to have a work permit. Firstly I must point out that each Thai province does follow slightly different guidelines and my information does in no way substitute you actually having a legal consultation with a reputable lawyer's company if you actually intend to work. There are those that believe the little they would do in reality would make a work permit hardly worth the trouble. This is a big mistake and one that could cost you more problems than you would believe. The Thai Immigration takes cases of foreigners working without a work permit very seriously and the penalties are harsh. If you are here on a tourist visa you cannot in any way participate in a job. So let's have a look at what's actually required to apply for a work permit. Firstly you need to have a business class visa which in most cases will have to be applied for at a Thai Consulate outside of Thailand. There have recent changes to the system, whereby smaller Thai embassies such as the one in Penang, Malaysia, have stopped issuing multiple entry visas. Initially there were those who whispered that the only way to arrange these multiple entry visas was for the individual in question to return to their home country and obtain the visa from their local Thai embassy. This however had been proved to be incorrect with the embassy in Kuala Lumpur still issuing multiple entry visas until recently, but currently the situation remains in a state of flux with even legal profession als unsure as to the long term guidelines. We therefore strongly advise obtaining up-to-date legal advice well in advance of pursuing your visa run, to ensure you are fully equipped with the documentation currently required for your business visa. Those working in Samui who earn a salary of 50000 Baht per month however, shouldn't have to face these visa run hassles, as they're entitled to a business visa that only needs to be renewed once per annum at an immigration office. Further details of this scheme can be obtained via a legal professional or at the local immigration office in Na-Thon. Either way, once you have the correct visa, you'll be able to apply for or renew your current work permit. Once again there are procedures required for this, which your legal professional will prepare for you. This process might seem tedious, but it is nothing unusual, with every country having its own procedures and legal applications. Thailand is no different and don't be fooled by the laid back and casual attitude of many Thai people on the island, as this is no reflection of the order required in any formal legal requests such as visa or work permit applications. When it comes to legal matters you need to ensure you follow the correct procedure and can produce the appropriate paperwork. Car Insurance, What You Should Know. There are lots of vehicles driving around Thailand that are NOT insured. In the event of a motor accident, If the other vehicle has insurance then you may be able to claim against them. If they don’t you have to rely on your own insurance cover. There are two types of motor insurance cover, Compulsory & Voluntary:Compulsory This is the ‘sticker’ which resides in the top left corner of your car window. It is also what the police initially look for. Most vehicles will have this insurance as it’s very obvious when it’s missing. Voluntary - There are 4 basic types of voluntary cover, Class 1, Class 2, Class 3 & Class 3+. These relate quite well to the UK’s Comprehensive - Third Party Fire & Theft & Third Party Only respectively. There are other important features that you need to ensure are covered correctly in your policy. Bail Bond - This needs to be 200,000 Bt. minimum and is necessary if you should be arrested and detained by the police. Also check that the cover for Personal Accident, Medical Treatment and Third Party Liability are at the levels you require. Named or Any Driver - It may surprise you that in Europe the driver is insured, however in Thailand it’s the vehicle. Naming a driver might reduce the premium but will restrict payout if someone else is in the driving seat when an accident occurs. No claims bonus - It is possible to obtain a discount if you can provide proof of No claims, even from abroad. It pays to shop around or better still get your broker to do the work for you. You should have your old policy to hand when you call your broker to ensure you get the best rate. In all walks of life, you get what you pay for and insurance is no different. The cheapest quotes are not always the best, look for value for money, good cover at a reasonable price. Staging Your Home For A Sale In today’s market, selling a house is not easy - but it can still be done. Here are few ways to improve your chances of doing so both on the inside and outside.
1.
First impressions last. Have a look at the outside of your house and make any repairs or necessary cleanup efforts. Maintain this at all times, as you never know when someone might want to have a look, or may be just passing.

Have a thorough clean of your house inside and out. Clear out anything that looks unkempt such as entranceways and closets. If you have a garden, make sure it is looking trim and tidy. You want potential buyers to look at a home, not the mess. 122
3. If you are currently living in the house,
consider packing away or storing personal items. This may be most important if you have any religious or political items. People want to imagine themselves in the home and this can distract from them from doing so.
4.
Clear all counter space or shelves. Leaving the bare essentials, put any personal items, toothbrushes, lotions, salt and pepper in a hidden place.
5. Tone down any personal dĂŠcor.
Strong colours and art may not be to everyone’s taste and should be avoided when selling a house. Studies have shown that buyers are more likely to buy a house that has little personal influence, again something that they can easily visualise themselves in.
6.
Think about your target demographic and what may be appealing to them. If you think your house is more of a family home, make sure it is a safe for children.
7. If you have pets, make sure there is no
evidence of them when people are visiting. Odours and pet stains or hair will put buyers off especially if they have an allergy.
8.
Get the lighting right. Open blinds and curtains when photographing or showing your property. If you have special lighting features, make sure to highlight them.
9. Look at your furniture. If it is in need of
updating, consider removing it or hiring new sets. Some furniture companies will allow for rental, this is a great way to spruce up a home. Ask an interior decorator to come and take a look at your house for any suggestions for improvements, even if they are temporary. It may be worth it.
10. Make sure your house is clean at all
times. Keep it in order, as if you are expecting someone to come at any time.

Fruits of Labour

If anything typifies the Thai traditional garden it would be the presence of fruit trees. With more emphasis usually placed on practicality than ornamentation, the informal Thai garden is commonly made use of for its edible assets. Although it’s difficult to find very much written on the subject of traditional Thai garden style, historical art often depicts the use of fruit trees, especially mango, in domestic settings, suggesting that this has long been the case.
Commercially grown fruit most often hails from the Northern and Eastern regions of Thailand, where fruit farming for the export and domestic markets accounts for the vast majority of employment. This is partly due to both climate and geography. In the South and the Islands, the sea claims the highest percentage of occupational commitment, with the remaining agricultural share accounted for mainly by rubber and oil palm farming. The soil is generally too acidic for large scale rice and vegetable production in the region. This aside, some species of fruit will thrive on the island and can be helped along with a little cultivation of the soil. Your efforts will be rewarded by the satisfaction gained in eating fruit from your own garden and the enjoyable anticipation as the season ripens. Pineapple The plant itself has an unruly appearance with long, waxy, thin leaves lined with murderous spikes. Not a great plant for those with young children. The fruit grows on a stem from the centre of the plant and flowering occurs cyclically. The plant has a relatively short productive life of between twelve to thirty months. Miniature species of pineapple are now available in many nurseries and a red variety is free from spikes. The fruit of these small species is inedible but quirky looking.

Mango Statistically, mangos beat apples, oranges and bananas as the worlds most consumed fruit. Referred to, not just in Thailand but throughout South East Asia and the Indian sub-continent as ‘the king of fruits’, the mango is a revered fruit, often symbolically entwined in local legend or religion.
Star fruit
The mango tree is a substantial and impressive specimen with a thick trunk and distinctive foliage. There are many varieties of size and flavour found locally from the small, sour, green variety to the large, juicy, sweet yellow variety. Mango makes a great shade tree and has a productive life of up to 50 years.
With several varieties, the fruit flavour ranges from acidic to sweet. Trees grown for commercial and landscape usage in Thailand are often of the sweet variety of which there are several differing types. It’s possible to obtain these trees at a very mature size as they develop very well with their roots balled. Certainly one of the more aesthetically desirable fruit trees, the star fruit has a productive life span of up to 40 years.
Banana
Papaya The papaya plant may not appeal to everyone’s tastes for either its flavour or its looks but it does serve as an integral part of Thai culture and cookery. The papaya is not actually a tree but a herb by classification and boasts as high a content of vitamin C as an orange. Lime The common Thai variety of limes are produced by coarse, thorny, shrubby trees which can actually reach heights of over 4 metres. These can be either planted out or kept as a pot plant in plenty of sunshine.The world’s most widely consumed citrus fruit is a very useful plant to have in the garden and potted specimens are available for purchase in many local nurseries.

For Western nationals, the banana is by far the most popular and imported tropical fruit. Like the papaya, the banana is a herb by classification. Producing large amounts of fruit and an edible flower, the plant grows prolifically and with no effort from the gardener. In fact, controlling its will to take over is where the growers attentions are focused. Its unruly nature and rather scruffy appearance, make it more suitable for out of view areas or if properly maintained can be used for screening. From a landscape design perspective, fruit trees of certain species can provide a desirable and functional component to a domestic garden space with the potential yield adding an element of life and expectation. Selecting a fruiting plant or tree should be based entirely upon personal taste and suitability of location.
HOME MAINTENANCE
Plumbing Lessons If learning lessons about maintenance the hard way is the one most readily taught, then maybe its time to think ahead. Many of the niggling jobs that need to be done around the house can be made into routine rituals and can make costly repairs avoidable. A good rule for homeowners is to get to know your house. This education may be most important in terms of your plumbing among other things. Most people take for granted the fact that the plumbing will always work smoothly until something goes horribly wrong. This may come by way of a leak or overflowing toilet. When this happens, you may quickly realize the value of knowing where to shut off the supply. Knowing and teaching your family members and house caretakers too is very important. Show your kids, babysitter and grandparents. It may be a good idea to include this information on an emergency guide that is clearly displayed somewhere in your house.
If you don’t already know your plumbing lines, make a diagram. It can come in handy if you need to do repairs yourself or hire someone to come in to repair things for you. Have a reputable plumber’s number available in case of emergency. Find the source of problems such as a leak or overflow. It may seem obvious, but many people who come to visit may not know the extreme sensitivity of plumbing systems in Thailand and may need to be made aware of what NOT to flush down the loo. Emphasize precisely what can and cannot be put into your system. Drainage systems and electric disposals are meant for specific matter and

water. Putting anything other than what is intended to go into such drains will cause problems. Anyone driving along the Ring Road during rainy season may have noticed what can happen otherwise! Even with electric disposals, fibrous vegetables such as asparagus and celery can cause a backup and should be avoided. Never put any meat, fat (solid or liquid) down any drain. Consider composting leftover vegetables, this can be easily implemented and drains or disposals should never be used as a replacement. NEVER put any hazardous materials down any drains, this includes paints, insecticides or solvents. This may end up in the ground water or could end up in the sea or rivers around Samui poisoning plant, animals, marine life and people. Think before you dump. Another issue to consider with plumbing systems on Samui, especially in the dry season, is the “root� problem. This is important because trees and shrubs tend to gravitate towards a source of water. Any pipes that may have a leak are particularly susceptible. Over time, the roots can grow causing the breach to widen and can be a major and expensive problem. A good way to maintain drains without chemicals to ensure there is little or no blockage is the most basic method applied by plumbers. Using a long hose and two people, point the hose down the drain and seal the drain and hose with a rag at the closest point to the drain, slowly build up the pressure and let run for a few minutes. Be sure to have a clear method of communicating with the second person before beginning the process! Anyone who has experienced any time without a viable water source will tell you, applying these small plumbing practices is well worth the effort.

"What do you predict our occupancy is likely to be?" "What is the return on my investment likely to be?" These are frequently asked questions put to developers or agents, though not easily answered given the complexity of factors which determine an owner's net income. Leaving aside political unrest, the increases in oil prices, hikes in air fares and the global 'credit crunch', which are beyond our control, here are some 'Fact not Fiction' considerations.
The villa is on or near to the beach It has a good sea view A private pool It looks great It is realistically priced There's good management in place (if the customers have a positive service experience, they'll want to return year on year!) What doesn't help: The rates are uncompetitive The road leading up to the villa is too steep It's poorly maintained No swimming pool Too far from the beach or shops Low specification Given the large number of completed villa projects on the Island, it is perhaps not surprising to note the diverse range of private villas advertised for let, which means greater choice for the holiday maker or long-term resident. Holiday makers, who choose to arrange their own accommodation and flights, normally do the research and explore the numerous possibilities on the internet, making several enquiries whilst trying to negotiate the price down. This can sometimes mean that as an owner, if you're not flexible enough on pricing, you're going to lose out to another similarly priced villa that may even be next door to you. Before deciding to let your villa, you'll need to calculate what the outgoings are likely to be and whether it is worthwhile to you. Being thorough is essential if you want to establish an accurate net income figure. This is particularly important if you're going to rely upon the income to repay money you've borrowed in order to buy the villa. If you are a potential owner, it's essential to note that figures like 6% or 8% return will be banded around by the seller
like confetti, as if to celebrate your marriage to the villa and the financial rewards from rental that will follow in subsequent years. Regardless of whether or not these figures are accurate, and quite frankly nobody has a crystal ball, who can blame any seller wanting to paint a glossy picture in order to seal the deal. If all you want to do is cover your outgoings and finance keeping the villa in good condition, then this is certainly achievable. In fact, this is perhaps the right reason to let. However, if you're going to borrow money to pay for the villa then rely upon the income from letting to repay the money, then this is not a good starting point and you'll need to look very carefully at the figures. Unique Phangan Koh Phangan has always attracted what most would consider a more alternative crowd and the island is also becoming a more permanent host to visitors, with residential developments beginning to spring up on the beaches and mountainsides. It may be the unique stream of visitors that has lead some developers on Koh Phangan to look at more forward thinking ways of appealing to potential investors, but is also undoubtedly the unique nature of the island’s environment. The island prides itself on its less than modern atmosphere, and many things such as seafood, transportation, accommodation and souveniers, are cheaper than on the other more developed islands. Koh Phangan offers a suprising variety of attractions and activities for all types of tourists. An island that was once considered the 'back-door escape' from Samui, has now established itself as a destination in its own right. Regular boat and ferry services take thousands of people to Koh Phangan and places of interest include four, year-round waterfalls, a cave temple situated near a typical Thai village and some fabulous offshore islands. Several new restaurants have opened in the last year on Koh Phangan and are doing very well. The island now boasts Thai, Thai fusion, Italian, Indian and even Swedish cuisine. All these new restaurants are part of a general shift up-market, which is driving both the tourism and property markets. Meanwhile the local government is planning a beautfication programme for the island’s roads and a campaign to re-inforce Koh Phangan’s appeal as a natural destination.

Property on Koh Phangan Baan Tai village characterizes the original atmosphere of this unique location in the Thai Gulf with its narrow winding footpaths and old Chinese architecture. The village front faces a sandy beach, and is nestled against a lush green tropical hillside with footpaths that meander like a labyrinth up through the village and into the surrounding jungle. A more contemporary version of the island can be found at places like Sitara Village and Tong Nai Pan Estates, both low-density projects aimed at buyers who are environmentally concerned about the future. Such low-key residential projects have been doing very well on Koh Phangan, even without excessive marketing. They include many eco-alternative features to standard built housing, including solar power options, compulsory water containment, organic waste treatment as well as tree preservation and even a community centre directed at involvement in environmental awareness and island issues. In addition to the above projects, new residential develpments are now happening around the island in Haad Salad, Chalobaankao and Ban Kai. These developments will be like nothing Koh Phangan has previously seen. All of the developments will include full infrustructure and properties are expected to be offered at half the price or less then comparable residences on Koh Samui. With such higher scale developments and new upscale restaurants and resorts making their presence felt in the market, locally based property professionals believe that the benchmark is already being set with regard to future development. The developers of these projects hope to learn from the mistakes that have been made in other parts of Thailand and say they will preserve the natural beauty of Koh Phangan, while building quality, eco-friendly homes for a new type of conscious investor.

Efficient Ways To Deal With Climate Change Climate change – two words which have begun to intrude more and more into our lives, whether we like it or not. The world scrabbles to find ways to lower carbon footprints and searches for new types of fuel. Although governments and companies are focusing on the long-term, we shouldn’t forget what we can do in the meantime. Energy efficiency is being touted as the answer, at least in the short term, and is something which not only industry, but small businesses and individuals can contribute to. Although Thailand has not embraced a lot of the energy saving options that have been adopted in the West as a matter of course, there are movements afoot, and no more so than on the islands in the South, where expatriates and Thai’s alike are finding innovative methods of consuming less energy more efficiently. There is a difference between energy conservation and energy efficiency, even though many people use the two terms interchangeably. Energy conservation is any behavior which results in the use of less energy - such as turning off lights when not in the room – whereas energy efficiency is about the use of technology that requires less energy to perform the same function. A common example of the latter would be using energy efficient light bulbs, which use up to 80% less energy and last for months at a time.

Solar, wind, biomass, biogas, hydro, biofuels, geothermal and fuel cells are all included in their strategic plan, and education on energy efficiency has been highlighted. However, they are fighting an uphill battle as the market for energy efficient products is still immature. Demand is being cultivated by industry educating the market and demonstrating the benefits, but the cost for many consumers is still prohibitive as the cost of a normal 60 watt

light bulb is still usually less than one third the price of a long-life fluorescent bulb. The choices we make when using energy will have an increasing impact on the quality of our environment and lives. Research is being undertaken on how to slash the prices of energy efficient products and how to encourage consumers to invest in them, for long term economic benefits as well as environmental reasons. More education needs to be undertaken in order to make the advantages clear to consumers. Island inhabitants need to remember that energy efficient measures are currently the most reliable, cheapest and environmentally friendly source for their daily requirements and the best way to help the planet.

NEW ROUTES FROM MALAYSIA Firefly Airlines plans to launch a code share agreement with Malaysia Airline this year, which would bring more people to Samui using Malaysia Airlines from Kuala Lumpur International Airport. The budget airline opened a direct flight from Samui to KL in October last year and it has proved a popular option for travellers. Firefly is is also reportedly looking at the Middle East to open more routes to Samui, especially for weekend breaks, which would boost tourism at a time when visitor numbers from Europe sre down. On domestic routes, Firefly also recently added more destinations to its network, launching a new twice-daily flight to Kerteh in Terengganu, Malaysia. MD Eddie Leong says the airline is committed to providing alternative, affordable travel both for Malaysians and international visitors.
